0:01:39 > 0:01:43But there was one group of drivers who popped up again and again.

0:01:43 > 0:01:47Newly qualified drivers are a high risk group on the roads.

0:01:47 > 0:01:51One in five will have an accident within six months of passing their test.

0:01:51 > 0:01:55It's not surprising many of you suggested guys in their teens

0:01:55 > 0:01:58or early 20s. Families like the Gibsons.

0:01:59 > 0:02:04Liam Gibson is a 21-year-old electrician who needs to drive for his job.

0:02:04 > 0:02:07But is bad attitude behind the wheel is driving mum, Janet, to despair.

0:02:07 > 0:02:10When Liam is driving he thinks he owns the road

0:02:10 > 0:02:13and that others are just in his way.

0:02:13 > 0:02:16He gets quite aggressive, tailgates other people.

0:02:16 > 0:02:18The faster he goes, the better.

0:02:18 > 0:02:23It's quite scary. You're doing 70, 80 on a 40 mile an hour road.

0:02:23 > 0:02:24It's fine.

0:02:24 > 0:02:26Liam is a really lovely lad.

0:02:26 > 0:02:29He's very helpful, caring and because I've now got

0:02:29 > 0:02:32multiple sclerosis he is doing more driving for me.

0:02:32 > 0:02:35I've now got an insight in how he does really drive.

0:02:35 > 0:02:38You are either going fast or braking very sharply.

0:02:38 > 0:02:42Or you're swerving around the corner so you get thrown around a bit.

0:02:42 > 0:02:43You are going fast around these bends.

0:02:43 > 0:02:46And it's not just his family that his recklessness affects.

0:02:46 > 0:02:49He cut somebody up and they chased him

0:02:49 > 0:02:51and the only way he could get away from this person was going

0:02:51 > 0:02:53through a red light and managed to lose them.

0:02:53 > 0:02:57And a bout of road rage in his work van led to another run-in -

0:02:57 > 0:02:59this time with his boss.

0:02:59 > 0:03:03Liam got a verbal warning and he was made to contact the driver

0:03:03 > 0:03:05and apologise.

0:03:05 > 0:03:08Liam hasn't had a serious road accident yet but sometime or other

0:03:08 > 0:03:11he will if he carries on and you can tell him

0:03:11 > 0:03:13but he doesn't want to listen.

0:03:15 > 0:03:18It's nine o'clock on a Monday morning. Guess where I am?

0:03:18 > 0:03:22In a chicken farm! It's where Liam's first job of the week is.

0:07:01 > 0:07:07- Over to you, Sandra.- I am totally unimpressed with your driving.

0:07:07 > 0:07:09You show a staggering disregard, not only for your safety,

0:07:09 > 0:07:12but for everybody else on the road.

0:07:12 > 0:07:15We saw you drive at excessive speeds past a school,

0:07:15 > 0:07:19nearly 50mph at school time when the children are coming out.

0:07:19 > 0:07:22You take unnecessary risks on bends in rural areas.

0:07:22 > 0:07:25You don't know what's going to be around the corner.

0:07:25 > 0:07:29If you were taking your driving test today, you would have failed within minutes.

0:07:29 > 0:07:32- What do you think of that? - Hands up in the air. Bang to rights.

0:07:32 > 0:07:36- You have no points on your licence, you've never been in an accident.- No.

0:07:36 > 0:07:38- You are oozing confidence, you feel like king of the road.- Yes.

0:07:38 > 0:07:41But you've gotten into bad habits.

0:07:41 > 0:07:45Sandra is going to try and sort those out for you. Are you up for that?

0:08:21 > 0:08:25- a woman with 15 years' experience behind the wheel.- Ooh, yes.

0:14:34 > 0:14:38You seemed to have a lack of awareness and anticipation

0:14:38 > 0:14:41about what the other road users are doing around you.

0:14:41 > 0:14:44You are consistently driving up the centre of the road.

0:14:44 > 0:14:47What we saw is when you got into busy traffic,

0:14:47 > 0:14:50more faults were starting to be generated.

0:14:50 > 0:14:53I have got real concerns about your driving.

0:14:53 > 0:14:56- Do you want to get better, Jodie? - Yeah, I do.

0:14:56 > 0:14:59Well, Sandra knows what you need to work on,

0:14:59 > 0:15:01and you've got a lot of work to do,

0:15:01 > 0:15:05so go and get a really good rest

0:15:12 > 0:15:16after what I've heard today, it is a little bit soul-destroying,

0:15:16 > 0:15:21but there still is the possibility that, since I've met Phil,

0:15:21 > 0:15:25it's got worse, because the job that I'm in makes me drive bad.

0:15:28 > 0:15:32Coming up, Phil's in the firing line again, with Jodie's driving.

0:15:32 > 0:15:37There's a bump in the bloody road, it's not my fault!

0:15:41 > 0:15:44Many of us are guilty when it comes to watching our speed.

0:15:44 > 0:15:45But, in the blink of an eye,

0:15:45 > 0:15:49high speed can turn into a serious incident.

0:15:49 > 0:15:52Nearly a quarter of fatal road accidents involve a driver

0:15:52 > 0:15:54who was using excessive speed.

0:15:54 > 0:15:57Today, I have joined Durham Police Special Operations Unit

0:15:57 > 0:16:01as they target speeding drivers breaking the 70mph limit

0:16:01 > 0:16:04in a notorious accident blackspot on the A66.

0:16:05 > 0:16:07So he's not even slowed down.

0:16:07 > 0:16:09Either that or he doesn't realise we're the police

0:16:09 > 0:16:11and we're now behind him at 91mph.

0:16:11 > 0:16:12Right, the penny's dropped.

0:16:12 > 0:16:15Were you aware that it's a 70mph speed limit?

0:16:15 > 0:16:18- I am, yes.- Yes, you are.

0:16:18 > 0:16:21- Why were you speeding?- I generally drive to what I think is safe.

0:16:21 > 0:16:24I have three kids in the car and my wife, so I wouldn't drive if I thought it was dangerous.

0:16:24 > 0:16:27But the police know that however confident you are,

0:16:27 > 0:16:30speeding puts you and others in danger.

0:16:30 > 0:16:31If he's got to stop quickly

0:16:31 > 0:16:34then I would suspect he would change his mind and think

0:16:34 > 0:16:38that it was quite dangerous, and he wished he was going a bit slower.

0:16:38 > 0:16:41When accidents happen, the police see first-hand

0:16:41 > 0:16:44the devastating impact of high speed.

0:16:44 > 0:16:47And where there is serious injury or fatality it's up to officers

0:16:47 > 0:16:50from the Serious Collision Investigation Unit

0:16:50 > 0:16:52to establish what caused the crash.

0:16:52 > 0:16:56These specialist police officers use state of the art technology

0:16:56 > 0:16:59and the very latest in vehicle forensics to try and establish

0:16:59 > 0:17:01whether there's a criminal case to answer.

0:17:20 > 0:17:23there's two cars crashed, they're totally smashed up.

0:17:23 > 0:17:25Just the one person injured?

0:17:25 > 0:17:27In this car, but there's another car, there's two in that one.

0:17:27 > 0:17:30Does everyone appear to be completely awake?

0:17:30 > 0:17:32No, he's not awake at all.

0:17:32 > 0:17:34When we get these types of call-outs,

0:17:34 > 0:17:38We know it's either going to be fatal or potentially fatal.

0:17:38 > 0:17:39It's going to be as bad as it gets.

0:17:40 > 0:17:45The scene that PC Gascoigne encountered on 15th August, 2012,

0:17:45 > 0:17:47was one of devastation.

0:17:47 > 0:17:49The driver of a silver Ford Fiesta,

0:17:49 > 0:17:5121-year-old Joseph Weston,

0:17:51 > 0:17:54appeared to have lost control of his car on a bend.

0:17:54 > 0:17:56He swerved into oncoming traffic -

0:17:56 > 0:17:59colliding head-on with a black Citroen C2.

0:17:59 > 0:18:01When the Fiesta came to a halt,

0:18:01 > 0:18:04its driver and the passenger both had broken bones

0:18:04 > 0:18:06But the driver of the second car,

0:18:06 > 0:18:1024-year-old Luke Winter, was fatally injured.

0:18:10 > 0:18:12You don't see somebody

0:18:12 > 0:18:18at seven o'clock at night and then, two hours later,

0:18:18 > 0:18:19you're identifying their body.

0:18:23 > 0:18:28Life before Luke's crash, we were pretty sorted, really.

0:18:28 > 0:18:31Just very happy. We'd got two great kids.

0:18:32 > 0:18:37And then, of course, 15th August arrived and, well...

0:19:20 > 0:19:22Basically, deal with it in a clinical way.

0:19:22 > 0:19:24And what was obvious to you at the time?

0:19:24 > 0:19:27Given the catastrophic damage to both vehicles,

0:19:27 > 0:19:29it was clear it was a high-speed impact.

0:19:32 > 0:19:36The police suspected that a serious crime could have taken place.

0:19:36 > 0:19:40He had caused a horrific collision with massive damage.

0:19:40 > 0:19:44Death by careless driving carries a maximum prison sentence

0:19:44 > 0:19:48of five years, whereas death by dangerous driving

0:19:48 > 0:19:51carries a maximum sentence of 14 years.

0:19:51 > 0:19:52Significantly more serious.

0:19:52 > 0:19:57The driver had not been drinking or using a mobile phone.

0:19:57 > 0:19:59To charge him with the more serious offence,

0:19:59 > 0:20:03the SCIU would need to establish evidence that he'd been speeding.

0:20:03 > 0:20:05To show death by dangerous driving,

0:20:05 > 0:20:07we needed to establish his speed

0:20:07 > 0:20:11to see whether it was excessively high.

0:20:11 > 0:20:15But proving what has really happened in a car accident can be hard.

0:20:16 > 0:20:19To get to the truth, the police had just one option -

0:20:19 > 0:20:22examine the forensic evidence at the scene,

0:20:22 > 0:20:24starting with the tyre marks.

0:20:24 > 0:20:26How can tyre marks help you establish the speed?

0:20:26 > 0:20:29Basically, we work backwards from the resting position

0:20:29 > 0:20:34of the silver Fiesta, and in order to perform these calculations,

0:20:34 > 0:20:36what we do is a skid test.

0:20:36 > 0:20:40The SCIU drive the accident route with a machine

0:20:40 > 0:20:43that records and monitors how the car behaves in a skid.

0:20:46 > 0:20:49Crucially, the test revealed that there was no oil,

0:20:49 > 0:20:51water or problems with the road surface

0:20:51 > 0:20:54that could explain the Fiesta's loss of control.

0:20:54 > 0:20:56And there was another vital find.

0:20:56 > 0:21:01Data told us that after the vehicle had finished spinning

0:21:01 > 0:21:05as it rotated from the collision, it was travelling at 43mph.

0:21:05 > 0:21:07After the collision.

0:21:07 > 0:21:09OK, which is just fractionally under

0:21:09 > 0:21:11- what the speed limit should be anyhow.- Exactly.

0:21:11 > 0:21:15Even though he's had such a severe impact.

0:21:15 > 0:21:18If the Fiesta was doing 43mph after the collision,

0:21:18 > 0:21:22its speed before the crash must have been extremely high.

0:21:22 > 0:21:25And an examination of the wrecked car seemed to prove it.

0:21:25 > 0:21:31We saw that the speedometer of the Ford Fiesta was locked at 94mph.

0:21:31 > 0:21:34That's all the evidence you need, surely? Case watertight?

0:21:34 > 0:21:35If only it was that simple.

0:21:35 > 0:21:39But the forensic lab found a major flaw in the evidence.

0:21:39 > 0:21:42The Fiesta's rev counter was stuck too,

0:21:42 > 0:21:45but at a rate that didn't match the speedo.

0:21:45 > 0:21:46With this inconsistency,

0:21:46 > 0:21:49the dangerous driving case could fall apart.

0:21:51 > 0:21:54Everything was going to come down to forensics with this case.

0:22:50 > 0:22:54you know, tap in the password to my phone to then connect it.

0:22:54 > 0:22:56Sometimes, it feels rude not to answer your phone,

0:22:56 > 0:22:58especially if it's someone you talk to a lot,

0:22:58 > 0:23:01they know you're available, and you just feel like you have to,

0:23:01 > 0:23:03or at least say, "I'm driving, I'll speak to you later on."

0:23:03 > 0:23:06If I'm making a phone call, I take my phone out,

0:23:06 > 0:23:08scroll through my contacts, and then I push the button,

0:23:08 > 0:23:10so isn't that the same as,

0:23:10 > 0:23:12almost practically the same as sending a text?

0:23:14 > 0:23:18For this lot, using the phone in the car is an everyday occurrence,

0:23:18 > 0:23:20but the latest research suggests that all phone use,

0:23:20 > 0:23:21including hands-free,

0:23:21 > 0:23:26has a potentially dangerous impact on your driving performance.

0:23:26 > 0:23:27To find out just how dangerous,

0:23:27 > 0:23:29I've brought Natalia and Stacey with me

0:23:29 > 0:23:31to the Transport Research Laboratory,

0:23:31 > 0:23:34so that Dr Nick Reed can put them through his tests.

0:23:37 > 0:23:40and we're going to ask you to do three drives.

0:23:40 > 0:23:43One as a baseline, to see what your normal driving behaviour's like,

0:23:43 > 0:23:46and then one whilst texting, and then one whilst using a hands-free,

0:23:46 > 0:23:49and I'll be looking at the data, have a look and see how you do.

0:23:49 > 0:23:53They have just a few minutes to get used to both the simulator

0:23:53 > 0:23:56and the route before starting phase one of the test.

0:23:56 > 0:24:00In this first part, Nick will mimic a hands-free conversation,

0:24:38 > 0:24:40I was quite shocked at how I wasn't able to concentrate

0:24:40 > 0:24:42on what somebody was saying to me,

0:24:42 > 0:24:44because I was concentrating on the road,

0:24:44 > 0:24:46and how much concentration it takes.

0:24:46 > 0:24:49Section two of the test. They've now got to send a text

0:24:49 > 0:24:53while Nick monitors the impact on their driving performance.

0:24:56 > 0:24:58That is typical of what we see in these kinds of tests,

0:25:01 > 0:25:06and just notice there, she had to do a real sudden correction.

0:25:07 > 0:25:09There are three parts to the distraction.

0:25:09 > 0:25:12She's thinking about how to compose the message,

0:25:12 > 0:25:15she is taking her eyes off the road, to look at the phone,

0:25:15 > 0:25:17and she's clearly holding the phone

0:25:17 > 0:25:19and taking her hand off the steering wheel,

0:25:19 > 0:25:22- so she's lost control in that respect.- Oh! There she goes.

0:25:22 > 0:25:26Those things together are really what contribute to the distraction.

0:25:26 > 0:25:31Wow! She very nearly drove into the side bank.

0:25:31 > 0:25:34Wow, really? Going to drive up the hill!

0:25:34 > 0:25:37She's really moving all over the place now.

0:25:37 > 0:25:38Yes, this is fairly typical.

0:25:38 > 0:25:40She's lost control of the vehicle,

0:25:40 > 0:25:42drifting from one side of the lane to the other,

0:25:42 > 0:25:44and not managing to keep control.

0:25:46 > 0:25:48So, the text message has just arrived.

0:25:48 > 0:25:50I'm just not sure she would have done.

0:25:50 > 0:25:52The test is over.

0:25:53 > 0:25:55And now it's time for the results.

0:26:21 > 0:26:25in terms of your reaction times, and control of the vehicle.

0:26:25 > 0:26:27That's really scary. Really scary.

0:26:27 > 0:26:29That's a shocking revelation,

0:26:29 > 0:26:32that driving even hands-free can affect your reaction time

0:26:32 > 0:26:35as much as being on the drink drive limit,

0:26:35 > 0:26:37and is no safer than hand-held calls,

0:26:37 > 0:26:41while the effect of texting can be even more dangerous.

0:43:43 > 0:43:47But the evidence gathered by the SCIU meant that the judge was able

0:43:47 > 0:43:51to sentence for the more serious charge of dangerous driving,

0:43:51 > 0:43:54starting with an initial term of nine years in jail.

0:44:00 > 0:44:05The SCIU had succeeded in securing a conviction for dangerous driving

0:44:05 > 0:44:08but for the family, the pain of Luke's death remains.
