:01:06. > :01:09.fight against terrorism but today, a federal judge delivered a body blow,
:01:10. > :01:18.calling the programme simply unconstitutional. This is a
:01:19. > :01:23.challenge to a programme that the president says has saved lives. The
:01:24. > :01:30.federal judge declared flatly that he believes the programme is
:01:31. > :01:34.unconstitutional. It may be the ultimate victory for fugitive NSA
:01:35. > :01:36.hacker Edward Snowden. Classified documents he leaked over the summer
:01:37. > :01:43.revealed just how much information the NSA collects on Americans and
:01:44. > :01:52.directly led to today 's ruling, and issued the NSA 's massive
:01:53. > :01:54.database... Today, the federal judge said that the programme almost
:01:55. > :01:59.certainly violates a reasonable expectation of privacy and is an
:02:00. > :02:06.unreasonable search and the fourth Amendment. He called the government
:02:07. > :02:11.programme almost Orwellian. The President has long said that the
:02:12. > :02:16.programme and another that tracks information online is a critical
:02:17. > :02:22.tool in keeping the country safe. We have saved lives. We know of at
:02:23. > :02:27.least 50 threats that have been averted because of this information
:02:28. > :02:36.not just in the US but in some cases threats in Germany. Lives have been
:02:37. > :02:38.saved. Today, the judge said there is a lack of evidence that a
:02:39. > :02:42.terrorist attack has ever been prevented because searching the NSA
:02:43. > :02:47.database was faster than other investigative tactics. The programme
:02:48. > :02:52.is limited to collecting information on who called whom and from where
:02:53. > :02:58.and is not eavesdropping. When it comes to telephone calls, no one is
:02:59. > :03:03.listening to your telephone calls. That's not what this programme is
:03:04. > :03:06.about. Despite the judge 's strong language, the programme will
:03:07. > :03:11.continue, as the government pursues an almost certain appeal. Make no
:03:12. > :03:20.mistake, this will be just the beginning of a battle that will go
:03:21. > :03:23.all the way to the Supreme Court. We are hearing that he may have more
:03:24. > :03:29.than 1 million documents in his possession? We know that publicly
:03:30. > :03:36.they have said 200,000 documents at least. That is easily over 1 million
:03:37. > :03:40.pages. The scariest thing is that intelligence officials do not know
:03:41. > :03:44.all of what he has, so there is the prospect we could see more links
