:01:03. > :01:06.Aberdeen, after a hospital mortuary van is taken to this garage for

:01:06. > :01:10.repairs, with a body still inside. Back to the future. Why Prince

:01:14. > :01:21.And, Andy Murray crashes out of the Monte Carlo Masters in a straight-

:01:21. > :01:24.Kimberley Hainey, who was convicted of murdering her toddler son and

:01:24. > :01:27.hiding his body, has been freed from jail, after all convictions

:01:28. > :01:37.against her were quashed. Miss Hainey was sentenced to a minimum

:01:38. > :01:39.

:01:39. > :01:43.of 15 years in December 2011. Catriona Renton reports.

:01:43. > :01:48.Declan Hainey was found in a partially decomposed state in a

:01:48. > :01:53.pocket in Paisley. His mother had a history of drug addiction. After

:01:53. > :01:58.Declan was born, Kimberley and the baby lived with her mother, but

:01:59. > :02:04.five months later in 2000 and it she got a flat of her own. The

:02:04. > :02:11.grandmother said she continued to see the baby until his first day --

:02:11. > :02:14.birthday. Declan was last seen alive in that summer 2009, aged 15

:02:14. > :02:20.months. Friends and family asked after him, Kimberly gave the

:02:20. > :02:29.impression nothing was wrong. Eight months later, his body was found in

:02:29. > :02:33.the flat which was strewn with rubbish. His body was in such a

:02:33. > :02:38.state of decomposition it was impossible to say how he died.

:02:38. > :02:43.Kimberley Hainey maintained she woke up one morning to find her

:02:43. > :02:47.baby Declan dead in his cot. She said she was in denial and could

:02:47. > :02:51.not accept he had gone and did not want anyone to take my way. When

:02:51. > :02:57.the case came to the High Court in Glasgow, the prosecution relied on

:02:57. > :03:02.scientific evidence Declan was malnourished. In December 2011,

:03:02. > :03:07.Kimberley Hainey was found guilty of murder, and of hiding the body

:03:07. > :03:13.of her son. She was sentenced to 15 years. Her neighbours gave their

:03:13. > :03:18.reaction. If justice has been served. Today, three appeal court

:03:18. > :03:23.judges gave their reasons for quashing the conviction and

:03:23. > :03:28.criticising a forensic anthropologist who gave evidence

:03:28. > :03:38.Declan was possibly malnourished despite the fact they were not

:03:38. > :03:55.

:03:55. > :04:02.They also criticised the trial judge for allowing evidence from Dr

:04:02. > :04:07.Cunningham. They said the jury had been misdirected and Kimberley

:04:07. > :04:11.Henie had suffered a miscarriage of justice. Had he lived, Declan would

:04:11. > :04:14.be five years old yesterday. Nobody knows how he died.

:04:14. > :04:18.Our home affairs correspondent Reevel Alderson joins me now. A

:04:18. > :04:24.very distressing case. What reaction has there been to this

:04:24. > :04:29.acquittal? There is bound to be a huge amount

:04:29. > :04:34.of public disquiet about the situation. The mother's conviction

:04:34. > :04:41.has been quashed but what remains troupe is that Declan, her young

:04:41. > :04:47.son, is dead, and his body had lain in his cot for eight months, which

:04:47. > :04:51.means we do not know how he died. Meanwhile, Kimberley Hainey, a

:04:51. > :04:56.heroin addict, was telling friends and relatives there was nothing

:04:56. > :05:00.amiss. She has been freed, because the appeal court said there was a

:05:00. > :05:06.miscarriage of justice involving that scientific and medical

:05:06. > :05:11.evidence. The prosecution says it will not seek a retrial which means

:05:11. > :05:16.in the eyes of the law Kimberley Hine has committed no crime. There

:05:16. > :05:21.must be lessons to be learned? there is an argument lessons have

:05:21. > :05:26.already been learnt. In the trial, the jury heard the health worker

:05:26. > :05:32.assigned to look after Declan had more than 300 cases on her books.

:05:32. > :05:36.As soon as his body was discovered, the council instituted a

:05:36. > :05:41.significant case review. Before Kimberley Hainey came to trial,

:05:41. > :05:47.that review had reported making 16 recommendations for changes to

:05:47. > :05:52.practise for those involved in child protection. They have all

:05:52. > :05:56.been implemented. The Care Commission has said they had been

:05:56. > :06:01.turned into a comprehensive and realistic action plan, with

:06:01. > :06:07.increased resources and appropriate training. The cows of says the

:06:07. > :06:11.information it gathered will be handed to a further inquiry. The

:06:11. > :06:17.council has called on the Scottish Government to meet the growing

:06:17. > :06:20.challenge of the neglect of children in our society.

:06:20. > :06:23.Scotland's greatest Olympian, Sir Chris Hoy, has confirmed he's

:06:23. > :06:26.retiring from competitive cycling. It means he won't be racing in the

:06:26. > :06:34.velodrome which bears his name at next year's Commonwealth Games in

:06:34. > :06:37.Glasgow. Rob Flett reports. It was a day he said had been

:06:37. > :06:46.hanging over him but Chris Hoy it is content he has achieved

:06:46. > :06:50.everything he can in his sporting career. Winning a 6th gold medal in

:06:50. > :06:56.London and earned him the title of our greatest Olympian.

:06:56. > :07:00.Chris Hoy gets the gold medal! also took its toll.

:07:00. > :07:04.He is in tears. I was successful in London but

:07:04. > :07:09.maybe people do not realise how much that took out of me. So, to

:07:09. > :07:13.try to go on for another year would be too much, one year too far for

:07:18. > :07:24.to win a medal for Scotland. Because I don't feel I can do that,

:07:25. > :07:28.I'd rather set -- Stepaside. On an emotional day he was supported by

:07:28. > :07:34.his wife. It was a decision ultimately he had

:07:34. > :07:39.to come to at the end of the date and I am delighted to hear him say

:07:39. > :07:43.it out loud. Retirement will mean more time for his role as an

:07:43. > :07:51.ambassador for Glasgow's Commonwealth Games. We are very

:07:51. > :08:00.keen to have further discussions. To be further involved, a fantastic

:08:00. > :08:05.role to play to inspire. Talk will turn to his legacy, which he says

:08:05. > :08:10.is helping to deliver an indoor velodrome for Scotland. For his

:08:10. > :08:15.name to be on that venue is a massive legacy for the next 100

:08:15. > :08:21.years of Scottish cyclists that fully competing and winning at

:08:21. > :08:26.world level. Ultimately we do it for fun, not because it is a job.

:08:26. > :08:30.He takes up the sport because you love it. I am pleased to say it I

:08:30. > :08:36.feel that way about it. I hope to try to encourage other people to

:08:36. > :08:44.get into the sport. There will be no more medals but he will remain a

:08:44. > :08:47.hugely influential figure in the future of Scottish sport. Thank you.

:09:28. > :09:38.to a garage for repairs with a body still inside. A member of staff has

:09:43. > :09:52.been suspended. A porter picked up a van on what

:09:52. > :09:56.should have been a routine vehicle tail light repair. But unknown to

:09:56. > :10:01.him and the mechanics, there was still a dead body in the back of

:10:01. > :10:04.the van. The garage has made no comment. NHS Grampian have

:10:04. > :10:11.described this as very embarrassing. A member of staff has been

:10:11. > :10:16.suspended. They are apologising to everybody involved.

:10:16. > :10:20.The first thing I want to say is how sorry we are, and how sorry I

:10:20. > :10:24.am on behalf of NHS Grampian, to the family of the deceased, for the

:10:24. > :10:28.distress this would obviously have caused. We would also want to

:10:28. > :10:37.apologise to the staff in the garage for this. And, generally, to

:10:37. > :10:40.say to the public we are taking this incident extremely seriously.

:10:40. > :10:50.Richard Carey has commissioned an independent inquiry into what went

:10:50. > :10:52.

:10:52. > :10:55.wrong and he wants that report as soon as possible. The First

:10:55. > :10:58.Minister, Alex Salmond, has called on the Better Together campaign to

:10:58. > :11:02.return half a million pounds that it received from the businessman,

:11:02. > :11:05.Ian Taylor. He heads the oil trading firm, Veetol. Mr Salmond

:11:05. > :11:07.questioned whether it was the "right type of donation to accept"

:11:07. > :11:10.because controversy has surrounded some of Veetol's past business

:11:10. > :11:18.dealings. Better Together said it was a "valid donation", and would

:11:29. > :11:35.independence. These lottery winners gave Yes Scotland �1 million. So

:11:40. > :11:45.personal donation of �500,000. The chief Executive of the oil trading

:11:45. > :11:49.firm Veetol. He has previously given cash to the Conservatives. No

:11:49. > :11:53.one is questioning his right to make political donations but the

:11:53. > :12:02.SNP is questioning the wisdom of accepting money from someone who

:12:02. > :12:06.heads a company which has had controversial business dealings. A

:12:06. > :12:12.Serbian parametric was reported to have received payment from Veetol.

:12:12. > :12:16.The company says it did nothing illegal. Saddam Hussein rant Iraq

:12:16. > :12:22.and Veetol has admitted making payments to the national or a

:12:22. > :12:26.company which led to Veetol being fined by a New York court. The

:12:26. > :12:30.First Minister says Better Together must take this into account.

:12:30. > :12:33.campaign should return the money in the same way as the Labour Party

:12:33. > :12:39.argued that Conservatives should return their money. The Labour

:12:39. > :12:45.leader did not want to comment but one of her Members did. Do you have

:12:45. > :12:50.a problem accepting money from Ian Taylor? This was a valid donation.

:12:51. > :12:56.Nobody is suggesting he should not invest in Harris tweed. It is a

:12:56. > :13:00.valuable donation. Ian Taylor's investments in Harris tweed were

:13:00. > :13:06.raised by the Liberal Democrats. it is good enough for Harris Tweed,

:13:06. > :13:09.it is good enough for Better Together. The Scottish Conservative

:13:10. > :13:13.leader chose not to say one way or the other.

:13:13. > :13:16.Labour has outlined draft plans to transfer more power to Holyrood,

:13:16. > :13:19.including full control of income tax. But, ahead of their conference

:13:19. > :13:22.in Inverness, party leaders are stressing that the ideas, in a

:13:22. > :13:25.party commission report, are still at an early stage. They say nothing

:13:25. > :13:34.would be done to cut Scotland's public spending budget. Our

:13:34. > :13:38.political editor Brian Taylor has the details.

:13:38. > :13:46.Polling tells Labour leaders they need a new offer to counter

:13:46. > :13:49.independence. A commission has been set up. The report says devolving

:13:49. > :13:55.air passenger duty and vehicle excise duty. They say they are

:13:55. > :14:00.minded to shift control of all income tax. We are in the business

:14:00. > :14:07.of making people in Scotland's lives better. If it is too

:14:07. > :14:12.expensive or there are concerns, then that wouldn't make sense. This

:14:12. > :14:16.is driven by a desire to improve the people of Scotland. Some Labour

:14:16. > :14:23.MPs are known to be sceptical. The commission is cautious. They are

:14:23. > :14:28.against devolving corporation tax. They say it oil revenues are too

:14:28. > :14:33.volatile to handover. It would keep welfare in UK hands. It is beyond

:14:33. > :14:36.comprehension a Labour report looking at more powers for Scotland,

:14:36. > :14:40.at a time when the Tories in Westminster but dismantling the

:14:40. > :14:46.welfare state, would recommend power over welfare stays in

:14:46. > :14:51.Westminster. That is beyond belief. For Scottish Labour, this is part

:14:51. > :14:55.of a continuing process, not an end product in itself. Some within the

:14:55. > :15:03.party say, instead of devolving income tax entirely, Labour might

:15:03. > :15:13.give Holyrood the power to vary the gap. As Scotland prepares for that

:15:13. > :15:25.

:15:25. > :15:28.referendum next year, the pro-union Scotland this Thursday. A man has

:15:28. > :15:31.appeared at the High Court in Glasgow, charged with murdering the

:15:31. > :15:33.42-year-old Thai woman Khanokporn Satjawat in the toilets of the Clyde

:15:33. > :15:36.Auditorium last November. Clive Carter from Motherwell made no plea

:15:36. > :15:39.- and the case was continued. The Government has published legislation

:15:39. > :15:42.to increase pre-school childcare. The Children and Young People Bill

:16:15. > :16:17.this side of Scotland mean more people will have support. A new

:16:17. > :16:19.traffic control centre has officially opened in South

:16:19. > :16:21.Queensferry. It will be used to co-ordinate major travel incidents

:16:21. > :16:23.and help motorists during severe weather.

:16:23. > :16:26.A new political party has been launched with the express intention

:16:26. > :16:29.of rallying voters opposed to wind farms. The Alliance Party of

:16:29. > :16:31.Scotland was formed by activists, who claim the country's landscapes

:16:31. > :16:37.are being destroyed and thousands of people forced into fuel poverty,

:16:37. > :16:42.because of wind power. An osprey thought to be the oldest

:16:42. > :16:45.breeding bird of her kind in the UK has laid her 65th egg.. "Lady"

:19:36. > :19:46.world of track cycling with six Olympic gold medals, 11 world and to

:19:50. > :19:56.Commonwealth titles. -- two. Whatever he goes on to do he will be

:19:56. > :20:04.brilliant at. He is just one of these guys that will be successful

:20:04. > :20:07.at whatever redial -- whatever he does and we wish him the best.

:25:34. > :25:41.loves what an amazing sense of Glasgow's industrial past and also

:25:41. > :25:48.the sheer size and the drama of the structure. He loves the story behind

:25:48. > :25:58.the event as well as the sheer amazing sound that is created.

:26:04. > :26:14.real percussion magnet because each cured these thousands of raindrops.
