:00:00. > :00:36.Good evening, the headlines on BBC Newsline. The father - the family of

:00:37. > :00:48.Barry McGrory who was murdered last week Speaker of their devastation.

:00:49. > :00:52.Health Minister had to say after a Health Minister had to say after a

:00:53. > :00:58.High Court judge described his policy on gay men giving blood as a

:00:59. > :01:03.rational. We have details of the first day of the court case in

:01:04. > :01:07.Dublin when Rory McIlroy takes his management to court. Thousands of

:01:08. > :01:16.motorists are caught up in chaos on the M one. And Ulster rugby players

:01:17. > :01:21.kick off in style. And it looks as if we will get another day of the

:01:22. > :01:32.nice weather before the change arrives later in the week. The

:01:33. > :01:34.Health Minister Edwin Poots says he can't change the current ban on gay

:01:35. > :01:36.men giving blood because the decision's been taken out of his

:01:37. > :01:39.hands. A judge has ruled that the decision's been taken out of his

:01:40. > :01:42.minister's decision to impose the ban was "irrational" and "breached

:01:43. > :01:45.ministerial guidelines". Mr Poots says it's now up to the Health

:01:46. > :01:48.Secretary in Westminster to decide what happens next. Our health

:01:49. > :01:57.correspondent Marie Louise Connolly has been following the story. Blood

:01:58. > :02:02.and fluid it is donated by has now joined a long list of contentious

:02:03. > :02:07.issues in Northern Ireland. Last year England, Scotland and Wales

:02:08. > :02:11.lifted the ban on prohibiting sexually active gay men from

:02:12. > :02:15.donating. But here the Health Minister insisted it remain in

:02:16. > :02:17.place. Raised last Friday in the High Court, the judge ruled that

:02:18. > :02:44.decision was irrational. He said: Speaking for the first time about

:02:45. > :02:50.the ruling, the minister gave this response. The judge believes it is

:02:51. > :02:57.the decision for Jeremy Hunt. But Jeremy Hunt did not believe it was

:02:58. > :03:03.a decision for him. That is a matter for the Department of Health.

:03:04. > :03:08.What happens next is not clear. The ball appears to be in the Court of

:03:09. > :03:12.the Department of Health in England. It says it is considering the

:03:13. > :03:23.potential implications of the judgment. Those members of the

:03:24. > :03:32.public we spoke to did not seem to be concerned about the prospect of

:03:33. > :03:36.receiving blood from a gay man. The issue is high on the political

:03:37. > :03:40.radar. But the minister accused politicians in the Assembly today

:03:41. > :03:47.and the media of misreading the rolling of the judge. I did not go

:03:48. > :03:52.far enough for the judge. If I had banned blood coming from GB the

:03:53. > :03:56.judge would have found it rational! But Sinn Fein accused the minister

:03:57. > :04:02.of passing the buck. I have no doubt there will be an issue on

:04:03. > :04:07.legal advice, but we also have a moral and ethical duty to the wider

:04:08. > :04:11.community and this situation in relation to maintaining a ban is

:04:12. > :04:17.completely at odds to the scientific advice we were given. A

:04:18. > :04:21.very small percentage, just 6% of those eligible, actually donate

:04:22. > :04:25.blood in Northern Ireland so that means that blood donated by the gay

:04:26. > :04:29.community would be almost minuscule. But according to those who have

:04:30. > :04:33.spoken out, that is not the point. They believe their rights are being

:04:34. > :04:37.denied and there are calling on the minister to reverse the decision.

:04:38. > :04:42.In response to accusations of imposing his own religious views on

:04:43. > :04:45.others, Edwin Poots said he was not produced and listed countries

:04:46. > :04:50.including the United States and France where a similar ban is in

:04:51. > :05:02.place. But the Mr may find it difficult to convince his opponents.

:05:03. > :05:07.- the minister. The mother of a man murdered last week has told BBC

:05:08. > :05:10.Newsline her son did not deserve his brutal death. Ballymagorry was

:05:11. > :05:16.shot last Thursday in a brutal execution. Police have appealed for

:05:17. > :05:25.a man wanted in connection with the killing to give himself up. Barry

:05:26. > :05:33.McCrory Cup was the victim of what police called a terrific execution.

:05:34. > :05:43.- horrific. His mother recalled the moment she was told that her son

:05:44. > :05:50.had been shot. Once I got back that Gordon was in place and I knew that

:05:51. > :05:57.was an area where Barry was. I approached a policewoman and asked

:05:58. > :06:01.if she knew who it was. She said another officer will speak to you.

:06:02. > :06:07.I asked if it was my son and they said it was. Ballymagorry had an

:06:08. > :06:11.expensive criminal record and his mother today acknowledged he was no

:06:12. > :06:14.angel but said nothing could justify his killing and that she

:06:15. > :06:21.still cannot come to terms with what happened. I'm trying hard not

:06:22. > :06:31.to sink under the whole circumstances. If I was to let my

:06:32. > :06:37.mind wander, I could not cope. I cannot make sense of it. Police

:06:38. > :06:42.want to speak to this man, 58 year- old Ciaran McLaughlan about the

:06:43. > :06:48.murder. Today the officer in charge of the investigation appealed to

:06:49. > :06:50.him to get in touch. We are not judging you and I would like to

:06:51. > :06:56.speak directly to you now. Please make contact with us. It is of

:06:57. > :07:00.concern to us that there is a far arm on the streets of Derry to

:07:01. > :07:23.light. Please come forward and give us your account of what happened

:07:24. > :07:35.that night. Of 45 in old man has been arrested in connection with

:07:36. > :07:38.the murder of Kevin Kenny. The body of the 46-year-old father of four

:07:39. > :07:39.was found in a lake in Alexandra Park, off the Antrim Road, on

:07:40. > :07:46.Wednesday. Kevin Kearney from Dunmore Road had been reported

:07:47. > :07:51.missing the previous day. Police are investigating the sports of

:07:52. > :07:58.masked man claiming responsibility for the murder. - reports. For the

:07:59. > :08:02.third time in a week a bomb alert forced the closure of part of the

:08:03. > :08:04.M1. The motorway was closed in both directions for ten hours which had

:08:05. > :08:10.a knock on effect on traffic stretching from Lurgan into Belfast.

:08:11. > :08:13.Motorists and other commuters were left in three hour traffic jams,

:08:14. > :08:17.many of them late for work, schools and hospital appointments. BBC

:08:18. > :08:20.Newsline's Mervyn Jess reports. This is starting to become a

:08:21. > :08:26.familiar feature of the morning rush-hour commute on the M1 near

:08:27. > :08:28.Belfast. For the third time in a week, one of the busiest routes in

:08:29. > :08:31.Northern Ireland was closed to traffic due to a bomb scare. While

:08:32. > :08:33.this stretch of motorway between Lisburn and Belfast was deserted,

:08:34. > :08:43.the side roads were choc-a-block with motorists seeking a way round

:08:44. > :08:50.the security alert. I have travelled from Lisburn. It is going

:08:51. > :08:57.to take me another 30 minutes to get to work. At the moment it could

:08:58. > :09:06.take me about two hours to get to work. It is hectic. It is pretty

:09:07. > :09:15.miserable. The previous alert disrupted the busiest shopping day

:09:16. > :09:17.of the week. With traffic along the M1 once again disrupted by a hoax

:09:18. > :09:19.bomb scare, this time under the motorway at the Stockmans Lane

:09:20. > :09:25.roundabout. The latest security operation began at midnight and

:09:26. > :09:28.lasted ten hours. A vehicle was abandoned close to the where the M1

:09:29. > :09:33.meets Blacks Road on the outskirts of Belfast. It had been reported

:09:34. > :09:35.stolen earlier in Lisburn. Army technical officers examined the

:09:36. > :09:38.suspect vehicle, but nothing was found and the area was reopened.

:09:39. > :09:43.However, it was too late for the early morning commute. By that

:09:44. > :09:46.stage some people had been stuck in bumper to bumper traffic for

:09:47. > :09:53.several hours, with delays reported as far away as Lurgan. Still to

:09:54. > :09:55.come on the programme this evening. Rory McIlroy's court battle begins

:09:56. > :10:17.against his former agent - we've the latest from Dublin.

:10:18. > :10:27.Constable Stephen Carroll was shot dead by the continuity IRA in

:10:28. > :10:31.Craigavon in 2009. Brendan McConnell was found guilty of the

:10:32. > :10:35.murder. Along with 22 year-old John-Paul Porton from Lurgan. The

:10:36. > :10:40.men are trying to have their convictions overturned. At the

:10:41. > :10:46.original trial Amman testified that he had seen McConville near the

:10:47. > :10:52.scene of the killing. Today his father gave evidence to the judges

:10:53. > :10:57.hearing the appeal. He said the witness had been nicknamed as water

:10:58. > :11:08.committee because of his lies. He said he liked to make up stories. -

:11:09. > :11:12.- Walter Mitty. He said no one should be convicted on his word. He

:11:13. > :11:17.said he believed police were trying to get him to say he made the

:11:18. > :11:21.statement under duress. He told the court he had never been arrested

:11:22. > :11:25.before and was not happy about being arrested this time. He also

:11:26. > :11:30.said a bus had been set on fire outside his house. The court heard

:11:31. > :11:36.details of surveyors recordings. The prosecution barrister said his

:11:37. > :11:41.father had been head saying, if he gets off, I will be a hero. The

:11:42. > :11:44.prosecution lawyer also asked the man if he made things up when it

:11:45. > :11:49.suited him but he denied that this was the case. The father of the

:11:50. > :11:54.witness will continue to give evidence tomorrow. Before it

:11:55. > :12:01.governor of Magheraberry jail and the former prison ombudsman are

:12:02. > :12:04.also expected to testify. Bereaved relatives and people injured in the

:12:05. > :12:06.Claudy bombing say the police may have suspended their investigation

:12:07. > :12:15.until there is new evidence, but they will continue their fight for

:12:16. > :12:17.justice to find the perpetrators. The Deputy First Minister, Martin

:12:18. > :12:20.McGuinness, a senior IRA leader in Derry at the time, has been urged

:12:21. > :12:22.to do more to help the families and he has repeated he's willing to

:12:23. > :12:27.meet them. Here's our North-West reporter, Keiron Tourish. Nine

:12:28. > :12:30.people were killed when three bombs exploded in the village of Claudy

:12:31. > :12:33.in 1972. No one has ever been charged in connection with the

:12:34. > :12:36.attack. On Friday, a delegation including relatives of those who

:12:37. > :12:42.died, met with the PSNI for an update on the investigation. They

:12:43. > :12:52.were shocked at the disclosure that the inquiry has for the moment been

:12:53. > :12:58.halted. In a statement the police said their investigation had been

:12:59. > :13:02.suspended. It would not resume unless new evidence was received.

:13:03. > :13:04.One woman who survived the attack - and who is a Ulster Unionist

:13:05. > :13:09.councillor on Derry City council - has challenged the Deputy First

:13:10. > :13:11.Minister to do more. He was a senior IRA leader at the time, but

:13:12. > :13:19.has always maintained he knew nothing about the bombing. I always

:13:20. > :13:27.feel Martin McGuinness you something. Why can he not let us

:13:28. > :13:30.know, if he does not. He has never really approached us. It would be

:13:31. > :13:36.hard to talk to him if he knows anything, but why does he not put

:13:37. > :13:43.our minds at ease. Why are they all avoiding us? Anyone operating in

:13:44. > :13:47.the Londonderry area in the early 1970s who were in the IRA, they

:13:48. > :13:52.have the information. If they were not responsible themselves, they

:13:53. > :13:56.know who was. That information needs to be forthcoming. For many

:13:57. > :14:00.relatives, Claudy has remained the forgotten atrocity of the troubles.

:14:01. > :14:02.But the TUV leader says it's vital to establish the truth of what

:14:03. > :14:11.happened and identify those responsible. I expect we would have

:14:12. > :14:17.sufficient disclosure to satisfy a reasonable observer that there has

:14:18. > :14:23.been a thorough investigation both into the fence and the alleged

:14:24. > :14:27.cover-up of that of France. - offence. The Deputy First Minister

:14:28. > :14:29.has again stated that he's willing to meet the Claudy families to

:14:30. > :14:35.discuss the bombing. Meanwhile the PSNI has urged anyone with

:14:36. > :14:39.information to come forward. A question mark hangs over the future

:14:40. > :14:42.of the Consumer Council. The Enterprise Minister Arlene Foster

:14:43. > :14:44.says a review has concluded it may not be essential to consumers and

:14:45. > :14:53.she's now consulting with the public on three options. She's

:14:54. > :14:55.asking if the Consumer Council should continue as it is, be

:14:56. > :14:57.abolished with it responsibilities transferred to other advice bodies,

:14:58. > :15:08.or if a new independent body should be created. The report recognises

:15:09. > :15:12.that the council has been affected as an organisation but it concludes

:15:13. > :15:16.that the political and consumer landscape has changed since the

:15:17. > :15:21.General Consumer Council was created. The council was last

:15:22. > :15:26.reviewed in 1999. It is important that we periodically review public

:15:27. > :15:30.sector organisations to make sure they continued to fulfil the lead

:15:31. > :15:36.and take account of changed circumstances. No doubt we live in

:15:37. > :15:41.an age when consumers can try to represent themselves but there is

:15:42. > :15:47.clearly still in need for us. One family spent four years trying to

:15:48. > :15:53.get redress the Met airline. It took four years. They needed our

:15:54. > :15:59.help. So there still is a need for us. You're watching BBC Newsline

:16:00. > :16:05.help. So there still is a need for and still ahead before seven. We

:16:06. > :16:07.focus on the final game for Northern Ireland's footballers in

:16:08. > :16:10.their ill-fated world qualifying campaign. Before the golf star,

:16:11. > :16:14.Rory McIlroy, and the start of his court case against his former

:16:15. > :16:16.management company. Proceedings in the High Court in Dublin heard

:16:17. > :16:20.today that Horizon Sports Management, which is Dublin-based,

:16:21. > :16:22.intends to counter-sue him. Our Dublin correspondent Shane Harrison

:16:23. > :16:31.was in the court for us. Shane, what was said? Rory McIlroy's legal

:16:32. > :16:35.team work attempting to get his case fast track to the Commercial

:16:36. > :16:39.Court which is a division of the High Court that the Oaks after Big

:16:40. > :16:45.many cases. And they succeeded in that. The detail of Rory McIlroy's

:16:46. > :16:49.action was not read out but it is understood he believes that

:16:50. > :16:54.excessive fees were charged. Said to be 7.5 million euros over an 18

:16:55. > :17:05.month period that coincided with his 1 million dollar deal with

:17:06. > :17:09.companies. We learned that the company are going to Cardoso. They

:17:10. > :17:14.say they achieved exceptional results from Rory McIlroy, who was

:17:15. > :17:19.not in court. The case will be heard in full and October of next

:17:20. > :17:28.year. That is plenty of time then for both sides to reach an out-of-

:17:29. > :17:31.court settlement. Ulster's rugby players got their European Cup

:17:32. > :17:34.campaign off to a flying start with a victory against Leicester.- and

:17:35. > :17:38.one of the winning team is in the studio with us. Stephen Watson will

:17:39. > :17:41.do the introductions. Darren Cave starred in Ulster's win against the

:17:42. > :17:50.Leicester Tigers. An excellent 22- 16 victory at Ravenhill. The game

:17:51. > :17:53.was the first of what was three days of the best club rugby in

:17:54. > :18:02.Europe. Great for us all to watch, what was it like to play in? It is

:18:03. > :18:07.a fantastic competition to play in. I always watch it when I was

:18:08. > :18:14.growing up. There is a special buzz about the place when the games are

:18:15. > :18:18.on. The future of the game is in turmoil. How important is it that

:18:19. > :18:27.the Heineken Cup situation is resolved? The game's, we look

:18:28. > :18:33.forward to them the most and look forward to them. Not only in the

:18:34. > :18:42.training ground for what the whole province. It is important that they

:18:43. > :18:47.get something sorted for us. Next up is Montpellier cooled once at

:18:48. > :18:58.the weekend. Are you confident of winning in France? We have not won

:18:59. > :19:04.many games in France, to be honest. We won last year but the before we

:19:05. > :19:18.were close. This is as good an Ulster team as we have been in a

:19:19. > :19:22.professional era. There have been some new signings and it seems to

:19:23. > :19:32.be a place where players want to be a part of it. I said I would never

:19:33. > :19:37.forgive myself if I went to play anywhere else. I think a lot of

:19:38. > :19:47.players feel we have a good opportunity in the next couple of

:19:48. > :19:50.years. The Northern Ireland footballers have reached Israel in

:19:51. > :19:58.the final leg of their ill-fated World Cup campaign. The manager

:19:59. > :20:04.questioned whether he had made progress with the team. But he can

:20:05. > :20:10.still call on one veteran eager to play the part. Pulling on the boobs

:20:11. > :20:14.again after a spell in the wilderness, Chris Baird has found

:20:15. > :20:18.himself a new club and is now hoping that Michael O'Neill sees

:20:19. > :20:22.him as the answer to his defensive crisis tomorrow night. After

:20:23. > :20:28.failing to start an international for almost one year, he is ready to

:20:29. > :20:33.take his chance. It is just frustrating, it has been a long

:20:34. > :20:40.summer it for me. I did a lot of training by myself. But coming here

:20:41. > :20:44.is a bonus for me. It is also a bonus for the manager been able to

:20:45. > :20:48.call on the experience of Chris Baird. Is he tempted to bring the

:20:49. > :20:55.curtain down on his international career? I feel fine and as long as

:20:56. > :21:10.I'm playing at club level, that is the main thing. I am still enjoying

:21:11. > :21:20.it so that is the main thing. There is a lot of work to be done. But

:21:21. > :21:28.despite the disappointment of wizened results the current manager

:21:29. > :21:36.has fate in his squad. - recent results. Moving forward if I have

:21:37. > :21:40.the opportunity to take this group for what I will look forward to

:21:41. > :21:52.the Irish League. Both teams hoping to move into second place on their

:21:53. > :21:55.own. But whatever the outcome, neither can overtake the leaders

:21:56. > :21:58.Linfield. They were bottom a few weeks ago, but after a win against

:21:59. > :22:11.Dungannon, are cruising at the top. Gavin Andrews reports. Linfield's

:22:12. > :22:17.shaky start seems a distant memory. This doubled made it seven for the

:22:18. > :22:27.season and drew praise from the manager. Alongside that hard work

:22:28. > :22:33.and good attitude there is talent. When those are combined you do

:22:34. > :22:41.produce the goods. Up until now he has done tremendously well.

:22:42. > :22:53.Cliftonville relied on another proven goalscorer to overcome baton

:22:54. > :23:02.a mallard. Or meat fried in the open-air -- Gormley fired in the

:23:03. > :23:11.opener. Steven Cousins helped Coleraine into a lead over

:23:12. > :23:19.Ballymena. And Crusaders fired for past guards at Seaview to take them

:23:20. > :23:33.to third in the table. -- Ards. The Belfast giants are top of the elite

:23:34. > :23:45.lead after winning away to Coventry last night. That followed an

:23:46. > :23:50.exciting game against Sheffield. Clonoe are Tyrone Gaelic football

:23:51. > :23:52.champions. They defeated Carrickmore in the final in Omagh

:23:53. > :23:56.yesterday to win their second club championship in five years. But

:23:57. > :23:59.with only one week until their Ulster championship campaign begins

:24:00. > :24:09.- the manager is not happy. Thomas Niblock reports. The small village

:24:10. > :24:14.of Clonoe are now the proud holders of the O'Neill Cup in the O'Neill

:24:15. > :24:16.County! In front of 7,000 spectators, Carrickmore had Tyrone

:24:17. > :24:21.players like Martin Penrose, Conor Gormley and Mark Donnelly. But

:24:22. > :24:26.Clonoe had one of their own - Conor McAliskey. And he was a constant

:24:27. > :24:32.threat against the 15 times Tyrone champions. Captain Sean McNulty

:24:33. > :24:36.scored the winning point when Clonoe last won a championship. He

:24:37. > :24:44.scored the final two points yesterday, so how does it compare?

:24:45. > :24:50.It was great to get it the first time but the second time, to be

:24:51. > :24:53.part of that team, I'm over the moon. Ballinderry players were in

:24:54. > :24:58.Omagh, observing their next opponents. The Derry champions will

:24:59. > :25:00.now play Clonoe in the Ulster club championship this Sunday and the

:25:01. > :25:11.frustrations of Clonoe manager Damien Cassidy are clear! Two years

:25:12. > :25:19.ago we had the same situation. We asked to go out and play against

:25:20. > :25:22.Letterkenny. And here we are again. It is just not fair. Frustration
