:01:05. > :01:07.A fatal accident inquiry has opened into the death of toddler

:01:08. > :01:10.Declan Hainey whose body was found in his Paisley home eight months

:01:11. > :01:13.His mother, Kim was found guilty of his murder

:01:14. > :01:20.Today Declan's grandmother broke down as she told the inquiry how she

:01:21. > :01:23.hadn't seen the little boy after his first birthday.

:01:24. > :01:38.Declan Hainey was found in his court at his mother's flat in March 2010.

:01:39. > :01:47.He had been dead for about eight months. Rubbish, soiled nappies,

:01:48. > :01:52.half filled baby bottles were all over the flat but in other places

:01:53. > :01:57.there were neat shelves of baby clothes. He was about 15 months old

:01:58. > :02:02.when he died. His mother was found guilty of his murder but was

:02:03. > :02:07.acquitted on appeal. She was found to have suffered a miscarriage of

:02:08. > :02:10.justice. At the start of proceedings, the sheriff said this

:02:11. > :02:16.was an enquiry into what might be known about the circumstances and

:02:17. > :02:20.facts of the death. He says now one stands accused of anything, this is

:02:21. > :02:27.not a fault finding exercise and as far as possible is a fact finding

:02:28. > :02:34.one. The first witness to give evidence was Kim's mother. She had

:02:35. > :02:39.lived with her while pregnant but was put out of the house for taking

:02:40. > :02:44.heroin. After Declan Hainey arrived they all lived at her home. Kim was

:02:45. > :02:49.on a methadone programme and her mother said she was doing great.

:02:50. > :02:56.Five months later they moved to Bristol Road. She saw them regularly

:02:57. > :03:03.until Declan Hainey's first birthday and says after that she never saw

:03:04. > :03:08.them again. Kim continued to visit but said the boy was at playgroup.

:03:09. > :03:12.She said it broke her heart and challenged her daughter but if she

:03:13. > :03:17.fell out she would not bring him to see her. She told the enquiry it was

:03:18. > :03:21.almost a year since she had last seen Declan Hainey and received a

:03:22. > :03:26.phone call saying her grandson would be reported missing. Her husband

:03:27. > :03:39.found a key for the flat and ran in to see if she was the...

:03:40. > :03:44.The enquiry is expected to last eight weeks.

:03:45. > :03:47.Aberdeen maternity hospital has been given one month to clean up

:03:48. > :03:50.its theatres, following another critical report from inspectors.

:03:51. > :03:52.It follows an unannounced visit which found contaminated instrument

:03:53. > :03:56.trays, high dust levels and an incident where a porter came into

:03:57. > :04:08.A new arrival for this first-time mother. He was born by Caesarian

:04:09. > :04:16.section five days ago. Both parents have no complaints about the state

:04:17. > :04:17.of the ward. It is clean and tidy uncomfortable, what else can you ask

:04:18. > :04:24.for? They are regularly going around uncomfortable, what else can you ask

:04:25. > :04:29.cleaning and I felt good and relaxed uncomfortable, what else can you ask

:04:30. > :04:35.and in a clean environment. That was not the experience of inspectors on

:04:36. > :04:39.an unannounced visit. Although improved on previous checks, they

:04:40. > :04:45.found stealing, blood spotting and sometimes high levels of dust. At

:04:46. > :04:48.one point inspectors witnessed a porter transferring medical waste

:04:49. > :04:54.onto a trolley without protective clothing. One of the bags split

:04:55. > :05:00.causing blood to spell. That incident was deemed so serious it

:05:01. > :05:04.was reported to the Health and Safety Executive. The man

:05:05. > :05:12.responsible told me inspection rates are low and he is pleased with

:05:13. > :05:18.progress. If everything was 100%, we would not need inspections on the

:05:19. > :05:22.way we have them today. They are to support us on an ongoing basis,

:05:23. > :05:29.way we have them today. They are to get things right. To be honest, it

:05:30. > :05:32.will never be 100% every time. New procedures are being put in place on

:05:33. > :05:39.the ward and it is hoped the next inspection will show improvements.

:05:40. > :05:42.Police are hunting three men after a 33-year-old woman was forced

:05:43. > :05:54.The victim was walking in Edinbeg Avenue,

:05:55. > :05:57.in the car, then subjected her to a serious sexual assault.

:06:04. > :06:06.Scots are being "short changed" over pensions, because life expectancy is

:07:27. > :07:31.that by spreading the whole cost, pensions are safer than they would

:07:32. > :07:34.be otherwise. That is something the Scottish government might not want

:07:35. > :07:38.to hear but it is the truth of the matter. They can make a difference

:07:39. > :07:41.and can do that by matter. They can make a difference

:07:42. > :07:42.and can do that using the powers of education and health that they

:07:43. > :07:44.already have. and can do that using the powers of

:07:45. > :07:50.education and health that They should be doing that instead of

:07:51. > :07:54.daydreaming. Pensions are now clearly at the corner of the

:07:55. > :08:02.independence referendum. Back at the daycare centre, this is for elderly

:08:03. > :08:06.people who can lead to a certain degree in the past, but this issue

:08:07. > :08:13.of pensions is very controversial and very pertinent. It is about the

:08:14. > :08:17.economy and personal security, but also about the fact elderly people

:08:18. > :08:21.tend to vote. Still to come

:09:20. > :09:25.minute wait but hours later, some people are still waiting. Some of

:09:26. > :09:29.these people have been venting their frustrations. They have come out

:09:30. > :09:35.with comments saying it is an absolute joke. One person trying to

:09:36. > :09:41.buy tickets all day is Peter Carrollton and when we spoke to him

:09:42. > :09:47.at 5pm he was still waiting. It is a farce. They do not seem to be able

:09:48. > :09:58.to cope with this and they are not communicating with people to let

:09:59. > :10:04.them know. People want to buy the tickets but they have a life to

:10:05. > :10:11.live. Here I am sitting still waiting. What are the organisers say

:10:12. > :10:15.in? They are blaming unprecedented demand but say it may be something

:10:16. > :10:19.to do with the number of people trying to access the site solely are

:10:20. > :10:24.trying to control the number and get a small number through each time,

:10:25. > :10:29.but they say they are still tickets they are for people if they want

:10:30. > :10:34.them. It is hugely frustrating when people are so excited that we have

:10:35. > :10:38.problems but the focus is on fixing those problems and we are hoping we

:10:39. > :10:44.have now done that and can increase the flow of people. We are told

:10:45. > :10:49.plenty of tickets still left but I tried to get some today and just

:10:50. > :10:54.before I went on a this was what I was eventually pleated wet. I got

:10:55. > :11:06.through and tried to buy tickets and another error message. The return of

:11:07. > :11:19.the Commonwealth Batten has been going smoothly.

:13:45. > :13:50.switching to marathons but had not done too well and his court said to

:13:51. > :13:55.him he should not run marathons and 2016 so we do not know what event he

:13:56. > :13:57.will be running, but he simply said, see you in Glasgow.
