:00:58. > :01:03.First, Rachel has been in Barry, investigating a garage where second
:01:03. > :01:06.hand cars can come with a nasty surprise. You haven't seen this car,
:01:06. > :01:13.have you? Black Renault Scenic we're looking for? Doesn't look
:01:13. > :01:18.familiar at all? Haven't seen that anywhere? I'm on the hunt for the
:01:18. > :01:22.Renault Scenic that's not been seen for weeks. One place you won't find
:01:22. > :01:29.it is on the drive of Linda Savory, which is strange considering she
:01:29. > :01:34.paid nearly �1,800 to buy it. And there's no sign of it here - the
:01:34. > :01:37.Barry garage that sold it to her a few months ago. Linda left it here
:01:37. > :01:46.last November so they could fix something which seemed pretty
:01:46. > :01:50.simple, a key that didn't work. But she's not seen it since. If I'd
:01:50. > :01:54.have known then what I know now, I would not have touched the car with
:01:54. > :02:04.a barge pole. Searching online last September, Linda spotted the
:02:04. > :02:04.
:02:04. > :02:08.second-hand Scenic Trade Price Cars Ltd had for sale. Back then, the
:02:08. > :02:11.family were desperate for a car to get to work, school and lots of
:02:11. > :02:13.hospital appointments for disabled son Tyler. I took it out for a
:02:13. > :02:17.little drive with my brother-in-law and it seemed absolutely fine, it
:02:17. > :02:21.drove like a dream. I kind of fell in love with it and thought, yeah,
:02:21. > :02:28.this is the car that's just perfect for us. Not everything was rosy -
:02:28. > :02:31.the car had no MOT, no spare tyre, no stereo and a broken window.
:02:31. > :02:34.Linda says the salesman promised her they'd sort all the little
:02:34. > :02:41.problems out and reassured her that buying from them meant she'd
:02:41. > :02:45.nothing to worry about. If I had any problems, all I had to do was
:02:45. > :02:49.come back and ask and he would rectify those problems. With the
:02:49. > :02:53.jobs done, Linda collected her car. The salesman said the key card was
:02:53. > :03:00.a bit temperamental but just needed a new battery. She tried that, but
:03:00. > :03:06.it didn't work. I needed to be at the school and I couldn't get into
:03:06. > :03:10.the car. Fixing the key would be no problem,
:03:10. > :03:13.said Trade Price Cars, who told her to just bring it in and they'd sort
:03:13. > :03:20.it out. If only! Over the next month, Linda spent far more hours
:03:20. > :03:23.waiting for her car than behind the wheel. We think we had it for about
:03:23. > :03:28.10 days. They were promising the fix the problem, deadlines would
:03:28. > :03:30.come and go, the mechanic would never turn up. Totally fed up with
:03:30. > :03:38.the sluggish service, Linda approached another garage for their
:03:39. > :03:43.opinion. But she was in for a shock. A history check by the dealership
:03:43. > :03:47.revealed there was outstanding finance on the car. Someone who'd
:03:47. > :03:57.previously bought it hadn't finished paying for it. It's a
:03:57. > :03:58.
:03:58. > :04:01.simple check that any of us buying a second-hand car can do. But the
:04:01. > :04:03.important thing here is that all used car dealers should be doing
:04:03. > :04:06.these checks anyway before selling us a car. Official guidelines tell
:04:06. > :04:11.traders to check for things like outstanding finance to make sure
:04:11. > :04:18.they're sticking to the laws that protect consumers. So why on earth
:04:18. > :04:21.did Trade Price Cars sell that Scenic to Linda? That was a hell of
:04:21. > :04:24.a shock. Not only was the car faulty, I really didn't know
:04:24. > :04:34.anything about the car and the dealership said, "in a nutshell,
:04:34. > :04:35.
:04:35. > :04:38.it's not yours". Linda might have had her receipt, but the car still
:04:38. > :04:45.belonged to the finance company. They were owed more than �1,000 so
:04:45. > :04:49.were keen track it down. Linda wanted nothing more to do with the
:04:49. > :04:59.car. She says Trade Price Cars wouldn't give her a full refund but
:04:59. > :05:02.
:05:02. > :05:07.eventually agreed to pay back just over �1,600. Did the money
:05:07. > :05:11.materialise? No, after then were just constantly fighting on again.
:05:11. > :05:14.On a daily basis I'd hound him and ask "when's this money coming?",
:05:14. > :05:18."can you give us dates, can you give us times?" And he would
:05:18. > :05:21.promise a date and he would promise a time and he would never turn up.
:05:21. > :05:31.Several weeks, many calls, texts and letters later, Linda was still
:05:31. > :05:31.
:05:31. > :05:34.waiting for her money. It was time for direct action. I said, "I've
:05:34. > :05:41.come for my money" and they said, "well it's not here, you're not
:05:41. > :05:45.getting it". I said, "well I'm not leaving until I get it". It was
:05:45. > :05:51.only when staff began shutting up shop that Linda had to abandon her
:05:51. > :06:01.protest. So after a three-hour sit- in, Linda didn't get her refund
:06:01. > :06:01.
:06:01. > :06:03.that day. There was also something else missing - the car at the
:06:03. > :06:07.centre of this whole sorry situation. Today at Trade Price
:06:07. > :06:13.Cars, there's still no sign of the Scenic but plenty of other motors
:06:14. > :06:17.are on the forecourt. We decided to find out if any of them had a
:06:17. > :06:21.hidden history buyers needed to know. X-Ray checked eight cars. A
:06:21. > :06:26.silver Lexus on this forecourt right now is a category D write-off.
:06:26. > :06:30.That means it's been damaged in an accident. Now these cars can be
:06:30. > :06:34.sold but they have to be repaired properly and a dealer should tell
:06:34. > :06:41.what you're getting. Posing as potential customers, we paid the
:06:41. > :06:44.garage a visit. And guess what? The salesman told us twice that the
:06:44. > :06:50.Lexus hadn't been in any accidents and even assured us they'd checked
:06:50. > :06:53.to make sure that was true. But when we tried to pass on our
:06:53. > :07:02.concerns and get some answers, it seemed that the staff at Trade
:07:02. > :07:05.Price Cars weren't too keen to see us. If I get out, I promise you
:07:05. > :07:11.I'll smash down your (BLEEP) face, you idiot. They might not be very
:07:11. > :07:17.happy but neither is Linda. just so angry and frustrated that
:07:17. > :07:20.they will not give that money back. It's not theirs, it's my money.
:07:20. > :07:24.Well, we do now have some good news for Linda! Just hours after we
:07:24. > :07:30.delivered a letter outlining her problems to the garage, she got a
:07:30. > :07:33.call from them. And they have now refunded her in cash! But as for
:07:33. > :07:36.the other issues we raised with the garage, including that Lexus
:07:36. > :07:40.classified as a category D write- off, we haven't heard a word from
:07:40. > :07:43.them. And remember if you've got anything

:08:03. > :08:13.goods, it's almost certain that you'll be offered an extended
:08:13. > :08:13.
:08:14. > :08:18.warranty. But are they worth the money? No, I don't like them at all.
:08:18. > :08:23.I find you get a guarantee for one year, and after that they can keep
:08:23. > :08:30.going for quite a few years. depends how much money you spend on
:08:30. > :08:33.it. If I paid quite a high price, then I would. It gives me peace of
:08:33. > :08:36.mind. There have been concerns about these warranties for years,
:08:36. > :08:42.and there are now regulations to make sure that customers get a fair
:08:42. > :08:52.deal. We've been undercover checking out if stores are sticking
:08:52. > :08:56.
:08:56. > :08:59.to the rules. Shops like these are an invitation to splash the cash.
:08:59. > :09:04.But however much I spend the sales assistant will usually to make me
:09:04. > :09:09.spend a little bit more by selling me a warranty. But are the biggest
:09:09. > :09:12.sellers of extended warranties playing fair with their customers?
:09:12. > :09:21.Glen Sheriff from Carmarthenshire spent �750 on this HD telly from
:09:21. > :09:25.Currys nearly five years ago and he signed up for an extended warranty.
:09:25. > :09:31.I thought fair enough, �6.99, that's a couple of pints of beer or
:09:31. > :09:35.a packet of fags these days. Last year it looked like the warranty
:09:35. > :09:42.might come in useful. The sound, I just had to keep putting it up and
:09:42. > :09:45.up and up to hear it. My sons kept nagging me that the telly is
:09:45. > :09:48.rubbish. Currys have tried to fix the telly five times, but now
:09:48. > :09:53.they're refusing to provide a replacement, which is what the
:09:53. > :09:56.warranty promised. They will repair it to its full standard and if they
:09:56. > :10:00.do not repair it within a certain time they will replace it with
:10:00. > :10:04.something of an equivalent value. And they have not even offered that.
:10:04. > :10:08.Glen is not the only one who is worried about extended warranties.
:10:08. > :10:12.The Office of Fair Trading has been trying to get a better deal for
:10:12. > :10:15.customers for more than a decade. Regulations published in 2005 were
:10:15. > :10:22.designed to encourage competition and to drive down the price of
:10:22. > :10:32.warranties. Stores had to publish leaflets like these giving
:10:32. > :10:34.
:10:34. > :10:36.customers key information about their rights. The law says these
:10:36. > :10:39.leaflets must be prominently displayed. They have to tell
:10:40. > :10:43.customers they can shop around. And they don't have to buy the warranty
:10:43. > :10:46.the same time you buy their goods. But are the shops sticking to the
:10:46. > :10:52.rules? We've been undercover in Currys and Argos stores across
:10:52. > :11:02.North Wales to find out. In many, we struggled to find leaflets
:11:02. > :11:02.
:11:02. > :11:10.outlining our rights. In the TV department in Currys in Llandudno
:11:10. > :11:13.we did find them. Tucked away underneath a television. They may
:11:13. > :11:23.forget the leaflets but they rarely forget to try to sell you the
:11:23. > :11:32.
:11:32. > :11:38.warranty! Do you want breakdown But how far would they bend the
:11:38. > :11:42.rules to make a sale? Would I have to get it today or
:11:42. > :11:52.would I be able to come back in? It's like an offer. It's like a
:11:52. > :11:53.
:11:54. > :11:58.special offer with the televisions. OK. Do I have to get it today?
:11:58. > :12:01.Really? The law say they have to keep their offers open for 30 days!
:12:01. > :12:11.Let's ask another question. Can you get this anywhere else? Can you
:12:11. > :12:20.
:12:20. > :12:30.No, you can shop around for warranties. And the salesman at
:12:30. > :12:50.
:12:50. > :12:54.Currys in Bangor knew just where to Well, not quite. We checked out his
:12:54. > :12:58.claim on the Protect Your Bubble website. They'd charge �4.49 a
:12:58. > :13:08.month, not six quid. They also promise to replace your TV within
:13:08. > :13:12.
:13:12. > :13:15.seven days just like Currys! We asked a consumer law expert to look
:13:15. > :13:19.at our footage. The prices that other people may charge. It's quite
:13:19. > :13:22.legitimate for them to say you can buy it elsewhere but I don't know
:13:22. > :13:26.how much it would cost. But to actively give you a false statement
:13:26. > :13:36.would be contrary to the law. the worst offender was Argos in
:13:36. > :13:49.
:13:49. > :13:52.If that sounds too good to be true, it's because it is. Scratches are
:13:52. > :13:55.just not covered. If they're saying it would cover you for a scratch
:13:55. > :13:58.when it doesn't, then they are misleading you. Retailers are
:13:58. > :14:01.relying on the fact that the customers are going to get swept up
:14:01. > :14:04.in the excitement of buying their television or their video or
:14:04. > :14:06.whatever and automatically say I don't want my �600 TV getting
:14:06. > :14:09.damaged. Of course I shall buy an extended warranty. If you're
:14:09. > :14:13.offered an extended warranty it might be an idea to follow the
:14:13. > :14:15.advice of consumer group Which?. They say it's rare for new
:14:15. > :14:21.appliances to break down these days, and you're probably better off
:14:21. > :14:24.saving the cash and paying a repair man if the worst happens.
:14:24. > :14:26.So, what are those shops saying? Well Curry's have promised to
:14:26. > :14:29.investigate the incidents we highlighted, and they'll be
:14:29. > :14:33.offering their staff support and training where necessary. They're
:14:33. > :14:38.surprised we couldn't find those leaflets. They say their own secret
:14:39. > :14:42.shoppers seem to find them in 98.9% of shops. And there is good news
:14:42. > :14:47.for Glen. As a gesture of goodwill, they've given him a new state-of-
:14:47. > :14:52.the-art telly. And what about Argos? They're also investigating
:14:52. > :15:00.the concerns we raised. They say that consumer rights are not only
:15:00. > :15:10.displayed in leaflets, but on the website and in the catalogue.
:15:10. > :15:18.
:15:18. > :15:21.Next, Lucy's in Anglesey, where a giant wall is causing a LOT of
:15:21. > :15:25.worry. With its pretty marina and views
:15:25. > :15:29.across the Irish sea, Holyhead on Anglesey boasts some lovely scenery.
:15:29. > :15:32.But other parts of town aren't quite as picturesque. Behind these
:15:32. > :15:41.bungalows, there was once an ugly, disused coal yard, until developers
:15:41. > :15:45.bought the land to build a smart new housing estate. The residents
:15:45. > :15:51.of Bryn Gwyn Road hoped the view from their windows was going to
:15:51. > :15:58.improve - But instead they got THIS! An enormous wall, running
:15:58. > :16:03.around the new estate and across the bottom of their gardens! Nigel
:16:03. > :16:08.Moore and his family live at number five. To me, it looks like a prison
:16:08. > :16:11.wall. We were never consulted, we used to have a wooden fence, when I
:16:11. > :16:21.came back from holiday the wall had been started and the fence had been
:16:21. > :16:22.
:16:22. > :16:32.taken away. And neighbours Iris and Griff Thomas were horrified by the
:16:32. > :16:34.
:16:34. > :16:40.four-metre high monstrosity! looks like a jail, a prison wall.
:16:40. > :16:45.Nobody asked her opinion how the war should look. Aside from looking
:16:45. > :16:49.awful, there was another problem. Before the wall was finished, the
:16:49. > :16:54.developers, TJ McCarter Ltd, went bust! The new estate was then
:16:54. > :16:57.snapped up by the Royal Bank of Scotland. But in the summer of 2011,
:16:57. > :17:05.when Nigel's young children were playing in the garden, he spotted
:17:05. > :17:08.something very alarming. One of the boys kicked the ball onto the top
:17:08. > :17:17.of the wall, I climbed up to retrieve it and noticed the cracks
:17:17. > :17:19.were starting to appear in the top. It was worrying. When Anglesey
:17:19. > :17:24.Council's building inspectors came out, they were shocked by the
:17:24. > :17:27.dangerous leaning wall. They told Nigel to steer well clear and to
:17:27. > :17:33.take it up with the new owners of the development behind his bungalow,
:17:33. > :17:39.the Royal Bank of Scotland. phone calls started between myself
:17:39. > :17:43.and RBS and emails were sent. sent out a surveyor but he said
:17:43. > :17:49.there were two walls, not one. And the lower wall, which was leaning
:17:49. > :17:51.into Nigel's garden, belonged to him. They told us that the bottom
:17:51. > :17:56.wall was our responsibility and they were responsible for the top
:17:57. > :18:02.wall. What was your reaction to that? It was devastating. We didn't
:18:02. > :18:07.ask for the wall, why should it be me? Then, in May last year,
:18:07. > :18:13.disaster struck in the middle of the night. We heard a loud bang,
:18:13. > :18:20.the wall had collapsed completely. There was 40-50 tonnes of masonry
:18:20. > :18:25.lying across the garden, it's just totally destroyed everything. If
:18:25. > :18:29.we'd have been out here, it would have killed us. Without any shadow
:18:29. > :18:33.of a doubt. A desperate Nigel asked the Royal Bank of Scotland for help
:18:33. > :18:36.- but unlike the wall, the bank stood firm. RBS did pay for the
:18:36. > :18:43.rubble to be taken away but they're refusing to compensate Nigel for
:18:43. > :18:48.his damaged property or the cost of fixing the wall. Eight months on,
:18:48. > :18:50.huge cracks have appeared in the remaining structure. Next door,
:18:50. > :18:58.it's leaning so badly that pensioners Gruff and Iris are
:18:58. > :19:02.living in fear. We're very worried about the current situation. If the
:19:02. > :19:09.wall comes down, what are we going to do? It could damage our
:19:09. > :19:13.conservatory plus the greenhouse. You've got it on your mind all the
:19:13. > :19:21.time, do you know what I mean? called in surveyor Chris Armstrong
:19:21. > :19:24.to take a look at it. This wall is not safe. It may have been built as
:19:24. > :19:32.two walls but the actions of the developer by filling the gap and
:19:32. > :19:35.capping the gap between the two walls has created a single wall.
:19:35. > :19:43.Especially the filling between wall, the weight of that has pushed the
:19:43. > :19:50.wall over. Is it fair Nigel has to pay? That's not fair, rubbing salt
:19:50. > :19:55.in the wound. The wall wasn't built properly. The developer or
:19:55. > :20:01.whoever's responsible needs to come and get this sorted out. And Chris
:20:01. > :20:05.is even more worried about the wall next door. It's on the point of
:20:05. > :20:10.collapse, it's dangerous, something needs to be done urgently. It's one
:20:10. > :20:13.of the worst cases of any garden or retaining wall I've ever seen.
:20:13. > :20:17.RBS's own surveyors agree that the poor design of the wall probably
:20:17. > :20:20.caused its collapse. But they insist it's not their problem. For
:20:20. > :20:26.Nigel and his family, and Iris and Griff next door, this giant
:20:26. > :20:32.structure has made their lives a misery. And they're just waiting
:20:32. > :20:35.for the rest of the wall to crumble. It could happen if I was putting
:20:35. > :20:43.clothes on the line, it could go any time The children can't play
:20:43. > :20:48.out, we won't let them in case something else happens. I didn't
:20:48. > :20:52.build it, I didn't ask for it, why should I have to pay for it? It
:20:52. > :20:55.could have killed my family! What a nightmare. Well, we asked RBS
:20:55. > :21:00.whether they would reconsider their decision not to fix Nigel's wall -
:21:00. > :21:04.and Iris and Griff's next door. They said that they don't believe
:21:04. > :21:07.they own the lower wall. But because the residents don't agree,
:21:07. > :21:10.RBS say they will pay for further investigation to clarify the legal
:21:10. > :21:16.ownership of the wall - and if it does belong to them, they will
:21:16. > :21:19.repair it. We'll keep our fingers crossed.
:21:19. > :21:26.Now, Rhodri's been to meet a viewer from Newport whose dream it is to
:21:26. > :21:36.own a piece of movie history. It was one Newport man's dream to
:21:36. > :21:51.

:24:25. > :24:28.because he knew all about the film. I thought, I'm safe. Bob paid a 50%
:24:28. > :24:34.deposit of �187 to Kalcium Limited, the company behind the website, who
:24:34. > :24:43.promised delivery before Christmas. But was the seller's name a bad
:24:43. > :24:48.omen? His name was Mr Lance El Indio Ward. Right, and El Indio? El
:24:48. > :24:52.Indio is the baddie in the film. And he's the bad man in your story
:24:52. > :24:56.now, as well? And he's the bad man in my story too. Time ticked by.
:24:56. > :25:01.Bob kept asking for his watch. Until, in December, there was bad
:25:01. > :25:08.news. He replied saying there was a delay, he's got to get the film
:25:08. > :25:15.rights. He said he did not know he had to get the rights. I thought,
:25:15. > :25:23.that doesn't sound right. Most people know there's a copyright.
:25:23. > :25:30.What made it worse was he said this watch may be ready in December 2015.
:25:30. > :25:34.That's a long time? That's too long. Bob asked for his money back. El
:25:34. > :25:38.Indio refused to bite the bullet and accept defeat. He held onto
:25:38. > :25:42.Bob's cash, saying it had already been used to make the watch. I went
:25:42. > :25:47.back to him after but I got no reply whatsoever. He totally
:25:47. > :25:52.ignored my emails and letters. I feel that they've taken advantage.
:25:52. > :25:57.I mean, they've got my money and I haven't got nothing. I want my
:25:57. > :26:01.money back! Well, we've written to Lance El Indio Ward. We've e-mailed
:26:01. > :26:05.his office in Staffordshire and we've been ringing his mobile. But
:26:05. > :26:09.he seems to be avoiding us - he's even changed his number. Short of
:26:09. > :26:15.challenging him to a duel we're a bit stuck. But, fortunately for Bob
:26:15. > :26:22.- he paid his deposit by credit card. And his card company have
:26:22. > :26:26.agreed to refund him his �187. Yee- Now, some news of a familiar face
:26:26. > :26:28.on this programme - Harby Panesar. He found fame as the dad who spent
:26:28. > :26:35.a reported �20,000 on his daughter's televised 15th birthday
:26:35. > :26:37.party. But we exposed Mr Panesar as the boss of Motorcare Elite, the
:26:37. > :26:47.Llantwit Major-based company selling bogus warranties for
:26:47. > :26:48.
:26:48. > :26:51.second-hand cars. So what's the news? Well, it's taken some time
:26:51. > :26:57.but an investigation by the Financial Services Authority is now
:26:57. > :27:04.complete. The headlines are that Panesar misappropriated over
:27:04. > :27:07.�180,000 from Motorcare Elite and his previous company. As for his
:27:07. > :27:13.customers, over 6,000 were left without the motor cover they'd paid
:27:13. > :27:20.for, all as a result of his reckless business practices.
:27:20. > :27:25.what's the punishment? They've banned him from working in the
