0:02:57 > 0:03:04Rachel burden's life is in tatters. She's lost her job and her

0:03:04 > 0:03:08reputation. Today, she's in court in the hope a judge 's decision will

0:03:08 > 0:03:12change her fortunes for the better. Two years of my life have just been

0:03:12 > 0:03:19taken away.She didn't harm anyone. She didn't steal anything. She

0:03:19 > 0:03:24posted a photo to Facebook. For 21 years, Rachel worked at this care

0:03:24 > 0:03:35home for elderly and vulnerable adults. As manager, every Friday

0:03:35 > 0:03:39night, she organised entertainment for the residents. It was the

0:03:39 > 0:03:44highlight of the week for 57-year-old David, who has down's

0:03:44 > 0:03:48syndrome.He popped on stage. He wanted his photograph taken with the

0:03:48 > 0:03:53three of us, so we did. It was a great night. Nothing untoward. I put

0:03:53 > 0:03:56the photograph on Facebook and thought nothing more of it after

0:03:56 > 0:04:01that.By posting the photo, identifying David and the location,

0:04:01 > 0:04:07Rachel had breached the council's social media guidance and resident

0:04:07 > 0:04:11confidentiality.The assistant director told me, "This is probably

0:04:11 > 0:04:14going to be construed as gross misconduct, and you could end up

0:04:14 > 0:04:16getting dismissed from the council. "

0:04:16 > 0:04:22getting dismissed from the council. ".She was suspended on full pay and

0:04:22 > 0:04:27given an ultimatum.I was given two working days to decide on demotion

0:04:27 > 0:04:32or dismissal. No way could I make that sort of decision in that time

0:04:32 > 0:04:37frame. They phoned me up and told me if I didn't accept it then I was

0:04:37 > 0:04:41being dismissed with effect from that day, and that's what happened.

0:04:41 > 0:04:50The photo received five likes. No one shared it.I knew how good she

0:04:50 > 0:04:56was at her job.Reverend David had been visiting the care home for over

0:04:56 > 0:05:00a year, offering chaplaincy to residents.Rachel had such care for

0:05:00 > 0:05:04the residents, and was so observant. It was very friendly and homely.

0:05:04 > 0:05:10There was a sense of love.I didn't mean any harm by what I did. And

0:05:10 > 0:05:18they crucified me for giving 21 years.Come here. Rachel had broken

0:05:18 > 0:05:24the rules, and why while residents appeared happy to be in the photo,

0:05:24 > 0:05:29his family could have objected. Here is the real moral dilemma in this

0:05:29 > 0:05:33case. They didn't. In fact, they were more than happy for David to be

0:05:33 > 0:05:37featured. Claire is David's sister. She and her husband Graham were

0:05:37 > 0:05:40there on that fateful Friday evening. Can I just be absolutely

0:05:40 > 0:05:49clear and ask you, did you mind? When we found out, we were aghast.

0:05:49 > 0:05:53Friday night was the thing that he looked forward to every day.He

0:05:53 > 0:05:58loved being the centre of attention. Absolutely. And does taking photos

0:05:58 > 0:06:03and posting them on Facebook and sharing them with the family.He

0:06:03 > 0:06:08wanted that to happen.So when the incident occurred, we were just

0:06:08 > 0:06:12amazed that that was the cause of the problems that Rachel

0:06:12 > 0:06:16experienced.Rachel took the council to an employment tribunal, accusing

0:06:16 > 0:06:21them of unfair dismissal. With no money, she couldn't afford legal

0:06:21 > 0:06:27representation, but Reverend David stepped up.I lived under vows to be

0:06:27 > 0:06:31a supporter of everything that is fine and fair and a challenger of

0:06:31 > 0:06:35what is mean and destructive. You cannot stand on the sidelines and

0:06:35 > 0:06:42let things happen to people as good as Rachel.David represented Rachel

0:06:42 > 0:06:47in the tribunal.I needed to prove that what I did, OK, yes, I did

0:06:47 > 0:06:53something wrong, but the sanction was far too harsh.Rachel won her

0:06:53 > 0:06:58case. The tribunal found that the two days she had to make a decision

0:06:58 > 0:07:03wasn't fair. But she had lost the career she loved. Today, she is back

0:07:03 > 0:07:07at court to find out how much compensation she will receive for

0:07:07 > 0:07:11her unfair dismissal.I'm extremely nervous at the moment because it is

0:07:11 > 0:07:15a massive big day.After a full day in court, Rachel has the decision.

0:07:15 > 0:07:27An offer of £5,800.It is not what I wanted. 21 years of going above and

0:07:27 > 0:07:34beyond for my clients and my staff and the families. That's all I'm

0:07:34 > 0:07:38worth is £5,800.The average person uploads for voters to Facebook

0:07:38 > 0:07:42everyday. How often do you stop and think about the consequences? --

0:07:42 > 0:07:51format photographs.There was no malice in what I did. He loved the

0:08:31 > 0:08:34offer to the motor to a lower grateful was unfair and it was that

0:08:34 > 0:08:40which determined the compensation. So you have had time to really think

0:08:40 > 0:08:46about things going forward. What are your plans?Well, since my story has

0:08:46 > 0:08:51broken in BBC Radio four and a newspaper, I have very kindly got

0:08:51 > 0:08:54legal representation, and there is a barrister looking at now whether I

0:08:54 > 0:08:59should appeal the judgment going forward.And can you ever see

0:08:59 > 0:09:06yourself going back into the care sector I can.Maybe not this year,

0:09:06 > 0:09:11but certainly next year, but I won't go back into full management. It is

0:09:11 > 0:09:15my vocation. It is what I was born to do.And at the end of the day,

0:09:15 > 0:09:20you were posting that photo to celebrate that night and David's

0:09:20 > 0:09:24performance. Kevin, it is tough and really hard to hear this, but there

0:09:24 > 0:09:29are lessons here for people when you read between the lines. The best way

0:09:29 > 0:09:30forward as far as uploading photographs and the amount of

0:09:30 > 0:09:37content that you are pairing with that.Yes, I think anybody who has a

0:09:37 > 0:09:40social media account, most companies have a social media policy in place

0:09:40 > 0:09:45and the rule is if you are not sure ask your HR department and read the

0:09:45 > 0:09:51policy. It is as simple as that. Lots of people on social media

0:09:51 > 0:10:01books, "Views are my own." That doesn't you, legally.Doesn't it?

0:10:01 > 0:10:07That's interesting.But it will make you more conscientious about what

0:10:07 > 0:10:11you are putting on there. Social media is evolving all the time and

0:10:11 > 0:10:14the onus is on the company to let you know if they have changed their

0:10:55 > 0:10:59my Facebook account, but obviously I am very careful of what I post on

0:19:53 > 0:19:57reaction to that?I don't think the renewed test is dangerous at all. I
