:01:13. > :01:18.teenagers in Edinburgh 35 years ago. Angus Sinclair was acquitted five
:01:18. > :01:22.years ago of killing Christine Eadie and Helen Scott, in what
:01:22. > :01:26.became known as the world's end murders. If a retrial is granted,
:01:26. > :01:30.it will be the first held after double jeopardy legislation was
:01:30. > :01:35.changed last year. 17 year-olds Helen Scott and
:01:35. > :01:40.Christine Eadie have been on a night out in Edinburgh on 15th
:01:40. > :01:45.October 1977. They were last seen alive leaving this club, the
:01:45. > :01:50.world's end, on the Royal Mile. The case became known as the World's
:01:50. > :01:57.End murders. The next day, Christine's body was found in
:01:57. > :02:01.Castlebay in East Lothian. Helen's was found six miles away in a field,
:02:01. > :02:07.both brutally murdered. Police conducted an investigation. Despite
:02:07. > :02:12.their efforts, no one stood trial for the deaths until 30 years later.
:02:12. > :02:16.That is when this man, Angus Sinclair, went on trial. But he was
:02:16. > :02:21.acquitted after a judge ruled there was insufficient evidence against
:02:21. > :02:30.him, leaving Helen Scott's Father devastated. Words cannot explain
:02:30. > :02:36.how I feel. 30 years of trying to get a conclusion. I promised I
:02:36. > :02:40.would stick by this and get somebody brought and get justice,
:02:40. > :02:45.which honestly I do not think I have had today. It was the collapse
:02:45. > :02:53.of this case which prompted the review of the ban on people being
:02:53. > :02:58.charge price for the same effect -- defence. It is understood that
:02:58. > :03:03.fresh DNA evidence has since been uncovered by police in this case.
:03:03. > :03:08.For 35 years, Helen Scott's Father has waited for someone to be
:03:08. > :03:12.convicted of the murder of his daughter. Today, Morain Scott told
:03:12. > :03:16.the BBC this is completely new territory and another step on the
:03:16. > :03:20.ladder for getting justice for his daughter and her friend.
:03:20. > :03:25.A child has been flown to hospital in Aberdeen after a serious road
:03:25. > :03:31.crash. The accident between a car and a lorry happened on the A90 two
:03:31. > :03:36.miles south of Fraserburgh. Two other people were taken to hospital.
:03:36. > :03:39.The child's condition is not known. The man found guilty of murdering
:03:39. > :03:43.Edinburgh office worker Suzanne Pilley has had an appeal against
:03:43. > :03:48.his conviction refused. David Gilroy was jailed earlier this year
:03:48. > :03:52.for killing his ex-lover, whose body has never been found.
:03:52. > :03:56.David Gilroy's family arrived in court today hoping for a positive
:03:56. > :04:01.outcome. It was less than two hours later before his appeal was
:04:01. > :04:06.rejected. It was in March she was found guilty of murdering Suzanne
:04:06. > :04:11.Pilley, who have been trying to end their affair. This was made 2010.
:04:11. > :04:18.The pair were captured on CCTV shopping. Two days later, she
:04:18. > :04:22.disappeared. A jury convicted him of killing her in the basement of
:04:22. > :04:27.their office before driving to Argyll with her body in the boot of
:04:27. > :04:32.the car. He was questioned in a police station in Edinburgh and
:04:33. > :04:37.treated as a witness. Today Gilroy's lawyer argued police
:04:37. > :04:40.should have treated him as a suspect right from the start. He
:04:40. > :04:45.put to the Appeal Court judges that he should have been cautioned and
:04:45. > :04:49.give access to a lawyer, and that meant the same as he gave should
:04:49. > :04:56.never have been used in evidence against him. They also said that
:04:56. > :05:05.the whole trial should have been halted as the jury work given a
:05:05. > :05:10.pathologist's report a erroneously. Kilroy has always been vocal, as he
:05:10. > :05:17.claimed to be innocent. But in judge today he remained quiet. His
:05:17. > :05:22.legal team say they will now go to the Supreme Court in London.

:06:30. > :06:35.away. The road has re-opened but that caused some serious hold-ups
:06:35. > :06:39.for drivers only on today. A van driver was stuck in floodwater for
:06:39. > :06:45.a time. His band have to be towed to safety by a farmer using his
:06:45. > :06:53.tractor. In Dundee they are keeping a close eye on the level of the
:06:53. > :07:00.River Tay tonight. High tide is due just after eight Ben Clark and the
:07:00. > :07:04.coast levels could get as high as five metres. -- eight o'clock. The
:07:04. > :07:11.water cascades down into the rivers and the Burns, causing those levels

:07:15. > :07:21.Earlier on today, heavy equipment was brought in to shore up the

:07:24. > :07:31.houses when they reached over the weekend. But today the real focus
:07:31. > :07:36.of concern is the River Carron here in Stonehaven. Sandbags have been
:07:36. > :07:40.issued to householders and all set up in Peterhead. There is also some
:07:40. > :07:46.concern about the river Devon further north in Huntly and alerts

:07:50. > :07:56.is not necessarily the heaviness of the rain but its persistence with
:07:56. > :08:01.the deluge expected to last. The company which operates the Aberdeen
:08:01. > :08:05.to the Northern Isles ferry service has called off all ferry sailings
:08:05. > :08:09.today. They say they may well be ferry sailings tomorrow but if not,
:08:09. > :08:18.there will not be any more now until Boxing Day. Extra flights

:08:22. > :08:26.Some staff at Tayside health board felt bullied into fiddling waiting
:08:26. > :08:30.times figures and many other health boards do not have accurate ways of
:08:30. > :08:34.making sure they are offering patients timely appointments,
:08:34. > :08:38.according to auditors. Today the Scottish Government announced the
:08:38. > :08:44.results of audits into the ways all health boards have met waiting
:08:44. > :08:48.targets. Our health correspondent joins me. Why were these audits
:08:48. > :08:51.offered in the first place? There was suspicion that health boards
:08:51. > :08:55.were not actually meeting Government waiting time targets and
:08:55. > :08:57.that followed a scandal in NHS Lothian where it was discovered
:08:57. > :09:01.patients were being offered appointments they could not
:09:01. > :09:05.possibly keep because they were at short notice in faraway hospitals.
:09:06. > :09:11.These audits that were carried out found no evidence of general
:09:11. > :09:15.cheating. They did find, though, that the system was very complex,
:09:15. > :09:19.certainly not transparent for patients. There was a particular
:09:19. > :09:22.problem in Tayside though, where it was found 17 % of patients in a
:09:22. > :09:25.particular sample were wrongly marked down as unavailable.
:09:25. > :09:31.Knocking someone down as unavailable means there waiting
:09:31. > :09:33.time clock stops and it meant they were removed from the waiting time
:09:33. > :09:38.targets and therefore NHS Tayside did not attract attention by
:09:38. > :09:42.breaching those targets. Staff involved said they felt bullied
:09:42. > :09:48.into doing that. NHS Tayside has apologised and said it will not
:09:48. > :09:52.happen again. So how long should we will be waiting? The clocks start
:09:52. > :09:57.from when you are referred for treatment by your GP. If that
:09:57. > :10:02.referral was before October of this year, don't you should not wait
:10:02. > :10:06.longer than 18 weeks. Is the referral was after October this
:10:06. > :10:10.year, he should not wait longer than 12 weeks, and that is because
