:00:49. > :00:57.weeks earlier, Anni Hindocha had married Shiren Dewani in a

:00:57. > :01:01.fairytale three-day wedding ceremony. She was so beautiful.

:01:01. > :01:05.Anni's honeymoon murder generated interest around the world, and one

:01:05. > :01:12.burning question, did Shrien have her killed? I just got married to

:01:12. > :01:17.the girl of my dreams, why would I want to kill her? Now, said to be a

:01:17. > :01:21.broken man and a suicide risk, the 32-year-old insists he's innocent,

:01:21. > :01:27.he's fighting a British court's decision to extradite him to South

:01:27. > :01:31.Africa. Anni's family demand Shrien must go. If he's innocent, the

:01:31. > :01:38.court will show that, if he's not, then he should pay for what he has

:01:38. > :01:42.done. The South African police and

:01:42. > :01:47.prosecutors have already made up their minds about Shrien's guilt.

:01:47. > :01:51.This is a criminal matter of someone who murdered his wife who

:01:51. > :01:57.should have been celebrating her honeymoon. Have they got it right?

:01:57. > :02:00.Should he ever be extra dietd, it won't just be Shiren Dewani in the

:02:00. > :02:06.dock. South Africa will be on trial. If justice fails, it will give this

:02:06. > :02:12.country a bad impression. For the first time, we are able to

:02:12. > :02:17.piece together key bits of the case using CCTV, never before shown of

:02:17. > :02:22.the couple in their Cape Town hotel. The footage captures the moment

:02:22. > :02:26.Shrien is said to have commissioned Anni's murder. It shows Shrien and

:02:27. > :02:31.Anni just hours before she was killed. And the moment after her

:02:31. > :02:39.death when the Bristol businessman is said to have paid off one of the

:02:39. > :02:42.hit team. Tonight, on Panorama, is Shiren Dewani a man who could have

:02:42. > :02:52.his wife killed, and the new footage, which suggests the case

:02:52. > :03:08.

:03:08. > :03:16.against him may not be as clear cut It was meant to be the beginning of

:03:16. > :03:22.a lifetime together, but it ended barely before it had started. The

:03:22. > :03:28.first day of Shrien and Anni's honeymoon, a luxury Safari lodge in

:03:28. > :03:34.South Africa's Kruger National Park. Flying in overnight from the UK,

:03:34. > :03:39.they had been married for just nine days. She struck me as extremely

:03:39. > :03:44.beautiful woman, I was quite taken aback when I saw her, beautiful

:03:44. > :03:47.long dark hair. He seemed like a very decent young man. They seemed

:03:47. > :03:54.like any other honeymoon couple that came through here, very much

:03:54. > :03:59.in love and enjoying the bush. This is where the Dewanis stayed, our

:03:59. > :04:03.Malacite Suite. What went on in the relationship behind closed doors,

:04:03. > :04:09.only Shiren Dewani really knows, we can't ask him. He's sectioned under

:04:09. > :04:13.the Mental Health Act. But, we can hear Shiren Dewani's

:04:14. > :04:16.actual words, before he was arrested in December 2010, the 32-

:04:16. > :04:21.year-old gave an interview about the events surrounding his wife's

:04:21. > :04:29.death. It was with the Sun Newspaper, and it was recorded.

:04:29. > :04:33.Panorama has obtained a copy. Was Shrien telling the truth? When he

:04:33. > :04:41.spoke just a week after Anni's death, there were already are you

:04:41. > :04:45.mores that Shrien was behind her murder. This is -- are you mores

:04:45. > :04:51.that he was behind -- are you murs that he was behind her death.

:04:51. > :05:00.made some of the guests sick with our hamness. Anni and Shrien were

:05:00. > :05:04.comfortable around each other. They reminded Sharan and I as two good

:05:04. > :05:07.mates. Chloe Speller was staying at Chitwa Chitwa with her good friend,

:05:07. > :05:11.Sharon Aylward. They were not overaffectionate towards each other,

:05:11. > :05:16.we put it down to a cultural difference. Anni, unlike her

:05:16. > :05:26.husband, had never been on Safari before.

:05:26. > :05:32.

:05:32. > :05:37.Shrien says the couple had an amazing time. The Dewanis left

:05:37. > :05:41.their Safari mind after three days, heading towards the next leg of

:05:41. > :05:44.their seemingly idyllic honeymoon. She loved everything about life.

:05:44. > :05:48.She loved going out, she loved being at home, she loved to talk,

:05:48. > :05:54.she loved her friends, she loved her family.

:05:54. > :05:59.Just a fortnight before Anni died, she married Shrien in a spectacular

:05:59. > :06:05.three-day ceremony in Mumbai, India. The wedding cost �150,000. The

:06:05. > :06:09.couple had known each other for a year flaf, and been engaged for --

:06:09. > :06:13.a year-and-a-half, and had been engaged for five months. I was very

:06:13. > :06:19.proud, she was so beautiful. Was it a very happy day for you? It was a

:06:19. > :06:23.most happy day. At their wedding, as they did on the Safari, the

:06:23. > :06:30.couple project add picture of happiness. Yet Anni's family say

:06:30. > :06:33.their relationship was blighted by underlying tensions, there were

:06:33. > :06:40.dozens of text messages, that they have handed to South African police.

:06:40. > :06:44.We heard about one in which she says, "crying is any new hobby",

:06:44. > :06:48.which suggests she was not happy. Is that the impression you got?

:06:48. > :06:54.That particular text message was not sent to myself, it was sent to

:06:54. > :06:58.a friend in India. But it was sent? Yes. Things changed between the

:06:58. > :07:07.engagment and the wedding. They got more problems within the

:07:07. > :07:14.relationship. He was controlling. I think that she didn't really like

:07:14. > :07:19.that. Three weeking before the wedding,

:07:19. > :07:23.it looked to Anni's cousin, as though the relationship was

:07:23. > :07:27.actually over. Anni and Shrien had a fight, and I found out because

:07:27. > :07:32.Anni called me in the middle of the night crying in the phone. She told

:07:33. > :07:37.me she had thrown the ring at Shrien, and she took a cab to

:07:37. > :07:40.another hotel and she stayed there the night. At that point she was

:07:40. > :07:44.going to basically walk out of everything. Anni's older sister

:07:44. > :07:50.convinced her it was just the stress of organising the wedding,

:07:50. > :08:00.persuading her to return to Shrien. I should have listened to her.

:08:00. > :08:01.

:08:01. > :08:07.Because then she may be, maybe this wouldn't have happened.

:08:07. > :08:15.Cape Town, almost a thousand miles away from their Safari lodge at

:08:16. > :08:20.Chitwa Chitwa. Shrien and Anni landed here at 4.00pm, Friday 12th

:08:20. > :08:26.November. 30 hours later Anni would be dead, her body found in the back

:08:27. > :08:30.of an abandoned taxi. Police in South Africa have begun a

:08:30. > :08:35.murder hunt...Her Body abandoned in the back of a taxi, and a manhunt

:08:35. > :08:40.under way to find those responsible. Her 31-year-old husband was

:08:40. > :08:45.unharmed. At first it appeared Anni was yet another victim of South

:08:45. > :08:51.Africa's violent society. But then, an even darker and more

:08:51. > :08:57.extraordinary twist, a taxi driver Shrien hired, told police that

:08:57. > :09:01.within an hour of meeting the businessman, he had been contracted

:09:02. > :09:07.to complete Anni's execution. The taxi driver was offered a reduced

:09:07. > :09:13.sentence if he offered to testify against Shrien Dewani.

:09:13. > :09:19.The South African police chief was confident, Shrien, who he

:09:19. > :09:23.reportedly dubbed, "a murdering monkey", was there man". I'm not a

:09:23. > :09:30.legal expert what to charge a person for, what we know he did par

:09:30. > :09:36.take in the killing of the wife. I travelled to South Africa to test

:09:36. > :09:44.that confidence. In the late 1990, I was based here

:09:44. > :09:49.as a BBC foreign correspondent. The couple, like me, would need a taxi

:09:50. > :09:55.to travel to their hotel, the five- star Cape Grace. But unlike the

:09:55. > :10:01.Dewanis, they didn't choose the hotel's pricey but plush service,

:10:01. > :10:08.or even the airport's cheaper official taxies, Shrien opted for

:10:09. > :10:13.an illegal taxi tout he had never met before. Zola Robert Tongo. 30

:10:13. > :10:20.at the time, an unmarried father of five, and by all accounts, a hard

:10:20. > :10:26.working taxi driver, with no police record. He spoke in English, he

:10:26. > :10:30.seemed trustworthy, the car seemed secure. We have used this actor to

:10:30. > :10:38.read extracts from Tongo's evidence statement to the South African High

:10:38. > :10:41.Court. I am in formal employment, I also freelance as a shuttle

:10:41. > :10:45.operator from the Cape Town International Airport. Tongo's

:10:45. > :10:49.freelancing was news to his boss, who had no idea his model employee

:10:49. > :10:54.was moonlighting. When I bought the business, the current owner said to

:10:54. > :10:59.me that out of all of the drivers, Robert is the most trustworthy. I

:10:59. > :11:07.believed him. During the time that he worked for me, there was also no

:11:07. > :11:12.reason for me to believe otherwise. On the 20 or so minute journey to

:11:12. > :11:15.the Cape Grace, Shrien said the couple got on well with Tongo.

:11:15. > :11:22.showed us around the sites that were there to see between the

:11:22. > :11:28.airport and the hotel. We became quite jokey with him. If you have

:11:28. > :11:33.ever met Zola, he's a very, very nice guy, he has a very open,

:11:33. > :11:42.friendly, easy going personality. It wouldn't surprise me if he made

:11:42. > :11:48.a good impression. Welcome to the Cape Grace Hotel, please enjoy your

:11:53. > :12:00.The Cape Grace, sitting right in the heart of Cape Town's water

:12:00. > :12:05.front, the hotel boasts fabulous views of the iconic Table Mountain.

:12:05. > :12:11.With rooms starting at around �300 a night, it is one of the most

:12:11. > :12:15.expensive hotels in the city. This is Tongo and the Dewanis

:12:15. > :12:20.arriving at the Cape Grace. The honeymooners planned to stay here

:12:20. > :12:25.for four nights, leaving on the Tuesday.

:12:25. > :12:31.Panorama has obtained swathes of CCTV footage, showing Shrien and

:12:31. > :12:34.Anni Dewani, staying, on their honeymoon, in this hotel.

:12:34. > :12:40.The cameras track Anni from the moment she walks into the hotel to

:12:40. > :12:44.check in. This footage is a unique and revealing insight into the

:12:44. > :12:53.couples' relationship, in the hours before she was killed. Until now,

:12:53. > :12:58.none of it has been seen publicly. Outside Shrien is alone with Tongo,

:12:58. > :13:01.for a shade over five minutes. According to South African police,

:13:01. > :13:06.the CCTV helps build the case against Shrien.

:13:06. > :13:09.After we were at the hotel, Shrien Dewani approached me alone, and

:13:09. > :13:13.asked me if he knew anybody who could have a client of his taken

:13:13. > :13:23.off the scene. After some discussion with him, I understood

:13:23. > :13:23.

:13:23. > :13:28.that he wanted someone, a woman, killed. Shrien then leaves Tongo

:13:28. > :13:32.waiting for him in the hotel car park, and checks himself in,

:13:32. > :13:36.alongside Anni. Has Shrien simply hired Tongo as a honeymoon tour

:13:36. > :13:42.guide, as he says, or has he already taken the first step

:13:42. > :13:45.towards having Anni killed. Finishing up at the check-in desk,

:13:45. > :13:49.Shrien leaves Anni for another, longer meeting with the taxi driver.

:13:49. > :13:57.Anni is left to be shown to the couples' room, by a member of the

:13:57. > :14:02.Cape Grace staff. So what did Shrien and Tongo talk

:14:02. > :14:05.about? If it was murder, Shrien was taking a huge risk, what is to stop

:14:06. > :14:11.Tongo going straight to the police. From my room at the Cape Grace, you

:14:11. > :14:14.can see the car park where Tongo and Shrien allegedly plotted the

:14:14. > :14:18.murder. By this stage they had known each other about an hour,

:14:18. > :14:21.they had only been together alone for about 17 minutes. Is it really

:14:21. > :14:25.credible, that in a short time, including the meeting down there,

:14:25. > :14:32.they can arrange a woman's murder? Well, South African police think it

:14:32. > :14:37.is. As do others. It doesn't surprise me at all, I

:14:37. > :14:44.think very few things would surprise a criminal lawyer in South

:14:44. > :14:49.Africa. Not every South African lawyer is convinced, though. Surely

:14:49. > :14:52.any intelligent person, wanting to appoint a hitman, would look

:14:52. > :15:02.carefully at the person and wouldn't just engage him within

:15:02. > :15:11.

:15:11. > :15:17.half an hour. It just doesn't make Lake veorn earn in central Sweden,

:15:17. > :15:21.Anni Hindocha was born in a town on the shores. Childhood holidays were

:15:21. > :15:28.spent on its beaches, and then last year, her family came here to

:15:28. > :15:34.scatter Anni's ashes. When you are here you just think about your

:15:34. > :15:39.sister? I do, I miss her, I think she's lying here, and she shouldn't

:15:39. > :15:47.be here, she should have been alive. She should have been here, standing

:15:47. > :15:51.here with me. Anni's death has devastated the Hindocha family.

:15:51. > :16:01.Every single day is a nightmare for us, it is a big torture. I haven't

:16:01. > :16:04.

:16:04. > :16:08.been to work for one year now, I can't do it. The family home in

:16:08. > :16:12.Mariestad, where Anni grew up, here the Hindocha family can't grieve

:16:12. > :16:18.properly, because of the question, as yet unanswered by a court, was

:16:18. > :16:23.Anni killed on Shrien's orders? We need so many answers, and one

:16:23. > :16:29.answer I need to know is, what happened to her? And why. Do you

:16:29. > :16:36.come in here every day. Yes, every day we come in here. And I light a

:16:36. > :16:40.candle. Because this was her room. I don't have the guts to come here,

:16:40. > :16:50.not often. I did everything a father should do for a daughter.

:16:50. > :16:54.

:16:54. > :16:57.Only thing I could not do is save After Tongo's meeting with Shrien

:16:57. > :17:04.at the Cape Grace, the driver told police he drove away from the hotel

:17:04. > :17:09.to meet a man who played a crucial role in Anni's murder. I went to a

:17:09. > :17:17.friend of mine, to inquire whether he could assist me sourcing anyone

:17:17. > :17:22.prepared to carry out the killing as requested by Shrien Dewani.

:17:22. > :17:28.Monde Mbolombo, the called middle man and self-confessed link between

:17:28. > :17:34.Zola Tongo, and the men said to be Anni's killers.

:17:34. > :17:39.Mbolombo worked as a receptionist at this hotel. His detailed

:17:39. > :17:45.confession to his part in Anni's murder, has never been heard in

:17:45. > :17:49.public before. Somewhere between 3.00pm-5.00pm, Zola came in and

:17:49. > :17:56.asked to speak to me in private. We went out and stood in front of the

:17:56. > :18:03.hotel, where Zola asked me if I knew anybody that was a hitman.

:18:03. > :18:08.Right from the start, there are holes in his story. His time, must

:18:08. > :18:14.be wrong, the Dewanis didn't land at Cape Town until around 4.0 0mm,

:18:14. > :18:22.and didn't arrive at the cape -- 4.00pm, and didn't arrive at the

:18:22. > :18:26.Cape Grace until after 5.00. Yet in return for his evidence against in

:18:26. > :18:33.the case, he has been given immunity if he is judged to have

:18:33. > :18:39.told the truth. According to Tongo he said they discussed the share of

:18:39. > :18:44.the money in the murder. He said we should pay the hitman 10,000 Rand.

:18:44. > :18:48.At first I said I didn't know anyone, then I remembered,

:18:48. > :18:57.Mziwamadoda Qwabe. Qwabe, an unemployed 25-year-old,

:18:57. > :19:02.and the man alleged to have driven Anni to her death. Qwabe had been

:19:02. > :19:08.arrested for attempted murder in 2009, but the case was never

:19:08. > :19:13.properly investigated, so he remained a free man. I was

:19:13. > :19:23.contacted who told me another man, named Zola, was looking for a

:19:23. > :19:24.

:19:24. > :19:27.hitman to murder somebody. While plans for Anni's murder were

:19:27. > :19:31.allegedly under way, the Dewanis left the Cape Grace for a Friday

:19:31. > :19:34.night out. Just a short walk from their hotel,

:19:34. > :19:40.which is 50 yards back that way, is where they went out to dinner here

:19:40. > :19:50.on Cape Town's water front. They booked a table at 9.00pm, it is

:19:50. > :19:55.

:19:55. > :20:04.just coming up to that time now. Their waitress says she remembers

:20:04. > :20:08.the Dewanis well. They both were reserved, not your

:20:08. > :20:11.typical honeymoon table, I have served quite a few honeymoon tables,

:20:11. > :20:16.they are normally very much in love, hugging and kissing, it wasn't

:20:16. > :20:22.really the case here. The next time Clara Jane went to save them,

:20:22. > :20:26.Shrien wasn't there. I had noticed Anni was sitting alone, she told me

:20:26. > :20:33.that I should hold back the shoe she, because her husband had gone

:20:33. > :20:37.on -- shoe -- sushi, because her husband had gone on a business call.

:20:37. > :20:40.There may have been other business calls, but one was to Zola Tongo.

:20:40. > :20:44.Police have phone records that revealed they spoke for five

:20:44. > :20:49.minutes and 27 seconds. A lot of people commented about this man who

:20:49. > :20:53.was gone, leaving this lady on their honeymoon. What did Shrien

:20:53. > :20:59.speak to Tongo about? Because he is currently sectioned in the UK, we

:20:59. > :21:02.can't ask him, and his family declined to take part in this

:21:02. > :21:07.programme. What is for certain, Shrien's

:21:07. > :21:11.recollection of the night, doesn't tally with what the waitress told

:21:11. > :21:17.us. We had an amazing evening on Friday night, food, environment,

:21:18. > :21:23.drink, everything, was just fantastic.

:21:23. > :21:28.But, if Shrien Dewani wanted his wife dead, what could possibly be

:21:28. > :21:38.the motive? Could it have been financial? Anni's family have never

:21:38. > :21:39.

:21:39. > :21:43.thought so. So what else? That has come up a lot of stuff about his

:21:43. > :21:46.sexuality, maybe that was a motivation. That he might be gay?

:21:46. > :21:54.Could be. And that he got into something that he didn't want to be

:21:54. > :22:02.in? Could be. South African police seem sure.

:22:02. > :22:07.This UK UK based man, who advertises his services on the web,

:22:07. > :22:13.told them Shrien was a client, and even before he got engaged, he told

:22:13. > :22:15.Leisser he needed to find a way out of the marriage. Could he have felt

:22:15. > :22:22.trapped? I don't know. There is nothing wrong with being gay, it is

:22:22. > :22:26.just that if you are, then why are you with a woman? Panorama

:22:26. > :22:29.understands another alleged male sexual partner from Shrien Dewani's

:22:29. > :22:34.past, contacted British police, but declined to give a statement. But

:22:34. > :22:39.if there were other men, there was also a history of girlfriends. He

:22:39. > :22:43.had even been engaged before. This was not an arranged marriage,

:22:43. > :22:53.Shrien maintains Anni was the one. You just got married to the girl of

:22:53. > :23:07.

:23:07. > :23:16.my dreams, and she actually was the girl of my dreams. The day of

:23:16. > :23:22.Anni's murder. The couple rose late and headed to

:23:22. > :23:28.the Cape Grace restaurant for breakfast, it was after 1.00am,

:23:28. > :23:31.despite claims of tensions within the relationship, the CCTV footage

:23:31. > :23:36.tells a different story. They headed to the hotel swimming pool.

:23:36. > :23:46.But Shrien didn't spend too long relaxing with Anni. After just ten

:23:46. > :23:46.

:23:46. > :23:51.minutes, Shrien heads back to their room, to change.

:23:51. > :23:57.On Saturday Shrien Dewani contacted me to meet him at the hotel. Shrien

:23:57. > :24:01.is once again alone with Zola Tongo. They head into central Cape Town.

:24:01. > :24:06.Shrien Dewani said he was willing to pay an amount of 15,000 Rand, he

:24:06. > :24:11.said he had US dollars, and could pay in US dollars.

:24:11. > :24:15.But, it is claimed, the hitmen wanted paying in Rand. So Shrien's

:24:15. > :24:24.US dollars needed changing, and Tongo knew a place where he could

:24:24. > :24:33.get a good exchange rate. According to police evidence, Shrien Dewani

:24:33. > :24:39.change $1 500 here on the black market, worth about 10,000 Rand,

:24:39. > :24:45.added to the 11,000 Rand Shrien had cashed up on honeymoon, and it is

:24:45. > :24:48.more than enough for the hit. That is about �1900, that is an awful

:24:49. > :24:55.lot of cash to be carrying around for the final four days of a

:24:55. > :24:59.honeymoon. But was it actually money for Anni's murder?

:24:59. > :25:06.The fact that Shrien changed money was not a secret. He told Anni's

:25:06. > :25:13.father. Where are you, I asked him, he said he was in the town changing

:25:13. > :25:20.money. It was not a big issue for me at that time. On the way back to

:25:21. > :25:27.the Cape Grace, Tongo insists that Shrien Dewani told him how he

:25:27. > :25:33.wanted Anni murdered. We would make it looks a if it was a victim of a

:25:33. > :25:37.murder, commited with a firearm. For my assistance I would be paid

:25:37. > :25:42.5,000 Rand. They arrive back at the Cape Grace, Shrien has now been

:25:42. > :25:52.away from Anni for 55 minutes. He runs straight back to his room, to

:25:52. > :25:55.change again. The Dewanis spent the afternoon at

:25:55. > :26:03.the pool, Shrien had organised for Tongo to collect the couple later

:26:03. > :26:08.that evening. While Shrien and Anni were relaxing,

:26:08. > :26:13.Tongo claims he was planning the murder. He came here, Khayelitsha

:26:13. > :26:21.township, to meet the driver, Qwabe, and the man later accused of

:26:21. > :26:26.shooting Anni. Xolile Mngeni. picture here is my grandson, he

:26:26. > :26:32.looks very happy there. 26 years old, unemployed, Mngeni, lived with

:26:32. > :26:38.his grandmother here, on this township plot.

:26:38. > :26:43.His mother passed away in 1990. At that time he was five years old. So

:26:43. > :26:47.I grow him up. And it has been a struggle ever

:26:47. > :26:57.since, especially in a country where work is so scarce.

:26:57. > :27:04.

:27:04. > :27:08.More than half of those aged This shack is the reality for many

:27:08. > :27:13.young black South Africans. A reality just a few miles from the

:27:13. > :27:16.luxury of the Cape Grace. Wealthy tourists and poverty can be a

:27:16. > :27:23.dangerous mix in a country which has one of the highest murder rates

:27:23. > :27:28.in the world. And when they collide so publicly, tourists may stay away.

:27:28. > :27:32.The South African authorities are paying so much attention to the

:27:32. > :27:39.Dewani case, to show the rest of the world that they are doing

:27:39. > :27:42.something about crime in South Africa. That is a big factor in

:27:42. > :27:47.this case. The reputation of our country affects us all. And we have

:27:47. > :27:55.been getting a lot of bad press. Very many South Africans are

:27:55. > :28:02.extremely upset about it. Mngeni had been seen that morning,

:28:02. > :28:07.according to police, carrying a 9mm pistol. I informed Qwabe and Mngeni

:28:07. > :28:16.that they would receive 15,000, Qwabe said that we had to leave the

:28:16. > :28:23.15,000 Rand in the cuby hole of the vehicle.

:28:23. > :28:29.15,000 split between the hitman, 5,000 Rand for Tongo, 5,000 for

:28:29. > :28:34.Mbolombo, the middle man, a to thele of 25,000 Rand. All these

:28:34. > :28:38.figure -- a total of 25,000 Rand. All these figures come from a state

:28:38. > :28:45.from the murder. The court also heard from Tongo that Shrien

:28:45. > :28:49.offered him just 15,000 Rand, which is it, 15,000 or 25,000?

:28:49. > :28:59.It is a massive inconsistency in Tongo's evidence, which has been

:28:59. > :29:09.accepted by the South African courts, without challenge. Saturday

:29:09. > :29:09.

:29:09. > :29:16.night, the night of Anni's murder. At 6.17pm, Shrien Dewani emerges

:29:58. > :30:06.of the couple together. And if she didn't like the resulting picture,

:30:06. > :30:11.she could always persuade them to take another.

:30:11. > :30:18.This is, in a way, the couple whose story has not been told in the

:30:18. > :30:21.accounts of these events so far. That same evening, Anni spoke to

:30:21. > :30:27.her parents for the first time since the wedding. She said

:30:27. > :30:34.everything is fine. But I have got a lot to tell you. I will tell you

:30:34. > :30:39.when I'm back on Tuesday in London. Vincent thought his daughter

:30:39. > :30:43.sounded muted and -- Vinod Hindocha thought his daughter sounded muted.

:30:43. > :30:48.It wasn't the normal Anni. I thought it was strange, she's not

:30:48. > :30:54.talking to me, properly, I found something is not OK. But if dad was

:30:54. > :31:01.concerned, mum wasn't. I wasn't worried, that was the last time I

:31:06. > :31:13.didn't turn up as arranged. When he said he was late, we had another

:31:13. > :31:16.drink and carried on chatting. Tongo claims Shrien Dewani became

:31:16. > :31:20.agitated because he was late. His lawyer goes further. Dewani

:31:21. > :31:25.demanded to know what the hold up was, and insisted the act be

:31:25. > :31:29.perpetrated, and perpetrated that very day. But this CCTV, never

:31:29. > :31:36.before made public, does not support that version of events.

:31:45. > :31:51.sign of being agitated, is it credible that Shrien insisted Anni

:31:58. > :32:04.The Dewanis left the bar and waited in the lobby for Tongo to arrive.

:32:04. > :32:09.Look at that, he leans over and pecks her on the cheek. She seems

:32:09. > :32:14.to, interesting body language, she almost pulls away, and then they

:32:15. > :32:21.put their heads together, very sweetly. Is he doing this for the

:32:21. > :32:27.cameras? Shrien continues to take pictures of Anni. Is this what a

:32:27. > :32:31.murderer does? He takes pictures of his wife, before he has her killed?

:32:31. > :32:41.As we will see, there are other telling moments of the couple

:32:41. > :32:50.together. Side by side, the Dewanis leave the

:32:50. > :32:54.Cape Grace lobby to join Tongo. texted just before 8.00 to say he

:32:54. > :33:04.was outside, he didn't say why he was late. Anni gets into the car in

:33:04. > :33:05.

:33:05. > :33:09.which her life will shortly end. Tongo first took the couple on a

:33:09. > :33:16.nightime tour of Cape Town. Showing them a view where they

:33:16. > :33:21.could see the entire city. Before heading towards a restaurant 27

:33:21. > :33:25.miles away from the Cape Grace, for a 9.30 reservation. The route to

:33:25. > :33:35.the restaurant, in a town called Somerset West, is flanked either

:33:35. > :33:48.

:33:55. > :33:58.party scene, right outside Mzolis, in Gugulethu township.

:33:58. > :34:04.One thing you are told in the country, is you are do not go into

:34:05. > :34:08.the township at night, as a tourist, just don't do it.

:34:08. > :34:14.Zola Tongo's taxi was to be attacked by Qwabe and Mngeni here,

:34:14. > :34:17.just down the road from Mzolis, but because he was running late, the

:34:17. > :34:23.hijackers were not there. Tongo instead left Gugulethu and headed

:34:23. > :34:28.for the restaurant the couple had booked in Somerset West.

:34:28. > :34:33.Qwabe called me and confirmed that he and Mngeni had just missed me

:34:33. > :34:37.when I drove into Gugulethu. Mid- journey, according to Shrien, the

:34:37. > :34:42.Dewanis changed their minds about where they wanted to eat, Tongo

:34:42. > :34:45.diverted to the seafront, in Somerset West. We had a short walk,

:34:45. > :34:50.it was a nice warm evening, and there was a large number of people

:34:50. > :34:56.flying kites on the beach. Which doesn't seem to make any

:34:56. > :35:00.sense. They were here at roughly this time, and it is windy, but as

:35:00. > :35:03.you can see, it is pitch black, it does raise the question, why on

:35:03. > :35:08.earth Shrien Dewani would say he was here, watching people flying

:35:08. > :35:16.kites. Tongo is pictured here, escorting

:35:16. > :35:19.the Dewanis into Surfside, a budget seafood restaurant.

:35:19. > :35:24.Prior to entering the restaurant, Shrien Dewani asked me what was

:35:24. > :35:31.happening. He said he wanted to have the job done that night.

:35:31. > :35:35.the couple were having dinner, Zola Tongo rescheduled the hijack.

:35:35. > :35:39.contacted me and told me the husband wanted his wife killed that

:35:39. > :35:44.same night. Qwabe confirmed they would be waiting at the previously

:35:44. > :35:47.agreed location. The couple were in Surfside less than one hour. We ate

:35:47. > :35:53.fairly quick low and decided to head back into town. I called Zola

:35:53. > :35:58.to come back and pick us up, he came outside the restaurant and he

:35:58. > :36:04.was waiting. Tongo says the call was more sinister. Shrien Dewani

:36:04. > :36:08.contacted me and wanted to know if I had arrange the for the guys, I

:36:08. > :36:18.confirmed to Shrien Dewani that everything had been arranged.

:36:18. > :36:19.

:36:19. > :36:29.These are the last known pictures of Anni Dewani alive.

:36:29. > :36:32.The the couple left Surfside at 10.24 pm. One of Tongo's most

:36:32. > :36:37.devastating allegations against Shrien Dewani comes from this leg

:36:37. > :36:41.of the journey. I sent a text to Shrien Dewani not to forget about

:36:41. > :36:46.the money, he answered by way of text message that the money was in

:36:46. > :36:51.an envelope in the pouch behind the front passenger seat. If what Tongo

:36:51. > :36:57.says is true, what was the money for? And why would Shrien be

:36:57. > :37:02.texting Tongo with Anni beside him in the car?

:37:02. > :37:05.Tongo's lawyer has never been shown the actual texts, but says he did

:37:05. > :37:10.see electronic signatures which reveal there was an exchange of

:37:10. > :37:18.texts between the two men. Do South African police have the wording of

:37:18. > :37:24.these alleged text messages? Or are they relying on Tongo's say so.

:37:24. > :37:27.Shrien says Tongo offered to take them to a place where they could

:37:27. > :37:32.watch African dancing. I was keen to go straight back, she had a

:37:32. > :37:36.habit of calling me boring, so I succumbed to the going out. We had

:37:36. > :37:41.no reason to distrust him at all. You do not feel that Anni would

:37:41. > :37:45.have asked to go? Absolutely not. Because she would have known it

:37:45. > :37:51.would be unsafe? She would, not the way she was dressed. She would not

:37:51. > :37:55.go to places like that. Shrien's recollection of this time

:37:55. > :37:59.is of himself and Anni being distracted, looking through their

:37:59. > :38:05.money moon pictures. We were sat in the back of the car, looking

:38:06. > :38:10.through our photographs, the driver suggested we drive through one of

:38:10. > :38:19.the township areas. For the second time that night, Tongo drove the

:38:19. > :38:23.couple into Gugulethu township, where Qwabe and Mngeni were waiting.

:38:23. > :38:31.The first Shrien says he knew of the hijack was when a man started

:38:31. > :38:35.banging a pistol on the taxi's windscreen. I was instructed to

:38:35. > :38:40.open the doors, Qwabe getting in the driver's side, and Mngeni

:38:40. > :38:45.getting in the back. I grabbed Anni and I covered her, and held her

:38:45. > :38:48.tight, because she was starting to cry. Shrien says Anni head her

:38:48. > :38:58.wedding and engagment rings in the gap between the car seats, where

:38:58. > :38:58.

:38:58. > :39:01.they were later found by police. Her wedding rings, especially her

:39:01. > :39:07.engagment ring were the most valuable thing to her in the world,

:39:07. > :39:10.giving it to her was the best moment of my life. The rings not

:39:10. > :39:15.being stolen made Anni's family suspicious. If it was a robbery,

:39:15. > :39:21.the rings weren't stolen, they were expensive rings, �25,000 worth of

:39:21. > :39:26.rings. It wasn't stolen? That didn't make sense.

:39:26. > :39:31.Shrien says he did hand over around 4,000 Rand in cash, roughly �400.

:39:31. > :39:40.Why he was carrying so much has not been explained. He says the gunmen

:39:40. > :39:43.became threatening on discovering his hidden mobile phone. He said he

:39:43. > :39:49.would shoot me. He had no hesitation in what he was saying or

:39:49. > :39:56.doing. He was very sure of his actions.

:39:56. > :40:01.Qwabe travelled for a short distance before he stopped. Zola

:40:01. > :40:05.Tongo was then ejected from his own taxi, right outside Gugulethu

:40:05. > :40:11.police barracks. The gunmen took his mobile phone, why, if he was in

:40:11. > :40:17.on the plot, was Shrien Dewani not thrown out at the same time. Tongo

:40:17. > :40:22.informed us that the money was behind the front passenger seat.

:40:22. > :40:27.the gunmen drove off in the night, Tongo used the phone in the

:40:27. > :40:33.barracks to alert local police, he did not call South African's

:40:33. > :40:37.equivalent of 999, buying his acomplises extra time. Anni had

:40:37. > :40:41.been getting increasingly more hysterical as the driving went on.

:40:41. > :40:47.She wouldn't stop saying to them, we are on honeymoon, just let us go,

:40:47. > :40:52.we don't have anything. The gunmen drove into the darkness of their

:40:52. > :41:02.home turf, Khayelitsha township. They were saying to me, make her

:41:02. > :41:03.

:41:03. > :41:07.shut up. But we will shoot. About half an hour after the car was

:41:07. > :41:12.first hijacked, it was Shrien's turn to leave. I was holding on to

:41:12. > :41:16.her, hanging on to her, and they priced us apart, they held a gun to

:41:16. > :41:20.my head, and said either leave or we will shoot you. Shrien says the

:41:20. > :41:24.back door would not open, and he was eventually forced out of the

:41:24. > :41:29.window, begging the gunmen to let Anni go as well.

:41:29. > :41:36.For Anni's family, Shrien's explanation is suspicious. The rear

:41:36. > :41:40.window of a Volkswagen Sharan only opens 34cms. I have tried it.

:41:41. > :41:48.tried it? I tried it. With a car window that was open the same

:41:48. > :41:52.distance? Same car, I'm not that big. But I had pain in my shoulders,

:41:52. > :41:57.and enormous pain, my shoes couldn't come out, I dropped them

:41:57. > :42:02.off in the car. It is impossible. So was Shrien forced out of the

:42:02. > :42:07.vehicle here, or did he leave of his own volition. This is what the

:42:07. > :42:11.driver Qwabe told the police, following his arrest shortly after

:42:11. > :42:16.Anni's death. It has never before been made public. We ordered the

:42:16. > :42:21.husband out of the car. Three months later, this version was made

:42:21. > :42:26.public by police and prosecutors. We let the husband out of the

:42:26. > :42:31.vehicle. Ordered or let, it is just a word,

:42:31. > :42:37.but one makes Shrien Dewani a victim, and the other a murderer,

:42:37. > :42:43.so why the change. Unlike Tongo, who was dropped off

:42:43. > :42:49.at a police barracks, Shrien was now alone in a township notorious

:42:49. > :42:53.locally for gun violence. The car sped off, my heart was racing, the

:42:53. > :43:03.first thing I did was shout for help. Luckily for Shrien, help was

:43:03. > :43:04.

:43:04. > :43:11.at hand. A local Government auditor was just arriving home in his car.

:43:11. > :43:17.I was about to pull in and park the car, he came closer to me. He could

:43:17. > :43:21.ask me to take him to the police station. The vast sprawl of

:43:21. > :43:30.Khayelitsha township, is criss- crossed with a network of police

:43:30. > :43:34.stations. Simelane called his cousin, an officer based nearby.

:43:34. > :43:40.was pacing up and down the road, and he was short of like shaking, I

:43:40. > :43:45.thought he was crying. He says Shrien became frantic the

:43:45. > :43:53.police were taking so long to arrive. Did his behaviour that

:43:53. > :43:57.night seem authentic. When I found out I was a bit surprised. When he

:43:57. > :44:02.told me his story that night, I believed him, and I thought what he

:44:02. > :44:07.was saying it was all the truth. It was genuine.

:44:07. > :44:13.Simbonile Matokazi and his wife are the only independent eyewitnesses

:44:13. > :44:21.to gauge Shrien's immediate reaction to the hijack. I don't

:44:21. > :44:26.think this guy had killed his wife. You know.

:44:26. > :44:32.While Shrien was waiting for police to arrive, Anni may already have

:44:32. > :44:36.been dead. He says he still believed she would survive. They

:44:36. > :44:41.said they didn't want to hurt her, so where were they going to leave

:44:41. > :44:44.her. I heard a shot go off in the back of the vehicle, Mngeni was

:44:44. > :44:51.still holding the female passenger at gun point, I was scared and

:44:51. > :44:59.nervous, I parked the vehicle on the side of the road. This is where

:44:59. > :45:06.the car came to a halt. And it was here Anni's life ended. Why kill

:45:06. > :45:11.only the girl? There is something fishy here. We have spoken to an

:45:11. > :45:15.eyewitness who saw the killers dump Tongo's taxi, never imagining a

:45:15. > :45:19.woman had just been shot. Two men emerged from the vehicle, they

:45:19. > :45:23.walked towards this street corner, one of them doubled back, went back

:45:23. > :45:27.to the vehicle, opened the door, and pulled out a brown paper

:45:27. > :45:31.envelope, they were both described as very relaxed, as they walked

:45:31. > :45:38.towards the witness here on the street corner, even saying to the

:45:38. > :45:41.person, "how are you", before disappearing off down that street.

:45:41. > :45:45.The witness has never been questioned by police, yet their

:45:45. > :45:49.evidence, if accurate, seems to support the prosecution case. So

:45:49. > :45:56.what was in that brown paper envelope, and had Shrien left it

:45:56. > :46:01.for these calm, casual killers? When first interviewed by police,

:46:01. > :46:07.the driver, Qwabe, told detectives Anni's death had been accidental.

:46:07. > :46:11.We had not planned to kill the deceased, but rather to con Zola,

:46:11. > :46:17.by just dumping the lady and the car, and taken the money Zola would

:46:17. > :46:20.have left in the car for us. Since her murder, South African police

:46:20. > :46:24.have consistently stated that Anni Dewani was killed by a single

:46:24. > :46:30.gunshot wound to the neck. Combined with the findings that Anni was

:46:30. > :46:34.shot sexually assaulted, it seems, clear cut, this was a cold blooded

:46:34. > :46:40.execution. But Panorama has seen the postmortem report, it reveals

:46:40. > :46:46.that the South African's -- South African police's description of the

:46:46. > :46:51.fatal injury is incomplete. We have learned the 9mm bullet first

:46:51. > :46:58.travelled through Anni's left hand beforele travelling into her chest,

:46:58. > :47:03.it travelled up her body and causing fatal injuries to her neck,

:47:03. > :47:06.before leaving an irregular neck wound. It was not a straight

:47:06. > :47:13.forward execution shot to the neck. It raises questions could Anni have

:47:13. > :47:18.been trying to escape or fight off her attacker when she was shot?

:47:18. > :47:26.When arrested Mngeni told the police the gun fired as Anni's bag

:47:26. > :47:32.was grabbed. After a fruitless search for Anni,

:47:32. > :47:38.police took Shrien back to the Cape Grace Hotel.

:47:38. > :47:43.These pictures were captured at just after 1.00am, Shrien appears

:47:43. > :47:51.upset, he called Anni's father during these early hours. Shrien

:47:52. > :47:56.said, dad, I'm sorry, I could not take care of Anni. At that time it

:47:56. > :48:02.wasn't confirmed she was dead. But I told him, straight away, don't

:48:02. > :48:10.say that, she's not dead yet. Shrien emerged from their room,

:48:10. > :48:17.holding a tissue. Just look at the expression there, now is that a man

:48:17. > :48:20.who was commissioning the murder of his wife, or is that a man in shock

:48:20. > :48:30.because he simply does not know what has just happened, and where

:48:30. > :48:31.

:48:31. > :48:35.she has gone. Shrien was told Anni's body had

:48:35. > :48:45.been discovered on Sunday morning, he says he started screaming

:48:45. > :48:48.

:48:48. > :48:55.hysterically. Tongo was nearby. When we found out that Anni had

:48:55. > :49:05.been shot, he started to cry as well. Everyone was coming to

:49:05. > :49:07.

:49:07. > :49:12.console me. I think he was one of those people. Tongo was he at the

:49:12. > :49:17.hotel to help police with photofits of the men -- Tongo was at the

:49:17. > :49:22.hotel to help the police with photofits of the men he said had

:49:23. > :49:27.taken Anni. Anni's father was given the terrible news while on route to

:49:27. > :49:34.South Africa. The flight was a nightmare. Because you knew there

:49:34. > :49:44.was no hope? I knew Anni was dead. It was the worst thing I have ever

:49:44. > :49:47.

:49:47. > :49:52.Two days later, hours before Shrien left South Africa with Anni's body,

:49:52. > :49:56.he had one final meeting with Zola Robert Tongo at the Cape Grace.

:49:56. > :50:02.Tongo, seen here in white, was, at the time, still a robbery victim, a

:50:02. > :50:07.witness, not a suspect. I met up with Shrien Dewani at the

:50:07. > :50:13.hotel, why I received a 1,000 Rand payment for my role in

:50:13. > :50:18.orchestrating the murder, robbery and kidnapping of the d deceased.

:50:18. > :50:23.Was this payment, as Tongo claims, for his part in Anni's murder, or

:50:23. > :50:27.cash for the innocent services of a tour guide. Shrien, holding a white

:50:27. > :50:34.plastic bag, met Tongo in the lobby, and then disappeared from view into

:50:34. > :50:38.the Cape Grace's internet room. It is one of the few public places in

:50:38. > :50:44.the hotel where there is no CCTV. If he was simply paying Tongo as a

:50:44. > :50:48.tour guide, why did Shrien bring him in here to give him the cash?

:50:48. > :50:56.They were in the room together just over a minute. Shrien leaves first,

:50:56. > :51:00.without the white plastic bag. Tongo, ten seconds later.

:51:00. > :51:08.Zola emerges with the plastic bag, it is secreted under his shirt. He

:51:08. > :51:13.goes into the gents. But, Panorama can reveal the secret meeting

:51:13. > :51:17.wasn't so secret afterall. This mystery couple went in before them,

:51:17. > :51:27.and exited after both men had left. So the handover took place in front

:51:27. > :51:31.of witnesses. Have police spoken to them? Zola Tongo left the hotel

:51:31. > :51:36.with the bag in clear view. South African prosecutors maintain the

:51:36. > :51:40.taxi driver was in severe financial difficulties at the time, and

:51:40. > :51:48.Shrien Dewani exploited this. was supporting his mum, in addition

:51:48. > :51:54.to having his own expenses, as well as his teenage sister. I suppose

:51:54. > :52:00.temptation got the better of him. Still, 1,000 Rand, around about �90

:52:00. > :52:05.doesn't sound very tempting. His former boss is perplexed. What

:52:05. > :52:15.baffles me most about this case is the fact that Robert has taken such

:52:15. > :52:16.

:52:17. > :52:23.a big risk for 1,000 Rand. His monthly earnings was ten to fifteen

:52:23. > :52:27.times that amount. To kill someone for 1,000 Rand, it just doesn't

:52:27. > :52:32.make sense at all. And what happened to the 5,000 Rand fee

:52:32. > :52:36.Tongo claims was agreed with Shrien Dewani? In a follow up statement,

:52:36. > :52:42.Zola has claimed he counted the money and then went looking for

:52:42. > :52:48.Shrien when he realised he had been short changed. The CCTV reveals

:52:48. > :52:53.that to be untrue. Tongo handed himself in to police

:52:53. > :52:58.six days after Anni's body was found. The gunmen and the driver

:52:58. > :53:00.had already been arrested, both have since retracted their

:53:00. > :53:05.confessions, saying they were beaten out of them. They plan to

:53:05. > :53:11.plead not guilty at their trial. Qwabe's lawyer says his client was

:53:11. > :53:16.forced to make a confession, scripted to police instructions.

:53:16. > :53:22.The beating was continuous, they would not let him go without making

:53:22. > :53:28.a statement. I have done a lot of cases where police have assaulted

:53:28. > :53:32.clients, so it is almost like business as usual for the police to

:53:32. > :53:36.do that. Police deny beating the men. Mngeni struggles to get in and

:53:36. > :53:40.out of court, having undergone surgery on a brain tumour,

:53:40. > :53:45.diagnosed while awaiting trial. The pair have now been on remand for 16

:53:45. > :53:50.months, with no trial date in sight, their confessions doing them no

:53:50. > :53:55.favours. Unlike Tongo, the day after his

:53:55. > :53:59.arrest, and having been shown the evidence against him by police,

:53:59. > :54:03.including CCTV material, the taxi driver cut a deal to plead guilty.

:54:03. > :54:11.In return for testifying against Shrien Dewani, Tongo was given

:54:11. > :54:17.seven years off a 25-year sentence, and he could be free in just eight.

:54:17. > :54:21.Anni's father had to agree to Tongo's plea bargain.

:54:21. > :54:29.The prosecution asked me do you approve of this, if he tells the

:54:29. > :54:35.truth. I said, yes, I want to know the truth, what happened to my Anni.

:54:35. > :54:39.Monde Mbolombo, the middle man, without whom the murder could not

:54:39. > :54:43.have happened, has secured the best deal of all. By giving evidence for

:54:43. > :54:48.the prosecution, he has escaped scot free, without a stain on his

:54:48. > :54:51.character. Why are the South Africans happy to offer plea

:54:51. > :54:56.bargains and immunity from prosecution to those who have

:54:56. > :54:59.admitted their involvements in Anni's murder. Why are they

:54:59. > :55:04.apparently willing to overlook inconsistencies in the evidence.

:55:04. > :55:08.Why are they so certain that Shrien Dewani is guilty, without having

:55:08. > :55:11.ever interviewed him as a suspect, despite repeated opportunities to

:55:11. > :55:16.do so. Neither the police nor the

:55:16. > :55:20.prosecuting authorities would talk to us ahead of any trial. South

:55:21. > :55:23.African's Justice Minister, is, however, adamant, the courts will

:55:24. > :55:28.guarantee his country's judicial integrity. Our courts are

:55:28. > :55:32.independent, they are subject to the constitution and the law. So,

:55:32. > :55:38.as far as we are concerned, Mr Dewani, if he comes before a

:55:38. > :55:41.competent court in South Africa, will receive a fair trial. But,

:55:41. > :55:47.according to some, it is not the courts that are barriers to a fair

:55:47. > :55:53.trial, but the police and prosecutors.

:55:53. > :55:59.I have my trust in the judges of this country, I have little trust

:55:59. > :56:06.in the police. The objectivity is a major problem.

:56:06. > :56:09.And I have often seen that they take sides. There is not enough

:56:09. > :56:19.attention spent investigating right at the beginning to see who is

:56:19. > :56:24.actually telling the truth. Within a week of Anni's death, with

:56:24. > :56:29.rumours swelling around he was responsible, Shrien Dewani was

:56:29. > :56:34.adamant he didn't kill his wife. Any insinnation that I had anything

:56:34. > :56:37.to do -- insinuation that I had anything to do with this is absurd,

:56:37. > :56:42.what does anyone have to gain from killing someone they have just

:56:42. > :56:47.married and trying to set up a life with. Still battling mental

:56:47. > :56:50.illnesses, Shrien Dewani vows to clear his name. His family told

:56:50. > :56:53.Panorama he will return to South Africa when he's well enough, until

:56:53. > :56:57.then he will fight a ruling by a British court that it is in the
