0:04:04 > 0:04:09"Over the last year..." I said, "Hang on. Over a year? You've never had me in the office
0:04:09 > 0:04:13"and all of a sudden, you're telling me I'm out the door?"
0:04:13 > 0:04:16With four children and a wife relying on his income,

0:05:12 > 0:05:14I went in the courtroom, stood on my own two feet
0:05:14 > 0:05:17and I wouldn't let them win, no matter what happened.
0:05:17 > 0:05:20After what they'd done to me, I just...
0:05:20 > 0:05:24Everything he chucked at me, I kept fighting back.

0:05:32 > 0:05:36and had to borrow from relatives to give her an appropriate send-off,

0:05:39 > 0:05:42And that's how it is.
0:05:43 > 0:05:48Globe Cleaning and Maintenance attended the tribunal and contested Michael's case.
0:05:48 > 0:05:54But despite having to represent himself, Michael still won his claim for unfair dismissal.
0:05:54 > 0:06:00He was awarded £10,969 in compensation.
0:06:00 > 0:06:04When he awarded it and he said the figure and that,
0:06:04 > 0:06:07I just walked out the courtroom
0:06:07 > 0:06:11and I just punched my hands in the air, "Yes, I've done it."
0:06:11 > 0:06:14But despite his tribunal ruling,
0:06:14 > 0:06:17Globe Cleaning and Maintenance wouldn't pay up.
0:06:17 > 0:06:21It was just dragging on and dragging on.
0:06:21 > 0:06:23I was getting no closer.
0:06:23 > 0:06:27Christmas was coming. I had to cancel Christmas for my kids.
0:06:27 > 0:06:30And after Christmas, I just decided myself,
0:06:30 > 0:06:33"I need to go to a solicitor and get help from them."
0:06:34 > 0:06:37The solicitor called in the help of the sheriffs.
0:06:37 > 0:06:42They are Michael's last resort if he's to get any of the money he's owed.
0:06:42 > 0:06:46And it's Lawrence and Kev who have been tasked with enforcing Michael's writ,
0:06:46 > 0:06:52which, with costs and interest, now comes to nearly £13,000.
0:06:52 > 0:06:55The sheriffs have reached their destination.
0:06:55 > 0:06:59There it is. Go in these gates here.
0:06:59 > 0:07:04That's the building. It's still got it on the front, with the bricked-up entrance.
0:07:04 > 0:07:08But a bricked-up company office is not what the sheriffs are looking for.
0:07:08 > 0:07:11Is Globe Cleaning and Maintenance still trading?
0:07:11 > 0:07:16Either way, Lawrence is already eyeing up potential seizure targets.
0:07:16 > 0:07:18They've got loads of vehicles outside.
0:07:21 > 0:07:25There's definitely business activity in the yard behind.
0:07:25 > 0:07:28Are you all right there, mate? Have you got Globe Cleaning?
0:07:28 > 0:07:31- They're not here any more. - They're not here.- Nah.
0:07:31 > 0:07:33That was their office, wasn't it?
0:07:33 > 0:07:38Although the sign says Globe, the business moved out some time ago.
0:07:38 > 0:07:41But the sheriffs don't give up easily.
0:07:41 > 0:07:45Lawrence and Kev are determined to track the debtors down.
0:07:45 > 0:07:51- You don't know where they've gone? - I don't know the new address. All I know is Fordhouse Lane.
0:07:51 > 0:07:52Lawrence!
0:07:52 > 0:07:55Thanks for your help. Cheers, man.
0:07:57 > 0:08:00So it's back in the van for Lawrence and Kev.
0:08:00 > 0:08:04The premises are completely empty. The sign's up, but that's about it.
0:08:04 > 0:08:06But we've have managed to obtain
0:08:06 > 0:08:11a partial address for their new premises, five miles away,
0:08:11 > 0:08:15which is in Fordhouse Lane, also in Birmingham.
0:08:15 > 0:08:20So we've managed to find Fordhouse Lane on the sat-nav, although we don't know a number.
0:08:20 > 0:08:24So we're going to have a look. It's only five miles down the road.
0:08:24 > 0:08:26We might as well go there anyway
0:08:26 > 0:08:29because we are allowed to go to any address in England and Wales
0:08:29 > 0:08:33where we believe the defendant might have assets.
0:08:33 > 0:08:37Sheriffs have been enforcing writs since Saxon times.
0:08:37 > 0:08:41These days, a High Court writ costs £60.
0:08:41 > 0:08:44If the sheriffs are successful in getting the cash owed,
0:08:44 > 0:08:46there's nothing more for their client to pay.
0:08:47 > 0:08:52If not, with most writs, there's just a £60 admin fee.
0:08:52 > 0:08:56With employment tribunals, there's no fee at all.
0:08:56 > 0:08:58Lawrence and Kev have arrived.
0:08:58 > 0:09:01It looks like they've tracked Globe down.
0:09:01 > 0:09:03The company's vans are in the car park.
0:09:03 > 0:09:07This is Barn Close. That's what we thought was residential.
0:09:07 > 0:09:10Well, I'll be jiggered.
0:09:10 > 0:09:13That's it. Block that in. That's all marked up.
0:09:13 > 0:09:15The sheriffs need to work fast.
0:09:15 > 0:09:20They block the company van in, in case they need to seize it to clear the debt to Michael.
0:09:20 > 0:09:23Try and get out quick. They've clocked us.
0:09:23 > 0:09:26They might've shut that door on us.
0:09:26 > 0:09:29Hello there. Looking for Globe Cleaning and Maintenance.
0:09:29 > 0:09:33- Globe Services. - Not Globe Cleaning and Maintenance?
0:09:33 > 0:09:37- Because this is the registered address.- Globe Services.
0:09:37 > 0:09:41An employee at the address says that the Globe cleaning company he works for
0:09:41 > 0:09:45is completely different to the Globe cleaning company that the sheriffs are after.
0:09:45 > 0:09:48But Lawrence isn't buying it.
0:09:48 > 0:09:53I'm here to execute a High Court writ against Globe Cleaning and Maintenance Company Ltd.
0:09:53 > 0:09:55This is the registered office.
0:09:55 > 0:10:00We're here to seize company assets from Globe Cleaning and Maintenance
0:10:00 > 0:10:03to the tune of just under £13,000.
0:10:03 > 0:10:06It doesn't matter who's here,
0:10:06 > 0:10:10because the writ is against the company, not the director.
0:10:10 > 0:10:13We're here to seize goods to that value today.
0:10:13 > 0:10:17The employee suggests they talk inside.
0:10:17 > 0:10:21The company front door is as far as our cameras are allowed.
0:10:21 > 0:10:27Lawrence's conversation with the Globe employee continues behind closed doors.
0:10:28 > 0:10:3315 minutes later and the conversation doesn't seem to be going anywhere.
0:10:33 > 0:10:37The employee continues to insist it's a different company,
0:10:37 > 0:10:40but Lawrence has his doubts.
0:10:41 > 0:10:46We had sufficient reason to believe that Globe Cleaning and Maintenance
0:10:46 > 0:10:48does have assets at this address.
0:10:48 > 0:10:51There's all the accreditations on the wall
0:10:51 > 0:10:55and things for Globe Cleaning and Maintenance Company Ltd.
0:10:55 > 0:10:59Finally, Lawrence's firm-but-fair approach seems to be working.
0:10:59 > 0:11:03One of the company directors is put on the phone to him.
0:11:04 > 0:11:07Your colleague's reading the writ where it orders us,
0:11:07 > 0:11:10if we don't seize goods today, we are in contempt of court
0:11:10 > 0:11:15because we have a High Court writ ordering us to come here and seize goods.
0:11:15 > 0:11:20We're not breaking the law, sir. You've got your opinion and I know exactly where I stand.
0:11:20 > 0:11:24I've got a writ that tells your colleagues where I stand on this.
0:11:25 > 0:11:29While Lawrence continues his battle on Michael's behalf,
0:11:29 > 0:11:32Kev decides to raise the stakes.
0:11:32 > 0:11:36He notes the details of the vehicles outside the office.
0:11:36 > 0:11:42If no payment's forthcoming today, the sheriffs will seize them for auction to pay off the debt.
0:11:42 > 0:11:46Any car or van owned by the company is fair game.
0:11:51 > 0:11:53Kev listing the vehicles in the car park
0:11:53 > 0:11:56and Lawrence's forensic analysis of the paperwork in the office
0:11:56 > 0:11:59seem to have done the trick.
0:11:59 > 0:12:03The employer's liability insurance and all the certificates on the wall
0:12:03 > 0:12:06were all in the name of Globe Cleaning and Maintenance Ltd,
0:12:06 > 0:12:09so I seized everything on the premises.
0:12:09 > 0:12:12The directors weren't there. One was skiing somewhere
0:12:12 > 0:12:15and the other was down in London for the day.
0:12:15 > 0:12:20We seized everything and the director authorised a payment to be made.
0:12:20 > 0:12:24He gave somebody his PIN number for his online account
0:12:24 > 0:12:29and they transferred the full balance of £12,982.49 into our account.
0:12:29 > 0:12:31So it was a Paid In Full.
0:12:32 > 0:12:35It's a great result for Lawrence and Kev.
0:12:35 > 0:12:38Their persistence paid off.
0:12:39 > 0:12:42And it's wonderful news for Michael and his family.
0:12:42 > 0:12:47Thanks to the sheriffs, they will be receiving a hefty cheque soon.
0:12:55 > 0:12:57Any member of the public
0:12:57 > 0:13:00chasing court-awarded debts of over £600
0:13:00 > 0:13:03can escalate their writ to the High Court.
0:13:04 > 0:13:07But that's the easy bit.
0:13:09 > 0:13:12Mike Aynsley is a director of one of Britain's largest
0:13:12 > 0:13:15High Court enforcement agencies.
0:13:15 > 0:13:18The easiest thing in this whole system is to get a judgement.
0:13:18 > 0:13:20Getting your money is the hardest.
0:13:20 > 0:13:24A judge will say, "OK, you owe the money,"
0:13:24 > 0:13:29and most claimants think, "I've got the money," but all they've got is a judgement.
0:13:29 > 0:13:32Which is where the sheriffs come in.
0:13:32 > 0:13:35They are tasked with making sure money awarded by courts
0:13:35 > 0:13:38goes to the people that deserve it.
0:13:38 > 0:13:42I have a High Court writ, OK, which orders me to come here
0:13:42 > 0:13:45and seize goods to the value of this debt.
0:13:45 > 0:13:47Sheriffs have more powers than bailiffs
0:13:47 > 0:13:52to enter properties and seize goods to auction to pay off the debts.
0:13:53 > 0:13:56Wherever there's a defendant, there's a claimant.
0:13:56 > 0:13:59The claimant, more often, needs the money
0:13:59 > 0:14:02and they have just as much right to that money.
0:14:02 > 0:14:05Much of the hard work takes place back in the office
0:14:05 > 0:14:11where writs are received, investigated and then distributed to the sheriffs.
0:14:11 > 0:14:16If it's a commercial property, we can force entry to levy, if necessary.
0:14:16 > 0:14:22There are over ten companies licensed to carry out enforcement work in England and Wales.
0:14:22 > 0:14:26They execute over 70,000 writs a year,
0:14:26 > 0:14:30retrieving millions of pounds for members of the public.
0:14:30 > 0:14:33What we're after are the Won't Pays.
0:14:33 > 0:14:36These are the people that most people get upset with.
0:14:36 > 0:14:39And this High Court enforcement office
0:14:39 > 0:14:44has just been called by someone who has good reason to be upset.
0:14:47 > 0:14:52When you think back to your wedding, it's hopefully with nothing but happy memories.
0:14:52 > 0:14:56For Randeep Desai, however, that's not the case.
0:14:56 > 0:14:59She was left heartbroken and out of pocket
0:14:59 > 0:15:04after coming into contact with a woeful wedding photographer.
0:15:04 > 0:15:06Following a whirlwind engagement,

0:15:14 > 0:15:17Hopes and expectations were very high.
0:15:17 > 0:15:22It was something that we'd planned for over a year. It's very special.
0:15:22 > 0:15:25It's a day that you won't get again.
0:15:25 > 0:15:28And when it came to picking a wedding photographer,
0:15:28 > 0:15:30Randeep wanted someone who'd fit the bill.
0:15:30 > 0:15:33It's important that they understand the Sikh ceremony,
0:15:33 > 0:15:38so somebody that's done a Sikh ceremony before is ideal.
0:15:38 > 0:15:42I had a look around, friends recommended a few people.
0:15:42 > 0:15:46There were some renowned ones, but they were really pricey.

0:15:50 > 0:15:54Kash Mohammed ran a wedding photography business in East London.
0:15:54 > 0:15:58I went over to have a look at his work. It was really good.
0:15:58 > 0:16:02I decided to go with Kash on that basis.
0:16:02 > 0:16:07And in this case, Kash cost cash. And lots of it.
0:16:07 > 0:16:11Randeep was due to pay him £3,300 in total,
0:16:11 > 0:16:14for which he'd give her a DVD of the wedding
0:16:14 > 0:16:17and two copies of a 60-page storybook wedding album
0:16:17 > 0:16:21shot by a professional photographer, hired for the occasion.
0:16:21 > 0:16:25The price also included a pre-wedding shoot with a professional photographer
0:16:25 > 0:16:27in a location of the couple's choice.
0:16:27 > 0:16:33Randeep wanted hers amongst the world-famous landmarks of Central London.

0:16:38 > 0:16:41and he said that my photographer wasn't going to be able to make it
0:16:41 > 0:16:46so he was going to do the photography himself.
0:16:46 > 0:16:50I wanted to confirm whether it was still in Central London.
0:16:50 > 0:16:55I wanted to have the iconic wheel and the Tower Bridge
0:16:55 > 0:17:02and things that really kind of centre on London and what it is.
0:17:02 > 0:17:05Instead, he asked us to come to Brixton!
0:17:05 > 0:17:09I was like, "OK. It's not really what we planned out."
0:17:09 > 0:17:13But he was quite insistent, so I kind of agreed reluctantly.
0:17:15 > 0:17:18The shoot itself was supposed to last half a day,
0:17:18 > 0:17:23but Kash rushed it through in 45 minutes.
0:17:23 > 0:17:28Despite this, Randeep felt it was too late to change wedding photographer.
0:17:28 > 0:17:30The special day came
0:17:30 > 0:17:34and the wedding itself was everything Randeep had hoped for.
0:17:34 > 0:17:37The wedding was really good. It went way too fast.
0:17:37 > 0:17:41Almost a blur. But it was really nice.
0:17:41 > 0:17:43It started at four in the morning
0:17:43 > 0:17:47and didn't finish until 10, 11 at night.
0:17:47 > 0:17:50- But we had fun.- It was great.
0:17:50 > 0:17:52The wedding finished,
0:17:52 > 0:17:55Randeep was shown the photos shot by the professional photographer
0:17:55 > 0:17:58and picked the 150 she wanted.
0:17:58 > 0:18:02She then waited patiently for her wedding albums and DVD.
0:18:02 > 0:18:03Very patiently.
0:18:03 > 0:18:06A full year and a half after the ceremony,
0:18:06 > 0:18:09she finally received a disc of the wedding album.
0:18:09 > 0:18:12When I opened up the post and got what I did,
0:18:12 > 0:18:15it was very disappointing.
0:18:15 > 0:18:17They didn't include any photos
0:18:17 > 0:18:21by the professional photographer that Kash had hired for the day
0:18:21 > 0:18:23because he hadn't paid him.
0:18:23 > 0:18:28The only pictures were the ones taken by Kash himself.
0:18:28 > 0:18:32The album didn't include the pictures I had chosen.
0:18:32 > 0:18:35There were 40 pages instead of 60
0:18:35 > 0:18:37and it was haphazard, just put together.
0:18:37 > 0:18:40There was no thought into it whatsoever.
0:18:40 > 0:18:42It was just a horrible album to look at.
0:18:43 > 0:18:47And the DVD was a video nasty.
0:18:47 > 0:18:50It had a lot of jolty moments,
0:18:50 > 0:18:54there was a lot of repeat editing.
0:18:54 > 0:19:00There was a lot of moments, like when I came into the temple,
0:19:00 > 0:19:04he had me coming in twice, so he's obviously not edited it.
0:19:04 > 0:19:07I'm not sure whether you're familiar with Sikh ceremonies,
0:19:07 > 0:19:11but you have to go around the Holy Book four times.
0:19:11 > 0:19:14He had me going around about seven or eight.
0:19:14 > 0:19:17It was just a farce.
0:19:17 > 0:19:20A lot of takes of people's backs,
0:19:20 > 0:19:25a lot of hand-shaking...
0:19:25 > 0:19:27It's just not nice to watch.
0:19:27 > 0:19:30You put so much faith in somebody.
0:19:31 > 0:19:34There was a lot of family that couldn't come
0:19:34 > 0:19:37so they've been asking my mum for the video.
0:19:37 > 0:19:43I couldn't give it to them at the standard that he gave me.
0:19:43 > 0:19:46It was too poor.
0:19:46 > 0:19:49On his website, he talks about it being a privilege
0:19:49 > 0:19:53to share such an important day with somebody,
0:19:53 > 0:19:56but then carelessly discarded all of that,
0:19:56 > 0:19:59had no thought to it, just trampled on your memories.
0:20:00 > 0:20:02You can't get those memories.
0:20:02 > 0:20:05You won't be able to video that again.
0:20:07 > 0:20:09Appalled by what she'd received,
0:20:09 > 0:20:12Randeep demanded the professional photos
0:20:12 > 0:20:16in the display album she'd been promised. Nothing came.
0:20:16 > 0:20:21She demanded her money back, but received none of that either.
0:20:21 > 0:20:26At her wits' end, Randeep took Kash to the Small Claims Court.
0:20:26 > 0:20:30He admitted liability and agreed to pay her back the money,
0:20:30 > 0:20:33but Randeep hasn't received a penny.
0:20:33 > 0:20:38With nothing left to lose, she's had to turn to the sheriffs.
0:20:38 > 0:20:41I don't want this to happen to anybody else.
0:20:41 > 0:20:44It's a horrible experience. Really, really horrible.
0:20:47 > 0:20:49It's a rainy morning in East London
0:20:49 > 0:20:54and Sheriffs Marc and Lawrence have promised to get Randeep her money back.
0:20:54 > 0:20:58They're on their way to a certain wedding photographer's registered business address,
0:20:58 > 0:21:00which they suspect is also his home.
0:21:00 > 0:21:06We're off to see Kashif Mohammed in East London, in E6.
0:21:06 > 0:21:08Erm...
0:21:08 > 0:21:11He owes £3,314.
0:21:13 > 0:21:16The sheriffs arrive
0:21:16 > 0:21:18and head straight for the front door.
0:21:23 > 0:21:26Morning. I'm after Kashif Mohammed.
0:21:26 > 0:21:30The man says Kash Mohammed no longer lives there.
0:21:30 > 0:21:35He's not sure when he moved out, but it's the third time someone's come looking for him.
0:21:35 > 0:21:38He's adamant that he is not Kash Mohammed.
0:21:38 > 0:21:42But to eliminate him from the writ, Marc asks him to show them some photo ID.
0:21:42 > 0:21:45I'm just going to go and have a look round the side.
0:21:45 > 0:21:47While they wait for him to find some ID,
0:21:47 > 0:21:50Lawrence wants to check on something.
0:21:50 > 0:21:55He's heard that Kash Mohammed has a photographic studio somewhere on site,
0:21:55 > 0:21:57full of potentially seizable equipment,
0:21:57 > 0:22:00which would more than cover his debt.
0:22:02 > 0:22:05There's definitely something in the extension at the back
0:22:05 > 0:22:07but Lawrence can't see exactly what.
0:22:07 > 0:22:11To seize any of it, he's got to get access to it.
0:22:11 > 0:22:13But as it's a residential property,
0:22:13 > 0:22:15he can't force entry.
0:22:15 > 0:22:20He can, however, enter peacefully if a door or window is left open.
0:22:20 > 0:22:23There's lights on in the extension.
0:22:23 > 0:22:27- Is there? - I wonder if it's not separate...
0:22:27 > 0:22:29It could be, couldn't it?
0:22:29 > 0:22:31While the man's still searching for his ID,
0:22:31 > 0:22:34Marc and Lawrence are forced to wait outside.
0:22:34 > 0:22:37I'm glad I put my thermal vest on!
0:22:38 > 0:22:42The man returns with his driving licence, proving he's not Kash Mohammed.
0:22:42 > 0:22:44I've not seen one of these before,
0:22:44 > 0:22:47these chip-and-PIN driving licences.
0:22:47 > 0:22:51They're still having trouble establishing Kash's connection to the house,
0:22:51 > 0:22:54whether he owns it, or anything else inside
0:22:54 > 0:22:57that the sheriffs could seize to pay back Randeep.
0:22:57 > 0:23:00They ask for the owner and the man agrees to fetch her.
0:23:00 > 0:23:05He says she's called Mrs Mohammed, but is no relation to Kash.
0:23:07 > 0:23:10Hiya. When did you buy the property?
0:23:10 > 0:23:13Did you buy it off Mr Mohammed or...?
0:23:14 > 0:23:17Mrs Mohammed says Kash is her husband
0:23:17 > 0:23:22but that they are separated and that he moved out six or seven years ago.
0:23:22 > 0:23:25So Mrs Mohammed is related to Kash.
0:23:25 > 0:23:28Someone's been misleading the sheriffs.
0:23:28 > 0:23:32And Lawrence is suspicious about some of the other things he's been told.
0:23:33 > 0:23:37We've got a judgement against him from a claim which is within the time that he's left,
0:23:37 > 0:23:41with him operating a photographic studio from these premises.
0:23:41 > 0:23:47Are you happy for us to come in and check that there is no photographic studio at the back of the property?
0:23:47 > 0:23:50I'm not trying to be pushy about it.
0:23:52 > 0:23:56Mrs Mohammed is not happy about them entering her property.
0:23:56 > 0:23:59But while she goes off to contact her solicitor,
0:23:59 > 0:24:01she leaves the front door unattended.
0:24:01 > 0:24:04It's all the opportunity Lawrence needs to enter the house
0:24:04 > 0:24:08to see whether there's a studio there.
0:24:09 > 0:24:10We're in.
0:24:10 > 0:24:13Thank you very much.
0:24:13 > 0:24:17We're going to do a diligent search of the property, because we gained peaceful entry.
0:24:17 > 0:24:19High Court enforcement officers
0:24:19 > 0:24:23are entitled to enter a residential property named in a writ,
0:24:23 > 0:24:25as long as they don't force their way in.
0:24:25 > 0:24:29In this case, it's Lawrence's last resort
0:24:29 > 0:24:32if he's to get Randeep back some money.
0:24:32 > 0:24:35Unhappy about having Marc and Lawrence in the house,
0:24:35 > 0:24:37the family calls the police.
0:24:37 > 0:24:43As expected, they confirm that Marc and Lawrence are within their right in entering.
0:24:46 > 0:24:50After a lengthy search, the sheriffs emerge
0:24:50 > 0:24:52and they've got good news.
0:24:52 > 0:24:54They were reluctant to let us in the garden,
0:24:54 > 0:24:59so I started searching drawers and cupboards for keys, which they weren't happy about.
0:24:59 > 0:25:03And from the other side of the room, I saw about three or four millimetres of key
0:25:03 > 0:25:06sticking off the top of a high shelf.
0:25:06 > 0:25:09Reached up and there was the bunch of keys.
0:25:09 > 0:25:12Out into the back door, into the conservatory affair,
0:25:12 > 0:25:18opened that and there was a 20-foot by 15-foot photographic studio,
0:25:18 > 0:25:21with Apple computers in it, erm,
0:25:21 > 0:25:25a tower unit for burning CDs and DVDs.
0:25:25 > 0:25:28So we've seized everything and got a walk-in possession on it.
0:25:28 > 0:25:32Also, there was ID for the defendant in there,
0:25:32 > 0:25:37obviously where he's been doing photographic work, so we took a photo of that.
0:25:37 > 0:25:40So it ties him to the property.
0:25:40 > 0:25:44The threat of Lawrence's paper seizure of her husband's assets
0:25:44 > 0:25:47persuaded Mrs Mohammed to pay in full.
0:25:47 > 0:25:51It's nice to get a Paid In Full under your belt first thing in the day.
0:25:51 > 0:25:54It was a residential job, which are harder to get into, anyway,
0:25:54 > 0:25:57but we did manage to gain peaceful entry,
0:25:57 > 0:26:00seized sufficient goods to cover the debt and got a payment.
0:26:00 > 0:26:03That's about as good as it gets, really, for a residential.
0:26:05 > 0:26:08The £3,314
0:26:08 > 0:26:12will go some way to consoling Randeep for her tarnished wedding memories,
0:26:12 > 0:26:16thanks in no small part to the sheriffs.
0:26:19 > 0:26:24Mrs Mohammed maintains that she does not know where her former husband is
0:26:24 > 0:26:29and she only paid the debt to prevent the sheriffs from taking further action.
0:26:33 > 0:26:38Sheriffs Kev and Lawrence are driving to a car dealer in Warwickshire.
0:26:38 > 0:26:42A member of the public took the dealer to court over a faulty car.
0:26:42 > 0:26:47The dealer didn't attend and the member of the public was awarded judgement.
0:26:47 > 0:26:52We've got a writ to enforce against a car dealer, Universal Motor Co.
0:26:52 > 0:26:55I would expect that they'll have plenty of stock,
0:26:55 > 0:26:58so I would hope that we would get a result on this one.
0:26:58 > 0:27:02We're aiming to get there for 9am, when they're likely to be open.
0:27:06 > 0:27:08The sheriffs arrive and head in.
0:27:10 > 0:27:13Morning, gents.
0:27:13 > 0:27:18Are either of you the owner at all? No? I'll show you some ID.
0:27:20 > 0:27:22My name's Mr Grix. I'm an enforcement officer.
0:27:22 > 0:27:24I'm here to execute a High Court writ.
0:27:24 > 0:27:28Are you able to get the guv'nor on the phone at all?
0:27:28 > 0:27:30While they wait to hear from the owner,
0:27:30 > 0:27:34Lawrence starts writing down details of the cars in the showroom.
0:27:34 > 0:27:37If there's no payment today, he will be looking to seize cars
0:27:37 > 0:27:41with a view to auctioning them to pay off the debt.
0:27:41 > 0:27:44With two sheriffs on his premises,
0:27:44 > 0:27:47unsurprisingly, the owner is soon taking an interest.
0:27:47 > 0:27:50I fully understand what you're saying,
0:27:50 > 0:27:53but it has been transferred to the High Court.
0:27:53 > 0:27:56We are here today to seize goods.
0:27:57 > 0:27:59You would need to prove that, sir.
0:27:59 > 0:28:04The owner argues that the cars don't belong to the company, so can't be seized.
0:28:04 > 0:28:07He says he's selling them on behalf of other owners.
0:28:07 > 0:28:11He suggests Lawrence rings up the owners direct.
0:28:11 > 0:28:15A phone number and me speaking to somebody on the phone doesn't do anything.
0:28:15 > 0:28:19I would need to see purchase paperwork for the vehicles.
0:28:19 > 0:28:24You need to get in touch with the person who has and they need to bring the paperwork here.
0:28:24 > 0:28:26The owner says he's on his way down.
0:28:26 > 0:28:28Bye-bye.
0:28:29 > 0:28:32Lawrence goes on the hunt for paperwork
0:28:32 > 0:28:35that might show who the cars do belong to.
0:28:35 > 0:28:40His High Court writ entitles him to look for evidence relating to the company named in it.
0:28:42 > 0:28:45He's, erm, apparently getting the, erm,
0:28:45 > 0:28:50the person who buys the vehicles in their name to come down with the purchase paperwork.
0:28:52 > 0:28:55This is the sale paperwork.
0:28:55 > 0:28:59But not everyone is as clued up on sheriffs' rights as Lawrence.
0:28:59 > 0:29:03- Are you allowed to go through all of that?- Yes, we are indeed.
0:29:03 > 0:29:06- All my personal stuff? - Your personal desk.
0:29:06 > 0:29:08- You work here?- Yes.
0:29:08 > 0:29:11- What's your role?- Car sales.
0:29:11 > 0:29:15- So, this is your personal piece of paper?- Yes.
0:29:15 > 0:29:19- Nothing to do with Universal Motor Co?- It's my personal work.
0:29:19 > 0:29:23But it's not your personal work if you work for the company.
0:29:23 > 0:29:25It... No.
0:29:25 > 0:29:27- We do...- Have you come here to seize vehicles?
0:29:27 > 0:29:31- Yes. We do a diligent search...- Yes.
0:29:31 > 0:29:34You can see that piece of paper. That's fine.
0:29:34 > 0:29:37No, we do a diligent search of the paperwork
0:29:37 > 0:29:39to get evidence either way
0:29:39 > 0:29:43of what company's trading here, what trading names are.
0:29:43 > 0:29:46So we're looking for any paperwork
0:29:46 > 0:29:51with regards to when the cars are bought in and when they're sold back out.
0:29:57 > 0:30:00Lawrence returns to his search.
0:30:00 > 0:30:03Soon after, the man he spoke to on the phone arrives.
0:30:04 > 0:30:07- Are you the owner? Are you the guy I spoke to?- I am.- Right.
0:30:07 > 0:30:11At this point, our cameras are asked to leave the garage.
0:30:11 > 0:30:15Lawrence continues his discussions with the owner behind closed doors.
0:30:17 > 0:30:22Kev conspicuously sizes up the vehicles outside
0:30:22 > 0:30:24and it's led to a breakthrough.
0:30:24 > 0:30:26Lawrence has got some of the cash owed.
0:30:26 > 0:30:30We made the best of what could've been a bad job.
0:30:30 > 0:30:33We collected £2,000 in cash on that job,
0:30:33 > 0:30:36which is over two-thirds of the outstanding debt.
0:30:36 > 0:30:39What the gentleman was saying was,
0:30:39 > 0:30:44all the vehicles were on sale or returned from other dealers,
0:30:44 > 0:30:48other people he knows, and they were getting the paperwork together
0:30:48 > 0:30:53to come round with that to prove that he didn't own any of the vehicles there.
0:30:53 > 0:30:55That was going to take some time,
0:30:55 > 0:30:59probably two or three hours before they could get there with the paperwork.
0:30:59 > 0:31:04All that would've done is clock up two or three hours' worth of waiting time added on to the bill.
0:31:04 > 0:31:09If they turned up with the paperwork, we wouldn't have had anything to seize anyway,
0:31:09 > 0:31:13so it just seems prudent to take the £2,000 in cash.
0:31:13 > 0:31:16He signed a walk-in possession agreement.
0:31:16 > 0:31:20He's going to get the paperwork over to the office to prove none of the stock is his
0:31:20 > 0:31:23and then pay the balance by the end of next week.
0:31:24 > 0:31:28£2,000 out of £2,800 owed, with more promised,
0:31:28 > 0:31:32is a solid result for the sheriffs on a tricky mission.
0:31:32 > 0:31:37With nothing more to do, they pack up and head off.
0:31:43 > 0:31:47Another person that's had to turn to the sheriffs for help
0:31:47 > 0:31:49is Louise Oakley-Green.
0:31:49 > 0:31:52There's nothing on that side.
0:31:52 > 0:31:55Living in a small Wiltshire village, and with three young children,
0:31:55 > 0:31:58a car is essential for her to get around.
0:31:58 > 0:32:01So when her car irretrievably broke down,
0:32:01 > 0:32:04she needed to get a replacement in a hurry.
0:32:04 > 0:32:09We decided to treat ourselves to a new car because we couldn't live without one.
0:32:09 > 0:32:13We started looking around for a big family car.
0:32:13 > 0:32:20I started looking on the internet to see where locally had those in stock,
0:32:20 > 0:32:22second-hand to buy.
0:32:22 > 0:32:26Louise's husband Stuart is a British Army soldier
0:32:26 > 0:32:27serving in Afghanistan,
0:32:27 > 0:32:30so she had enough to worry about.
0:32:30 > 0:32:35With Stuart away, Louise had to sort the car purchase all on her own.
0:32:35 > 0:32:39Online, she found a Ford Galaxy for sale at a local garage,
0:32:39 > 0:32:42Edwards Car Company Ltd.
0:32:42 > 0:32:46The car that I found at Edwards did tick all of the boxes.
0:32:46 > 0:32:50It drove beautifully, took it for a test drive.
0:32:50 > 0:32:55The guys at the garage seemed honest and nice.
0:32:56 > 0:33:01Loving the car, Louise agreed a price of £5,300
0:33:01 > 0:33:05and, with her husband's approval by email from Afghanistan,
0:33:05 > 0:33:07paid up for it.
0:33:07 > 0:33:11But it wasn't long before things started to go wrong.
0:33:11 > 0:33:14I drove the car back to my mum's house
0:33:14 > 0:33:16to go and show it off
0:33:16 > 0:33:20and immediately, I went to lock the car with the key fob
0:33:20 > 0:33:23and the remote central locking wasn't working,
0:33:23 > 0:33:29which I thought was really strange because it wasn't something they'd pointed out to me.
0:33:29 > 0:33:33As far as I was aware, everything was working on the car.
0:33:33 > 0:33:35And the problems didn't stop there.
0:33:35 > 0:33:39Within days of realising the central locking wasn't working,
0:33:39 > 0:33:42the internal door lock failed, as well.
0:33:42 > 0:33:45Louise complained and the garage agreed to try and fix them,
0:33:45 > 0:33:47but without success.
0:33:47 > 0:33:50The car went into the garage a couple of times
0:33:50 > 0:33:52for a day at a time.
0:33:52 > 0:33:54Each time the car went in,
0:33:54 > 0:33:58I received it back still not working
0:33:58 > 0:34:00and they basically said to me
0:34:00 > 0:34:04that they would have to have it in again.
0:34:04 > 0:34:07And worse was to come. Two weeks after buying the car,
0:34:07 > 0:34:12and with the locking issue still unresolved, there was a problem with the gearbox.
0:34:12 > 0:34:17Reverse gear couldn't be used, making the car unfit for the road.
0:34:17 > 0:34:22Louise phoned Edwards Car Company, who told her to bring it back for fixing.
0:34:22 > 0:34:27With reverse gear not working, I really started becoming concerned for the safety of me and the kids
0:34:27 > 0:34:29when we were driving around.
0:34:30 > 0:34:34I spoke to Edwards Car Company a number of times,
0:34:34 > 0:34:38a number of times I didn't receive phone calls back from them.
0:34:38 > 0:34:40They said that they promised to do the work.
0:34:40 > 0:34:43Over two months after buying the car,
0:34:43 > 0:34:47Louise agreed to let Edwards try and fix it for the third time
0:34:47 > 0:34:49on the basis that they do it within two weeks
0:34:49 > 0:34:53and she be given a courtesy car as a replacement.
0:34:53 > 0:34:57But after the fortnight was up, Edwards still hadn't fixed the Galaxy.
0:34:57 > 0:35:01At this point, I was feeling really angry. I'd just had enough.
0:35:01 > 0:35:04I didn't want the car any more, I didn't trust Edwards Car Company,
0:35:04 > 0:35:08I didn't trust the work that was being done.
0:35:08 > 0:35:11They sent me a loan car after two weeks
0:35:11 > 0:35:14and I didn't even trust the loan car.
0:35:14 > 0:35:16I didn't want anything to do with them any more.
0:35:16 > 0:35:19I had had enough.
0:35:19 > 0:35:23Louise wrote to Edwards explaining she no longer wanted the car
0:35:23 > 0:35:26and demanding full refund.
0:35:26 > 0:35:29Edwards' response was to attempt to redeliver the car
0:35:29 > 0:35:32with a refitted gearbox.
0:35:32 > 0:35:34But Louise had had enough.
0:35:34 > 0:35:37She refused to take delivery of the car and shut the door.
0:35:37 > 0:35:41Five minutes later, he posted the keys through the letterbox
0:35:41 > 0:35:45and basically forced delivery of the Galaxy onto me.
0:35:45 > 0:35:48I didn't believe that they had done that.
0:35:48 > 0:35:51I didn't know where I stood, I didn't know what to do
0:35:51 > 0:35:55and I then had the car back that I didn't want.
0:35:55 > 0:36:00Louise decided she had no choice but to take legal action.
0:36:00 > 0:36:02Six months after she bought the Galaxy,
0:36:02 > 0:36:05she went to the County Court.
0:36:05 > 0:36:09Edwards didn't attend and the court awarded in Louise's favour,
0:36:09 > 0:36:12but it's not been the end of her ordeal.
0:36:12 > 0:36:16As a family, it's been a huge burden.
0:36:16 > 0:36:21It has been one of the most stressful periods in my entire life.
0:36:21 > 0:36:24There's lots of things I've done, like buying a house,
0:36:24 > 0:36:27moving, having children,
0:36:27 > 0:36:31this experience, I would not wish on my worst enemy.
0:36:31 > 0:36:36A month after her court award, Louise is still stuck with the car she doesn't want
0:36:36 > 0:36:39and hasn't received a penny from Edwards.
0:36:39 > 0:36:43With nowhere else to turn, she's come to the sheriffs for help.
0:36:43 > 0:36:45If I did get the money back,
0:36:45 > 0:36:49it'll mean that we can actually...
0:36:49 > 0:36:53..go out and buy the family car that we were dreaming of.
0:36:54 > 0:36:57And tasked with making that dream come true
0:36:57 > 0:37:01are sheriffs Marc Newton and Kev McNally.
0:37:01 > 0:37:03We're off to a village in Wiltshire
0:37:03 > 0:37:06for a company called Edwards Car Company.
0:37:06 > 0:37:10They owe just over £6,300.
0:37:10 > 0:37:14I had a quick look on the internet and they seem to still be trading,
0:37:14 > 0:37:19so, hopefully, we'll catch someone in there today and get this dealt with.
0:37:19 > 0:37:22Perhaps unsurprisingly, given their line of work,
0:37:22 > 0:37:25Marc and Kev are no strangers to the second-hand car market.
0:37:25 > 0:37:28Sometimes they don't take too kindly to us.
0:37:28 > 0:37:32It's just one of those things, unfortunately.
0:37:32 > 0:37:37We'll be there and they're not going to get rid of us that easy, so we'll see how they are.
0:37:37 > 0:37:40They may be fine. It may be an oversight on their behalf
0:37:40 > 0:37:43and they might just pay us and we might go.
0:37:43 > 0:37:46But I'm not counting on that, to be honest.
0:37:50 > 0:37:55It's not long before they find Edwards Car Company's car yard.
0:37:55 > 0:37:58They head in, writ in hand.
0:37:59 > 0:38:02Is it here? Looks like it's here.
0:38:03 > 0:38:08A High Court writ has been issued for Edwards Car Company Limited.
0:38:08 > 0:38:12The first person they meet doesn't seem too keen on talking to them.
0:38:13 > 0:38:18But soon after, another member of staff arrives to see what he can do.
0:38:18 > 0:38:21- Has payment got to be made or...? - Payment's got to be made, yes.
0:38:21 > 0:38:26- How much is it?- £6,332.- £6,300.
0:38:26 > 0:38:30At this point, our camera operator is asked to leave.
0:38:31 > 0:38:34Marc and Kev's presence seems to have an effect.
0:38:35 > 0:38:38The man agrees to try and arrange a payment.
0:38:38 > 0:38:43It has to be paid while we're here. Are you on the Faster Transfer system?
0:38:43 > 0:38:47The account number is at the bottom there. That one there.
0:38:48 > 0:38:52Marc then takes a call from a senior member of the Edwards staff.
0:38:52 > 0:38:56It looks like the sheriffs have made significant progress today.
0:38:56 > 0:38:59I just spoke to some lady, she didn't give her name,
0:38:59 > 0:39:02but she said she would pay the money into our bank.
0:39:02 > 0:39:05It seems a bit too good to be true at the moment, so we'll hang on
0:39:05 > 0:39:08and give them 45 minutes to see whether they get to the bank.
0:39:08 > 0:39:12She said she's by a bank at the moment, but she's got to go home.
0:39:12 > 0:39:15Then we'll start geeing them up a bit
0:39:15 > 0:39:17and if the payment hasn't gone in,
0:39:17 > 0:39:20start chasing them up and see where they are.
0:39:20 > 0:39:24With the money hopefully on its way, Marc and Kev decide to wait
0:39:24 > 0:39:28until they get word the transfer's complete.
0:39:28 > 0:39:31- We'll give them till half 11 and we'll start geeing up.- Yes.
0:39:31 > 0:39:34Money transfers can fail to clear.
0:39:34 > 0:39:39If this happens, the sheriffs will be forced to seize some of the vehicles onsite.
0:39:39 > 0:39:41While they wait to find out,
0:39:41 > 0:39:45Marc and Kev take the opportunity to browse the goods on display.
0:39:45 > 0:39:47They also take a personal interest.
0:39:47 > 0:39:50I can get the kids in that, as well.
0:39:50 > 0:39:53It's the same money. It's not as good a spec, though, is it?
0:39:55 > 0:40:00- I can see you razzing around in a hot hatch!- They're big-boy hatches, aren't they?!
0:40:04 > 0:40:07The sheriffs don't have to wait long.
0:40:07 > 0:40:10A few minutes later, the transfer goes through,
0:40:10 > 0:40:14meaning Louise will definitely be getting her money.
0:40:14 > 0:40:16That was a good result for us.
0:40:16 > 0:40:20Was in there just over the hour, collected £6,332.
0:40:20 > 0:40:23We're happy, the claimant will be happy.
0:40:23 > 0:40:26It was a good day's work, to be honest.
0:40:26 > 0:40:29A good day's work for Marc and an even better day for Louise.
0:40:29 > 0:40:33She's got the money she's owed, in full,
0:40:33 > 0:40:36thanks to the sheriffs.
0:40:43 > 0:40:48It's a month since Lawrence and Marc visited the home of Mrs Mohammed.
0:40:48 > 0:40:54Randeep and Amardeep have received all the money they were owed.
0:40:54 > 0:40:57They recovered my money. I'm just waiting for the funds to clear.
0:40:57 > 0:41:00We've lots to look forward to. We've a baby on the way.
0:41:00 > 0:41:02In a couple of months,
0:41:02 > 0:41:05we can start taking our own pictures.
0:41:07 > 0:41:11The sheriffs' visit to Globe Cleaning and Maintenance Ltd clearly did the trick.
0:41:11 > 0:41:14Michael's received full payment.
0:41:15 > 0:41:21And since Marc and Kev managed to get Louise's money back from Edwards Car Company,
0:41:21 > 0:41:23she's had another piece of good news.
0:41:23 > 0:41:25Her husband is back, safe and sound,
0:41:25 > 0:41:27from his tour of duty in Afghanistan.
0:41:30 > 0:41:34I couldn't believe that they'd been able to collect the full amount
0:41:34 > 0:41:38after all the hassle that I'd gone through since June.
0:41:38 > 0:41:40I'm really happy with the outcome.
0:41:46 > 0:41:51Former office manager Shelley was sacked by text.
0:41:51 > 0:41:55She won a tribunal, but never got the compensation.
0:41:55 > 0:41:59At one point, I seemed to have everything and the next, I was left with nothing.
0:41:59 > 0:42:02Can the sheriffs put that right?
0:42:04 > 0:42:07Steve Knock had always dreamed of buying a boat,
0:42:07 > 0:42:11but when he finally got one, it became a nautical nightmare.
0:42:11 > 0:42:15He took the company which sold him the faulty vessel to court
0:42:15 > 0:42:17and got an out-of-court settlement,
0:42:17 > 0:42:19but still hasn't got his money.
0:42:19 > 0:42:23The sheriffs try to pay them a visit.
0:42:23 > 0:42:27Every asset on these premises is now seized.
0:42:27 > 0:42:30And this garage sold a car for a customer,
0:42:30 > 0:42:33but didn't give him the cash they got for it.
0:42:33 > 0:42:37The sheriffs go to the garage to get the customer what he's owed,
0:42:37 > 0:42:39but they get a frosty reception.
0:42:39 > 0:42:43If you try and shut me in here by pulling the shutter down,
0:42:43 > 0:42:46that's an arrestable offence. I'm just warning you.
