0:02:10 > 0:02:17It all stems from a dispute over the repair of a 4x4, a Mitsubishi L200

0:02:17 > 0:02:21owned by Rob Gallon, who needs an off-road vehicle for work.

0:02:25 > 0:02:27it's a family-run business

0:02:27 > 0:02:32and it does require going off onto sites where I have to go off road,

0:02:36 > 0:02:39so the Mitsubishi L200 was absolutely perfect.

0:02:39 > 0:02:42But when the turbo failed, causing piston damage,

0:02:42 > 0:02:45Rob decided to get the engine replaced

0:02:45 > 0:02:48and started looking for a garage to do the work.

0:02:48 > 0:02:51Quality Engine Services from Birmingham,

0:02:51 > 0:02:53sounded like a company that knew what they were doing.

0:02:53 > 0:02:57I did explain to the guy that I would prefer another engine

0:02:57 > 0:03:01in the car and not to rebuild the one that I've got,

0:03:01 > 0:03:05and he convinced me that he was the one to put this car right.

0:03:05 > 0:03:08The man he dealt with called himself Nick.

0:03:08 > 0:03:11A week later, the repair was complete

0:03:11 > 0:03:13and Rob went to take a look.

0:03:13 > 0:03:16Started it up and it didn't sound right,

0:03:16 > 0:03:18and he said, "Oh, it just needs running in."

0:03:18 > 0:03:21Anyway, I drove the car home down the motorway,

0:03:21 > 0:03:24half a mile away from home it broke down

0:03:24 > 0:03:26and spilt all the oil all over the road.

0:03:26 > 0:03:31After handing over £2,000 Rob wasn't best pleased -

0:03:31 > 0:03:33especially when he inspected the engine

0:03:33 > 0:03:35and found it was still the same one.

0:03:35 > 0:03:39Nick was apologetic and took the car back for a second time.

0:03:39 > 0:03:42The car, again, was supposed to be in the garage

0:03:42 > 0:03:44for no more than seven days.

0:03:45 > 0:03:47I contacted Nick after nine days

0:03:47 > 0:03:51and he said they were having a few problems with a few of the belts

0:03:51 > 0:03:53and the auxiliaries,

0:03:53 > 0:03:55it should be ready for the weekend.

0:03:56 > 0:03:58I rang again at the weekend

0:03:58 > 0:04:00and it was Monday it was going to be finished,

0:04:00 > 0:04:03and then I rang on Monday and it would be Wednesday,

0:04:03 > 0:04:06and it just continued on and on and on.

0:04:06 > 0:04:08But some of Nick's reasons for the delay

0:04:08 > 0:04:10were difficult to argue with.

0:04:10 > 0:04:12He can't do anything for me at the minute

0:04:12 > 0:04:15because his wife had died over the last two weeks,

0:04:15 > 0:04:19and that's why the car hadn't been delivered back.

0:04:19 > 0:04:21So, Rob gave him some time -

0:04:21 > 0:04:23but as weeks became months,

0:04:23 > 0:04:27he got increasingly worried he was never going to get the car back -

0:04:27 > 0:04:31and it wasn't just about the money. It also had sentimental value.

0:04:32 > 0:04:36I owned a Mitsubishi L200 prior to this one

0:04:36 > 0:04:42that I had an accident in, in 2008, and it saved my life.

0:04:42 > 0:04:45If I was in any other vehicle, I wouldn't be here today -

0:04:45 > 0:04:49and I didn't drive from 2008 to 2012,

0:04:49 > 0:04:53and my wife went and bought me this L200 to get me back out on the road,

0:04:53 > 0:04:57get me driving again. So, the car is very important.

0:04:57 > 0:05:00It's a big part of my life, it's a hell of a big part of my life.

0:05:00 > 0:05:02That was the vehicle that got me back on track,

0:05:02 > 0:05:04it started getting our life back together.

0:05:04 > 0:05:08As Rob's hopes of ever seeing his beloved car again faded,

0:05:08 > 0:05:10he began to get desperate.

0:05:10 > 0:05:14I contacted Staffordshire Police and West Midlands Police

0:05:14 > 0:05:17a number of times to see if they would accompany me

0:05:17 > 0:05:18to the garage in Birmingham,

0:05:18 > 0:05:21so as I could recover my vehicle.

0:05:21 > 0:05:24At this point I was told by the police there was nothing they can do

0:05:24 > 0:05:27because this is a civil matter,

0:05:27 > 0:05:32and unless Nick hands over the keys to that car,

0:05:32 > 0:05:35I legally cannot take that car out of that garage,

0:05:35 > 0:05:37or else I'll be charged with theft.

0:05:37 > 0:05:40Eventually, the garage offered to sell his car on,

0:05:40 > 0:05:42and Rob reluctantly agreed,

0:05:42 > 0:05:44thinking it was the only way out -

0:05:44 > 0:05:46but he never received any money,

0:05:46 > 0:05:50apart from a refund of the £2,000 he'd already spent on the repair.

0:05:51 > 0:05:53His bank statement

0:05:53 > 0:05:56revealed the money came from Rocco Motor Solutions Limited.

0:05:56 > 0:05:59Presuming this to be the company behind the trading name

0:05:59 > 0:06:00Quality Engine Services,

0:06:00 > 0:06:05Rob took its director, Nitin Kareer, to court for the value of the car.

0:06:05 > 0:06:09My initial thoughts were, "I can't wait to get this guy in court,"

0:06:09 > 0:06:13but that never happened, because he never responded to any letter

0:06:13 > 0:06:16or any correspondence from the courts at all.

0:06:17 > 0:06:21Rob was awarded a County Court judgment in his favour by default,

0:06:21 > 0:06:23and when Mr Kareer didn't pay it,

0:06:23 > 0:06:26put the matter in the hands of the sheriffs.

0:06:26 > 0:06:27They're most certainly my last hope.

0:06:27 > 0:06:33I don't think there's any other way that I can get this sorted.

0:06:40 > 0:06:44In Birmingham, Craig is approaching the garage.

0:06:45 > 0:06:47There it is, on the left.

0:06:47 > 0:06:49There's no name above the door,

0:06:49 > 0:06:51and no mention of Quality Engine Services -

0:06:51 > 0:06:53but that's no concern to Craig.

0:06:53 > 0:06:57There's only one name on his writ, a Mr Nitin Kareer,

0:06:57 > 0:06:59and that's who he needs to find.

0:07:47 > 0:07:52but if he isn't, then Craig's best hope of persuading him to do so

0:07:54 > 0:07:57The problem is, anything here owned by his company,

0:07:57 > 0:08:01rather than by him personally, would be off limits.

0:08:01 > 0:08:05So while he waits for him to arrive, Craig turns detective...

0:08:07 > 0:08:10try and get some evidence that our guy, as an individual,

0:08:10 > 0:08:13trades from here, as opposed to his company.

0:08:13 > 0:08:14..and it doesn't take long

0:08:14 > 0:08:17before he stumbles across something of interest.

0:08:17 > 0:08:18I've located some of the invoices

0:08:18 > 0:08:21that they used for recent sort of parts

0:08:21 > 0:08:23and it's all in the name of his limited company,

0:08:23 > 0:08:25Rocco Motor Solutions, Limited,

0:08:25 > 0:08:27so, unfortunately, it's looking like our

0:08:27 > 0:08:32guy trades under a limited company here, so not as an individual.

0:08:32 > 0:08:34It's bad news for Craig,

0:08:34 > 0:08:37as it looks like he'll need to persuade the debtor to pay up

0:08:37 > 0:08:41without having any leverage to negotiate with.

0:08:41 > 0:08:43Mr Kareer hasn't shown up yet, either,

0:08:43 > 0:08:46and soon, one of the mechanics hands Craig a phone.

0:10:26 > 0:10:29involving anything from faulty goods or poor workmanship,

0:10:29 > 0:10:30to unpaid invoices.

0:10:31 > 0:10:35Claims can be filed by post or online for a small fee.

0:10:35 > 0:10:39Both parties in the case will be asked to submit evidence,

0:10:39 > 0:10:41and you may have to attend a court hearing.

0:10:41 > 0:10:45If you're successful, a County Court judgment, or CCJ,

0:10:45 > 0:10:47will be issued against the debtor -

0:10:47 > 0:10:51and if they still don't pay, that's when you call the sheriffs.

0:10:55 > 0:10:59Sheriffs typically enforce over 1,000 writs every year,

0:10:59 > 0:11:01and while each one is different,

0:11:01 > 0:11:04enforcement agents often find diplomacy is more effective

0:11:04 > 0:11:08than simply threatening to remove everything in sight.

0:11:10 > 0:11:14If it's necessary to play the long game, Ken Warby is happy to do so.

0:36:47 > 0:36:52Kieron accepted, and the agreement was rubber-stamped by the judge.

0:36:52 > 0:36:57His first payment was due to myself of £100 on the 1st of December.

0:36:57 > 0:37:00He failed to pay it, and he said he had family issues.
