0:03:44 > 0:03:49I mean, they become so commonplace here that people just brush them off

0:05:20 > 0:05:23- OK.- Doesn't get any answer.

0:05:23 > 0:05:24He opens up the door,

0:05:24 > 0:05:29sees Bob on the ground, looks like his throat is cut

0:05:29 > 0:05:30and that's where we stand.

0:05:36 > 0:05:42The second body is thought to be Bob Massey's niece, Amy,

0:05:42 > 0:05:48who was living in the trailer with her boyfriend.

0:05:48 > 0:05:51Two people have been staying here with the primary deceased victim.

0:06:04 > 0:06:07I'm trying to figure out if TJ's floating around somewhere.

0:06:07 > 0:06:08It sounds like he's not around.

0:06:08 > 0:06:11And if he's been living here, better safe than sorry on a search warrant.

0:06:11 > 0:06:13- Yes, absolutely. - Since his girlfriend's deceased

0:06:13 > 0:06:16- and he's not around.- Right.

0:06:16 > 0:06:22The son of the male deceased, he's standing by over here.

0:06:22 > 0:06:25Is the... I'm assuming that's probably the older son

0:06:28 > 0:06:29David. OK.

0:06:31 > 0:06:34- Hi, I'm...- Hi, sir. I'm David, I'm his son.

0:06:43 > 0:06:44- OK.- We got this picture.

0:06:44 > 0:06:46It's not super recent, but that's him.

0:06:46 > 0:06:48They said it's a bit of an older picture,

0:06:48 > 0:06:50maybe a year, but that's him.

0:06:50 > 0:06:52- For sure.- You don't mind me taking a quick picture?

0:06:52 > 0:06:54I definitely want you to e-mail it to him.

0:06:54 > 0:06:56Yeah, I'm going to send it to his e-mail.

0:06:56 > 0:06:58Let me just take a quick picture, if you don't mind.

0:06:58 > 0:07:00Go ahead. Watch the glare.

0:07:01 > 0:07:03Are you... So, you're...

0:07:03 > 0:07:06I'm the oldest son of the man who owns the trailer.

0:07:06 > 0:07:08Are you stepson or actual son?

0:07:08 > 0:07:12- Actual son.- Actual son, OK. - Actual. I'm David Anthony Massey.

0:07:12 > 0:07:14He is Robert Anthony Massey.

0:07:14 > 0:07:16Just letting you know, if it is him,

0:07:16 > 0:07:18you'll be considered the next of kin.

0:07:18 > 0:07:21I'm going to try and use you as the primary person to talk with.

0:07:21 > 0:07:23- That's fine.- And again, thank you very much.

0:07:23 > 0:07:25- Yeah.- And I'm sorry if this is...

0:07:25 > 0:07:27- Just find the guy, find him. You need to.- OK.

0:07:29 > 0:07:30Thank you.

0:07:35 > 0:07:39You get a sense of what the family is looking for.

0:07:39 > 0:07:43And, you know, in your heart, you'll agree or disagree.

0:07:45 > 0:07:50But you try to get justice for those that have died.

0:07:53 > 0:07:56But justice is just an ongoing battle.

0:07:56 > 0:07:59The police do what we can do to catch the person

0:07:59 > 0:08:00who did these things.

0:08:02 > 0:08:06It goes on to the state attorneys to try to get the conviction.

0:08:07 > 0:08:10A prosecutor from the State Attorney's Office,

0:08:10 > 0:08:13Janeen Kirch, arrives on the scene.

0:08:13 > 0:08:17We have at this point, Robert Massey.

0:08:17 > 0:08:20He's got a superficial cut across his neck.

0:08:20 > 0:08:24The lady is most likely going to be Amy Hatfield.

0:08:24 > 0:08:27- That's his niece? - Yes, that's his niece.

0:08:27 > 0:08:29She came down about three weeks ago.

0:08:29 > 0:08:32- Came down here with her boyfriend.- OK.- TJ.

0:08:32 > 0:08:36She's laying pretty much face up.

0:08:36 > 0:08:40- She has got a very similar cut to him on the neck.- OK.

0:08:40 > 0:08:43Two towels laying across her face and a shoestring's tied

0:08:43 > 0:08:45around her neck also.

0:08:46 > 0:08:49- All right, we've got some booties that you just need to put on.- OK.

0:08:49 > 0:08:52- And we'll go on in, OK? - All right.- OK.

0:08:55 > 0:08:56Mind the step.

0:08:56 > 0:08:59Homicide attorneys go out to the scene to check

0:08:59 > 0:09:02out what it entails.

0:09:02 > 0:09:06Because ultimately we're the ones who will be describing it to a jury.

0:09:06 > 0:09:09So it helps if we can do that from our memories

0:09:09 > 0:09:13of what we saw that evening, what we smelled that evening,

0:09:13 > 0:09:15what the temperature was like, how we felt.

0:09:21 > 0:09:26Janeen must decide what punishment the state will seek for this crime.

0:09:35 > 0:09:40I think that I may have turned off a sense of emotion towards death

0:09:40 > 0:09:42that most people have.

0:09:42 > 0:09:45But I do it so that I can do my job.

0:09:48 > 0:09:52For the worst offences, she can choose to seek the death penalty.

0:09:54 > 0:09:57By now, I have enough experience and knowledge of the law to know

0:09:57 > 0:10:00what's going to fall into that category.

0:10:04 > 0:10:08But there's still somebody out there who has brutally murdered two

0:10:08 > 0:10:12people and you have to let the detectives do their job.

0:10:12 > 0:10:15They will not rest until they get this person.

0:10:23 > 0:10:28In Florida, the state prosecutors are among the most powerful people

0:10:28 > 0:10:29in the judicial system.

0:10:29 > 0:10:34Not only deciding who is charged, but what punishment they could face.

0:10:40 > 0:10:44Every prosecutor in Jacksonville works for Angela Corey,

0:10:44 > 0:10:47whose uncompromising approach won her two-thirds of the vote

0:10:47 > 0:10:48in the last election.

0:10:50 > 0:10:53Since then, her office has sent more people to death row

0:10:53 > 0:10:56than any other in Florida.

0:10:56 > 0:11:00Good afternoon, I'm Angela Corey, proud to be your state attorney

0:11:00 > 0:11:04and I come to you today to tell you that you should re-elect me

0:11:04 > 0:11:07and I say that with the confidence

0:11:07 > 0:11:10borne of 35.5 years of experience.

0:11:10 > 0:11:15Working side-by-side with law enforcement to make sure justice

0:11:15 > 0:11:17occurs in this community. Thank you very much.

0:11:20 > 0:11:22My name is Melissa Nelson.

0:11:22 > 0:11:25And I'm running for state attorney for the Fourth Judicial Circuit.

0:11:25 > 0:11:27The reason I have decided to run for this office

0:11:27 > 0:11:29is because I have a deep care...

0:11:29 > 0:11:31But Angela Corey has a rival.

0:11:31 > 0:11:35A former employee who believes her brand of tough justice

0:11:35 > 0:11:36has gone too far.

0:11:36 > 0:11:39This election is about restoring trust in the office

0:11:39 > 0:11:41of the state attorney.

0:11:41 > 0:11:46It's about electing a state attorney who will serve the interests

0:11:46 > 0:11:49of the public she's elected to serve, over her own interests.

0:11:49 > 0:11:53I believe we can do better and I believe I'm the right choice

0:11:53 > 0:11:54to make that happen.

0:11:57 > 0:12:02I left the State Attorney's Office almost seven years ago.

0:12:02 > 0:12:06It was my belief that among my colleagues,

0:12:06 > 0:12:10other lawyers, the State Attorney's Office had earned a reputation,

0:12:10 > 0:12:13not just locally, but nationally,

0:12:13 > 0:12:17for misusing the power of that office.

0:12:20 > 0:12:23State Attorney Angela Corey, one of the most embattled

0:12:23 > 0:12:27and controversial local office holders in recent memory...

0:12:27 > 0:12:30Corey became a lightning rod for controversy in her second term,

0:12:30 > 0:12:33taking heat over her office's handling of high-profile cases.

0:12:33 > 0:12:37The New York Times described Corey as overzealous.

0:12:37 > 0:12:41The client of the state attorney, of the prosecutor,

0:12:41 > 0:12:45is the public, is the community.

0:12:45 > 0:12:48For the justice system to work as it is intended to work

0:12:48 > 0:12:53in America, people have to believe that the justice system is fair.

0:12:53 > 0:12:58The prosecutor in America has incredible and vast power

0:12:58 > 0:13:03and so that power has to be wielded very responsibly.

0:13:07 > 0:13:11I've got the swabs, the blood swab from the bank

0:13:11 > 0:13:14that matches Mr Wright's DNA.

0:13:14 > 0:13:16Blood swab from the .22 rifle.

0:13:16 > 0:13:20Prosecutors from Angela Corey's office are preparing evidence

0:13:20 > 0:13:24for a case that will test the boundaries of her tough justice.

0:13:24 > 0:13:26They're trying a man for murder,

0:13:26 > 0:13:29even though he didn't kill anyone himself.

0:13:29 > 0:13:33That is Mr Wright's DNA and the DNA swab from the rounds.

0:13:38 > 0:13:44Prosecutors allege that early in the morning of May the 18th 2015,

0:13:44 > 0:13:48two masked men entered a student apartment to commit a robbery.

0:13:52 > 0:13:54Armed with a gun,

0:13:54 > 0:13:57they allegedly woke one of the housemates, demanding money.

0:14:00 > 0:14:02Another resident heard the struggle,

0:14:02 > 0:14:05came in and shot the alleged intruders.

0:14:10 > 0:14:11One of them was injured.

0:14:14 > 0:14:16The other, killed.

0:14:18 > 0:14:21Prosecutors chose not to charge the resident

0:14:21 > 0:14:23who fired the fatal shots,

0:14:23 > 0:14:26accepting his claim that he acted in self-defence.

0:14:28 > 0:14:32Instead, the alleged intruder who survived is being held

0:14:32 > 0:14:36responsible for the death and is charged with murder.

0:14:37 > 0:14:40Bad things will happen when you do bad things.

0:14:42 > 0:14:48When one or more people commit a violent crime and the person

0:14:48 > 0:14:52who you are committing the crime with gets killed,

0:14:52 > 0:14:55the blood ends up being on your hands.

0:14:57 > 0:15:01There needs to be some accounting for committing a particular crime.

0:15:01 > 0:15:05Society needs to be protected and punishment is appropriate.

0:15:07 > 0:15:12The accused man is 26-year-old Trey Wright.

0:15:12 > 0:15:16There is always that fear present that I'm going to get found guilty

0:15:16 > 0:15:20and spend the rest of my life in prison, you know.

0:15:20 > 0:15:22Is this what I'm going to have to look forward to

0:15:22 > 0:15:25for the rest of my life?

0:15:25 > 0:15:27The person who was shot and killed in the incident

0:15:27 > 0:15:31was Trey's cousin and best friend, Bryant Collier.

0:15:32 > 0:15:36I got shot about 10 or 12 times.

0:15:36 > 0:15:41My cousin got shot four times and he didn't make it.

0:15:43 > 0:15:47I don't know if it's something I will ever be able to get over

0:15:47 > 0:15:49cos he was like a brother to me.

0:15:53 > 0:15:58Trey denies the charges and is going to fight them at trial.

0:16:03 > 0:16:04People don't understand.

0:16:04 > 0:16:06"How can I be charged with murder

0:16:06 > 0:16:08"if I wasn't the one that pulled the trigger?"

0:16:11 > 0:16:14The laws in the state of Florida are very harsh.

0:16:14 > 0:16:16People from other parts of the country are shocked

0:16:16 > 0:16:20at what people in Florida are facing.

0:16:20 > 0:16:24It's kind of all or nothing. There isn't a medium.

0:16:24 > 0:16:26He's facing three life sentences.

0:16:26 > 0:16:29And life is life. There's no parole any more in the state of Florida.

0:16:29 > 0:16:32So he would go to prison and he would never get out.

0:16:34 > 0:16:36He would die of old age in the prison.

0:16:45 > 0:16:49Trey was shot over ten times

0:16:49 > 0:16:51and Bryant was there.

0:16:51 > 0:16:53And we knew that because of the law,

0:16:53 > 0:16:59that Trey would be charged with Bryant's murder

0:16:59 > 0:17:03and that was very difficult to swallow, to deal with.

0:17:03 > 0:17:06Because we knew that he was going to be charged with a

0:17:06 > 0:17:09loved one's murder. A murder of someone that he loves.

0:17:12 > 0:17:14Trey and Bryant grew up together,

0:17:14 > 0:17:16but during the trial

0:17:16 > 0:17:19their families will sit on opposite sides of the court.

0:17:24 > 0:17:26Even though I know he's not here,

0:17:26 > 0:17:31but if I want to come to visit, this is where I have to come.

0:17:31 > 0:17:33So it breaks my heart...

0:17:36 > 0:17:39..every time I come, but I still feel like I have to.

0:17:43 > 0:17:45They told me that my son died

0:17:45 > 0:17:48in the process of committing a home invasion

0:17:48 > 0:17:52and that the person that shot him, shot him in self-defence.

0:17:56 > 0:17:59You know, this is crazy to me that you can shoot somebody

0:17:59 > 0:18:01and it's OK.

0:18:01 > 0:18:03You don't ask any questions.

0:18:03 > 0:18:05You don't have to be accountable for that.

0:18:07 > 0:18:10I just... I want someone to be responsible.

0:18:26 > 0:18:30It's been 24 hours since the double murder of Bob Massey

0:18:30 > 0:18:32and his niece, Amy Hatfield.

0:18:32 > 0:18:37- Amy was strangled.- Yes. A long black, nylon shoelace.- OK.

0:18:37 > 0:18:39And it was tight.

0:18:39 > 0:18:41It was tight enough to abrade the neck.

0:18:41 > 0:18:42And you can see an outline

0:18:42 > 0:18:45- where he actually was starting to cut through the tissue.- OK.

0:18:45 > 0:18:49Detectives now have the postmortems on the bodies.

0:18:49 > 0:18:52They think Amy was killed first.

0:18:52 > 0:18:54So with Mr Massey, what do you have?

0:18:54 > 0:18:59We got two upward thrusts.

0:18:59 > 0:19:01It looked like a single-edged blade,

0:19:01 > 0:19:04penetrated about an inch and a quarter into his neck.

0:19:04 > 0:19:06He wouldn't have lost consciousness right away.

0:19:06 > 0:19:08He was probably trying to make it into the bedroom,

0:19:08 > 0:19:11maybe to call 911, and collapsed at that point.

0:19:11 > 0:19:12Gotcha. OK.

0:19:13 > 0:19:17They're tracking the mobile phone used by their main suspect,

0:19:17 > 0:19:19Amy's boyfriend, TJ.

0:19:20 > 0:19:24Now, the phone started to ping around eight o'clock this morning

0:19:24 > 0:19:28and it's on its way up I75, towards Perry, Georgia, Atlanta,

0:19:28 > 0:19:30- up in that area.- Right.

0:19:34 > 0:19:38Where we are is that this individual is from Pennsylvania.

0:19:38 > 0:19:40He has fled.

0:19:40 > 0:19:42We contacted Georgia State Patrol,

0:19:42 > 0:19:46we updated them with, you know, our ping locations when we got them

0:19:46 > 0:19:49and they were kind of one step behind him most of the day.

0:19:49 > 0:19:51He has turned the phone off.

0:19:51 > 0:19:55We need him picked up so we know where he is and we can talk to him.

0:19:57 > 0:20:00All right, that will work. I appreciate it, Jim.

0:20:01 > 0:20:04Unless the suspect uses the phone again,

0:20:04 > 0:20:09detectives are relying on police in Georgia to find him.

0:20:09 > 0:20:13If someone doesn't want to be found, and they're good at hiding,

0:20:13 > 0:20:15it is hard at times to find them.

0:20:15 > 0:20:18We've been working this case since yesterday and I think we've

0:20:18 > 0:20:22been home with about four hours of sleep.

0:20:22 > 0:20:25And it's now a day later.

0:20:25 > 0:20:28And we work it until we have nothing else to follow through on.

0:20:31 > 0:20:34A lot of these families, you know, like you would expect,

0:20:34 > 0:20:39want the killer of their loved ones found right away.

0:20:39 > 0:20:41And it's usually a long process.

0:20:46 > 0:20:47Don't just grab random waters.

0:20:47 > 0:20:50- This thing needs to come down.- Come on.

0:20:50 > 0:20:52- Don't give me that face.- Yeah.

0:20:55 > 0:20:57Who told you you can be in here?

0:20:58 > 0:21:00The first day I come over here when you went to work,

0:21:00 > 0:21:02I come over here at like six o'clock in the morning,

0:21:02 > 0:21:06by myself, to clean up and there was blood everywhere. It was hard.

0:21:06 > 0:21:08And then I freaked out trying to scrub blood up

0:21:08 > 0:21:10off the floor, for some reason.

0:21:10 > 0:21:12There was blood around the water bed.

0:21:12 > 0:21:14And, obviously, they found Dad here.

0:21:14 > 0:21:17We heard that from the roommate, we don't even know.

0:21:17 > 0:21:20And then the blood soaked through the floor here.

0:21:20 > 0:21:24Which is the other big bloodstain in the floor.

0:21:24 > 0:21:28When we first came in here, you walk in and it was like he was just here.

0:21:28 > 0:21:30He still has a beer out on the porch.

0:21:30 > 0:21:33- Hamburger I made him.- There's a hamburger in the refrigerator.

0:21:33 > 0:21:36You know, like, it's just... It's odd, you know.

0:21:36 > 0:21:40Cos you walk in and it's exactly like he was just out, you know.

0:21:40 > 0:21:42Except there's blood everywhere.

0:21:47 > 0:21:49I think it's really going to hit me after we're done

0:21:49 > 0:21:50and we get everything finished.

0:21:50 > 0:21:53I think that's when it's really going to hit me.

0:21:53 > 0:21:56Because, like he said, your brain just kind of shuts it off.

0:21:56 > 0:21:59I've always... Like, any time I've been upset,

0:21:59 > 0:22:01I just kind of shove it down.

0:22:01 > 0:22:03It's weird how we handle things differently

0:22:03 > 0:22:05because it's not quite the same for me.

0:22:05 > 0:22:08I let it hit me whenever it hits.

0:22:08 > 0:22:12But like I said, it just comes in waves. So...

0:22:12 > 0:22:15- Just want to get my hands on him. Just once.- Yeah.

0:22:17 > 0:22:21- SOBS:- I should've been here, man. - It wasn't your fault at all.

0:22:21 > 0:22:22I shouldn't have left.

0:22:27 > 0:22:28Come here, man.

0:22:29 > 0:22:31It's OK, dude. It's not your fault.

0:22:31 > 0:22:34- You didn't know anything... - He's dead.

0:22:39 > 0:22:41I should've been here, man.

0:22:41 > 0:22:42I should've fucking been here.

0:22:42 > 0:22:44No, man.

0:22:44 > 0:22:45Kill that son of a bitch, man.

0:22:50 > 0:22:52It's not your fault, man.

0:23:02 > 0:23:04Hello?

0:23:04 > 0:23:06Yeah, it's kind of hectic.

0:23:06 > 0:23:09We're trying to get a murder warrant.

0:23:09 > 0:23:13I need you to pack me a bag again.

0:23:13 > 0:23:16Yeah, we're heading to Georgia.

0:23:16 > 0:23:17Hoping to.

0:23:17 > 0:23:20Are we going to be able to have access to him this evening?

0:23:20 > 0:23:22The main suspect, TJ, has been picked up

0:23:22 > 0:23:26at a drug rehab clinic 160 miles away.

0:23:26 > 0:23:28Trying to get everything squared away right now.

0:23:28 > 0:23:32We're on the phone with the state attorney right now.

0:23:32 > 0:23:34All right, I appreciate it. Thank you.

0:23:38 > 0:23:39All righty.

0:23:51 > 0:23:54Everyone that we interview is different.

0:23:54 > 0:23:57Some people will feel comfortable talking to me.

0:23:57 > 0:24:00And once they feel comfortable, they're a little easier

0:24:00 > 0:24:03to get information from.

0:24:03 > 0:24:09Then, once you get them talking, you want to get to a point

0:24:09 > 0:24:11where they can confide in you.

0:24:13 > 0:24:17And that hopefully will eventually lead to an admission.

0:24:28 > 0:24:32Everyone makes mistakes in life.

0:24:32 > 0:24:34And that's what's part of being a human being.

0:24:34 > 0:24:37We're all going to make mistakes. Some are more serious than others.

0:24:40 > 0:24:43You never know what you're really going to get until you get there.

0:24:43 > 0:24:46Some of them, you look at them and it kind of sends

0:24:46 > 0:24:49the hair on the back of your neck up.

0:24:49 > 0:24:52But the majority is like you and me.

0:24:52 > 0:24:56Some of them are evil

0:24:56 > 0:24:58and some of them just made a terrible mistake.

0:25:19 > 0:25:21- How are you?- Good, how are you?

0:25:21 > 0:25:24- Nice to meet you. - Joey Blackburn, nice to meet you.

0:25:31 > 0:25:33Can you call Thomas Brown? Thank you.

0:25:37 > 0:25:39- It's out.- Yep.- It's good.

0:25:42 > 0:25:44- I've accessed him there. - Yes, indeed. Yes.

0:25:49 > 0:25:51Morning, TJ.

0:25:51 > 0:25:52How you doing, man?

0:25:54 > 0:25:57- This is my sergeant.- How are you? - These are my team-mates.

0:26:00 > 0:26:01You good?

0:26:02 > 0:26:05You want to smoke a cigarette first?

0:26:05 > 0:26:10- I'll get one. - I appreciate it.- Mm-hm.

0:26:10 > 0:26:14The investigation now hangs on what the suspect reveals

0:26:14 > 0:26:16in his interview with Detective Bobby Bowers.

0:26:18 > 0:26:22It's all the way you come across to them.

0:26:22 > 0:26:25If you come in here being an asshole,

0:26:25 > 0:26:27you're not going to get anywhere.

0:26:27 > 0:26:28You know?

0:26:28 > 0:26:33You have to learn to read people and kind of feel them out.

0:26:33 > 0:26:36Even if they don't want to give you anything,

0:26:36 > 0:26:39you're going to have to find a way to get it.

0:26:43 > 0:26:47Bobby starts by questioning TJ about his relationship with Amy.

0:28:15 > 0:28:17- I promise you.- You never... OK.

0:28:24 > 0:28:25Yeah, probably. Yeah.

0:28:28 > 0:28:29OK.

0:28:42 > 0:28:46He gave us the detail of what they did

0:28:46 > 0:28:49from the time they left Pittsburgh.

0:28:49 > 0:28:53He admits that he choked her to death.

0:28:53 > 0:28:55And when she was still moving, at that point, he covered

0:28:55 > 0:28:57her face with a towel and started cutting her throat.

0:28:57 > 0:29:01- Why did he cover her face? Did he explain why?- He didn't say.

0:29:01 > 0:29:04In fact, in both cases, he used a towel to cover their face.

0:29:04 > 0:29:07I don't think he wanted them looking at him

0:29:07 > 0:29:10- because he had feelings for them. - While they were dying?

0:29:10 > 0:29:14While he's cutting their throat, he didn't want to see their reaction.

0:29:14 > 0:29:17He got up, went into the bathroom, threw up.

0:29:17 > 0:29:20And as he was going toward the kitchen, he saw Bobby standing there

0:29:20 > 0:29:23and he admitted that he had killed her.

0:29:23 > 0:29:24And then Bobby charged him,

0:29:24 > 0:29:27they grappled and he said he stabbed him

0:29:27 > 0:29:29because he didn't want him to suffer.

0:29:29 > 0:29:31Cos he liked him.

0:29:31 > 0:29:32So he wanted to kill him quicker.

0:29:40 > 0:29:44TJ is taken back to Jacksonville to face prosecution.

0:29:51 > 0:29:55I think right now TJ is probably terrified.

0:29:57 > 0:30:00He asked me if Florida was a death penalty state.

0:30:00 > 0:30:01And I told him it was.

0:30:04 > 0:30:07And he asked if this was a death penalty case.

0:30:07 > 0:30:11And I explained to him that that's not my decision to make.

0:30:11 > 0:30:12It goes to the state attorney.

0:30:12 > 0:30:18And even though we may argue it, the family might argue it,

0:30:18 > 0:30:19and the families often argue it.

0:30:19 > 0:30:23They want justice. You know, they want an eye for an eye.

0:30:23 > 0:30:27But if the state decides that they don't want to go for the

0:30:27 > 0:30:31death penalty, then it doesn't happen and that's the end of it.

0:30:31 > 0:30:34And the family has to live with it.

0:30:42 > 0:30:46The trial of Trey Wright starts today.

0:30:48 > 0:30:53He is charged with the felony murder of his cousin, Bryant,

0:30:53 > 0:30:56shot while they were allegedly committing a robbery.

0:31:01 > 0:31:04The prosecution offered Trey a reduced sentence

0:31:04 > 0:31:07if he pleaded guilty before trial.

0:31:07 > 0:31:12But he refused, choosing instead to fight the charges in court.

0:31:12 > 0:31:15It's always the client's decision.

0:31:15 > 0:31:20And if they choose to go to trial, then we do our best.

0:31:20 > 0:31:22We work hard for them.

0:31:25 > 0:31:29I think I would plead rather than risk the trial.

0:31:29 > 0:31:33Because a lot of times with the judges in this circuit,

0:31:33 > 0:31:36if you lose at trial, you're going to get slammed,

0:31:36 > 0:31:38you're going to get life.

0:31:38 > 0:31:42Do you think you'd take a plea even if you knew you were innocent?

0:31:43 > 0:31:45I think... I don't know.

0:31:45 > 0:31:48I...

0:31:48 > 0:31:51I would be scared to death to go to trial.

0:31:52 > 0:31:56The trial is overseen by Judge Russell Healey.

0:31:56 > 0:31:59If Trey's found guilty, he will decide the sentence.

0:31:59 > 0:32:05I try and be fair in the sentences that I hand out.

0:32:05 > 0:32:08Some of them are harsh.

0:32:08 > 0:32:09I believe they are deserving.

0:32:13 > 0:32:15You know, and I'm OK with people thinking I'm tough.

0:32:15 > 0:32:18That doesn't bother me in the least.

0:32:18 > 0:32:21It may be a hard pill for some people to swallow. I get that.

0:32:21 > 0:32:24At the end of the day, I've got to go home and put my head

0:32:24 > 0:32:26on a pillow and sleep, too.

0:32:26 > 0:32:30The defendant is charged with three separate offences.

0:32:30 > 0:32:33The first count is second-degree felony murder.

0:32:33 > 0:32:38The second count is armed burglary. The third count is armed robbery.

0:32:39 > 0:32:44As his parents, we feel like our hands are tied.

0:32:44 > 0:32:48Because the first thing a parent wants to do is to come to

0:32:48 > 0:32:49your child's defence.

0:32:50 > 0:32:55You realise that you've got to face the system,

0:32:55 > 0:33:00but you also got to trust the system to a degree, OK?

0:33:00 > 0:33:03And we're hoping that, erm...

0:33:04 > 0:33:06..that mercy will prevail.

0:33:08 > 0:33:12The prosecution presents its case first.

0:33:12 > 0:33:14It relies on the evidence

0:33:14 > 0:33:17of three people who were in the residence that night.

0:33:17 > 0:33:19Can you please introduce yourself to the jury?

0:33:19 > 0:33:21My name is Abdul Rosenje.

0:33:21 > 0:33:24- And, Mr Rosenje, do you have a nickname?- Yes, I go by Mo.

0:33:24 > 0:33:28First, the victim of the alleged robbery.

0:33:28 > 0:33:33I want to draw your attention to the events of May 18th, 2015, OK?

0:33:33 > 0:33:37Can you tell the jury how you woke up?

0:33:37 > 0:33:40I was asleep in my bed, it was pretty early in the morning.

0:33:40 > 0:33:46I woke up to two masked men with a gun, pretty large size,

0:33:46 > 0:33:49an assault rifle or some type of military weapon, and I was being

0:33:49 > 0:33:52nudged with the weapon. And that was how I woke up.

0:33:52 > 0:33:55They were telling me to keep quiet, trying to keep me quiet.

0:33:55 > 0:33:58The house was really quiet, it was early in the morning.

0:33:58 > 0:34:00And he just kept saying, "Shh, shh!"

0:34:00 > 0:34:03At that point, for a second he might have looked away

0:34:03 > 0:34:05or something happened, but he was distracted.

0:34:05 > 0:34:07In that millisecond, I instantly just reached,

0:34:07 > 0:34:10lunged for the front of the gun.

0:34:10 > 0:34:12We were wrestling back and forth over it.

0:34:12 > 0:34:14And at that point, I had my hands on the gun like this,

0:34:14 > 0:34:16we were wrestling over the gun.

0:34:16 > 0:34:19He yanked it back. At that point, it went like this.

0:34:19 > 0:34:21And that was when he shot me in the stomach.

0:34:30 > 0:34:33Explain to the jury what you heard on the morning of May 18th, 2015.

0:34:33 > 0:34:36The next witness is the man who killed Bryant,

0:34:36 > 0:34:39whom the prosecution say was defending his home.

0:34:39 > 0:34:42I was getting ready to go to summer school

0:34:42 > 0:34:45when I started hearing scuffling in the room.

0:34:45 > 0:34:48- And what did you do next? - I crept around the corner.

0:34:48 > 0:34:51When I was creeping round the corner, like,

0:34:51 > 0:34:53that's when I seen three dudes scuffling.

0:34:53 > 0:34:56- And I seen one of them in a chokehold.- Mo?- Yeah.

0:34:56 > 0:34:58He was in a chokehold

0:34:58 > 0:35:01and he was fighting with a guy with a rifle.

0:35:01 > 0:35:03And then, when I see his face, that's when I ran in.

0:35:03 > 0:35:07I rushed in, I just had a gun in my hand

0:35:07 > 0:35:10and then I just reacted, just started shooting.

0:35:13 > 0:35:16I seen Mo's face, so I just shot the two that I didn't know.

0:35:19 > 0:35:22I heard gunshots, multiple ones.

0:35:22 > 0:35:26And I kind of panicked, I ran back to my room.

0:35:26 > 0:35:27And I called 911.

0:35:30 > 0:35:32- RECORDING:- 911, 911. Please.

0:35:48 > 0:35:52After I got off the phone, I seen the one guy on the floor.

0:35:52 > 0:35:55He was in the doorway of the second bedroom and he didn't have

0:35:55 > 0:35:58- any mask on any more. - Was he standing or sitting?

0:35:58 > 0:36:00Laying down on his back.

0:36:00 > 0:36:03- Was he still alive? - He was gasping for air.

0:36:08 > 0:36:09I've no further questions,

0:36:09 > 0:36:12I'll tender the witness for cross-examination.

0:36:14 > 0:36:18Trey's defence is that he wasn't there to commit a robbery

0:36:18 > 0:36:21and so can't be guilty of felony murder.

0:36:22 > 0:36:25His team start by attacking the evidence

0:36:25 > 0:36:28of the prosecution's witnesses.

0:36:28 > 0:36:31- Good morning, Mr Rosenje. - How are you doing today, ma'am?

0:36:31 > 0:36:36- You woke up to two masked men in your room?- Yes.

0:36:36 > 0:36:39- And you had no idea who they were?- No idea.

0:36:39 > 0:36:43Mr Rosenje, isn't it true that you saw Bryant Collier

0:36:43 > 0:36:48and Trey Wright at a barbecue the night before the shooting?

0:36:48 > 0:36:50- Is that correct?- Yes.

0:36:51 > 0:36:54And isn't it true that Bryant Collier,

0:36:54 > 0:36:57you've known him for a couple of years

0:36:57 > 0:36:58and he was a friend of yours?

0:36:58 > 0:37:03- He was actually a very good friend. Is that correct?- Yeah.- OK.

0:37:03 > 0:37:07- And you're wrestling with Trey Wright.- Yes.

0:37:07 > 0:37:11- And you had been with him, hours before, at a barbecue?- Yes.

0:37:11 > 0:37:14- And you didn't recognise him? - No, I did not.

0:37:14 > 0:37:15But he was at the barbecue the night before?

0:37:15 > 0:37:18- He was at the barbecue the night before.- OK.

0:37:21 > 0:37:22We're trying to show the jury

0:37:22 > 0:37:24that the state witnesses, they're not credible.

0:37:24 > 0:37:28If there is doubt about enough little things,

0:37:28 > 0:37:30then the jury starts thinking, "Well, wait a minute,

0:37:30 > 0:37:34"how can I trust this person on the big picture?"

0:37:36 > 0:37:41The defence team also have questions about the gun used to kill Bryant.

0:37:42 > 0:37:45So, during the altercation, you exit your room.

0:37:45 > 0:37:48- Do you have a gun at that point? - No.- All right.

0:37:48 > 0:37:51So, when you go into the other room with the three guys that

0:37:51 > 0:37:56- are fighting, you end up with a gun at that point?- Yes.- OK.

0:37:56 > 0:37:58Do you know what kind of gun that was?

0:37:58 > 0:38:01The gun... I don't know what kind of gun it was that was used.

0:38:01 > 0:38:03I just... It was just in my hand.

0:38:03 > 0:38:06All right. But that gun that was in your hand

0:38:06 > 0:38:09was the one that shot the individuals lying on the ground?

0:38:09 > 0:38:10Yeah.

0:38:13 > 0:38:18As a criminal defence attorney, you have cases where you start

0:38:18 > 0:38:22stumbling upon the pieces that don't make sense.

0:38:22 > 0:38:26There was a gun, it was used to kill someone.

0:38:26 > 0:38:32It's never been located, the gun that's used to kill Bryant Collier.

0:38:33 > 0:38:36You got shot once by the rifle and once by Bart?

0:38:36 > 0:38:37Yes.

0:38:37 > 0:38:41- And you don't know what happened to the gun that Bart had?- No.

0:38:41 > 0:38:45- And you don't know where Jabarta got his gun from?- No, I do not know.

0:38:45 > 0:38:48- The gun that Jabarta had was not your gun?- It was not my gun.

0:38:48 > 0:38:51You don't know where it came from and you don't know where it went?

0:38:51 > 0:38:54- Don't know where it came from, I don't know where it went.- OK.

0:38:54 > 0:38:56No further questions.

0:38:59 > 0:39:01All right, ladies and gentlemen, that'll do it.

0:39:01 > 0:39:04Please again remember, do not discuss the case

0:39:04 > 0:39:06among yourselves, don't let anybody discuss the case with you

0:39:06 > 0:39:08or in your presence.

0:39:08 > 0:39:11Tomorrow, the defence will call their only witness,

0:39:11 > 0:39:13Trey Wright himself.

0:39:14 > 0:39:18His testimony is critical.

0:39:18 > 0:39:20There's a lot of good stuff to say about Trey Wright.

0:39:20 > 0:39:23He does not have a record.

0:39:23 > 0:39:25He's not a convicted felon,

0:39:25 > 0:39:28he's got a college degree and if the jury believes him,

0:39:28 > 0:39:32we're going to win. That is the bottom line.

0:39:34 > 0:39:39But if he gets convicted of felony murder, he's, you know, looking...

0:39:39 > 0:39:41He's going to get life.

0:39:51 > 0:39:53I have been working all morning.

0:39:53 > 0:39:56I can rebut everything that's in that report and I'm horrified

0:39:56 > 0:40:00that people have not challenged the veracity of that report,

0:40:00 > 0:40:03but I intend to challenge it.

0:40:03 > 0:40:06With just weeks to the state attorney election,

0:40:06 > 0:40:08Angela Corey is under fire.

0:40:10 > 0:40:11A report has been published

0:40:11 > 0:40:15criticising her overuse of the death penalty.

0:40:15 > 0:40:17Now, if this isn't directly attributable

0:40:17 > 0:40:20to me running for office, why did they feel the need to just single

0:40:20 > 0:40:22us out in this report?

0:40:22 > 0:40:24As opposed to comparing us to other counties in the state

0:40:24 > 0:40:27where the laws are the same.

0:40:27 > 0:40:30The death penalty is the law of the state of Florida

0:40:30 > 0:40:33and I will not apologise for enforcing our laws,

0:40:33 > 0:40:35including the death penalty.

0:40:35 > 0:40:38Our Fourth Judicial Circuit needs a major overhaul,

0:40:38 > 0:40:41so just because someone made a mistake in their life,

0:40:41 > 0:40:44doesn't mean you have to kill them in return.

0:40:44 > 0:40:49The death penalty in Duval County needs to be suspended immediately.

0:40:49 > 0:40:55The negative press means Angela is slipping in the polls.

0:40:55 > 0:40:58We cannot live another eight, ten, 12 years

0:40:58 > 0:41:00under this vindictive woman.

0:41:00 > 0:41:05I hope to see you, August 30th, at the election office.

0:41:05 > 0:41:08The problem with being the elected official is when there's

0:41:08 > 0:41:11misinformation about what you do and how you do it,

0:41:11 > 0:41:14it causes people to want to take you down.

0:41:14 > 0:41:17Angela Corey's campaign, it surprised me, again,

0:41:17 > 0:41:19the lack of ownership.

0:41:19 > 0:41:24Her refusal to be accountable. Miss Corey blames everybody.

0:41:24 > 0:41:27The media is included in that.

0:41:27 > 0:41:31One of the things that I am pledging is to be open with the media

0:41:31 > 0:41:35and with the community and the people who I represent.

0:41:35 > 0:41:38It is time for a change, so join your unions,

0:41:38 > 0:41:41organise, register to vote and make your voices heard.

0:41:41 > 0:41:44God bless you all.

0:41:44 > 0:41:46Every single person that doesn't like one decision you make

0:41:46 > 0:41:49on one case becomes very vocal.

0:41:51 > 0:41:54I will never stop trying to convince them of how we operate

0:41:54 > 0:41:57within the bounds of the law and the facts in our cases

0:41:57 > 0:42:01but I also won't apologise to them for doing what we have to do

0:42:01 > 0:42:02to protect this community.

0:42:12 > 0:42:16Thomas TJ Brown is back in Jacksonville,

0:42:16 > 0:42:20charged with the double murder of Bob Massey and Amy Hatfield.

0:42:21 > 0:42:25Despite his confession, he's pleading not guilty,

0:42:25 > 0:42:29so he's presumed innocent by the courts.

0:42:31 > 0:42:35Detectives hand over the case file to prosecutor Janeen Kirch.

0:42:35 > 0:42:38She decides what punishment the state will seek

0:42:38 > 0:42:39if he's found guilty.

0:42:39 > 0:42:41- We'll see you later.- All right.

0:42:41 > 0:42:44For first-degree murder she only has two options -

0:42:44 > 0:42:47life without parole or the death penalty.

0:42:47 > 0:42:49I think a lot of people have a mistaken belief about how

0:42:49 > 0:42:52it is we come to the decision to seek the death penalty.

0:42:52 > 0:42:54And it's not come to lightly.

0:42:54 > 0:42:56I mean, we understand that we would be seeking

0:42:56 > 0:42:58to take someone's life.

0:43:00 > 0:43:03In order for us to even seek the death penalty,

0:43:03 > 0:43:06we look at the Florida Statutes. We review all the facts.

0:43:06 > 0:43:10We talk to the family members of the deceased individuals.

0:43:10 > 0:43:12You know, we have to learn the background.

0:43:12 > 0:43:15Is this person even eligible for the death penalty,

0:43:15 > 0:43:17by their age, by their mental health?

0:43:17 > 0:43:22So there are a lot of factors to consider when making a decision.

0:43:24 > 0:43:26So the way the charging document is...

0:43:26 > 0:43:29Here's the indictment, I can show you.

0:43:29 > 0:43:34So the first count's for Amy and the second count is for your dad.

0:43:34 > 0:43:37So it's two counts of murder in the first degree.

0:43:37 > 0:43:38And in the state of Florida,

0:43:38 > 0:43:40the only two possible penalties for murder

0:43:40 > 0:43:43in the first degree is mandatory life in prison,

0:43:43 > 0:43:46which is day for day, we don't have parole any more,

0:43:46 > 0:43:49or the death penalty. That's where we're at right now.

0:43:49 > 0:43:52Obviously, my goal is to seek justice for your family.

0:43:52 > 0:43:54So my goal is for him not to walk.

0:43:54 > 0:43:57I will make the best decision for the case

0:43:57 > 0:43:59and for justice for your family.

0:43:59 > 0:44:03But we do take great weight into what you all want.

0:44:03 > 0:44:07Before making that decision, Janeen, is this case a possibility

0:44:07 > 0:44:11to qualify for death penalty or is that not even an issue right now?

0:44:11 > 0:44:13So the best that I can tell you right now

0:44:13 > 0:44:16is that I'm still investigating the appropriate penalty.

0:44:16 > 0:44:20I'd say, as far as the answer to which penalty,

0:44:20 > 0:44:22when do you think we'll know more information?

0:44:22 > 0:44:24Because we still don't know much.

0:44:24 > 0:44:26I mean, we know he killed Amy, we know he killed Dad.

0:44:26 > 0:44:28But did he kill Amy because...?

0:44:28 > 0:44:31The way I see things, he could have killed Amy and just ran,

0:44:31 > 0:44:33but he didn't.

0:44:33 > 0:44:34So I want to know more.

0:44:34 > 0:44:36- Sure.- I mean, either way,

0:44:36 > 0:44:38if he gets charged for the first-degree murder,

0:44:38 > 0:44:40he's minimum spending life in prison, am I right?

0:44:40 > 0:44:42If he is found guilty, correct.

0:44:42 > 0:44:44And what is life in prison in Florida? 30 years?

0:44:44 > 0:44:46- Life is life.- It's life. - There is no parole in Florida.

0:44:46 > 0:44:49There is no good behaviour any more, or anything like that.

0:44:49 > 0:44:50It's, erm...

0:44:50 > 0:44:55And I appreciate you all telling me you're not quite sure yet,

0:44:55 > 0:44:59and a lot of people come in here and they... They're so...

0:44:59 > 0:45:01But they're so emotional about the loss of their family member,

0:45:01 > 0:45:03which is understandable.

0:45:03 > 0:45:05But I appreciate you all wanting to give it some thought

0:45:05 > 0:45:08- and take your time. - Kind of take it all in.

0:45:08 > 0:45:11We're going to do everything we can, that's for sure.

0:45:11 > 0:45:12All right, guys.

0:45:12 > 0:45:16Well, thank you so much for coming in. I will walk you all out.

0:45:16 > 0:45:18- Thanks.- Let me put this in here.

0:45:21 > 0:45:26Janeen must now decide if the crime fits one of the 16 conditions

0:45:26 > 0:45:29needed to qualify for the death penalty in Florida.

0:45:29 > 0:45:32I'm so sorry for your loss and if you need anything, give me a call.

0:45:32 > 0:45:35Florida Statute 921.141.

0:45:35 > 0:45:39Aggravating circumstances for when we can seek death.

0:45:39 > 0:45:42"Capital felony was especially heinous, atrocious or cruel,

0:45:42 > 0:45:45"B, the capital felony was a homicide.

0:45:45 > 0:45:48"It was committed in cold, calculated or premeditated..."

0:45:53 > 0:45:58This decision is discretionary, you know, period.

0:46:01 > 0:46:05We're guided by the Statutes of what we should do,

0:46:05 > 0:46:08but it is discretionary.

0:46:10 > 0:46:13And it's not come to lightly. And it's a hard decision.

0:46:13 > 0:46:18You know, even the prosecutors in this office have different views on

0:46:18 > 0:46:20the death penalty.

0:46:21 > 0:46:25It's hard, but that's why this system is so important.

0:46:43 > 0:46:46We wanted to come out to the beach and light the lanterns with the

0:46:46 > 0:46:49prayers on them because he would have really liked that.

0:46:49 > 0:46:51THEY CHEER

0:46:55 > 0:46:59My dad was an old man, he couldn't have put up much of a fight.

0:47:00 > 0:47:03It was just pointless, senseless.

0:47:03 > 0:47:06He is a coward and he deserves whatever he gets.

0:47:08 > 0:47:12I guess I just never felt more powerless in my life.

0:47:12 > 0:47:15Yeah, definitely powerless.

0:47:15 > 0:47:20I can't do anything about it. I can't even get to him.

0:47:23 > 0:47:28I want him to feel what my dad felt. I want him to feel scared.

0:47:31 > 0:47:34I hope they give him the death penalty, honestly.

0:47:38 > 0:47:40I don't know which one's worse,

0:47:40 > 0:47:42spending the rest of your days locked in prison,

0:47:42 > 0:47:44or the death penalty.

0:47:46 > 0:47:49I don't know. I'm not sure.

0:47:52 > 0:47:54It doesn't bring Dad back.

0:47:54 > 0:47:56I knew that from the get-go.

0:47:56 > 0:47:59Yeah, it gives Dad a little bit of justice,

0:47:59 > 0:48:01but what is that, really, you know?

0:48:19 > 0:48:24Janeen is called to court to give her decision.

0:48:24 > 0:48:26When I was applying for this job,

0:48:26 > 0:48:32you know I was a young, 24-year-old and I knew that

0:48:32 > 0:48:33the question was going to come up.

0:48:33 > 0:48:36"What are you... How do you feel about the death penalty?"

0:48:36 > 0:48:40And so I talked about it with my dad and I said,

0:48:40 > 0:48:43"You know, I'm not sure what I'm going to say."

0:48:43 > 0:48:47And he goes, "What would you want to happen to

0:48:47 > 0:48:52"the person who raped and murdered your little niece?"

0:48:54 > 0:48:58And I was like, "I would want to seek the death penalty."

0:48:58 > 0:49:00And he said, "Well, there's your answer."

0:49:03 > 0:49:05But as the protectors of our community,

0:49:05 > 0:49:07we don't want people making decisions

0:49:07 > 0:49:09based on how they feel that day.

0:49:09 > 0:49:10This is the law.

0:49:26 > 0:49:28Good morning, Your Honour.

0:49:28 > 0:49:30Janeen Kirch on behalf of the State of Florida.

0:49:30 > 0:49:33If I may please call the case of Thomas Brown.

0:49:35 > 0:49:39The State of Florida does give notice to the defendant in this case

0:49:39 > 0:49:43that pursuant to Florida Statutes 921.141,

0:49:43 > 0:49:45the state intends to seek the death penalty for the

0:49:45 > 0:49:48two counts of first-degree murder charged in this case.

0:49:48 > 0:49:50The state further gives notice to the defendant

0:49:50 > 0:49:53of the aggravating factors the state will rely on.

0:49:53 > 0:49:55The state requests that the defendant provide the

0:49:55 > 0:49:58State of Florida with a statement of particulars,

0:49:58 > 0:50:00listing the statutory and non-statutory...

0:50:00 > 0:50:05'Citizens think that we have all this power and we are just harshly

0:50:05 > 0:50:09'prosecuting these individuals.

0:50:09 > 0:50:14'People say, "Oh, I don't think it works, it's not fair."'

0:50:14 > 0:50:16But those individuals have a right to a jury of their peers,

0:50:16 > 0:50:19and their peers are the ones out there saying that it's

0:50:19 > 0:50:21a harsh, harsh system.

0:50:23 > 0:50:27Those peers, they decide guilt. They get to vote.

0:50:27 > 0:50:31That's the beauty of our system. They can make it fair.

0:50:39 > 0:50:40All rise.

0:50:43 > 0:50:45Good morning, everybody, and welcome back.

0:50:45 > 0:50:47You can all have your seats.

0:50:47 > 0:50:50It's the final day of Trey Wright's trial.

0:50:50 > 0:50:52The defence will call Trey Wright to the stand.

0:50:52 > 0:50:55Mr Wright, if you'll come on up?

0:50:55 > 0:50:58He is the only witness for the defence.

0:50:58 > 0:51:00And if you'll come right here before the clerk and raise your right hand.

0:51:00 > 0:51:03To have any chance of acquittal,

0:51:03 > 0:51:06he must convince the jury that he and his cousin Bryant

0:51:06 > 0:51:09weren't at the house to commit a robbery.

0:51:09 > 0:51:13It's all about the jury. They want to hear from the guy.

0:51:13 > 0:51:15And I tell my clients it's their decision.

0:51:15 > 0:51:18They don't have to testify.

0:51:18 > 0:51:22But he'd rather roll the dice and take his chances.

0:51:24 > 0:51:30You know, if he comes across as sincere and telling the truth,

0:51:30 > 0:51:32if they like him and believe him,

0:51:32 > 0:51:33they're going to walk him.

0:51:34 > 0:51:38Mr Wright, did you know the decedent in this case, Bryant Collier?

0:51:38 > 0:51:39Yes, I did.

0:51:39 > 0:51:41What was your relationship with him?

0:51:41 > 0:51:44He was my cousin, my best friend.

0:51:44 > 0:51:49Now, did you and your cousin actually see Abdul Rosenje

0:51:49 > 0:51:52- at a party or barbecue the night before?- Yes, ma'am.

0:51:52 > 0:51:54Did you and Bryant make plans

0:51:54 > 0:51:59- to come and see Abdul later on that morning?- Yes.

0:51:59 > 0:52:00So he knew you were coming?

0:52:00 > 0:52:04- Yes.- When you walked into that apartment, what was your plan?

0:52:04 > 0:52:10Erm, to smoke weed and possibly trade or sell a rifle.

0:52:10 > 0:52:11- He wanted the rifle?- Yes, ma'am.

0:52:11 > 0:52:14He was going to give you cash or marijuana.

0:52:14 > 0:52:17He was reluctant to give me cash for it,

0:52:17 > 0:52:20- he preferred to give me marijuana for it.- OK.

0:52:20 > 0:52:23And as I'm checking out the weed,

0:52:23 > 0:52:26I hear the bullet become loaded in the chamber.

0:52:26 > 0:52:28And I turn around and I see him.

0:52:28 > 0:52:31He's pointing it at us and he's like,

0:52:31 > 0:52:32"Y'all dead now.

0:52:32 > 0:52:35"It's... This is basically mine, this is mine."

0:52:35 > 0:52:38And so I look at Bryant. And he's kind of confused.

0:52:38 > 0:52:42I turn my attention back to Mo and I'm like... Just...

0:52:42 > 0:52:44I take a step towards him and

0:52:44 > 0:52:46that's when he hit me with the rifle.

0:52:47 > 0:52:50And we started wrestling for the gun.

0:52:50 > 0:52:51As I'm wrestling,

0:52:51 > 0:52:55I hear the door behind me kind of just burst open

0:52:55 > 0:53:01and I see a gun and then I just hear shots and I feel shots

0:53:01 > 0:53:03and the first shot that I feel hits me on my shoulder.

0:53:06 > 0:53:09And then I just remember falling and hearing more shots,

0:53:09 > 0:53:12hearing more shots and then it went silent.

0:53:14 > 0:53:16Mr Wright, did you shoot anyone?

0:53:16 > 0:53:18No, ma'am.

0:53:18 > 0:53:20- Did you intend for anyone to be shot?- No, ma'am.

0:53:28 > 0:53:30No further questions, Your Honour.

0:53:34 > 0:53:38If Trey Wright, as he spoke with you,

0:53:38 > 0:53:44if you believe that that is plausible, possible,

0:53:44 > 0:53:48that that could have happened, that's reasonable doubt.

0:53:50 > 0:53:54I submit to you that Trey Wright is not guilty of these charges.

0:53:57 > 0:54:00Every life has value.

0:54:00 > 0:54:03This is how Bryant Collier was left.

0:54:03 > 0:54:08He ends up deceased because, during a violent crime, such as a robbery,

0:54:08 > 0:54:10bad things happen.

0:54:10 > 0:54:12He is guilty of burglary

0:54:12 > 0:54:15and being armed while burglarising that residence

0:54:15 > 0:54:20and he is guilty, by virtue of being one of the robbers,

0:54:20 > 0:54:23of the death, the second-degree felony murder

0:54:23 > 0:54:25of Bryant Collier.

0:54:25 > 0:54:27Thank you.

0:54:27 > 0:54:28Ladies and gentlemen,

0:54:28 > 0:54:30I too want to thank you for your time and attention.

0:54:30 > 0:54:33Your duty is to determine if the defendant has been

0:54:33 > 0:54:35proven guilty or not, in accord with the law.

0:54:35 > 0:54:38It is my job to determine a proper sentence

0:54:38 > 0:54:41if the defendant is ultimately found guilty.

0:54:42 > 0:54:44You do your very best.

0:54:44 > 0:54:48You fight tooth and nail, every step of the way,

0:54:48 > 0:54:52and then you just let it unfold.

0:54:53 > 0:54:57If you've got somebody that you really believe is innocent,

0:54:57 > 0:54:58it's very scary.

0:55:03 > 0:55:05We charge felony murder

0:55:05 > 0:55:08because somebody has to be held accountable when someone

0:55:08 > 0:55:10dies a violent death.

0:55:11 > 0:55:14Our ultimate goal is to do justice.

0:55:22 > 0:55:26- Has the clerk published the verdicts?- Yes, Your Honour.

0:56:18 > 0:56:21It's always a risk going to trial

0:56:21 > 0:56:23because one of the wonderful things about the system

0:56:26 > 0:56:28They get to render their verdict.

0:56:28 > 0:56:33I can't appeal it, I can't ask the judge to overturn it.

0:56:33 > 0:56:36I can't even ask the jury to explain it.

0:56:37 > 0:56:39So, it's a way that citizens still

0:56:39 > 0:56:41have some control over the government,

0:56:41 > 0:56:46before the government takes a person's liberty away.

0:56:54 > 0:56:58The comfort that I can take in it, when things don't go the way

0:56:58 > 0:57:00that I want them to go,

0:57:40 > 0:57:43And it worked out in his favour. And I really am happy for him.

0:57:45 > 0:57:49The state didn't care anything about really getting justice for Bryant.

0:57:49 > 0:57:52It was really about putting Trey away.

0:57:52 > 0:57:54We may never get answers

0:57:54 > 0:57:58and, you know, we're going to have to...

0:57:59 > 0:58:04..to find a way to move on.

0:58:06 > 0:58:10Our law enforcement officers are the symbol of authority on the street

0:58:10 > 0:58:12and they must be obeyed.

0:58:12 > 0:58:15Three gunmen fired 50 rounds into a group of people last night.

0:58:15 > 0:58:18He got hit in the neck and that's what all that blood is.

0:58:18 > 0:58:20Stop! You're a xenophobe. You're a racist!

0:58:20 > 0:58:22Build that wall! Build that wall!

0:58:22 > 0:58:27The disconnect that exists between law enforcement and the community...

0:58:27 > 0:58:29So let's keep it cool. Don't give me none of this.

0:58:29 > 0:58:31..is the greatest problem

0:58:31 > 0:58:33facing the American justice system right now.
