0:03:09 > 0:03:12The boys were walking on the other side of the road to a party less

0:03:12 > 0:03:15than half a mile away and the car mounted the curb and had them. Other

0:03:15 > 0:03:21friends with them were unhurt but saw the whole thing.

0:03:42 > 0:03:45This road's busy 24-7 and if I'm honest, I'm surprised there hasn't

0:03:45 > 0:03:49been more accidents along it.

0:03:49 > 0:03:51Police believe two men were in the crashed car,

0:03:51 > 0:03:54and with many other teenagers heading to the same party,

0:03:54 > 0:03:58they're appealing for any witnesses to contact them.

0:04:18 > 0:04:20But the government's chief legal adviser says there's no evidence

0:04:20 > 0:04:22of "widespread malpractice or dishonesty" in the

0:04:22 > 0:04:23prosecution system.

0:04:28 > 0:04:32Disclosure of evidence in some recent highly publicised rape cases

0:04:32 > 0:04:37has gone badly wrong, but how widespread is the problem?

0:04:37 > 0:04:40In December, Liam Allen's trial for rape and sexual assault

0:04:40 > 0:04:45collapsed when it emerged evidence on a computer disc which police

0:04:45 > 0:04:47examined showed messages from the alleged victim

0:04:47 > 0:04:51pestering him for casual sex.

0:04:51 > 0:04:55And the number of prosecutions in England and Wales that collapsed

0:04:55 > 0:04:58because of a failure by police or prosecutors to disclose evidence

0:04:58 > 0:05:02has increased by 70% in the last two years.

0:05:02 > 0:05:05Now, the Director of Public Prosecutions,

0:05:05 > 0:05:10Alison Saunders, has ordered an urgent review of all rape

0:05:10 > 0:05:13and sexual assault cases and conceded it's likely a number

0:05:13 > 0:05:15will be dropped.

0:05:15 > 0:05:18One of the major problems is the amount of digital evidence

0:05:18 > 0:05:22on phones and social media.

0:05:22 > 0:05:25It's very apparent that in some cases, mistakes have been made that

0:05:25 > 0:05:26simply shouldn't have been.

0:05:26 > 0:05:30It's important that when you look at that kind of case,

0:05:30 > 0:05:32that the prosecutors and the investigators look

0:05:32 > 0:05:36at social media traffic, look at text messages that have past

0:05:36 > 0:05:38between the two individuals, because they can put

0:05:38 > 0:05:41what's happened in a very significant different light.

0:05:41 > 0:05:44A national disclosure improvement plan has been published.

0:05:44 > 0:05:48It includes a review of disclosure training,

0:05:48 > 0:05:50developing a group of specialists in every police force

0:05:50 > 0:05:56and all multi-media evidence to be provided to the defence digitally.

0:05:56 > 0:05:59Yesterday here, a people trafficking case, not a rape

0:05:59 > 0:06:02or sexual assault trial, collapsed because prosecutors failed

0:06:02 > 0:06:06to disclose critical evidence to the defence.

0:06:06 > 0:06:11The judge has demanded an urgent explanation in a case made even more

0:06:11 > 0:06:15shocking by the fact that one of the young female defendants

0:06:15 > 0:06:20was held in prison for 13 months during which time she gave birth.

0:06:20 > 0:06:22This problem is systemic and endemic throughout

0:06:22 > 0:06:24the criminal justice system.

0:06:24 > 0:06:27It's been known about for many years and it's as a result of chronic

0:06:27 > 0:06:33underfunding of the police, the prosecution service

0:06:33 > 0:06:34and particularly the defence lawyers, who've

0:06:34 > 0:06:35suffered years of cuts

0:06:35 > 0:06:36of legal aid.

0:06:36 > 0:06:39If public confidence in our fair trial system is to be maintained,

0:06:39 > 0:06:41fixing disclosure is now the criminal justice

0:06:41 > 0:06:48system's biggest challenge.

0:06:48 > 0:06:51A bombing in the Afghan capital, Kabul, has left 95 people dead
