:00:23. > :00:25.he'd cancel if it didn't suit him. But are gyms in Wales sticking to

:00:25. > :00:28.the rules when it comes to contracts?

:00:28. > :00:38.And more complaints about the garages who don't tell us about

:00:38. > :00:50.

:00:59. > :01:02.stranger. First up though, gym contracts. If

:01:02. > :01:12.you've signed up for two years, can your gym hold you to it? Rhod's

:01:12. > :01:14.

:01:15. > :01:24.Nigel Phillips enjoys a good work- out. So when he was invited to

:01:24. > :01:27.visit a local gym recently, he jumped at the chance. Nigel came

:01:27. > :01:30.here, to the Glamorgan Health and Racquet Club on a guest pass with a

:01:30. > :01:36.friend. He saw the gym, the swimming pool, the tennis courts

:01:36. > :01:40.and was pretty impressed. A friend at work was a member there and he

:01:40. > :01:43.just encouraged me to come along and have a look, he got a free pass

:01:43. > :01:47.for me. It looked very family orientated. Nigel and his friend

:01:47. > :01:51.were taken for a coffee by the sales rep. Nigel says they talked

:01:51. > :01:54.about the pool parties and BBQs in the evening and how there was a

:01:54. > :02:00.fantastic social scene at the club. I think it worked out to be �12 a

:02:00. > :02:04.week. He taught me that would be the gym, the pool. He also said my

:02:04. > :02:11.children could go free. What we your first impressions of the

:02:11. > :02:13.salesman? Usually they give you the hard sell but this man was quite

:02:13. > :02:17.chatty and friendly, like one of the lads.

:02:17. > :02:20.Nigel says the rep at the Esporta gym told him the contract was for

:02:20. > :02:24.two years but he could cancel anytime with three months' notice.

:02:24. > :02:31.Nigel was won over. He signed the contract there and then, but wasn't

:02:31. > :02:35.given a copy to take away and read. He underlined the three-month

:02:35. > :02:40.contract bit, as long as you phoned up and gave three months' notice,

:02:40. > :02:45.you could pull out. But that wasn't the case. Did you take the

:02:45. > :02:50.children? I asked at the desk one day to take the children swimming

:02:50. > :02:52.and she said it would cost �7 each on top of my membership. And I had

:02:52. > :02:56.already been told they would be free.

:02:56. > :02:59.A week after Nigel signed the contract, he said he got a copy in

:02:59. > :03:01.the post, and when he looked closely at the small print, he was

:03:01. > :03:05.shocked. He discovered that he couldn't give

:03:05. > :03:10.three months' notice to get out of the contract. Instead, he was

:03:10. > :03:13.locked in for 24. If he wanted to cancel, he'd have to pay nearly

:03:13. > :03:17.�1,400, an amount he simply couldn't manage. He had only

:03:17. > :03:20.visited the gym six times so that worked out to be around �230 a

:03:20. > :03:23.visit. He felt he'd been misled by the

:03:23. > :03:30.sales man. He phoned to cancel his membership and stopped his direct

:03:30. > :03:36.debit. And that's when the letters started arriving. Debt recovery and

:03:36. > :03:41.agencies, telling me I owed this might and if not, court proceedings

:03:41. > :03:44.would start. It is not nice having anyone threatening you with court

:03:44. > :03:48.and demanding money so I was not very pleased at all.

:03:48. > :03:51.X-Ray have been looking into the legality of these contracts. And

:03:51. > :03:54.we've found that Virgin Active, who now own the gym, didn't have the

:03:54. > :03:58.legal right to enforce this contract because of a legal

:03:58. > :04:00.judgement earlier this year. Back in May, the High Court investigated

:04:00. > :04:05.a company called Ashbourne Management who wrote contracts for

:04:05. > :04:12.700 gyms. The judge ruled that most of their contracts were unfair,

:04:12. > :04:14.partly because they tied people in for more than 12 months. And

:04:14. > :04:18.because they weren't, fair they weren't enforceable.

:04:18. > :04:21.That ruling means that Nigel would just have had to pay for 12 months

:04:21. > :04:24.to get out of his contract not the full 24.

:04:24. > :04:27.So how does this ruling affect other people on gym contracts they

:04:27. > :04:31.want to get out of? What it now means is that anyone

:04:31. > :04:34.who has a contract that ties them in for more than 12 months is now

:04:34. > :04:38.in a position to challenge that term as being unfair and they can

:04:38. > :04:41.cancel after 12 months as long as they give notice.

:04:41. > :04:47.And Professor Margaret says that Nigel should have been allowed to

:04:47. > :04:49.cancel. It doesn't necessarily mean that gyms will have known straight

:04:49. > :04:52.away of the ruling but certainly this particular gym knew in

:04:52. > :04:56.September and so there really is no justification for them not having

:04:56. > :04:59.resolved the matter then, when they what the new ruling was.

:04:59. > :05:02.So what about other gyms in Wales? X-Ray contacted all the major

:05:02. > :05:07.chains, and the good news is they're all following the new

:05:07. > :05:10.guidelines. But when we rang a number of independent gyms across

:05:10. > :05:16.the country, we found that six out of 30 were still selling contracts

:05:16. > :05:21.that tie customers in for more than a year. Mark Watkins manages a new

:05:21. > :05:29.gym in Port Talbot. He and members like Matthew know what it's like to

:05:29. > :05:33.try and get out of a gym contract. We've had some people coming in who

:05:33. > :05:36.have been tied in for two years, three years, and they want to get

:05:36. > :05:43.out of contracts through injury and they are still getting pestered by

:05:43. > :05:47.people to pay and debt collecting letters. I had to pay it, it wasn't

:05:47. > :05:53.very nice for it to come out of my bank every month knowing I could

:05:53. > :05:56.not use the facilities, but there was no other way. So if you are

:05:56. > :06:00.tempted by a cheaper longer contract, this is something to be

:06:00. > :06:04.aware of. The good news is, if you have signed one and you want to get

:06:04. > :06:08.out of it, you can. But as ever, with any contract, the advice is to

:06:08. > :06:11.read the small print or, like Nigel, you could end up in a fight trying

:06:11. > :06:15.to get out of it. Well, Virgin Active, who took over

:06:15. > :06:18.all Esporta gyms in July, have responded to Nigel's complaints.

:06:18. > :06:21.They say they're sorry he felt misled when entering into the

:06:21. > :06:27.contract, and all Esporta staff have now been re-trained to make

:06:27. > :06:29.sure memberships are sold accurately and honestly. And Virgin

:06:29. > :06:33.say they've cancelled Mr Phillips' membership and cleared all the

:06:33. > :06:35.outstanding payments. They've also been working with the debt

:06:35. > :06:38.collection agency to ensure other members on Esporta two-year

:06:38. > :06:41.contracts don't have the same problems.

:06:41. > :06:45.Now last week we featured bathroom fitter, David Foster, who left a

:06:45. > :06:48.trail of people across North Wales thousands of pounds out of pocket.

:06:48. > :06:51.We've had lots of response to that item, including some very useful

:06:51. > :06:57.information about Mr Foster's whereabouts. We'll keep you

:06:57. > :07:03.informed. Next, a few weeks ago, we looked at

:07:03. > :07:06.the problems one driver was having using his Mazda around town. Quite

:07:06. > :07:10.a few of you got in touch and it seems you're experiencing problems

:07:10. > :07:14.with diesel cars. Rachel's been finding out what's going on.

:07:14. > :07:19.It's the best kept secret in the motor industry. Something that car

:07:19. > :07:28.manufacturers don't want you to know about. It's something we've

:07:28. > :07:31.featured before on X-Ray and it's called a diesel particulate filter.

:07:31. > :07:37.Chris Nichols from Cardiff first heard of the filter when he started

:07:37. > :07:43.having problems with his diesel Mazda 6. The filter traps polluting

:07:43. > :07:51.soot particles but it sometimes needs to clean itself. It does this

:07:51. > :07:54.by burning off the soot with red hot exhaust gasses. But to do this,

:07:54. > :07:58.you need to drive for ten or 15 minutes at high revs and that

:07:58. > :08:02.doesn't tend to happen with the kind of driving you do in urban

:08:03. > :08:08.areas like this. So urban drivers like Chris, featured three weeks

:08:08. > :08:11.ago, can find oil levels rising and warning lights flashing up. He knew

:08:11. > :08:17.nothing about this when he bought the car and he's not the only to

:08:17. > :08:20.get an unwelcome surprise. Russell Jones from New Tredegar had no idea

:08:20. > :08:30.about the limitations of his Chevrolet Captiva, which he bought

:08:30. > :08:31.

:08:31. > :08:38.from Evans Halshaw in Merthyr last November. -- in Cardiff last year.

:08:38. > :08:43.I got the car in November and it wasn't until March that this

:08:43. > :08:49.started appearing. It was only when I was doing short

:08:49. > :08:52.journeys that the DPF light came on. The car's handbook told him to keep

:08:53. > :09:00.a constant speed of 30 miles an hour for ten to 15 minutes to clear

:09:00. > :09:06.the light. Is it possible to do the kind of journeys you need to in the

:09:06. > :09:11.valleys? Impossible around the roads where I live. You come to

:09:11. > :09:14.roundabouts, road junctions, you have to slow down. So where is the

:09:14. > :09:18.nearest location that you can go to to achieve that?

:09:18. > :09:23.The heads of the Valleys is the nearest from here. It's about six

:09:23. > :09:30.or seven miles from here. When you bought the vehicle, was

:09:30. > :09:35.there any mention of the diesel particulate filter? None at all.

:09:35. > :09:39.Russell's not the only one who's worried about diesel filters.

:09:39. > :09:42.Gerald Lee from Newport found it could have serious consequences.

:09:42. > :09:46.He'd had two warning lights on his second hand Seat Ibiza and should

:09:46. > :09:56.have taken the car to a dealer, but he thought a long drive might sort

:09:56. > :10:00.the problem. It didn't. I was on and made wrote -- Maine Road, 40

:10:00. > :10:05.mph speed limit, and all of a sudden, the vehicle would not do

:10:05. > :10:09.any more than 10 Mars are now well. It suddenly your speed drops to 10

:10:09. > :10:15.miles are now well, there is a risk that someone will go into the back

:10:15. > :10:19.a few, but lucky enough I managed to get the car into a side road. It

:10:19. > :10:22.was quite frightening because I had no idea what had happened.

:10:22. > :10:26.The car seems to have gone into "drive home" mode, which allows a

:10:26. > :10:31.driver to crawl home despite serious problems. He was told it

:10:31. > :10:38.was a diesel filter problem. I had no idea what a DPF was. And

:10:38. > :10:42.the implications of it. Do you think the leadership should have

:10:42. > :10:47.told you about it? Yes, I definitely think they should. We

:10:47. > :10:52.discussed things like economy but we didn't discuss DPF. Does the car

:10:52. > :10:56.influence your driving habits? have to plant and think about it.

:10:56. > :11:01.If I want to go shopping, can I work in another trip rather than

:11:01. > :11:06.just go to the nearest supermarket? The car should be from my

:11:06. > :11:12.convenience! You don't expect to have to plan your shopping habits

:11:12. > :11:18.around the car. We've heard from owners of three

:11:18. > :11:26.car brands. Seat, Chevrolet and Mazda. None of them knew about the

:11:26. > :11:30.potential problems with diesel filters. What about the rest of the

:11:30. > :11:35.industry? We by nearly 1 million new diesel cars in Britain every

:11:35. > :11:44.year, so on any of the manufacturers giving us all the

:11:44. > :11:46.information we need? Of the UK's top 10 selling diesel

:11:46. > :11:50.cars, Volkswagen and Nissan, make any mention of the problems a

:11:50. > :11:53.diesel filter can cause on their website. BMW say they do not see

:11:53. > :11:55.the need to officially advise people of every way a car might

:11:55. > :12:02.behave on their site. Ford and Vauxhall are thinking of putting

:12:02. > :12:05.something on theirs. But what about the dealers? Managers at Thomson

:12:05. > :12:10.and Thomson who sold Gerald his Seat have promised to improve the

:12:10. > :12:13.way staff tell customers about diesel filters. All the other firms

:12:13. > :12:16.we contacted say their staff are trained to warn customers about

:12:17. > :12:26.diesel particulate filters. So you should get some kind of briefing

:12:27. > :12:28.

:12:28. > :12:32.from a salesman. Butter until all manufacturers give clear and

:12:32. > :12:36.unambiguous warnings about the problem with these engines,

:12:36. > :12:40.customers will keep buying cars that are simply wrong for them.

:12:40. > :12:48.wasn't informed when I bought the car. Obviously if I had known this

:12:48. > :12:58.before I bought it, I might have made a different joy this. -- a

:12:58. > :12:58.

:12:58. > :13:02.choice of. One way to ensure some peace of

:13:02. > :13:04.mind when you buy a car is to buy a warranty at the same time. But

:13:04. > :13:06.we've recently heard of one company based in Llantwit Major, whose

:13:06. > :13:10.lifetime warranties didn't stand up to scrutiny.

:13:10. > :13:13.In 2008, Lee Stoneham splashed out almost �9000 on a second hand BMW.

:13:13. > :13:20.At the same time he also bought a lifetime warranty with Motorcare

:13:20. > :13:23.Elite Limited costing �595. It was piece of mind because it was a

:13:23. > :13:26.second hand car and I thought if any parts, any moving parts needed

:13:26. > :13:29.replacing, then the warranty was there to cover should anything go

:13:29. > :13:32.wrong. In September last year, a part on

:13:32. > :13:40.the car, called the inlet cam sensor, needed replacing. So Lee

:13:40. > :13:46.contacted Motorcare. They said yes, it could be replaced under the

:13:46. > :13:50.warranty. They said, when you book the car into the garage, ring us,

:13:50. > :13:56.which I did. Then I handed the phone over to the mechanic and he

:13:56. > :14:02.said, yes, they have agreed to replace the part and pay for the

:14:02. > :14:04.hours of labour. The cost was �141. So Lee paid for the work and then

:14:05. > :14:09.contacted Motorcare Elite. But months later he was still waiting

:14:09. > :14:13.for them to pay out. Then in March this year, he received a letter

:14:13. > :14:16.from the firm saying they'd stopped trading.

:14:16. > :14:19.Claims waiting to be processed were handed over to a company called

:14:19. > :14:23.Autoprotect, who were administrators for the company.

:14:23. > :14:27.Took Autoprotect four months to get back to me to say they were acting

:14:27. > :14:32.on behalf of a different company of underwriters. So then I was at a

:14:32. > :14:36.dead-end wall basically. The administrators told Lee that

:14:36. > :14:38.they couldn't find any trace of his warranty. And we've discovered that

:14:38. > :14:41.the underwriters named on Lee's policy have never provided

:14:41. > :14:49.warranties for Motorcare Elite, so it looks like Lee's warranty isn't

:14:49. > :14:57.worth the paper it's written on. makes you quite angry I suppose and

:14:57. > :15:01.then wait, that you have paid something and it just hasn't

:15:01. > :15:03.followed up the policy of the warranty. I was quite annoyed for

:15:03. > :15:05.that. After we heard Lee's story, we got

:15:05. > :15:09.in touch with the Financial Services Authority who regulate

:15:09. > :15:12.insurers. And guess what? They've been investigating Motorcare EIite,

:15:12. > :15:14.and they say they've come across information which suggests that

:15:14. > :15:20.Motorcase may not have properly registered customers' details and

:15:20. > :15:23.premiums, making some people's policies worthless.

:15:23. > :15:31.We'll be looking into the company, so if you've been sold a warranty

:15:34. > :15:39.weeks ago, we told you about concerns that more and more of our

:15:39. > :15:43.public toilets could be forced to close as councils try to save money.

:15:43. > :15:45.Brian Bertola, a town councillor from Llandudno, rang in. He praised

:15:45. > :15:50.a scheme that pays shops and restaurants �500 to open their

:15:50. > :15:55.toilets up to the public. He says they piloted the idea first in

:15:55. > :16:02.Llandudno and 12 local businesses signed up for it. Not so happy,

:16:02. > :16:05.though, was Frederick Bright from Cardiff. He'd spotted articles

:16:05. > :16:08.about a �400 million pound underspend by the Welsh Government.

:16:08. > :16:10.Money that's no longer available. He asked why some of that cash

:16:10. > :16:20.couldn't have been spent improving public toilets.

:16:20. > :16:32.

:16:32. > :16:36.June Champion was delighted when she found a great deal on a new

:16:36. > :16:42.sofa and armchair. But after weeks of waiting she still has not

:16:42. > :16:49.received her furniture. I paid my deposit and never

:16:49. > :16:53.received my sweet. Time for a trip to Ammanford. Seven

:16:53. > :16:59.months ago June Champion and her husband decided to treat themselves

:17:00. > :17:07.to a new sofa and chairs. My husband was not very well so

:17:07. > :17:13.wanted new furniture. She found the perfect three-seater

:17:13. > :17:22.so at -- City and chair at the Leather Sofa Company.

:17:22. > :17:26.It was nice and comfortable. �800. She paid �150 deposit. She

:17:26. > :17:30.was told the furniture would arrive at the end of June. But the small

:17:30. > :17:36.print stated that it could be delivered up to eight weeks after

:17:36. > :17:43.that date. I kept phoning and phoning.

:17:43. > :17:50.Throughout June and July. They kept saying give it another week,

:17:50. > :17:54.another two weeks. So you waited?

:17:54. > :18:00.And waited and waited and waited. Then I got fed up and thrown them

:18:00. > :18:03.back and said I do not wanted. At that point Leather Sofa Company

:18:03. > :18:07.said that it was ready to be delivered but June had already

:18:07. > :18:16.decided that she was unhappy with the customer service and wanted her

:18:16. > :18:25.deposit back. I feel I have been treated poorly.

:18:25. > :18:30.What would you like me to do? Get me my money back.

:18:30. > :18:36.I am on the case. It seemed at that June did everything right. Let's

:18:36. > :18:40.see what the Leather Sofa Company have to say. They say that because

:18:40. > :18:47.manufacturing delays occasionally occur they allow a further eight

:18:47. > :18:51.weeks on top of the anticipated delivery of 12 weeks. They add that

:18:51. > :18:56.the so far was delivered to the Leather Sofa Company on 11th August.

:18:56. > :19:06.But they say that then June refused to accept it. However the Leather

:19:06. > :19:07.

:19:07. > :19:17.Sofa Company have now offered to refund a her �150 deposit. That is

:19:17. > :19:19.

:19:19. > :19:24.Now the on going Sagar regarding a company we have featured several

:19:24. > :19:27.times regarding their sales techniques. We told you be Sian

:19:27. > :19:31.Morris resent someone else's wedding photos. We asked you to

:19:37. > :19:40.tracked down the blushing bride. Lucy went to meet her. How did you

:19:40. > :19:45.first find out that your wedding pictures had ended up in somebody

:19:45. > :19:51.else's hands? We were watching television when my

:19:51. > :19:54.mother in law phoned. She said turn on BBC One. By the time that she

:19:54. > :19:59.had explained what was on I had missed the part of the programme I

:19:59. > :20:07.needed to watch but she said that a lady was sent my photographs and I

:20:08. > :20:12.was on television. I was like, what? I did not believe her.

:20:12. > :20:14.What did you think when you realise they had ended up on some else's

:20:15. > :20:21.hands and there was an appeal on our programme to find out to

:20:21. > :20:25.feature of their? I thought it was funny. My mobile

:20:25. > :20:31.began going off. A friend at work told me my pictures were on

:20:31. > :20:37.television. It is definitely you, he said. I thought he was winding

:20:37. > :20:45.me up. Over mobile phones were going crazy.

:20:45. > :20:49.I felt like my privacy had been invaded. I was angry and upset.

:20:49. > :20:55.How do you feel that your pictures have got into somebody else's

:20:55. > :21:00.hands? Do you think that is acceptable?

:21:00. > :21:06.It is appalling. Unacceptable. Their private pictures sent to some

:21:06. > :21:11.other women. A total lack of professionalism.

:21:11. > :21:15.The company have applied to us and say the photographs were printed at

:21:15. > :21:18.a photographic laboratory and that the Laboratory are currently

:21:18. > :21:22.investigating how the mistake was made. They say they will make sure

:21:22. > :21:27.that the situation does not happen again. If you would like us to

:21:32. > :21:36.Lucy is an Crymmych in Pembrokeshire to investigate a

:21:36. > :21:42.boiler left in a dangerous state. Keeping warm and our homes is at

:21:42. > :21:47.the forefront of our minds at this time of year. In the winter of 2009,

:21:47. > :21:52.Celia Smith decided that her elderly father should get a new

:21:52. > :21:56.boiler fitted. She spotted something called the Home Energy

:21:56. > :22:03.efficiency Scheme run by the Welsh government. It is designed to make

:22:03. > :22:09.new boilers affordable. My dad will be 100 in April. I want

:22:09. > :22:15.him to have come for. I was afraid that when he let his gas heaters he

:22:15. > :22:22.might hurt himself. -- I want him to be comfortable.

:22:22. > :22:30.The EC scheme provided a grant. We thought it would be safe and

:22:30. > :22:34.worthwhile. Something wonderful for him.

:22:34. > :22:40.In 2009 the scheme was being run by a company called Carillion Energy

:22:40. > :22:44.Services. You where initially happy?

:22:44. > :22:51.Very happy. He was warm and comfortable which was what we aimed

:22:51. > :22:56.for. After the boiler was fitted an

:22:56. > :23:02.inspector noticed a problem if the electrics. Nobody ever went back to

:23:02. > :23:08.fix it. It was not until July when her father needed to move into a

:23:08. > :23:16.coma that they found out there was a serious problem with the boiler.

:23:16. > :23:24.-- move into a home. He brought his hat in February and

:23:24. > :23:31.we needed a tenant. -- hype. So we got an electrician to come in and

:23:32. > :23:36.he said that the electrics were condemned.

:23:36. > :23:44.It turned out the boiler had been any potentially dangerous condition

:23:44. > :23:54.for two years. I was horrified. It could have

:23:54. > :23:54.

:23:54. > :24:01.killed my father, killed any of us. We asked an electrical lecturer to

:24:02. > :24:08.explain what might have happened. You on earth things so that if a

:24:08. > :24:18.fault occur as the electrics are cut off.

:24:18. > :24:22.What do you think about this boiler being left on earth?

:24:22. > :24:29.I find it incredible. Any metal attached to the boiler and all the

:24:29. > :24:37.metal work of the boiler, all had the potential to become a live.

:24:37. > :24:43.Extremely dangerous, potentially fatal.

:24:43. > :24:47.After getting an independent repair, Celia Smith got in touch with a

:24:47. > :24:53.Carillion Energy Services seeking a refund of the original �650 paid,

:24:53. > :24:57.as well as the cost of repairs. They told her to get in touch with

:24:57. > :25:01.British Gas, who run the Welsh government scheme. But British Gas

:25:01. > :25:09.claimed that Carillion Energy Services remain liable for work

:25:09. > :25:16.carried out before the first of people. What did people tell you?

:25:16. > :25:24.I was passed around from pillar to post. Nobody cared. I was sent

:25:24. > :25:32.around for days, weeks, months, going in circles on the phone.

:25:32. > :25:40.And it is not just this problem causing her concerns.

:25:41. > :25:44.I am worried that other people on the same scheme are in danger now.

:25:44. > :25:49.Carillion Energy Services have told us that all works are independently

:25:49. > :25:54.checked. But on this single occasion the remedial work was not

:25:54. > :25:58.carried out as specified. The company does not believe that the

:25:59. > :26:04.problem could have been repeated in other homes. Carillion Energy

:26:04. > :26:10.Services has now offered to pay Celia Smith �650 and apologised

:26:10. > :26:15.that on this occasion service levels fell short. British Gas have

:26:15. > :26:24.also offered �350 as a goodwill gesture. How has it left you

:26:24. > :26:33.feeling? Very angry. They put a vulnerable

:26:33. > :26:39.old man in a dangerous position. Just enough time to update you on a
