0:04:17 > 0:04:18Hello?
0:04:24 > 0:04:26A mass shooting at Eureka Gardens last night
0:04:26 > 0:04:28left seven people wounded.
0:04:28 > 0:04:31Police are reviewing security footage, hoping it will help
0:04:31 > 0:04:33lead them to three gunmen who fired 50 rounds into
0:04:33 > 0:04:35a group of people last night.
0:04:37 > 0:04:41Eureka Gardens is a poor, predominantly black housing complex
0:04:41 > 0:04:43in the west of Jacksonville.
0:04:44 > 0:04:47These tenants are naturally very distraught.
0:04:47 > 0:04:48You can understand why.
0:04:48 > 0:04:50We have been here all morning.
0:04:50 > 0:04:53A group of at least eight people were outside -
0:04:53 > 0:04:54one of them is a baby -
0:04:54 > 0:04:57when three men walked up to them and started shooting.
0:04:57 > 0:05:00They fired at least 50 rounds.
0:05:02 > 0:05:05And which apartment was it they hit? 105 or 106?
0:05:05 > 0:05:06105?
0:05:06 > 0:05:10Detectives from Jacksonville Sheriff's Office arrive at the scene
0:05:10 > 0:05:11of last night's mass shooting.
0:05:15 > 0:05:18This is where the eight partiers...
0:05:18 > 0:05:20People were hanging out on the patio, having beers and relaxing,
0:05:20 > 0:05:21when the gunfire started?
0:05:21 > 0:05:23Yes. Yes. This part takes a strike here...
0:05:23 > 0:05:25Seven people were injured in the attack -
0:05:25 > 0:05:28two are fighting for their lives.
0:05:28 > 0:05:32One of the male victims was standing up in the vicinity of this area.
0:05:32 > 0:05:36He and several other victims fled inside the apartment complex
0:05:36 > 0:05:37as they were getting shot.
0:05:37 > 0:05:40- They got hit in the neck, and that's what all that blood is?- Yes.
0:05:40 > 0:05:42DOG BARKS
0:05:44 > 0:05:48And the 15-month-old and two-week-old were out front when
0:05:48 > 0:05:50the shooting started, and no kids were hit?
0:05:50 > 0:05:51No kids were hit.
0:05:53 > 0:05:55Lucky.
0:05:58 > 0:06:01Don't take this wrong... Have you ever been shot at before?
0:06:01 > 0:06:02Nope, never have...
0:06:02 > 0:06:06One of the group, who was shot at, is still at the scene.
0:06:06 > 0:06:09- The boys were standing out here on the grass.- On the grass, mm-hmm.
0:06:09 > 0:06:11The girls were standing back there...
0:06:11 > 0:06:16and then...and then we heard "pow pow".
0:06:16 > 0:06:18So, I'm just happy to be alive.
0:06:18 > 0:06:21- You know how lucky you are, right? - Yeah.
0:06:21 > 0:06:24I hope they get shot like they did us.
0:06:24 > 0:06:26I think it's fair.
0:06:26 > 0:06:30I think they should be prosecuted to the fullest effect.
0:06:30 > 0:06:31OK.
0:06:33 > 0:06:35While detectives hunt for witnesses,
0:06:35 > 0:06:39a prosecutor from the State Attorney's Office, London Kite,
0:06:39 > 0:06:40is assigned to the case.
0:06:40 > 0:06:42In order for me to feel confident,
0:06:42 > 0:06:47you need strong physical evidence and solid eyewitnesses.
0:06:47 > 0:06:53However, Eureka Gardens has had this, kind of, continuing, um...
0:06:53 > 0:06:55kind of battle with the police.
0:06:56 > 0:06:59They are a tight-knit community.
0:06:59 > 0:07:04Then, when they have problems, they shun law-enforcement,
0:07:04 > 0:07:07and then they try to take care of the problem themselves -
0:07:07 > 0:07:09that's been my experience with them.
0:07:18 > 0:07:23London is briefed by detectives who've returned from the scene.
0:07:24 > 0:07:27There were seven victims that were bullet to bone.
0:07:27 > 0:07:29Two of them are life-threatening.
0:07:29 > 0:07:33The female is expected to...
0:07:33 > 0:07:35probably have the plug pulled on her today, is that correct?
0:07:35 > 0:07:39Yes. Just to bring London up to speed...
0:07:39 > 0:07:41From the evidence, London, at the scene, we have...
0:07:41 > 0:07:44On the corner, shooting across the parking lot,
0:07:44 > 0:07:49we have some 50 or so rounds of three different calibres.
0:07:49 > 0:07:51Two rifles and one pistol.
0:07:51 > 0:07:52Where does the video come from?
0:07:52 > 0:07:54They're coming from inside the complex.
0:07:54 > 0:07:55They have video cameras?
0:07:55 > 0:07:58Security cameras inside the complex.
0:08:01 > 0:08:03You have the building across the street.
0:08:03 > 0:08:06They come from this direction on foot, post up right here,
0:08:06 > 0:08:09and shoot, just like that. So, what, 40 yards?
0:08:11 > 0:08:12They go down that sidewalk,
0:08:12 > 0:08:14and, by the time they turned around and came back,
0:08:14 > 0:08:15it's between three and five seconds.
0:08:15 > 0:08:19So, it's not like they stopped to see what their best angle was,
0:08:19 > 0:08:21took a position of fire... No.
0:08:21 > 0:08:24They walked down the sidewalk, let all their rounds go
0:08:24 > 0:08:25and walked...ran right back.
0:08:27 > 0:08:32The surveillance footage not only shows the suspects -
0:08:32 > 0:08:34it also shows that there are witnesses.
0:08:34 > 0:08:36There's two eyewitnesses,
0:08:36 > 0:08:39because, when the suspects are running back, you can see...
0:08:39 > 0:08:42You can't see the person, but he's upstairs on the balcony.
0:08:42 > 0:08:44You see him flick a cigarette.
0:08:47 > 0:08:49So, we've just got to track those guys down.
0:08:58 > 0:08:59'We need witnesses.
0:08:59 > 0:09:02'Witnesses are one of the most important parts
0:09:02 > 0:09:04'of a criminal trial.'
0:09:05 > 0:09:07- So...- They're hiding on this corner.
0:09:07 > 0:09:08They're coming on this corner.
0:09:08 > 0:09:11We have a witness sitting upstairs on 68.
0:09:11 > 0:09:16'But there's a significant history of distrust between
0:09:16 > 0:09:18'the community and law-enforcement,
0:09:18 > 0:09:22'because law enforcement don't look like them.'
0:09:22 > 0:09:24DOG BARKS
0:09:31 > 0:09:35Of the 12 homicide lawyers working in the State Attorney's Office,
0:09:35 > 0:09:38London is the only African-American.
0:09:39 > 0:09:42When I was growing up, I experienced racism.
0:09:42 > 0:09:46I've been followed in stores just because I was a young black female.
0:09:47 > 0:09:51My life experiences have given me a little bit more insight
0:09:51 > 0:09:54into how that community operates.
0:09:54 > 0:09:57You know, maybe a white prosecutor doesn't understand that
0:09:57 > 0:10:00as, um, personally as I do.
0:10:11 > 0:10:14- PHONE:- The subscriber you have dialled is not in service.
0:10:14 > 0:10:17The hardest thing that we have to do is get our witnesses to show up.
0:10:19 > 0:10:23Prosecutor Alan Mizrahi's next case goes to trial in a week.
0:10:23 > 0:10:25PHONE RINGS
0:10:30 > 0:10:32(Ridiculous...)
0:10:32 > 0:10:35It's a murder that took place in a strip club.
0:10:35 > 0:10:39- PHONE:- You have reached the voicemail box of 90...
0:10:39 > 0:10:42Despite happening in front of 300 people,
0:10:42 > 0:10:46Alan is struggling to get anyone to testify in court.
0:10:46 > 0:10:48It is an old-school case.
0:10:48 > 0:10:53We are not relying upon DNA, fingerprints, surveillance videos -
0:10:53 > 0:11:00things that in the 21st century we rely upon regularly.
0:11:00 > 0:11:03In this case, we're relying upon the statements of eyewitnesses.
0:11:05 > 0:11:09The victim, 23-year-old Brandon Green,
0:11:09 > 0:11:13was celebrating a friend's birthday in a strip club called Mascara's.
0:11:15 > 0:11:20One of his group had an altercation and, in the argument that followed,
0:11:20 > 0:11:22Brandon was shot in the head.
0:11:25 > 0:11:30Brandon Green being murdered in a strip club is very unfortunate,
0:11:30 > 0:11:34because people were drinking, and because people...
0:11:34 > 0:11:37sometimes they go to those clubs in the middle of the night,
0:11:37 > 0:11:39are not friends of law enforcement,
0:11:39 > 0:11:42and they do not trust law enforcement
0:11:42 > 0:11:48as much as people that may attend church on a Sunday morning,
0:11:48 > 0:11:49and, because of that dynamic,
0:11:49 > 0:11:52it makes it even more difficult to make sure that these people will
0:11:52 > 0:11:55come to court, will testify and will be truthful.
0:12:01 > 0:12:03Alan is meeting Brandon Green's parents
0:12:03 > 0:12:05to prepare them for the trial.
0:12:06 > 0:12:10In virtually every case that I've had where I sit down
0:12:10 > 0:12:15as a white prosecutor and I sit across from a black family,
0:12:15 > 0:12:17I would say, at the initial meetings,
0:12:17 > 0:12:20there is always a level of guardedness.
0:12:20 > 0:12:22There is an apprehension
0:12:22 > 0:12:25that the system is going to work for that victim.
0:12:27 > 0:12:28In terms of murder cases,
0:12:28 > 0:12:31it's not terrible. It's not terrible, OK?
0:12:31 > 0:12:34I'm not going in, "Oh, my God, I've got no chance."
0:12:34 > 0:12:37But we have no physical... We have no gun, no DNA...
0:12:39 > 0:12:41So, it's probably a little below average
0:12:41 > 0:12:44and that's just where the shooting took place.
0:12:44 > 0:12:46I don't lose murder cases, but I have.
0:12:46 > 0:12:49I mean, so, like... It happens.
0:12:49 > 0:12:52And, if it happens, he was put on trial for the murder,
0:12:52 > 0:12:56which is a lot more than a lot of victims' families ever get.
0:12:56 > 0:12:59Because a lot of victims' families, um, they never know
0:12:59 > 0:13:00who killed their loved one.
0:13:00 > 0:13:03So, in this case, we've charged him and we'll put him through trial,
0:13:03 > 0:13:06and we have to have some level of comfort knowing that
0:13:06 > 0:13:10justice will be served just by putting him through the trial,
0:13:10 > 0:13:12and that it was public...
0:13:12 > 0:13:13I hear you.
0:13:15 > 0:13:18'This is something that these parents have waited for
0:13:18 > 0:13:22'since they got that horrendous call on September 8th, 2013,
0:13:22 > 0:13:25'and found out their boy was dead,'
0:13:25 > 0:13:28and this is the culmination of
0:13:28 > 0:13:31society's judgment on what happened to their son.
0:13:35 > 0:13:38You know, victims, I think they struggle with the process
0:13:38 > 0:13:39cos they're so powerless.
0:13:39 > 0:13:41They have no control over the jury,
0:13:41 > 0:13:44they have no control over the evidence and they've lost their son.
0:13:48 > 0:13:50When I lay down and I close my eyes
0:13:50 > 0:13:53and I try to picture Brandon lying there,
0:13:53 > 0:13:56shaking and fighting for his life,
0:13:56 > 0:13:58it's just...
0:13:58 > 0:14:01It's just so unreal... I just...
0:14:01 > 0:14:04I just can't believe it. I just can't believe it.
0:14:07 > 0:14:09HARRIET SNIFFLES
0:14:09 > 0:14:11And, you know, after he got shot,
0:14:11 > 0:14:14and everybody was running out of the club...
0:14:18 > 0:14:22..I asked his friend, I say, "Were anybody stepping on my baby?"
0:14:22 > 0:14:25"Were anybody stepping on him?"
0:14:25 > 0:14:27SHE SNIFFLES
0:14:27 > 0:14:31And I always want to ask details
0:14:31 > 0:14:35about what he was doing, about...
0:14:35 > 0:14:37"Were his eyes closed or were he talking
0:14:37 > 0:14:40"or were he begging for his life?"
0:14:40 > 0:14:42But I never got the courage to ask him that,
0:14:42 > 0:14:45and I don't think he will share that with me.
0:14:46 > 0:14:49And I don't think he'll share it with me.
0:14:55 > 0:14:56Brandon got a little girl.
0:14:56 > 0:14:59She wasn't even one year old when he died,
0:14:59 > 0:15:02so, you know, he ever had the opportunity to show what kind of
0:15:02 > 0:15:04father he could have been.
0:15:05 > 0:15:07You know, I mean, he loved his kid, man.
0:15:07 > 0:15:09He loved his children, man.
0:15:09 > 0:15:12Yeah, I know he would've been a good father.
0:15:12 > 0:15:16The struggle to find witnesses means Brandon's family has been forced to
0:15:16 > 0:15:20wait nearly three years for the case to come to trial.
0:15:23 > 0:15:24So, we knew from day one.
0:15:24 > 0:15:26You know, they know from day one who had killed him,
0:15:26 > 0:15:30but they took six months to bring him to justice.
0:15:30 > 0:15:32You know what I mean? To get a warrant to arrest the guy.
0:15:32 > 0:15:34So, when they got him, you know,
0:15:34 > 0:15:37we've been going through this over two and a half years now.
0:15:37 > 0:15:40It's so much time-consuming, and, you know,
0:15:40 > 0:15:43and, for the family of the victim,
0:15:43 > 0:15:48you have to relive this every time you go to court.
0:15:48 > 0:15:49You know what I mean?
0:15:49 > 0:15:53You've got to look at this guy, knowing this guy killed your son.
0:15:53 > 0:15:55That there is the hardest part for me.
0:16:06 > 0:16:10The man accused of Brandon's murder has been in jail since his arrest
0:16:10 > 0:16:12two and a half years ago.
0:16:14 > 0:16:18His name is Lenard Anderson.
0:16:18 > 0:16:21I think about the victim's family from time to time,
0:16:21 > 0:16:23and I sympathise what they're going through,
0:16:23 > 0:16:26and I understand that, you know, that they're seeking justice,
0:16:26 > 0:16:30but I also know that they have the wrong guy.
0:16:30 > 0:16:32I did not commit this crime.
0:16:32 > 0:16:34I did not commit any wrongly activity.
0:16:37 > 0:16:41I feel that justice is not blind here
0:16:41 > 0:16:44for the simple fact of the colour of my skin.
0:16:46 > 0:16:51People my colour are forced into trial,
0:16:51 > 0:16:53forced to take pleas that they don't want to accept.
0:16:55 > 0:16:57Justice is the truth,
0:16:57 > 0:17:01not going after a person
0:17:01 > 0:17:05according to their characteristics or the colour of their skin.
0:17:09 > 0:17:12The State Attorney's Office, they don't uphold the law,
0:17:12 > 0:17:15they take the law into their own hands.
0:17:15 > 0:17:18They do things their way here,
0:17:18 > 0:17:22so there's no justice here, especially for people of my colour.
0:17:22 > 0:17:24No, sir, I don't believe so.
0:17:36 > 0:17:38It's been 24 hours since
0:17:38 > 0:17:41the mass shooting at Eureka Gardens.
0:17:41 > 0:17:44Two of the victims are critical in hospital.
0:17:44 > 0:17:45So, let's get right to it.
0:17:45 > 0:17:48- Travis, will you update everybody? - OK.
0:17:48 > 0:17:51There was a total of seven victims shot.
0:17:51 > 0:17:57Jessica Nelson, who was the homeowner at 105, 1214 Labelle.
0:17:57 > 0:18:00She has the most severe injuries.
0:18:00 > 0:18:02At some point yesterday, she was touch-and-go on whether or not
0:18:02 > 0:18:06she was going to survive, because of her internal injuries.
0:18:06 > 0:18:09She is going to be dialysis this morning.
0:18:10 > 0:18:14Despite surveillance footage showing there were witnesses,
0:18:14 > 0:18:15no-one has come forward.
0:18:18 > 0:18:22So detectives return to Eureka Gardens to step up the hunt.
0:18:24 > 0:18:29Some people view police officers, really, as the ultimate enemy.
0:18:29 > 0:18:32You know, this guy could've killed this person, but...
0:18:32 > 0:18:34and that person's related to you,
0:18:34 > 0:18:36but I'm not going to go to the police, even if I saw it,
0:18:36 > 0:18:37because that's worse than anything.
0:18:37 > 0:18:39That whole dynamic is really...
0:18:42 > 0:18:45I guess it's the whole "us and them", and that needs to change,
0:18:45 > 0:18:48because policemen, without co-operation in a neighbourhood,
0:18:48 > 0:18:49we're not very effective.
0:19:00 > 0:19:02Sheriff's Office!
0:19:02 > 0:19:04DOG BARKS
0:19:04 > 0:19:05Hello?
0:19:06 > 0:19:07There we go. Hey.
0:19:07 > 0:19:08Hey, Mister.
0:19:08 > 0:19:11- Step out on, sir. - There's nobody else home.
0:19:11 > 0:19:13- Give me ID, man.- I ain't got no ID.
0:19:13 > 0:19:15I hold you as a material witness on this crime,
0:19:15 > 0:19:17so don't give me no lip-service, please.
0:19:17 > 0:19:18I'm not here to play around.
0:19:18 > 0:19:20I'm here to do my job. You understand that?
0:19:20 > 0:19:22I ain't like these guys you talked to before,
0:19:22 > 0:19:24I'm one of these guys who ain't going to come here
0:19:24 > 0:19:25and understand that lip-service.
0:19:25 > 0:19:27You understand me? Do you understand me?
0:19:27 > 0:19:29Cos if you ain't got your ID, and you ain't got your ID,
0:19:29 > 0:19:32we ride downtown and I'll figure out who you are with fingerprints.
0:19:32 > 0:19:33You feel me?
0:19:33 > 0:19:36- Sir? Sir, you understand that? - You already know my name.
0:19:36 > 0:19:38I don't know you. I ain't never met you.
0:19:38 > 0:19:41- Do you know my name?- You know my name.- Do you know my name?
0:19:41 > 0:19:44Do you know my name? If you don't know my name, I don't know yours.
0:19:44 > 0:19:45I could ride you downtown.
0:19:45 > 0:19:47I've got this support that's backing me up on that.
0:19:47 > 0:19:51- You understand that?- Yes, sir. - All right, so let's keep it cool.
0:19:51 > 0:19:52Don't give me none of this.
0:19:52 > 0:19:54All right. Well, dude, keep your hands up,
0:19:54 > 0:19:56and just keep your mouth shut. Hands up, mouth shut.
0:20:00 > 0:20:03I generally think that most police officers that, you know,
0:20:03 > 0:20:06go in those neighbourhoods are trying to do the very best
0:20:06 > 0:20:08with the worst set of circumstances.
0:20:10 > 0:20:13A lot of times it's frustration, because they are going through
0:20:13 > 0:20:14this horrible incident.
0:20:14 > 0:20:17They've got somebody stabbed or they've got somebody shot,
0:20:17 > 0:20:19and they're just frustrated with the whole, like,
0:20:19 > 0:20:20process of it all.
0:20:20 > 0:20:22Look at me, cos I want to promise you something, OK?
0:20:22 > 0:20:24This isn't a threat or anything else.
0:20:24 > 0:20:27Citizens of Jacksonville, this apartment complex,
0:20:27 > 0:20:30the businessmen, the clergy, the mayor, the sheriff,
0:20:30 > 0:20:31are all tired of this violence.
0:20:31 > 0:20:34- That's why I said that... - So what I'm saying is -
0:20:34 > 0:20:37don't be a part of the problem, be a part of the solution.
0:20:41 > 0:20:45When you're dealing with the police, it's their way or no way.
0:20:47 > 0:20:51They treat us like nothing, so we've no type of respect for them.
0:20:51 > 0:20:54He's not, but be respectful, because he's earned that badge.
0:20:54 > 0:20:57They always get frustrated, but...
0:20:57 > 0:20:59there ain't nothing they can really do about it
0:20:59 > 0:21:01besides abuse their authority.
0:21:01 > 0:21:03It's worse every time they come.
0:21:03 > 0:21:06When they don't get what they want, it's worse.
0:21:06 > 0:21:08It's really worse.
0:21:08 > 0:21:11All right. You see some bad things, you call the police.
0:21:11 > 0:21:12You got me? All right.
0:21:12 > 0:21:17No witnesses are found and detectives are running out of leads.
0:21:20 > 0:21:2322-year-old Vernell Bing has died after being shot by police
0:21:23 > 0:21:25in Springfield.
0:21:25 > 0:21:28It started with a pursuit, yet ended with a crash and gunfire.
0:21:28 > 0:21:32A shooting puts the Sheriff's Office in Jacksonville
0:21:32 > 0:21:34at the centre of a new storm.
0:21:34 > 0:21:37Check out this video from our scene last night. Take a look.
0:21:37 > 0:21:39Now, JSO says the man was still in the car
0:21:39 > 0:21:43ignoring the officer's commands, then got out of the car
0:21:43 > 0:21:46and was trying to get away when the officer shot him in the back.
0:21:49 > 0:21:5322-year-old Vernell Bing was shot dead after crashing his car
0:21:53 > 0:21:56into police following a pursuit.
0:21:58 > 0:22:00The car he was driving had been involved
0:22:00 > 0:22:02in a shooting the previous month.
0:22:05 > 0:22:07APPLAUSE
0:22:07 > 0:22:10OK, people will tell us folks it's all right, but it's not all right.
0:22:10 > 0:22:14No, it's not all right for young, unarmed black men to be shot down.
0:22:17 > 0:22:21Not by one another, and certainly not by JSO.
0:22:24 > 0:22:25No, it's not all right!
0:22:29 > 0:22:31The sad commentary is this -
0:22:31 > 0:22:35nobody knew what this young man was when he was shot.
0:22:38 > 0:22:40But we did know that he was a black man.
0:22:40 > 0:22:41Yeah!
0:22:41 > 0:22:43APPLAUSE
0:22:47 > 0:22:49WOMAN CRYING
0:22:56 > 0:22:58SHE WAILS AND SCREAMS
0:23:03 > 0:23:05I'm just sick of it. I'm sick of it.
0:23:05 > 0:23:06I'm just sick of it.
0:23:06 > 0:23:08I'm tired.
0:23:08 > 0:23:12I'm sick and tired of coming to black funerals in this city,
0:23:12 > 0:23:15and our young black men being killed,
0:23:15 > 0:23:17and I'm sick of the police brutality.
0:23:17 > 0:23:19I'm sick of it, and we demand justice.
0:23:19 > 0:23:20I'm tired of it.
0:23:20 > 0:23:22The police haven't even been charged,
0:23:22 > 0:23:24haven't been investigated,
0:23:24 > 0:23:27had nothing been done, and this boy is dead.
0:23:27 > 0:23:29This is another black young man dead.
0:23:29 > 0:23:31No accountability.
0:23:32 > 0:23:34There's no respect for black life in this city.
0:23:37 > 0:23:40An investigation into Bing's death is launched
0:23:40 > 0:23:42by Jacksonville Sheriff's Office.
0:23:46 > 0:23:48An investigation of any type of shooting,
0:23:48 > 0:23:50whether it's by a citizen or a law enforcement officer,
0:23:50 > 0:23:55is a long and detailed investigation, and I won't see
0:23:55 > 0:23:57the results until everything is in,
0:23:57 > 0:24:00as to whether it was justifiable use of deadly force.
0:24:03 > 0:24:04The question that has to be asked is,
0:24:04 > 0:24:08are we working to hold our officers accountable for their actions?
0:24:08 > 0:24:10And the answer to that is yes.
0:24:10 > 0:24:13But will I violate the law in an effort to rush to judgment?
0:24:13 > 0:24:15I can't and I won't.
0:24:15 > 0:24:18Our community deserves the truth and nothing but the truth.
0:24:20 > 0:24:23I know that trust begins with having a law enforcement agency
0:24:23 > 0:24:25we can all have faith in and be proud of.
0:24:25 > 0:24:29That's how trust is built and that's how transparency is fostered.
0:24:29 > 0:24:34He said, "Our community deserves the truth and nothing but the truth."
0:24:34 > 0:24:36- What truth is he talking?- Exactly.
0:24:36 > 0:24:41The truth is, you shot down and killed an unarmed black man.
0:24:41 > 0:24:44This is not the first time - that's the truth.
0:24:44 > 0:24:46Why didn't you say that?
0:24:47 > 0:24:49In the last ten years,
0:24:49 > 0:24:5345 black men have been shot dead by police in Jacksonville.
0:24:56 > 0:24:59Each incident has been investigated.
0:24:59 > 0:25:01No officer has ever been prosecuted.
0:25:02 > 0:25:05Sometimes, the officers are justified.
0:25:05 > 0:25:09If he was not complying, you don't have to sit there and wait to die.
0:25:09 > 0:25:13If a person is coming at you, with their hands hidden,
0:25:13 > 0:25:16you don't have to wait until they pull the gun and pull the trigger
0:25:16 > 0:25:18for you to do something about it.
0:25:18 > 0:25:23You know, people are stirring up raw emotions sometimes, um,
0:25:23 > 0:25:29that have a real, long-lasting, detrimental effect on
0:25:29 > 0:25:33how law enforcement and the community deals with each other.
0:25:37 > 0:25:40I'm planning on calling you and Gerald.
0:25:40 > 0:25:42- 'OK.'- OK, so I'll need... We're going to meet...
0:25:42 > 0:25:46I'm going to need to meet with Twan, Devondro, Gerald...
0:25:46 > 0:25:49It's two days until the trial of Lenard Anderson,
0:25:49 > 0:25:52accused of murdering Brandon Green in a strip club.
0:25:52 > 0:25:54- 'Yes, sir.' - All right, so just stay in touch,
0:25:54 > 0:25:56I'll look forward to hearing from you tomorrow, OK?
0:25:56 > 0:26:00Prosecutor Alan Mizrahi is now threatening to use court orders
0:26:00 > 0:26:03to force witnesses to testify.
0:26:03 > 0:26:05That was Cornelius Toliver -
0:26:05 > 0:26:08he's one of the witnesses in the case.
0:26:08 > 0:26:09He, er...
0:26:09 > 0:26:12He was part of the victim's group that was at the club.
0:26:12 > 0:26:13He did not see the shooting,
0:26:13 > 0:26:16but is friends with all of the people that were there.
0:26:18 > 0:26:22Cornelius Toliver is one of the few who's volunteered to testify
0:26:22 > 0:26:27and is helping Alan by trying to persuade others to come forward.
0:26:27 > 0:26:29In order to get a conviction in the case,
0:26:29 > 0:26:32these people have to come to court
0:26:32 > 0:26:35and give their testimony in front of a defendant,
0:26:35 > 0:26:37but it's incredibly difficult.
0:26:40 > 0:26:43There's a saying that "snitches get stitches",
0:26:43 > 0:26:46and people that are cooperating with the state of Florida
0:26:46 > 0:26:49potentially has the danger of some retaliation against them.
0:26:54 > 0:26:58Cornelius still lives and works in the community
0:26:58 > 0:26:59where he and Brandon grew up.
0:27:57 > 0:27:59I get butterflies in my stomach sometimes...
0:28:02 > 0:28:05..because I think, "Oh, my God,
0:28:05 > 0:28:06"will he be found not guilty?"
0:28:10 > 0:28:12I just don't want them to find him not guilty,
0:28:12 > 0:28:15and then he'll get off and go and kill again.
0:28:19 > 0:28:22Lenard Anderson very well could walk away a free man, absolutely.
0:28:24 > 0:28:27The percentages tell us that. We sometimes lose cases,
0:28:27 > 0:28:31and we sometimes lose cases that are a lot better than this case.
0:28:31 > 0:28:34It's certainly something that I'm aware of
0:28:34 > 0:28:36and certainly the family will be aware of.
0:28:52 > 0:28:55The trial starts with the prosecution.
0:28:55 > 0:28:59Alan Mizrahi and his co-counsel begin their case by calling
0:28:59 > 0:29:03Cornelius Toliver, and the rest of Brandon's friends,
0:29:03 > 0:29:05to describe what they saw the night he died.
0:29:07 > 0:29:09With no physical evidence,
0:29:09 > 0:29:12the whole of Alan's case rests on their testimony.
0:29:15 > 0:29:17Can you tell the jury why you're here?
0:29:17 > 0:29:22Because a very close friend of mine was murdered in a nightclub.
0:29:22 > 0:29:25Were you an eyewitness to that?
0:29:25 > 0:29:26Yes, sir.
0:29:26 > 0:29:28And who is that close friend of yours?
0:29:28 > 0:29:30His name was Brandon Green.
0:29:30 > 0:29:34I want to take you to the night of September 7th, 2013.
0:29:34 > 0:29:36Can you tell the jury what you were doing?
0:29:36 > 0:29:39Uh, in Mascara's, celebrating my cousin's birthday.
0:29:40 > 0:29:43I walked to the bar, um,
0:29:43 > 0:29:45I slipped past the dude and got behind him,
0:29:45 > 0:29:48and ordered my bottle of water,
0:29:48 > 0:29:51and, as I'm walking off, I accidentally bump him.
0:29:51 > 0:29:53I'm thinking, "No problems."
0:29:53 > 0:29:56I turn to him and I say, "My bad," you know,
0:29:56 > 0:29:59"I'm sorry," and walk off and think nothing of it.
0:30:00 > 0:30:03Devondro came back, and he was chill for a second,
0:30:03 > 0:30:06but then, like, a couple of minutes after that,
0:30:06 > 0:30:10I seen a guy come follow him over there.
0:30:11 > 0:30:14He has on a red Kangol hat.
0:30:14 > 0:30:17It looked like a fisherman Kangol hat.
0:30:17 > 0:30:19I called it, like, an LL Cool J hat, like,
0:30:19 > 0:30:22cos, like, that's what he used to wear back in the day.
0:30:24 > 0:30:28I asked him, "Hey, what's going on, man? Everything is OK?
0:30:28 > 0:30:30"Everything good?"
0:30:30 > 0:30:33He's like, "Yeah, everything's good. Who you with?"
0:30:33 > 0:30:36And he had his hand down by his belt, and he was holding
0:30:36 > 0:30:38his gun outside his belt.
0:30:39 > 0:30:43And then, I looked back, he'd upped the gun.
0:30:43 > 0:30:46What did you think was going to happen?
0:30:46 > 0:30:47He was going to shoot all of us.
0:30:48 > 0:30:52At that point, I froze up. I couldn't move.
0:30:52 > 0:30:54He shot it one time, boom,
0:30:54 > 0:30:58and then everything scattered, everything went mayhem...
0:30:58 > 0:31:02Everybody's scrambling and running, trying to...trying to get out,
0:31:02 > 0:31:07and I see someone laying on the floor in the section that we had,
0:31:07 > 0:31:09and I go over there...
0:31:09 > 0:31:11HE CLEARS HIS THROAT
0:31:13 > 0:31:15I go over there and I...
0:31:15 > 0:31:17and I see it's Brandon Green.
0:31:19 > 0:31:22I mean...
0:31:22 > 0:31:27he got hit right in the face, so it was like the head was, like,
0:31:27 > 0:31:30open, and there was blood everywhere.
0:31:32 > 0:31:36At that, I get up off the ground
0:31:36 > 0:31:38and jump up.
0:31:38 > 0:31:42My cousin Cornelius, he comes running back to us, like,
0:31:42 > 0:31:44"What's going on? What's going on? What's up?"
0:31:44 > 0:31:48Did Brandon Rivers say anything to you?
0:31:48 > 0:31:49Oh, he was pointing at the guy there.
0:31:49 > 0:31:52He told me, he said, "That guy right there just shot BG."
0:31:52 > 0:31:53I'm like, "Bro, Cuz, that's him right there.
0:31:53 > 0:31:55"That's him right there, in the red Kangol hat,
0:31:55 > 0:31:57"moving through the crowd. That's him."
0:31:57 > 0:31:59And what did that person look like, that you saw?
0:31:59 > 0:32:01I'd say a little bigger than me, probably a little lighter.
0:32:01 > 0:32:03He was wearing a red hat.
0:32:03 > 0:32:09Are you able to identify the person that you saw murder your friend?
0:32:09 > 0:32:13Yes, sir, he's sitting over there.
0:32:13 > 0:32:15He's sitting over there.
0:32:15 > 0:32:18Thank you. That's all the questions I have, Your Honour.
0:32:18 > 0:32:20Thank you. Cross-examination.
0:32:20 > 0:32:24Lenard Anderson's defence is that the state's witnesses
0:32:24 > 0:32:29are unreliable, and he is the victim of mistaken identity.
0:32:29 > 0:32:32People always talk about defence attorneys punching...trying to punch
0:32:32 > 0:32:34holes into the state's case,
0:32:34 > 0:32:36'and that's true - that's what we do.'
0:32:36 > 0:32:40Mr Toliver, have you been previously convicted of a felony?
0:32:40 > 0:32:42- Yes, I have.- How many times?
0:32:42 > 0:32:44HE CLEARS HIS THROAT
0:32:45 > 0:32:47Numerous times.
0:32:47 > 0:32:50At least seven felony convictions, would you agree, sir?
0:32:52 > 0:32:53I would agree.
0:32:55 > 0:32:59'Defence attorneys will push every advantage they can.
0:33:00 > 0:33:03'Their goal is to undermine the credibility of every witness that'
0:33:03 > 0:33:07provides information that implicates their client.
0:33:07 > 0:33:09Did you have a cellphone on you?
0:33:09 > 0:33:11- Did I have a cellphone?- Yeah. - Yeah, I had a cellphone.
0:33:11 > 0:33:14Did you call 911?
0:33:14 > 0:33:16Um, no.
0:33:16 > 0:33:17Did you call the police?
0:33:18 > 0:33:21I was just trying to get home.
0:33:21 > 0:33:23You said you did not call the police when you got outside?
0:33:23 > 0:33:25MANS COUGHS
0:33:25 > 0:33:26No.
0:33:26 > 0:33:29You didn't call them when you got home?
0:33:29 > 0:33:30No.
0:33:31 > 0:33:34'I don't think the jury's really going to like
0:33:34 > 0:33:36'who the victim was hanging with,'
0:33:36 > 0:33:39and I think that the jury's going to think
0:33:39 > 0:33:42that they are bad people.
0:33:44 > 0:33:49If you put a nun next to a prisoner wearing a green jumpsuit,
0:33:49 > 0:33:52and they told you the same story, you're going to believe the nun,
0:33:52 > 0:33:55and that's just the normal biases of jurors,
0:33:55 > 0:33:58and, obviously, those biases are based somewhat in reality.
0:34:02 > 0:34:04'I was angry at a lot of his buddies that he went to
0:34:04 > 0:34:06'the club with that night,
0:34:06 > 0:34:09'because, after Brandon's murder,'
0:34:09 > 0:34:12they was hiding a lot of details, you know?
0:34:12 > 0:34:16They knew exactly what happened and nobody was telling nothing.
0:34:17 > 0:34:21You know, a lot of them had warrants on them, but my son is dead,
0:34:21 > 0:34:24and y'all are worried about going to jail for a week
0:34:24 > 0:34:26instead of helping me catch his killer.
0:34:30 > 0:34:32The defence has one more piece of evidence
0:34:32 > 0:34:35to use against witness Cornelius Toliver.
0:34:35 > 0:34:37So, you had a weapon with you inside Mascara's?
0:34:37 > 0:34:38Yes, ma'am.
0:34:38 > 0:34:40Where did you put it on your person?
0:34:40 > 0:34:43I ran out of the club with it in my hand.
0:34:43 > 0:34:44Why didn't you go to your car,
0:34:44 > 0:34:47which is the one that you said you drove down with?
0:34:47 > 0:34:49Because nine times out of ten, I know my wife,
0:34:49 > 0:34:51she were out with her gun.
0:34:51 > 0:34:54- But you already had a gun on you, correct?- It wasn't big enough.
0:34:56 > 0:34:59I was going to chase the guy my cuz had pointed at.
0:34:59 > 0:35:01And what were you going to do?
0:35:01 > 0:35:03An eye for an eye.
0:35:03 > 0:35:05- I'm sorry?- An eye for an eye.
0:35:07 > 0:35:10No further questions at this time, Your Honour.
0:35:10 > 0:35:11Ladies and gentlemen of the jury,
0:35:11 > 0:35:13I'm going to excuse you for the evening.
0:35:13 > 0:35:15This will be your evening recess.
0:35:15 > 0:35:17I hope you have a peaceful and restful evening,
0:35:17 > 0:35:19and we'll see you tomorrow morning at 9am. Thank you.
0:35:24 > 0:35:26People know what he did, you know what I mean?
0:35:26 > 0:35:27But it's just like...
0:35:27 > 0:35:30It's not what you know, it's what you can prove, you know what I mean?
0:35:30 > 0:35:34You know, Alan's trying to do his best, but, you know,
0:35:34 > 0:35:38I see what the defence are trying to do is put in reasonable doubt.
0:35:38 > 0:35:43And she...and the defence attorney's doing a good job doing it.
0:35:43 > 0:35:46You know, but whether the, you know, people believe in them or not,
0:35:46 > 0:35:47yeah, that's another thing.
0:35:58 > 0:36:01It's been a week since the mass shooting in Eureka Gardens
0:36:01 > 0:36:03and detectives are still struggling.
0:36:03 > 0:36:07The local community is afraid of retribution,
0:36:07 > 0:36:10so they're calling people directly, to persuade them to speak.
0:36:10 > 0:36:12I totally understand that,
0:36:12 > 0:36:15and that is the reason why, if you get in your car
0:36:15 > 0:36:18and come to the police station, nobody in that apartment complex
0:36:18 > 0:36:20knows where you are or where you're going.
0:36:20 > 0:36:22They've failed to finds the witnesses
0:36:22 > 0:36:26in the surveillance footage, but now think a resident has information
0:36:26 > 0:36:28about the motive for the attack.
0:36:28 > 0:36:30There's no way around it.
0:36:30 > 0:36:32Nobody wants to be in the predicament they're in.
0:36:32 > 0:36:33We have seven people that were shot.
0:36:33 > 0:36:35I bet you can't talk to one of them that says,
0:36:35 > 0:36:37"Hey, I wanted to be shot."
0:36:39 > 0:36:40So, how do you want to do it?
0:36:40 > 0:36:43Do you want me to send some cars to your house? Do you want to get
0:36:43 > 0:36:45in your car and come down here? How do you want to do it?
0:36:45 > 0:36:47VOICE ON THE LINE
0:36:47 > 0:36:48All right, drive safe.
0:36:53 > 0:36:55HE EXHALES
0:37:05 > 0:37:07Defying expectations,
0:37:07 > 0:37:11the most seriously injured victim of the attack, Jessica Nelson,
0:37:11 > 0:37:14has pulled through.
0:37:14 > 0:37:18She was shot four times, and has lost a kidney and half her pancreas.
0:37:20 > 0:37:23One bullet is still lodged in her chest.
0:37:24 > 0:37:28Her husband John was the person who rang 911.
0:37:28 > 0:37:32- 'Sir, who got shot? - Come on! My wife, my baby!
0:37:32 > 0:37:36'Get here! Get here, now!
0:37:36 > 0:37:39We have help on the way to you. Who shot them?
0:37:39 > 0:37:42- 'Get here now! Get here now!' - HE SCREAMS AND CRIES
0:37:44 > 0:37:47They're making an appeal for witnesses to come forward.
0:37:47 > 0:37:50What was the worst thing for you, in that moment?
0:37:52 > 0:37:57I really didn't think that I would ever see my family again.
0:38:03 > 0:38:05I know JSO hasn't caught these guys.
0:38:05 > 0:38:08They said they had surveillance video.
0:38:08 > 0:38:12Are you angry that this hasn't been resolved yet?
0:38:13 > 0:38:17I'm really disappointed that it hasn't.
0:38:17 > 0:38:20I can't be angry, but I am disappointed.
0:38:22 > 0:38:25People like that shouldn't be around,
0:38:25 > 0:38:30so it's very important to me that they get found.
0:38:39 > 0:38:41Detectives may have a breakthrough -
0:38:41 > 0:38:44a possible name for the intended target of the shooting.
0:38:44 > 0:38:48We've had someone tell us that one of our potential witnesses
0:38:48 > 0:38:52is out there at 173 Eureka Garden Apartments,
0:38:52 > 0:38:54a male known to us as Chico.
0:38:54 > 0:38:58We are very certain that it's him that was getting fired on,
0:38:58 > 0:39:00and we're going to try to get Chico to come downtown
0:39:00 > 0:39:03and talk to us about what's going on.
0:39:03 > 0:39:08Hey, we are in the front of the apartment complex,
0:39:08 > 0:39:11and so we're all set, and nobody's going to lay hands on us.
0:39:11 > 0:39:13No, all right.
0:39:13 > 0:39:16OK, all right. OK.
0:39:16 > 0:39:17He's walking out to us.
0:39:21 > 0:39:23- Oliver?- Yeah, I'm Oliver.- I'm...
0:39:23 > 0:39:26- Hey, do me a favour.- Yeah? - That brown car, where is it?
0:39:26 > 0:39:27It's right there, right there.
0:39:27 > 0:39:29Cool, go hop in that car there, we'll go downtown.
0:39:29 > 0:39:31- Downtown? - BOTH: We'll bring you back.
0:39:31 > 0:39:33- Not...- Nobody'll mess with you. - We only want to talk.
0:39:33 > 0:39:35How long will y'all have me down there?
0:39:35 > 0:39:37We'll get you in and out as soon as we can, OK?
0:39:37 > 0:39:40- Thank you.- Thanks, man. Get in that car right there.
0:39:45 > 0:39:48Detectives believe the attack may have been retaliation
0:39:48 > 0:39:51for an earlier shooting Chico is suspected to have carried out.
0:39:55 > 0:39:56If that is the case,
0:39:56 > 0:40:00Chico will be able to name the suspects detectives are after.
0:40:04 > 0:40:07'Most of the neighbourhoods do, especially Eureka Gardens...'
0:40:07 > 0:40:12We've had... We've had actual cases, like murder cases, where, um...
0:40:12 > 0:40:14members of that community or neighbourhood have
0:40:14 > 0:40:17taken matters into their own hands.
0:40:18 > 0:40:23It's a very thin line between being a victim or a defendant.
0:40:25 > 0:40:27INAUDIBLE
0:40:34 > 0:40:36Now, what's he telling you?
0:40:36 > 0:40:37He's saying he knows nothing.
0:40:39 > 0:40:42He is denying any activity or any involvement.
0:40:43 > 0:40:45But it's kind of hard to call him a liar
0:40:45 > 0:40:47when you don't have anything to confront him with.
0:40:49 > 0:40:52Well, I don't think you have any reason to
0:40:52 > 0:40:55keep him or continue to badger him, or...
0:40:55 > 0:40:59- Yeah, I think we need to leave it like that.- Mm-hm.- Yeah.
0:40:59 > 0:41:00Same place we were on day one.
0:41:14 > 0:41:18The shooting of Vernell Bing by police ten days ago
0:41:18 > 0:41:20continues to cause controversy.
0:41:20 > 0:41:23Jacksonville Sheriff's Office must be held accountable
0:41:23 > 0:41:24for their actions.
0:41:24 > 0:41:26You have a community that's grieving, outcrying...
0:41:26 > 0:41:29You have entire families that's in pain.
0:41:29 > 0:41:30We're drawing a line. We're tired of it.
0:41:30 > 0:41:32- We won't go unheard. - DOG BARKS
0:41:32 > 0:41:35The legal system of Jacksonville has failed the black community.
0:41:35 > 0:41:37We're making it clear we want an indictment,
0:41:37 > 0:41:40we want an arrest, and we want to make sure it's taken to
0:41:40 > 0:41:41the full extent of the law.
0:41:44 > 0:41:47Protests are planned across Jacksonville.
0:41:48 > 0:41:54There's several Black Lives Matter or similar type of motivated groups
0:41:54 > 0:41:57who claim they're going to show up and protest peacefully,
0:41:57 > 0:41:59but leech groups have, kind of, latched on,
0:41:59 > 0:42:01so we don't know what's going to show up.
0:42:01 > 0:42:03There are some agitators in those groups, guys.
0:42:03 > 0:42:05In the group format, they're going to try to agitate you
0:42:05 > 0:42:09and say racial stuff, anti-police stuff... They want that attention.
0:42:09 > 0:42:11All right, guys, be careful. Thank you.
0:42:11 > 0:42:14Black lives matter! Black lives matter!
0:42:14 > 0:42:16Black lives matter!
0:42:16 > 0:42:18Black lives matter! Black lives matter!
0:42:18 > 0:42:21Black lives matter!
0:42:21 > 0:42:24Black lives matter! Black lives matter!
0:42:26 > 0:42:30'There's a fundamental disconnect between law enforcement
0:42:30 > 0:42:32'and the community it is supposed to protect.'
0:42:32 > 0:42:35It's not OK to shoot our children,
0:42:35 > 0:42:37and it's not OK to shoot our men,
0:42:37 > 0:42:40and it's not OK to shoot our women.
0:42:40 > 0:42:45We want change! We want change! We want change!
0:42:45 > 0:42:47One can only achieve justice through the cooperation
0:42:47 > 0:42:51and the trust of the community we are trying to seek justice for.
0:42:51 > 0:42:54We want change! We want change! We want change!
0:42:54 > 0:42:59I believe that this disconnect is the greatest problem
0:42:59 > 0:43:01facing the American justice system right now.
0:43:07 > 0:43:12The trial of Lenard Anderson is entering its third day,
0:43:12 > 0:43:14and his defence attorney, Ann Finnell,
0:43:14 > 0:43:18is going to present an alternative theory for how Brandon Green died.
0:43:21 > 0:43:25She begins by analysing the evidence of the medical examiner.
0:43:27 > 0:43:30This impact of the bullet, with its pressure wave,
0:43:30 > 0:43:33broke the skullcap and the base of the skull -
0:43:33 > 0:43:35that's the top and the bottom of the skull -
0:43:35 > 0:43:37especially in the area of the right eye.
0:43:37 > 0:43:39And then there's haemorrhage associated with this,
0:43:39 > 0:43:42and some bruising of the brain, so he did not die immediately.
0:43:44 > 0:43:47I mean, my argument is that, when they saw him...
0:43:47 > 0:43:50I mean, they saw him fall, and they saw him on the ground,
0:43:50 > 0:43:52they see a hole in the middle of his forehead
0:43:52 > 0:43:55and they assume he was shot from the front.
0:43:55 > 0:43:59Would...the injury you observed
0:43:59 > 0:44:02be consistent with a shot coming from this direction?
0:44:02 > 0:44:06From the body alone, in this case, I can't tell you where the gun was,
0:44:06 > 0:44:08but the shot's coming from behind,
0:44:08 > 0:44:12and it's going from his right side to his front, and slightly upward.
0:44:15 > 0:44:17So the shot comes in here,
0:44:17 > 0:44:18right by the temple,
0:44:18 > 0:44:20and it comes out of the eye,
0:44:20 > 0:44:22right by the right eye.
0:44:24 > 0:44:29If you can imagine, it'd be like if it enters here,
0:44:29 > 0:44:33and comes out in the middle of the head.
0:44:33 > 0:44:37So, in order to be shot from the front, from the camera,
0:44:37 > 0:44:41the person would have to pivot their body all the way around.
0:44:43 > 0:44:45The reality could be that, you know,
0:44:45 > 0:44:48the shot came from behind him and to the right,
0:44:48 > 0:44:51which could be another member of their group,
0:44:51 > 0:44:54it could be just somebody randomly, you know, showing off a gun,
0:44:54 > 0:44:56and having the gun discharge.
0:44:56 > 0:44:57You just don't know.
0:45:00 > 0:45:03All right, sir, thank you. No further questions, Your Honour.
0:45:05 > 0:45:07The state calls Detective Bobby Bowers.
0:45:10 > 0:45:13Prosecutor Alan Mizrahi has one final witness.
0:45:16 > 0:45:19Good afternoon, Detective. Please introduce yourself to the jury.
0:45:19 > 0:45:21I'm Bobby Frank Bowers Senior.
0:45:21 > 0:45:22What do you do for a living, sir?
0:45:22 > 0:45:24I'm a detective with the Homicide Unit
0:45:24 > 0:45:27at the Jacksonville Sheriff's Office.
0:45:30 > 0:45:35Detective Bobby Bowers interviewed Lenard when he was arrested.
0:45:35 > 0:45:36We haven't heard from you.
0:45:36 > 0:45:40- Yes, sir.- We don't know what you have to say about what happened.
0:45:40 > 0:45:42- Yes, sir, I understand.- OK?
0:45:42 > 0:45:46Now, I didn't come here to question you if you did the shooting.
0:45:46 > 0:45:49What I came here to talk to you about was what happened,
0:45:49 > 0:45:52and why did it happen, and why did it get to that point?
0:45:52 > 0:45:55Sir, I have no recognition. I wasn't there. It wasn't me.
0:45:59 > 0:46:01Do you remember who the DJ was?
0:46:04 > 0:46:05No, sir, I wasn't...
0:46:05 > 0:46:08Like I say, I wasn't there, so I wouldn't know.
0:46:08 > 0:46:09You weren't there?
0:46:09 > 0:46:11I wasn't there. It wasn't me.
0:46:11 > 0:46:12OK.
0:46:17 > 0:46:21'If you in any way acted in self-defence,
0:46:21 > 0:46:23'this would be a good time to let me know,
0:46:23 > 0:46:28'because, down the road, when this case, if it goes to trial...
0:46:28 > 0:46:29'Yes, sir.'
0:46:29 > 0:46:32..and then you come forward and say,
0:46:32 > 0:46:36' "I remember what happened," it's not going to hold much ground,
0:46:36 > 0:46:41'when we first met and you had no recollection of the whole incident.
0:46:41 > 0:46:42'I understand, sir.'
0:46:49 > 0:46:51- May it please the court? - JUDGE:- Proceed.
0:46:51 > 0:46:55Mr Anderson, you know that you were in the club that night, right?
0:46:55 > 0:46:59- Yes, sir.- You know you were present when shots rang out?- Yes, sir.
0:46:59 > 0:47:03- And you know you've been arrested for that case?- Yes, sir.- OK.
0:47:03 > 0:47:06So, here's the thing, Mr Anderson.
0:47:06 > 0:47:09- Yes, sir.- You said...
0:47:09 > 0:47:11"I wasn't there."
0:47:11 > 0:47:13"I wasn't there, I didn't do it, you have the wrong person."
0:47:13 > 0:47:15But that was a lie, right?
0:47:15 > 0:47:17Well, I said, "I wasn't there, I didn't do it,
0:47:17 > 0:47:19"you have the wrong person," which it doesn't...
0:47:19 > 0:47:21Why don't you just answer my questions, OK?
0:47:21 > 0:47:25I said, "I wasn't there, you have the wrong guy, I didn't do this."
0:47:25 > 0:47:27"I wasn't there"...
0:47:27 > 0:47:30- Yes, I said that.- ..was a lie.
0:47:30 > 0:47:31Yes or no?
0:47:31 > 0:47:32Yes, it was.
0:47:35 > 0:47:38Isn't it true, Mr Anderson, that you lied to those detectives
0:47:38 > 0:47:41because it was in your interest to lie to them, correct?

0:48:03 > 0:48:07When you're picked up by detectives, you're either being arrested
0:48:07 > 0:48:09or you have a BOLO out for a warrant for questioning,

0:48:13 > 0:48:15- for this charge.- OK.

0:48:33 > 0:48:35'you don't want to be involved,
0:48:35 > 0:48:39'or you may be faced with those same people that committed those crimes.

0:50:03 > 0:50:06but at this point, you know, getting to the point
0:50:06 > 0:50:09where we can make any kind of arrest is... It's far off,
0:50:09 > 0:50:14because of the level of cooperation that everyone's not giving us.
0:50:18 > 0:50:20'The residents that live there,
0:50:20 > 0:50:23'they know the individuals perpetrated the crime.

0:50:34 > 0:50:36'if they do speak up and speak out.'
0:50:38 > 0:50:40The people are scared. They're scared to talk

0:50:49 > 0:50:52' "Oh, I'd do the right thing and I'd talk."
0:50:52 > 0:50:56'But part of me, you know, the part of me that would think rationally'

0:52:17 > 0:52:18Huh!

0:52:24 > 0:52:27is to get out of trouble.
0:52:27 > 0:52:31You know what? That's not the biggest problem in the case.
0:52:31 > 0:52:35The biggest problem in this case,
0:52:35 > 0:52:38it's when Cornelius Toliver
0:52:38 > 0:52:40went to Brandon Green.
0:52:40 > 0:52:43The only thing he saw was a hole
0:52:43 > 0:52:48right in the middle of Brandon Green's face.

0:53:23 > 0:53:25You know why? Because that's not what happened.
0:53:25 > 0:53:28It didn't come from the front.
0:53:28 > 0:53:32It didn't come from some red Kangol-hatted man.
0:53:32 > 0:53:37It came from behind and to the right.
0:53:37 > 0:53:39The shot didn't come from behind.
0:53:39 > 0:53:42There's no grassy knoll in Mascara's.
