0:00:32 > 0:00:39And so inconsequential, and so powerless.

0:00:47 > 0:00:49I was trying to resist and say no.
0:00:49 > 0:00:52You know in that moment that you may not make it.

0:01:20 > 0:01:23Harvey Weinstein had an incredibly complex machine designed to maintain
0:01:23 > 0:01:25silence around this.
0:01:25 > 0:01:28We got very angry and said, I've investigated you,
0:01:28 > 0:01:33and you're not so clean, so be careful.
0:01:33 > 0:01:38It saddens me that everyone woke up because of Harvey Weinstein.
0:01:38 > 0:01:46On the other hand, thank God we've woken up.
0:01:50 > 0:01:53I was just out of acting school, going on auditions
0:01:53 > 0:01:56and pounding the pavement.
0:01:59 > 0:02:03The first time I met him was in his office.
0:02:03 > 0:02:09It was at a meeting set up by my agents.
0:02:09 > 0:02:15The first moments of that meeting were very easy, breezy, casual.
0:02:15 > 0:02:18And I felt very much like he was going to take care of me.
0:02:18 > 0:02:21It was 1994.
0:02:21 > 0:02:25Actress Katherine Kendall thought she was about to get her big break.
0:02:25 > 0:02:29She'd been invited by Harvey Weinstein to a movie screening.
0:02:29 > 0:02:33He sent his driver to collect her.
0:02:33 > 0:02:36Once I got there, I realised it wasn't a special screening
0:02:36 > 0:02:38with cast and crew.
0:02:38 > 0:02:46It was just a movie.
0:02:46 > 0:02:50I knew I'd been had. I mean, I knew I'd been tricked.
0:02:50 > 0:02:52I wanted to leave.
0:02:52 > 0:02:58He said, I'll take you home.
0:02:58 > 0:03:04We ended up stopping at his house.
0:03:04 > 0:03:09And then I ended up going up, probably against my better judgment.
0:03:09 > 0:03:13Once I was in there, we had an hour-long conversation
0:03:13 > 0:03:16about movies and film and books.
0:03:16 > 0:03:19It was almost like he had my playlist.
0:03:19 > 0:03:22And he knew exactly what book to talk about.
0:03:22 > 0:03:25And he knew that book, the way I knew that book.
0:03:25 > 0:03:29And he knew who to quote and what passage to quote.
0:03:29 > 0:03:32And he knew the author, and he had the rights
0:03:32 > 0:03:32to that book, actually.
0:03:32 > 0:03:36He was going to make a movie of that book.
0:03:36 > 0:03:42I kind of got up to leave, or get my stuff.
0:03:42 > 0:03:49And he went into the other room and he came back with a robe on.
0:03:49 > 0:03:53And the robe was just an open robe.
0:03:53 > 0:03:55I didn't even look to see, you know...
0:03:55 > 0:04:00I was just so stunned.
0:04:00 > 0:04:08There was no, like, suave moves or anything.
0:04:09 > 0:04:12There was just a really weird, awkward, "Will
0:04:12 > 0:04:13you give me a massage?"
0:04:13 > 0:04:15I had to say, just no.
0:04:15 > 0:04:18He said, well, a lot of other people do it.
0:04:18 > 0:04:20I mean, so-and-so does it all the time, and she's one
0:04:20 > 0:04:22of my really good friends.
0:04:22 > 0:04:23I said no, I'm not comfortable.
0:04:23 > 0:04:26At one point he said...

0:04:38 > 0:04:41And this time when he came back, he was just fully naked.
0:04:41 > 0:04:44I thought, he's coming after me.
0:04:44 > 0:04:51You know in that moment that you may not make it.
0:04:51 > 0:04:58I said, you know, I can't believe you're doing this to me.
0:04:58 > 0:05:02You are undermining me in a way that is so painful, you know?

0:05:10 > 0:05:15I don't know if he heard me, but he may have.
0:05:15 > 0:05:21I was able to finally get a way out.
0:05:21 > 0:05:25I knew that if I went up against Harvey Weinstein,
0:05:25 > 0:05:27just instinctually, I would be squashed.
0:05:27 > 0:05:31So, I was scared.
0:05:31 > 0:05:36So, I didn't say anything.
0:05:36 > 0:05:43To the people that might have been able to help me.
0:06:00 > 0:06:02It began in Buffalo.
0:06:02 > 0:06:07It all began in Buffalo.
0:06:07 > 0:06:11It was a brash young fellow from Flushing, Queens,
0:06:11 > 0:06:13who arrived here as an 18-year-old freshman at the
0:06:13 > 0:06:16University of Buffalo.
0:06:16 > 0:06:19I believe he only put in a year before he was just kind
0:06:19 > 0:06:23of mesmerised by all of the opportunities
0:06:23 > 0:06:30that awaited him here.
0:06:30 > 0:06:31In Buffalo, Harvey Weinstein built up a successful career
0:06:31 > 0:06:35in the music business.
0:06:35 > 0:06:40Then, in 1980, he made his first film.
0:06:40 > 0:06:4424-year-old Paula Wachowiak applied to be an intern.
0:06:44 > 0:06:48And he said, how would you like to work on a movie I'm making?
0:06:48 > 0:06:50So, I was excited.
0:06:50 > 0:06:56I thought, yeah.
0:06:56 > 0:07:00It was a gory film about a guy that comes back for revenge
0:07:00 > 0:07:03and murders people.
0:07:05 > 0:07:10During filming, Paula says she was asked to take some cheques
0:07:10 > 0:07:12to Harvey Weinstein's hotel room for him to sign.
0:07:12 > 0:07:16I opened the door.
0:07:16 > 0:07:23He was standing there, and he had a hand towel around his waist.
0:07:23 > 0:07:25So, all these things started flying through my head, how calm
0:07:25 > 0:07:28he was without his clothes on.
0:07:28 > 0:07:32Which to me seemed unusual.
0:07:32 > 0:07:37I handed him the folder, and he dropped the hand towel.
0:07:37 > 0:07:39And all the while he's asking me questions about cheques.
0:07:39 > 0:07:43And he sat down on the bed.
0:07:43 > 0:07:47And he plopped the folder on his lap.
0:07:47 > 0:07:49And then he started saying, what about this one?
0:07:49 > 0:07:50And he's pointing.
0:07:50 > 0:07:52And I'm not going to look down.
0:07:52 > 0:07:55So I say, which one is that, Harvey?
0:07:55 > 0:07:59Then he said, I have a crick in my shoulder.
0:07:59 > 0:08:02He said, could you give me a massage, could
0:08:02 > 0:08:05you rub it out for me?
0:08:05 > 0:08:08And at that point I looked at him and I said, Harvey,
0:08:08 > 0:08:11I don't think that's in my job description.
0:08:21 > 0:08:25At the end of the shoot, he said to me, just in this tone...

0:08:31 > 0:08:35And I looked at him and I was like, Harvey, no, you disgust me.
0:08:35 > 0:08:42And he laughed.
0:08:48 > 0:08:55Harvey Weinstein soon left Buffalo for New York City.
0:08:56 > 0:08:59Here, with his brother Bob, he grew the company that
0:08:59 > 0:09:01would make them famous - Miramax.
0:09:01 > 0:09:03They saw themselves as artists.
0:09:03 > 0:09:06Outsiders to the Hollywood system.
0:09:06 > 0:09:09At Miramax we are not under that corporate pressure to say, Jesus,
0:09:09 > 0:09:12we've got to go up each year.
0:09:12 > 0:09:16We can do what we think is good, and if our profits are lower next
0:09:16 > 0:09:18year than they were the year before, so what.
0:09:18 > 0:09:22So what, as long as we did good work.
0:09:22 > 0:09:27I first met Harvey when he started to come over to the UK.
0:09:27 > 0:09:29What made Harvey so successful is there is nobody around
0:09:29 > 0:09:32who works harder than him.
0:09:32 > 0:09:34Seemed to be able to speed read, could consume books,
0:09:34 > 0:09:39articles, films, scripts, at a phenomenal rate.
0:09:39 > 0:09:44Seems to have a photographic memory.
0:09:44 > 0:09:50And he used that to power this kind of insatiable lust for success.
0:09:50 > 0:09:54Miramax's niche became making the kind of movies that mainstream
0:09:54 > 0:10:00Hollywood studios had ignored.
0:10:00 > 0:10:03With a script or a book, I try to do what would appeal to me.
0:10:03 > 0:10:06And I'm not here to do the mainstream movies.
0:10:06 > 0:10:11I want to take the audience on an incredible journey.
0:10:11 > 0:10:15He became, basically, the quality judge for a lot
0:10:15 > 0:10:17of independent cinema for many, many years.
0:10:17 > 0:10:20At least two decades.
0:10:20 > 0:10:24And it was because he had an instinct for intense emotions.
0:10:24 > 0:10:27And he could understand the basic nature of drama in ways that many
0:10:27 > 0:10:29business people wouldn't.
0:10:29 > 0:10:32Come on, we got 'em.
0:10:32 > 0:10:40Miramax was working with some of Hollywood's top talent.
0:10:43 > 0:10:45In 1992, Sean Young starred in their new film, Love Crimes.
0:10:45 > 0:10:46Who are you?
0:10:46 > 0:10:49District attorney, asshole.
0:10:49 > 0:10:53It was about a man who poses as a photographer so he
0:10:53 > 0:10:55could prey on women.
0:10:55 > 0:10:59I play a character who discovers this sexual predator
0:10:59 > 0:11:01and then tracks them down.
0:11:01 > 0:11:04The wire went out, I wanted to get him on a felony
0:11:04 > 0:11:06and I needed him on tape.
0:11:06 > 0:11:10I was sitting in Harvey's office after the picture.
0:11:10 > 0:11:12And this is the only time this has ever happened
0:11:12 > 0:11:16to me, he pulled his...
0:11:16 > 0:11:21Thing out, and my response was, you know, Harvey.
0:11:21 > 0:11:24I really wouldn't be pulling that thing out,
0:11:24 > 0:11:26because it's really not pretty.
0:11:26 > 0:11:30And I got up and I left.
0:11:30 > 0:11:34Actresses are expected to be obedient, talented, and,
0:11:34 > 0:11:41depending on the person, available.
0:11:41 > 0:11:44But I upset a few important men.
0:11:44 > 0:11:52And the trajectory of my career went wooo...
0:11:55 > 0:11:58The reason I didn't get another movie with Harvey Weinstein was that
0:11:58 > 0:12:05I made him feel foolish.
0:12:13 > 0:12:17In 1993, Harvey Weinstein cut a deal that gave Miramax
0:12:17 > 0:12:21massive financial clout.
0:12:21 > 0:12:27They were now being bankrolled by the Disney company.
0:12:27 > 0:12:29Miramax was one of the hottest production companies in the world.
0:12:30 > 0:12:36And Harvey Weinstein was its leading man.
0:12:36 > 0:12:38Working at Miramax was like being in a cult.
0:12:38 > 0:12:42The cult of Harvey.
0:12:42 > 0:12:49I took the job in 1995 as president of production for Miramax.
0:12:49 > 0:12:52It was a long process of seduction from Harvey.
0:12:52 > 0:12:55I knew I was making a deal with the devil.
0:12:55 > 0:12:58I knew he was a bully.
0:12:58 > 0:13:06I knew he was a dangerous character.
0:13:07 > 0:13:09But I knew also that he was at the epicentre
0:13:09 > 0:13:11of where I wanted to be.
0:13:11 > 0:13:18Once the deal was done, everything changed.
0:13:18 > 0:13:20In one of my first production meetings at Miramax,
0:13:20 > 0:13:23Harvey was getting angrier and angrier, as he often did.
0:13:23 > 0:13:29He turned to me, his president of production and said,
0:13:29 > 0:13:31"Well, what do you think, Mr President of production?!"
0:13:31 > 0:13:34So, immediately shrinking me to kind of micro size.
0:13:34 > 0:13:36And then he proceeded to say something else.
0:13:36 > 0:13:44I said, Harvey, that's not true.
0:13:45 > 0:13:48And that was a cue for a tirade of abuse, basically.
0:13:48 > 0:13:49Which, you know...
0:13:49 > 0:13:53I still remember with horror.
0:13:53 > 0:14:01People that I knew within the company were afraid.
0:14:01 > 0:14:06They all knew that they had the potential to work
0:14:06 > 0:14:07on great movies, OK?
0:14:07 > 0:14:10And the question was always, is that worth it?
0:14:10 > 0:14:11Oh, my love.
0:14:11 > 0:14:13I thought you were dead.
0:14:13 > 0:14:16A part in a Miramax film could mean artistic
0:14:16 > 0:14:21credibility, fame and awards.
0:14:21 > 0:14:29In 1998, 26-year-old Gwyneth Paltrow appeared in Shakespeare In Love.
0:14:31 > 0:14:35The movie propelled her to international stardom
0:14:35 > 0:14:39and won both Paltrow and Harvey Weinstein an Oscar.
0:14:39 > 0:14:42This is a movie about life and art.
0:14:42 > 0:14:45And art and life combining is called Magic.
0:14:45 > 0:14:49However, an ugly story had begun to circulate around Hollywood.
0:14:49 > 0:14:53We had heard that Gwyneth Paltrow had been assaulted.
0:14:53 > 0:14:59We heard it from a director who was very upset about it.
0:14:59 > 0:15:02And we thought, well, yeah, we've got to try and do this.
0:15:02 > 0:15:03Kim Masters was a journalist working in Hollywood
0:15:03 > 0:15:06with contacts inside Miramax.
0:15:10 > 0:15:13Intermittently we would call someone we knew who worked
0:15:13 > 0:15:15there, someone who left.
0:15:15 > 0:15:18But it was just, there was no path forward at that point at all.
0:15:18 > 0:15:21If you called their publicist and said I want to talk
0:15:21 > 0:15:24to Gwyneth Paltrow because I heard she was attacked by Harvey
0:15:24 > 0:15:26Weinstein, you can imagine how that phone call would go.
0:15:26 > 0:15:28It would be short.
0:15:28 > 0:15:36Last year, Gwyneth Paltrow went on the record about the rumours.
0:15:36 > 0:15:39She didn't accuse Harvey Weinstein of assault but told reporters that
0:15:39 > 0:15:42when she was 22 years old he had sexually harassed her.
0:15:42 > 0:15:44He'd suggested a massage in his hotel bedroom,
0:15:44 > 0:15:51which she'd refused.
0:15:51 > 0:15:53I remember one executive saying that there are people
0:15:53 > 0:15:57who are famous, and there are people who are not famous.
0:15:57 > 0:16:00And I was, like, OK the famous people are not going to want to go
0:16:00 > 0:16:03there, but what about those who are not famous.
0:16:03 > 0:16:07So, the question was who were they, and we never got a name.
0:16:07 > 0:16:11I mean, we never got a single name.
0:16:11 > 0:16:13Harvey Weinstein had a small army of assistants,
0:16:13 > 0:16:15usually young women.
0:16:15 > 0:16:18Bright and ambitious, but with little experience
0:16:18 > 0:16:22in the world of work.
0:16:22 > 0:16:28For four years, Zelda Perkins was employed in Miramax's London office.
0:16:28 > 0:16:31He had a repertoire that included constant requests of massage,
0:16:31 > 0:16:36constantly appearing in the room undressed.
0:16:36 > 0:16:38His first meeting would usually be 8:30 in the morning,
0:16:38 > 0:16:42and generally when you turned up he would still be in bed.
0:16:42 > 0:16:45So, he would have a habit of trying to grab you from the bed
0:16:45 > 0:16:48and say come on, you know, come and have a cuddle,
0:16:48 > 0:16:52come and lie down.
0:16:52 > 0:16:56The first time that I travelled alone abroad with him,
0:16:56 > 0:16:59he insisted that I went into the bathroom while he had a
0:16:59 > 0:17:05sauna because he needed to do work.
0:17:05 > 0:17:10And he was reeling off names of all the actresses that he had had
0:17:10 > 0:17:12some sort of sexual relations with, or had given him
0:17:12 > 0:17:15massages, or whatever.
0:17:15 > 0:17:17And I remember looking round at him and saying,
0:17:17 > 0:17:20how do you look at yourself in the mirror?
0:17:20 > 0:17:25How do you do that?
0:17:25 > 0:17:28I can remember him looking back at me utterly nonplussed,
0:17:28 > 0:17:36and saying I have no problem at all.
0:17:42 > 0:17:46The Venice Film Festival in 1998 was when things
0:17:46 > 0:17:49really came to a head.
0:17:49 > 0:17:57I had a new colleague with me who was there to assist with Harvey.
0:17:57 > 0:18:05She came to me in a very distressed state, and told me
0:18:06 > 0:18:11that he had assaulted her, that he had attempted to rape her.
0:18:11 > 0:18:14I was completely sideswiped by this, because I honestly never
0:18:14 > 0:18:22believed that Harvey would physically overpower anybody.
0:18:24 > 0:18:27I went straight to Harvey and confronted him, and he swore
0:18:27 > 0:18:29on the life of his wife and children that absolutely
0:18:29 > 0:18:33nothing had happened.
0:18:33 > 0:18:36I was very aware of his tactics, and swearing on the life of his wife
0:18:36 > 0:18:42and children was a very familiar get out of jail card.
0:18:42 > 0:18:45Back in the UK, Zelda and her colleague quit Miramax
0:18:45 > 0:18:53and took legal advice.
0:18:53 > 0:18:55There didn't seem to be any recourse in terms
0:18:55 > 0:19:02of bringing Harvey to justice.
0:19:02 > 0:19:06We had no physical proof, we hadn't gone to the police in Venice.
0:19:06 > 0:19:14Really the only option that we were given was to request damages.
0:19:14 > 0:19:19During the negotiations, Zelda and her colleague agreed
0:19:19 > 0:19:21a payment of £125,000 each.
0:19:21 > 0:19:24They were asked to sign a nondisclosure agreement,
0:19:24 > 0:19:27common in many media organisations.
0:19:27 > 0:19:31But her agreement went further than most.
0:19:31 > 0:19:39This wasn't a normal confidentiality agreement.
0:19:40 > 0:19:42This wasn't us saying that we weren't going to give
0:19:42 > 0:19:43away corporate secrets.
0:19:43 > 0:19:49This was a deeply personally binding agreement.
0:19:49 > 0:19:51Harvey Weinstein has admitted that over the last 30 years he's
0:19:51 > 0:19:55settled up to nine claims of harassment against him.
0:19:55 > 0:19:59When he settled with Zelda Perkins, it was his brother and Miramax
0:19:59 > 0:20:05co-founder Bob Weinstein who provided the money.
0:20:05 > 0:20:10He has said that he believed it was to conceal affairs.
0:20:10 > 0:20:16The use of NDAs on behalf of Weinstein was an enabling factor.
0:20:16 > 0:20:18It allowed him to silence complaining victims and just see it
0:20:18 > 0:20:25as a cost of doing business.
0:20:25 > 0:20:28And learning that he could successfully use NDAs to buy
0:20:28 > 0:20:32silence, he also knew that he had nothing to fear from continuing
0:20:32 > 0:20:36with the behaviour that led to the problem in the first place.
0:20:36 > 0:20:40And again, and again, and again.
0:20:40 > 0:20:46Zelda had been silenced, but she was determined to fight back.
0:20:46 > 0:20:49She wanted better protection for women in the company
0:20:49 > 0:20:52and a clause in the agreement that could see him fired
0:20:52 > 0:20:53if he paid off anyone else.
0:20:53 > 0:20:56And that wasn't all.
0:20:56 > 0:21:00We insisted that he had to go to therapy, and I had to be present
0:21:00 > 0:21:07in the first therapy session to make sure that he talked
0:21:07 > 0:21:10about the issues, and that there had to be a big new HR policy that
0:21:10 > 0:21:14informed all employees of their rights.
0:21:14 > 0:21:16Zelda successfully pushed through most of her demands,
0:21:16 > 0:21:21but when it came to the therapy sessions there was a stalemate.
0:21:21 > 0:21:24They kept holding us off and holding us off,
0:21:24 > 0:21:27and to be honest I was exhausted and pretty broken from
0:21:27 > 0:21:33the whole experience.
0:21:33 > 0:21:37And I gave up, I gave up pushing, and I actually...
0:21:37 > 0:21:40I went abroad for a while.
0:21:40 > 0:21:43And so I have no idea whether he complied
0:21:43 > 0:21:51with the therapy or not.
0:21:58 > 0:22:00So you take your cheque, and you try to deal
0:22:00 > 0:22:03with it as best you can.
0:22:03 > 0:22:09He got away with it for years just on the strength of that.
0:22:09 > 0:22:12Only a small circle of people knew about the allegations being levelled
0:22:12 > 0:22:16against Harvey Weinstein.
0:22:16 > 0:22:19However, some of those who worked for him were beginning
0:22:19 > 0:22:24to connect the dots.
0:22:24 > 0:22:27I think we were all complicit because you were in there,
0:22:27 > 0:22:29you are in the company, it was part of doing
0:22:29 > 0:22:34business at Miramax.
0:22:34 > 0:22:38My memory is that I was fully aware that Harvey was a serial womaniser,
0:22:38 > 0:22:42that there would be times when you'd be kicked out of the suite
0:22:42 > 0:22:50of the Savoy or the Peninsula Hotel in LA, and he would entertain.
0:22:50 > 0:22:54But I think it didn't take too much brain power to put it together that
0:22:54 > 0:22:57a man who was so abusive and bullying in every aspect
0:22:57 > 0:23:02of his life would bring that abuse into the sexual arena.
0:23:02 > 0:23:08I think, looking back, that I did know and I chose to suppress it.
0:23:08 > 0:23:12I chose to hide from that fact.
0:23:12 > 0:23:16Could I have done anything at the time?
0:23:16 > 0:23:19Well, I know that I prevented my assistant being called
0:23:19 > 0:23:20to the Savoy Hotel late at night.
0:23:20 > 0:23:26I said no, you can't go.
0:23:26 > 0:23:28So, obviously I was aware of that.
0:23:28 > 0:23:32I didn't have the guts to do anything about it,
0:23:32 > 0:23:38I think the deal I'd made with the devil was to my advantage.
0:23:38 > 0:23:40Harvey Weinstein was now Hollywood's most powerful
0:23:40 > 0:23:48independent film producer, and a regular at film festivals.
0:23:48 > 0:23:55At Cannes, his films had won the top prize three times.
0:23:55 > 0:23:58A number of women also say they were harassed or assaulted
0:23:58 > 0:24:01by Harvey Weinstein here.
0:24:01 > 0:24:09In 1998, I was 24, modelling around the world.
0:24:09 > 0:24:13I thought I was tough.
0:24:13 > 0:24:15Zoe Brock joined the head of her modelling agency
0:24:15 > 0:24:17on a private trip to Cannes.
0:24:17 > 0:24:24She hoped it would help her career.
0:24:24 > 0:24:26I flew to the south of France, and we were taken into
0:24:26 > 0:24:28the Majestic Hotel to have dinner.
0:24:28 > 0:24:34That was where I was sat next to Harvey.
0:24:34 > 0:24:36As the evening was drawing to a close, Zoe's friends got
