0:00:24 > 0:00:26Did you think you were going to die?
0:00:26 > 0:00:29I thought my life was in danger, yeah.
0:00:29 > 0:00:31She's broken a code that goes back hundreds of years,
0:00:31 > 0:00:36built around what's seen as a sacred trust - the family honour.
0:00:39 > 0:00:43Honour, or izzat, is respect, status.
0:00:43 > 0:00:48The reality is power and control.
0:00:48 > 0:00:51Women's behaviour has to fit in with whatever men have to say.
0:00:52 > 0:00:56There are thousands of other young people like her in Britain today,
0:00:56 > 0:00:58who live in fear of their own families.
0:01:00 > 0:01:03But very few are prepared to talk about it.
0:01:06 > 0:01:10This film, two years in the making, tells one shocking story.
0:01:10 > 0:01:13Do you understand that you are under arrest?

0:01:16 > 0:01:21Family honour - that's the main thing that keeps coming up

0:01:56 > 0:02:00including forced marriages, false imprisonment and assault.
0:02:00 > 0:02:02If we do bring charges, we'll bring the family back in early...
0:02:02 > 0:02:06This programme tells the inside story of the investigation
0:02:06 > 0:02:10of a crime that split a family apart.
0:02:10 > 0:02:12It's now just going through what we need for CPS.
0:02:13 > 0:02:17This team, based in Blackburn, have dealt with more than 60 cases
0:02:17 > 0:02:19in the last 12 months.
0:02:19 > 0:02:24Almost all of them have involved girls under 21 being forced into marriages
0:02:24 > 0:02:30they don't want - otherwise face emotional blackmail or much worse.
0:02:32 > 0:02:35Parents are prepared to harm their own children
0:02:35 > 0:02:42in order to protect this, um, this THING that they call honour.
0:02:44 > 0:02:48Shabana is 23 and a victim of that code of honour.
0:02:48 > 0:02:52She's one of the latest cases for the Blackburn team.
0:02:52 > 0:02:54Shabana isn't her real name, and we've blurred her face
0:02:54 > 0:02:57and altered her voice at her request.
0:02:57 > 0:03:02It took me a lot of courage to run away from my family.
0:03:02 > 0:03:04So many times I decided to go and then I was like,
0:03:04 > 0:03:06"No, I love my family.
0:03:06 > 0:03:09"My family's here." You just...
0:03:09 > 0:03:13There's always that family barrier thing stopping you from going away.
0:03:14 > 0:03:19And then, I don't know, I just came to a point where I thought,
0:03:19 > 0:03:22"I've got no more choices or options," and I just had to do it.
0:03:22 > 0:03:26I just had to make the decision for myself. So I just went.
0:03:27 > 0:03:31Shabana ran away from her mother's home where she lived,
0:03:31 > 0:03:35rather than going through with a forced marriage to a cousin.
0:03:35 > 0:03:36She went to another city
0:03:36 > 0:03:40and met and fell in love with a young Muslim man there.
0:03:40 > 0:03:42I didn't want my life to end up in a question mark
0:03:42 > 0:03:44so I thought, "Yeah, let's get married.
0:03:44 > 0:03:48"What can be more beautiful than that - to have a marriage?"
0:03:48 > 0:03:51It's the Islamic way as well and it's legal.
0:03:51 > 0:03:56So we got married and I was so happy.
0:03:56 > 0:03:59That was the happiest day of my life. Seriously.
0:03:59 > 0:04:02And like, I don't know, it was just 24/7 him, him, him, him.
0:04:02 > 0:04:05Same for him - he treats me like a princess.
0:04:08 > 0:04:11But her happiness was to be short-lived.
0:04:11 > 0:04:14When Shabana's family found out about her secret marriage,
0:04:14 > 0:04:17some of them were very unhappy.
0:04:17 > 0:04:20They never liked him, that's the thing. They'd fake it on the face.
0:04:20 > 0:04:22They've never ever liked him.
0:04:24 > 0:04:26Shabana tried to reconcile matters with them
0:04:26 > 0:04:29but while she was staying without her husband
0:04:29 > 0:04:34at her sister's house in January 2010, matters came to a head.
0:04:36 > 0:04:38It didn't feel right. I said, "No, I want to go.
0:04:38 > 0:04:41"I just have to go." But they wouldn't let me.
0:04:43 > 0:04:46While Shabana was at her sister's, her mother,
0:04:46 > 0:04:50brother and brother-in-law went to her new home.
0:04:50 > 0:04:53Her brother climbed through the kitchen window of the house,
0:04:53 > 0:04:56and Shabana's husband says he was threatened,
0:04:56 > 0:05:00and her belongings, passport and marriage certificate taken away.
0:05:02 > 0:05:04They blackmailed him and said,
0:05:04 > 0:05:08"You've got two weeks to prove yourself, otherwise you're not getting her back."
0:05:08 > 0:05:12SIREN WAILS
0:05:12 > 0:05:15Her husband, concerned about Shabana's welfare, alerts police.
0:05:15 > 0:05:19Later that same night, they track down her whereabouts
0:05:19 > 0:05:23and order the car she's in to rendezvous with them at a petrol station.
0:05:28 > 0:05:32Shabana is a car being driven by her brother-in-law,
0:05:32 > 0:05:35supposedly to take her back to her husband.
0:05:35 > 0:05:39She was under the influence of something - we didn't know what.
0:05:39 > 0:05:40She couldn't talk properly.
0:05:40 > 0:05:44She was slurring her words. We could hardly get a name off her.
0:05:44 > 0:05:47Pretty much had to carry her back to our police vehicle.
0:05:47 > 0:05:51She was slurry and her eyes were all over the place really.
0:05:51 > 0:05:53She didn't look well at all.
0:05:56 > 0:06:00Because of Shabana's condition, she is sent to a nearby hospital.
0:06:00 > 0:06:04She's treated and samples of her blood and urine are taken.
0:06:05 > 0:06:07What she tells police that night,
0:06:07 > 0:06:12starts a process that will end with five members of her family being arrested.
0:06:23 > 0:06:26The next day, the Community Cohesion Unit of Lancashire Police
0:06:26 > 0:06:33based in Blackburn, begins further investigations into what Shabana has said.
0:06:33 > 0:06:35Cos she made a disclosure to the officer
0:06:35 > 0:06:39about being unwell after having this drink.
0:06:39 > 0:06:45Shabana is discharged from hospital and brought to the police station.
0:06:45 > 0:06:48Well, she's been discharged. Er, she's feeling a bit groggy.
0:06:48 > 0:06:52Detectives questioning her suspect she may have been drugged
0:06:52 > 0:06:55or poisoned through a drink she'd been given -
0:06:55 > 0:06:57hot, sweet milk.
0:06:57 > 0:07:02- See you later. Bye.- Have you had that before? This sweet milk before?
0:07:02 > 0:07:03No.
0:07:03 > 0:07:06How long was it before you felt really ill after you had a mouthful of this drink?
0:07:06 > 0:07:11I was fine and then as soon as I went in the living room to sit down,
0:07:11 > 0:07:13I don't know what...
0:07:13 > 0:07:16I wasn't even prepared for it, I just puked.
0:07:16 > 0:07:20- And it was like my eyes were half shut. - So you've thrown up in the house?
0:07:20 > 0:07:23Yeah, and there was everybody talking to each other.
0:07:23 > 0:07:26And I don't know who's wiping my face. I don't know what's going on.
0:07:26 > 0:07:30When you said that everyone was talking and you could hear
0:07:30 > 0:07:34different people talking, could you hear what the conversation was like?
0:07:34 > 0:07:38- I don't know. I was just like knocking out, like blacking out. - Crap.
0:07:38 > 0:07:44Next minute, someone's holding me to take me outside the house.
0:07:44 > 0:07:47My brother-in-law got in the van - he was the driver.
0:07:47 > 0:07:51They went to a petrol station and then after that, all I can remember
0:07:51 > 0:07:55is a police guy knocking on the window and asking me if I'm all right.
0:07:55 > 0:07:59And it was confusing cos I didn't know where he'd come from
0:07:59 > 0:08:02because who had reported to the police what's going on?
0:08:02 > 0:08:06- It was your husband. - He opened the door and he got my stuff for me and he grabbed me out.
0:08:06 > 0:08:10And he helped me in the van. After that, I don't remember nothing.
0:08:10 > 0:08:12Right, I've got enough just to speak to Bobby
0:08:12 > 0:08:15- and then we can go back right from the beginning. Sorry about that.- It's OK.
0:08:15 > 0:08:18It's just something I've to get done by two o'clock.
0:08:20 > 0:08:22Now he's got the extra information,
0:08:22 > 0:08:26DC Dave Souch is anxious to brief his boss straight away.
0:08:26 > 0:08:28We got her to get straight to the point about what...
0:08:28 > 0:08:32about what's gone on before we start doing any in-depth work and bits and pieces.
0:08:32 > 0:08:35I'll get a statement from her, if she's happy to provide one.
0:08:35 > 0:08:40- So when did you make the decision to go?- I decided quite a few times.
0:08:40 > 0:08:45PC Angela Harwood is getting some background about why Shabana left home.
0:08:45 > 0:08:48I just couldn't take any more at all.
0:08:48 > 0:08:51Do you know, forget it, I don't want to be here.
0:08:51 > 0:08:53Then I just felt so helpless and hopeless.
0:08:54 > 0:08:57Following Shabana's account of what's happened,
0:08:57 > 0:09:02police believe they now have enough grounds to start making arrests.
0:09:02 > 0:09:05They plan to search the sister's house for any evidence,
0:09:05 > 0:09:08particularly relating to that hot, sweet milk.
0:09:08 > 0:09:12- We're looking for a mug, that's all she knows.- What colour?
0:09:12 > 0:09:17What colour was the mug you drank out of? A white mug?
0:09:17 > 0:09:21- Is it a standard mug or is it? - It's more a curved, round mug.
0:09:21 > 0:09:27- A curved round mug, Richard. White. Curved, round mug - white.- Round.
0:09:27 > 0:09:28And white.
0:09:28 > 0:09:32- What was the drink?- Milk. - Hot.- Hot milk.
0:09:32 > 0:09:35- And whereabouts did you put the mug down?- What room?
0:09:35 > 0:09:38- Put it back on the sink.- Put it back on the sink in the kitchen.
0:09:38 > 0:09:41- Colin's coming.- Yeah?
0:09:44 > 0:09:46Right. Um.
0:09:55 > 0:09:58They were saying to me, "Get a divorce.
0:09:58 > 0:10:00"Any guy would do but not him."
0:10:00 > 0:10:03- Was he angry?- Shabana recalls how her brother first came to her house.
0:10:03 > 0:10:07It was a terrifying experience.
0:10:09 > 0:10:13He said, "If you don't open the door I'm going to bash it in."
0:10:14 > 0:10:18He sounded angry and aggressive.
0:10:18 > 0:10:24- Were you frightened when he was banging on the door?- Yeah. Very frightened.
0:10:26 > 0:10:30- Shall we crack on?- Yes. - Right, thanks for coming.
0:10:30 > 0:10:33Basically we're going to execute a warrant to a corner terrace house.
0:10:33 > 0:10:38I'll just give you some background in relation to the job.
0:10:38 > 0:10:41PC Richard Jarram is briefing the arrest team.
0:10:41 > 0:10:46She was going to ne forced into a marriage against her will.
0:10:48 > 0:10:52There's plenty of backup but he's planning a low-key approach.
0:10:52 > 0:10:57We've had a quick look at the address as a fly-by fiscal visit.
0:10:57 > 0:11:00As I say, it's an end terrace house with a UPVC door.
0:11:00 > 0:11:04I'm assuming that we're going to be knocking on entry rather than using force.
0:11:04 > 0:11:07The warrant's here for you.
0:11:07 > 0:11:12So what we're looking for is a curved, round mug, white,
0:11:12 > 0:11:14maybe part of a set.
0:11:14 > 0:11:19Any medicine or signs of medicine having been crushed up,
0:11:19 > 0:11:24or any of what you'd consider to be a noxious substance that's at hand.
0:11:24 > 0:11:30The car in which she was in, is a Toyota Estima
0:11:30 > 0:11:32and it's outside the address.
0:11:35 > 0:11:36Oh, yeah, that's good.
0:11:36 > 0:11:40I've literally just finished taking a statement with her.
0:11:40 > 0:11:44All she wants to do is go back to be reunited with husband.
0:11:44 > 0:11:48They are now moving him to a safe house.
0:11:48 > 0:11:51The Lancashire Police team are on the way
0:11:51 > 0:11:53to make their arrests at Shabana's sister's house.
0:11:55 > 0:11:58Shabana is signing a statement that will be
0:11:58 > 0:12:02the basis of the evidence against her family.
0:12:02 > 0:12:05Whether we find anything it's going to be difficult.
0:12:05 > 0:12:08We may end up seizing a lot of items
0:12:08 > 0:12:10because to the naked eye
0:12:10 > 0:12:14we might not see what we're looking for, but after forensic examination
0:12:14 > 0:12:19we might actually find the vital bit of evidence.
0:12:21 > 0:12:26- Hiya, sorry to bother you. Richard Jarram from the police.- Yes. - May we come in?- Yes.
0:12:31 > 0:12:33We have a search warrant to search this address.
0:12:33 > 0:12:39Your sister's made certain allegations that we're following up, OK?
0:12:39 > 0:12:41Hello, sir. Are you husband?
0:12:41 > 0:12:47OK, I'm going to inform you that you're under arrest on suspicion of administering poison.
0:12:48 > 0:12:51The first arrest is Shabana's brother-in-law.
0:12:53 > 0:12:56He was driving the car she was found in.
0:12:58 > 0:13:00Anything you do say may be given in evidence.
0:13:00 > 0:13:02Do you understand that you're under arrest?
0:13:06 > 0:13:07Just over here.
0:13:07 > 0:13:11Next to be arrested are Shabana's father and her sister.
0:13:14 > 0:13:18- Sit behind this seat.- This seat? - Yes.
0:13:23 > 0:13:26- PHONE RINGS - Richard Jarram.
0:13:26 > 0:13:29Hi, Angie.
0:13:31 > 0:13:33Yeah, three arrested. On our way to Greenbank.
0:13:36 > 0:13:38Back at the police station,
0:13:38 > 0:13:43detectives decide that Shabana needs to stay overnight in a hotel, to allow her to rest
0:13:43 > 0:13:46and come in for further questioning in the morning.
0:13:46 > 0:13:52I need accommodation for a single female for tonight quite urgently, please.
0:13:52 > 0:13:55Thank you. Come on, chuck. I'm waiting for a car to turn up
0:13:55 > 0:13:59so I can take you to somewhere to get your head down.
0:13:59 > 0:14:02As Shabana leaves, her father and two other members of her family
0:14:02 > 0:14:05are brought in for questioning.
0:14:05 > 0:14:08She's taken a big step.
0:14:08 > 0:14:11- If you come in here...- No, come in.
0:14:14 > 0:14:18Shabana's brother-in-law arrives at the police station.
0:14:18 > 0:14:21He's destined to play a major part in this family drama.
0:14:21 > 0:14:24BUZZER
0:14:36 > 0:14:42Richard Jarram reports back to his bosses on what the search of the sister's home has uncovered.
0:14:42 > 0:14:46The cups at the house, there's a number that match the description
0:14:46 > 0:14:49- but they've all been washed. - Yes.- And they've all been put away.
0:14:49 > 0:14:53- There's nothing that stands out as the obvious instrument.- Right.
0:14:53 > 0:14:56Obviously we need to know how fast the forensics
0:14:56 > 0:15:01will turn round on the blood to tell us whether there's anything...
0:15:01 > 0:15:05- Is that urine as well?- Yeah. I think urine sample as well.
0:15:05 > 0:15:08So that's just being checked now.
0:15:08 > 0:15:11We've got them till about three o'clock tomorrow if necessary, haven't we?
0:15:11 > 0:15:15- Was it about three o'clock? - Half three.- All right. So we've plenty of time.
0:15:15 > 0:15:19The detectives discuss the plan of action for the next day.
0:15:19 > 0:15:21Shabana is required to give vital information
0:15:21 > 0:15:25before she rejoins her husband.
0:15:25 > 0:15:27There may be stuff to clarify after the interviews.
0:15:27 > 0:15:29- Yeah.- We may need another interview with her.
0:15:29 > 0:15:32- We'll then take her back home.- Yeah.
0:15:32 > 0:15:36And the agreement is that if we take her back,
0:15:36 > 0:15:38- we get a statement off husband. - Right.
0:15:46 > 0:15:50The first of Shabana's family to be questioned is her brother-in-law.
0:15:50 > 0:15:53He's requested a lawyer to be present.
0:15:53 > 0:15:55INDISTINCT CONVERSATION
0:15:55 > 0:15:59We've met her and she's been practically passed out in the vehicle.
0:15:59 > 0:16:01She didn't want to go back.
0:16:02 > 0:16:04A kidnap.
0:16:04 > 0:16:09The whole family are... So we'd normally base this on the forced marriage thing. Yeah?
0:16:23 > 0:16:28Whilst her brother-in-law is questioned, Shabana heads for her hotel.
0:16:28 > 0:16:32Her revelations have left the police with many unanswered questions.
0:16:35 > 0:16:38We've got a girl who, for whatever reason,
0:16:38 > 0:16:41has become stupefied by a chemical of some description.
0:16:41 > 0:16:46Um, we don't know what the reason for that was.
0:16:46 > 0:16:50Is it just to be able to control someone?
0:16:50 > 0:16:53Right up to, is it to do someone some serious harm?
0:16:53 > 0:16:59In which case, you go from one low spectrum of seriousness right up to, potentially, murder.
0:17:05 > 0:17:07She's had a drink of warm, sweet milk.
0:17:08 > 0:17:11And then, within five minutes, she's throwing up.
0:17:13 > 0:17:18Um, it's difficult to say what on earth was in that
0:17:18 > 0:17:21to make her be sick.
0:17:21 > 0:17:27It's all going to come down to toxicology reports as to what is actually in her system.
0:17:40 > 0:17:42It's been a long day and night
0:17:42 > 0:17:46but the detectives need to meet to compare notes.
0:17:47 > 0:17:50'There's an awful lot that we don't know.'
0:17:50 > 0:17:53Where she went in the car, which way the car was heading.
0:17:53 > 0:17:55Was she going where she wanted to go?
0:17:55 > 0:17:58Was she going against her own will?
0:17:58 > 0:18:01And obviously they're lines of enquiry.
0:18:01 > 0:18:03Do you want to give taped disclosure?
0:18:03 > 0:18:05I think we ought to in this case
0:18:05 > 0:18:08just in case that toxicology comes back as being iffy.
0:18:08 > 0:18:12The stories of the family members need to be crosschecked.
0:18:12 > 0:18:15Dave and Richard begin with Shabana's sister,
0:18:15 > 0:18:18someone she was very close to.
0:18:18 > 0:18:23She reveals that she saw her brother hitting Shabana during an argument.
0:18:24 > 0:18:26Brother's turned round and basically turned round
0:18:26 > 0:18:30and said, "You, wind your neck in.
0:18:30 > 0:18:34- "Do as you're told. I am going got tell her how it is."- Right.
0:18:34 > 0:18:37She said he was angry - mad, in effect.
0:18:37 > 0:18:42So they've gone into the living room and he starts talking
0:18:42 > 0:18:47about disrespecting people and actually pushes her onto the sofa.
0:18:47 > 0:18:53- Right.- At some point, brother has belted her across the face.
0:18:53 > 0:18:57- Yeah.- Did she not mention that?
0:18:57 > 0:19:00No, that's not mentioned in her statement.
0:19:00 > 0:19:04- So she's got a belt out of this. - Right.- She said, "I want to go."
0:19:04 > 0:19:05Brother's saying, "You ain't.
0:19:05 > 0:19:09"You're stopping here for a couple of days. You're doing this.
0:19:09 > 0:19:10- "You ain't leaving."- Right.
0:19:10 > 0:19:13So we've got a nice little false imprisonment from a witness there.
0:19:13 > 0:19:17The person doing all the talking and the bawling was her brother.
0:19:17 > 0:19:21He was the one making all the demands on people.
0:19:23 > 0:19:26And he was the one who was livid.
0:19:26 > 0:19:28Right.
0:19:29 > 0:19:33People are going to have to start to answer some very awkward questions
0:19:33 > 0:19:39and then it will come down to why has that happened to her?
0:19:41 > 0:19:43Explain.
0:19:43 > 0:19:47And then, no doubt, we can then go down the roads of
0:19:47 > 0:19:53dishonouring the family, disrespecting the family, big insults,
0:19:53 > 0:19:55how it affects their community standing.
0:20:01 > 0:20:02And see what they have to say.
0:20:04 > 0:20:09Shabana's father is asked about that honour issue.
0:20:10 > 0:20:13I said, "Well, you keep mentioning this honour,
0:20:13 > 0:20:16"about bringing shame to the family, dishonouring...
0:20:16 > 0:20:20"You know, bringing disgrace to the family, and that."
0:20:20 > 0:20:22So he explained that, no, no, no,
0:20:22 > 0:20:25although people do believe in that, other people, but he doesn't.
0:20:29 > 0:20:35The police case is building, and the detectives decide to arrest Shabana's brother.
0:20:35 > 0:20:38But because they've heard he was violent toward his sister,
0:20:38 > 0:20:42Dave Souch calls in some support.
0:20:42 > 0:20:45Unfortunately, we don't know a great deal about this lad,
0:20:45 > 0:20:47if he's handy or anything.
0:20:47 > 0:20:51That's why we like a section van there to transport him back to Greenbank.
0:20:54 > 0:20:55OK?
0:20:55 > 0:20:58Thank you very much. Cheers, mate.
0:21:00 > 0:21:04What we're going to do is, lock him up first,
0:21:04 > 0:21:10keep him away from other family members, and then part four bail...
0:21:12 > 0:21:18..those who are already in custody, and then we deal with him in the morning.
0:21:20 > 0:21:23CAR ALARM
0:21:33 > 0:21:37You're going to be arrested on suspicion of administering
0:21:37 > 0:21:41a noxious fluid, and taken to Blackburn police station.
0:21:41 > 0:21:45Shabana's brother is the fourth member of the family to be arrested.
0:21:49 > 0:21:53Can I just text my partner to let them know that's what's happening?
0:21:53 > 0:21:57No, not at this stage. We'd speak to the custody sergeant, and he'd do it for you.
0:22:14 > 0:22:18Shabana's brother has a powerful role within the family.
0:22:18 > 0:22:22I'm authorising your detention here at the moment to secure and preserve evidence,
0:22:22 > 0:22:24and obtain evidence by questioning.
0:22:24 > 0:22:27Dad's never been around much in the family.
0:22:27 > 0:22:29And my big brother's always been there.
0:22:29 > 0:22:33He's the one who thinks... He is the one that's responsible, type of thing.
0:22:33 > 0:22:35Like, he's well known.
0:22:35 > 0:22:39When he walks around people are going to say to him, "Oh, where's your sister gone?"
0:22:39 > 0:22:44Like, he's going to get the blame for it, type of thing.
0:22:45 > 0:22:47It's like, shame for him.
0:22:47 > 0:22:50Like, he won't be able to bear it, that's what he said to me.
0:22:53 > 0:22:58What we're finding is several families think that what
0:22:58 > 0:23:01makes them what they are is this issue of honour.
0:23:01 > 0:23:06That their children, their grandchildren have to maintain it.
0:23:06 > 0:23:09And if they don't maintain it, there are consequences.
0:23:10 > 0:23:15In this case, Shabana's brother is most concerned about that.
0:23:17 > 0:23:19As he's being taken into a holding cell,
0:23:19 > 0:23:21Shabana's brother-in-law is being questioned.
0:23:24 > 0:23:28Right, the type is 00, 00 on...
0:23:28 > 0:23:30He's requested a solicitor,
0:23:30 > 0:23:33and she reads a statement that he's prepared.
0:23:33 > 0:23:38It contains a revelation that gives the police a major lead.
0:23:38 > 0:23:40- FROM RECORDING:- 'There is a prepared statement,
0:23:40 > 0:23:42'it's pretty limited due to the language,
0:23:42 > 0:23:46'but it will just give a bit of background, and I think it might just help.
0:23:46 > 0:23:49'"I went to pick the children up, and when I came back
0:23:49 > 0:23:54'"I found out from my brother-in-law that they had given her something.
0:23:54 > 0:23:58'"Mother-in-law and brother-in-law were having this conversation.
0:23:58 > 0:24:03'"I suspected it to be Shamrez, and he said, I have given her something."'
0:24:03 > 0:24:07When Dave Souch returns after arresting Shabana's brother, Shamrez,
0:24:07 > 0:24:11he's told about the brother-in-law's statement.
0:24:11 > 0:24:14He's given a sort of prepared statement,
0:24:14 > 0:24:18but he's basically said, yeah, everything up to Tuesday,
0:24:18 > 0:24:24mother-in-law, brother has turned up, all very angry, quite apparent.
0:24:24 > 0:24:28Brother-in-law intimates, "Yeah, I've give her summat."
0:24:28 > 0:24:30Sorry?
0:24:30 > 0:24:34He says, "I can tell by looking at her she's been given something." That's on his prepared statement.
0:24:36 > 0:24:40So, spoke to the solicitor, she's prepared to let him answer them questions,
0:24:40 > 0:24:41and what he thinks the brother has meant
0:24:41 > 0:24:44when he said he's given her something, what does he mean.
0:24:47 > 0:24:50- Or somebody did.- Yeah, so just bear that in mind for the interview.
0:24:50 > 0:24:52Yeah.
0:24:52 > 0:24:56Detective sergeant Colin Dassow also reports up the line about
0:24:56 > 0:24:59what the brother-in-law has been saying about Shabana's brother, Shamrez.
0:24:59 > 0:25:02Shamrez has said to him, "I've given her something." Right?
0:25:02 > 0:25:05Now, Shamrez is the one that Richard went to arrest,
0:25:05 > 0:25:07he's currently in the cells...
0:25:07 > 0:25:10Yeah, who we think's done it.
0:25:10 > 0:25:13And he's there present at all the bad stuff.
0:25:13 > 0:25:16So, it's all coming about, really.
0:25:16 > 0:25:20DC Sal Yusuf, who interviewed the brother-in-law, is delighted with how it went.
0:25:20 > 0:25:23It took me all of four minutes, no, 15 minutes to do the caution,
0:25:23 > 0:25:26and then within two minutes I'd had the confession.
0:25:29 > 0:25:34The news about the brother-in-law's interview is spreading.
0:25:35 > 0:25:39- I think there's a little bit of a cough coming on here.- I hope so.
0:25:39 > 0:25:46- No, from Sal's interview with the brother-in-law.- Brother-in-law, yeah.
0:25:46 > 0:25:50When the brother, Shamrez, is interviewed, he admits to hitting his sister, Shabana.
0:26:07 > 0:26:12Dave Souch also questions him about his visit to Shabana's house when she was away.
0:26:30 > 0:26:35Shabana's sister and father are going home on bail to return at a later date.
0:26:36 > 0:26:41Both have said they know nothing of any plot against Shabana.
0:26:41 > 0:26:44Her sister rejects the allegations against her,
0:26:44 > 0:26:47and says she is very close to Shabana.
0:26:47 > 0:26:49Shabana's father is separated from her mother,
0:26:49 > 0:26:52and is stunned by the charges against him.
0:26:52 > 0:26:55You've no suicide or self-harm issues?
0:26:57 > 0:26:59- I won't.- "I won't," he said.
0:27:00 > 0:27:02That's good enough for me.
0:27:05 > 0:27:09People do, unfortunately, so we have to ask the questions.
0:27:14 > 0:27:16Don't tempt fate like that.
0:27:28 > 0:27:31The next morning, the detective team meet
0:27:31 > 0:27:35to update everyone on what's been happening, and chew the case over.
0:27:35 > 0:27:38OK, let's run through yesterday's job.
0:27:40 > 0:27:43Our concerns are, that if she's been drugged,
0:27:43 > 0:27:49what was the purpose of the journey in the car?
0:27:49 > 0:27:51Was it to take her back to be with family?
0:27:51 > 0:27:53Or was there some more sinister motive?
0:27:53 > 0:27:57Whenever I went round the address,
0:27:57 > 0:28:01it was always they were expecting cops to arrest them.
0:28:01 > 0:28:04It was all so matter-of-fact, "You're under arrest."
0:28:04 > 0:28:09Yeah, brother clearly knows what he should and shouldn't be saying
0:28:09 > 0:28:13at this stage, like, "I don't need a solicitor, what can a solicitor
0:28:13 > 0:28:18"actually tell me to say to you what I don't already know?"
0:28:19 > 0:28:25Richard and Angela are going to examine the car Shabana was found in.
0:28:25 > 0:28:29They doubt the brother-in-law's claim he was driving her back to her husband.
0:28:29 > 0:28:33Why they acted the way they have when she's quite clearly ill,
0:28:33 > 0:28:36when they should be thinking about taking her to a hospital,
0:28:36 > 0:28:40which any reasonable person would be in those circumstances...
0:28:41 > 0:28:44The course of action they've taken is bizarre.
0:28:44 > 0:28:48It wouldn't be bizarre if their intention was to stupefy her
0:28:48 > 0:28:50so she doesn't put up any resistance.
0:28:50 > 0:28:53Or to stupefy her to harm her in some way.
0:28:53 > 0:28:56At the pound where the car is being held,
0:28:56 > 0:29:01a police photographer has already arrived to start capturing pictures
0:29:01 > 0:29:04that may be useful for the investigation.
0:29:06 > 0:29:10Richard discovers something that may be of interest.
0:29:10 > 0:29:12It's a bowl, like a washing-up bowl.
0:29:12 > 0:29:16It's got a couple of tissues in, by the looks of it,
0:29:16 > 0:29:18and what appears to be bile.
0:29:19 > 0:29:25Which would confirm that our lady was sick.
0:29:25 > 0:29:27And perhaps she was sick,
0:29:27 > 0:29:30or they'd got this ready for if she was sick in the car.
0:29:32 > 0:29:35Now, I'm going to take that satnav that's at the front.
0:29:37 > 0:29:39Can you just mind over, please?
0:29:39 > 0:29:44The vehicle's satellite navigation device is also taken away for analysis.
0:29:44 > 0:29:48It can be crucial evidence, really, because they may have
0:29:48 > 0:29:52programmed in certain addresses in different towns.
0:29:52 > 0:29:56In the end, however, the satnav doesn't reveal anything useful.
0:30:08 > 0:30:12Dave and Angela arrive at the hotel to pick up Shabana after she's had some sleep.
0:30:14 > 0:30:17Four of her family have now been arrested.
0:30:17 > 0:30:19You look a lot healthier, today.
0:30:22 > 0:30:27Most of us didn't finish till about three o'clock this morning, so we've had a busy day.
0:30:32 > 0:30:37Today, police will complete Shabana's formal statement.
0:30:37 > 0:30:40They've waited till now to help her recover from her ordeal.
0:30:40 > 0:30:44Right, yesterday, where do we go?
0:30:44 > 0:30:49During interview, a couple of things have come out.
0:30:49 > 0:30:53The main one is your brother was, in fact, absolutely raging. He was mad.
0:30:53 > 0:31:02And you've been taken into the living room where he's assaulted you.
0:31:02 > 0:31:05He's given you a good belt across the face,
0:31:05 > 0:31:07and he's pushed you onto the sofa.
0:31:08 > 0:31:11- Do you recall that?- Yeah.- Right.
0:31:11 > 0:31:14OK, we just need to take a quick statement to clarify
0:31:14 > 0:31:17what actually happened in the morning.
0:31:27 > 0:31:30She's remembered loads of stuff.
0:31:30 > 0:31:33One line that she can remember hearing was her mum going,
0:31:33 > 0:31:36"Oh, my God, you lot are stupid, she's vomiting, she's being sick.
0:31:36 > 0:31:39"You've made her sick."
0:31:39 > 0:31:45- There weren't going to let her out of the house. - That's all right. No problem.
0:31:45 > 0:31:48The police unit at Blackburn specialises in honour crime,
0:31:48 > 0:31:52so they're experienced in dealing with cases like this,
0:31:52 > 0:31:56and threats like those Shabana says her brother used.
0:31:56 > 0:31:58When he's assaulted you, what's he been saying to you?
0:31:58 > 0:32:00He said to me, basically, he'll kill me.
0:32:00 > 0:32:04Did he say, "I'll kill you if you don't do this, that and the other"?
0:32:04 > 0:32:07No, it was just like, "I'm going to kill you."
0:32:07 > 0:32:10I kept saying, "I want to go to my husband." I was scared, obviously.
0:32:10 > 0:32:12You know, I was on my own.
0:32:12 > 0:32:16- Did you believe that your brother would kill you at that time? - Yeah.- OK.
0:32:20 > 0:32:23Then he said, "You're not getting your phone back.
0:32:23 > 0:32:26"You're not going back."
0:32:26 > 0:32:31- Basically they came to take me back with them.- How do you know that?
0:32:31 > 0:32:33Because they burned my stuff.
0:32:33 > 0:32:36They said, "You're not going back there and you're coming back with us."
0:32:37 > 0:32:42That's when my mum said, "Sit down and we'll talk about this.
0:32:42 > 0:32:44I said to my sister,
0:32:44 > 0:32:47"Please pass me your house phone," and I'd ring the police."
0:32:48 > 0:32:50That's when my brother said to me,
0:32:50 > 0:32:54- "I'll kill you before they even arrive here."- OK.
0:32:57 > 0:33:03- Who was blocking your way?- My brother was in front of me, my mum
0:33:03 > 0:33:07was on the left, my brother-in-law was next to my brother.
0:33:07 > 0:33:08They were all around me.
0:33:08 > 0:33:13- Was he angry at the time he told you he'd kill you?- Very angry.
0:33:14 > 0:33:17I kept saying that I wanted to go to my husband,
0:33:17 > 0:33:19and, "You can't touch me."
0:33:19 > 0:33:21Cos he was touching me.
0:33:21 > 0:33:27That's when he physically pushed me down again and slapped me twice.
0:33:27 > 0:33:30Hang on. How did he hit you? Fist? Hand?
0:33:30 > 0:33:34He slapped me twice. I think that's because of that as well.
0:33:34 > 0:33:42When he hit me, it was like... everything echoed. Very like numb.
0:33:42 > 0:33:46My cheeks were stinging. I think that's because of that.
0:33:46 > 0:33:50The only person that was shocked like me was my sister.
0:33:51 > 0:33:53We were proper shocked.
0:33:53 > 0:33:57- Did you start crying? - I was crying already.
0:33:58 > 0:34:03I panicked because I knew I was alone. They can do anything.
0:34:04 > 0:34:08- Did you think you were going to die? - I thought my life was in danger, yeah.
0:34:17 > 0:34:20Prompted by Shabana's revelations,
0:34:20 > 0:34:23the police set off to make another arrest.
0:34:23 > 0:34:27She says that she recalls her mum saying
0:34:27 > 0:34:30when she was in this disorientated state,
0:34:30 > 0:34:37I think her exact words were, "Oh, God, look what you have done.
0:34:37 > 0:34:40"You lot, look what you lot have done."
0:34:41 > 0:34:50She has been sick which intimates that the family have done something to her to make her ill.
0:34:56 > 0:34:57Hello. Are you all right?
0:34:57 > 0:35:00She's not going to be very long, your wife.
0:35:00 > 0:35:03We are ready to interview her now.
0:35:03 > 0:35:06Shabana's mother becomes the fifth
0:35:06 > 0:35:10and final member of the family to be taken in for questioning.
0:35:20 > 0:35:25- How did you get on with the young lady?- Eight pages.
0:35:25 > 0:35:29- You still doing it? - Just finished it.
0:35:29 > 0:35:33She has had a sleep. She has got whatever was inside her out of her system.
0:35:35 > 0:35:39Very matter of fact. This is how it was.
0:35:41 > 0:35:47Which is nice because it ties in with what lots of other people
0:35:47 > 0:35:49have said in interviews.
0:35:49 > 0:35:52Yes, she was belted by her brother.
0:35:52 > 0:35:56He has threatened to kill her and she believed he was going to do it.
0:35:57 > 0:35:59Poor girl.
0:35:59 > 0:36:04Munover Shah a Muslim link worker at the police station checks on how
0:36:04 > 0:36:06Shabana is bearing up under the strain.
0:36:08 > 0:36:10Eat something at least.
0:36:10 > 0:36:13You need to flush out whatever it was.
0:36:15 > 0:36:21Don't say, "I don't want to eat." You need to eat to keep you going.
0:36:21 > 0:36:23To fight against what is coming.
0:36:25 > 0:36:28You need to keep yourself intact.
0:36:31 > 0:36:38Whatever you want to say, whatever's in your heart and mind, just tell them and they will sort you out.
0:36:38 > 0:36:39Where are you going now?
0:36:39 > 0:36:44I dressed up because I thought I was going to go to my husband today.
0:36:44 > 0:36:49I hope I do because I really miss him now. I really do.
0:36:49 > 0:36:53- Aw!- When he sees me, I don't want him to get worried.
0:36:53 > 0:36:56That is why I dressed up. I am going to put on a brave face.
0:36:56 > 0:36:58Be strong for him as well.
0:36:59 > 0:37:01The way things are happening,
0:37:01 > 0:37:03I think the community needs to learn
0:37:03 > 0:37:05that they need to talk to the children.
0:37:05 > 0:37:09What you can do with honour
0:37:09 > 0:37:16in the first place, then dishonour won't come upon you.
0:37:16 > 0:37:23If you sort yourself out in the first place. You need to speak
0:37:23 > 0:37:26to your children and meet them halfway.
0:37:32 > 0:37:35With her statement complete, officers are taking Shabana
0:37:35 > 0:37:40to be reunited with her husband at a secret location.
0:37:40 > 0:37:44The journey gives her time to reflect on the attitudes of some
0:37:44 > 0:37:45in the community around her.
0:37:45 > 0:37:51I think it is a real shame for the family
0:37:51 > 0:37:56if the girl goes away to get married with her own choice.
0:37:56 > 0:38:02Even sometimes if it's with your own cousin, they don't accept it.
0:38:02 > 0:38:10I don't know. Sometimes it is not even about marriage, it is about a girl working.
0:38:10 > 0:38:17Some families in Pakistan, they don't let you work either.
0:38:20 > 0:38:24Some girls, they are really close to their parents
0:38:24 > 0:38:29and they don't want to hurt their parents.
0:38:29 > 0:38:34Their parents could come round to it and accept the marriage
0:38:34 > 0:38:35and the children.
0:38:35 > 0:38:37Some parents don't.
0:38:37 > 0:38:40Obviously, they want you dead on the spot.
0:38:40 > 0:38:43Or they don't want to know you at all.
0:38:43 > 0:38:48It all comes down to family honour and shame.
0:38:50 > 0:38:52That's what it really is about.
0:39:05 > 0:39:10A week after arresting five members of Shabana's family on suspicion of poisoning,
0:39:10 > 0:39:12the police take their evidence
0:39:12 > 0:39:14to a lawyer from the Crown Prosecution Service.
0:39:15 > 0:39:21Lisa Worsley will decide what charges could be brought against members of the family.
0:39:21 > 0:39:29I'm just wondering, kidnap is the obvious charge for carting her off.
0:39:29 > 0:39:35I have looked briefly at administration of the noxious substance.
0:39:35 > 0:39:40We need to establish by forensics what that was.
0:39:40 > 0:39:44We have got the initial hurdle of proving,
0:39:44 > 0:39:48A - that they are in her system, B - that they have been put there
0:39:48 > 0:39:52illegally and they are not something she has voluntarily ingested.
0:39:52 > 0:39:59That the concentration of them is such that they must have been hidden.
0:39:59 > 0:40:05And that they are solely responsible for the reaction that was observed.
0:40:06 > 0:40:09Harassment?
0:40:09 > 0:40:15False imprisonment is a starter, isn't it?
0:40:15 > 0:40:20That was before the point at which she was administered whatever she was administered.
0:40:20 > 0:40:23You would expect her to have a recollection of that.
0:40:24 > 0:40:28I am reluctant to go back to her. We have already got two statements.
0:40:28 > 0:40:31I am reluctant to go back to her too many times
0:40:31 > 0:40:35because it looks like we are coaching her and prompting her.
0:40:35 > 0:40:37From reading the investigation,
0:40:37 > 0:40:42it is all about family honour from the family side.
0:40:42 > 0:40:46Even if they have not caused her to be in that state,
0:40:46 > 0:40:49they know what her symptoms are.
0:40:49 > 0:40:51We were not there,
0:40:51 > 0:40:54but it is only when this drink is given to her
0:40:54 > 0:40:56that she becomes ill.
0:40:56 > 0:41:00It is almost like it is a last-ditch attempt to stop her from going back.
0:41:00 > 0:41:02I will have a look at the content of conversations again.
0:41:02 > 0:41:07The harassment is probably a non-starter, but worth consideration.
0:41:07 > 0:41:09No problem. Thanks for your time.
0:41:09 > 0:41:11So, you will be in touch?
0:41:17 > 0:41:21The police have recovered Shabana's belongings which were taken from her home.
0:41:22 > 0:41:25Nearly two weeks after the arrests, they are taking them
0:41:25 > 0:41:28back to her new safe house.
0:41:28 > 0:41:32The detectives have heard Shabana is not happy with the location
0:41:32 > 0:41:35that has been chosen for her hideaway.
0:41:35 > 0:41:39She is fully aware that she stands out among this community
0:41:39 > 0:41:44because she is the only Asian lady in that area.
0:41:44 > 0:41:49Which is predominantly a white community so she does stand out.
0:41:52 > 0:41:58For all the best in the world, people will find out.
0:42:02 > 0:42:06The police team is concerned about Shabana's welfare.
0:42:06 > 0:42:09She is also the key witness and without her co-operation,
0:42:09 > 0:42:11the case could collapse.
0:42:12 > 0:42:15The less people know anything about her,
0:42:15 > 0:42:19the better it is for her safety.
0:42:19 > 0:42:23As soon as we fail to look after her properly, and she becomes
0:42:23 > 0:42:29at risk, potentially, she may refuse to co-operate.
0:42:29 > 0:42:33That would pose problems we do not need at this stage.
0:42:33 > 0:42:40All the time she is safe, well, happy,
0:42:40 > 0:42:43the better it is for others as investigators.
0:42:47 > 0:42:51The first thing on the agenda when Dave and Richard
0:42:51 > 0:42:56arrive at Shabana's temporary home is to check on how she is feeling.
0:42:56 > 0:43:00- Just to clarify you're happy here. - Yes.
0:43:00 > 0:43:03We do not want you to live like prisoners,
0:43:03 > 0:43:09but you must be mindful that your family is still trying to look for you.
0:43:09 > 0:43:12Hopefully, those efforts will come to nothing.
0:43:12 > 0:43:15- How are you getting on in this area? - It is all right now.
0:43:15 > 0:43:18At first, I said to you there were no Asian people.
0:43:18 > 0:43:26We found a few Indians. About the halal meat, Suzanne has asked a few people
0:43:26 > 0:43:28and she has find somebody for us.
0:43:30 > 0:43:33The people are nice, kind.
0:43:35 > 0:43:36- You're fitting in OK?- Yes.
0:43:37 > 0:43:41Reassured, Richard alerts Shabana to the real possibility that
0:43:41 > 0:43:45members of her family may now face serious charges.
0:43:45 > 0:43:55We have sent the blood and urine off that was taken off you at hospital to be forensically examined for any
0:43:55 > 0:43:59potential toxins or substances that made you ill.
0:44:00 > 0:44:06If we find something, we have been to the Crown Prosecution Service
0:44:06 > 0:44:12already and asked them what are the possibilities of prosecution.
0:44:12 > 0:44:15If we do find something,
0:44:15 > 0:44:20they will entertain a prosecution against one or more family members.
0:44:20 > 0:44:23You are still on board with that, I take it?
0:44:23 > 0:44:28- Yeah?- Yeah. I am getting nightmares though.- Sorry?
0:44:28 > 0:44:31I'm getting nightmares. Seriously.
0:44:31 > 0:44:36Like, my mum has taken me somewhere or my brothers. Just stupid things.
0:44:36 > 0:44:39I cannot sleep most of the time.
0:44:39 > 0:44:41It just goes through my head. I don't know why.
0:44:41 > 0:44:44You are going to have to work through that.
0:44:44 > 0:44:51- You are safe and well here.- Yeah. - You are safe and well here.
0:44:52 > 0:44:54- OK? Well, we're love you and leave you.- All right.
0:45:03 > 0:45:07A few weeks later, the toxicology report arrives.
0:45:07 > 0:45:09Its findings will be crucial.
0:45:09 > 0:45:12It could reveal what caused Shabana's condition
0:45:12 > 0:45:15after she drank the hot, sweet milk.
0:45:17 > 0:45:20We've got a statement back from a forensic scientist,
0:45:20 > 0:45:23who's analysed the urine.
0:45:23 > 0:45:25There's six pages.
0:45:25 > 0:45:31It confirms that there are traces of Lorazepam, a powerful sedative.
0:45:31 > 0:45:32This evidence is important,
0:45:32 > 0:45:39because it supports what we believed from the very onset,
0:45:39 > 0:45:43that she was given, administered a substance
0:45:43 > 0:45:47to render her, erm, unfit...
0:45:48 > 0:45:51..to, basically, subdue her,
0:45:51 > 0:45:53for what purpose we still don't know.
0:45:53 > 0:45:57But it confirms our suspicions from the onset.
0:45:58 > 0:46:00Putting a sleeping tablet,
0:46:00 > 0:46:03a prescription medication into somebody's drink,
0:46:03 > 0:46:05yeah, it is a desperate act.
0:46:05 > 0:46:09The toxicology report states that this drug is a prescription drug.
0:46:09 > 0:46:11It's not something you can find, you know,
0:46:11 > 0:46:16or put into a drink sort of by accident.
0:46:16 > 0:46:19It's something that's been placed there.
0:46:19 > 0:46:22We don't know what was going to happen to her.
0:46:22 > 0:46:23If the officer hadn't gone then,
0:46:23 > 0:46:26if they hadn't have been able to catch hold of the car,
0:46:26 > 0:46:29we don't know where the vehicle was heading.
0:46:29 > 0:46:32And that is what is worrying
0:46:32 > 0:46:34for, certainly, the investigating officers
0:46:34 > 0:46:38and why I feel that she had a very, very, very lucky escape.
0:46:38 > 0:46:42It's time for Richard to update the Crown Prosecution Service
0:46:42 > 0:46:44on latest developments.
0:46:44 > 0:46:47The brothers then sort of got involved, and...
0:46:47 > 0:46:50The lawyers have to assess the strength of the case.
0:46:53 > 0:46:56And the villain of the piece is Shamrez Khan.
0:46:56 > 0:46:59The bottom line is, from the family's point of view,
0:46:59 > 0:47:00this is a question of honour,
0:47:00 > 0:47:02and it's been made clear, you know,
0:47:02 > 0:47:06that disrespecting the family is an honour-type situation, isn't it?
0:47:06 > 0:47:09- I don't think there's any dispute about that.- No.
0:47:09 > 0:47:10It's about the family honour
0:47:10 > 0:47:14and her doing things that are not consistent with where they see...
0:47:14 > 0:47:16the family going, with whatever.
0:47:16 > 0:47:18So we're fairly clear on that.
0:47:18 > 0:47:21These are photographs of...
0:47:21 > 0:47:23Richard briefs the lawyers
0:47:23 > 0:47:26on how Shabana's brother had climbed through her kitchen window
0:47:26 > 0:47:28while she was away
0:47:28 > 0:47:30and how Shabana's belongings were taken.
0:47:30 > 0:47:33At this point,
0:47:33 > 0:47:37mum and brother start sort of collecting all...
0:47:37 > 0:47:40Her personal belongings?
0:47:40 > 0:47:43All her stuff, yeah, everything that's there that's belonging to her,
0:47:43 > 0:47:47- and also, crucially, the passport and the marriage certificate.- Oh, dear.
0:47:49 > 0:47:50- OK?- Which means control.
0:47:50 > 0:47:52A lot of control, yeah.
0:47:52 > 0:47:55- But we're not talking about a normal burglary here, are we?- No.
0:47:55 > 0:47:57What we're talking about,
0:47:57 > 0:48:00this behaviour is just part of the same thing.
0:48:00 > 0:48:01Yeah, to control her.
0:48:01 > 0:48:04So whether or not we go for burglary at the end of the day,
0:48:04 > 0:48:06if we're satisfied about the evidence,
0:48:06 > 0:48:07is another matter, isn't it?
0:48:07 > 0:48:12It's probably just all part of the same incident,
0:48:12 > 0:48:14which is basically...
0:48:14 > 0:48:16What we're saying is that it looks like
0:48:16 > 0:48:19they're conspiring to kidnap her, aren't they, and imprison her?
0:48:19 > 0:48:21That's what, basically, we're saying.
0:48:21 > 0:48:25Whichever way you look at this, this case, it seems to be a runner.
0:48:25 > 0:48:29It's something where we would be looking to build it.
0:48:29 > 0:48:33- It's destined for the Crown Court. OK?- Thank you.- All right.
0:48:39 > 0:48:41After further investigations,
0:48:41 > 0:48:44the police bring all five members of the family back
0:48:44 > 0:48:48for formal charging for kidnap, false imprisonment
0:48:48 > 0:48:50and administering the drug Lorazepam.
0:48:50 > 0:48:53You're charged with the offences shown below.
0:48:53 > 0:48:56Even though Shabana has said she trusts her sister Saima,
0:48:56 > 0:48:59she is still charged.
0:48:59 > 0:49:01Do we call you Mohammed? Is that OK?
0:49:01 > 0:49:03- Or...?- Her father, Mohammed,
0:49:03 > 0:49:05is still baffled by what is happening.
0:49:05 > 0:49:08- Do you want to make any reply to the charges?- Not guilty.
0:49:08 > 0:49:09- Not guilty.- Not guilty.
0:49:19 > 0:49:23Her brother Shamrez Khan wants more detail of the charges.
0:49:23 > 0:49:26Shamrez, this is a joint charge
0:49:26 > 0:49:29with the other family members that appeared today. OK?
0:49:31 > 0:49:33Do you want to make any...
0:49:35 > 0:49:37..reply to the charges?
0:49:42 > 0:49:44It says, "Namely, false imprisonment,"
0:49:44 > 0:49:49ie you've kept somebody in an area against their will.
0:49:49 > 0:49:51And that one's actually kidnap.
0:49:51 > 0:49:54That's actually moving someone from one place to another.
0:49:54 > 0:49:57- OK? So he's asking you if you've any reply to make.- No comment, no.
0:49:57 > 0:49:59OK. Thank you.
0:50:00 > 0:50:02OK? You must attend court on that date.
0:50:02 > 0:50:06If you don't, there will be a warrant issued for your arrest. All right?
0:50:06 > 0:50:09Her mother, Shamim Akhtar, who helped collect
0:50:09 > 0:50:11Shabana's belongings,
0:50:11 > 0:50:12also faces charges.
0:50:15 > 0:50:18And finally, Shabana's brother-in-law, Zahid Mahmood,
0:50:18 > 0:50:20is called forward.
0:50:20 > 0:50:23He stated that Shabana's brother told him he had given her sedatives.
0:50:23 > 0:50:27You're charged with four offences, Zahid, OK?
0:50:27 > 0:50:29And released on bail to appear at court.
0:50:30 > 0:50:32In a later statement,
0:50:32 > 0:50:35he said he couldn't be certain about what he said.
0:50:35 > 0:50:39But now it's time for a jury to decide who and what to believe.
0:50:41 > 0:50:43I don't think they were expecting
0:50:43 > 0:50:46the seriousness of the charges.
0:50:46 > 0:50:47Obviously, they were informed
0:50:47 > 0:50:51prior to attending the police station this morning via their solicitors
0:50:51 > 0:50:52that they were facing charges,
0:50:52 > 0:50:55but we didn't tell them the nature of the offences
0:50:55 > 0:50:57with which they were going to be charged.
0:50:58 > 0:51:02Yeah, I think it took the wind out of their sails, really.
0:51:04 > 0:51:07Anyone that's faced any one of them particular charges,
0:51:07 > 0:51:10would be automatically going to Crown Court,
0:51:10 > 0:51:13they're indictable-only offences.
0:51:13 > 0:51:15Erm, quite serious offences,
0:51:15 > 0:51:19each of them carries a life sentence - potentially.
0:51:19 > 0:51:25Obviously, in this case, it would be up to a judge to decide the relevant sentences,
0:51:25 > 0:51:27should they be found guilty.
0:51:27 > 0:51:29And...the next port of call is court.
0:51:29 > 0:51:32Right, I'll see you out. OK.
0:51:40 > 0:51:43When the case comes to its full trial,
0:51:43 > 0:51:46the five defendants arrive to face their peers on the jury.
0:51:46 > 0:51:50For the police, just getting legal proceedings started is an achievement
0:51:50 > 0:51:55in itself because of the pressures such accusations put on families.
0:51:59 > 0:52:03Most people who're in her situation or similar situations,
0:52:03 > 0:52:05don't want to attend court
0:52:05 > 0:52:09and don't want to send their family to prison.
0:52:09 > 0:52:12The thought of that and criminalising them
0:52:12 > 0:52:14is a very difficult choice to make.
0:52:16 > 0:52:21For the number of investigations we do in relation to forced marriages,
0:52:21 > 0:52:26very few actually come to court
0:52:26 > 0:52:30because before we get to that stage, before we do a prosecution with
0:52:30 > 0:52:34the Crown Prosecution Service, many of the victims want to withdraw.
0:52:35 > 0:52:39The court allows Shabana to give her evidence from behind a screen,
0:52:39 > 0:52:42so she is hidden from her family's view.
0:52:42 > 0:52:45Even so the whole thing is a tremendous ordeal.
0:52:46 > 0:52:50This young lady has been waiting two years for the trial
0:52:50 > 0:52:54and she's spent the last two years coming to terms with the fact
0:52:54 > 0:53:00that the people closest to her could harm her and wanted to harm her.
0:53:00 > 0:53:03So it's been a difficult time for her, trying to rebuild a life
0:53:03 > 0:53:06but also knowing that at some point she'd have to give
0:53:06 > 0:53:09evidence against her family.
0:53:09 > 0:53:14She did say that she just got used to not hearing her family's voice.
0:53:14 > 0:53:19Her sisters, her mum and dad, just general family life,
0:53:19 > 0:53:22and now she has to see or hear them again
0:53:22 > 0:53:26and hearing the voices in the corridor was very difficult for her,
0:53:26 > 0:53:31it brought her other life back to her.
0:53:31 > 0:53:33She was really upset about that.
0:53:35 > 0:53:40All five family members plead not guilty to the charges of kidnap,
0:53:40 > 0:53:43false imprisonment and administering a drug.
0:53:44 > 0:53:47But Shabana's brother and brother-in-law change their pleas
0:53:47 > 0:53:49to guilty during the proceedings.
0:53:53 > 0:53:57After nearly three weeks, her mother is also found guilty
0:53:57 > 0:54:02but Shabana's sister and her father are acquitted on all charges.
0:54:04 > 0:54:07The police pass on the news of the convictions to Shabana.
0:54:07 > 0:54:11When we spoke to her afterwards she said it was perhaps
0:54:11 > 0:54:13one of the worst times of her life.
0:54:13 > 0:54:19Ultimately what she wants to come out of it is, it shouldn't
0:54:19 > 0:54:23have happened to me and I don't want it to happen to anybody else.
0:54:23 > 0:54:27After being declared innocent, Shabana's sister gives her reaction through her barrister.
0:54:29 > 0:54:33This is also a very tragic day as far as she's concerned
0:54:33 > 0:54:35because not only has she been exonerated but members of her
0:54:35 > 0:54:42family have now found themselves in custody facing very serious charges
0:54:42 > 0:54:44and likely prison sentences.
0:54:44 > 0:54:48The family are divided, hopefully in the future there will be
0:54:48 > 0:54:54a possibility of some form of reconciliation between the sisters.
0:54:57 > 0:55:00Shabana's father, too, reveals his feelings
0:55:00 > 0:55:03and how the trial has split the family apart.
0:55:05 > 0:55:09"I strongly condemn the acts of my family members for any
0:55:09 > 0:55:12"wrongdoing and they should be punished for that.
0:55:12 > 0:55:16"And also want to say I am against any sort of force
0:55:16 > 0:55:19"used against your daughters to get them married against their will."
0:55:19 > 0:55:22- Thank you very much.- What do you think about your daughter?
0:55:22 > 0:55:25- I've no comments.- Would you say anything to your daughter?
0:55:25 > 0:55:28Do you want to say anything to your daughter?
0:55:28 > 0:55:32Well, I still miss her. I can't express my...
0:55:32 > 0:55:37..Nor can I forget her but she forget me. I don't know why, how.
0:55:37 > 0:55:43I miss her and I love her.
0:55:46 > 0:55:52For Shabana, the end of the trial is not an end to the hurt.
0:55:52 > 0:55:56But, even before the trauma of the trial itself, she recognised
0:55:56 > 0:55:59it could be the beginning of a new life -
0:55:59 > 0:56:02a life perhaps without her family.
0:56:05 > 0:56:11I can't imagine my life without running away and back in that family,
0:56:11 > 0:56:16living the life like I was, because I wasn't going nowhere.
0:56:16 > 0:56:20And what's happened now has happened because they've made it happen.
0:56:21 > 0:56:25She's sort of torn between the love for her family
0:56:25 > 0:56:27and what has happened to her.
0:56:27 > 0:56:32And that is part of the healing process she's going through.
0:56:32 > 0:56:36I've got no feelings left, if you know what I mean.
0:56:36 > 0:56:39Like, what's happened has happened and when I just let go,
0:56:39 > 0:56:41forget I ever had a family -
0:56:41 > 0:56:43if that's the way it has to be now.
