Good evening. A Wiltshire man who wants a doctor | :00:53. | :00:57. | |
to be able to end his life lawfully has won the right to have his case | :00:57. | :01:00. | |
heard in the High Court. Tony Nicklinson from Melksham suffers | :01:00. | :01:03. | |
from locked-in syndrome which means his body is paralysed, but his mind | :01:03. | :01:08. | |
is unaffected. He says it is intolerable not having a way out | :01:08. | :01:10. | |
and sums up his life as "dull, miserable, demeaning and | :01:10. | :01:19. | |
undignified". Alice Bouverie Tony Nicklinson has suffered every | :01:19. | :01:24. | |
day for the last six-and-a-half years. You can't do anything -- he | :01:24. | :01:27. | |
can't do anything for himself. Everything has to be done for him. | :01:27. | :01:31. | |
If he has a scratch, someone has to itch it for himpm. Known as Royals | :01:31. | :01:35. | |
to his friends, he was a former rugby player and daredevil, but | :01:35. | :01:39. | |
since suffering a stroke in 2005, he has been unable to move from the | :01:39. | :01:42. | |
neck down. Only able to communicate through a | :01:42. | :01:47. | |
letter board and his computer. By looking at him, I know what he | :01:47. | :01:51. | |
is thinking a lot of the time and it is, life is hell for him really. | :01:51. | :01:56. | |
It is not going to get any better. Although Jane says Tony doesn't | :01:56. | :02:00. | |
want to die tomorrow, he wants to know he has a way out when he can't | :02:00. | :02:04. | |
take it anymore. What is different about this case, it isn't assisted | :02:04. | :02:08. | |
suicide. Tony Nicklinson isn't in pain and he is not dying, but he | :02:08. | :02:13. | |
wants a doctor to end his life and not fear prosecution for murder and | :02:13. | :02:17. | |
he wants that defence to be under the common-law of necessity. | :02:17. | :02:20. | |
Necessity because it is Tony Nicklinson's own way of ending his | :02:20. | :02:23. | |
suffering. The Ministry of Justice wanted the | :02:23. | :02:27. | |
case thrown out, arguing that needing to kill someone can never | :02:27. | :02:32. | |
be a defence to a charge of murder. But today a judge ruled the case | :02:32. | :02:35. | |
can proceed. This was Tony's reaction. | :02:36. | :02:40. | |
I'm delighted that the issue surrounding assisted dying are to | :02:40. | :02:49. | |
be aired in court. Outside the High Court, the Nicklinson's solicitor | :02:49. | :02:54. | |
argued if the law was change people didn't need to fear it. Cases would | :02:54. | :02:56. | |
be considered on an individual basis. | :02:56. | :03:01. | |
This Is a case where the court would have to authorise in advance | :03:01. | :03:07. | |
any such step to be taken. The court already does so in cases | :03:07. | :03:11. | |
involving the withdrawal of nutrition and hydration. So the | :03:11. | :03:15. | |
courts are well used to dealing with those cases so it is not a | :03:15. | :03:17. | |
case of the floodgates being opened at all. | :03:17. | :03:21. | |
Such are the implications of this case, it is likely to go all the | :03:21. | :03:26. | |
way to the Supreme Court. Tony and Jane Nicklinson's daily nightmare | :03:27. | :03:36. | |
Well, with us now to discuss some of the issues is Timothy James, a | :03:36. | :03:39. | |
Senior Lecturer in Law and Medical Ethics at Birmingham City | :03:39. | :03:44. | |
University. Thank you for joining us. The law here is 50 years old | :03:44. | :03:49. | |
and in that time medical science improved. Is it time for a re- | :03:49. | :03:55. | |
evaluation? The law is more than 50 years old. It is over 200 years old. | :03:55. | :04:00. | |
What Mr Nicklinson's lawyer is arguing is the defence of necessity | :04:00. | :04:07. | |
should be available to a doctor who killed Mr Nicklinson. Now until | :04:07. | :04:10. | |
2000 there was no defence of necessity and then we had the | :04:10. | :04:13. | |
conjoined twins case and for the first time the law recognised the | :04:13. | :04:17. | |
defence of necessity in killing specifically for the conjoined | :04:17. | :04:23. | |
twins. Now, 12 years later, somebody wants to broaden that | :04:23. | :04:26. | |
exception and this is the way the law goes. The question is whether | :04:26. | :04:31. | |
it is going in the right direction. What are you worried about then? | :04:31. | :04:36. | |
Well, many of the issues, of course, were anticipated by his solicitor. | :04:36. | :04:40. | |
She said there was absolutely no risk of the opening of floodgates | :04:40. | :04:45. | |
and I think that is unrealistic unrealistic. She gave the example | :04:45. | :04:53. | |
of people who have, who are being fed through a tube and who are | :04:53. | :04:58. | |
unaware and the court is asked to approve this being withdrawn. When | :04:58. | :05:03. | |
this was first considered in Tony Bland's case in 1993 it was highly | :05:03. | :05:07. | |
controversial and received a detailed looking at. Now, it is | :05:07. | :05:11. | |
fairly systematic. You know which forms to fill in and it is | :05:11. | :05:15. | |
straightforward. You can guarantee what the outcome will be. | :05:15. | :05:18. | |
But Tony Nicklinson's argument is he should have the right to take | :05:18. | :05:22. | |
his own life and he doesn't because he can't do it himself? No, his | :05:23. | :05:25. | |
point is that he should have the right to have somebody else kill | :05:25. | :05:32. | |
him. He does have the right to take his own life, but... But he doesn't | :05:32. | :05:37. | |
have the the ability to do that and that is his problem. The law draws | :05:37. | :05:40. | |
a bright line between the two. It says we can't stop you killing | :05:40. | :05:44. | |
yourself, but in practise somebody who prevents you from committing | :05:44. | :05:51. | |
suicide won be criticised for that, but that crossing the line to | :05:51. | :05:54. | |
deliberately killing somebody because they want to die is too far. | :05:54. | :05:59. | |
I think that is right. I think those who say there is no slippery | :05:59. | :06:02. | |
slope haven't looked at the history of the last 30 years. | :06:02. | :06:08. | |
The trial has begun of a Bath newsagent who went on the run 12 | :06:08. | :06:12. | |
years ago after being accused of sex offences against teenage girls. | :06:12. | :06:15. | |
Lewis Knight, now 60, disappeared in 2000, but last year he was | :06:15. | :06:20. | |
tracked down in Spain. Today, he faced 11 allegations including four | :06:20. | :06:30. | |
:06:30. | :06:31. | ||
The jury heard how Lewis Knight ran what was then a newsagent's shop, | :06:31. | :06:34. | |
but is now a general stores here in Mount Road, Whiteway in the late | :06:34. | :06:37. | |
1990s, but he used his position to assault and rape his victims some | :06:37. | :06:45. | |
as young as 13-years-old. In 1999, Lewis Knight a Spanish national who | :06:45. | :06:48. | |
had married a British woman was charged with seven counts of sexual | :06:48. | :06:52. | |
abuse. But despite surrendering his passport, he obtained a replacement | :06:52. | :06:55. | |
from the Passport Office, jumped bail and failed to turn up for his | :06:55. | :07:02. | |
trial at Bristol Crown Court. He went on the run to Spain and | :07:02. | :07:06. | |
disappeared from sight. But last August members of Avon and | :07:06. | :07:09. | |
Somerset's Cold Case team tracked him down to the remote village of | :07:09. | :07:13. | |
Torres de Segre near Barcelona. He was later extradited back to the UK | :07:13. | :07:17. | |
in September after a court appearance in Madrid. Prosecuting, | :07:17. | :07:19. | |
Andrew MacFarlane, told the court how Lewis Knight inexplicably took | :07:19. | :07:28. | |
advantage of the young girls. He explained how the defendant groomed | :07:28. | :07:31. | |
the girls before taking them down into the cellar where he raped and | :07:31. | :07:35. | |
indecently assaulted them. The jury were told how he used his position | :07:35. | :07:38. | |
of manager of the shop to approach the girls who either did paper | :07:38. | :07:41. | |
rounds or worked with him in the shop. Three victims who were | :07:41. | :07:44. | |
between 13 and 15 have given interviews to the police, | :07:44. | :07:48. | |
describing how humiliated and terrified they were. One said she | :07:48. | :07:53. | |
that at the time she just couldn't tell her mother she had been raped. | :07:53. | :07:56. | |
The former newsagent denies four charges of rape, six of indecent | :07:56. | :08:04. | |
Gloucestershire County Council's dealings with the now defunct | :08:04. | :08:08. | |
Cotswold Water Park Society have been revealed today. Last year, the | :08:09. | :08:11. | |
chief executive of the society, Dennis Grant, was jailed for | :08:11. | :08:13. | |
defrauding it of over �600,000, prompting an inquiry into the | :08:14. | :08:23. | |
:08:24. | :08:25. | ||
council's involvement with him. Dennis Grant was the public face of | :08:25. | :08:29. | |
the water park scanned 85, but following accusation that senior | :08:29. | :08:33. | |
council officials were in cahoots with him, the county council set up | :08:33. | :08:36. | |
an independent inquiry. Today the author delivered his verdict. No | :08:36. | :08:41. | |
officers acting illegally, but the report did find the council failed | :08:41. | :08:47. | |
to properly scrutinise a deal that Dennis Grant did to lease the | :08:47. | :08:51. | |
Kenyes Country Park to another company. The council failed to deal | :08:51. | :08:55. | |
with complaints made to it about the agreement. Secret evidence has | :08:55. | :08:58. | |
been uncovered that's been passed to the police who are investigating | :08:58. | :09:03. | |
the water park scandal. The district councillor who sees | :09:03. | :09:06. | |
getting to the truth as a personal crusade says the report is just the | :09:06. | :09:10. | |
start. This is not about drawing a line | :09:10. | :09:14. | |
under a pretty sordid period in the water park's history. This is about | :09:14. | :09:21. | |
bringing people to account, well paid public servants, to account | :09:21. | :09:24. | |
and getting to the truth and I don't think we're there yet. | :09:24. | :09:28. | |
The county council admits mistakes were made in its dealing with the | :09:28. | :09:30. | |
water park society and promised things will change. | :09:31. | :09:34. | |
Clearly there were a number of failings within the internal | :09:34. | :09:37. | |
systems and I think that's just not good enough for a public | :09:37. | :09:40. | |
organisation like ourselves and it doesn't meet the standards that | :09:40. | :09:42. | |
local residents would expect from that. | :09:42. | :09:46. | |
The the author of the report says the council has a real opportunity | :09:46. | :09:50. | |
to avoid mistakes of the past. It is very important in terms of | :09:50. | :09:55. | |
what the council can learn for its future approach for example, in | :09:55. | :09:59. | |
handing over libraries or youth centres or other things like that | :09:59. | :10:02. | |
which are on a bigger scale and would affect more people. There is | :10:02. | :10:06. | |
a long way to go. There is a theme of optimism running throughout this | :10:06. | :10:10. | |
report. A chance, of course, to put the wrongs right, but maybe to | :10:10. | :10:14. | |
start again. A chance for the water park to achieve its vision that was | :10:14. | :10:19. | |

and she had not been on an an intensive care ward. As a | :12:45. | :12:48. | |
registered nurse for patients with learning difficulties, Violeta | :12:48. | :12:53. | |
