0:02:29 > 0:02:33when he was looking for a family-sized car for his wife.

0:02:33 > 0:02:37I have actually got about 13 grandchildren

0:02:37 > 0:02:39and six great-grandchildren.

0:02:39 > 0:02:42And my wife takes them, especially in the summer holidays,

0:02:42 > 0:02:45takes them down, we've got a caravan in Selsey Bill.

0:02:45 > 0:02:48So, it was always ideal to have a bigger car

0:02:48 > 0:02:52to carry the children around.

0:02:52 > 0:02:54They hadn't been looking for long

0:02:54 > 0:02:57before they found a car which seemed to fit the bill.

0:02:57 > 0:03:02My wife looked through the internet and found a Vauxhall Zafira,

0:03:02 > 0:03:07um...at Prestige Cars of South Norwood.

0:03:07 > 0:03:09So they went to have a look

0:03:09 > 0:03:11and took the car for a test-drive.

0:03:11 > 0:03:14We'd taken it out on the Saturday and it sounded quite nice.

0:03:14 > 0:03:19It was fine. The MOT was only three-four weeks old, the MOT.

0:03:19 > 0:03:22And unfortunately, I left my bag there, in the back of the car,

0:03:22 > 0:03:25after test-driving the vehicle.

0:03:25 > 0:03:29Um...and when we got home, my wife said, "Well, that's an omen.

0:03:29 > 0:03:33"You know, that car must be for me."

0:03:33 > 0:03:37So, they bought it for £2,290.

0:03:37 > 0:03:40But the problems began immediately.

0:03:40 > 0:03:42The next day, there was a puncture,

0:03:42 > 0:03:45so we put a new tyre on the vehicle.

0:03:45 > 0:03:50Um...then I said, "Well, you'd best go down to the tyre place

0:03:50 > 0:03:52"and get the tyres checked".

0:03:52 > 0:03:55Um...and it needed another two tyres.

0:03:55 > 0:04:00Um...and this is only two days after we bought the vehicle.

0:04:00 > 0:04:02And that was just the start.

0:04:02 > 0:04:04It was only a matter of days

0:04:04 > 0:04:07before it started misfiring about two cylinders.

0:04:07 > 0:04:10It started to rock all over, it was jumping all over the place,

0:04:10 > 0:04:12with misfiring, so on and so forth.

0:04:12 > 0:04:17And then, finally, it just gave up the ghost, basically.

0:04:17 > 0:04:22So we had to abandon the vehicle and get it back home.

0:04:22 > 0:04:25David called up Prestige Car Sales

0:04:25 > 0:04:27to report that the car had broken down.

0:04:27 > 0:04:30He said, "Well, can you get the vehicle to us?"

0:04:30 > 0:04:33I said, "No, we can't really because it's immobile".

0:04:33 > 0:04:37Instead, they agreed he'd take it to a local garage.

0:04:37 > 0:04:40Their inspection revealed a plethora of problems.

0:04:40 > 0:04:42The coil springs at the back were gone,

0:04:42 > 0:04:47the exhaust, um...manifold nuts were missing, so that was leaking gases.

0:04:47 > 0:04:49He said, "If I was you," he said, "I've got it running for you,

0:04:49 > 0:04:52"but you shouldn't really spend any more money," he said,

0:04:52 > 0:04:55"because the misfiring's still there

0:04:55 > 0:04:59"and diagnostically, it's telling me that it could be the engine,

0:04:59 > 0:05:04"it could be the gearbox or it could be a sensor."

0:05:04 > 0:05:07I mean, what do you do? Do you replace the three?

0:05:07 > 0:05:10It could have been anything up to about £2,000-£3,000.

0:05:10 > 0:05:14It was very, very frustrating that they'd sent the vehicle out

0:05:14 > 0:05:18in that sort of condition after me telling them

0:05:18 > 0:05:22and explaining to them what the vehicle was going to be used for.

0:05:23 > 0:05:28David spent £600 fixing just enough to get the car back on the road

0:05:28 > 0:05:33and contacted Prestige Car Sales about the remaining problems.

0:05:33 > 0:05:35He said, "Well, bring the vehicle back", he said,

0:05:35 > 0:05:37"and we'll sort it out for you".

0:05:37 > 0:05:40So, David returned the car to the dealers.

0:05:40 > 0:05:43But while he waited for it be repaired, he took a closer look

0:05:43 > 0:05:46at the service history documents which he still had.

0:05:46 > 0:05:49He found a cylinder head had previously been replaced

0:05:49 > 0:05:52and the car had experienced recurring issues

0:05:52 > 0:05:54with the engine misfiring.

0:05:54 > 0:05:56I said to my wife, I said, "Look,"

0:05:56 > 0:05:59I said, "this car isn't any good".

0:05:59 > 0:06:03I said, "It's just not fit for purpose, basically".

0:06:03 > 0:06:06David decided he no longer wanted it

0:06:06 > 0:06:09and asked Prestige Car Sales to keep the car and give him a refund.

0:06:09 > 0:06:13They told him to put it writing, so he did.

0:06:13 > 0:06:18I just said I'd forgo the £600 and £200 I spent on tyres,

0:06:18 > 0:06:21just pay me that, I think, £2,290.

0:06:21 > 0:06:25I said, "All I want is my money back, basically,

0:06:25 > 0:06:27"so we can get another vehicle".

0:06:27 > 0:06:31Um...no reply. Nothing. Nothing at all.

0:06:31 > 0:06:35I couldn't believe that someone could think that they could

0:06:35 > 0:06:40just take £2,000-plus off somebody, a working person,

0:06:40 > 0:06:43and seem to think they'd forget all about it.

0:06:43 > 0:06:46David took Prestige Car Sales to court.

0:06:46 > 0:06:49They didn't defend the case, so he won a default judgment

0:06:49 > 0:06:51for the full cost of the car

0:06:51 > 0:06:53and the repairs he'd made at his own expense.

0:06:55 > 0:06:58So, now David's put the sheriffs on the case.

0:10:49 > 0:10:53And if it finds in your favour, the debtor will be ordered to pay up.

0:10:56 > 0:10:58the High Court will grant a writ,

0:10:58 > 0:11:02authorising the sheriffs to act on your behalf.

0:11:02 > 0:11:04If they're successful, you get all your money back.

0:14:58 > 0:15:01wanted us to wait around for the rest of the day and possibly longer.

0:15:03 > 0:15:07But it seems light-footed Lawrence has managed to give the MD the slip.

0:15:15 > 0:15:17With the sheriffs listing assets in the back,

0:15:17 > 0:15:20it was game over for SBE Ltd.

0:15:20 > 0:15:24We're back dealing with the lady we were initially dealing with.

0:15:24 > 0:15:27She has her debit card and she will be paying.

0:15:27 > 0:15:30So, we've got the card machine here, we're going in, getting payment,

0:15:36 > 0:15:39and true to their word the company finally pay up.

0:15:47 > 0:15:49We were dealing with it quite sensibly

0:15:49 > 0:15:52and calmly initially with the young lady,

0:15:52 > 0:15:56but then the managing director came down and started getting himself

0:15:56 > 0:15:59involved telling us we couldn't do this, we couldn't do that.

0:15:59 > 0:16:02We were required to stay in reception,

0:16:02 > 0:16:06we said we weren't going to so he instructed the receptionist to press

0:16:06 > 0:16:10the panic alarm but I managed to nip through a door

0:16:10 > 0:16:12when somebody went through it so I declined the offer

0:16:12 > 0:16:15to go back to reception which didn't please them very much.

0:16:15 > 0:16:18But after ten minutes, the young lady came back

0:16:18 > 0:16:20and said she would pay it on her card.

0:16:20 > 0:16:23And that's what happened. So, we got paid in full.

0:16:23 > 0:16:26And with that, the sheriffs head off to the next job.

0:16:26 > 0:16:32The cleaning company will now get the £2,325 they were owed.

0:16:40 > 0:16:44This morning, Tommy and Craig are in the Black Country.

0:16:48 > 0:16:52to two employment tribunal cases against the same company.

0:16:52 > 0:16:55The company itself is Enable UK Midlands Limited.

0:16:55 > 0:16:58The director of the company is an Amjad Mahmood.

0:16:58 > 0:17:03One's for £5,100 and the other one is for £11,700.

0:17:13 > 0:17:15for the disabled and elderly.

0:17:15 > 0:17:19In 2015, the Care Quality Commission described its services

0:17:19 > 0:17:24as "not always safe" and the leadership as "inadequate".

0:17:25 > 0:17:29Now, two former staff members have won employment tribunal cases

0:17:29 > 0:17:32for breaches of contract and unpaid wages.
