:00:12. > :00:14.to be quashed after a ruling by the Court of Appeal. Martin McCauley was

:00:15. > :00:17.convicted after being injured in a so-called shoot to kill incident in

:00:18. > :00:20.County Armagh 32 years ago. Three judges today accepted that the

:00:21. > :00:23.conviction was unsafe because vital evidence about what happened was

:00:24. > :00:38.withheld from his trial. Our Home Affairs Correspondent Vincent

:00:39. > :00:43.Kearney reports. Scorers that time has not removed. 17-year-old Michael

:00:44. > :00:49.was killed and Martin McCauley was injured when they were shot here by

:00:50. > :00:55.RUC officers in November, 1982. Nearly 32 years later, the shooting

:00:56. > :00:59.here remains shrouded in mystery and controversy. Police claim they were

:01:00. > :01:03.confronted by two men armed with rifles and only opened fire after

:01:04. > :01:08.shouting and number of warnings. Martin McCauley has insisted they

:01:09. > :01:13.were not armed and that no warnings were given. It later emerged that

:01:14. > :01:18.MI5 had a listening device hidden inside the shed that recorded what

:01:19. > :01:38.happened, but that recording was destroyed. This is Martin McCauley

:01:39. > :01:40.leaving court in 1985 at being given at two year suspended sentence for

:01:41. > :01:43.possession of three rifles found inside the shed. The court was not

:01:44. > :01:45.made aware of the MI5 recording. Its existence and the fact that it was

:01:46. > :01:47.later destroyed, was discovered by the Deputy Chief Constable of

:01:48. > :01:49.Greater Manchester. He investigated allegations that the RUC was

:01:50. > :01:54.deliberately killing unarmed republicans. At the Court of Appeal,

:01:55. > :01:57.Martin McCauley's lawyer but -- quoted from the report into the

:01:58. > :02:02.incidents. It is the first time details of the report have been made

:02:03. > :02:07.public. The lawyer said the report notes that police officers fired 47

:02:08. > :02:12.shots at the men and that none were fired in return. She said it was

:02:13. > :02:16.clear there had been a conspiracy by police officers to prevent those

:02:17. > :02:20.involved in the shooting facing criminal charges. The cover-up

:02:21. > :02:26.involved the destruction of the secret recording. The QC read the

:02:27. > :02:30.accounts of five MI5 officers who listen to the recording before it

:02:31. > :02:34.was destroyed, none of them said they heard any warning. One officer

:02:35. > :02:38.said he was concerned that there had not been a warning and that firing

:02:39. > :02:44.had continued even after a cease-fire order had been given.

:02:45. > :02:47.Another officers said he heard someone say, we will get them

:02:48. > :02:51.between bursts of gunfire. The barrister said it was clear that

:02:52. > :02:55.both men had been shot without warning or the opportunity to

:02:56. > :02:58.surrender. She said the fact that evidence about the shooting had been

:02:59. > :03:04.destroyed and that police officers had lied about what happened, meant

:03:05. > :03:09.the conviction was unsafe. After brief discussion with the two

:03:10. > :03:13.judges, the Lord Chief Justice said they were satisfied that the

:03:14. > :03:18.conviction was unsafe and should be quashed. Martin McCauley's wife was

:03:19. > :03:23.in court and afterwards welcomed the ruling. Nothing will bring back

:03:24. > :03:27.Michael, but at least what has been exposed, for his family, his parents

:03:28. > :03:32.and siblings have known for years, was that Michael was cut down in

:03:33. > :03:41.cold blooded murder by state forces. Martin McCauley could not face --

:03:42. > :03:48.could not face the hearing because... A 49-year-old woman is in

:03:49. > :03:51.a critical condition in hospital after an incident at a house in

:03:52. > :03:54.Lisburn this morning. It's understood she's being treated for

:03:55. > :03:58.burn injuries. A 48-year-old man who was also in the house on Glenavy

:03:59. > :04:00.Road is also being treated for burn injuries. It's believed his

:04:01. > :04:02.condition is not life-threatening. The police are trying to establish

:04:03. > :04:09.what happened. An ambulance taking a patient to hospital after a road

:04:10. > :04:13.crash in County Armagh was itself involved in a hit and run this

:04:14. > :04:16.afternoon. A car which collided with the ambulance in Camlough drove off

:04:17. > :04:19.in the direction of Newtwonhamilton. The patient and crew were not

:04:20. > :04:22.seriously injured but the ambulance was damaged. The police are

:04:23. > :04:23.appealing for witnesses to the incident on Old Road at around four

:04:24. > :04:27.o'clock to contact them. A incident on Old Road at around four

:04:28. > :04:28.the Sisters of Nazareth has apologised again on behalf of the

:04:48. > :04:52.was the public face of the Sisters of Nazareth giving evidence today. A

:04:53. > :04:56.congregation battered and bruised by years of allegations of child abuse

:04:57. > :05:03.and on the half of the nuns, Sister McCall admitted that abuse happened

:05:04. > :05:06.and apologised. She listened in to much of the evidence of former

:05:07. > :05:11.residents over the first 36 days of the enquiry and today, giving

:05:12. > :05:16.evidence, she said that much of that evidence has been very shocking and

:05:17. > :05:21.harrowing for us. She said, it is clear that at certain times, and

:05:22. > :05:27.with certain nuns, some things were not right. When asked about a

:05:28. > :05:29.previous apology and whether that should be extended to include

:05:30. > :05:36.emotional abuse, she should be extended to include

:05:37. > :05:40.former Bishop of Derry, should be extended to include

:05:41. > :05:42.said he never experienced should be extended to include

:05:43. > :05:46.like he witnessed in should be extended to include

:05:47. > :05:50.admired the work of the nuns in helping people in need.

:05:51. > :05:53.admired the work of the nuns in on the abuse, the retired Bishop

:05:54. > :05:56.said, I think we are all responsible for not knowing and he said

:05:57. > :06:21.said, I think we are all responsible believes that society in general and

:06:22. > :06:23.community leaders like himself take the work of the Sisters of Nazareth

:06:24. > :06:27.nuns looked after 5000 children, the nuns looked after 5000 children, the

:06:28. > :06:29.have happened to the children if they had not. He said that in 36

:06:30. > :06:30.years, he received only one complaint about the Sisters of

:06:31. > :06:34.Nazareth. It came complaint about the Sisters of

:06:35. > :06:36.from her brother. The bishop described the letter she sent him as

:06:37. > :06:40.long and hard braking. The phase of the enquiry examining the homes is

:06:41. > :06:43.due to finish later this month. The NI21 party has announced it will

:06:44. > :06:46.change its designation in the Assembly at the earliest opportunity

:06:47. > :06:49.from 'Unionist' to 'other'. The party's Executive took the decision

:06:50. > :06:52.earlier today ahead of Thursday's elections. The European Candidate

:06:53. > :06:55.Tina McKenzie said it was a response intended to clear up any confusion

:06:56. > :06:59.about the party's position, which is cross-community. The Queen's Baton
