:00:26. > :00:31.topic of conversation among MSPs is the fall-out from John Swinney's

:00:31. > :00:35.Budget statement yesterday, the spending implications and plans and

:00:35. > :00:41.attempts to reshape the public sector. That imposition on

:00:41. > :00:45.retailers to sell alcohol and tobacco, loads to talk about. The

:00:45. > :00:51.these and other matters will come up in questions to the First

:00:51. > :00:56.Minister. We now go to the chamber and my colleague, Glenn Campbell.

:00:56. > :01:01.Questions at the moment on Freedom of Information and would be

:01:01. > :01:06.Government make plans to extend the cover to other areas. We have also

:01:06. > :01:12.had questions on transport, shared equity schemes, whistle blowing in

:01:13. > :01:19.the National Health Service, such is the variety of question time

:01:19. > :01:24.here in Holyrood. We are now heading towards the main event,

:01:24. > :01:28.questions to the First Minister, and as Brian was saying I think

:01:28. > :01:32.that the budget and plans the Scottish Government has for

:01:32. > :01:36.spending over the next three years will probably dominate. Iain Gray

:01:36. > :01:40.for Labour goes first, and it is the Conservatives' turn.

:01:40. > :01:45.Question number one, Iain Gray. To ask the First Minister what

:01:45. > :01:51.engagements he has planned for the rest of the day. The I am delighted

:01:51. > :01:57.to say later today and will be meeting with a chief executive

:01:57. > :02:02.whose company is to establish a new centre of excellence in Broxburn

:02:02. > :02:08.creating 250 new jobs and safeguarding 1,000 others.

:02:08. > :02:12.Among the new jobs will be up to 100 modern apprenticeships, which

:02:12. > :02:17.will use public support as a lever for job creation and training

:02:17. > :02:27.opportunities. I know the whole chamber will will come this latest

:02:27. > :02:28.

:02:28. > :02:33.in a long line of welcome additions. The Labour has been a big supporter

:02:33. > :02:39.of moderate apprenticeships. 100 modern apprenticeships are

:02:39. > :02:44.always welcome but there are 172,000 young Scots unemployed.

:02:44. > :02:47.Those are levels last seen under the Tory Government in 1992. Why on

:02:47. > :02:54.earth did the First Minister cut further education in his Budget

:02:54. > :02:58.yesterday. -- in his Budget yesterday? I am glad that Iain Gray

:02:58. > :03:06.welcomes modern apprenticeships. Can we just have remembered Modern

:03:06. > :03:10.apprenticeship snow in Scotland, at 25,000 per year for the next five

:03:10. > :03:19.years, are 60 % higher than the level inherited from the Labour

:03:19. > :03:29.Party. As Iain Gray notes, in terms of the Budget, the remarkable

:03:29. > :03:33.things that funding for further and higher education has produced is

:03:33. > :03:37.against cuts in Westminster that are the worst in a generation.

:03:37. > :03:41.Many of those modern apprenticeships are delivered by

:03:41. > :03:49.Scotland's colleges. He cut a further education last year, and

:03:49. > :03:53.has cut it again in real terms by 20 %. I spoke to Scotland's

:03:53. > :03:59.colleges today. They do not believe they can sustain their contribution

:03:59. > :04:03.to the apprenticeships with this scale of cuts. 1,000 jobs have

:04:03. > :04:10.already gone from our colleges and it is clear student places are next.

:04:10. > :04:18.Last week, Microsoft will does he will shut colleges. -- Mike Russell

:04:18. > :04:25.told as he will shot colleges. Let us have the truth about the

:04:26. > :04:29.education cuts. How many colleges will they get rid of? 10, 20 or 30?

:04:29. > :04:34.A if we are dealing with truth, let's be accurate about what was

:04:34. > :04:41.said. Mike Russell talked about mergers with colleges being

:04:41. > :04:48.productive. As indeed we have had recently in the City of Glasgow,

:04:48. > :04:50.which was even supported by the Labour Party in that great city.

:04:50. > :05:00.The 25,000 modern apprenticeships per year it will be achieved in

:05:00. > :05:01.

:05:01. > :05:08.Scotland, as well the 100,000 training places, and our Investment

:05:08. > :05:18.in post 16 education will rise from 1.9 2 billion to 1.99 bn, an

:05:18. > :05:20.

:05:20. > :05:25.increase of 3.5 %. -- 1.9 2 billion to 1.99 bn. I would have thought

:05:26. > :05:30.just a passing mention from Iain Gray in welcoming opportunities for

:05:30. > :05:36.all, and training opportunity for every young stuff between the ages

:05:36. > :05:39.of 16 to 19 in Scotland, would have come. He that not something this

:05:39. > :05:48.entire Parliament should unite behind?

:05:48. > :05:55.Yes, indeed, I agree absolutely with the SNP's George Kevin, who

:05:55. > :06:00.referred to this policy as being from straight out of the Labour's

:06:00. > :06:04.manifesto, but that is the trouble with that. The trouble is, those

:06:04. > :06:09.who has to deliver these training places do not believe they will be

:06:09. > :06:14.able to do it when they'd have to deliver a 20 % cut. Back in the 90s,

:06:14. > :06:19.when we had youth unemployment like this, even the Tories created new

:06:19. > :06:26.colleges and universities to expand opportunity. But this Government

:06:26. > :06:33.will close them down. It is not just colleges - he is going to get

:06:33. > :06:39.rid of universities, too. Everyone knows Mike Russell has a hit list,

:06:40. > :06:45.so let us have the truth. Which universities has he decided to

:06:46. > :06:50.close? I Noel Iain Gray, throughout his

:06:50. > :06:57.time as Labour Leader, has led with his chin at First Minister's

:06:57. > :07:00.Questions, but this takes the biscuit. Has he seen any of the

:07:00. > :07:05.statements from university principals over the last 24 hours?

:07:05. > :07:09.The convenor of universities - this is a significant investment in

:07:09. > :07:12.Scotland's universities, one which will put the sector won a

:07:12. > :07:18.competitive footing for the future. The Scottish Government has closed

:07:18. > :07:25.the funding gap facing Scottish universities. Convenor of

:07:25. > :07:34.universities Scotland - the Scottish Government continues to

:07:34. > :07:38.give over �1 billion per year to the Scottish economy. Best of all,

:07:38. > :07:42.Professor Anton muscatel lake, someone who has not always been the

:07:42. > :07:52.most enthusiastic person for the Scottish Government, he should have

:07:52. > :07:55.his day today. I strongly welcomed the announcement of the Scottish

:07:55. > :08:00.Government's Spending Review. This is a fantastic commitment by the

:08:00. > :08:06.Scottish Government which the Leeds the funding of the -- which fully

:08:06. > :08:10.meets the needs of higher education in Scotland. Given that endorsement,

:08:11. > :08:17.will Iain Gray find it in his heart to realise the Scottish Government

:08:17. > :08:23.are investing in the future of Scotland?

:08:23. > :08:27.The fact is, the First Minister is going to close that Professor's --

:08:27. > :08:37.is not going to close that Professor's University, he is going

:08:37. > :08:42.

:08:42. > :08:52.to close above take university. 500 staff at 5,000 students. -- Abertay

:08:52. > :08:58.University. They are top of Mike Russell's hit list. Will the First

:08:58. > :09:03.Minister tell us, is he going to close that a university?

:09:03. > :09:08.I read out the vice convener of universities Scotland's statement,

:09:08. > :09:13.and I have already pointed out that Iain Gray twice in this session has

:09:13. > :09:16.totally misrepresented the Education Secretary. Given that

:09:16. > :09:20.nobody in this country believes the Labour Party, if they had been in

:09:20. > :09:27.Government, would have funded our universities to anything like this

:09:27. > :09:36.extent, can Iain Gray find it in himself to agree with university

:09:36. > :09:43.Scotland, -- universities Scotland, that this is a fantastic settlement

:09:43. > :09:49.for Scotland. Annabel Goldie.

:09:49. > :09:56.To ask the First Minister at - I read in the Scottish newspapers he

:09:56. > :10:00.likes to be styled excellence lay - when he plans to meet the Secretary

:10:00. > :10:04.of State for Scotland. I have no plans to meet the

:10:05. > :10:08.Secretary of State for Scotland in the near future.

:10:08. > :10:15.The First Minister likes to wax lyrical about the powers he does

:10:15. > :10:19.not have, like corporation tax. Can I ask the First Minister how many

:10:19. > :10:24.businesses in Scotland would benefit for his recent proposals

:10:24. > :10:34.for a corporation tax cut? It would create tens of thousands

:10:34. > :10:34.

:10:34. > :10:40.of new jobs in Scotland. I heard from the CBI that they were

:10:40. > :10:48.thoroughly in favour of such a move. It was the CBI of Northern Ireland,

:10:48. > :10:56.of course, who saw the advantages of such a move! I wonder why the

:10:56. > :11:01.CBI in Scotland cannot follow their example. I notice that only two

:11:01. > :11:05.places along the bench from Annabel Goldie is David McLetchie. If I

:11:05. > :11:09.remember correctly, he signed up to the declaration of Wendy Alexander

:11:09. > :11:14.that if any other country had Palmer's over corporation tax, this

:11:14. > :11:18.Parliament and this Government should have them as well.

:11:18. > :11:23.It is not the CBI or David McLetchie who is sitting over there

:11:23. > :11:28.to answer questions, it is the First Minister. That is not the

:11:28. > :11:31.question I asked. Let me give them an answer, because he does not want

:11:31. > :11:38.to admit it. According to the Scottish Parliament's own research,

:11:38. > :11:43.fewer than 3% of all businesses in Scotland would benefit. By the

:11:43. > :11:50.Government's own admission, the creation of their estimated 27,000

:11:50. > :11:54.new jobs by reducing corporation tax would take 20 years. I am all

:11:54. > :11:59.in favour of cutting tax for business, but the First Minister

:11:59. > :12:05.has attacks power he can use now, and it is called business rates,

:12:05. > :12:10.paid by the vast majority of all businesses in Scotland, not just 3%.

:12:10. > :12:20.In a press release from the Deputy First Minister, no less, we are

:12:20. > :12:25.

:12:25. > :12:35.told that the small business bonus - delivered by the Conservatives...

:12:35. > :12:36.

:12:36. > :12:41.Without the votes from these benches there would be no small

:12:41. > :12:45.business bonus. That deliverance created 40,000 new jobs in just 40

:12:45. > :12:53.years at a fraction of the cost of the First Minister's proposal for

:12:53. > :12:57.corporation tax, so why on earth was yesterday's budget silent on

:12:57. > :13:03.extending more help to more businesses, large and small, to cut

:13:03. > :13:07.their businesses -- to cut their business rates and create more jobs

:13:07. > :13:11.are now? I don't know if Annabel Goldie

:13:11. > :13:15.bothered to look at the reaction of the Small Business Federation to

:13:15. > :13:19.yesterday's budget, but it was incredibly enthusiastic, both about

:13:19. > :13:24.closing the disparity between small retailers and larger retailers in

:13:24. > :13:30.terms of the measures taken, but in particular the continuation of the

:13:30. > :13:34.small business bonus. The most extraordinary, fantastic incentive

:13:34. > :13:42.helping 80,000 businesses across Scotland and giving small business

:13:42. > :13:46.at �3,000 advantage over businesses elsewhere in these islands. One of

:13:46. > :13:50.the great things about being a majority Government is that Annabel

:13:50. > :13:58.Goldie will no longer be able to claim the credit for SNP policies.

:13:58. > :14:03.I put it to Annabel Goldie, let me put it as simply as possible as a

:14:03. > :14:07.matter of arithmetic, given we know longer depend on the faults of the

:14:08. > :14:12.Conservative Party in this Budget, does it not follow that the

:14:12. > :14:16.decision to continue with the small business bonus, this fantastic

:14:16. > :14:21.scheme benefiting 80,000 small businesses across Scotland, must

:14:21. > :14:28.now, by definition, be entirely the responsibility of this SNP

:14:28. > :14:32.Government? Constituency question.

:14:32. > :14:37.Thank you, Presiding Officer. Since Iain Gray did not get an answer to

:14:37. > :14:41.his final question, can the First Minister confirmed what was

:14:41. > :14:44.reported in the Herald on Monday that the Cabinet Secretary for

:14:44. > :14:50.Education is in favour of above tape and Dundee University's

:14:50. > :14:56.merging? That is not what Iain Gray asked.

:14:56. > :15:01.As I tried to point out a number of times, Iain Gray twice said that

:15:01. > :15:05.the Cabinet Secretary had proposed the closure of further and higher

:15:05. > :15:08.education institutions. The Cabinet Secretary never did any such thing,

:15:08. > :15:16.he opened up the possibility of mergers as we have seen that

:15:16. > :15:20.mergers in the sector before. I am sure that she knows the College of

:15:20. > :15:26.Art in Edinburgh or merged recently with the University of Edinburgh.

:15:26. > :15:35.In terms of accuracy, I know she asked her? Much more carefully than

:15:35. > :15:38.her current party leader. Perhaps a candidacy may be in the offing.

:15:38. > :15:43.Mergers of higher education institutions have happened many

:15:43. > :15:52.times in Scottish education history, and it is entirely different from

:15:52. > :15:56.The First Minister will be aware of the fast resignation of the

:15:56. > :15:59.monitoring group set up by the Health Secretary and they did so

:15:59. > :16:02.because they felt their pews were substantially ignored by the Health

:16:02. > :16:06.Board and that is demonstrated by their proposal to close the ward

:16:06. > :16:13.which provides in-patient mental health services. On the basis on

:16:13. > :16:16.the increase of cases, that means an inability to cope and patience

:16:16. > :16:19.to my committee being sent to Lanarkshire and Ayrshire. Well he'd

:16:19. > :16:25.meet with me and the lay members concerned to discuss their

:16:25. > :16:29.concerns? I'm sure the Health Secretary will be glad to agree to

:16:29. > :16:33.that and we are disappointed by the decision of lay members and we were

:16:33. > :16:37.grateful to the monitoring group for their input into the

:16:37. > :16:43.supplementation. We are fully aware of the strength of feeling in

:16:43. > :16:47.support of the ward and that is by Abe Kaplan secretary published this

:16:47. > :16:51.in 2009 and therefore the Health Secretary will be delighted to meet

:16:51. > :16:55.with the members to pursue these talks and I would as gently as I

:16:55. > :17:00.can point out to Jackie Baillie that if it had been up to Jackie

:17:00. > :17:08.Pele and the Labour Party, there would not being at the lovely Downe

:17:08. > :17:11.hospital to have these talks. -- Dave Vale of leaves. Does the

:17:11. > :17:15.Scottish Government plan to impose a cap on the gusts of the railway

:17:15. > :17:21.project in the borders? A community to delivering the Borders railway

:17:48. > :17:52.timescales referred to in the meeting are consistent with our

:17:52. > :17:59.programme on budget and by 20th December 14. We have publicly put

:18:00. > :18:02.the construction figure between 235 and �225 million. The Minister for

:18:02. > :18:05.Transport will make an announcement on the future delivery of this

:18:05. > :18:12.project in the near future and it would like to add to things. The

:18:12. > :18:17.track record of delivering huge budgets under budget, the end 74

:18:17. > :18:22.and the end 84, is impeccable compared to the last administration

:18:22. > :18:27.and when he was transport minister, not only did he not 0.1 penny into

:18:27. > :18:31.the borders will a project, which she claimed to be supporting, but

:18:31. > :18:38.he was a major sponsor of the Private Finance Initiative which

:18:38. > :18:45.only this week yet again we have seen details other cost to future

:18:45. > :18:51.generations of Scots from that misguided policy. Can I further

:18:51. > :18:57.reminder First Minister that on the Labour lead them watch, the

:18:57. > :19:04.sterling allowed to Cartland line went to �85 million and was two

:20:00. > :20:05.around the borders to believe that trains will road into the

:20:05. > :20:08.communities in 2014 when the timetable keeps going back and back

:20:08. > :20:17.and the Minister for Transport in 2009 stated that the contract...

:20:17. > :20:22.Your question? Can he give us some specific date as to win we can all

:20:22. > :20:28.go online and book tickets to Galashiels? Can I repeat what I

:20:28. > :20:32.said. The timescales referred to in the media are consistent with the

:20:32. > :20:37.programme for delivering the Borders railway on budget and by

:20:37. > :20:42.20th December 14. And the confidence that he can have in that

:20:42. > :20:46.statement is based on the confidence and the strong delivery

:20:46. > :20:49.record of Transport Scotland in terms of this Government's term of

:20:49. > :20:55.office, which in project after project has been delivered on time

:20:55. > :20:58.and on budget. We should not allow the mistakes of the past committed

:20:58. > :21:08.by other parties to do his confidence in the ability of this

:21:08. > :21:11.Government to find a way to deliver this project on time and on budget.

:21:11. > :21:14.What recent discussions has the Government had with the UK

:21:14. > :21:19.government regarding transmission charges for companies wishing to

:21:19. > :21:24.connect to the UK grid? Scottish Government and Indeed

:21:24. > :21:26.supported by other voices across this chamber have long argued that

:21:26. > :21:31.rapidly-changing the energy sector and the current charging regime

:21:31. > :21:36.makes no sense and must be changed. Scotland has some of the greatest

:21:36. > :21:40.low carbon energy areas in Europe yet depressing approach sees

:21:40. > :21:44.Scotland generally in the areas of the highest renewable resource and

:21:44. > :21:47.paying the highest charges. We have substantial hopes that we will be

:21:47. > :21:51.on the brink of a breakthrough of this matter and we are still

:21:51. > :22:00.confident of a better outcome but I would like to see the decoration

:22:00. > :22:06.from OFGEM sooner rather than later. Thank you. Earlier this week,

:22:06. > :22:13.Scottish renewables Chief Executive proposed 1600 megawatts of wave and

:22:13. > :22:17.tidal projects planned for Orkney waters and they face an annual

:22:17. > :22:24.charge of �56 million compared to an �11 million subsidy if they were

:22:24. > :22:30.on the south-west coast of England. Is there any case for this unfair

:22:30. > :22:35.discrepancy in charges? And when the First Minister again urge the

:22:35. > :22:40.UK government to look again at this issue? I have pressed this issue

:22:40. > :22:44.and many times with the previous and current government. I have my

:22:44. > :22:49.most recent letter for the Secretary of State for Energy and

:22:49. > :22:53.climate change when I argued for a level playing field. Mr Sheehan's

:22:53. > :22:56.most recent response indicated broad agreement with that. Can I

:22:56. > :23:01.remind people across the chamber that the last time this was voted

:23:01. > :23:04.for in this Parliament, it was carried with no votes against and

:23:04. > :23:09.there should be a more equitable approach to transmission charging

:23:10. > :23:16.across the UK. One that did not discriminate against Scotland and

:23:16. > :23:21.parts of Scotland in particular. The result of that division was 457

:23:21. > :23:23.against, carrying the support of the main parties. 52 abstentions

:23:23. > :23:26.and I do not understand why the Conservatives and Labour parties

:23:27. > :23:30.could not find it in their hard to argue that Scottish generators

:23:30. > :23:40.should get an equal deal to mobilise the great resources of

:23:40. > :23:40.

:23:40. > :23:43.Scotland? The First Minister has welcomed the project transmit

:23:43. > :23:47.undertaken by the current government and I'm sure he will

:23:47. > :23:51.welcome the extension to the time frame for the project to allow all

:23:51. > :23:56.of these issues to be fleshed out but he will have noticed from

:23:56. > :23:58.Scottish renewables and their report about the large

:23:58. > :24:02.discrepancies, particularly in Ireland areas and does he think

:24:02. > :24:09.there is a case for separating the issues relating to Ireland areas

:24:09. > :24:13.compared to the rest of the UK? They should not be any log jam. We

:24:13. > :24:19.have every reason to believe that the announcements from OFGEM which

:24:19. > :24:26.were expected this autumn would bring about the closing of this

:24:26. > :24:28.massive disparity and we believe we have the support of the United

:24:28. > :24:31.Kingdom Secretary for energy and cannot change and we are still

:24:31. > :24:37.confident that we will get a resolution of this long-standing

:24:37. > :24:43.and quite disgraceful piece of discrimination. I am surprised to

:24:43. > :24:49.hear the member welcomed the delay in coming to that conclusion. Our

:24:49. > :24:52.belief was that he would have a resolution this autumn and why it

:24:52. > :24:56.is so important is that the decisions and the investment

:24:56. > :25:01.decisions cannot wait for OFGEM to have another six months of talking

:25:01. > :25:06.when we need action and we believe we had at principled agreement that

:25:06. > :25:12.action would be taken so I know that Liam will add his for us to

:25:12. > :25:20.the many voices across Scotland who say this disparity must be closed

:25:20. > :25:24.and closed now. What action is the Scottish Government taking

:25:24. > :25:31.following the loss of 1000 jobs in the further education sector over

:25:31. > :25:34.the last year? It is important for every member that he will protect

:25:34. > :25:40.college places for young Scots and we are providing a record number of

:25:40. > :25:44.training opportunities, including a commitment to their awarding of a

:25:44. > :25:48.training place to all 16 - 19 year- olds and reform that means we can

:25:48. > :25:51.deliver these opportunities for young Scots. The Government has

:25:51. > :25:54.reiterated the causes and principles and the importance of

:25:54. > :26:01.avoiding compulsory redundancies and that is something being

:26:01. > :26:05.achieved in almost every college. would be intrigued to know how

:26:05. > :26:10.yesterday's announcement of 20% cuts in colleges budgets is going

:26:10. > :26:15.to help prevent future job losses. I am glad he mentioned college

:26:15. > :26:18.places because it would like to ask him a further question. Can the

:26:19. > :26:24.First Minister guarantee that despite these cuts, he will meet

:26:24. > :26:29.his own election manifesto promise to maintain the number of college

:26:29. > :26:33.places for Scotland's students over the lifetime of this Parliament?

:26:33. > :26:39.will make not just that manifesto commitment but the other manifesto

:26:39. > :26:43.commitments which were so strongly supported by the Scottish people.

:26:43. > :26:48.As far as a compulsory redundancies are concerned, I would welcome

:26:48. > :26:50.again at the Labour Party's support for the urging of the education

:26:50. > :26:55.ministers and urging the colleges to go down the road of other

:26:55. > :26:59.aspects of public sectors in the control of this government and

:26:59. > :27:07.avoiding compulsory redundancies. I should say that many colleges have

:27:07. > :27:13.already given that commitment. the First Minister agree that there

:27:13. > :27:17.is nothing more inspirational for fans and players alike than the

:27:17. > :27:20.sound of the pipes. Does he share the disappointment of hundreds of

:27:21. > :27:29.Scottish fans who have travelled halfway across the world to support

:27:29. > :27:36.the national team... Excuse me... I'm sorry. That has nothing to do

:27:36. > :27:39.with the question posed. Question number six... To as the first but

:27:39. > :27:42.as to whether the Scottish Government has received a response

:27:42. > :27:46.from the Advocate-General to the final report of the review of the

:27:46. > :27:52.relationship between a High Court and the Supreme Court in criminal

:27:52. > :27:56.cases? I understand the Advocate General wrote yesterday indicating

:27:56. > :27:59.that he would reflect further on their conclusions of the review and

:27:59. > :28:04.the group has recommended a resolution to the clear anomaly

:28:04. > :28:06.where an appeal to the UK Supreme Court is refused by the highest

:28:06. > :28:11.court in Scotland but there is still potential for leave to be

:28:11. > :28:16.granted. That isn't possible for cases coming from English courts
