:00:17. > :00:18.after an investigation by the Charity Commission.

:00:19. > :00:20.Derek Tughan had converted two property companies into charities

:00:21. > :00:25.Because of that he has now lost control of a housing empire valued

:00:26. > :00:32.Here's our investigations reporter Kevin Magee.

:00:33. > :00:34.Derek Tughan is one of Northern Ireland's

:00:35. > :00:38.His father built up two property rental companies,

:00:39. > :00:40.Bangor Provident Trust and Victoria Housing,

:00:41. > :00:45.containing some 500 homes in Belfast and North Down.

:00:46. > :00:47.In the mid '80s Mr Tughan converted them into charities

:00:48. > :00:58.On our taxable revenues we paid no tax nor did we pay any capital gains

:00:59. > :01:01.tax on any properties that we happened to sell.

:01:02. > :01:10.When the charity watchdog was set up in 2010, it began investigating

:01:11. > :01:17.As a result Mr Tughan has been removed as a trustee and has lost

:01:18. > :01:22.Now he's arguing Bangor and Victoria are not in fact charities at all,

:01:23. > :01:31.I'm afraid I am going to have to fight this because it is wrong.

:01:32. > :01:34.There is an injustice being done here.

:01:35. > :01:38.They have grabbed control of Tughan family property and I regard it

:01:39. > :01:47.There are 188 in Riverdale in Andersonstown,

:01:48. > :01:50.88 in the Holywood Road area of East Belfast,

:01:51. > :01:53.54 in the Harmin estate and Farmley Park in Glengormley

:01:54. > :02:02.The total value of all the properties is estimated

:02:03. > :02:08.As well as losing control of them, Mr Tughan is being asked to repay

:02:09. > :02:10.any money he allegedly moved out of the charities -

:02:11. > :02:15.a demand which he estimates could be in the region of ?10 million.

:02:16. > :02:20.That's a total potential loss to Derek Tughan of ?25 million.

:02:21. > :02:23.The voluntary trustee appointed to run Victorian Housing

:02:24. > :02:26.in his place says the Charity Commission is acting

:02:27. > :02:30.These are absolutely definitely charities?

:02:31. > :02:34.The money that belongs to a charity must be applied for the benefit

:02:35. > :02:38.of its beneficiaries, in this case the tenants.

:02:39. > :02:42.It was not and therefore we are seeking the return of these assets.

:02:43. > :02:46.These are just some of the flats that form part of Victoria Housing

:02:47. > :02:53.Under the new regime, the Victoria and Bangor

:02:54. > :02:55.housing charities' plan is to refurbish any empty homes,

:02:56. > :02:57.move new tenants in and ensure the two charities

:02:58. > :03:06.An extra ?72 million is to be made available to help ease pressures

:03:07. > :03:12.The money is part of a reallocation of money from the Executive's budget

:03:13. > :03:20.which for various reasons hasn't been spent.

:03:21. > :03:27.In anyone's language that is a significant commitment to health.

:03:28. > :03:31.However, as we are all aware, and has been repeated across the house

:03:32. > :03:34.from all sides, continuing to provide funding for health does not

:03:35. > :03:42.address the underlying issues so it is vital that the reforms identified

:03:43. > :03:44.as a result of the report has recommended there should be

:03:45. > :03:46.substantial reforms to our health service.

:03:47. > :03:48.The Chief Constable has said he's surprised the Police Ombudsman

:03:49. > :03:50.didn't arrest and charge the officers he said

:03:51. > :03:51.colluded with loyalists in the Loughinisland murders.

:03:52. > :03:54.A UVF gang shot dead six Catholics in the County Down

:03:55. > :03:58.Last week an Ombudsman report said the killers had been protected

:03:59. > :04:00.Our Home Affairs Correspondent Vincent Kearney reports.

:04:01. > :04:04.Families of the victims of the UVF attack said they'd been vindicated

:04:05. > :04:07.when the Police Ombudsman said police officers had

:04:08. > :04:13.They also made it clear they want action to be taken

:04:14. > :04:24.Today we finally have a report by the ombudsman that vindicates our

:04:25. > :04:27.long-held suspicions that the truth about these murders was covered

:04:28. > :04:29.up by the very people, the police, who were

:04:30. > :04:35.We need justice and accountability from those in authority.

:04:36. > :04:38.It appears there has been a per version of justice on

:04:39. > :04:44.It's the responsibility of the Police Ombudsman

:04:45. > :04:48.to investigate alleged criminal behaviour by current

:04:49. > :04:52.His investigators also have the power to arrest

:04:53. > :04:55.suspects, and can recommend that they face charges.

:04:56. > :04:59.Michael Maguire was highly critical of some members

:05:00. > :05:03.He said police informers involved in the Loughinisland attack,

:05:04. > :05:06.and the importation of a huge consignment

:05:07. > :05:08.of weapons from South Africa, had been protected.

:05:09. > :05:13.Some police officers placed more value on collecting information and

:05:14. > :05:15.protecting sources than on preventing crime.

:05:16. > :05:19.But he didn't have any of them arrested.

:05:20. > :05:21.And he didn't send any files to the Public Prosecution Service

:05:22. > :05:26.recommending that they should face charges.

:05:27. > :05:28.In an interview for tonight's BBC Spotlight programme,

:05:29. > :05:33.the Chief Constable has expressed surprise.

:05:34. > :05:38.There does seem to be some sort of distance between the strength

:05:39. > :05:41.of the language in the report and the fact that we're not having

:05:42. > :05:50.police officers even reported to the PPS.

:05:51. > :05:53.If I got to a point where I was convinced in a very clear way

:05:54. > :05:56.that collusion was a key element of the Loughinisland murders,

:05:57. > :05:58.then I'd be looking to take that conclusion into evidence

:05:59. > :06:06.through arrests, interviews, charges and reports to the PPS.

:06:07. > :06:09.The Ombudsman has said that while there was sufficient evidence

:06:10. > :06:12.for him to say some police officers had been involved in collusion,

:06:13. > :06:13.there wasn't enough to support criminal charges.

:06:14. > :06:16.In a statement to the BBC, Michael Maguire said that

:06:17. > :06:19.as a result of the passage of time, some witnesses were no longer

:06:20. > :06:26.available, some documentation was missing and it was not always

:06:27. > :06:28.possible to get a detailed picture of the role of certain individuals.

:06:29. > :06:31.He said a number of related issues referred to in

:06:32. > :06:39.the Loughinisland report are still under investigation.

:06:40. > :06:41.The Spotlight programme looks at the implications of

:06:42. > :06:47.the Police Ombudsman's Loughinisland report straight after this news.

:06:48. > :06:50.The man killed in a hit and run in County Armagh yesterday morning

:06:51. > :06:52.was 52-year-old James Shields from Markethill.

:06:53. > :06:54.His body was found on Shillinghill Road near the village

:06:55. > :06:58.The police have appealed for information.

:06:59. > :07:01.The two men who were on board an aircraft that crashed

:07:02. > :07:07.into the sea off the Antrim coast last week were from North Yorkshire.

:07:08. > :07:08.The families of 66-year-old Terry Driffield

:07:15. > :07:18.The pair were flying a microlight aircraft

:07:19. > :07:19.from City of Derry Airport to Scotland.

:07:20. > :07:25.Wreckage was located close to Glenarm but the men's bodies

:07:26. > :07:31.Several hundred people have gathered at Belfast City Hall

:07:32. > :07:34.to remember the victims of the weekend gun attack in Orlando.

:07:35. > :07:36.49 people died and many more were injured

:07:37. > :07:42.in the shootings at a gay night club by a lone gunman.

:07:43. > :07:47.Tonight's crowd in Belfast said the main message was one of solidarity.

:07:48. > :07:53.This was an attack on the LGBT community and I think it is

:07:54. > :07:58.important for people to recognise that and it is an important message

:07:59. > :08:02.to get across to people. Solidarity and unity are the main thing. To see

:08:03. > :08:05.so many people here today is fantastic and it shows how far we as

:08:06. > :08:09.a community and as a society have come.

:08:10. > :08:11.The Duke and Duchess of Cambridge were at Hillsborough Castle today

:08:12. > :08:15.It was their first visit since getting married in 2011.

:08:16. > :08:20.The Duke met members of the Irish Guards

:08:21. > :08:23.as Colonel of the regiment, and then the couple then spent an hour

:08:24. > :08:25.meeting representatives of voluntary and charity groups.

:09:40. > :09:44.writing us off but over the years the Northern Ireland team has been

:09:45. > :09:49.written off and always pull things out of the bag and I am confident we

:09:50. > :09:53.can do it. Like Northern Ireland, Ukraine need a win on Thursday and

:09:54. > :09:56.they have done their homework on the team. Northern Ireland have plenty

:09:57. > :10:00.of fighting spirit and they have given everything right until the end

:10:01. > :10:04.and they are organised and they give a compact game. They close down the

:10:05. > :10:09.winners and do not give their players in a space in the game. They

:10:10. > :10:13.play defensive style and to defend it on the counter attack.
