:02:51. > :02:56.how to turn to second-hand ticket agencies like viagogo, GET ME IN and

:02:57. > :03:00.StubHub. Watchdog reveals that not only our customers buying seats at

:03:01. > :03:02.vastly inflated sums, they are also handing over money for tickets that

:03:03. > :03:12.can be fake or don't even exist. I really fancy catching a show,

:03:13. > :03:30.something musical. No. No. Why not a bit of opera? All

:03:31. > :03:33.I need now is the ticket. But getting hold of one of those deep

:03:34. > :03:39.these days can be quite a performance. The simplest way is to

:03:40. > :03:44.buy one on what is known as the primary market. It is a classy

:03:45. > :03:48.production with a small cast. The box office either sells to you

:03:49. > :03:51.directly or allocate its tickets to professional sellers like

:03:52. > :03:56.Ticketmaster or see tickets, who add a booking fee and then sell them on.

:03:57. > :04:01.But if the show is sold out you can turn to the secondary market. That

:04:02. > :04:04.has a much bigger cast. People who have bought tickets from the box

:04:05. > :04:08.office and primary market sellers then put them back on sale on ticket

:04:09. > :04:14.exchange websites, where they can then be sold to you or me. The main

:04:15. > :04:20.players are viagogo, StubHub, Seatwave and GET ME IN. They, of

:04:21. > :04:24.course, take a cut. But this means that you might end up paying a lot

:04:25. > :04:30.more than you bargained for. Take blues fan Jim Maclean. He wanted by

:04:31. > :04:38.Tea Party tickets for an American singer. He used get me into buying a

:04:39. > :04:42.pair for ?234. I was standing on the steps waiting to go to the concert,

:04:43. > :04:45.I looked at the tickets and realised that the face value of the tickets

:04:46. > :04:51.was about nearly half the price of what I paid for them. That is a hell

:04:52. > :04:54.of a difference. So what are the rules protecting the buyers from

:04:55. > :05:00.paying over the odds? The simple fact is there aren't any. The

:05:01. > :05:04.secondary ticketing websites do not think to limit the amount to beat

:05:05. > :05:10.goes on sale for, so prices can be breathtaking. Like this ?90 ticket

:05:11. > :05:17.for the last night of the Proms. It is available on StubHub for ?1950.

:05:18. > :05:22.All this, ?232 Wimbledon final ticket on Seatwave. It's on sale for

:05:23. > :05:25.almost 12 brand, including a sizeable booking fee. If you are

:05:26. > :05:33.beginning to think this sounds just like touting then you'd be right,

:05:34. > :05:35.but touting is only illegal for football matches. For anything else

:05:36. > :05:39.you can't be prosecuted for selling or buying a ticket at an inflated

:05:40. > :05:41.price. You could argue that the people that resell tickets, whether

:05:42. > :05:47.they are ticket touts or genuine fans, are merely entrepreneurs. Is

:05:48. > :05:52.there really a difference between selling a ticket and a second-hand

:05:53. > :05:55.car? Actually, there is because some of the tickets out there are sold at

:05:56. > :06:02.a low price for a very deliberate reason. The National Theatre sells

:06:03. > :06:05.some of their tickets at a reduced price to ensure their shows are

:06:06. > :06:10.accessible to everyone. They are able to do this through government

:06:11. > :06:15.funding, with money from you and me. But in many cases it is ticket touts

:06:16. > :06:18.who actually benefit, buying up subsidised tickets and then flogging

:06:19. > :06:24.them on the secondary market for a huge profit. It's incredibly

:06:25. > :06:28.frustrating, that it's those tickets which are often the ones being sold

:06:29. > :06:31.at multiples of their face value. Crucially pricing out the people

:06:32. > :06:36.that we really want to be able to come and take advantage of those

:06:37. > :06:41.tickets. Consumer law does insist that customers are at least told

:06:42. > :06:45.their ticket's original face value, but we found evidence that viagogo

:06:46. > :06:48.sometimes don't do that. Like with these VIP tickets for Wimbledon,

:06:49. > :06:54.which means they could be breaking the law. But some people will always

:06:55. > :06:59.be willing to pay over the odds if it means they are able to go to an

:07:00. > :07:05.otherwise sold-out event. But even that isn't guaranteed if you use the

:07:06. > :07:11.secondary market. Bernadette paid ?387.55 on viagogo, more than ?200

:07:12. > :07:16.more than the asking price for her son and three friends to see their

:07:17. > :07:20.favourite band, the Arctic Monkeys. When they hadn't arrived with a week

:07:21. > :07:24.to go she got on the phone. They casually said the reason they hadn't

:07:25. > :07:28.contacted me was because they didn't have any tickets for me. I was

:07:29. > :07:34.going, excuse me, I don't think you can say that. You took my money in

:07:35. > :07:38.July, where are the tickets? The tickets never arrived and Bernadette

:07:39. > :07:44.and Sean had to get a refund. Not so much viagogo, more no-no. So why

:07:45. > :07:48.didn't the tickets arrive? Perhaps the seller never had hold of them in

:07:49. > :07:51.the first place. You see, some people advertise tickets they never

:07:52. > :07:58.have, hoping to find a buyer and then managing to get hold of some at

:07:59. > :08:02.a later date. But often they don't. It's called speculative ticketing.

:08:03. > :08:06.And it is a practice the secondary market routinely allows to happen.

:08:07. > :08:10.There are no checks in place to make sure the sellers on their site

:08:11. > :08:16.actually have the tickets they are offering. Or if they did that are

:08:17. > :08:18.genuine. Roy Lucas bought a pair of tickets from viagogo for some

:08:19. > :08:27.friends to accompany him and his wife to see a violinist. The

:08:28. > :08:32.expected good concert seats were musical chairs. As I got there there

:08:33. > :08:37.were two the people in the seat. The tickets were being shuffled around,

:08:38. > :08:41.checking this and that. Then another two people arrived. It turned out

:08:42. > :08:46.three different couples had been sold tickets for the same set of

:08:47. > :08:49.seats. I was spitting blood. In the end they were told they had to buy

:08:50. > :08:53.new tickets because the venue thought it likely they will all

:08:54. > :08:58.counterfeit. Roy got his money back from viagogo but he feels that isn't

:08:59. > :09:06.the point. They shouldn't have been on sale on the site in the first

:09:07. > :09:08.place. Yet secondary market obliged to ensure the tickets you are buying

:09:09. > :09:13.real. And that means fake tickets are a serious problem for all types

:09:14. > :09:16.of events. We've seen a massive escalation in the numbers of

:09:17. > :09:22.counterfeit and invalid tickets sold through so-called safe platforms.

:09:23. > :09:27.From March to December last year we saw 3600 people turn up at the O2

:09:28. > :09:31.having purchased invalid tickets through these sites. So using

:09:32. > :09:36.secondary ticket selling websites seems risky. I could end up

:09:37. > :09:40.massively overpaying for tickets, buying ones that never arrived or

:09:41. > :09:46.being turned away from events because my tickets are fake. And

:09:47. > :09:58.that means I could end up getting a lot less than I bargained for. Well,

:09:59. > :10:01.all of the companies featured in our film say they provide a safe

:10:02. > :10:06.marketplace and guaranteed refunds or replacements in cases of fraud or

:10:07. > :10:08.tickets not arriving. Seatwave and StubHub say they don't support a cap

:10:09. > :10:13.on ticket prices and that many tickets on their side self or below

:10:14. > :10:17.face value. They point out that most sellers only receive payment after

:10:18. > :10:24.the event and, as a result, claim that fraud is where. StubHub says

:10:25. > :10:26.tickets on sale for vastly inflated prices are already bought. Although

:10:27. > :10:31.speculative ticketing is outlawed on their site, it's impossible for them

:10:32. > :10:39.to check every sale. Joining me now from viagogo, about which we

:10:40. > :10:46.received the most complaints, is the operation manager Ed Parkinson. Your

:10:47. > :10:52.company operates in 100 countries. That's right. All over the world.

:10:53. > :10:58.Have you got a family? I have two children. What is their favourite

:10:59. > :11:02.event to go to? Theatre shows at Christmas. Supposing your family got

:11:03. > :11:07.to the theatre and there were ten people for former proceeds. They'd

:11:08. > :11:11.be very disappointed, but that's exactly why we founded viagogo. We

:11:12. > :11:14.provide access to tickets with a guarantee of customer service. But

:11:15. > :11:17.in a company that is global, dealing with millions of customers every

:11:18. > :11:21.week, there will be occasions when things don't go as planned. But I

:11:22. > :11:26.think it's a measure of companies to see what you do about it and deal

:11:27. > :11:30.with it. What checks do you put in place? Millar we do a lot to check

:11:31. > :11:34.sellers and buyers in our marketplace. Anyone has to register

:11:35. > :11:37.their credit card. We can charge them at things go wrong and we don't

:11:38. > :11:42.take them until the buyer has successfully been to the event. You

:11:43. > :11:47.can't make money selling fake and fraudulent tickets on viagogo. We

:11:48. > :11:55.went about putting a ticket for eight fake concert on your site are

:11:56. > :11:59.absolutely no checks. What we do... You would have had to put your

:12:00. > :12:02.credit card information in there. We would track that ticket. If you

:12:03. > :12:06.didn't deliver it we would step in, find a replacement ticket for that

:12:07. > :12:10.buyer and get another ticket for them. That didn't happen with the

:12:11. > :12:15.Arctic Monkeys. You still haven't told the people that there were no

:12:16. > :12:18.tickets for them. We are very sorry about those particular cases, it is

:12:19. > :12:29.never acceptable to let someone down. But we looked for tickets but

:12:30. > :12:32.minute couldn't find them. We always give people a full refund. We go

:12:33. > :12:35.above and beyond that. Why do you keep the money for so long? The

:12:36. > :12:37.Rugby World Cup in September, if I book now you'd hang onto the money

:12:38. > :12:43.until the last minute. We don't pay sellers for tickets... Why don't you

:12:44. > :12:46.hang onto the tickets? We send tickets out as soon as they enter

:12:47. > :12:50.the market. The Rugby World Cup tickets will come out next year. But

:12:51. > :12:55.if we had the tickets earlier we would find out whether they were

:12:56. > :12:58.real or not. We are on the side of the consumer, we put fraud checks in

:12:59. > :13:01.place and guarantee customers get what they paid for. We make sure if

:13:02. > :13:05.something goes wrong that we step in. In the worst case, we will give

:13:06. > :13:11.a full refund and additional compensation. Would you like someone

:13:15. > :13:17.amount to clean up the industry. Customers are getting much better

:13:18. > :13:24.service from us than the good old days of standing out in the rain

:13:30. > :13:33.tickets are fake? Fake tickets are extremely unusual on our platform.

:24:42. > :24:47.and why did they act so badly when it came to putting the situation

:24:48. > :24:51.right? When the family discovered what had happened they contacted the

:24:52. > :24:55.travel agent and the requested to be moved to a similar room at another

:24:56. > :25:00.Disney hotel, but Disney said they had no availability elsewhere,

:25:01. > :25:03.leaving them with three options, take a refund and disappoint the

:25:04. > :25:11.kids by cancelling the holiday, spend more money upgrading to a more

:25:12. > :25:16.expensive room, or make do with the current one. If they did that, what

:25:17. > :25:18.kind of experience would they get for the money? I headed off to find

:25:19. > :25:34.out. First impressions, the hotel looks

:25:35. > :25:41.impressive, but what about when you get up close? There are two

:25:42. > :25:47.restaurants, both are supposed to be lovely, so we will go and check them

:25:48. > :25:52.out. Restaurant number one is boarded up, closed for

:25:53. > :25:58.refurbishment. Restaurant number two, lines are down, it is also

:25:59. > :26:02.shot. You can still get food on site but only from this makeshift

:26:03. > :26:08.restaurant set up in the convention centre. Not exactly the lakeside

:26:09. > :26:23.view you would expect. One of the hotel's big attractions

:26:24. > :26:30.is the huge indoor -outdoor swimming pool, but as you can see, it is a

:26:31. > :26:32.building site, as is the entertainment centre. They are

:26:33. > :26:36.supposed to have arcade machines here, but as you can see, it is very

:26:37. > :26:48.much work in progress. Remember the Jacuzzi and gymnasium

:26:49. > :26:52.they were looking forward to after a tiring day at the theme park? Also

:26:53. > :26:59.shut. What have we learned? If you come here between now and October

:27:00. > :27:04.you will find no restaurants, no swimming pool, no facilities and a

:27:05. > :27:12.whacking great Bill to switch hotels and get the facilities you have paid

:27:13. > :27:18.for. Our Disney taking the Mickey? Unsurprisingly the family opted not

:27:19. > :27:21.to stay there, and they paid the money to move to a different hotel.

:27:22. > :27:28.That is not to say they completely lost out. Some compensation was

:27:29. > :27:34.offered. ?50 voucher to spend in the park. Fantastic. In the end, to make

:27:35. > :27:43.sure the kids had their dream holiday, we moved to another hotel,

:27:44. > :27:51.but we paid more money. We have fought out -- spent another 17

:27:52. > :27:55.hundred -- 1700 quid. The travel regulations give you specific

:27:56. > :27:58.rights. When an organiser makes a change the customer should not be

:27:59. > :28:01.expected to pay more because they have paid for the holiday and a

:28:02. > :28:04.change the customer should not be expected to pay more because they

:28:05. > :28:06.have paid for the holiday they won did. If the organiser makes a change

:41:20. > :41:23.card. But what I didn't realise is that PlayStation and Xbox keep hold

:41:24. > :41:27.of your card details. So all my son had to do was hit confident purchase

:41:32. > :41:37.completely without my knowledge. And, by the way, before I got wind

:43:41. > :43:44.they continued to use our card or other payments without our

:43:45. > :43:47.knowledge. And it is an easy thing to get caught out by because you

:43:48. > :43:52.might have signed up to those services a long time before. David

:43:53. > :43:58.Porter, from the Shetlands, has been an Xbox owners since 2009. He bought

:43:59. > :44:02.his son FIFA 14 last September. Two months later he got his credit card

:44:03. > :44:12.bill. I opened it and there were four pages. It was all Xbox, Xbox.

:44:13. > :44:15.The total came to be ?1260. Once again, Microsoft were taking the

:44:16. > :44:20.payments for the player packs from the credit card he'd used to sign up

:44:21. > :44:27.to Xbox Live. But here's the thing, he'd done that over four years ago.

:44:28. > :44:30.To me, it was a subscription that would keep on being renewed on a

:44:31. > :44:34.year-to-year basis. I didn't think for a minute you would be able to

:44:35. > :44:38.purchase, certainly not spend this amount of money. This is

:44:39. > :44:42.consistently happening on both the PlayStation and the Xbox. And the

:44:43. > :44:46.fact they retain the right to do this isn't exactly spelled-out.

:44:47. > :44:52.These are the terms and conditions for Microsoft and Sony's online

:44:53. > :44:56.services. Both over 6000 words long, both with complicated

:44:57. > :45:01.statements buried deep within, stating that they retain the right

:45:02. > :45:07.to charge but other services besides the ones you've already signed up

:45:08. > :45:11.for. They are not exactly spelling it out. There is a way to let both

:45:12. > :45:15.Microsoft and Sony know that the person playing isn't an adult and

:45:16. > :45:19.therefore shouldn't be treated as such. There are parental controls

:45:20. > :45:24.that you can use to set up restricted accounts for children or

:45:25. > :45:28.teenagers. But, as Peter and his son, James, found out, even after

:45:29. > :45:34.taking those precautions you can still fall foul of FIFA 14. I was

:45:41. > :45:43.expectation that the key system default would be purchase

:45:44. > :45:50.protection, not accessing inappropriate content and the like.

:45:51. > :45:53.We paid for the Microsoft Xbox Live account and played. But it made no

:45:54. > :46:00.difference because Peter, too, received a shock bill. There was

:46:01. > :46:05.over ?1200 of Xbox transactions within a 14 or 15 day period. When

:46:06. > :46:08.Peter went back to check the parental controls he discovered that

:46:09. > :46:13.even if you set up a team account, the default setting is still to

:46:14. > :46:17.allow a parent's credit card to be charged for endgame purchases. You

:46:18. > :46:22.have to deselect that option to prevent your child spending your

:46:23. > :46:26.money. This is a 21st-century gaming system but the parental controls,

:46:27. > :46:35.the access, the logic, it's just not good enough. EA sports said they are

:46:36. > :46:40.looking to improve clarity over purchases in all their games. Xbox

:46:41. > :46:45.says it is clear that real money is being spent when you buy the packs.

:46:50. > :46:53.and apologises and says they will improve how they handle complaints.
