:01:02. > :01:03.Martin McCauley was seriously injured and

:01:04. > :01:06.his 17-year-old friend was killed in one of the most controversial

:01:07. > :01:09.He also came to prominence when he was convicted

:01:10. > :01:13.of being a member of an IRA team training rebel forces in Colombia.

:01:14. > :01:15.Today, the 52 year old from Lurgan is back in

:01:16. > :01:18.the news over that fatal shooting, a so-called RUC shoot-to-kill

:01:19. > :01:23.In its aftermath, Martin McCauley was found guilty of having weapons.

:01:24. > :01:26.It has since emerged that a secret MI5 recording of the incident wasn't

:01:27. > :01:31.Today, the Prosecution Service said it would not oppose his appeal.

:01:32. > :01:45.Our home affairs correspondent Vincent Kearney has the story.

:01:46. > :01:53.Police claimed Martin McCauley confronted them with a rival in

:01:54. > :01:59.October 1982. He was seriously injured and his friend was killed

:02:00. > :02:05.when officers opened fire. This is him leaving court in 1985 after

:02:06. > :02:09.being given a two year suspended sentence for possession of three

:02:10. > :02:14.rifles. He insisted he and his friend were not armed and police did

:02:15. > :02:19.not issue any warnings before they were shot. It was a claim he

:02:20. > :02:25.repeated in a BBC interview at the scene of the shooting. There were

:02:26. > :02:30.two shots. I saw a guy with a rifle moving across the door and once he

:02:31. > :02:36.disappear, the place exploded with gunfire -- disappeared. I moved to

:02:37. > :02:40.get cover and in doing so I was hit. Police insist the Ben Watt armed and

:02:41. > :02:47.had been given three warnings. Years later, it was revealed MI5 had a

:02:48. > :02:49.listening device inside the shed at the time of the shooting that

:02:50. > :02:56.recorded what happened. That recording could have a stab wished

:02:57. > :03:01.if police shouted warnings or made reference to Martin McCauley being

:03:02. > :03:06.bombed before they opened fire -- established. The recording was not

:03:07. > :03:10.made known to the court at the time of the trial. It was discovered by

:03:11. > :03:13.the Deputy Chief Constable of Greater Manchester who invested

:03:14. > :03:19.allegations of a shoot-to-kill policy and to established the

:03:20. > :03:23.recording was later destroyed. Last year, the criminal cases review

:03:24. > :03:29.commission group -- referred the case to the Court of Appeal on the

:03:30. > :03:35.basis evidence had with -- had been withheld. A QC told the court he had

:03:36. > :03:41.been instructed to read a statement on behalf of the Crown Prosecution

:03:42. > :03:46.Service. It said relevant material had been withheld at the time, from

:03:47. > :03:52.the court and from the defence in the trial. The statement said this

:03:53. > :03:56.undermined public confidence in the criminal justice system and it wrote

:03:57. > :04:01.it into disrepute. The lawyer told the three Appeals Court judges the

:04:02. > :04:06.prosecution service would not make submissions to uphold the conviction

:04:07. > :04:10.and invited them to use their discretion. There will be a hearing

:04:11. > :04:17.next week to decide whether to do so. The lawyers of Martin McCauley

:04:18. > :04:21.will argue the conviction should be quashed on the basis title evidence

:04:22. > :04:25.was not made available to the judge's trial. The contents of the

:04:26. > :04:28.investigation have never been made public and the lawyers hope that

:04:29. > :04:34.will change during next week's hearing. He was tried in public and

:04:35. > :04:39.he was convicted in public and it is his fundamental right these

:04:40. > :04:42.documents be opened in a court so he and the general public are aware of

:04:43. > :04:47.what happened. Martin McCauley was not in court to hear the prosecution

:04:48. > :04:53.statements today as he faces extradition to South America if he

:04:54. > :04:57.returns to Northern Ireland. He was one of three men arrested in

:04:58. > :05:00.Colombia three years ago accused of training rebel forces in the

:05:01. > :05:06.country. Initially cleared off the charge, they were later convicted on

:05:07. > :05:08.appeal and sentenced to 17 years in jail but sentenced -- but fled to

:05:09. > :05:31.the Republic to avoid jail. Police are investigating an arson

:05:32. > :05:35.attack on an errant all attack. They claim there was a similar attack.

:05:36. > :05:38.Survivors and relatives of those killed in the Dublin Monaghan

:05:39. > :05:41.bombings 40 years ago this week are to sue the British Government.

:05:42. > :05:44.They claim the attacks were carried out by Loyalists,

:06:37. > :06:38.The total number of claimants in April stood at 56,100.

:06:46. > :06:58.An update now on a story we brought you yesterday on the deaths of

:06:59. > :07:00.hundreds of thousands of endangered baby eels, called elvers.

:07:01. > :07:04.Over Easter, they got caught in traps that were meant to help them

:07:05. > :07:07.get past a hydro-electric dam in County Donegal and into Lough Erne.

:07:08. > :07:09.Today, the firm that runs the power station

:07:10. > :07:12.said the traps were being checked every day, but they had experienced

:07:13. > :07:23.Julian Fowler reports from Ballyshannon.

:07:24. > :07:33.The dam stands in the way of the tiny young eels making their way to

:07:34. > :07:37.Lough Erne. They are supposed to be given a helping hand into a tank

:07:38. > :07:42.where they are collected and transported around the dam to be

:07:43. > :07:50.released. The remarkable journey of the eels against thousands of miles

:07:51. > :07:54.away in a part of the Atlantic. The love I drift slowly across the ocean

:07:55. > :08:01.and when they reach shallow waters, they transform into elvers and make

:08:02. > :08:05.their way to the freshwater is Lough Erne. Some will stay here for up to

:08:06. > :08:10.25 years before a game making their way to the Open ocean and back to

:08:11. > :08:18.the Sargasso Sea to breed. As we know, the hydroelectric plant at

:08:19. > :08:22.Ballyshannon broke this cycle. Around 300,000 eels died in the

:08:23. > :08:28.traps here last month. One night over Easter, there was a large

:08:29. > :08:35.increase in elvers into one trap and we estimate about 150 kilograms of

:08:36. > :08:41.elvers, which represents 90% of the entire run last year, entered in one

:08:42. > :08:48.night into one trap. These were not detected until the following morning

:08:49. > :08:52.and unfortunately, 112 kilograms of elvers were lost at that stage. One

:08:53. > :08:59.expert said because elvers run at night, traps should be checked at

:09:00. > :09:05.night. He said there was far too casual and approached are critically

:09:06. > :09:10.endangered space you. Power company says it has transported 480

:09:11. > :09:15.kilograms of elvers this year, more than double the total of last year.

:17:22. > :17:26.Dunlop family. Robert and Joey lost their lives by competing in this

:17:27. > :17:29.dangerous sport. Robert is the most successful rider in the history of

:17:30. > :17:34.the competition and his sons are here this week to keep the Dunlop

:17:35. > :17:40.name going. Brotherly love at Northwest 200, the

:17:41. > :17:46.new generation of the Dunlop family are helping to prolong the famous

:17:47. > :17:51.surname of their Father Robert and on-call Joey. John McGuinness knew

:17:52. > :17:56.them better than most, his former team-mate and family friend paid a

:17:57. > :18:02.special visit to their hometown of Ballymoney this afternoon. They will
