0:01:35 > 0:01:38everybody who celebrates the life and legacy of Scotland's great bard.

0:01:38 > 0:01:45Mr Speaker, as my right honourable friend the Prime Minister made, we

0:01:45 > 0:01:48intensify our discussions with the devolved administrations on powers

0:01:48 > 0:01:51returning from the EU, I had a useful discussion with Michael

0:01:51 > 0:01:54Russell earlier in the New Year and I'm confident discussions will

0:01:54 > 0:02:02continue to be productive.The honourable member for East

0:02:02 > 0:02:06Renfrewshire had said during the committee stage, "I will not support

0:02:06 > 0:02:09a Bill that undermines the deletion and does not respect the integrity

0:02:09 > 0:02:13of the union. If that was the position of the Scottish

0:02:13 > 0:02:17Conservatives why did they invoke against the Labour amendment that

0:02:17 > 0:02:23would safeguard devolution?Mr Speaker, it's quite easy in

0:02:23 > 0:02:29opposition to pursue stance and gimmicks. That is what the Labour

0:02:29 > 0:02:37amendment was. What this government have made quite clear is we agree

0:02:37 > 0:02:41with the Scottish and Welsh Assembly government 's an amendment to be

0:02:41 > 0:02:46brought forward to the Bill, that is what we are doing.

0:02:48 > 0:02:54Thank you, Mr Speaker. Figures published today show that trade with

0:02:54 > 0:02:58Scotland and the rest of the UK is four times more important to

0:02:58 > 0:03:05Scotland than with the EU. Does my right honourable friend agree that

0:03:05 > 0:03:09as powers returned to Scotland, we protect the UK internal market so

0:03:09 > 0:03:15businesses in Scotland continued to flourish?I absolutely agree with my

0:03:15 > 0:03:21honourable friend. I would point out these figures produced by the

0:03:21 > 0:03:29Scottish themselves. Trade within the UK is worth four times as much

0:03:29 > 0:03:34to Scotland as with the EU, therefore when Scotland's place in

0:03:34 > 0:03:40Europe was published last week it disappointed me that that fact was

0:03:40 > 0:03:49not recognised.Did the Secretary of State tell the House what is wrong

0:03:49 > 0:03:52with the devolution powers of the EU Withdrawal Bill and what he would

0:03:52 > 0:04:05like to see to get he just great pudding of Chieftain race?The

0:04:05 > 0:04:12honourable gentleman always has an interesting take on events. But I am

0:04:12 > 0:04:16very clear that we want to work with the Scottish Government, with the

0:04:16 > 0:04:19Welsh Assembly government, with the Scottish parliament would be

0:04:19 > 0:04:25financed and Constitution committee, has set out their views in relation

0:04:25 > 0:04:28to clauses ten and 11 of the Bill and I want to read agreement with

0:04:28 > 0:04:34them said the government will recommend an LCM.Does my right

0:04:34 > 0:04:37honourable friend agree with me that Brexit presents an enormous

0:04:37 > 0:04:45opportunity for the Scottish bar and to gain even further powers? --

0:04:45 > 0:04:49Scottish Parliament to gain.Is it not only represents that opportunity

0:04:49 > 0:04:54but it represents one to use those powers. But that is one of the

0:04:54 > 0:04:57issues we never hear the Scottish National Party talking about. How

0:04:57 > 0:05:04power is devolved to Scotland after leaving the EU, will actually be

0:05:04 > 0:05:11used. That is the debate we should be having now.Mr Speaker, first of

0:05:11 > 0:05:19all can I cook the sentiments expressed on behalf of the lassies

0:05:19 > 0:05:25to wish a happy then stay. I was comforted to hear the Secretary of

0:05:25 > 0:05:30State committed to bring forward amendments to the EU Withdrawal Bill

0:05:30 > 0:05:35at the amendment state. But the Secretary of State did not keep that

0:05:35 > 0:05:41commitment. Please now tell us all why.The answer is very simple, we

0:05:41 > 0:05:46could not meet the timescale that we have aspired to. I take

0:05:46 > 0:05:49responsibility for that, I gave a commitment at the dispatch box, we

0:05:49 > 0:05:54will bring forward amendments at the book will report stage, but we could

0:05:54 > 0:05:57not reach agreement with the Scottish Government Welsh

0:05:57 > 0:06:03Government, on these important amendments within the timescale.

0:06:03 > 0:06:06Very significant work is currently ongoing in that regard. The

0:06:06 > 0:06:11commitment to amend the Bill is unchanged but it will be an

0:06:11 > 0:06:15amendment that can command the support of the Scottish Parliament,

0:06:15 > 0:06:19not a gimmick amendment.That lack of planning is extremely

0:06:19 > 0:06:26disappointing. Because in failing to keep his commitment for the

0:06:26 > 0:06:29Secretary of State has now single-handedly put the future of

0:06:29 > 0:06:34the devolution settlement in the hands of the other place. Given his

0:06:34 > 0:06:39lack of judgment in his previous commitments, how confident is the

0:06:39 > 0:06:42Secretary of State that an amendment will come back to this place, that

0:06:42 > 0:06:50all parties will find acceptable?Mr Speaker, I know that the honourable

0:06:50 > 0:06:55lady is relatively new to this House but she will now that this amendment

0:06:55 > 0:06:59will be capable of being discussed in this chamber and that it will

0:06:59 > 0:07:00always telling

0:07:01 > 0:07:12by the Scottish Government where Weise seeks -- we seek the

0:07:12 > 0:07:15legislative consent. It has been all over the place in the EU, I don't

0:07:15 > 0:07:18know how they will vote when it comes to the Scottish parliament but

0:07:18 > 0:07:23I hope that it will be a guess. -- a.

0:07:26 > 0:07:38Mr Speaker, with permission and later answer questions two, five,

0:07:58 > 0:08:03failed in his promise to amend clause 11 in this House, to avoid

0:08:03 > 0:08:07undermining the principle of devolution to Scotland and Wales. As

0:08:07 > 0:08:12not to Scotland governing party but all Scottish MPs will be excluded

0:08:12 > 0:08:15from the next stage of the debate, can he tell us now what proposals

0:08:15 > 0:08:23will be brought forward in the Lords?Mr Speaker, I very much

0:08:23 > 0:08:27echoes the remarks that Michael Russell made yesterday in the debate

0:08:27 > 0:08:31in Holyrood, the Scottish Government is aiming to reach an agreement on

0:08:31 > 0:08:34amendments to the Bill would beat UK Government that would allow

0:08:34 > 0:08:36legislative consent to join telling

0:08:40 > 0:08:45The Welsh Assembly has not given a running commentary on those

0:08:45 > 0:08:55negotiations and I don't intend to do so either.Holyrood's financial

0:08:55 > 0:08:58Constitution stated that clause 11 as Khaled

0:09:02 > 0:09:09-- as currently drafted is incompatible, does he agree?I agree

0:09:09 > 0:09:13and my commitment remains that I will amend the Bill to meet the

0:09:13 > 0:09:17concerns of the committee, set out in the report, and the majority of

0:09:17 > 0:09:22members of the Scottish Parliament can vote for a legislative motion in

0:09:22 > 0:09:27respect of the Bill.The reality that the Secretary of State with

0:09:27 > 0:09:32glee this morning when the secretary step made a promise he couldn't

0:09:32 > 0:09:36keep. Isn't the reality that all the talk on the Tories about giving back

0:09:36 > 0:09:43to the Scotland is just a power grab?Mr Speaker, the pantomime

0:09:43 > 0:09:54season is over. But the honourable gentleman's theatrical time strikes

0:09:54 > 0:10:00a discordant note with the tone that Michael Russell, the Minister in the

0:10:00 > 0:10:04Scottish Government responsible for these matters, said yesterday. There

0:10:04 > 0:10:08was no suggestion of a power grab, there was a suggestion that both

0:10:08 > 0:10:11governments are engaged in intensive negotiations to agree an amendment

0:10:11 > 0:10:18to the clause.I want to state that I appreciate the Minister's honestly

0:10:18 > 0:10:21saying he ran out of time to get the amendments there but unfortunately

0:10:21 > 0:10:28that's not good enough. I'd like the Minister to justify how it can be OK

0:10:28 > 0:10:33that Michelle moan and hours ago will have more of an impact on this

0:10:33 > 0:10:37Bill than the members some of what on his own side -- Michelle and Alan

0:10:37 > 0:10:45Sugar.Everything I say and read in Scotland, the honourable lady has a

0:10:45 > 0:10:47considerable impact on events in Scotland and I'm sure that her views

0:10:47 > 0:10:56on this Bill will be well recorded. The Bill will be debated, it in the

0:10:56 > 0:11:04House of Lords, I regret it's in the House of Lords being brought forward

0:11:04 > 0:11:08but we didn't meet this timescale we have aspired to, there'll be another

0:11:08 > 0:11:11opportunity to debate that the moment in this House, and the

0:11:11 > 0:11:14Scottish parliament which is what the members opposite say all the

0:11:14 > 0:11:19time they are concerned about, they will have extensive debate and vote

0:11:19 > 0:11:25on that clause.Will his colleagues in the House of lords make the

0:11:25 > 0:11:29changes he promised us, he would make to the Brexit Bill, and will he

0:11:29 > 0:11:32sit down with the Scottish Government thereafter to discuss

0:11:32 > 0:11:38what further powers need to be devolved?

0:11:38 > 0:11:44I am intending to sit down with the scarf -- Scottish Government next

0:11:44 > 0:11:49week to discuss clause 11 in relation to further devolution, the

0:11:49 > 0:11:56Smiths... This government does not support changes to the devolution

0:11:56 > 0:12:03arrangements as agreed in the Smith commission.The secretary has failed

0:12:03 > 0:12:08to answer for his failed promise for close 11 to this House and his Tory

0:12:08 > 0:12:18colleagues in Scotland. That means that 26 bishops have more say over

0:12:18 > 0:12:25the state of Scotland than their own MPs. Will he apologise for that sad

0:12:25 > 0:12:30state of affairs?I am sure his views and mine are probably closer

0:12:30 > 0:12:38than he would anticipate. But I have taken full responsibility for not

0:12:38 > 0:12:42meeting the timescale originally set out. We are committed to amend the

0:12:42 > 0:12:47bill and amend the bill in agreement with the Scottish Government and the

0:12:47 > 0:12:50Welsh assembly government. I would have thought that that is something

0:12:50 > 0:12:57that even members of the cert would recognise.In a rear lucid moment,

0:12:57 > 0:13:03the government made a clear commitment with regards to close 11.

0:13:03 > 0:13:12As a conservative member I do not want to get a point where I cannot

0:13:12 > 0:13:17take... Will he apologise to the colleagues, this House and the

0:13:17 > 0:13:22people of Scotland for letting is all down?Mr Speaker, the honourable

0:13:22 > 0:13:29gentleman seeks to conflate two issues. The commitment to amend the

0:13:29 > 0:13:33bill remains unchanged. The bill will be amended in agreement with

0:13:33 > 0:13:37the Scottish Government and the Welsh assembly government. That we

0:13:37 > 0:13:42fail to meet the timescale that I had aspired to, I take full

0:13:42 > 0:13:49responsibility for that.Resistance to further devolution of powers

0:13:49 > 0:13:52comes from many quarters such as the constitutional research Council led

0:13:52 > 0:13:59by the Secretary of State's friend, at prominent Scottish Tory, who

0:13:59 > 0:14:06funded the UUP's hard Brexit in the campaign. It is time for full

0:14:06 > 0:14:12disclosure of those funds. If he does not, it undermines the

0:14:12 > 0:14:17principles of democracy that he says he stands for.Matters and entirely

0:14:17 > 0:14:23separate issue. As you recognise, Mr Speaker, there are a range of

0:14:23 > 0:14:28procedures in place for people who have issues and concerns about

0:14:28 > 0:14:32funding of political activity.Will he confirm when the United Kingdom

0:14:32 > 0:14:38leaves the European Union, the fact -- flag of this nation will remain

0:14:38 > 0:14:52the union flag.As my honourable friend knows, in September 2014, the

0:14:52 > 0:15:01people of Scotland voted overwhelmingly to remain in the UK.

0:15:01 > 0:15:06The United kingdom flag is the flag of the entire United Kingdom. When

0:15:06 > 0:15:10educational standards are falling and police Scotland is in chaos, the

0:15:10 > 0:15:18priority of the First Minister of Scotland is flags.The Secretary of

0:15:18 > 0:15:22State talks a good game but delivery does not appear to be her strong

0:15:22 > 0:15:28point. Speaking of old acquaintance, it turns out as key adviser tasked

0:15:28 > 0:15:31with increasing awareness of devolution across government is no

0:15:31 > 0:15:38other than the chief executive of Correlli on. Given the shambolic

0:15:38 > 0:15:46handling of clause 11 last week, how does he think it is going?First of

0:16:25 > 0:16:33investigation into Carillion and any such enquiries are complete.I wish

0:16:33 > 0:16:46you a happy Burns season. Can we now believe another word he says in this

0:16:46 > 0:16:54House?Mr Speaker, I know that the honourable gentleman does not have

0:16:54 > 0:16:58necessarily the best of relations with some people in the Scottish

0:16:58 > 0:17:02Government, but perhaps he could have a word with them about the

0:17:02 > 0:17:06publication of the frameworks. I am keen that we do publish what has

0:17:06 > 0:17:11been agreed in relation to frameworks, but the current position

0:17:11 > 0:17:15of the Scottish Government is that that should not be published.He is

0:17:15 > 0:17:18personally responsible for a breakdown between the relationship

0:17:18 > 0:17:23between this House and the Scottish Government, and all members of the

0:17:23 > 0:17:27size. The bags at secretary has suggested that he is the blockage to

0:17:27 > 0:17:38progress. -- Brexit secretary. Is he now at about about thinking of its

0:17:38 > 0:17:44own position?Mr Speaker, again, the honourable gentleman strikes a

0:17:44 > 0:17:52completely different tone from my -- Mike Russell, who has pursued a

0:17:52 > 0:17:56professional approach to these matters. They are complicated and

0:17:56 > 0:18:02difficult matters. It is important that they are thoroughly debated,

0:18:02 > 0:18:05discussed and agreed. The reason that the government did not bring

0:18:05 > 0:18:09forward an amendment at that stage was there was not an agreed

0:18:09 > 0:18:12amendment with the Scottish Government. But we are committed to

0:18:12 > 0:18:20delivering that. Today's figures from the Scottish Government again

0:18:20 > 0:18:24show that Scotland's trade with the rest of the UK is worth nearly four

0:18:24 > 0:18:29times than with the EU. We know that more than half a million Scottish

0:18:29 > 0:18:33jobs depend on the vital UK internal market and that people in Scotland

0:18:33 > 0:18:39want a UK wide approach to trade. As the UK prepares to leave the EU, it

0:18:39 > 0:18:44is essential that we ensure that the important UK internal market can

0:18:44 > 0:18:51continue unimpeded.My right honourable friend may be aware that

0:18:51 > 0:18:54the First Minister of Scotland recently said independence must be

0:18:54 > 0:19:00an option. Highlighting once again some people's interest in

0:19:00 > 0:19:04separation, not governing. Does he agree separating on the table will

0:19:04 > 0:19:12allow over opportunities to disappear for Scotland and the UK?I

0:19:12 > 0:19:18agree with my honourable friend. It has become absolutely clear that

0:19:18 > 0:19:22when Nicola Sturgeon and the SNP are asked what do they want from Brexit,

0:19:22 > 0:19:30the answer is another independence referendum.Brexit poses the biggest

0:19:30 > 0:19:36risk to Scotland's a condiment. Does the Secretary of State believe that

0:19:36 > 0:19:41the reports that are available in this place should also be made

0:19:41 > 0:19:45available to MSP 's?I had understood that they had been made

0:19:45 > 0:19:52available to MSP 's. If that is not the case, I will ensure that it is.

0:19:52 > 0:19:56Moray Council discussed the project is to be included in the growth

0:19:56 > 0:20:01deal. The Secretary of State knows my support for this made. Will he

0:20:01 > 0:20:07join me to meet the people involved in this deal to show the

0:20:07 > 0:20:11government's commitment to making sure these projects are delivered.

0:20:11 > 0:20:15These city deals and growth deals across Scotland are important to the

0:20:15 > 0:20:20economy as we prepare to leave the EU. I am excited about the proposals

0:20:20 > 0:20:23being brought forward by stakeholders and Moray, I would be

0:20:23 > 0:20:29delighted to visit with my honourable friend.Does the

0:20:29 > 0:20:32Secretary of State for Scotland agree with me that today's export

0:20:32 > 0:20:38statistics show the importance to Scotland remaining within the EU and

0:20:38 > 0:20:43the UK, despite the SNP pours Mac latest attempt to break that link by

0:20:43 > 0:20:50breaking down -- taking down the flag.She would expect me to agree

0:20:50 > 0:20:56with part of what she has said. Of course, as the people of Scotland

0:20:56 > 0:21:00voted, Scotland must remain in the UK and benefit from the UK internal

0:21:00 > 0:21:04market. But the people of the United Kingdom have voted to leave the EU

0:21:04 > 0:21:12and we are leaving the EU.Thanks to the investment that we have all made

0:21:12 > 0:21:17in the future of renewables and the government policy framework,

0:21:17 > 0:21:22Scotland's renewable energy is thriving. A quarter of the capacity

0:21:22 > 0:21:26is placed in Scotland because of the geography and climate there. That

0:21:26 > 0:21:29capacity has more than doubled since the Conservatives led government

0:21:29 > 0:21:34came into power in 2010. We will be going further into bringing forward

0:21:34 > 0:21:42energy from remote offshore wind projects in the next...That is not

0:21:42 > 0:21:49what Scottish renewables would say. Growth against, in all other

0:21:49 > 0:21:54technologies is stagnant. What funding will be available to

0:21:54 > 0:21:58Scotland under the strategy, and will she assess the impact it will

0:21:58 > 0:22:06have in Scotland?We will be making almost £560 million available up to

0:22:06 > 0:22:112025 to support all forms of renewable energy. As we have set

0:22:11 > 0:22:16out, we will be enabling offshore wind projects, to be bidding into

0:22:16 > 0:22:21that next option. We want to keep this going, Scotland is doing

0:22:21 > 0:22:25incredibly well. Last year renewable energy across the UK contributed to

0:22:25 > 0:22:34a third of our energy. I spoke to the Scottish Government for the

0:22:34 > 0:22:42economy jobs last week and will meet shortly to discuss a joint approach,

0:22:42 > 0:22:46including how we can deliver my honourable friend in sterling on

0:22:46 > 0:22:53their deal.I thank the Secretary of State for that answer. Will he

0:22:53 > 0:22:57confirm to the House now that the UK Government is committing new money

0:22:57 > 0:23:04to the deal, not rebranding existing money. When he next meets with the

0:23:04 > 0:23:08Scottish Government, will he secured a commitment from the Scottish

0:23:08 > 0:23:12Government that they will put new money into the deal and not re-patch

0:23:12 > 0:23:18existing funding?The UK Government will definitely be putting new money

0:23:18 > 0:23:21into the sterling and Clackmannanshire deal. That has been

0:23:21 > 0:23:25approach to these deals and that is why they have such a transporter to

0:23:25 > 0:23:31have effect. I will speak to Keith Brown on the issue that he raises,

0:23:31 > 0:23:37but I know he takes a particular issue in that deal.All the city

0:23:37 > 0:23:42region cash that has gone to Inverness is most welcome to

0:23:42 > 0:23:47resonance of Inverness. But other communities struggle to see the

0:23:47 > 0:23:52benefit it is supposed to be a city region deal. Could he look into why

0:23:52 > 0:24:00this is not working into the way it should?Mr Speaker, I will, of

0:24:00 > 0:24:07course, look into the point that the honourable gentleman races. The same

0:24:07 > 0:24:13point was raised with me when I was in sky. Can I be but the fake news

0:24:13 > 0:24:18that sky is real and not open for business to two lists. It is open

0:24:18 > 0:24:24for business and it is a great destination.It is always a pleasure

0:24:24 > 0:24:30to speak to Scottish businesses. We have had over 100 conversations in

0:24:30 > 0:24:35my department. I am looking forward to meeting many more businesses on

0:24:35 > 0:24:41Friday when I travel to Aberdeen, including a visit to the oil and

0:24:41 > 0:24:52energy sector.I am grateful for the minister for that answer. I am aware

0:24:52 > 0:24:56that Scotland produces some of the UK's best-known products including

0:24:56 > 0:25:02Scotch whiskey. What steps is being taken to ensure these new

0:25:02 > 0:25:06opportunities as we leave the European Union are taken to the

0:25:06 > 0:25:11benefit of the whole United Kingdom economy?I have told that Corby is a

0:25:11 > 0:25:20great place. Whiskey, as we know it is one of the UK's greatest exports,

0:25:20 > 0:25:26employing 40,000 people, experts over £40 billion. This business

0:25:26 > 0:25:35stands to benefit from the post Brexit trade of.Order! It is

0:25:35 > 0:25:39discourteous, the Minister is giving us a detailed answer that the House

0:25:39 > 0:25:45should here.I am sure whiskey drinkers everywhere will be grateful

0:25:45 > 0:25:49for that intervention. It sets out opportunities with other industries

0:25:49 > 0:25:54across the UK to improve their experts and create high-value jobs.

0:25:54 > 0:25:57We're working very closely with the Scottish Government to implement the

0:25:57 > 0:26:13strategy.To mitigate against the...

0:26:13 > 0:26:18To mitigate against extreme hard Tory Brexit and create more job

0:26:18 > 0:26:23opportunities in Scotland, will he admit to speaking to onshore wind

0:26:23 > 0:26:31developers and allow them to bed for offshore options?We are keen to

0:26:31 > 0:26:35bring forward renewable technology at the right price for British bill

0:26:35 > 0:26:40payers and key consumers across the UK. We will continue to offer

0:26:40 > 0:26:44opportunities for all sorts of businesses to get involved in our

0:26:44 > 0:26:52options going forward.Mr Speaker, the UK's Scottish and Welsh

0:26:52 > 0:26:56governments agreed the principles that will guide how we approach

0:26:56 > 0:27:01common frameworks in future and the GMC N on 16th October. These

0:27:01 > 0:27:08principles have facilitated constructive discussion and we

0:27:08 > 0:27:15expect to make progress.During those discussions, has he received

0:27:15 > 0:27:22any indication how they will use the new powers they will be receiving?

0:27:22 > 0:27:28In response to a previous question, we have heard nothing from the SNP

0:27:28 > 0:27:33Scottish Government about how they intend to use the new powers that

0:27:33 > 0:27:37will be available after we leave the EU. Let's have a debate about using
