Good evening. A Sussex doctor has described as inhumane and barbaric | :01:08. | :01:12. | |
the treatment of a cancer victim who is being forced to undergo a review | :01:13. | :01:17. | |
of his fitness to work. 60`year`old David Cole from Bexhill, who has | :01:18. | :01:20. | |
lung cancer, heart disease and cirrhosis of the liver, has been | :01:21. | :01:23. | |
told his entitlement to benefits will be reviewed. This move comes | :01:24. | :01:26. | |
despite a tribunal ruling earlier this year that he was unfit for work | :01:27. | :01:33. | |
and would never be so. The Citizens Advice Bureau claims his case is | :01:34. | :01:37. | |
just the tip of the iceberg. Colin Campbell has our exclusive report. | :01:38. | :01:47. | |
David Cole has osteoporosis, diabetes, cirrhosis of the liver and | :01:48. | :01:52. | |
heart problems. He has depression and is recovering from cancer after | :01:53. | :01:57. | |
having a third of a lung removed. With help from his wife, he takes 24 | :01:58. | :02:02. | |
tablets a day, five injections of insulin, and despite this he was | :02:03. | :02:06. | |
assessed as being fit for work. It has been traumatic. In the respect | :02:07. | :02:12. | |
that... You have to... Keep trying to prove | :02:13. | :02:26. | |
to them that you are ill. Employment and support allowance is a new | :02:27. | :02:30. | |
benefit introduced in 2008 for those who are not able to work due to | :02:31. | :02:34. | |
disability or illness. It replaced incapacity benefit, and from 2011 | :02:35. | :02:39. | |
onwards those claiming incapacity benefit have been reassessed and | :02:40. | :02:43. | |
moved on to ESA. Under the new system, claimants have to undergo a | :02:44. | :02:48. | |
work capability assessment, which for many has involved a face`to`face | :02:49. | :02:53. | |
assessment, worked contract it to a French company. But a tribunal | :02:54. | :02:57. | |
review told David he should not be reassessed ever again. But then he | :02:58. | :03:02. | |
received another letter from the DWP, saying he needed to attend a | :03:03. | :03:09. | |
medical assessment. It has been a pain in the neck, it has caused me | :03:10. | :03:14. | |
quite a lot of anger at times. In a letter listing David's conditions | :03:15. | :03:20. | |
and numerous medications, is GP describes the treatment as | :03:21. | :03:23. | |
inhumane. The ads, it is not the first example, even in our own | :03:24. | :03:29. | |
practice, this barbaric activity. This has been an unnecessary process | :03:30. | :03:32. | |
which has been quite distressing for him. It is somewhat inhumane. Dozens | :03:33. | :03:38. | |
advice bureau say they have helped over 100 people in East Sussex who | :03:39. | :03:45. | |
have been wrongly assessed as fit for work. `` Citizens Advice Bureau. | :03:46. | :03:52. | |
It is very clear that these people have long`term conditions, and it | :03:53. | :03:55. | |
does not seem possible that they should be expected to be looking for | :03:56. | :03:58. | |
work or even be expected to go back into paid work. It has left me | :03:59. | :04:08. | |
feeling like the Government is more interested in figures than people. | :04:09. | :04:15. | |
The Department for Work and Pensions say they are committed to helping | :04:16. | :04:18. | |
people move from benefits into work if they are capable, while giving | :04:19. | :04:22. | |
unconditional support to those who need it. David feels he has received | :04:23. | :04:28. | |
no support and feels the Government not listening. | :04:29. | :04:30. | |
Well, we asked the Department for Work and Pensions if we could speak | :04:31. | :04:33. | |
to a minister about David Cole's case, they told us no`one was | :04:34. | :04:37. | |
available. But Colin joins us in the studio. What have they told you? | :04:38. | :04:42. | |
Yes, they say that the letter that was sent to David Cole, they admit | :04:43. | :04:46. | |
that the letter requesting him to undergo a further medical assessment | :04:47. | :04:50. | |
was a mistake. David Cole has received an apology for that | :04:51. | :04:54. | |
letter, which the DWP ad mitts must have caused in distress. | :04:55. | :05:00. | |
Interestingly, David Cole, described by his GP as someone who is unfit | :05:01. | :05:04. | |
for work, must still undergo a further assessment in three years. | :05:05. | :05:10. | |
Mr Kohl has already been given the date for that assessment. The DW PE | :05:11. | :05:14. | |
has already also told me that the tribunal service do not have the | :05:15. | :05:19. | |
power to say someone should not be reassessed, as was the case in this | :05:20. | :05:26. | |
case. How is the Government defending this? The Government say | :05:27. | :05:31. | |
this is about getting people into the workplace if possible, they say | :05:32. | :05:37. | |
that the policy involves regular reassessment as health issues and | :05:38. | :05:43. | |
conditions change over time. The Government say only a small | :05:44. | :05:45. | |
proportion of the decisions are overturned on appeal. Citizens | :05:46. | :05:53. | |
Advice Bureau say 80% of the people they have seen are having appeals | :05:54. | :05:56. | |
overturned. A Sussex care home for dementia | :05:57. | :05:59. | |
patients is under investigation after complaints from the relatives | :06:00. | :06:03. | |
of its residents. Conditions at the Bramber care home in Peacehaven are | :06:04. | :06:07. | |
being looked at by both the Care Quality Commission and East Sussex | :06:08. | :06:11. | |
County Council. Mark Sanders is in Peacehaven for us now. Mark, what | :06:12. | :06:19. | |
has triggered this inquiry? Well, we can reveal tonight that two | :06:20. | :06:23. | |
separate complaints were made about this care home, a care home which | :06:24. | :06:27. | |
caters for about 20 people with dementia type illnesses, and that | :06:28. | :06:31. | |
was the trigger for what the county council calls a safeguarding | :06:32. | :06:35. | |
investigation which it expects to conclude in the New Year. All this | :06:36. | :06:41. | |
follows a recent report by the care watchdog, the seat you see, into the | :06:42. | :06:45. | |
home, which said a number of improvements have to be made. `` the | :06:46. | :06:47. | |
CQC. It is also worth stressing that the | :06:48. | :07:03. | |
CQC found that the staffing levels here were adequate. Has there been a | :07:04. | :07:08. | |
response from the care home today? We did approach the care home for a | :07:09. | :07:12. | |
comment, and someone who would not give their name but said they were | :07:13. | :07:15. | |
the manager, not the owner, said they had nothing to add to what the | :07:16. | :07:19. | |
county council has been saying today. The county council stresses | :07:20. | :07:22. | |
there has been a recent change in ownership here and stresses that | :07:23. | :07:26. | |
some of the issues raised may predate the current management. | :07:27. | :07:30. | |
In a moment, the way is cleared for a ?2 billion theme park in Kent as | :07:31. | :07:34. | |

Stewart, who has been leading a campaign against legal highs after | :09:21. | :09:25. | |
her daughter died in 2009. It is something we have been waiting for | :09:26. | :09:28. | |
for an awfully long time, and it makes a change from feeling as if we | :09:29. | :09:34. | |
are a voice in the wind. The Government have not to date, as far | :09:35. | :09:36. | |

options, a second crossing at Dartford or one east of Gravesend. | :13:26. | :13:31. | |

delays in the country. The Government is convinced of the need | :13:37. | :13:40. | |

exciting development potential projects down that particular | :13:54. | :13:56. | |
peninsula. The theme park would be around the same size as Disneyland | :13:57. | :14:00. | |

could create 27,000 jobs and open in 2019, but it had been in doubt | :14:15. | :14:17. | |
before the announcement. Would you like to go on holiday to a | :14:18. | :14:19. | |
world`class resort with a motorway flyover across the side of its? The | :14:20. | :14:22. | |
answer is no, so that is a concern to us. In Swanscombe, many are | :14:23. | :14:26. | |
relieved. If it means more investment and less traffic, I | :14:27. | :14:30. | |
cannot see how that is a bad thing. If it brings people to this corner | :14:31. | :14:36. | |
of the UK, it needs some kind of boost, I think, in Kent. So option B | :14:37. | :14:43. | |
at Swanscombe has been rejected, but still on the table is option A, a | :14:44. | :14:48. | |
crossing alongside the existing one, and option C, east of Gravesend, in | :14:49. | :14:54. | |

have been badly affected in this area, because people are choosing | :15:04. | :15:06. | |

have probably taken 20 years back on my lifestyle, given up smoking, feel | :20:43. | :20:47. | |
a lot more energetic, a lot more time with my family. The challenge | :20:48. | :20:50. | |
of running two marathons back`to`back, how tough is that? | :20:51. | :20:55. | |
Very, very hard. I did a marathon this year, hit the wall at 21 | :20:56. | :21:00. | |
miles, so I am under no illusion how hard this is going to be. Matthew | :21:01. | :21:06. | |
will be running from Dover to Maidstone prison and is putting up | :21:07. | :21:09. | |
posters along the route. His workmates say he is an inspiration. | :21:10. | :21:14. | |
The change in him is incredible, to lose the amount of weight he has in | :21:15. | :21:18. | |
the time he has is absolutely superb, you know, such a vast | :21:19. | :21:22. | |
amount. He has about half his size as to what he was before. So it is | :21:23. | :21:28. | |
very difficult to put into words what he has achieved. It is the | :21:29. | :21:31. | |
longest run Matthew has ever undertaken, and he hopes to complete | :21:32. | :21:36. | |
the distance in eight hours, with well`wishers bearing him on in towns | :21:37. | :21:44. | |
and villages along the route. Wow! That is impressive. Some of us | :21:45. | :21:50. | |
say that golf is a good walk ruined. And for Wilson the chocolate | :21:51. | :21:54. | |
labrador, golf ruined him ` after he swallowed seven golf balls. He had | :21:55. | :22:01. | |
to undergo major surgery to remove the balls when he was out for a walk | :22:02. | :22:07. | |

of grass in there. Wilson is not the only dog who has swallowed something | :22:55. | :22:58. | |
