0:01:45 > 0:01:5117 years ago, Kate's parents, Jeremy and Suzanne, spoke of their loss.
0:01:51 > 0:01:54It was a Saturday evening in the run up to Christmas.
0:01:54 > 0:01:57Kate was walking a neighbour's dog a few hundred yards from her Exeter
0:01:57 > 0:01:59home.
0:01:59 > 0:02:06When she didn't return, her family began a search and her
0:02:06 > 0:02:10body was found by her father.
0:02:10 > 0:02:13When, two months ago, Kate Bushell was killed while walking a dog
0:02:13 > 0:02:17near her home in Devon, the story made front`page ndws.
0:02:17 > 0:02:22The killing shocked the nathon, and featured prominently on Crilewatch.
0:02:22 > 0:02:25I can remember driving along and having the windows open,
0:02:25 > 0:02:29just in case we could hear her as we went past.
0:02:29 > 0:02:33If she's not at her friend's, then we'll call the police.
0:02:33 > 0:02:35For some reason, I just began to get this sort of gut
0:02:35 > 0:02:40feeling of panic or dread inside.
0:02:40 > 0:02:42Now we can reveal, in the year following this
0:02:42 > 0:02:46reconstruction of the discovery of Kate's body, key forensic evidence
0:02:46 > 0:02:48in the case was contaminated.
0:02:48 > 0:02:50That resulted in a major police operation being
0:02:50 > 0:02:55wasted, the incrimination of an innocent man, and it casts doubt on
0:02:55 > 0:03:01whether a successful prosecttion can ever be brought against the killer.
0:03:01 > 0:03:03The inquiry, Operation Deakhn, was overseen here
0:03:03 > 0:03:06at police headquarters in Exeter.
0:03:06 > 0:03:09We've spoken to several of the original investigation team.
0:03:09 > 0:03:13They've told us of hopes behng raised for a breakthrough, `nd their
0:03:13 > 0:03:17astonishment and anger when the new lead turned out to be nothing more
0:03:17 > 0:03:22than a basic error in forensics
0:03:22 > 0:03:25In terms of contamination bx fibres, it is a serious blunder,
0:03:25 > 0:03:28without a doubt.
0:03:28 > 0:03:30It was a really basic error.
0:03:30 > 0:03:33It's not something we'd expdct from the Forensic Science Sdrvice or
0:03:33 > 0:03:35our forensic providers.
0:03:35 > 0:03:39The contamination happened during a review of the case.
0:03:39 > 0:03:42At the time of the murder, forensic evidence was taken from Katd's body
0:03:42 > 0:03:47and clothing, and possible suspects ` but led to no breakthroughs.
0:03:47 > 0:03:50The review, though, sent the samples for re`testing `
0:03:50 > 0:03:55and made what appeared to bd a startling discovery.
0:03:55 > 0:03:59Tiny purple fibres were detdcted on the samples taken from K`te,
0:03:59 > 0:04:04and also on clothes taken from a man who lived in the local area.
0:04:04 > 0:04:06A new team of detectives was assembled
0:04:06 > 0:04:08and began investigating him.
0:04:08 > 0:04:11But he had an alibi and had been eliminated
0:04:11 > 0:04:14from the original inquiry.
0:04:14 > 0:04:16After around three months of work, detectives eventually concltded he
0:04:16 > 0:04:18couldn't possibly be the killer
0:04:18 > 0:04:21Other exhibits from the casd were also re`examined, and more purple
0:04:21 > 0:04:27fibres were found there, too.
0:04:27 > 0:04:29The samples were analysed by a government agency,
0:04:29 > 0:04:32the Forensic Science Servicd.
0:04:32 > 0:04:33They checked their work...and
0:04:33 > 0:04:35discovered something shocking.
0:04:35 > 0:04:37There'd been contamination.
0:04:37 > 0:04:41A technician was wearing a top which left the same purple fibres
0:04:41 > 0:04:45on the different sets of exhibits.
0:04:45 > 0:04:48Chris Boarland is a former head of CID at Devon and Cornwall Police.
0:04:48 > 0:04:51He told me it was a dreadful error which would have
0:04:51 > 0:04:54hampered the investigation.
0:04:54 > 0:04:55It doesn't really get more serious.
0:04:55 > 0:05:03As a police service, we havd very, very strict routines in terls
0:05:03 > 0:05:06of recovery of evidence, making sure that it's handldd
0:05:06 > 0:05:10properly and that it eventu`lly gets to the forensic science provider
0:05:10 > 0:05:14in an uncontaminated form.
0:05:14 > 0:05:16Once it's there, I think we have generally relied upon their
0:05:16 > 0:05:22professionalism and their absolutely tip`top procedures for making sure
0:05:22 > 0:05:25that they never get contaminated.
0:05:25 > 0:05:28It's a blow when something like this happens.
0:05:28 > 0:05:31The contamination also casts doubt on whether
0:05:31 > 0:05:35a successful prosecution cotld now be brought against the murddrer
0:05:35 > 0:05:38Barrister David Osborne says the defence in any trial would have to
0:05:38 > 0:05:43be told about it, and could use the error to undermine forensic evidence
0:05:43 > 0:05:47that might be put before a jury
0:05:47 > 0:05:50It would be enormously useftl, if you are looking, as one hs,
0:05:50 > 0:05:57to the acquittal of the man accused of the crime
0:05:57 > 0:06:00I would submit, indeed, I would be surprised, in fact,
0:06:00 > 0:06:03that I would need to submit because I would have thought
0:06:03 > 0:06:07the prosecution would understand that in a case such as this,
0:06:07 > 0:06:13where it is contaminated evhdence, that it would be unfair to proceed.
0:06:13 > 0:06:17That would be my submission to the charge and I would expect
0:06:17 > 0:06:18the judge to agree.
0:06:18 > 0:06:20So an issue like this could be sufficiently
0:06:20 > 0:06:23serious to mean a case could not proceed against the defendant?
0:06:23 > 0:06:28That's correct.
0:06:28 > 0:06:31The defence, quite rightly, would make an issue of this.
0:06:31 > 0:06:33They may be able to discount particular fibres,
0:06:33 > 0:06:36but they are understandably going to call into question
0:06:36 > 0:06:39the whole forensic procedurd, and they would want to cast doubt
0:06:39 > 0:06:42on any other forensic evidence.
0:06:42 > 0:06:46Hopefully, the police and Forensic Scidnce
0:06:46 > 0:06:50Service providers will be in a position to be able to substantiate
0:06:50 > 0:06:54everything else they have got.
0:06:54 > 0:07:01Yes, to some extent, it's m`nner from heaven for any defence.
0:07:01 > 0:07:03Despite extensive search and continuing investigations, Kate s
0:07:03 > 0:07:07murderer has never been caught.
0:07:07 > 0:07:11But the police believe ` evdn with the forensics errors ` a prosecution
0:07:11 > 0:07:19remains possible, as they still have samples which were not cont`minated.
0:07:19 > 0:07:22Clearly, it is an issue we would have to disclose to the defdnce
0:07:22 > 0:07:23for the reasons you have outlined.
0:07:23 > 0:07:26But I maintain that it is not insurmountable.
0:07:26 > 0:07:29It is an issue, we would disclose that to the defence but, actually,
0:07:29 > 0:07:33in terms of our forensic evhdence, contamination has occurred
0:07:33 > 0:07:38but the forensic test that took place before that would be secure.
0:07:38 > 0:07:40It would inevitably damage your case, though?
0:07:40 > 0:07:43It would undermine the case.
0:07:43 > 0:07:46We deal with issues that undermine the case on a daily basis.
0:07:46 > 0:07:50It's something we would disclose to the defence team and,
0:07:50 > 0:07:52as a prosecution team, we would work through it.
0:07:52 > 0:07:54Do you still think you could get a conviction after that?
0:07:54 > 0:07:58There's no reason we couldn't get a conviction but clearly we are long
0:07:58 > 0:08:00way from that at the present time.
0:08:00 > 0:08:03The history of the Forensic Science Service ` which was based in
0:08:03 > 0:08:06Chepstow ` was not a gloriots one.
0:08:06 > 0:10:21It was littered with errors and high profile embarrassmdnts
0:10:21 > 0:10:24But an Inside Out investigation has discovered criminal gangs are using
0:10:24 > 0:10:30specially adapted machines to steal our bank details and then otr cash.

0:11:31 > 0:11:38But a quick look online shows there are many more victims.
0:11:38 > 0:11:41That's the thing with the internet ` there are the good people on there,
0:11:41 > 0:11:46like the innocent victims ` and then there are the bad.
0:11:46 > 0:11:49I'm talking to a man who knows all about stolen pin numbers

0:14:52 > 0:14:55and we're seeing convictions in the Old Bailey in respect of that.
0:14:55 > 0:14:58The industry's existing advhce to consumers is to protect your PIN.
0:14:58 > 0:15:01Well, with something like that there's no point is there?

0:15:07 > 0:15:11everybody when it comes to this type of fraud, which is a very r`re type
0:15:11 > 0:15:14of crime, is that even if you are the victim of it, you'll receive a
0:15:14 > 0:15:18full refund of all of your losses.
