0:00:02 > 0:00:05'Tonight on Motorway Cops - Booze and Twos...'

0:00:07 > 0:00:12- Lots and lots and lots of vodka. - '..the search for gangs who transport illegal spirits

0:00:12 > 0:00:14'and counterfeit cigarettes.'

0:00:14 > 0:00:16Keys out! Keys!

0:00:16 > 0:00:19'Targeting criminals in stolen cars.

0:00:19 > 0:00:23'Drivers trying and failing to hide the truth.'

0:00:23 > 0:00:26Don't lie to me when I ask you, "Have you had a drink?" "No, I haven't."

0:00:26 > 0:00:29'And the search for their true identities.'

0:00:29 > 0:00:32His alias names are Macaulay Anthony Conway

0:00:32 > 0:00:34and Christopher Anthony Russell.

0:00:34 > 0:00:39You stood by the fact that your name was Christopher Russell. Clearly it isn't.

0:00:39 > 0:00:45Who in their right mind transports counterfeit goods in a stolen vehicle?

0:00:45 > 0:00:48We seize on the mistakes that criminals make.

0:01:13 > 0:01:16'Britain motorway network drives the economy.

0:01:16 > 0:01:19'Every day, more than two million tonnes of freight is transported

0:01:19 > 0:01:22'along 2,000 miles of roads.

0:01:26 > 0:01:30'But it's not only legal businesses who rely on the motorways.

0:01:30 > 0:01:36'They're crucial for criminals, too, who use them to transport illegal goods and stolen vehicles.

0:01:39 > 0:01:44'On the M6 near Stafford, PCs Jason Roberts and Kevin Shail

0:01:44 > 0:01:48'are on the lookout for a stolen van which is heading their way.'

0:01:48 > 0:01:52- Southbound, Doxey slip. - 'They're in radio contact with two other patrol cars

0:01:52 > 0:01:54'which are already following the van.'

0:01:54 > 0:01:59The other car and the stolen vehicle are now probably just a couple of miles north of our location.

0:01:59 > 0:02:03"Committed. Committed through 14."

0:02:03 > 0:02:05And it is committed on the motorway.

0:02:05 > 0:02:08'The van will be with them in just a few minutes.

0:02:08 > 0:02:10'But stopping a stolen van is always tricky

0:02:10 > 0:02:13'and this time there's an added problem for the cops.'

0:02:13 > 0:02:16Roadworks are starting in a couple of hundred yards

0:02:16 > 0:02:20and the roadworks continue down to the next junction,

0:02:20 > 0:02:24so we won't be trying to stop the vehicle before the next junction.

0:02:24 > 0:02:27That's it going through there.

0:02:27 > 0:02:30So we've now got two police vehicles behind it.

0:02:30 > 0:02:33One marked car, one unmarked. We're going to be joining them.

0:02:33 > 0:02:37'The marked patrol car is just a few feet behind the van.

0:02:37 > 0:02:41'So close, the cops hope they won't be seen by the driver.

0:02:41 > 0:02:44'Inside is PC Richard Elliott, who's in charge of the stop.'

0:02:44 > 0:02:50It's always difficult, with a stolen vehicle, knowing whether they are going to try to make off from you.

0:02:50 > 0:02:54So if we can, we will always try to get other cars to come to us.

0:02:56 > 0:03:00'With PCs Roberts and Shail in place, everything is ready.

0:03:00 > 0:03:02'Well, almost everything.

0:03:02 > 0:03:06'The roadworks have left the hard shoulder completely blocked off,

0:03:06 > 0:03:08'preventing them pulling the van over.

0:03:08 > 0:03:13'But delaying the stop means the driver has more chance of seeing the motorway cops behind him.'

0:03:13 > 0:03:17If the driver's using his mirrors, it's quite possible he knows he's been spotted.

0:03:18 > 0:03:20"Go."

0:03:32 > 0:03:35The van is in lane two at the moment.

0:03:36 > 0:03:39There's two police vehicles in front of us

0:03:39 > 0:03:42and the van's immediately in front of the first police vehicle.

0:03:42 > 0:03:45'The plan is to stop the van before the next junction,

0:03:45 > 0:03:49'but that means the cops have to be ready to move as soon as the roadworks end.'

0:03:49 > 0:03:52"32 to 92, can you just do us a bit of safety, then?"

0:03:52 > 0:03:55"Dropping back."

0:03:56 > 0:04:00'The unmarked car drops back to control the traffic following behind.

0:04:00 > 0:04:03'But if the van driver decides to go for it,

0:04:03 > 0:04:05'the cops could be in trouble.'

0:04:06 > 0:04:08It's a bigger vehicle than we are,

0:04:08 > 0:04:13so the potential is there for him to try and bully his way past.

0:04:15 > 0:04:19'Finally, the hard shoulder is clear and the cops can make their move.'

0:04:19 > 0:04:23- Just confirm you want us to the front.- "Yeah."

0:04:23 > 0:04:25Understood, thank you.

0:04:25 > 0:04:30'As the traffic speeds up again, PC Elliott searches for an opening to get ahead of the van.'

0:04:30 > 0:04:35"The green one. After the green one. The gap in front of that."

0:04:37 > 0:04:39- OK.- "OK, 11, move up."

0:04:39 > 0:04:42'While the marked car stays at the back,

0:04:42 > 0:04:46'Roberts and Shail go to the front to signal to the driver to stop.'

0:04:49 > 0:04:53The vehicle's stopping, he's pulling over onto the hard shoulder.

0:04:55 > 0:04:57"Vehicle's stopped."

0:04:57 > 0:04:59Step out of the van for me, please, if you would.

0:04:59 > 0:05:04I'll explain it all to you in a second. Come and have a seat in our car, mate.

0:05:04 > 0:05:06'The driver is a man of few words

0:05:06 > 0:05:11- 'and just why is about to become clear.'- Afternoon, young man.

0:05:11 > 0:05:13- How are you, mate?- All right.

0:05:13 > 0:05:18- At this moment in time, the van's been reported stolen, so we'll make further enquiries.- Stolen?

0:05:18 > 0:05:26You're under arrest on suspicion of theft of a motor vehicle. We'll find out what's going on with that, OK?

0:05:26 > 0:05:29- Whose van is it?- It's hired.

0:05:29 > 0:05:32- Right, OK. - Have you got the key?- Yeah.

0:05:32 > 0:05:35Anything in the back?

0:05:35 > 0:05:37'It looks like they've hit the jackpot.'

0:05:37 > 0:05:40Lots and lots and lots of vodka.

0:05:40 > 0:05:47It's a stolen van, it's not a big leap to think there might be other stolen articles in the back.

0:05:47 > 0:05:53'PC Elliott suspects it may be the work of a criminal gang who prowl the motorways at night.'

0:05:53 > 0:05:58It's not unheard of for us to come across incidents

0:05:58 > 0:06:03where goods vehicles have been attacked on the motorway network or close to the motorway network

0:06:03 > 0:06:06when the trailers have had their curtains slashed

0:06:06 > 0:06:09and the goods stolen from the trailers,

0:06:09 > 0:06:12usually while the driver's asleep in the cab at the front.

0:06:12 > 0:06:14Yeah, this VW got stopped.

0:06:14 > 0:06:18For your info, he's got 86 boxes of vodka

0:06:18 > 0:06:22that's been resealed up containing 12 bottles.

0:06:22 > 0:06:25Do you want to open one? Glen's Vodka.

0:06:25 > 0:06:29- It just seems strange that it's taped up.- Mm.

0:06:29 > 0:06:32'But the condition of the packaging raises another possibility.

0:06:32 > 0:06:37'This may not be stolen vodka, but something much more interesting.'

0:06:37 > 0:06:40You might expect the odd box to have been looked at

0:06:40 > 0:06:45but every single box seemed to have been sealed in an amateur way, if you like.

0:06:45 > 0:06:50So I think that began to change our opinions as to what the vodka was.

0:06:50 > 0:06:54'Although the vodka is labelled as a reputable brand,

0:06:54 > 0:06:57'the cops think it might not be made by the genuine manufacturer.

0:06:57 > 0:07:01'They suspect that it's counterfeit, or fake vodka.'

0:07:01 > 0:07:03A normal distributor of alcohol

0:07:03 > 0:07:09wouldn't have boxes that had been opened and resealed badly if it's genuine vodka.

0:07:09 > 0:07:13'The van and the man will be taken away

0:07:13 > 0:07:16'while the cops try to work out where the vodka has come from.

0:07:21 > 0:07:25'On the M6 near Birmingham, the early evening rush hour is underway.

0:07:25 > 0:07:29'Motorway cops Dave Glover and Gareth Westbury are parked up out of the traffic.

0:07:29 > 0:07:33'They've received intelligence about another van which is on the move.

0:07:33 > 0:07:38'This one is thought to be full of thousands of counterfeit cigarettes.'

0:07:44 > 0:07:47'The van's just been spotted on the motorway

0:07:47 > 0:07:50'and PCs Glover and Westbury are on their way to intercept it.

0:07:50 > 0:07:53'But Birmingham's rush-hour traffic is taking its toll.

0:07:55 > 0:08:00'More than one billion counterfeit cigarettes are seized every year in the UK.

0:08:00 > 0:08:06'Millions more slip through the net, resulting in a massive loss of £200 million for the tax man.

0:08:06 > 0:08:10'The cops are keen that at least this load won't be part of the statistics.

0:08:11 > 0:08:15'As they head north, they tail an unmarked police car,

0:08:15 > 0:08:17'also on the way to stop the van.

0:08:17 > 0:08:21'But they're still more than two miles away from where it was last seen.'

0:08:22 > 0:08:27It's just been sighted by an officer near to the Perry Barr location.

0:08:27 > 0:08:32So we're making towards that location to give the officer some support cos he's single crew.

0:08:32 > 0:08:36'As the traffic finally clears, they spot the van ahead

0:08:36 > 0:08:39'just as it's being pulled over by yet more motorway cops.

0:08:53 > 0:08:58'As the driver is cuffed, PC Glover checks the back of the van.'

0:08:59 > 0:09:02As you can see, a van full of boxes.

0:09:06 > 0:09:11'And it looks like they've struck gold. Boxes and boxes of gold.'

0:09:11 > 0:09:14We suspected he was carrying counterfeit cigarettes.

0:09:14 > 0:09:17As you can see, full of cigarettes.

0:09:19 > 0:09:25- Times 200.- Yeah, times 50 boxes. Half a million.

0:09:25 > 0:09:28'More than half a million cigarettes is a great result for the cops

0:09:28 > 0:09:33'but not for the driver of the van, who is known to the police.'

0:09:33 > 0:09:36When was the last time you were arrested roughly?

0:09:36 > 0:09:39I'm just trying to think. Erm...

0:09:39 > 0:09:41- It's got to be two or three years ago.- OK.

0:09:41 > 0:09:44'PC Glover suspects he's in it up to his neck.'

0:09:44 > 0:09:49It may well be that he's got links with some people that are making counterfeit cigarettes.

0:09:49 > 0:09:53It may be that they've smuggled them into the country via other means

0:09:53 > 0:09:57and he's got links with them and he's been to collect them.

0:09:57 > 0:10:01It may be that he's supplying corner shops who don't want to pay the tax.

0:10:01 > 0:10:05At this stage, we don't know what's involved in relation to this vehicle

0:10:05 > 0:10:08or where they're going or where they're from.

0:10:09 > 0:10:14'But what is clear is that this arrest will keep the cops busy all night long.

0:10:16 > 0:10:20'20 miles further north at Cannock Police Station,

0:10:20 > 0:10:23'the van driver arrested with what the cops believe is counterfeit vodka

0:10:23 > 0:10:26'is being questioned by PC Shail.

0:10:26 > 0:10:30'The van is also reported stolen but the man claims it's hired.'

0:10:30 > 0:10:32When did you hire it?

0:10:32 > 0:10:36What happened, my mate told me yesterday, "Will you do us a favour?

0:10:36 > 0:10:41- "Will you drop a delivery off to London?"- Right.

0:10:41 > 0:10:45So I gave him my licence and everything and he got us the van

0:10:45 > 0:10:48- and he said, "It's hired from- BLEEP - and I've got the hire agreement."

0:10:48 > 0:10:52'But he hasn't got any documents to back up his story.'

0:10:52 > 0:10:58It's normal for people without the proper paperwork for such things to just plead ignorance.

0:10:58 > 0:11:02"I'm just a driver, I'm just doing it as a favour for a friend."

0:11:02 > 0:11:05- Who's this friend?- He's called Imran.

0:11:05 > 0:11:08- Imran who?- Er, Shivag, I think.

0:11:08 > 0:11:12- So he's asked you to do the delivery and provided you with the van, has he?- Yeah.

0:11:12 > 0:11:15Have you got a contact number for Imran?

0:11:15 > 0:11:17Imran...

0:11:17 > 0:11:21I did, but he's usually on a private number.

0:11:22 > 0:11:26So how can we get hold of Imran, then, to verify your story?

0:11:26 > 0:11:30- Erm, you'll have ring- BLEEP - and ask them.

0:11:31 > 0:11:35Cos he got the van from them.

0:11:36 > 0:11:41'Until he comes up with a more convincing story, the cops are going to keep hold of him.'

0:11:42 > 0:11:45Would you like to speak to a solicitor?

0:11:45 > 0:11:48Er...no.

0:11:48 > 0:11:52You don't. OK. I do have to remind you, you can speak to one on the telephone

0:11:52 > 0:11:56and ask you if there's any reason why you don't want to speak to one at this time?

0:11:56 > 0:12:01- You don't have to give me a reason, it's just something I have to ask. - Cos it's...

0:12:01 > 0:12:05- I mean, the van's not stolen.- OK.

0:12:06 > 0:12:10The delivery's come from a cash and carry, so...

0:12:10 > 0:12:14'His latest story is that the vodka is from a cash and carry store.

0:12:14 > 0:12:17'But that fails to impress PC Elliott.'

0:12:17 > 0:12:21You wouldn't expect to see that amount of alcohol without some kind of receipt,

0:12:21 > 0:12:23some kind of bill from a cash and carry.

0:12:23 > 0:12:27So if nothing else, it'll be a customs-related incident.

0:12:27 > 0:12:31We'll find out where the vodka's come from.

0:12:31 > 0:12:35'And his first line of enquiry is the internet.'

0:12:35 > 0:12:38Using one of the many police tools available to us, Google,

0:12:38 > 0:12:41I was able to find out a bit more about Glen's Vodka

0:12:41 > 0:12:43and the counterfeiting of it.

0:12:43 > 0:12:48'Glen's Vodka is a genuine and popular brand,

0:12:48 > 0:12:53'but one that is being used by the crooks to pass off their substandard and often dangerous liquor.'

0:12:53 > 0:12:57When something's counterfeited, what you're getting is an inferior product.

0:12:57 > 0:13:02They're not going to be subject to the same kind of control measures

0:13:02 > 0:13:05that properly-produced alcohol will be,

0:13:05 > 0:13:10so it will be produced as cheaply as possible

0:13:10 > 0:13:17and that could be under conditions that are extremely unhygienic or whatever,

0:13:17 > 0:13:21but the actually purity of the alcohol itself can be extremely bad for you.

0:13:23 > 0:13:26The counterfeiters that are making this illegal alcohol,

0:13:26 > 0:13:31they're not worried about what they put into it. They don't care about your health.

0:13:31 > 0:13:34All they're interested in doing is making the product

0:13:34 > 0:13:36as quickly and as cheaply as possible,

0:13:36 > 0:13:38getting it out there and making a quick buck.

0:13:38 > 0:13:41'This batch of fake vodka will be destroyed.

0:13:41 > 0:13:45'It's a small proportion of more than seven million litres of alcohol seized last year.

0:13:45 > 0:13:49'But not every seizure is so easy.'

0:13:49 > 0:13:54There are thousands of white vans on the road. We picked on this particular one

0:13:54 > 0:13:56because it had a stolen report on it.

0:13:56 > 0:14:02Who in their right mind transports counterfeit goods in a stolen vehicle?

0:14:03 > 0:14:06We seize on the mistakes that criminals make.

0:14:08 > 0:14:11'As well as stolen goods, the motorways are also used

0:14:11 > 0:14:16'to quickly move stolen cars from one part of the country to another.

0:14:16 > 0:14:20'And the Midlands, the hub of the network, is often the best place to intercept them.'

0:14:21 > 0:14:25- I've got the reg. Can you give us the make and colour?- It's a Land Rover.

0:14:25 > 0:14:29"Green Land Rover Range Rover."

0:14:29 > 0:14:32'The stolen Range Rover is travelling south on the M6.

0:14:32 > 0:14:35'PCs Roberts and Shail are on their way to intercept it.'

0:14:35 > 0:14:39A high-powered vehicle had recently been stolen from a house.

0:14:39 > 0:14:42Intelligence was good. It was definitely a stolen vehicle.

0:14:43 > 0:14:47- We're making 11A. - 'The car was stolen up in Lancashire

0:14:47 > 0:14:50'and officers from the Greater Manchester Police are following it.'

0:14:50 > 0:14:55- "Officers from GMP are in a black Honda Civic."- Understood. Thank you.

0:14:55 > 0:15:00'The plan is for the motorway cops to help their Manchester colleagues stop the car.

0:15:00 > 0:15:05- 'But they're two miles from the nearest junction.'- This is a race against time to get onto the motorway

0:15:05 > 0:15:08and see if we can catch up with this vehicle and intercept it.

0:15:08 > 0:15:11'PC Elliott has also joined the hunt.'

0:15:11 > 0:15:14"32, we're just approaching 12."

0:15:14 > 0:15:16We're 30 seconds from 11.

0:15:16 > 0:15:21'Major roadworks on the southbound carriageway are causing traffic to slow.

0:15:21 > 0:15:26'But this time the roadworks may help the cops by delaying the progress of the stolen car.'

0:15:26 > 0:15:31- Three lanes static. - Three lanes of static traffic. - It hasn't hit 11A yet.

0:15:31 > 0:15:36- 'The question is now whether the target car has already passed by the junction.'- Tango 11.

0:15:36 > 0:15:40Can you just confirm, has it gone through 11A, please?

0:15:40 > 0:15:43- "Not according to the system. Bear with me."- Three lanes static.

0:15:43 > 0:15:46Yeah, received. We'll remain static, then.

0:15:50 > 0:15:57At the moment, we've got three lanes of static traffic. We know the car is just a short distance behind us now.

0:15:57 > 0:16:00It's literally probably just a mile, if that.

0:16:00 > 0:16:05We'll wait for it to come through the traffic, which has really played into our hands.

0:16:06 > 0:16:10'But spotting the Range Rover amongst the HGVs is proving a problem.'

0:16:10 > 0:16:14There were hundreds and hundreds of vehicles on the motorway, slow-moving traffic,

0:16:14 > 0:16:17and it was a bit like looking for a needle in a haystack.

0:16:17 > 0:16:21- "Approaching 11A." - They'll be with us very shortly.

0:16:25 > 0:16:29- What's that one over there?- No.

0:16:31 > 0:16:36There's a Range Rover. Can't see the colour.

0:16:36 > 0:16:40That's a black Civic behind it, isn't it?

0:16:40 > 0:16:42I couldn't see the reg of that Range Rover.

0:16:42 > 0:16:47- Yeah, that's it, mate. That's it. - We might be behind it, then.- Yeah, we think we're behind it. Stand by.

0:16:47 > 0:16:50- Stay there!- Yes, yes, we are behind it. We're going to go for it.

0:16:50 > 0:16:53'As the cops force their way into the traffic,

0:16:53 > 0:16:56- 'the order to strike comes in.' - "Do it now, do it now."

0:16:59 > 0:17:02- SIREN WAILS - Stay there!

0:17:04 > 0:17:07- Keys now! Keys! - Get out of the car now!- Hang on!

0:17:07 > 0:17:14- What's going on?- You're nicked for the theft of a car.- I'm not going to try anything, don't worry.

0:17:14 > 0:17:19- 'The driver has been taken completely by surprise.'- I'm not going to do anything, don't worry.

0:17:20 > 0:17:23- Travelling on your own?- Yes. - No cars following you?- No.

0:17:23 > 0:17:26- Where you going to?- Home. - Where's home?- Nuneaton.

0:17:38 > 0:17:43- OK, you've been nicked for the theft of this motor.- Yeah, I presume so. - Where have you got it from?

0:17:43 > 0:17:46- I just got it from...- You bought it?

0:17:46 > 0:17:50- No, I've been asked to drive it down here. - OK. Mind over a minute, our kid.

0:17:51 > 0:17:54'Once safely off the motorway,

0:17:54 > 0:17:57'the cops can have a closer look at the £50,000 motor.'

0:17:57 > 0:18:02The vehicle was stolen from a burglary, with keys, yesterday in the Manchester area.

0:18:02 > 0:18:05So, all in all, a good result.

0:18:05 > 0:18:08'The thieves have given the car just a rudimentary disguise.'

0:18:08 > 0:18:12Basically, they've tried to alter the identity

0:18:12 > 0:18:18by putting false number plates on from another vehicle, a similar vehicle,

0:18:18 > 0:18:23and they've also covered up the visible chassis number of the vehicle.

0:18:23 > 0:18:25However, being the masterminds they are,

0:18:25 > 0:18:30they've left the original tax disc in with the original stolen number on.

0:18:30 > 0:18:34It's already on false plates, it's clearly being taken somewhere for another purpose,

0:18:34 > 0:18:38be that for breaking for spares or what, I don't know,

0:18:38 > 0:18:42but because it's a bit of a quick disguise job on the number,

0:18:42 > 0:18:45it may be that it's going to be broken for spares somewhere

0:18:45 > 0:18:49as opposed to a complete new identity on it.

0:18:49 > 0:18:54'And for PC Roberts, catching the driver is not the only satisfaction.'

0:18:54 > 0:18:58That is a nice piece of work, when you can get these type of people off the road

0:18:58 > 0:19:03and recover somebody's pride and joy in one piece without any damage being caused to it.

0:19:03 > 0:19:08'While the cops arrange for the car to be returned to its owner, at Cannock Police Station,

0:19:08 > 0:19:11'PCs Shail and Roberts are booking the driver in.

0:19:11 > 0:19:14'They're discovering that he's no stranger to stolen cars.'

0:19:14 > 0:19:18- As I tried explaining, I'm actually on bail at the moment.- Yeah.

0:19:18 > 0:19:22- What's the offence you're on bail for?- Theft of a motor vehicle.

0:19:22 > 0:19:27That's what it's for. But they've bailed me because...

0:19:27 > 0:19:31- Not the same one?- No, they're under the impression that...

0:19:31 > 0:19:36Before they got all the evidence together, they were informed that I'd committed a burglary

0:19:36 > 0:19:40and it's actually come to light that I was nowhere near the area

0:19:40 > 0:19:44when it was supposed to have happened, so they had to bail me pending further enquiries.

0:19:44 > 0:19:49'This time, there won't be any confusion about whether he's involved or not.

0:19:49 > 0:19:51'He knows he's well and truly in the frame.'

0:19:51 > 0:19:54- Are you seizing his clothing?- Yes.

0:19:54 > 0:19:58What are you seizing my clothes for? No other force has seized my clothes.

0:19:58 > 0:20:00Go in this one here. Is that one being used?

0:20:02 > 0:20:08- This is a joke. Why didn't the police stations... - Different offence, mate.

0:20:08 > 0:20:12- It's the same thing.- It's not. - They got me for the same thing. - The stolen Range Rover?

0:20:12 > 0:20:16- No, they've caught me with another Range Rover. - Obviously you've got a problem.

0:20:16 > 0:20:21I'm not going to argue, it's not an interview. If you can't do the time, don't do the crime.

0:20:21 > 0:20:24- I've been in prison enough times. - You should've learnt.

0:20:24 > 0:20:30- Left.- 'He'll spend tonight in a cell until the Manchester cops decide how to deal with him.'

0:20:30 > 0:20:32Okey doke.

0:20:35 > 0:20:39There's a feeling of satisfaction when you get somebody like that off the streets.

0:20:39 > 0:20:45I'm happy if, at the end of the day, I can lock up the bad guys, put them behind bars where they belong.

0:20:46 > 0:20:49'13 miles further south in West Bromwich,

0:20:49 > 0:20:53'PCs Dave Glover and Gareth Westbury are bringing the van driver

0:20:53 > 0:20:57'caught with half a million counterfeit cigarettes into custody.

0:20:57 > 0:21:02'The arrest has resulted in police and customs officers raiding a property in the city.'

0:21:05 > 0:21:08A warrant has been executed at an address in Spar Hill

0:21:08 > 0:21:12where that vehicle is believed to have come from.

0:21:12 > 0:21:17We don't know, at this stage, what this chap's involvement is in this case.

0:21:17 > 0:21:22Customs and Excise are sending a team over, one, to search the van and recover all the property,

0:21:22 > 0:21:28and two, to come here and interview this chap in relation to his involvement in what we've got today.

0:21:34 > 0:21:37- What's your name, please?- BLEEP

0:21:38 > 0:21:40- Been arrested before?- Yes, mate.

0:21:41 > 0:21:46After caution, he stated he was asked by a friend

0:21:46 > 0:21:50to take the van and take it back.

0:21:50 > 0:21:55'Another "asked by my friend" story which isn't going to help the cops much.

0:21:55 > 0:21:59'But the cops are not concerned with getting information, they're more interested

0:21:59 > 0:22:04'in stopping him passing information on to his mates before the operation is completed.'

0:22:04 > 0:22:07I think my colleague spoke to the duty inspector

0:22:07 > 0:22:14about rights being delayed, phone call and information.

0:22:14 > 0:22:16As the officer's explained,

0:22:16 > 0:22:21the inspector has authorised that your right in relation to have somebody informed you're here

0:22:21 > 0:22:24and to have a phone call is being withheld at the moment.

0:22:24 > 0:22:29'PC Glover has no time for the organised gangs who deprive the government of revenue.'

0:22:29 > 0:22:33We have to pay tax. We're taxed to the hilt. Why shouldn't they?

0:22:33 > 0:22:35Why should people get away with it?

0:22:37 > 0:22:41- No sympathy at all. - 'While the man stews in the cells,

0:22:41 > 0:22:44- 'news of the raid is coming in.'- Ta.

0:22:44 > 0:22:48The update is that there was one person there

0:22:48 > 0:22:53and there's been around about two million cigarettes recovered from that address.

0:22:53 > 0:22:57So, overall, quite a good outcome.

0:23:00 > 0:23:03'Further east, the rush hour is easing off.

0:23:07 > 0:23:11'PCs Alan Colman and Kevin Whitehouse are leaving the motorway

0:23:11 > 0:23:14'and heading back into Birmingham City Centre.

0:23:14 > 0:23:17'But as they do so, they receive a call for help in locating a car.'

0:23:17 > 0:23:22"Right down Summer Hill Road, it's in lane two. A Chrysler Neon."

0:23:22 > 0:23:28We've had a report that a vehicle that made off from officers a few days ago, a Chrysler Neon,

0:23:28 > 0:23:34is believed to be in the city centre. We don't know which way it's going to come at the moment.

0:23:35 > 0:23:40'The car hasn't been stolen, so the reason why it failed to stop last time is a mystery.'

0:23:40 > 0:23:43The first thing that comes into your mind is it will fail to stop again

0:23:43 > 0:23:47so you have to prepare yourself that you may get into a pursuit

0:23:47 > 0:23:49with that person.

0:23:49 > 0:23:52And the other reason is, why has it failed to stop in the first place?

0:23:52 > 0:23:57- Are they committing crime? Is it someone that's wanted?- 'But the cops do know where the owner lives

0:23:57 > 0:24:03- 'and think the driver could be heading there now.'- Do you want to just go to nine?- Yeah.

0:24:03 > 0:24:06We decided to go up towards Tamworth way,

0:24:06 > 0:24:10as the vehicle was registered to there and had connections to that area.

0:24:10 > 0:24:15- That might be it. That's it. - 'They've guessed right.

0:24:15 > 0:24:21'The car is up ahead. PC Colman reckons he's just born lucky.'

0:24:21 > 0:24:23'I do have a knack of doing that.' That's him.

0:24:23 > 0:24:26'I have a knack of being in the right place at the right time.'

0:24:26 > 0:24:29Just a bit of luck, I think.

0:24:29 > 0:24:34'As they catch up with the car, it's obvious something's very wrong.'

0:24:34 > 0:24:37- Oh, he's all over the road here. - We'll tail him for a bit.

0:24:39 > 0:24:42'The car is weaving across the lanes. Drink may be an issue.

0:24:42 > 0:24:45'And because the car failed to stop last time,

0:24:45 > 0:24:47'there's a good chance it'll do so again.'

0:24:47 > 0:24:50The car had a report on it for failing to stop.

0:24:50 > 0:24:53So it's best to follow that vehicle for as long as you can

0:24:53 > 0:24:56and get other resources into position

0:24:56 > 0:25:00so if they manage to get away from you, you stand a good chance of catching them.

0:25:00 > 0:25:02- Bit erratic, isn't he? - He's all over the place.

0:25:06 > 0:25:11'While the roads stay quiet, the cops will follow until backup arrives.'

0:25:12 > 0:25:17Yeah, 22, he's 80 miles an hour. Little bit erratic in the lanes.

0:25:17 > 0:25:19On the run up to junction nine. Stand by.

0:25:21 > 0:25:23'But as the car approaches a junction,

0:25:23 > 0:25:27'the driver shows little sign of slowing.'

0:25:27 > 0:25:30Going through the red light.

0:25:31 > 0:25:34'This is now getting increasingly dangerous.'

0:25:37 > 0:25:40He's off at junction nine on the A446

0:25:40 > 0:25:43towards The Belfry, over.

0:25:43 > 0:25:47'The vehicle was weaving all over the road and it was getting very close to the kerb

0:25:47 > 0:25:51'and I know the area quite well cos I live there.'

0:25:51 > 0:25:57- He's bladdered, this bloke.- 'There's still no sign of any other patrols. As the car heads towards a town,

0:25:57 > 0:26:01- 'the cops are forced to make a decision.'- We'll have to do him. We're getting to a built-up area.

0:26:01 > 0:26:03- Yep.- Yep.

0:26:04 > 0:26:10'I wanted the vehicle stopped before we engaged in a pursuit through built-up areas.'

0:26:10 > 0:26:15It's more dangerous to pursue a vehicle through built-up areas than it is through the countryside.

0:26:15 > 0:26:18I took the choice that we should try and stop the vehicle.

0:26:18 > 0:26:2160 miles an hour.

0:26:22 > 0:26:2622, lights are on. He is braking. Stand by.

0:26:28 > 0:26:31'Fortunately, the driver's seen sense.'

0:26:31 > 0:26:3422, the vehicle's stopped. Stand by.

0:26:34 > 0:26:36'Just as a patrol car arrives.'

0:26:39 > 0:26:41Hiya.

0:26:41 > 0:26:43When it was eventually stopped,

0:26:43 > 0:26:47I was a little bit shocked at what appeared from the driver's seat.

0:26:47 > 0:26:51- Oh, dear.- Come and have a seat in the back of our car, please.

0:26:51 > 0:26:56I assumed it was a male because, rightly or wrongly, most people we pursue,

0:26:56 > 0:26:59most people I've pursued in my life as a police officer have been males.

0:26:59 > 0:27:02- Hello.- Hiya!

0:27:04 > 0:27:08- God, what have I done? - Your driving's all over the place.

0:27:08 > 0:27:11- 60?- Yeah, but you're like this.

0:27:11 > 0:27:14- I'm not.- You are.- 60?

0:27:14 > 0:27:19'Her behaviour is convincing the cops that she may have been drinking.'

0:27:19 > 0:27:22Listen, I've been at work for 15 hours.

0:27:22 > 0:27:24I'm sorry. No, no...

0:27:24 > 0:27:27The thing is, you went through a red light, as well.

0:27:27 > 0:27:31I've got three kids at home. I've been up since half past seven this morning.

0:27:31 > 0:27:37All I want to do is get home. You... No, not you. No disrespect.

0:27:37 > 0:27:41- I appreciate your job. This is me. I work in a casino.- Mm-hm.

0:27:41 > 0:27:45- If you can appreciate that. - Yeah.- I really, honestly...

0:27:45 > 0:27:48At the end of the day, we want to make sure you get home safely.

0:27:48 > 0:27:52- When you go onto the hard shoulder and swerve...- Do you know what?

0:27:52 > 0:27:56..particularly at this time in the morning, from the manner of your driving,

0:27:56 > 0:28:00you've gone up the M42, exited at junction nine and gone through a red light.

0:28:01 > 0:28:05- I'm just trying to think. - When you've come off at junction nine, the big island.

0:28:05 > 0:28:08- It means nothing to me. - And then coming down here...

0:28:08 > 0:28:10I put my hands up to that. I do.

0:28:10 > 0:28:15Because I'm... No, I've really got no excuse.

0:28:15 > 0:28:20I'm not going to even argue, because I can't. There's nothing I can say.

0:28:20 > 0:28:23- Can you just give me a quick breath test?- Yep.

0:28:23 > 0:28:26- Have you had anything to drink at all?- Er, no.

0:28:26 > 0:28:30Yeah, earlier I did have a drink. Earlier.

0:28:30 > 0:28:34- How long ago did you have your last drink?- About 12 o'clock.

0:28:35 > 0:28:39It was only because somebody bought me one as a tip.

0:28:39 > 0:28:44Can you lean forward for me? Form a seal round the tube and blow till I tell you to stop, OK?

0:28:44 > 0:28:46- OK.- All right? Big deep breath.

0:28:47 > 0:28:49OK?

0:28:50 > 0:28:53- Harder.- Keep blowing, keep blowing, keep blowing, keep blowing.

0:28:53 > 0:28:55Stop. That's enough.

0:28:55 > 0:29:00- It analyses your breath, OK? - Do it.- Yeah.

0:29:00 > 0:29:03It's analysing it.

0:29:03 > 0:29:07- MACHINE BEEPS - You've blown 59.- Right.

0:29:07 > 0:29:11- Which is a fail.- Which is...?

0:29:11 > 0:29:16It's indicated you've got 59. The limit by breath is 35.

0:29:16 > 0:29:21- OK?- Oh, dear. - I could smell alcohol on your breath when you got in the car.- OK.

0:29:21 > 0:29:25- All right? - I have had a couple. I have.- Yeah.

0:29:25 > 0:29:27I have. I ain't going to lie. I have.

0:29:28 > 0:29:32'She's one of the many drivers who claims they've just had a couple.'

0:29:32 > 0:29:35Jesus Christ. I don't drink generally.

0:29:35 > 0:29:38I ain't... Do you know what? I know you've heard it all before.

0:29:38 > 0:29:41But I don't. I was somebody's birthday.

0:29:41 > 0:29:45"Have a drink!" "Oh, all right, then. Go on, then!"

0:29:47 > 0:29:51'But the consequences of just a couple of drinks could've been dire.'

0:29:51 > 0:29:55Yeah, she's well drunk. That's why she's driving the way she is. She was all over the road.

0:29:55 > 0:29:59Red light. Danger to other people on the road, driving like that.

0:29:59 > 0:30:04'In the UK, 2,000 people are killed or seriously injured as a result of drink-driving.

0:30:04 > 0:30:09'Although she's over the limit, the cops have to test her on a more accurate machine at the station.

0:30:17 > 0:30:21'Five miles north of Birmingham, PCs Dave Gaunt and Kevin Faulkner

0:30:21 > 0:30:25'have been called to a breakdown on the M6 near Walsall.

0:30:25 > 0:30:30'They're using their blues and twos to get there, because this is no ordinary request for help.'

0:30:30 > 0:30:34We received a call from the RAC

0:30:34 > 0:30:37and they'd attended a breakdown

0:30:37 > 0:30:40and the RAC man that was in attendance

0:30:40 > 0:30:43contacted the police

0:30:43 > 0:30:47basically saying that he thought the driver had been drinking.

0:30:47 > 0:30:51'PC Gaunt is starting to think about what may happen when they arrive.'

0:30:52 > 0:30:58The only issue we've got here is the fact that the vehicle's parked up

0:30:58 > 0:31:02and you've got to ascertain how that vehicle's got to be there.

0:31:02 > 0:31:06Because it's OK breathalysing him and then going down that route

0:31:06 > 0:31:08and arresting him and everything like that,

0:31:08 > 0:31:12but he turns up in court and says, "I wasn't driving it, my mate was driving it".

0:31:12 > 0:31:18You've got to cover all the eventualities and say, "Where's your mate gone?"

0:31:18 > 0:31:22Oscar Tango 97. AI, please.

0:31:22 > 0:31:28'But as they arrive, there are no mates. Only the driver and the RAC patrolman who called them.'

0:31:37 > 0:31:39What you doing?

0:31:39 > 0:31:44- I just broke down. - You just broke down? Come and take a seat in our car, will you?

0:31:45 > 0:31:47It became apparent that he had been drinking.

0:31:47 > 0:31:49You could smell it on his breath.

0:31:51 > 0:31:53Take a seat in there.

0:31:53 > 0:31:56Hello, mate. What's up with your car?

0:31:56 > 0:31:59- Er, it's ran out of fuel.- Oh, dear.

0:32:02 > 0:32:06- Is that your car?- Yes, it is. - Sorry?- Yes, it is.

0:32:06 > 0:32:11- How's your car got here?- Er, I drove it.- You've drove it, have you?

0:32:11 > 0:32:14- What's your name, please? - Christopher Russell.

0:32:16 > 0:32:19- Have you had a drink tonight?- Yes.

0:32:20 > 0:32:25- How much you had to drink, mate? - Er, one and a quarter pints.

0:32:25 > 0:32:30Whoever buys a quarter of a pint of something? It doesn't come in a quarter of a pint.

0:32:30 > 0:32:34So you think perhaps he's not quite telling the truth.

0:32:34 > 0:32:40Unless he's gone minesweeper and he's gone round everybody else's drinks and had a quarter of somebody else's.

0:32:40 > 0:32:42How long ago was your last drink?

0:32:42 > 0:32:45It was about 20 minutes ago.

0:32:45 > 0:32:48Because I can smell alcohol on your breath, OK,

0:32:48 > 0:32:51and you've told me you've driven that car there,

0:32:51 > 0:32:57- I require you to provide me with a specimen of breath for the purpose of a roadside screening test.- OK.

0:32:57 > 0:33:02It's a bit like blowing a balloon up. You're not inflating anything, but that sort of strength of breath.

0:33:02 > 0:33:04Lean forward. I'll hold the device.

0:33:05 > 0:33:08Keep going, keep going, keep going, keep going.

0:33:08 > 0:33:12Keep going. OK, thank you.

0:33:12 > 0:33:15- What the device will now do is analyse your breath.- OK.

0:33:18 > 0:33:21- You see what that says there? - Fail.- Fail.

0:33:21 > 0:33:25OK? So you've therefore failed the roadside breath test procedure.

0:33:25 > 0:33:30I'm therefore arresting you on suspicion of driving having consumed excess alcohol.

0:33:30 > 0:33:36'It's a surprisingly high result for someone who claims he's drunk just one and a quarter pints.

0:33:36 > 0:33:42- 'Whatever the amount, it's too much for Faulkner.'- It wouldn't bother me if it was a nil drink-drive limit.

0:33:42 > 0:33:46I've attended fatal accidents where drink is a factor.

0:33:46 > 0:33:50What's left of vehicles and what's left of people is not very nice.

0:33:50 > 0:33:54And we have to go and deal with that situation.

0:33:54 > 0:33:58'And the RAC patrolman is in no doubt about how drunk the man is.'

0:33:58 > 0:34:04When I called him up originally, he said, "I've ran out of fuel" and he was slurring his words.

0:34:04 > 0:34:09I came down here, "What's that smell?" I said we were waiting for a truck.

0:34:09 > 0:34:15- I said, "You've been drinking." He said, "It's mouthwash".- 'It turns out the cops arrived just in time.'

0:34:15 > 0:34:19When I turned up... I blagged him and said, "What's your address? Where are we taking you?"

0:34:19 > 0:34:24- I thought he was going to leg it. - Really?- Yeah. He'd called his mate to pick him up.

0:34:24 > 0:34:27- Was there anybody else in the vehicle?- No, he was on his own

0:34:27 > 0:34:29- and he was in the driver's seat.- OK.

0:34:29 > 0:34:32And did he tell you he'd driven there?

0:34:32 > 0:34:37Yeah, he said he was on his way to Walsall to see his girlfriend. Some emergency.

0:34:37 > 0:34:40'But he won't be seeing his girlfriend tonight.'

0:34:40 > 0:34:43I'm in the back of a police car at the moment.

0:34:43 > 0:34:47I... Yeah, I've just failed a roadside breath test.

0:34:47 > 0:34:51'And news about the driver's previous convictions is just coming in.'

0:34:51 > 0:34:53OK, lovely. Thank you.

0:34:53 > 0:34:56I just got a result back on the radio. They've done a check on him

0:34:56 > 0:34:59to see if he's got a licence, et cetera.

0:34:59 > 0:35:02And he's got previous for drink-driving.

0:35:02 > 0:35:07'More than one in six convicted drink-drivers are caught drinking and driving again.

0:35:07 > 0:35:10'But this man claims he's not one of the statistics.'

0:35:10 > 0:35:14I don't know, because I've never been done before, so...

0:35:14 > 0:35:19'The roadside test machine PCs Gaunt and Faulkner are using just shows a pass or fail.

0:35:19 > 0:35:22'To find out exactly how much he really has had to drink,

0:35:22 > 0:35:27'they need to test him again at the police station. Any delay has important consequences.'

0:35:27 > 0:35:30'When somebody fails the breath test, it's a key factor for us

0:35:30 > 0:35:33'to get them to the police station as quickly as we can.'

0:35:33 > 0:35:36If they're very close to the drink-drive limit

0:35:36 > 0:35:39and they're kept too long before they go on the machine,

0:35:39 > 0:35:45there's a good chance that their result will diminish to a point where they're under the limit.

0:35:50 > 0:35:52'While PCs Gaunt and Faulkner take their man in,

0:35:52 > 0:35:56'PC Gareth Westbury has teamed up with PC Martin Smith.'

0:35:59 > 0:36:02The latest adventure for the night, we've just had a call to say

0:36:02 > 0:36:08there's about nine or ten, they're described as illegal immigrants, walking on the motorway.

0:36:08 > 0:36:12'The Midlands motorway network runs right through the urban areas of Birmingham

0:36:12 > 0:36:15'and here, jaywalkers can be a dangerous problem.'

0:36:15 > 0:36:19Reports of pedestrians on the motorway we treat as a fairly urgent call

0:36:19 > 0:36:23because when pedestrians go onto the motorway,

0:36:23 > 0:36:25quite often they get ran over.

0:36:25 > 0:36:29'More information is coming through.'

0:36:29 > 0:36:33It's now one pedestrian walking between junction nine and ten.

0:36:33 > 0:36:37'The cops' main concern is to avoid a serious or fatal injury.'

0:36:37 > 0:36:39He's a danger to himself as well as others.

0:36:39 > 0:36:43He could wander out into the main carriageway from the hard shoulder

0:36:43 > 0:36:46and he doesn't stand a chance.

0:36:46 > 0:36:50It has happened in the past and it will continue to happen where people get killed

0:36:50 > 0:36:53because they're walking on the motorway.

0:36:53 > 0:36:57Chances are he's walking on the motorway and trying to get home. He might have had a night out.

0:36:57 > 0:37:01So we'll have to advise him about the error of his ways, I think.

0:37:01 > 0:37:06- "He's probably another 150 yards." - Where is he?

0:37:07 > 0:37:11- Here he is. Got him. - Get off the road, mate.

0:37:13 > 0:37:15OK, stop here.

0:37:21 > 0:37:27'At this time of night, PC Smith is expecting that, once again, drink may be an issue.'

0:37:27 > 0:37:31- Hello, sir. You all right? - 'Especially as there's a report that he's been seen on CCTV

0:37:31 > 0:37:34- 'kicking traffic cones into the carriageway.'- Come and sit with us.

0:37:34 > 0:37:37'PC Smith can immediately tell he's had a drink or two.'

0:37:37 > 0:37:41'I think it was quite obvious from the onset that the bloke had had a few too many

0:37:41 > 0:37:45'and was just quite a bit drunk, really.' Come and sit with us.

0:37:54 > 0:37:56Hello, mate.

0:37:59 > 0:38:02What's been going on, then? How come you're on the motorway wandering about?

0:38:02 > 0:38:06I'm not wandering about. I'm trying to get...

0:38:06 > 0:38:09My brother-in-law's picking me up.

0:38:09 > 0:38:13- Where from?- Er...junction ten.

0:38:13 > 0:38:17He's been on a night out somewhere, couldn't quite work out how to get home

0:38:17 > 0:38:20and ended up trying to navigate there on the motorway.

0:38:20 > 0:38:23'But the man has still not sussed out that he's in trouble

0:38:23 > 0:38:26'and he's phoning his brother-in-law hoping for a lift home.'

0:38:26 > 0:38:30If you can get back to junction ten...

0:38:32 > 0:38:36- Do you want me to speak to him and tell him what's going on? - Yeah, please.

0:38:36 > 0:38:39- 'PC Smith has other plans for him.' - There's been an accusation made

0:38:39 > 0:38:44and I can't talk about it but he's been arrested. We're going to Walsall Police Station.

0:38:44 > 0:38:46Please tell me what I've done wrong.

0:38:46 > 0:38:49- We'll explain again in a minute. - He's really drunk,

0:38:49 > 0:38:54- he's been found on the motorway. - I'm not very drunk at all!- OK?

0:38:54 > 0:38:57He was quite, quite drunk.

0:38:57 > 0:39:02So he probably maybe didn't remember but at the same time, if he did, being as he was drunk,

0:39:02 > 0:39:06- he didn't want to get into trouble, so he was going to lie. - What have I done?

0:39:06 > 0:39:11You've been observed both on CCTV and by a member of the public kicking cones around the motorway

0:39:11 > 0:39:15- and walking on the hard shoulder. - I haven't kicked any cones!

0:39:15 > 0:39:20- You've kicked a large number of cones and knocked the orange lights off.- I would never do that

0:39:20 > 0:39:23- because I know the cones are for traffic on the motorway. - That's right.

0:39:23 > 0:39:26- All I've done... - You're not wrong, they are for that.

0:39:26 > 0:39:30All I've done is got off here and walked towards junction ten.

0:39:30 > 0:39:35I've done nothing else. I haven't kicked any cones, I have tried to disturb any traffic or anything.

0:39:35 > 0:39:37I wouldn't be that stupid.

0:39:37 > 0:39:44'Although Marlon believes he's done nothing wrong, the cops have to act on information from CCTV operators.

0:39:44 > 0:39:49'They've no choice but to take him into custody to get to the bottom of what's actually happened.

0:39:53 > 0:39:57'At Walsall Police Station, ten miles north of Birmingham City Centre,

0:39:57 > 0:40:03'the pressure is on to give the man who claims to he has drunk just one and a quarter pints

0:40:03 > 0:40:05'his second breath test.'

0:40:06 > 0:40:10- Can I ask your surname, please? - Russell.- Russell.

0:40:10 > 0:40:14- And your first name.- Christopher. - Have you ever been in custody before?

0:40:14 > 0:40:18- Er, once.- Once. How long ago?

0:40:18 > 0:40:21Er, about 18 months ago.

0:40:21 > 0:40:24'They want to get an accurate reading because as every minute ticks by,

0:40:24 > 0:40:27- 'his alcohol level is going down.' - Middle names?

0:40:27 > 0:40:30Christopher Anthony Stephen.

0:40:30 > 0:40:33'But first they have to verify he is who he says he is.

0:40:37 > 0:40:40'To make things worse, at this time of night,

0:40:40 > 0:40:45'the custody suite is full of yet more drink-drivers waiting to be tested.'

0:40:45 > 0:40:47Do you agree to provide...

0:40:47 > 0:40:50DISTANT SHOUTING

0:40:50 > 0:40:55'While they wait for the backlog to clear, the cops investigate the man's identity.'

0:40:55 > 0:40:58He had two forms of identification on him.

0:40:58 > 0:41:01He had an identification card in one name that we'd booked him in as

0:41:01 > 0:41:05and he had a driving licence in another name.

0:41:05 > 0:41:09It was a full driving licence. But the two photographs were the same person.

0:41:09 > 0:41:12He'd boxed himself into a corner.

0:41:12 > 0:41:15'He's given one chance to come clean.'

0:41:15 > 0:41:19Christopher, this is your opportunity to give us the correct details.

0:41:19 > 0:41:26- That is the correct details. - We will be fingerprinting you as soon as this procedure is finished.

0:41:26 > 0:41:30From the photographs shown there and there,

0:41:30 > 0:41:34I'm more inclined to believe the pass than the driving licence.

0:41:34 > 0:41:41I accept the driving licence photo to be good. But that looks more like you. That's a different name.

0:41:41 > 0:41:46Why have you got those bank cards with you? It doesn't add up, does it?

0:41:46 > 0:41:49'His explanation isn't fooling anyone.'

0:41:49 > 0:41:52Somebody's lying and it's obviously him.

0:41:52 > 0:41:55He's got the documentation with his picture on it,

0:41:55 > 0:42:01so, you know, it's a case of, "Come on, mate, which one are you?"

0:42:01 > 0:42:05'But the good news is the queue for the breath test machine is now clear

0:42:05 > 0:42:08'and so the investigation into his identity is put on hold.

0:42:08 > 0:42:13'But only until the cops check out his tale about having drunk just one and a quarter pints.'

0:42:13 > 0:42:18Right, you might well be under, but if you don't blow, you're never going to know.

0:42:18 > 0:42:22'It's been 40 minutes since he arrived at the station.

0:42:22 > 0:42:25'The delay may have been just enough to put him under the limit.'

0:42:25 > 0:42:29Keep it going, keep it going, keep it going. OK.

0:42:29 > 0:42:33OK, do you want to step back for a minute? Get yourself psyched up, then.

0:42:33 > 0:42:37- 'The cops will select the lower reading from two attempts.' - Harder, harder, harder.

0:42:37 > 0:42:39Keep it going. That's it. OK.

0:42:44 > 0:42:4636, 37.

0:42:46 > 0:42:49'He's actually failed the test, but not by much.

0:42:49 > 0:42:55'And it's police policy across the UK to allow some leeway before they decide to charge.'

0:42:55 > 0:43:01So you're over the legal limit, but the legal limit's 35.

0:43:01 > 0:43:03We don't prosecute till 40 and above.

0:43:03 > 0:43:05'It's been a very close shave.

0:43:05 > 0:43:09'There have been calls for the limit to be reduced by nearly 40 percent,

0:43:09 > 0:43:13'bringing the UK into line with much of continental Europe.

0:43:13 > 0:43:18'It's estimated that this could save up to 160 lives per year.'

0:43:18 > 0:43:24We always give certain tolerances to allow for any discrepancy in the machinery.

0:43:24 > 0:43:30If there's, say, a percentage that the machine can be out, the police like to give that.

0:43:30 > 0:43:34Everything's always in the driver's favour, so if the legal limit's 35,

0:43:34 > 0:43:38you always give the benefit of the doubt a little bit

0:43:38 > 0:43:40cos the machine might just be a little bit out.

0:43:40 > 0:43:43I'm just surprised I passed.

0:43:43 > 0:43:46- 'He's off the hook on one charge.' - I'm just surprised.

0:43:46 > 0:43:49'But he's yet to convince them of his true identity.'

0:43:51 > 0:43:56'These days, everyone who's arrested has their fingerprints put on a police database,

0:43:56 > 0:43:59'so it's easy to check out who they are.

0:44:00 > 0:44:05'The results take just a few minutes and confirm their suspicions.'

0:44:06 > 0:44:11His alias names are Macaulay Anthony Conway and Christopher Anthony Russell.

0:44:11 > 0:44:14Yeah, his main name's Stephen Conway.

0:44:14 > 0:44:17His driving licence is in an alias, obviously.

0:44:17 > 0:44:20I would say it's not a forgery,

0:44:20 > 0:44:24I think he's just applied for that in his Russell name, Christopher Russell.

0:44:24 > 0:44:29- 'They've found out that he has a chequered past.' - He's got loads of form.

0:44:30 > 0:44:35The last time he was convicted was October and he got...

0:44:35 > 0:44:3814/9, driving licence disqualified, Birmingham Mags.

0:44:38 > 0:44:40And he got suspended in prison.

0:44:40 > 0:44:46He got a two-year ban in...2007.

0:44:46 > 0:44:50'His attempt to continue driving whilst banned has backfired.'

0:44:50 > 0:44:53He was disqualified until 2010.

0:44:53 > 0:44:57I think what he'd actually done was he'd been disqualified under one name.

0:44:59 > 0:45:06But he took a test in another name, this alias, and passed his driving test to get the full licence.

0:45:06 > 0:45:10'Incredibly, he'd been disqualified under both his real and his fictitious names.

0:45:10 > 0:45:16'Even so, PC Faulkner has made sure he won't be able to drive using his twin identities again.'

0:45:16 > 0:45:19Now, I've notified the DVLA

0:45:19 > 0:45:23with the two driver numbers and the two names. They will cross-reference those.

0:45:23 > 0:45:27So any time he's now stopped in either of those names, it'll come back as disqualified.

0:45:27 > 0:45:30Stephen. I'm not going to call you Christopher

0:45:30 > 0:45:33cos I've checked the details on Livescan

0:45:33 > 0:45:38and on Livescan you've come back as Stephen Anthony Conway. OK?

0:45:38 > 0:45:45- You also stood by the fact that your name was Christopher Russell, which clearly it isn't.- It is.

0:45:45 > 0:45:50From the details you've given and the fingerprints we've taken, it isn't.

0:45:50 > 0:45:53OK? So as well as a disqualified driver, I'm also arresting you

0:45:53 > 0:45:56for obstructing a police officer in the course of his duty.

0:45:56 > 0:46:00'It's taken some time, but the investigation has been worth the effort.'

0:46:00 > 0:46:02If feels good that you've got an arrest,

0:46:02 > 0:46:06you've proved somebody out to be a liar,

0:46:06 > 0:46:10you haven't got them for the original offence that you were looking at

0:46:10 > 0:46:12but you've got them for something as serious.

0:46:12 > 0:46:14So it's a good feeling, yeah.

0:46:14 > 0:46:19So I'll get you a blanket, get your head down and I'll come back and wake you up, OK?

0:46:21 > 0:46:25'The man will have to explain who he really is to the magistrates in the morning.

0:46:25 > 0:46:29'Two miles west, the man found walking on the M6

0:46:29 > 0:46:33'is being taken into custody by PCs Gareth Westbury and Martin Smith.

0:46:33 > 0:46:37'They need to find out if the reports they have from CCTV operators

0:46:37 > 0:46:41'about him kicking traffic cones into the carriageway are true.'

0:46:41 > 0:46:44- Excuse me, sir.- Yes, Marlon?

0:46:44 > 0:46:47Can you answer my question? What have I done? How am I very drunk?

0:46:47 > 0:46:50I've explained a couple of times, more than a couple of times,

0:46:50 > 0:46:54- what you're alleged to have done. I haven't seen you.- But that's alleged.

0:46:54 > 0:46:58You can't tell me where the evidence has come from? That's just alleged.

0:46:58 > 0:47:01The allegation's been made, we've got to investigate it.

0:47:01 > 0:47:06No matter how much I tell you, it doesn't matter, it won't sink in cos you've had a few beers.

0:47:06 > 0:47:10- No, I haven't had a few beers. - We'll go down, round and back.

0:47:10 > 0:47:13I've had maybe two drinks from...

0:47:13 > 0:47:18Er, what you call it? A cocktail bar.

0:47:23 > 0:47:26Is it cos my skin's black or something?

0:47:26 > 0:47:28- Huh?- If you park up there... - What's that, Marlon?

0:47:28 > 0:47:31- Is it because my skin's black or something?- No, it's not.

0:47:31 > 0:47:35He was arrested because of what he'd done and that goes for anybody.

0:47:35 > 0:47:38If you commit the offence, you can expect to get arrested.

0:47:38 > 0:47:42What have you seen me do, then? I've done nothing wrong.

0:47:42 > 0:47:47- It's not what we've seen you do, it's what somebody else has seen you do. - What?

0:47:47 > 0:47:49You haven't told me what they've seen me do!

0:47:49 > 0:47:52I haven't done anything wrong. I ain't stupid!

0:47:52 > 0:47:54Quite frankly, getting him out of the car

0:47:54 > 0:47:58couldn't come a moment too soon. I've never known one person

0:47:58 > 0:48:01say so much in such a short space of time to so few people.

0:48:01 > 0:48:06I must have some degree of respect here! I've done nothing wrong. I am not a criminal.

0:48:06 > 0:48:10I have never been a criminal. I've never been fingerprinted.

0:48:10 > 0:48:15The whole time at the police station, this guy was particularly vocal.

0:48:15 > 0:48:20He was quite agitated. He became quite verbally aggressive.

0:48:20 > 0:48:23- Don't create a confrontation, OK? - I'm not creating a confrontation.

0:48:23 > 0:48:26If you tell me what I have done wrong...

0:48:26 > 0:48:29In the end, I think the sergeant became quite fed up of his rantings

0:48:29 > 0:48:35and he suggested that we just escort him to the nearest cell.

0:48:35 > 0:48:39This is a joke, this is. Honest to God, this is a joke.

0:48:39 > 0:48:44He was left there for the night to basically sober up.

0:48:44 > 0:48:46How long am I going to be in a cell for?

0:48:46 > 0:48:50Some officers from the morning shift will speak to you. Not me.

0:48:50 > 0:48:53- In the morning shift? - Yeah. They're on in an hour, Marlon.

0:48:53 > 0:48:56- Go on, Marlon. - Please.- Marlon, come on.

0:48:56 > 0:49:00- Marlon, we need you to go in there. - I've done nothing wrong, man!

0:49:00 > 0:49:04- Stand back from the door, please. - You're loving this. - We're not, actually.

0:49:04 > 0:49:07We'll get to you as soon as we can, OK?

0:49:09 > 0:49:11Awesome.

0:49:15 > 0:49:18- LOUD KNOCKING - 'His protests are falling on deaf ears.

0:49:20 > 0:49:23'But his antics have been caught on camera.'

0:49:25 > 0:49:28Some of what had gone on had been captured on CCTV.

0:49:28 > 0:49:33And it showed our friend in his suit having a bit of a wander through the street furniture.

0:49:35 > 0:49:41He'd committed this offence called, er, causing danger to road users.

0:49:41 > 0:49:46'And what may have been just mucking around has caused problems for the motorway traffic.'

0:49:46 > 0:49:51As it turned out, we'd got a lorry driver who'd contacted the police

0:49:51 > 0:49:54and said he'd seen this guy kicking out at cones

0:49:54 > 0:49:59and that one had come onto the motorway and caused him to swerve his large goods vehicle.

0:50:01 > 0:50:05'By 6am, traffic is already building up on the M6.

0:50:05 > 0:50:12'Every hour, more than 7,000 cars, vans and lorries will pass by Birmingham City Centre.

0:50:14 > 0:50:18'The motorway cops are nearing the end of their 12-hour shift.

0:50:18 > 0:50:25'But before they can take a break, there's one last problem for PCs Alan Colman and Kevin Whitehouse.

0:50:25 > 0:50:28'A broken-down car in the middle of the motorway.'

0:50:28 > 0:50:31Where it is is quite a dangerous position to be in.

0:50:31 > 0:50:33So we're making our way down there fairly quickly,

0:50:33 > 0:50:36get behind and give him some cover, see what's happened.

0:50:38 > 0:50:41'On this stretch of the motorway there's no central barrier,

0:50:41 > 0:50:44'just an empty lane separating the traffic.'

0:50:45 > 0:50:47There he is, there.

0:50:47 > 0:50:50That's ridiculous, what are they doing?

0:50:52 > 0:50:56'That lane is there to prevent other vehicles having head-on collisions,

0:50:56 > 0:51:01'So it's a barrier between the two opposing sets of traffic.'

0:51:01 > 0:51:06'And it's here, right between the fast-moving commuters, that the car has broken down.'

0:51:06 > 0:51:12'It was just sat there, no lights on, no nothing. Which is a very, very dangerous place to be.'

0:51:12 > 0:51:14We'll need a Range Rover, rapid.

0:51:18 > 0:51:23- All right. What's up?- No petrol. - No petrol?- Yeah. - Will it not start at all?- No.

0:51:23 > 0:51:27'This is possibly the worst place in Britain to run out of petrol.'

0:51:27 > 0:51:30You shouldn't come on the motorway with no petrol, you know? Hang on.

0:51:35 > 0:51:39- Going to need a Range, he's got no petrol.- He's run out of petrol? - Run out of petrol.

0:51:39 > 0:51:41Get back in the car!

0:51:41 > 0:51:47This idiot has run out of petrol. Could you send us a Range Rover down?

0:51:47 > 0:51:50'While they wait for the Range Rover to tow the car to safety,

0:51:50 > 0:51:52'the cops have to use their car to act as a shield.'

0:51:52 > 0:51:58In this situation here, he's managed to get into this lane, and although this lane is closed,

0:51:58 > 0:52:02it's still not safe, you still get emergency vehicles coming down here at speed,

0:52:02 > 0:52:05you can die on here. If a lorry hits you, you'll die. Simple as that.

0:52:05 > 0:52:10In the car is the safest place for him. Wandering round the carriageway all in black,

0:52:10 > 0:52:12he's just going to get wiped by one of these.

0:52:12 > 0:52:16'And, as if on cue, the driver foolishly decides to brave the traffic.'

0:52:16 > 0:52:19- Get in the car!- Sit in the car!

0:52:20 > 0:52:22Get in the car!

0:52:23 > 0:52:26Has he got a brain or what?

0:52:27 > 0:52:31Stupid. What's he going to be like being towed?

0:52:32 > 0:52:34'Time to make another check.'

0:52:35 > 0:52:40- Have you been towed before? - What do you mean, towed? - What do I mean, towed?

0:52:40 > 0:52:42Towed! As in pulled with a rope?

0:52:42 > 0:52:46- No, you haven't, have you? Sit in that seat over there. - Absolute fool.

0:52:48 > 0:52:50Whoa, whoa, whoa, whoa! Hang on!

0:52:50 > 0:52:53- You're on a main road here. Yeah? - Yeah, yeah, yeah.

0:52:53 > 0:52:56You need to be careful. You've got no protective clothing on.

0:52:56 > 0:52:58Just sit in there.

0:52:58 > 0:53:01He's that close to traffic... SIREN WAILS

0:53:09 > 0:53:13He's put three, three, four people in danger here.

0:53:13 > 0:53:19Five including himself. Plus, all these other motorists, he's put them all in danger through his stupidity.

0:53:19 > 0:53:22So we're just about to go off.

0:53:23 > 0:53:27I can't believe you've come out without enough petrol, mate.

0:53:27 > 0:53:33You pass your test, it is reasonable to expect that you should know that your petrol gauge,

0:53:33 > 0:53:35every car's got a petrol gauge,

0:53:35 > 0:53:38that you should have some sort of indication on there.

0:53:38 > 0:53:43- Is this your car, is it?- Sorry? - Is this your car?- Yeah.

0:53:43 > 0:53:45'It takes just a few minutes to tow him to safety.'

0:53:45 > 0:53:49- Right, you need to phone someone... - Yes.- ..to come out with some petrol.

0:53:49 > 0:53:54- Could you just take...? - No, no, no, no. You're in enough trouble as it is.

0:53:55 > 0:54:00- Now, I've told him what to do. He's just asked if we can drop him off home.- Oh, right.

0:54:00 > 0:54:05He had the cheek to ask us to give him a lift back to his house, which, erm, that's not happening.

0:54:05 > 0:54:07It says police on my shirt, not taxi.

0:54:10 > 0:54:16- What sort of driving licence have you got?- UK licence. - And how long have you had that?

0:54:16 > 0:54:21- Er, since 2006.- Right, you know when you took your test?

0:54:21 > 0:54:23- Test?- BOTH: Driving test.- Yeah.

0:54:23 > 0:54:29What did it say about preparing for your journey, making sure your car was in a roadworthy condition?

0:54:29 > 0:54:31And had oil, water, and most of all, petrol?

0:54:31 > 0:54:35'But PC Colman has an even more important question for him.'

0:54:35 > 0:54:40- Where have you been? Have you been at work or something? - No, I've been with my friends.

0:54:40 > 0:54:43- Right, have you been drinking last night?- No.

0:54:43 > 0:54:45- Are you sure?- Yeah.

0:54:45 > 0:54:48I'm sure I got a whiff of something.

0:54:48 > 0:54:52'PC Colman's not convinced that he's getting the truth about his drinking.

0:54:52 > 0:54:57'But before he can test him, more information is coming in about the man's licence.'

0:54:57 > 0:55:01Confirm, you've got an exact match on his details, but he is a non-licence holder?

0:55:01 > 0:55:03He's got three points, as well.

0:55:03 > 0:55:08"There's no match on his details. No exact match. And a non-licence holder on the DL."

0:55:08 > 0:55:12- You haven't got a driving licence. - You look surprised and shocked.

0:55:12 > 0:55:17- Did you understand what I said to you?- Yeah, I understand. - You don't have a driving licence.

0:55:17 > 0:55:23So what are you doing driving this car again? You've already been caught once, haven't you? Yeah?

0:55:23 > 0:55:27A fixed penalty notice, three points on the licence you don't have.

0:55:27 > 0:55:34Your car will be recovered, we're seizing the car. It will cost you £150 recovery. OK?

0:55:34 > 0:55:36'Now it's Colman's turn again.'

0:55:36 > 0:55:40I require you to provide me with a specimen of breath for analysis.

0:55:41 > 0:55:44Blow long and hard like you do on a balloon. Go on.

0:55:44 > 0:55:49Harder! Keep going, keep going, keep going! Stop! Stop! Stop!

0:55:49 > 0:55:51You have had a drink last night, you have.

0:55:51 > 0:55:56- A little bit.- Yeah, well don't lie to me when I ask you, saying, "No, I haven't had a drink."

0:55:56 > 0:55:59- I was just... - "Yes, I've got a licence."

0:55:59 > 0:56:03You are literally on the margin. It's 35.

0:56:03 > 0:56:07OK? So we won't be doing anything about that today, unfortunately.

0:56:07 > 0:56:12'The driver is right on the limit. And as they can't prosecute him, he is free to go.

0:56:12 > 0:56:15'But his car will be locked up in the police pound.'

0:56:15 > 0:56:19There you go. What do you need from the car? Get it from this side, all right?

0:56:19 > 0:56:23'He's travelling light. Just a half-finished can of pop.'

0:56:23 > 0:56:26You're going in our car with that. Is that empty?

0:56:26 > 0:56:30- Little bit.- Either drink it or throw it away, all right?

0:56:31 > 0:56:35- Not the can! You don't throw the can away!- Is he having a laugh, is he?

0:56:35 > 0:56:37You can't throw that away!

0:56:37 > 0:56:40I want you to pick it up. I don't want you to throw it on the floor.

0:56:40 > 0:56:45'With the empty can safely clutched in his hand, the cops have one last job to do.'

0:56:45 > 0:56:48We're just going to drop you at the top of the road, mate, OK?

0:56:48 > 0:56:51- Top of the road? - Yeah, we ain't taking you home.

0:56:51 > 0:56:55'The cops will take him just off the motorway, where he'll have to find his own way home.'

0:57:00 > 0:57:06I think our actions may well have prevented an accident, or saved his life.

0:57:06 > 0:57:10Because it was a matter of time before somebody ploughed straight into him.

0:57:10 > 0:57:13'But he is not in the mood for thanking the motorway cops.'

0:57:13 > 0:57:15- Bye.- Bye.

0:57:15 > 0:57:19It is illegal to driving without driving licence in this country,

0:57:19 > 0:57:22but I have to do that, you know,

0:57:22 > 0:57:27because I applied a few times for driving licence

0:57:27 > 0:57:30but they don't give me driving licence.

0:57:30 > 0:57:34'The man who ran out of petrol and who lied about having a licence

0:57:34 > 0:57:39'was fined and given another four points on his non-existent licence.

0:57:39 > 0:57:43'The man who was filmed on CCTV kicking traffic cones

0:57:43 > 0:57:46'was fined £80 for being drunk and disorderly.

0:57:46 > 0:57:50'The woman driver was found to be nearly twice the legal drink-drive limit,

0:57:50 > 0:57:55'was fined £160 and banned from driving for 12 months.

0:57:55 > 0:58:00'The driver who gave the police a false identity was sentenced to five months in prison,

0:58:00 > 0:58:03'and given an additional four-year driving ban.

0:58:03 > 0:58:07'The man stopped in the stolen Range Rover pleaded guilty to handling stolen goods

0:58:07 > 0:58:11'and was given a 12 month suspended prison sentence.

0:58:11 > 0:58:18'The van driver with £9,000 of counterfeit vodka was fined £250 for evading excise duty.

0:58:18 > 0:58:22'The liquor was destroyed by Trading Standards officers.

0:58:22 > 0:58:27'And the driver who claimed to know nothing about the half a million counterfeit cigarettes in his van,

0:58:27 > 0:58:31'pleaded guilty to fraudulently evading excise duty.'
