:01:05. > :01:10.Last New Year's Day at his home in County Durham, Michael Atherton
:01:10. > :01:13.gunned down three members of his own family and then killed himself.
:01:13. > :01:16.Tonight we can reveal the findings of an official report which sets
:01:16. > :01:18.out how a trail of blunders and failings by Durham police left
:01:18. > :01:28.Michael Atherton, a man with a history of domestic violence and
:01:28. > :01:37.
:01:37. > :01:41.I've had to identify bodies, had to about head stones for three family
:01:41. > :01:48.Bobby Turnbull lost his aunt, Susan McGoldrick, his sister Tanya and
:01:48. > :01:54.his mum Alison. I know me mam would have wanted us to be strong and try
:01:54. > :01:57.not and let it ruin me life. Bobby's convinced the police should
:01:57. > :02:04.never have granted Atherton a gun licence, and he's focusing all his
:02:04. > :02:06.efforts into a campaign to tighten up the guns laws. I want to succeed
:02:06. > :02:14.in that and hopefully change...something to the gun laws,
:02:14. > :02:17.so no-one else has to do some of As most of us were still
:02:17. > :02:22.celebrating the New Year, the three women were facing an enraged
:02:22. > :02:31.Michael Atherton. Some saw him as a quiet taxi driver who just flipped,
:02:31. > :02:34.but his family knew differently. If me mam said one word that he
:02:34. > :02:41.disagreed with, he'd just bray her, and then the police come out and he
:02:41. > :02:44.got locked up for a night. If he had too much to drink and he
:02:44. > :02:46.whacked her one, he'd just get locked up for one night, and then
:02:46. > :02:49.me mam didn't press charges and he come back home.
:02:49. > :02:52.Before Atherton applied for a licence to own guns, officers were
:02:52. > :02:57.called to his house four times after violent rows with his partner,
:02:57. > :03:00.Susan McGoldrick. He was arrested three times, on one occasion
:03:00. > :03:07.cautioned after admitting dragging her out of bed by the hair and
:03:07. > :03:12.So you'd think a record like that would rule Atherton out of ever
:03:12. > :03:14.owning a gun. Well, we've obtained this, a copy of the official report
:03:14. > :03:22.from the police watchdog into exactly what went on in Durham's
:03:22. > :03:25.gun licensing department. It makes uncomfortable reading. After
:03:25. > :03:28.Atherton was visited at home to be assessed on his application to own
:03:28. > :03:33.a shotgun, his file was passed to an official, described in the
:03:33. > :03:35.report as Person E, who applied a sticky note which read.
:03:35. > :03:43."Four domestics, last one 24/04/04, Would like to refuse, have we
:03:43. > :03:46.sufficient info, refuse re public safety." But that rather haphazard
:03:46. > :03:53.recommendation was overruled by two more senior people within the
:03:53. > :03:55.firearms department, described only as Persons F and G. Their reasons?
:03:55. > :04:00.They accepted Atherton's assurances that he'd given up drinking, and
:04:00. > :04:04.they were afraid they would lose if it went to appeal. Michael Atherton
:04:04. > :04:06.was issued with a shotgun licence and a warning letter that if he
:04:06. > :04:15.behaved in an irresponsible or uncontrolled way, the licence would
:04:15. > :04:20.Bobby believes Durham police are out of step with other forces where
:04:20. > :04:23.a history of domestic violence rules out gun ownership. His
:04:23. > :04:28.petition is calling for a tightening up on the way gun laws
:04:28. > :04:32.are applied across the country. I've got loads of support, people
:04:32. > :04:34.left right and centre asking for petitions to take them to work, to
:04:34. > :04:41.hand them on to friends for them to take them to work. People backing
:04:41. > :04:46.Our copy of the Independent Police Complaints Commission investigation
:04:46. > :04:48.highlights many of the family's concerns. It sets out how Atherton
:04:48. > :04:54.applied for firearms licence to own rifles and the automatic shotgun
:04:54. > :04:57.with which he killed the three women. Despite noting that Atherton
:04:57. > :05:00.had been arrested just a month earlier for affray, breaking the
:05:00. > :05:03.terms of the warning letter given to him earlier, a force employee
:05:03. > :05:11.identified only as Person H grants the licence for the more dangerous
:05:11. > :05:14.And the reason? Well, there is no record kept by the police, but
:05:14. > :05:20.Person H told the watchdog they'd been assured Atherton was unlucky
:05:20. > :05:27.to be arrested for the affray. So he walked away with a licence
:05:27. > :05:33.With the petition gaining support locally, Bobby wants it to go
:05:33. > :05:37.national. He's going to London for The burden of his grief and running
:05:37. > :05:41.the campaign is starting to take hold. I don't sleep very well, it's
:05:41. > :05:44.a lot of stress. I couldn't tell you how I'm dealing with it. The
:05:44. > :05:46.campaign helps us a lot. He is meeting the Gun Control
:05:46. > :05:51.Network, which successfully campaigned for handguns to be
:05:51. > :05:54.banned after the Dunblane massacre. We've also been working for a while
:05:54. > :06:04.on firearms licensing, because like you, we've been very concerned that
:06:04. > :06:13.it's very slack and often very cosy. That's what my campaign petition is
:06:13. > :06:19.We will help him contact politicians, we will help him to
:06:19. > :06:23.understand the process whereby laws are changed.
:06:23. > :06:30.After today, it makes us feels like it's going to be so much easier to
:06:30. > :06:34.By 2008, Atherton had built a collection of six fully licensed
:06:34. > :06:40.guns. And as the watchdog report sets out, there was one last chance
:06:40. > :06:45.for the police to intervene before Shortly before midnight on
:06:46. > :06:48.September 10th, armed police raced to Atherton's home after a 999 call.
:06:48. > :06:54.There'd been a disturbance, and Atherton, who was blind drunk, was
:06:54. > :06:58.threatening to, in the words of his partner, shoot his head off.
:06:58. > :07:02.He had too much to drink, and he said he was going to go upstairs
:07:02. > :07:06.and shoot himself. We phoned the police and the police came, and
:07:06. > :07:10.there was loads of riot vans. He had his guns took off him for about
:07:10. > :07:12.six weeks. Despite breaking the terms of his
:07:12. > :07:14.two warning letters, despite being involved in another drunken
:07:14. > :07:22.domestic dispute, and despite threatening to shoot himself,
:07:22. > :07:26.Atherton had his six guns returned. I do feel quite angry, because it's
:07:26. > :07:29.like common sense. If I was a policewoman, I know I'm not
:07:29. > :07:33.Einstein or anything, if a man tried to commit suicide, or
:07:33. > :07:42.pretended to, why would you give a man a gun back like that with a
:07:42. > :07:45.Once again, the police failed to record the reason for the decision.
:07:45. > :07:49.The report says, "Person H could not recall how they reached the
:07:49. > :07:54.recommendation to return his guns." Nor could Person H recall whether a
:07:54. > :08:03.final verbal warning was delivered to Atherton, as agreed. Whatever
:08:03. > :08:08.the reason, returning the guns Tanya was in the living room with
:08:08. > :08:11.Aunty Ali's friend, Aunty Ali was in the bathroom. And a couple of
:08:11. > :08:17.seconds later Big Mick came in plain a day with a gun held up,
:08:17. > :08:21.like pointing it at me mam, and then he shot me mam.
:08:21. > :08:24.I walked into the house and I just... I thought they were playing
:08:24. > :08:34.a trick on us. I thought it was a Hallowe'en trick or something when
:08:34. > :08:40.I walked into the house. It was I just cannot really put it into
:08:41. > :08:50.words what I saw. Well, Ali was still alive when I got there. I put
:08:50. > :08:57.her in the recovery position. I I was screaming out the door for
:08:57. > :09:01.somebody to help us but nobody came I was just pleading with them to
:09:01. > :09:07.let us in, I was like "Looker, it's me mam, if she's dying, I want to
:09:07. > :09:13.be with her." And one of the police just said, "Looker, son, there's
:09:13. > :09:23.four people in there and none of them's alive." I just cannot
:09:23. > :09:26.
:09:26. > :09:29.describe it, the way I felt, it's Susan was a much loved sister who
:09:29. > :09:33.was adored by family and friends... Bobby has been invited to speak at
:09:33. > :09:36.the annual victims of homicide conference in South Shields. Alison
:09:36. > :09:40.was a fantastic mother, sister and partner who was always there when
:09:40. > :09:44.we needed her. She was a fantastic mother to
:09:44. > :09:49.myself. Tanya was the most amazing daughter, partner and sister you
:09:49. > :09:53.could ever wish for. It's an emotional day and a chance to share
:09:53. > :09:59.experiences of similar tragedies. Andrew Foster's brother Christopher
:09:59. > :10:02.shot his wife and daughter in Shropshire. My brother made threats
:10:02. > :10:05.to kill, his weapons weren't taken away, he threatened to commit
:10:05. > :10:09.suicide also. I think we've got a lot in common. There are similar
:10:09. > :10:12.issues between both the cases, and I think we can work together to try
:10:12. > :10:17.to resolve and raise the issues that need to be worked upon at
:10:17. > :10:20.government level, really. And thanks to Bobby, that process
:10:20. > :10:23.is under way. A public debate on firearms
:10:23. > :10:27.licensing is still needed, and I believe, Mr Speaker, the time I
:10:27. > :10:36.right for the public and Parliament to consider if the current level of
:10:36. > :10:40.protections are adequate. Bobby has the support of his local MP, and it
:10:40. > :10:42.appears as if Government is already taking notice. The guidance to the
:10:42. > :10:44.police on firearms legislation is currently being revised and updated
:10:44. > :10:51.to help ensure licensing procedures are applied consistently across
:10:51. > :10:56.forces. In particular, we'll be highlighting the need to take full
:10:56. > :11:00.account of any incidences of domestic violence.
:11:00. > :11:03.So what are the conclusions of this official report? Well, time and
:11:03. > :11:09.time again the police are criticised for poor practice in not
:11:09. > :11:11.finding out more about Atherton's domestic disputes. It says there
:11:11. > :11:16.was no meaningful review after his guns were removed after he
:11:16. > :11:21.threatened to kill himself. It points out that the staff in the
:11:21. > :11:23.firearms licensing unit had little or no formal training. Senior
:11:23. > :11:26.officers' failure to follow up on concerns about Atherton's emotional
:11:26. > :11:34.state is described as unacceptable, and the lack of consideration to
:11:34. > :11:39.the welfare of the family and wider Contained within Mr Atherton's
:11:39. > :11:43.shotgun file is a handwritten Post- it note... What sort of way is that
:11:43. > :11:47.to pass on information? If you've lost people who are the
:11:47. > :11:50.closest to you in the world, you are going to feel anger. The police
:11:50. > :11:53.have had a number of opportunities to refuse the licence in the first
:11:53. > :12:00.place and also revoke the licence, a number of times which they
:12:00. > :12:02.haven't. I think people should be named in
:12:02. > :12:10.it, because it's...it's like they're trying to hide from the
:12:10. > :12:14.responsibility of the mistakes that So will anyone be held accountable?
:12:14. > :12:18.We asked Durham police for an interview. They declined but told
:12:18. > :12:20.us... We've been informed by the IPCC that it is their
:12:20. > :12:26.recommendation that there are no criminal or misconduct cases to
:12:26. > :12:29.answer. We feel that at this stage it is entirely appropriate that
:12:29. > :12:35.members of staff who made decisions within relevant guidance are not
:12:35. > :12:40.identified. We have carried out a full review of policy and
:12:40. > :12:43.procedures. It's a matter that's high on the
:12:43. > :12:46.agenda for Durham's newly-elected police commissioner. We need
:12:46. > :12:50.greater consistency if we are going to protect individuals in our
:12:50. > :12:53.community. The family's campaign is entirely honourable. I think that,
:12:53. > :12:56.given the tragedy that they have had to face, they've come through
:12:56. > :12:58.this with remarkable dignity, and they are quite clearly wanting to
:12:58. > :13:08.ensure this doesn't happen again anywhere else to any other family,
:13:08. > :13:11.and I totally support the type of Everything the report points out,
:13:11. > :13:19.it points out something what's also in the campaign, in the wording of
:13:19. > :13:29.If them people did their jobs correctly in the first place, like
:13:29. > :13:32.
:13:32. > :13:37.them lives would never have been Where is the Yorkshire Dales
:13:37. > :13:41.National Park? A silly question? Well, actually, no. Plans are afoot
:13:41. > :13:44.to move the boundaries and extend the park into Cumbria. Keeley
:13:44. > :13:51.Donovan has been finding out what that means to the people who live
:13:51. > :13:54.Welcome to Skipton, this is the heart of Yorkshire. Now, this town
:13:54. > :14:02.has always been known as the gateway to the Dales, but pretty
:14:02. > :14:09.soon things around here could be The Yorkshire Dales are a national
:14:09. > :14:12.treasure. They don't do sudden changes round here. But the Dales
:14:12. > :14:15.national park could expand out of Yorkshire to the north west into
:14:15. > :14:17.the area round the village of Crosby Ravensworth. Does anyone in
:14:17. > :14:25.Skipton know anything about it? Have you heard of Crosby
:14:25. > :14:28.Ravensworth? No. Is that a glass place. How do you feel about
:14:28. > :14:31.somewhere that is not in Yorkshire being part of the Dales National
:14:31. > :14:33.Park? Ever since the Dales National Park
:14:33. > :14:41.was established nearly sixty years ago, Yorkshire has always been at
:14:41. > :14:49.the centre of its identity. So where is Crosby Ravensworth? And
:14:49. > :14:51.why is the Dales set to expand there? The train now approaching...
:14:51. > :14:55.The Settle to Carlisle railway passes through the heart of the
:14:55. > :14:59.Dales and takes us to where the newest part of the national park
:14:59. > :15:02.would be. More than eight million visitors a year come to the
:15:02. > :15:06.Yorkshire Dales National Park - an area of outstanding beauty bounded
:15:06. > :15:10.by the M6 on one side, and the A1 on the other. My route takes me
:15:10. > :15:13.north to Kirkby Stephen. It's here that there'll be the biggest
:15:13. > :15:23.proposed expansion of the Dales in an area between Kirkby Stephen and
:15:23. > :15:28.
:15:28. > :15:38.the M6. Isn't London landed near. The under imminent intention it is
:15:38. > :15:48.
:15:48. > :15:53.there is for this future. -- a fantastic landscape. They're not in
:15:53. > :15:56.Yorkshire, are they? The National Park, 11 per cent of it is in
:15:56. > :15:59.Cumbria. That is not unusual. Most national parks are not in one
:15:59. > :16:01.county. What are the benefits? There are opportunities for
:16:01. > :16:04.business, tourism and farming because it will mean additional
:16:04. > :16:06.resources coming into their area. The proposals have been drawn up by
:16:06. > :16:09.Natural England, the agency advising the Government on
:16:09. > :16:11.protecting the landscape, and it says the changes are aimed at
:16:11. > :16:13.giving greater protection to this stunning countryside. I'm in
:16:13. > :16:23.Smardale, at a nature reserve hidden beneath the Settle Carlisle
:16:23. > :16:27.
:16:27. > :16:30.line. You have this amazing scenery and incredible wildlife. There is
:16:30. > :16:36.really interesting industrial archaeology as well, so lots of
:16:36. > :16:39.different things. It is a fantastically rich in ear. Why it
:16:39. > :16:48.did not get into being a national park in the first place, I am not
:16:48. > :16:51.sure. There is no doubt this area is worth preserving, not everyone
:16:51. > :16:53.agrees and National Park is the way to do it.
:16:53. > :16:56.Nearby other, smaller, changes to park boundaries are also being
:16:56. > :17:00.planned. An area south of Shap would go into the Lake District,
:17:00. > :17:03.and land north of Kirkby Lonsdale would become part of the Dales. Tom
:17:03. > :17:12.Lowther farms on the eastern edge of the Lake District, as well as
:17:12. > :17:16.representing Crosby Ravensworth on the county council. I think there
:17:16. > :17:18.is a coherent case to say we do not need National Park status any more.
:17:18. > :17:21.The landscape has tremendous protection through ministerial and
:17:21. > :17:23.European law. But the changes could bring more visitors into the area,
:17:23. > :17:30.and help tourism. Annie Kindleysides has a holiday home
:17:30. > :17:34.business. Being part of the National Park
:17:34. > :17:36.might raise this profile of the area. We don't have an obvious
:17:36. > :17:39.attrraction other than the countryside itself. We find once we
:17:39. > :17:42.get people here, we get them back. Perhaps the label national park
:17:42. > :17:47.would help. Annie's cousin John has farmed in Crosby Ravensworth all
:17:47. > :17:57.his life. We're not in the Yorkshire dales, we're in Cumbria

:19:29. > :19:37.Cumbria, not Yorkshire. That needs to be taken into account, for the
:19:37. > :19:40.expansion plans to be a success. You've got to be determined to
:19:40. > :19:46.follow your dream when others expect you to fail and you've
:19:46. > :19:49.hardly got the means to put your money where your mouth is. That
:19:49. > :19:53.didn't deter a North Yorkshire couple who decided to take on the
:19:53. > :19:57.racing establishment and have a revolution on the race track.
:19:57. > :19:59.In North Yorkshire many villages echo to the sound of hooves but one
:19:59. > :20:08.trainee racehorse isa maverick and he's turning the locals' heads
:20:08. > :20:12.Everyone loves him. He's a character round the place. A lot of
:20:12. > :20:15.amateur riders want to see him run. What marks Angrove Rum Baba out is
:20:15. > :20:19.his looks where else have you ever seen a racehorse with hotchpotch of
:20:19. > :20:23.colour all over his body? The moment he comes into public view
:20:23. > :20:26.it'll cause a storm. And it's been brewing for quite a few years -
:20:26. > :20:32.because across the county at Great Ayton his owners have been breeding
:20:32. > :20:36.foals with just one aim. I want to see a coloured horse win
:20:36. > :20:43.a race and show everyone what they can do. I really believe in them or

:21:17. > :21:23.him with the right thoroughbred mare and the resulting foal will
:21:23. > :21:26.have a multi-coloured coat and a pedigree that will allow it to race.
:21:26. > :21:29.4 years ago that perfect combination resulted in the birth
:21:29. > :21:35.of Angrove Rum Baba. Rummy looks the part but would he be an athlete
:21:35. > :21:39.like his mum? Just minutes old he struggles to find his legs but
:21:39. > :21:44.Heather dares to believe he could not only race, but win.
:21:44. > :21:48.It would be the first in the world. There hasn't been a coloured horse
:21:48. > :21:51.win a race. The years leading up to this have
:21:51. > :21:57.been cruel she and husband Alistair faced ruin when his business
:21:57. > :22:05.collapsed. We lost our home, car and we had about 2 grand in the
:22:05. > :22:09.bank. We purchased an old schoolroom from the local council.
:22:09. > :22:14.As we had coloured horses people in the area thought we were gypsies.
:22:14. > :22:17.There was a quite a hoo-ha in the village.
:22:17. > :22:23.Fitting in with the neighbours is as nothing to getting coloured
:22:23. > :22:30.horses accepted into mainstream racing. But they're undaunted.
:22:30. > :22:40.Rummy is now almost 2 years old and it's crunch time. He's got to now
:22:40. > :22:41.
:22:41. > :22:50.be sat on, be ridden. Jo will be legged up and lean over the saddle.
:22:50. > :22:54.He has to be ridden. It's vital. Walk on. Walk on.
:22:54. > :23:04.Jo was fantastic. She's such a professional. She's done wonders.

:23:05. > :23:08.I'm so thrilled. He's on track for getting on the race course.
:23:08. > :23:13.Just 6 months later, Rummy is at a professional training stable - that
:23:13. > :23:21.means getting up before dawn. On the gallops he's showing promise,
:23:21. > :23:27.but will he be ready in time? He's been entered for the last race of
:23:27. > :23:31.the season that's just one week away.
:23:31. > :23:35.But owner, trainer and Rummy cannot afford for him to be humiliated on
:23:35. > :23:40.his first outing and at the last minute he's pulled from the race.
:23:40. > :23:48.I was gutted, absolutely gutted. But you have to pick yourself up

:23:51. > :23:54.Keeping racehorses is an expensive business so Rummy has now become an
:23:54. > :24:03.investment there's a syndicate and he seems to know when his Yorkshire
:24:03. > :24:09.backers have come to visit. Hello. Come on. He's gorgeous! I was in
:24:10. > :24:17.hospital and I saw it in the paper. I thought I'll have a go at that.
:24:17. > :24:21.People at work said you've got a gypsy horse. You'd know what one he
:24:21. > :24:24.was with a black and white set. syndicate might be optimistic of a
:24:24. > :24:28.champagne moment but there's been pretty little of that for Heather
:24:28. > :24:32.and Alistair. We went through one winter without any heat at all
:24:32. > :24:35.which was desperate. We had nothing. We had some furniture, put a table
:24:35. > :24:45.in and some grandparents' furniture - even the wonderful four poster
:24:45. > :24:50.
:24:50. > :24:53.bed he was born in. We made holes in the ceiling to accommmodate it.
:24:53. > :24:57.Having since suffered health problems which put paid to her ever
:24:57. > :25:00.riding a horse again, Heather now has her sights set on a much bigger
:25:00. > :25:07.prize. A new trainer has agreed to give Rummy another crack at the
:25:07. > :25:11.racing. I'm happy with the work he's done.
:25:11. > :25:21.He's shown enough ability to be given his chance. He enjoys himself,

:25:29. > :25:38.be a stigma, maybe people feel it's a gimmick. It's a closed book,
