0:00:03 > 0:00:05'Never before have so many on-the-spot fines

0:00:05 > 0:00:07'been issued in Britain.

0:00:07 > 0:00:09'We're going to be following the men and women who hand out

0:00:09 > 0:00:13'over ?30 million worth of tickets every month...'

0:00:13 > 0:00:15Oops.

0:00:15 > 0:00:16Round here, they are an absolute blight.

0:00:16 > 0:00:18I'm up to 104 now. Wow!

0:00:18 > 0:00:20That is disgusting.

0:00:20 > 0:00:22Just walk away.

0:00:22 > 0:00:24'..for behaviour that's downright dangerous...'

0:00:24 > 0:00:27That was stupid for these sort of conditions, wasn't it?

0:00:27 > 0:00:28'..simply selfish...'

0:00:28 > 0:00:30Look at the mess you've created in the street.

0:00:30 > 0:00:32How's that our fault?

0:00:32 > 0:00:33'..or just...'

0:00:33 > 0:00:34What is he doing?

0:00:34 > 0:00:36'..well, plain silly.'

0:00:36 > 0:00:37What a doughnut.

0:00:37 > 0:00:40We'll be revealing the cost of their bad behaviour.

0:00:40 > 0:00:42?100 fine.

0:00:42 > 0:00:44Pays ?260. Ouch!

0:00:44 > 0:00:47'And how this could affect you.'

0:00:47 > 0:00:50I'll give him a punch. Do you want to see me kick off?

0:00:50 > 0:00:51'The police are on it...'

0:00:51 > 0:00:53What the...? Sir!

0:00:53 > 0:00:55'..the parking wardens are on it...'

0:00:55 > 0:00:57They should be thanking us for being here.

0:00:57 > 0:00:58'..and I'm on it.'

0:00:58 > 0:01:00Careful, it's a 30mph limit here!

0:01:00 > 0:01:02'I'm Dom Littlewood,

0:01:02 > 0:01:03'and I'm on the spot.

0:01:05 > 0:01:07'This time, I'm on the spot...'

0:01:07 > 0:01:09That was a bit stupid of him, wasn't it?

0:01:09 > 0:01:10'..spotting the speeders.'

0:01:10 > 0:01:13What must be going through his mind right now? "Oops."

0:01:13 > 0:01:17'Just who is going to pay the penalty in Lancashire?'

0:01:17 > 0:01:20He had a sheet over his head and he emptied the bin there.

0:01:20 > 0:01:22'And one man fights his fine...'

0:01:22 > 0:01:24Do you not accept that that's your vehicle?

0:01:24 > 0:01:25'..at the traffic tribunal.'

0:01:25 > 0:01:26No.

0:01:28 > 0:01:30Have you ever driven over the speed limit,

0:01:30 > 0:01:34forgot to MOT your car or not bothered with your seatbelt?

0:01:34 > 0:01:36You might think it's harmless,

0:01:36 > 0:01:39but they're all criminal offences and if you don't play by the rules,

0:01:39 > 0:01:43the police can hit you with a hefty fine, or more.

0:01:46 > 0:01:49I'm riding shotgun with Sergeant Warren Knight.

0:01:53 > 0:01:57The weekend is nearly over, and for traffic cops that means one thing...

0:01:58 > 0:02:00..dangerous drivers.

0:02:00 > 0:02:04So, Warren, a slightly wet Sunday afternoon in Wiltshire.

0:02:04 > 0:02:08A damp one, yeah. A damp start which is typically not what was forecast.

0:02:08 > 0:02:10What's it now? So, it's 3.40 now,

0:02:10 > 0:02:15we're on with you most of the night, what are you likely to expect?

0:02:15 > 0:02:19The plan for tonight is to go up and join colleagues on the motorway.

0:02:19 > 0:02:21We usually find the M4,

0:02:21 > 0:02:24because there are people going back towards London,

0:02:24 > 0:02:25it gets quite busy,

0:02:25 > 0:02:28and we usually have quite a lot of late-evening collisions.

0:02:28 > 0:02:30But also, as the traffic thins out,

0:02:30 > 0:02:33we then get the people that have left it quite late

0:02:33 > 0:02:35and they'll start increasing their speeds.

0:02:35 > 0:02:39Would it be fair to say that the majority of the RTCs

0:02:39 > 0:02:42that you see now would be as a result of people speeding?

0:02:42 > 0:02:44They're not all for speeding.

0:02:44 > 0:02:47A lot of inattention is the main cause, I would say.

0:02:47 > 0:02:50A combination of inattention,

0:02:50 > 0:02:52inappropriate speed or inappropriate driving.

0:02:52 > 0:02:56So that could mean that they're distracted by mobile phones,

0:02:56 > 0:02:58they're distracted by talking.

0:02:58 > 0:03:02I think people's lives are so busy now,

0:03:02 > 0:03:04they're such in a rush that they just don't think ahead,

0:03:04 > 0:03:07they're just thinking about, "I've got to get home,

0:03:07 > 0:03:08"I've got to get the kids to bed,"

0:03:08 > 0:03:10or, "I've got to get ready for work,"

0:03:10 > 0:03:13so they're not focusing on the job in hand, which is driving.

0:03:15 > 0:03:18You must see some horrific things.

0:03:18 > 0:03:21I've been a traffic sergeant for ten years and

0:03:21 > 0:03:24I've seen a multitude of people that have died

0:03:24 > 0:03:27as a result of road traffic collisions.

0:03:27 > 0:03:30Do any of those scenes or sounds you might hear, anything at all,

0:03:30 > 0:03:33does that haunt you afterwards... Erm... ..or are you able to

0:03:33 > 0:03:35distance yourself from that?

0:03:35 > 0:03:38They do for a while and you just hope, in time, that your mind

0:03:38 > 0:03:40can process it in the right way.

0:03:42 > 0:03:44It's the job of these guys to try

0:03:44 > 0:03:47and eliminate road traffic collisions.

0:03:47 > 0:03:49One way to focus drivers on the rules of the road

0:03:49 > 0:03:51is an on-the-spot fine.

0:03:51 > 0:03:53We haven't even made it onto the motorway

0:03:53 > 0:03:57before getting caught up in a dangerous manoeuvre.

0:03:57 > 0:04:00I can understand their frustrations but that is partly some of our job.

0:04:00 > 0:04:02We are catching, erm...

0:04:02 > 0:04:05Just got to deal with this. Yep.

0:04:08 > 0:04:12The driver in front has just overtaken us at an excessive speed.

0:04:12 > 0:04:13He's going to regret that,

0:04:13 > 0:04:16especially if he ends up with a ?100 on-the-spot fine.

0:04:17 > 0:04:20That was a bit stupid of him, wasn't it? Well, the road's clear,

0:04:20 > 0:04:22it's just a question of his speed

0:04:22 > 0:04:24and whether his speed is appropriate.

0:04:24 > 0:04:26We're in a 60 limit. Whilst he's overtaken,

0:04:26 > 0:04:28he hasn't eased off.

0:04:28 > 0:04:30The speed's now 73mph

0:04:30 > 0:04:33and we'll just monitor his speed as we go round the bend.

0:04:33 > 0:04:38It's a question of whether he does reduce his speed or he carries on

0:04:38 > 0:04:42and that allows me to gauge how I might deal with it.

0:04:43 > 0:04:46Unfortunately for this bloke, he's still breaking the speed limit.

0:04:48 > 0:04:50The gap between us hasn't really changed

0:04:50 > 0:04:53and we're still doing 70mph in a 60.

0:04:53 > 0:04:56What's your instincts right now, what are you thinking?

0:04:56 > 0:04:59I think we'll have a word with him.

0:04:59 > 0:05:01Well, he's got no chance of overtaking that... No.

0:05:01 > 0:05:04He's going to be stuck now. So he hasn't really achieved a lot,

0:05:04 > 0:05:07because he's been stuck behind that car.

0:05:07 > 0:05:10But we'll get the driver and just have a quick chat with him.

0:05:10 > 0:05:12SIREN WAILS

0:05:12 > 0:05:15I reckon the penny must have dropped by now.

0:05:16 > 0:05:20What must be going through his mind right now? "Oops."

0:05:20 > 0:05:23He's probably thinking, "Am I going to get a fine for this?"

0:05:30 > 0:05:31Hiya. Afternoon. You all right? Yeah.

0:05:31 > 0:05:34Do you know why I've stopped you? Speeding, I'm guessing.

0:05:34 > 0:05:35Yeah, it is speeding.

0:05:35 > 0:05:39'This is pretty serious - there are kids in the back.'

0:05:39 > 0:05:41Do have any points on your licence at the moment?

0:05:41 > 0:05:44I don't think so, I can't remember. Do you have your licence on you?

0:05:44 > 0:05:48Lovely. Cor, your licence has seen better days, hasn't it? Yeah.

0:05:48 > 0:05:50All right, I'll just do some checks. Sit tight.

0:05:50 > 0:05:52'Sergeant Knight needs to check to see if there are

0:05:52 > 0:05:54'any other issues with this vehicle.

0:05:54 > 0:05:58'If so, the driver could be in line for more than one fine.'

0:05:58 > 0:06:00What's your name? Tom.

0:06:00 > 0:06:03Tom. OK, you obviously didn't realise you overtook us.

0:06:03 > 0:06:05Yeah, I realised it as soon as he put his lights on.

0:06:05 > 0:06:08Yeah. What did you think when that happened?

0:06:08 > 0:06:10I thought, "Not again."

0:06:10 > 0:06:11Not again?!

0:06:11 > 0:06:14I got stopped along this road about ten years ago.

0:06:14 > 0:06:17Right. By a very similar grey BMW. Yeah.

0:06:19 > 0:06:22Oscar 074, if you could do me the vehicle check first

0:06:22 > 0:06:24and then the DL.

0:06:24 > 0:06:27They say lightning doesn't strike twice,

0:06:27 > 0:06:29but I'd say it has for this fella -

0:06:29 > 0:06:33caught speeding AND whilst overtaking an unmarked police car.

0:06:33 > 0:06:36But is he going to get an on-the-spot fine?

0:06:36 > 0:06:39He could be facing ?100 and three points.

0:06:39 > 0:06:41It's the moment of truth.

0:06:43 > 0:06:45So, what will it be?

0:06:53 > 0:06:54All right.

0:06:54 > 0:06:57Right, just ease off your speed, all right?

0:06:57 > 0:07:00I apologise, I know. It's...you know...

0:07:00 > 0:07:01It was overtaking... I know,

0:07:01 > 0:07:04you were frustrated by the line of traffic.

0:07:04 > 0:07:06Yeah...

0:07:06 > 0:07:09In your defence, at least you didn't accelerate any more

0:07:09 > 0:07:10because I think if you had,

0:07:10 > 0:07:13you and me would be having a different conversation, all right?

0:07:13 > 0:07:16Just think about your kids and that. Yeah, I know, the children...

0:07:16 > 0:07:18Yeah, but, you know, try and enjoy the rest of the day.

0:07:18 > 0:07:21All right? Thank you very much. OK, good day to you. That's very kind.

0:07:21 > 0:07:24It's a slap on the wrists this time, no fine for this driver.

0:07:25 > 0:07:28He's let you off with a verbal warning, hasn't he? Yeah.

0:07:28 > 0:07:30Which I think is very nice of him. You're obviously relieved?

0:07:30 > 0:07:32I'm extremely relieved, yeah.

0:07:32 > 0:07:35Honest truth - will it change your driving? Yeah, definitely.

0:07:35 > 0:07:38Yeah. I think it's probably worth saying, isn't it, you know?

0:07:38 > 0:07:40Especially as you've got two young kids in the back. Yeah.

0:07:40 > 0:07:43It's foolish. Yeah, you know it, you said it yourself, didn't you?

0:07:43 > 0:07:46Absolutely. Well, I'm really, really pleased that you didn't end up

0:07:46 > 0:07:49getting a ticket because it would've been painful

0:07:49 > 0:07:51and, you know, a nasty Sunday for you, wouldn't it?

0:07:51 > 0:07:53Yeah, I'm very pleased myself. Tom, take care.

0:07:53 > 0:07:54Thank you, Dominic. Thanks.

0:07:54 > 0:07:56Warren, can I ask why you took the decision then

0:07:56 > 0:07:58not to issue a penalty notice?

0:07:58 > 0:08:00That's the good thing about doing the job we do,

0:08:00 > 0:08:02that we can use common sense.

0:08:02 > 0:08:05Yes. The chap hasn't accelerated away, he's shown some restraint,

0:08:05 > 0:08:08so he's done his overtake and he's been sensible.

0:08:08 > 0:08:10I think that is the balance for me.

0:08:10 > 0:08:13It's not about just giving tickets out. Yeah.

0:08:13 > 0:08:17Because it's important that people understand the risks and, yes,

0:08:17 > 0:08:20he's gone away with a positive attitude, he's gone away thinking...

0:08:20 > 0:08:22And his kids have also gone away with a positive attitude.

0:08:22 > 0:08:24They haven't seen Daddy get a ticket. Yeah.

0:08:24 > 0:08:28I'm a dad myself and, you know, he's had a good day with his kids.

0:08:28 > 0:08:31Yeah. He doesn't want a police officer spoiling it

0:08:31 > 0:08:33by giving him three points and a ?100 fine.

0:08:33 > 0:08:36I tell you what, he wants to go and buy himself a lottery ticket now,

0:08:36 > 0:08:37cos it's his lucky day, doesn't he?

0:08:37 > 0:08:40I would, I'd go and have a lucky dip right now.

0:08:42 > 0:08:44In Pendle, Lancashire,

0:08:44 > 0:08:47Lesley Brooks is an environmental crime officer

0:08:47 > 0:08:49with the local council.

0:08:50 > 0:08:54Her job is to investigate crimes like fly-tipping and littering,

0:08:54 > 0:08:57and hand out on-the-spot fines to the culprits.

0:08:59 > 0:09:02She's had a report from a concerned resident.

0:09:02 > 0:09:04We're going to an area in Nelson

0:09:04 > 0:09:08where there's a problem with waste in the back streets.

0:09:08 > 0:09:10I don't really know much about it.

0:09:10 > 0:09:12I've seen a photograph, it looks a mess,

0:09:12 > 0:09:15so we'll just see what it is when we get there.

0:09:21 > 0:09:25It looks like someone's just emptied their recycle bin.

0:09:27 > 0:09:30The bin vandal has created an eyesore

0:09:30 > 0:09:32and with rotting rubbish on the street,

0:09:32 > 0:09:34the vermin won't be far behind.

0:09:34 > 0:09:36It's up to Lesley to track down the culprit

0:09:36 > 0:09:40and whoever it is could face a ?400 fine.

0:09:41 > 0:09:43It could well have all been in that bin

0:09:43 > 0:09:45and someone else has taken it out.

0:09:45 > 0:09:48Because the bags aren't sealed, we can't...

0:09:48 > 0:09:50Whatever rubbish is here, we wouldn't be able to implicate them

0:09:50 > 0:09:54in regard to fly-tipping because we don't know where it's come from.

0:09:54 > 0:09:56I mean, if it comes from this property,

0:09:56 > 0:09:58they might have put the bags out,

0:09:58 > 0:10:01obviously they've put incorrect waste in that bin,

0:10:01 > 0:10:04because that's a recycle bin, as opposed to a proper bin.

0:10:04 > 0:10:06So I'm going to look where it's come from anyway.

0:10:06 > 0:10:08I'm presuming it's come from here

0:10:08 > 0:10:12and I'm going to give them a knock and ask them what's gone on.

0:10:12 > 0:10:15It's a bit of a mystery to Lesley, but a neighbour might be able

0:10:15 > 0:10:18to shed some light on who could be responsible.

0:10:18 > 0:10:22He had a sheet over his head and he emptied the bin there... Right, OK.

0:10:22 > 0:10:24..went through everything, took what he wanted... Right.

0:10:24 > 0:10:27..then moved down a street.

0:10:27 > 0:10:30When he got to the few bins down there,

0:10:30 > 0:10:32he started emptying the bins down there.

0:10:32 > 0:10:36Right, OK. And there was some scrap outside.

0:10:36 > 0:10:38Well, he decided to just put everything down

0:10:38 > 0:10:40that he'd taken from there and he picked up all the scrap

0:10:40 > 0:10:44and walked away with it. Right, OK. So do you know who this guy is?

0:10:44 > 0:10:46No. No, right. I think he's homeless. Why...?

0:10:46 > 0:10:50Then he came back...and then he came back shortly afterwards

0:10:50 > 0:10:53and collected everything that he'd collected from that bin

0:10:53 > 0:10:57and a few of the others, and took the rest of it away. Right, OK.

0:10:57 > 0:10:58But he'd emptied a few bins

0:10:58 > 0:11:02but the other neighbours cleaned up the mess that they came out to.

0:11:02 > 0:11:04How long's it been like that, then, do you know?

0:11:04 > 0:11:07Just since Monday night. Right, OK.

0:11:08 > 0:11:11What makes you think it's a homeless guy?

0:11:11 > 0:11:13Well, he may not be homeless

0:11:13 > 0:11:16but he's a down and out, no job, whatever.

0:11:16 > 0:11:18Right, thank you very much. Thank you.

0:11:20 > 0:11:23The sheet is down there, what he said, so maybe his story is true.

0:11:23 > 0:11:25I'm still going to knock on the door.

0:11:25 > 0:11:26The plot thickens.

0:11:26 > 0:11:28But however the mess was created,

0:11:28 > 0:11:31Lesley needs to make sure that it gets cleaned up.

0:11:31 > 0:11:34She's going to have a word with the resident of the house

0:11:34 > 0:11:35the bin belongs to.

0:11:37 > 0:11:40I'm an environmental crime officer for Pendle Borough Council.

0:11:40 > 0:11:42All through your back alley, have you seen...?

0:11:42 > 0:11:45No, you go... I'll see you at the other side.

0:11:45 > 0:11:47All right, thank you.

0:11:47 > 0:11:49I'm a bit... I don't know whether we've already got issues with her

0:11:49 > 0:11:53because if you look at the front garden, I didn't want to be...

0:11:53 > 0:11:56We might already be trying to get it a 215 because there's bin bags

0:11:56 > 0:11:58and mattresses in the front garden so...

0:11:58 > 0:12:01I'll just speak to her about this round the back.

0:12:02 > 0:12:07A section 215 order can be used by the council to make untidy residents

0:12:07 > 0:12:11clean up their mess or face a ?1,000 fine.

0:12:11 > 0:12:13But at the moment, Lesley is more concerned

0:12:13 > 0:12:15about the rubbish round the back.

0:12:15 > 0:12:17It was bin day yesterday, wasn't it?

0:12:17 > 0:12:20Yeah. The rubbish obviously is your rubbish.

0:12:20 > 0:12:22Erm...

0:12:22 > 0:12:24When did you put your bin bags out?

0:12:24 > 0:12:28It turns out the bin tipper isn't the only one at fault here.

0:12:28 > 0:12:32Sunday, right. But it's bin day on Tuesday.

0:12:32 > 0:12:36I'm led to believe that some homeless guy has come here

0:12:36 > 0:12:40with a sheet over his head and gone through all your rubbish,

0:12:40 > 0:12:41hence this mess.

0:12:41 > 0:12:45But what's caused that is the fact you've put your bins out too early.

0:12:45 > 0:12:48If you'd put your bins out on the correct day

0:12:48 > 0:12:51in the correct receptacle, then this would've been avoided.

0:12:51 > 0:12:56But you need to recycle as well. If that's your recycle bin...

0:12:56 > 0:12:59See, the stuff that's in there is not all recycling either.

0:12:59 > 0:13:01So you're going to have to sort that out, all right?

0:13:02 > 0:13:05So let's take a look at the facts of this case.

0:13:05 > 0:13:07An overturned bin in the back alley,

0:13:07 > 0:13:10a mystery hooded homeless person

0:13:10 > 0:13:13and unsorted rubbish put out on the wrong day.

0:13:13 > 0:13:17Is it going to be a fine and, if so, for who?

0:13:17 > 0:13:20The stuff here, some of it's recycling and it should be in there.

0:13:20 > 0:13:25You need to split it or you're going to end up fined for not doing that.

0:13:25 > 0:13:27It's no fine.

0:13:27 > 0:13:30Lesley is giving this woman a chance to sort out the mess.

0:13:30 > 0:13:34The mystery homeless guy gets another chance too.

0:13:34 > 0:13:38I know you're not responsible for this mess because I have a witness

0:13:38 > 0:13:41who's just told me about this guy in a sheet

0:13:41 > 0:13:42riffling through your rubbish,

0:13:42 > 0:13:45but if you'd put your bins out on the correct day,

0:13:45 > 0:13:48in the correct receptacle, then this would've been avoided.

0:13:48 > 0:13:51Erm, you're going to have...

0:13:51 > 0:13:54You're going to have to, er, clear it up,

0:13:54 > 0:13:57get some bin bags and get this mess cleared up, and put it back out.

0:13:57 > 0:13:59It's going to be a fortnight.

0:13:59 > 0:14:01All right? It will be double checked.

0:14:01 > 0:14:04You could end up with an order on you. Right, OK.

0:14:04 > 0:14:06Thank you. Thanks, bye.

0:14:09 > 0:14:11It seems this resident has got her work cut out.

0:14:11 > 0:14:14She'll now need to clean up this mess.

0:14:14 > 0:14:17If she doesn't, the council will do it for her and send her the bill.

0:14:26 > 0:14:28Now, I don't know about you,

0:14:28 > 0:14:31but round my way there are lots of different parking rules.

0:14:31 > 0:14:36Single yellows, double yellows, loading, no loading,

0:14:36 > 0:14:38you can't park here but you can park here,

0:14:38 > 0:14:40but only when there's an R in the month.

0:14:41 > 0:14:44It's all very confusing.

0:14:44 > 0:14:46So I'm in Havering on the spot

0:14:46 > 0:14:48with parking enforcement officer Kam

0:14:48 > 0:14:52for a masterclass in parking regulation basics.

0:14:52 > 0:14:54To combat the illegal parking,

0:14:54 > 0:14:58the council gave out 40,000 penalty notices last year.

0:14:58 > 0:15:01I really, really hope that is not a zigzag.

0:15:01 > 0:15:02Ridiculous, look at that.

0:15:02 > 0:15:05You're on the footway, boss. You're not allowed to be there.

0:15:05 > 0:15:07I'm moving. Thank you.

0:15:07 > 0:15:09And after two years on the beat,

0:15:09 > 0:15:14Kam has given out her fair share of fines of up to ?130 a pop

0:15:14 > 0:15:18and that doesn't make her very popular round here.

0:15:18 > 0:15:20In your job, you're never, ever going to have anybody to say to you,

0:15:20 > 0:15:22"Thanks for doing a good job.

0:15:22 > 0:15:25"You're keeping the streets safe and parking well..."

0:15:25 > 0:15:29No-one's ever going to say... It's very rare. How rare?

0:15:29 > 0:15:31It does happen, I'm not going to say that it's never happened.

0:15:31 > 0:15:35It has happened but in six years, I reckon, maybe five or six times.

0:15:35 > 0:15:39Once a year, it comes like Christmas and it goes like Christmas as well!

0:15:39 > 0:15:42In and out, gone. That's when people compliment you?

0:15:42 > 0:15:46Yeah. So... It will normally be after we've sort of...

0:15:46 > 0:15:49responded to a complaint for a dropped kerb... Yeah.

0:15:49 > 0:15:56..or a resident opposite a school, but it will come where we're needed.

0:15:56 > 0:15:59It's not long before Kam spots her first offender.

0:16:01 > 0:16:03That one's staring you in the face, isn't it? Yeah...

0:16:03 > 0:16:06'There's a delivery lorry banged to rights on double yellow lines.'

0:16:06 > 0:16:08So many people think that putting your hazards on

0:16:08 > 0:16:10means you can give them a ticket, doesn't it?

0:16:10 > 0:16:13Yeah. No, that doesn't help, it really doesn't.

0:16:14 > 0:16:17Let's see. No, the driver's gone as well.

0:16:17 > 0:16:18Nowhere to be seen.

0:16:18 > 0:16:21So a lorry parked on double yellow lines

0:16:21 > 0:16:25directly in front of a "no loading" sign.

0:16:25 > 0:16:29Not sure those hazard lights are going to get him out of a fine.

0:16:29 > 0:16:32And just as Kam's about to issue a ticket...

0:16:32 > 0:16:33Is that you?

0:16:33 > 0:16:36Boss, you can't park there. Come on, you know that.

0:16:38 > 0:16:39Right.

0:16:41 > 0:16:42So what happens now?

0:16:42 > 0:16:46'An on-the-spot fine of ?130 could be on its way.'

0:16:46 > 0:16:48Now he says he's just waiting to open the door.

0:16:50 > 0:16:53Sir, you can't wait here.

0:16:53 > 0:16:57Are you not able to just go into the loading bay and then wait there?

0:16:57 > 0:16:59So it's his lucky day now, is it? He doesn't get a ticket?

0:16:59 > 0:17:01Yes, very lucky day.

0:17:01 > 0:17:04The driver escapes without a fine.

0:17:04 > 0:17:06That's exactly what the kerb marks and everything mean.

0:17:06 > 0:17:09No waiting, no loading.

0:17:09 > 0:17:12He's about a metre away from them...from the sign as well so...

0:17:12 > 0:17:16When they say, "I'm just loading or I'm just waiting,"

0:17:16 > 0:17:18but that's exactly what you're not allowed to do here.

0:17:18 > 0:17:20Well, in fairness, there are two loading bays

0:17:20 > 0:17:22about 20 metres up there.

0:17:22 > 0:17:27Yeah, so I can understand if there's really no other alternative.

0:17:27 > 0:17:30'The first fine of the day has been narrowly avoided,

0:17:30 > 0:17:33'all down to the compassion of Kam.

0:17:33 > 0:17:36'Who said parking attendants couldn't be reasonable?

0:17:36 > 0:17:39'But this next car might not be so lucky.

0:17:39 > 0:17:42'It's parked on a single yellow line

0:17:42 > 0:17:46'where parking is restricted between 8.30 and 6.30.

0:17:46 > 0:17:49'And guess what? It's just turned 8.30.

0:17:49 > 0:17:54'This could be an on-the-spot ?130 fine.'

0:17:54 > 0:17:56Where's the signs, then, that tells him...?

0:17:56 > 0:17:59Whenever there's a yellow line, somewhere along the stretch...

0:17:59 > 0:18:01If you see over there, that says,

0:18:01 > 0:18:04"Monday to Saturday 8.30am to 6.30pm." Ah, right, OK.

0:18:04 > 0:18:07They have definitely not been misinformed.

0:18:07 > 0:18:09So, Kam, just explain to me,

0:18:09 > 0:18:11why is this person looking at possibly getting a ticket

0:18:11 > 0:18:13and that one's not?

0:18:13 > 0:18:15This one, you can obviously see

0:18:15 > 0:18:17that is has a disabled badge with a clock.

0:18:17 > 0:18:20Blue badge holders are actually entitled to park

0:18:20 > 0:18:21for up to three hours. OK.

0:18:21 > 0:18:23Obviously, this one is a totally different case

0:18:23 > 0:18:27because it has nothing on display. So it is on a waiting restriction.

0:18:27 > 0:18:31Having said that, every vehicle does get its ten minutes grace now.

0:18:31 > 0:18:33So if... If they've nipped to the lavvy,

0:18:33 > 0:18:36they've got half a chance of not getting a ticket? Yep, basically.

0:18:36 > 0:18:38Let's hope they come back within ten minutes.

0:18:38 > 0:18:40If this person's unlucky and gets a ticket in a minute,

0:18:40 > 0:18:44how much will it be? It will be 65, if it's paid within 14 days.

0:18:44 > 0:18:48130 if not. Yep. It's a lot of money, isn't it?

0:18:48 > 0:18:51'So now we play the waiting game.'

0:18:51 > 0:18:53I sort of feel like I want to shout out

0:18:53 > 0:18:55or press a foghorn or something to warn the driver and say,

0:18:55 > 0:18:57"Come and collect your car, you've got ten minutes."

0:18:57 > 0:18:59Well, probably about eight now.

0:19:00 > 0:19:02That's not going to make someone's day, is it?

0:19:02 > 0:19:04'Tick tock, the clock is ticking.'

0:19:04 > 0:19:06If the driver does manage to come back within the next ten minutes,

0:19:06 > 0:19:09we'll be all right. Unfortunately...

0:19:09 > 0:19:13It's an awful lot of standing around. Yes. And walking. Yes.

0:19:13 > 0:19:15Don't you fancy bringing a little Thermos flask along

0:19:15 > 0:19:16and having a coffee and sitting down

0:19:16 > 0:19:19and dunking your biscuit in it? It's a lot to carry as well.

0:19:19 > 0:19:21I mean, during a day of patrolling,

0:19:21 > 0:19:24you can go through so many drinks and snacks,

0:19:24 > 0:19:26painkillers in case I get a headache,

0:19:26 > 0:19:28you know, things like that. When you say get headaches,

0:19:28 > 0:19:31is that because people are having a go at you? Yeah.

0:19:31 > 0:19:32Really? Definitely.

0:19:32 > 0:19:34After a while, you do need to take a moment and think,

0:19:34 > 0:19:36"Oh, my God, my head's hurting.

0:19:36 > 0:19:37"I'm going to go and have a coffee and..."

0:19:37 > 0:19:39There's someone coming down the street now.

0:19:39 > 0:19:42I wonder if this is the guy. It might be.

0:19:42 > 0:19:45He seems to be twiddling with his phone.

0:19:51 > 0:19:54No. We get that a lot as well.

0:19:54 > 0:19:57How much longer have they got? Got another...about 30 seconds.

0:19:57 > 0:19:59Right, and then that's it, bish, bash, bosh.

0:19:59 > 0:20:01Yep. Talk about the dosh.

0:20:01 > 0:20:03SHE LAUGHS

0:20:03 > 0:20:06'It's not looking good, the time is up.

0:20:06 > 0:20:08'Surely this is an open-and-shut case.

0:20:08 > 0:20:11'The car is parked up on a single yellow line,

0:20:11 > 0:20:13'it's not displaying a blue badge,

0:20:13 > 0:20:16'so there's no lawful reason for it to be there.

0:20:17 > 0:20:20'Kam's given the driver ten minutes' grace

0:20:20 > 0:20:23'but now they could be looking at a hefty fine of...

0:20:23 > 0:20:26'you've guessed it, ?130.'

0:20:26 > 0:20:28Well, in fairness, they had ten minutes' grace.

0:20:28 > 0:20:32Yeah, so if the driver does come back, they can't say,

0:20:32 > 0:20:35"Oh, you've given me a ticket as soon as enforcement starts,"

0:20:35 > 0:20:38because enforcement starts at half past eight,

0:20:38 > 0:20:40we've obviously been here for ten minutes now so

0:20:40 > 0:20:43I would be very annoyed if the driver came back

0:20:43 > 0:20:45and gave me abuse and said, "I've only been here two minutes."

0:20:45 > 0:20:50'Yep, it's a fine - a painful 130 smackers.'

0:20:52 > 0:20:55First one of the day, yeah? Yep.

0:20:55 > 0:20:59'Now Kam's heading off to her next hot spot in the centre of town,

0:20:59 > 0:21:01'where drivers have to pay and display.'

0:21:04 > 0:21:06Romford High Street, not market day

0:21:06 > 0:21:08cos they have market day here I think three times a week,

0:21:08 > 0:21:12which means that this whole street normally would be full of stalls.

0:21:12 > 0:21:13But now it's used as a car park.

0:21:13 > 0:21:15So what Kam's doing, she's going round,

0:21:15 > 0:21:17she's checking if people have bought a ticket.

0:21:17 > 0:21:20If they haven't, they've got about ten minutes', or so, grace.

0:21:20 > 0:21:22What she's doing now is, she's going round,

0:21:22 > 0:21:26she's logging the cars that don't have tickets showing, walking round.

0:21:26 > 0:21:29By the time they come back, if they haven't got one,

0:21:29 > 0:21:31that's it, ticket time. It's all going quite well, actually.

0:21:31 > 0:21:34So far we've been up and down the high street a couple of times

0:21:34 > 0:21:37and not one ticket issued. A good day for the motorists.

0:21:37 > 0:21:40A good day for Kam, really - less paperwork.

0:21:40 > 0:21:42Are you all right there, mam?

0:21:44 > 0:21:45OK.

0:21:46 > 0:21:49This car's driver has left the car,

0:21:49 > 0:21:52but claims her husband has gone to get a ticket.

0:21:52 > 0:21:54If he doesn't come back with one in ten minutes,

0:21:54 > 0:21:59she could be the proud recipient of a ?130 fine.

0:21:59 > 0:22:01You've just put that vehicle under observation, yeah? Mm-hm.

0:22:01 > 0:22:04Explain to me exactly what's going to happen now, then.

0:22:04 > 0:22:06I'm going to go back and check whatever other vehicles

0:22:06 > 0:22:09I've logged in this car park, because it is a big car park.

0:22:09 > 0:22:11I think I've logged about five, six vehicles.

0:22:11 > 0:22:13By the time we come back,

0:22:13 > 0:22:16her observation will be up as well and then obviously if she's...

0:22:16 > 0:22:19She'll either have bought a ticket or we'll move her on.

0:22:19 > 0:22:21If neither happens, then we'll give her a ticket.

0:22:24 > 0:22:28Kam checks out other vehicles while giving the woman her grace period.

0:22:28 > 0:22:30But when Kam returns,

0:22:30 > 0:22:34the women's husband is in the driving seat but still no ticket.

0:22:34 > 0:22:38In fact, now he claims his wife has gone for the ticket.

0:22:39 > 0:22:41Hey there, sir, do you have a ticket?

0:22:44 > 0:22:45All right because...

0:22:45 > 0:22:47I'm sure it's the same vehicle.

0:22:49 > 0:22:53Yeah, I logged this vehicle 15 minutes ago, sir, and...

0:22:53 > 0:22:55Right, she said that you were gone to get a ticket.

0:22:55 > 0:22:57Can you not have a go at me?

0:22:57 > 0:22:59I logged you 15 minutes ago and now you're back,

0:22:59 > 0:23:01now you're back and now you're telling me she's getting the ticket.

0:23:01 > 0:23:03Could you go and get a ticket please, sir? OK. Yeah?

0:23:03 > 0:23:07You've been here for 15 minutes and now you're having a go at me.

0:23:08 > 0:23:10You just... You were about to have a go at me

0:23:10 > 0:23:13until I made it very clear to you that you've already had 15 minutes.

0:23:13 > 0:23:15It's 9.20 now.

0:23:15 > 0:23:19You were logged at 9.05 and at that time, the lady who was sitting here

0:23:19 > 0:23:22said to me that you had gone to get a ticket.

0:23:22 > 0:23:25That is really annoying because he's tried having a go at me,

0:23:25 > 0:23:27claiming that, "Yeah, I'm waiting for her to go and get a ticket."

0:23:27 > 0:23:29But, I'm sorry, 15 minutes ago,

0:23:29 > 0:23:32YOU were going to get the ticket and she was in the driver's seat.

0:23:32 > 0:23:34So don't lie to me and don't raise your voice to me.

0:23:34 > 0:23:36That is just disgusting.

0:23:36 > 0:23:38It looks like this guy's pushing his luck.

0:23:38 > 0:23:43Kam is within her rights to slap a ?130 fine on his windscreen.

0:23:43 > 0:23:44It's not looking good for him.

0:23:45 > 0:23:48This driver has been sat in the car park

0:23:48 > 0:23:50without a ticket for 15 minutes.

0:23:50 > 0:23:53He claims his partner has gone to get change

0:23:53 > 0:23:56but that story is rapidly wearing thin with Kam.

0:23:56 > 0:24:00So will she give him an instant fine or let him off with a warning?

0:24:00 > 0:24:02Right, can you go and get a ticket, sir?

0:24:03 > 0:24:08Right, clearly there is no ticket process here.

0:24:08 > 0:24:10They're not getting change because

0:24:10 > 0:24:12he just told me she was going to get a ticket

0:24:12 > 0:24:15and now he's just jumped out with a note saying I need to get change

0:24:15 > 0:24:18and that's after 15 minutes of an observation.

0:24:18 > 0:24:19I'm very tempted to just tell him...

0:24:19 > 0:24:21Give me a minute? No, I can't give you a minute.

0:24:21 > 0:24:24You're either going to drive off or you're going to get a ticket, sir.

0:24:24 > 0:24:27You've had about 17 minutes now.

0:24:27 > 0:24:29'He's chosen to leave the car park.

0:24:32 > 0:24:37'Another driver escapes a fine, but Kam's not happy.'

0:24:37 > 0:24:39See, that has really annoyed me now.

0:24:39 > 0:24:41Clearly, neither of them have any intention of buying a ticket.

0:24:41 > 0:24:44So if that's really annoyed you and he's well over his stay,

0:24:44 > 0:24:46why didn't you issue a ticket?

0:24:46 > 0:24:48Because, erm...

0:24:48 > 0:24:50A, it would've just escalated the situation.

0:24:50 > 0:24:52If he had refused to move on,

0:24:52 > 0:24:55then I would've given him a ticket straight away.

0:24:55 > 0:24:56But, to be honest, like I said,

0:24:56 > 0:24:58the ticket is supposed to be the last resort.

0:24:58 > 0:24:59If I had given him a ticket,

0:24:59 > 0:25:02it would've purely been because I've let my annoyance get to me.

0:25:02 > 0:25:04We don't do the job personally.

0:25:04 > 0:25:07Personally, I would've loved to have given him a ticket.

0:25:07 > 0:25:08I think he deserved it...

0:25:08 > 0:25:10because was just taking the mick.

0:25:12 > 0:25:14After a morning on patrol,

0:25:14 > 0:25:18Kam's hot under the collar and I'm hot on top.

0:25:18 > 0:25:20One of the hazards of the job.

0:25:20 > 0:25:23I don't want to end up going home looking like a Swan Vesta match.

0:25:23 > 0:25:26I've put too much on now, haven't I? Yeah, you have. Good Lord!

0:25:26 > 0:25:29Do you want some of this? No, not off the top of your head, no!

0:25:29 > 0:25:32Oh. Nothing wrong with the top of my head.

0:25:32 > 0:25:33'It's for your own good, Kam.

0:25:33 > 0:25:35'If I burn my bonce, you'll never hear the end of it.'

0:25:39 > 0:25:42Nothing quite ruins your day like an ominous brown envelope

0:25:42 > 0:25:45arriving through the post with a hefty fine in it.

0:25:45 > 0:25:48Now, you might think that's the end of it and you've got to pay.

0:25:48 > 0:25:52But you'd be wrong. You might be in with a chance to appeal.

0:25:55 > 0:25:58We've been fined for things like going in bus lanes

0:25:58 > 0:26:01without realising it in a place that we don't know.

0:26:01 > 0:26:04It's the modern life we live in - everybody has got no time,

0:26:04 > 0:26:06everybody is in a rush.

0:26:06 > 0:26:10"I'll park here. I'll only be away five minutes."

0:26:10 > 0:26:13They are there probably for half an hour.

0:26:13 > 0:26:16I had a situation where I parked my car in a private housing area

0:26:16 > 0:26:19next to a shop and the sign was facing that way

0:26:19 > 0:26:21and I parked on the other side of it.

0:26:21 > 0:26:23So when I got out, ten minutes in the shop

0:26:23 > 0:26:25and I got a ticket. I was fuming.

0:26:25 > 0:26:26SIREN WAILS

0:26:27 > 0:26:30Well, all is not lost.

0:26:30 > 0:26:33Londoners who dispute their driving and parking fines

0:26:33 > 0:26:35can get their case heard

0:26:35 > 0:26:38at the London Tribunals at Chancery Exchange.

0:26:41 > 0:26:45I'm here today because I received a penalty fine outside my home.

0:26:45 > 0:26:47I took my nephew to the toilet.

0:26:47 > 0:26:48When I came back, I got a ticket.

0:26:48 > 0:26:50It was an emergency situation.

0:26:50 > 0:26:52They should have understood this kind of thing.

0:26:52 > 0:26:55It's probably the fifth time I have been here in the last 12 years

0:26:55 > 0:26:58and on the previous four occasions, I was successful.

0:27:00 > 0:27:03'Today, I've been granted special access

0:27:03 > 0:27:06'to sit in with serial appealer Narinder Marwah's tribunal.

0:27:06 > 0:27:09'He's fighting a ?65 penalty

0:27:09 > 0:27:12'for apparently stopping in a box junction.'

0:27:12 > 0:27:14Why do you feel you've got a case here?

0:27:14 > 0:27:15What happened?

0:27:15 > 0:27:18Actually, Enfield Council,

0:27:18 > 0:27:22they are alleging that I stopped at a box junction,

0:27:22 > 0:27:26whereas I shouldn't have.

0:27:26 > 0:27:33But I think the rules do allow you to stop in a junction

0:27:33 > 0:27:35if you are obstructed by oncoming traffic.

0:27:35 > 0:27:39So even if that was my car, that is what happened to me.

0:27:39 > 0:27:40Give me an idea. How do you feel

0:27:40 > 0:27:42your chances will be with the appeal?

0:27:42 > 0:27:50I have appealed in the last year or so and maybe six times I appealed,

0:27:50 > 0:27:52I won it five times. Really? Yeah.

0:27:52 > 0:27:55As a rule of thumb, would you appeal every single time?

0:27:55 > 0:27:56No, not necessarily.

0:27:56 > 0:28:01If I very clearly see that I was in the wrong, I will pay

0:28:01 > 0:28:04and I have paid.

0:28:04 > 0:28:06My sons have paid, my wife has paid.

0:28:06 > 0:28:08I have advised them to pay.

0:28:08 > 0:28:11If you are clearly in violation of the law, you must pay.

0:28:11 > 0:28:13So you are not just trying to get away with it?

0:28:13 > 0:28:16Of course not. You generally feel you've got a case to answer?

0:28:16 > 0:28:17You will take the time?

0:28:17 > 0:28:19OK, well, we'll be listening in on the case

0:28:19 > 0:28:21so we'll see how you get on.

0:28:21 > 0:28:22I'll have a quick chat with you afterwards.

0:28:22 > 0:28:24Thank you very much. Thank you.

0:28:24 > 0:28:27'So, Narinder might be a dab hand at this,

0:28:27 > 0:28:29'but there is a lot of money at stake.

0:28:29 > 0:28:33'If he loses, his original ?65 fine doubles.'

0:28:33 > 0:28:35Come in, sir, come and have a seat.

0:28:35 > 0:28:39'Making the call is adjudicator Caroline Hamilton.'

0:28:39 > 0:28:41In this case, the enforcement authority,

0:28:41 > 0:28:42the London Borough of Enfield,

0:28:42 > 0:28:44are contesting your appeal.

0:28:44 > 0:28:47They haven't sent a representative to the hearing,

0:28:47 > 0:28:50but they have submitted evidence and they do want to pursue the matter.

0:28:51 > 0:28:56What they are alleging is that on 25th February 2016,

0:28:56 > 0:28:596.29 in the evening,

0:28:59 > 0:29:02your vehicle was seen entering and stopping in a box junction.

0:29:02 > 0:29:05'The council have sent photo and video evidence

0:29:05 > 0:29:07'that they say clearly shows

0:29:07 > 0:29:09'Narinder's vehicle in the box junction.

0:29:09 > 0:29:12'We can't show the video, but it's OK,

0:29:12 > 0:29:14'Caroline's pretty clear what happened.'

0:29:14 > 0:29:16Once your vehicle comes to a halt,

0:29:16 > 0:29:19you're in contravention because you didn't leave the box.

0:29:19 > 0:29:20You're trapped in the box.

0:29:20 > 0:29:24The reason that that box is there is to keep the junction clear.

0:29:24 > 0:29:26Essentially, the regulation is this -

0:29:26 > 0:29:28you mustn't enter the junction

0:29:28 > 0:29:31until you can see that there's a space for you to leave.

0:29:31 > 0:29:34If you do enter the junction before your space is there,

0:29:34 > 0:29:36you're taking a risk.

0:29:36 > 0:29:41'Narinder doesn't deny that there is a vehicle within the box junction.

0:29:41 > 0:29:44'It's just a question of whose car it is.'

0:29:45 > 0:29:49I don't think that the car they are alleging to have done the violation

0:29:49 > 0:29:51was my car. Can you just tell me this?

0:29:51 > 0:29:54Do you not accept that that is your vehicle?

0:29:54 > 0:29:56No. You don't accept it's your vehicle? No.

0:29:58 > 0:30:00Yes, I was there.

0:30:00 > 0:30:02Just pause. You were there?

0:30:02 > 0:30:04You were there on that occasion?

0:30:04 > 0:30:06Yes, I was on the road.

0:30:06 > 0:30:08What you are saying is you are putting them to strict proof

0:30:08 > 0:30:12to show that that vehicle was your vehicle?

0:30:12 > 0:30:14'I'm no expert, but Caroline is,

0:30:14 > 0:30:17'and she's spotted a flaw in Narinder's explanation.'

0:30:17 > 0:30:23What the council are saying is that this is the registration number.

0:30:23 > 0:30:25I'm not denying that. Do you accept

0:30:25 > 0:30:27that that is your vehicle's registration number?

0:30:27 > 0:30:31Yes. So, what you are saying is that the camera that took it

0:30:31 > 0:30:33could have taken it from that vehicle.

0:30:33 > 0:30:35Of course. But that vehicle and that vehicle

0:30:35 > 0:30:37are completely different types of car, are they not?

0:30:39 > 0:30:43'But serial appealer Narinder doesn't think so.'

0:30:43 > 0:30:46They both have this light in the middle.

0:30:46 > 0:30:49From the back, they look identical, yeah.

0:30:49 > 0:30:51So, your case is that this car and that car

0:30:51 > 0:30:53look identical from the back.

0:30:53 > 0:30:54Yes.

0:30:56 > 0:30:58'It feels like stalemate to me.

0:31:00 > 0:31:03'So, there is clearly a vehicle in a box junction

0:31:03 > 0:31:05'but Narinder doesn't believe it to be his.'

0:31:07 > 0:31:09'Caroline has to make a decision.'

0:31:13 > 0:31:15All right, thank you very much, Mr Marwah.

0:31:15 > 0:31:17I am not going to allow your appeal.

0:31:17 > 0:31:19I am satisfied that the vehicle that was filmed

0:31:19 > 0:31:22by the CCTV camera enforcement crew was your vehicle.

0:31:22 > 0:31:24I think you know it was your vehicle.

0:31:26 > 0:31:28What happens now, sir, is that

0:31:28 > 0:31:30I am going to set out in writing why I have reached this decision.

0:31:30 > 0:31:33Essentially, it's because I'm satisfied

0:31:33 > 0:31:36that a contravention did occur.

0:31:36 > 0:31:37'It's not Narinder's day.'

0:31:39 > 0:31:43The penalty amount that is due is ?130.

0:31:43 > 0:31:45'But he's not giving up.'

0:31:45 > 0:31:48From the photograph, it doesn't show that it is my car.

0:31:48 > 0:31:50I understand, sir, that that's your case.

0:31:50 > 0:31:51I don't agree with you.

0:31:52 > 0:31:55'Nice try, Narinder, but Caroline's having none of it.

0:31:55 > 0:31:57'And now it's going to cost him.

0:31:57 > 0:32:00'For Narinder, that's a ?130 fine.'

0:32:05 > 0:32:07So, Narinder, unsuccessful.

0:32:07 > 0:32:09Yes. How are you feeling?

0:32:09 > 0:32:11I am not feeling very happy.

0:32:11 > 0:32:14But I think... I still hold the view

0:32:14 > 0:32:18that the photograph sent by the council

0:32:18 > 0:32:21did not conclusively prove that it was my car.

0:32:21 > 0:32:23If I can be honest, I was sitting in the background

0:32:23 > 0:32:25and I was being fairly silent.

0:32:25 > 0:32:29I felt watching the footage then, I felt that your argument -

0:32:29 > 0:32:32and this is my personal opinion, of course - it wasn't a strong one.

0:32:32 > 0:32:34I felt the decision was quite fair.

0:32:34 > 0:32:36Yes, I still hold the view

0:32:36 > 0:32:41that it cannot be said with 100% certainty that it was my car.

0:32:41 > 0:32:43If you take it as an overall picture now,

0:32:43 > 0:32:45this is your sixth appeal

0:32:45 > 0:32:49and it is only the second time your appeal hasn't been upheld.

0:32:49 > 0:32:51So, generally speaking, you definitely come off better off

0:32:51 > 0:32:53by appealing every time, haven't you?

0:32:53 > 0:32:54Yes, of course.

0:32:54 > 0:32:57Are you happy to accept it now and that's the end of it?

0:32:58 > 0:33:01No, I'll see what I can do about it.

0:33:01 > 0:33:05So you might fight this further? I might. OK. Thanks, Narinder.

0:33:05 > 0:33:06It's been a pleasure. Thank you.

0:33:06 > 0:33:08'It's not a good day for Narinder.'

0:33:08 > 0:33:10But the same can't be said for everyone.

0:33:10 > 0:33:13Almost half of the appeals that are heard here

0:33:13 > 0:33:15are, in fact, successful.

0:33:15 > 0:33:19So, basically, the adjudicator said she has to cancel the ticket.

0:33:20 > 0:33:24Coming here today has gone very smoothly.

0:33:24 > 0:33:26I put my point across.

0:33:26 > 0:33:28I got the answer that I wanted

0:33:28 > 0:33:30and obviously waiting for a letter to confirm that.

0:33:32 > 0:33:33Caroline, you're the chief adjudicator here.

0:33:33 > 0:33:36Do most people leave here, regardless of the results,

0:33:36 > 0:33:39content that they've had the chance to actually speak their mind?

0:33:39 > 0:33:42Obviously I hope, as a tribunal, is that once you come here,

0:33:42 > 0:33:45whether your outcome is a refusal or an allow, you leave here,

0:33:45 > 0:33:47as you've said, contented

0:33:47 > 0:33:49and with perhaps a better understanding

0:33:49 > 0:33:51of why it is the ticket was issued in the first place.

0:33:51 > 0:33:56Unfortunately, of course, there are people who are not happy

0:33:56 > 0:33:58and they will never be happy.

0:33:58 > 0:34:01But that is not something that the adjudicators can change,

0:34:01 > 0:34:02that does happen.

0:34:02 > 0:34:04That's life, isn't it? It is life, yeah.

0:34:12 > 0:34:14In Lincolnshire,

0:34:14 > 0:34:18the beautiful countryside and leafy lanes

0:34:18 > 0:34:20have become a haven for fly-tippers.

0:34:21 > 0:34:24And one man is waging a war on waste

0:34:24 > 0:34:26and those unscrupulous tippers.

0:34:26 > 0:34:29Steve Clegg is a district councillor.

0:34:29 > 0:34:31I'd say that's probably a commercial waste dump.

0:34:31 > 0:34:35My concern there is that it's so close to this main road,

0:34:35 > 0:34:39the A17, that, really, it causes a hazard.

0:34:39 > 0:34:41Not only is it unsightly,

0:34:41 > 0:34:43but it could cause a hazard to the traffic as well.

0:34:43 > 0:34:45So it's a safety concern.

0:34:49 > 0:34:54Anyone caught fly-tipping could be looking at a fine of up to ?50,000

0:34:54 > 0:34:55and even a jail term

0:34:55 > 0:34:58and there's no shortage of tip-offs from the public

0:34:58 > 0:35:00to help Councillor Clegg track them down.

0:35:01 > 0:35:04Oh, you've got fly-tipping down your fen?

0:35:04 > 0:35:07Would I be able to have a look at it today?

0:35:07 > 0:35:09Thanks for the call and we'll see you later.

0:35:09 > 0:35:11Bye.

0:35:11 > 0:35:16With 900,000 incidents a year in England alone,

0:35:16 > 0:35:18fly-tipping has become a country-wide epidemic.

0:35:21 > 0:35:23And Steve has come out to visit James Bourne,

0:35:23 > 0:35:26a local farmer who has been the victim of a fly-tip.

0:35:31 > 0:35:35Hiya, James. Nice to see you again. You all right?

0:35:35 > 0:35:37So, where is it happening, then?

0:35:37 > 0:35:40It's just over here.

0:35:40 > 0:35:42Because the grass is grown, you can't see it.

0:35:42 > 0:35:43Oh, right.

0:35:46 > 0:35:47Oh, my word!

0:35:52 > 0:35:55Someone has fly-tipped a load of waste off the highway,

0:35:55 > 0:35:59which could contain any number of contaminants.

0:35:59 > 0:36:02Without going through it... I don't want to get my hands in it.

0:36:02 > 0:36:06You don't know what's there, do you? You wouldn't want to take the risk.

0:36:06 > 0:36:09To make matters worse, the tip could already be affecting

0:36:09 > 0:36:12the water supply to the farmer's land.

0:36:12 > 0:36:15That's the main drain, you see, that runs along there from Digby.

0:36:15 > 0:36:18Oh, my word. It's going to slip down into the dyke.

0:36:18 > 0:36:19It could seriously pollute

0:36:19 > 0:36:22and that's going to go and wash its way into Digby. That's right, yes.

0:36:22 > 0:36:25This waste should have gone to the local tip,

0:36:25 > 0:36:27but it seems whoever dumped it

0:36:27 > 0:36:31just wanted to avoid the drive and a ?20 charge.

0:36:31 > 0:36:34It's just another example of selfish, lazy behaviour.

0:36:34 > 0:36:37It beggars belief that people would go to the effort of coming here.

0:36:40 > 0:36:44Council cutbacks have seen two local waste sites shut down recently.

0:36:44 > 0:36:4920,000 vehicles a year used to come to this one alone.

0:36:49 > 0:36:51But having to travel a bit further to dump waste

0:36:51 > 0:36:54is no excuse for fly-tipping.

0:36:57 > 0:37:00It's not long before Steve gets another tip-off.

0:37:00 > 0:37:01Oh, my word.

0:37:01 > 0:37:04And, even for him, this one is a shock.

0:37:04 > 0:37:07Absolutely astounding.

0:37:07 > 0:37:08It's blocking a whole road.

0:37:12 > 0:37:14Oh, my gosh!

0:37:16 > 0:37:18It's been tipped right across the roadway.

0:37:20 > 0:37:24Not only is this massive fly-tip blocking a road,

0:37:24 > 0:37:26there's an even bigger problem for Steve.

0:37:26 > 0:37:29He's spotted some potentially deadly waste.

0:37:29 > 0:37:31You've got asbestos.

0:37:31 > 0:37:33We're going to need to get specialist contractors in

0:37:33 > 0:37:36to remove this stuff, cos it is so hazardous.

0:37:36 > 0:37:40This is a really substantial expense for the council now

0:37:40 > 0:37:43because somebody has decided to dump it here,

0:37:43 > 0:37:45rather than dealing with it properly.

0:37:45 > 0:37:48It's almost as if somebody's shed is here,

0:37:48 > 0:37:51with the asbestos or garage.

0:37:51 > 0:37:53Yeah, it's an old garage or something.

0:37:53 > 0:37:55This is serious.

0:37:55 > 0:37:59If Steve can find evidence of who is responsible for this pile,

0:37:59 > 0:38:02they could be facing a huge fine and time in jail.

0:38:02 > 0:38:05Yeah, more speakers. Somebody who likes their music, I would think.

0:38:06 > 0:38:08Seven tyres, eight tyres.

0:38:08 > 0:38:10And more in here. And more in there.

0:38:12 > 0:38:13Oh, my word!

0:38:13 > 0:38:15Oh, God...

0:38:16 > 0:38:18This is incredible!

0:38:18 > 0:38:21So, this is obviously an expense that someone saved themselves

0:38:21 > 0:38:24by just dumping it here and saying, "Thank you very much."

0:38:24 > 0:38:27You and I can pay for it instead.

0:38:28 > 0:38:32Removing and disposing of asbestos is an expensive business.

0:38:32 > 0:38:35Sadly, it looks like the perpetrator has covered their tracks.

0:38:37 > 0:38:39I doubt there's going to be any evidence in here.

0:38:39 > 0:38:43You don't know, but it doesn't look to be if anything is going to be

0:38:43 > 0:38:47retrievable that could track it down to who's actually tipped it.

0:38:47 > 0:38:50With nothing to identify the culprits,

0:38:50 > 0:38:53it's looking like the council will have to foot the entire bill

0:38:53 > 0:38:55to remove this lot.

0:38:55 > 0:38:56It's not quite as simple

0:38:56 > 0:38:59as perhaps some of the other things we've seen.

0:38:59 > 0:39:05They'll need to get contractors in who can remove the materials safely.

0:39:07 > 0:39:10It's dangerous, it's totally inconsiderate.

0:39:10 > 0:39:13It's unbelievable.

0:39:13 > 0:39:15It might be frustrating,

0:39:15 > 0:39:18but for Steve and his colleagues at Lincolnshire County Council,

0:39:18 > 0:39:21the fight against fly-tippers will go on.

0:39:28 > 0:39:30In Wiltshire,

0:39:30 > 0:39:33traffic cop Jay Clifton is on patrol.

0:39:34 > 0:39:38He's stationed on a raised police ramp on the side of the busy M4.

0:39:39 > 0:39:41It's an observation platform,

0:39:41 > 0:39:44so from here we can carry out speed checks,

0:39:44 > 0:39:46I can look at vehicles, I can see the drivers.

0:39:46 > 0:39:48So I can see if people are wearing their seatbelts,

0:39:48 > 0:39:50I can see if the vehicle's...

0:39:50 > 0:39:51or get an idea if a vehicle is overweight.

0:39:53 > 0:39:55It's a good place to sit up and watch the world go by, really.

0:39:55 > 0:39:59Today, he's on the lookout for speeding motorists.

0:39:59 > 0:40:05If he catches any, he can issue them with a ?100 on-the-spot fine

0:40:05 > 0:40:06or even a court summons.

0:40:06 > 0:40:09And it's not long before he spots what he's looking for.

0:40:09 > 0:40:11That'll do. We'll have him.

0:40:19 > 0:40:22So this driver was clocked at 97mph,

0:40:22 > 0:40:26but maybe he's finally spotted the cop car in his rear-view mirror.

0:40:28 > 0:40:30Slowed down a lot now.

0:40:32 > 0:40:35What I'm going to do is take the vehicle off the motorway

0:40:35 > 0:40:38and have a chat with the driver in relation to his speed.

0:40:42 > 0:40:45Just get in front of him and use the "follow me".

0:40:45 > 0:40:48Well, that got the driver's attention.

0:40:48 > 0:40:51Could he be about to get a hefty fine?

0:40:51 > 0:40:53I need to have a quick chat with you about your speed.

0:40:53 > 0:40:56I can see you were travelling faster than the other vehicles

0:40:56 > 0:40:58on the carriageway and so I formulated the opinion

0:40:58 > 0:41:00that you were travelling in excess of the 70mph speed limit

0:41:00 > 0:41:02for the motorway. Inside here is a little red dot,

0:41:02 > 0:41:05I put it on the front of your car, pulled the trigger,

0:41:05 > 0:41:06lasers out at one end to the other,

0:41:06 > 0:41:07at which point it tells me that -

0:41:07 > 0:41:12that you were doing 97mph and that you were 502.6 metres away from me.

0:41:12 > 0:41:14Is there any lawful reason you can give me

0:41:14 > 0:41:17as to why you are travelling at the speed today?

0:41:22 > 0:41:23He's in Exeter?

0:41:23 > 0:41:26It's about 100 miles to Exeter!

0:41:26 > 0:41:28That's a lot of miles at a dangerous speed.

0:41:28 > 0:41:31Do you think you were going to drive all the way to Exeter at that speed?

0:41:33 > 0:41:36It's a bit much, isn't it?

0:41:36 > 0:41:38The problem is, I've never met you before.

0:41:39 > 0:41:41I can't validate that story at the moment, can I?

0:41:41 > 0:41:45I can obviously make a few calls if I need to. It's the truth.

0:41:46 > 0:41:48But if you've got to get to Exeter,

0:41:48 > 0:41:51you want to get there and see your dad.

0:41:51 > 0:41:54What you don't want to do is hit another car at that speed

0:41:54 > 0:41:57and end up killing somebody else. No, I agree with you.

0:41:57 > 0:42:00Do you have your licence with you at all?

0:42:00 > 0:42:03Take a seat there for me. I'm just going to shut these doors

0:42:03 > 0:42:04so we can have a chat.

0:42:10 > 0:42:13Let's take a look at Jay's options here.

0:42:13 > 0:42:17The man was definitely speeding and, at 97mph,

0:42:17 > 0:42:20Jay does have the option to issue the man with a court summons,

0:42:20 > 0:42:22meaning he could lose his licence.

0:42:22 > 0:42:27But he claims he was on the way to hospital in an emergency.

0:42:27 > 0:42:32On this occasion, I'm probably going to take it in the ear for it...

0:42:32 > 0:42:34His story checks out and Jay has decided

0:42:34 > 0:42:37to give him the benefit of the doubt.

0:42:37 > 0:42:39On this occasion, I'm going to let you go

0:42:39 > 0:42:41and that's just me showing a bit of compassion,

0:42:41 > 0:42:45but I need you to be honest with me and make sure you get there safely.

0:42:45 > 0:42:46Do you understand that?

0:42:49 > 0:42:54So there's no fine for this driver - just a firm warning.

0:42:55 > 0:43:00Something tells me the rest of his journey will be at a sensible 70mph.

0:43:00 > 0:43:03It's a tough job, but someone's got to do it.

0:43:03 > 0:43:05Join us next time for Dom On The Spot.

0:43:35 > 0:43:38Has anyone got eyes on Lane?

0:43:38 > 0:43:41What's going to happen to me now?

0:43:41 > 0:43:42Please!

0:43:42 > 0:43:43Move!
