:00:20. > :00:25.Good evening. This is BBC Newsline with Donna Traynor and Noel

:00:25. > :00:29.Thompson. The headlines this Tuesday evening.

:00:29. > :00:35.They Ballymena man who raped a pensioner had been out of prison

:00:35. > :00:39.for just two days. He had raped before that. He got out and raped

:00:39. > :00:42.someone else. It is claimed that the son of one of the Troubles most

:00:42. > :00:45.notorious terrorists was the getaway driver in the Massereene

:00:45. > :00:49.murders. Where men move into try to prevent

:00:49. > :00:53.any more landslides at homes in Londonderry.

:00:53. > :00:58.PGA referee quits after a club involved in a mass brawl was given

:00:59. > :01:05.a reprieve. A white some of our top sports men and women may miss out

:01:05. > :01:07.on a place in next year's Olympic Games. And after today's chill, it

:01:07. > :01:16.might temperatures tomorrow will be closer to those of mid-to-late

:01:16. > :01:21.April. The police have defended how sex offenders are monitored in the

:01:21. > :01:25.community after news that a Ballymena man raped a 74-year-old

:01:25. > :01:29.woman within two days of being freed from custody. 26-year-old

:01:29. > :01:32.Barry Johnston will be sentenced next month for what has been

:01:32. > :01:35.described as a vicious and diabolical crime. A group which

:01:36. > :01:39.works with rape victim says the case raises serious questions

:01:39. > :01:46.because Johnston had not only been convicted for a previous rape, but

:01:46. > :01:50.had also breached the sex offences order. The court was told that

:01:50. > :01:56.Barry Johnston's elderly victim had pleaded with him after he entered

:01:56. > :02:03.her house in August last year. The pensioner said to him, have mercy

:02:03. > :02:06.on me, I am an old woman. He went ahead and rector. After the attack,

:02:06. > :02:11.he told her not to reported, but she confided in a neighbour and the

:02:11. > :02:15.police were alerted and Johnston was arrested on the basis of DNA

:02:15. > :02:20.evidence. Johnston has a previous rape conviction and had served a

:02:20. > :02:24.sentence. The latest attack happened two days after he was

:02:24. > :02:30.released from custody for breaching a sex offences order in relation to

:02:30. > :02:33.that prior conviction. A rape victims' group said it is concerned.

:02:33. > :02:38.Obviously there are different categories of sex offenders and I

:02:38. > :02:44.cannot category --, De more category he was in. There should

:02:44. > :02:51.have been more robust protocols put in place, because someone has been

:02:51. > :02:55.grievously damaged as a result of this. In the vast majority of cases,

:02:55. > :02:59.these work, but in this case, we cannot always predict what will

:02:59. > :03:02.happen and unfortunately these things do happen. The PSNI

:03:02. > :03:06.described the attack on the pensioner as horrendous and

:03:07. > :03:10.diabolical. The court was told that Barry Johnston's victim was at risk

:03:10. > :03:15.of suffering from clinical depression and was unlikely to

:03:15. > :03:24.return it to be the person she was before the attack. Johnston also

:03:24. > :03:28.admitted possessing drugs and will be sentenced here on sixth January.

:03:28. > :03:32.A son of one of Northern Ireland's most notorious terrorists, Dominic

:03:32. > :03:36.McGlinchey, has been named in court as the getaway driver in the murder

:03:37. > :03:40.of two soldiers at Massereene Barracks. The claim was made by a

:03:40. > :03:49.barrister representing Colin Duffy, one of two men accused of the

:03:49. > :03:54.murders. Dominic McGlinchey, a self-confessed killer, was shot

:03:54. > :03:58.dead in chocolate heir in 1994. Today, the court was told that one

:03:58. > :04:02.of his sons was the driver of the car used during the attack in

:04:03. > :04:09.Massereene Barracks which code soldiers' Mark Quinsey and Patrick

:04:09. > :04:13.Azimkar. The claim was made by the defence barrister For: Duffy. He

:04:13. > :04:18.told the court that police have reliable information to indicate

:04:18. > :04:21.that one of the McGlinchey sons drove the car. He said both Dominic

:04:21. > :04:26.junior and his brother Declan had been arrested and questioned about

:04:26. > :04:30.the offences. The court also heard from Colin Duffy's wife. She said

:04:30. > :04:33.her husband had been at home on the night of the attack, that she

:04:34. > :04:38.remembered the date because they had been tired after attending a

:04:38. > :04:41.friend's wedding the day before. Martine Duffy said she believed the

:04:41. > :04:45.attack on the soldiers was absolutely terrible and she

:04:45. > :04:51.believed those responsible should be cut. It is awful she said that

:04:51. > :04:53.my husband should be accused of it, but summing up the case, the

:04:54. > :04:58.prosecution barrister Terence Mooney said there could be no

:04:58. > :05:02.innocent explanation for DNA been found in the getaway car,

:05:03. > :05:06.particularly Colin Duffy's on the tip of a latex glove for. He said

:05:06. > :05:11.it was related to the attack and was obviously present and had

:05:11. > :05:14.become detached from a glove worn by a terrorist who was trying to

:05:14. > :05:18.prevent traces of forensic material which could make a link between the

:05:19. > :05:24.terrace, the car itself and the attack. The court is entitled to

:05:24. > :05:27.draw inferences adverse to Duffy because he failed to give evidence.

:05:27. > :05:31.But Barry MacDonald QC said they were such complete absence of

:05:31. > :05:36.evidence against Colin Duffy that the prosecution did not know what

:05:36. > :05:39.case to make against 10. He said he was not a gun man nor of the driver

:05:39. > :05:44.of the car and inviting the just to draw an inference for him failing

:05:44. > :05:51.to take the stand was dangerous and entering a miscarriage of justice

:05:51. > :05:55.territory. The case continues. A man charged with the murder of a

:05:55. > :05:59.Crossmaglen man in Duntocher has been found dead in a holding cell

:05:59. > :06:03.at Dublin court house. Shane Rogers was accused of shooting the man 10

:06:03. > :06:08.days ago and was on suicide watch. It is understood he took his own

:06:08. > :06:11.life. The Prison Service and Bacardi are investigating.

:06:11. > :06:14.On BBC Newsline last night we reported that the police were

:06:14. > :06:17.investigating six allegations of abuse at Lissue Children's Hospital

:06:17. > :06:22.and Forster Green Hospital it, including one which was alleged to

:06:22. > :06:25.have happened this year. This was based on a request made to the

:06:25. > :06:29.police under the Freedom of Information Act. The police have

:06:29. > :06:34.now clarified that they are not investigating any reports of abuse

:06:34. > :06:38.from this year. He now the latest on the dangerous

:06:39. > :06:43.wall that has caused landslides behind -- beside terraced housing

:06:43. > :06:47.in Londonderry. Work by contractors to secure the area in and around

:06:47. > :06:50.Marlborough Terrace began this afternoon with emergency funding

:06:50. > :06:55.coming from the Department of the Environment. Kevin Sharkey has been

:06:55. > :07:01.reporting since the first landslide last week. We were told a residents

:07:01. > :07:05.may have to leave their homes because of the danger? Well, they

:07:05. > :07:08.have not had to leave their homes and I contended there is a lot of

:07:08. > :07:13.relief at that, because it is Christmas week and who wants to

:07:13. > :07:18.have to leave their homes during Christmas week? If there was relief

:07:18. > :07:25.at this, there is even more relieved that the clear up after a

:07:25. > :07:31.long, hard and anxious week is now underway. The force of nature

:07:31. > :07:37.brought much of this wall down, now it is the turn of man and machine.

:07:37. > :07:41.They are making it safe. This is how a quarter of a million pounds

:07:41. > :07:46.is helping to stabilise a huge bit of earth, and dangerous land bank

:07:46. > :07:52.behind one row of terraced housing above another. It collapsed in the

:07:52. > :07:59.last week twice. It smashed a band and two cause and wrecking a car

:07:59. > :08:03.workshop, leaving this community facing safety and health risks. Now,

:08:03. > :08:10.almost a week after that first landslide, action. Contractors

:08:10. > :08:13.accompanied by heavy machinery and heavier materials, a week-long

:08:13. > :08:19.crisis needing this emergency response. This is a story of

:08:19. > :08:25.families, their fears and worries. Lives disrupted in Christmas week.

:08:25. > :08:33.Today, a little irony, a lot of noise at bringing calm and

:08:33. > :08:36.reassurance to the people living here. Well, there is a lot of

:08:36. > :08:46.relief around a Marlborough Terrace that this work is now under way

:08:46. > :08:47.

:08:47. > :08:49.after such a difficult week. I am joined by a member of Derry city

:08:49. > :08:53.Council. Relief from everyone concerned? Absolutely. The

:08:53. > :08:56.contractor was appointed first thing this morning and as you can

:08:56. > :09:01.see, there is a considerable rump above activity and a large amount

:09:01. > :09:05.of work has been completed to stabilise some of the priority

:09:05. > :09:12.areas and there is a programme of work advanced over the next couple

:09:12. > :09:15.of days. Thank you. Derry city Council has been playing a lead

:09:16. > :09:19.role along with other agencies including the Department of the

:09:19. > :09:24.Environment, but most of all this story is about people and families

:09:24. > :09:30.and residents, among them this woman. Marion, it has been a long

:09:30. > :09:40.and difficult week for you. Very stressful. Very worrying for

:09:40. > :09:43.everyone. Bank got it is started. I would like to thank everyone.

:09:43. > :09:49.Everyone will be safe and well and we will all have a nice Christmas

:09:49. > :09:54.and sleep the better. Thank you for joining us. It has been such a

:09:54. > :10:00.difficult week for all concerned. Everyone is very happy comet with

:10:00. > :10:03.days to go to Christmas, that this work is now under way. Thank you.

:10:03. > :10:06.A formal Anglo-Irish Bank at a factory in County Cavan under

:10:06. > :10:10.surveillance after hearing that the businessman Sean Quinn was planning

:10:10. > :10:15.to start a new company there. The details emerged during a High Court

:10:15. > :10:18.hearing with the bank is trying to have this bankruptcy in Northern

:10:18. > :10:24.Ireland over terms. The bank says that Sean Quinn who until recently

:10:24. > :10:27.was reported to be Ireland's richest man, close at about 2.4

:10:27. > :10:32.billion. Arab business correspondent Kevin Magee has the

:10:32. > :10:36.latest on the court challenge. Sean Quinn's bankruptcy in Northern

:10:36. > :10:43.Ireland has been challenged by lawyers from the former anger --

:10:43. > :10:49.Anglo-Irish Bank. They argue that he is based in the Republic and

:10:50. > :10:54.should have been the bank up there. He would face much longer periods

:10:54. > :10:56.of disqualification there. He claims the centre of his business

:10:56. > :11:01.interest has a whole has always been in Derrylin in County

:11:01. > :11:05.Fermanagh. Mr Quinn's barrister said the affairs of the Quinn

:11:05. > :11:10.family were conducted from Derrylin and it was custom and practice for

:11:10. > :11:13.the banks to send all Quinn family correspondence to the former Queen

:11:13. > :11:18.headquarters in Derrylin. He said that Mr Quinn as the UK National

:11:18. > :11:21.Insurance number and was drawing the UK state pension. After the

:11:21. > :11:26.bank effectively told him to leave his Derrylin headquarters, he says

:11:26. > :11:30.he moved to another premises in this industrial park, but the bank

:11:30. > :11:35.insists his business is really best -- based where he lives south of

:11:35. > :11:38.the border. Earlier, the court was told by the Bank that it had

:11:39. > :11:44.engaged a security firm to gather information on Mr Quinn after it

:11:44. > :11:48.had seen rumours on a wet side that he was planning to start a new

:11:48. > :11:51.business in the disused factory in County Cavan. It was denied that Mr

:11:51. > :11:55.Quinn were members of his family had been watched by the Dublin-

:11:55. > :11:59.based security firm. He said that people born not been followed and

:11:59. > :12:06.that surveillance was too strong a word for what was happening.

:12:06. > :12:09.Judgment has been reserved and will be delivered in the New Year.

:12:09. > :12:12.A GAA referee has said he is quitting the game because sanctions

:12:12. > :12:16.imposed on a club whose members attacked him have been watered down

:12:16. > :12:19.on appeal. Ray Matthews was assaulted in the autumn and the

:12:19. > :12:25.club from Rasharkin in County Antrim was banned from competition.

:12:25. > :12:29.Now it has been told will be allowed to play. It was the day the

:12:29. > :12:33.GAA laid down a marker to its members. Lengthy bands and

:12:33. > :12:37.expulsions for 10 people from Rasharkin's GAA club involved in an

:12:37. > :12:42.assault on a referee. The plant itself kicked out of senior hurling

:12:42. > :12:47.and football for the entire year. It was an attack on Ray Matthews

:12:47. > :12:51.Bitts Park debt. He was the victim of a sustained physical assault

:12:51. > :12:55.after a close-fought and controversial under 21 match in

:12:55. > :13:03.October. Another of the officials who was there described the scene

:13:04. > :13:09.it to BBC Newsline at the time. those people had not been there, we

:13:09. > :13:15.would not have stood a chance. were fearful for you live? I were

:13:15. > :13:18.not say for my life, but from a good kicking, yes. Antrim county

:13:18. > :13:22.board which handed out the sanctions was praised for its

:13:22. > :13:27.stance, tackling the kind of thuggish behaviour which Mars GAA

:13:27. > :13:31.matches and indicating that match officials would be protected.

:13:31. > :13:35.Rasharkin did not question the individual sanctions but did appear

:13:35. > :13:40.that a band to the Ulster Council and it has now been rescinded.

:13:40. > :13:45.Rasharkin GAA will be able to play in senior competition but will not

:13:45. > :13:49.have home fixtures and that move has angered Ray Matthews who today

:13:49. > :13:53.told BBC Newsline that he decided to quit over it. He said that he

:13:53. > :13:58.feared for his life the day of the assault and that he was extremely

:13:58. > :14:04.annoyed, disappointed and disgusted at the appeal decision. Referees he

:14:04. > :14:07.said had been left high and dry by what had happened. There are two

:14:07. > :14:13.schools of thought in the GAA about this. The first is that by banning

:14:14. > :14:18.the entire club, the Antrim county board was that -- punishing all the

:14:18. > :14:21.members for something only some of them were involved in. If the GAA

:14:21. > :14:25.is serious about tackling violence in sport, it suggests, particularly

:14:25. > :14:30.those directed at match officials, it has to stand by the sanctions

:14:30. > :14:40.and that by watering them down, the Ulster Council is sending GAA fans

:14:40. > :14:40.

:14:40. > :14:46.Still to come: They drive the fastest cars in the world but that

:14:46. > :14:55.is not all they have in common. And Santa's helpers get ready for

:14:55. > :15:00.their big night. They are all of them in their.

:15:01. > :15:06.250 motorists have been called -- caught drinking and driving in the

:15:06. > :15:11.past few weeks. The three were four times over the alcohol limit. So

:15:11. > :15:16.drunk that they couldn't stand up. If you have been driving out over

:15:16. > :15:20.the last few weeks, you may have been stopped by a police officer.

:15:20. > :15:26.Often it ends up being a friendly chat but the police have court does

:15:26. > :15:31.of motorists who have had too much to drink. Since they started their

:15:31. > :15:37.campaign on 25th November, the police have stopped 250 drink-

:15:37. > :15:42.drivers. That is 28 more than last year. In 2010, fewer people were

:15:42. > :15:47.driving because of the snow. The oldest was 72 and the youngest was

:15:47. > :15:54.16. Some motorists who failed a breath tests were very drunk.

:15:54. > :15:59.highest we have had his 155. The legal prefaced 35 so that is over

:15:59. > :16:03.four times the legal limit. That is falling down drunk are witches

:16:04. > :16:11.utter madness. The risk that they pose to themselves is bad enough

:16:11. > :16:21.but the risk to motorists going about their normal business is vast.

:16:21. > :16:25.TV adverts like this are direct and often graphic. The police say they

:16:25. > :16:32.are disappointed that so many people are still ignoring the

:16:32. > :16:35.warnings. A 34 year-old man has been in court

:16:35. > :16:41.charged with the man's daughter of a Coleraine father of three at the

:16:41. > :16:46.weekend. Colin McLeister died after falling down the stairs at Tayport

:16:46. > :16:53.rush nightclub. The man was charged with unlawful killing on 17th

:16:53. > :16:59.December. Police made -- believe there was a row on that night.

:16:59. > :17:03.A man whose body was found behind a derelict building in Port Stewart

:17:03. > :17:06.last night was Christopher Connor, the 20 year-old from Coleraine. He

:17:06. > :17:11.was reported missing in the area at the weekend.

:17:11. > :17:16.Liam Adams, the brother of Gerry Adams will find out tomorrow if he

:17:16. > :17:21.is to be freed on bail by a -- for the alleged sexual abuse of his

:17:21. > :17:27.daughter. Today, Judge Tom Burgess told the risk of flight was an

:17:27. > :17:34.issue. Liam at L -- Liam Adams denies 18 charges including rape.

:17:34. > :17:41.His daughter has waived the right to anonymity.

:17:41. > :17:44.With only five more sleeps two Christmas Day, at some

:17:44. > :17:50.schoolchildren will be joining us here over the next few days to sing

:17:50. > :17:55.carols. Tomorrow we have Cedar Lodge School from North Belfast.

:17:55. > :17:59.Before the music tonight, we will be in search of Santa's reindeer

:17:59. > :18:04.and they are not all in Lapland. Now for the sport and there could

:18:04. > :18:09.be fewer members of the Irish Olympic team heading to London 2012.

:18:09. > :18:13.Stephen Watson will explain. The Olympic Council of Ireland is

:18:13. > :18:19.existing that athletes must meet a standard times if they want to be

:18:19. > :18:24.part of the Irish team going to the Olympic Games. Local athletes such

:18:24. > :18:31.as Jason Smythe and Melanie Nocher will not be in the team. The

:18:31. > :18:35.council insists their stance is raising standards.

:18:35. > :18:40.Lord Coe giving a guided tour of London's Olympic Park to the woman

:18:40. > :18:44.who has been in charge of team Ireland at next summer's Games. As

:18:44. > :18:48.a former Olympic silver medallist, Sonia O'Sullivan knows what it

:18:48. > :18:52.takes to read the top level of international sport. When it comes

:18:52. > :18:56.to qualifying for the Games, she can appreciate why the Irish

:18:56. > :19:00.officials are demanding a golden entry standards. There has been

:19:00. > :19:05.athletes that have gone to the Olympic Games before and maybe they

:19:05. > :19:10.didn't then that's part. They went there and didn't justify being on

:19:10. > :19:16.the Olympic team and we want to eliminate that. We are looking at

:19:16. > :19:20.athletes that can go out there and make a difference. We don't... It

:19:20. > :19:26.is not that we don't want to shut the door on those that have

:19:26. > :19:31.potential, we want them to take the stepping stones. As things stand,

:19:31. > :19:41.no Northern Ireland track and field athlete will be on the plane next

:19:41. > :19:47.summer. Jason Smythe and Kieran McKeon have only got to the beat

:19:47. > :19:53.qualifying standards. Athletics Ireland officials say that raising

:19:53. > :19:58.the bar is raising standards. have put the standard out there and

:19:58. > :20:03.we have 20 people qualifying. Raise the bar and people step-up to the

:20:03. > :20:11.plate. Coaches agree with the standards and suggest there is room

:20:11. > :20:20.for Lee Wave. As a coach, I said my standards high. Maybe we have too

:20:20. > :20:25.much set in concrete. Some might leave athletics. Maybe we should go

:20:25. > :20:35.the UK it way. They would send athletes for GB and Northern

:20:35. > :20:37.Ireland if they had the standard on a regular basis. The Olympic

:20:38. > :20:42.Council of Ireland says it is determined to stick with its plan

:20:42. > :20:47.for London. Nobody said qualifying would be easy but for some

:20:47. > :20:52.competitors, it is more difficult than ever.

:20:52. > :20:56.They are both from the same town in County Down, drive some of the

:20:56. > :20:59.fastest cars in the world and are previous winners of the breed it --

:20:59. > :21:04.British and racing driver of the year. That is not the only thing

:21:04. > :21:12.the two men have in common. They happen to share the same surname. -

:21:12. > :21:20.- British racing driver of the year. Johnny and Steven Kane's success is

:21:21. > :21:27.not known but they have had great success in America and all over

:21:27. > :21:33.Europe. We came to the same conclusion that we are brothers and

:21:33. > :21:39.both of average height. We are both from Northern Ireland and both of

:21:39. > :21:43.the same name. It is an obvious conclusion for people to come to.

:21:43. > :21:46.We were talking about the possibility that we could be
