was arrested after he confronted two men who were stealing diesel from | :01:53. | :01:56. | |
his yard near Abergavenny. One of the men suffered two broken legs and | :01:57. | :02:01. | |
a broken arm. Tonight his MP says the case should never have gone to | :02:02. | :02:05. | |
court. Jenny Rees reports. Ten months ago Andrew Woodhouse | :02:06. | :02:08. | |
received a text alert, his groundwork business a mile away had | :02:09. | :02:13. | |
been broken into. And not for the first time. He'd previously had | :02:14. | :02:16. | |
around ?20,000 of goods taken, nearly costing him his livelihood. | :02:17. | :02:26. | |
What makes this burglary different is Andrew confronted the eaves of 20 | :02:27. | :02:30. | |
attack him with a fence post he fought back. | :02:31. | :02:32. | |
Kevin Green received a broken arm and leg and fell breaking his other | :02:33. | :02:36. | |
leg. Andrew rugby tackled Timothy Cross and held him down until the | :02:37. | :02:42. | |
police arrived. The businessman was then arrested and charged with | :02:43. | :02:45. | |
grievous bodily harm with intent. Yesterday a jury took 20 minutes to | :02:46. | :02:52. | |
find him not guilty. They look back over these last ten lengths thinking | :02:53. | :02:56. | |
they would have done things differently, but I couldn't. Unless | :02:57. | :03:02. | |
they would have got away and not be seen again. They would've come back | :03:03. | :03:07. | |
next week and then it all again. It would have been another financial | :03:08. | :03:14. | |
loss. Yes, I don't think we could take it. There are now cause for | :03:15. | :03:21. | |

each charged with theft and given ?75 fines. | :04:27. | :04:30. | |
Earlier I spoke to the legal commentator, Joshua Rozenberg. I | :04:31. | :04:34. | |
began by asking him what the law says about cases like this. | :04:35. | :04:43. | |
The law says you can use reasonable force to defend yourself, your | :04:44. | :04:46. | |
family and your property. Reasonable force could be great force indeed. | :04:47. | :04:50. | |
You could use lethal force if necessary. You don't have to wait | :04:51. | :04:57. | |
for people to attack them. It has to be reasonable in the circumstances. | :04:58. | :05:00. | |
The prosecution argued if somebody is dealing jerry cans of diesel | :05:01. | :05:05. | |

somebody gets badly hurt when somebody is defending their | :06:00. | :06:04. | |
property. Mr Woodhouse's defence lawyer has asked the CPS to review | :06:05. | :06:11. | |
procedures. How likely do you think that is to happen? I think they will | :06:12. | :06:14. | |
bear this case in mind when another case comes up of somebody who has | :06:15. | :06:18. | |
used apparently excessive force and they realise how sympathetic Julie | :06:19. | :06:25. | |

that an application has been lodged to appeal against the length of that | :07:23. | :07:26. | |
punishment. That was done two days ago. South Wales Police are | :07:27. | :07:29. | |
continuing to investigate whether Watkins also committed offences in | :07:30. | :07:32. | |

at the curriculum as a whole we all know it is incredibly challenging to | :16:26. | :16:28. | |
include every aspect of the curriculum. Across Wales, courses | :16:29. | :16:37. | |
like this one teach children the basics and now that our course to | :16:38. | :16:40. | |
make sure every primary school offers a foreign language. Learning | :16:41. | :16:46. | |
any language and as many as you can early can reinforce these skills and | :16:47. | :16:52. | |
