:01:19. > :01:22.is to be chaired by a retired appeal court judge.
:01:23. > :01:26.The announcement was made by the Finance Minister,
:01:27. > :01:32.It follows last night's backing by the Assembly of a plan to cut
:01:33. > :01:35.costs associated with the heat scheme put forward by
:01:36. > :01:39.During that debate, the TUV leader Jim Allister raised questions
:01:40. > :01:43.about a former DUP special adviser's involvement in the scheme,
:01:44. > :01:54.Here is our political correspondent Stephen Walker.
:01:55. > :02:01.This was the last sitting of the assembly so it seemed appropriate
:02:02. > :02:04.the RHI scheme was on the agenda. Today it was announced that Patrick
:02:05. > :02:08.Coghlin the retired Lord Justice of Appeal will chair an enquiry into
:02:09. > :02:14.the scheme. He will begin his work next month. Openness and
:02:15. > :02:20.transparency will be key touchstones for Patrick Coghlin and his team. To
:02:21. > :02:25.key requirement but I pointed to earlier, the investigation will have
:02:26. > :02:31.to compel witnesses and evidence. Every student will be turned, no
:02:32. > :02:35.dark corners for a delight will be shone. Last night when the plan was
:02:36. > :02:41.presented by the economy minister aiming to cut costs associated with
:02:42. > :02:45.the RHI scheme was approved by L -- MLAs. During that debate allegations
:02:46. > :02:52.were made against Stephen Brimstone who used to work as a specialist
:02:53. > :02:59.adviser to DUP leader Arlene Foster. Stephen Brimstone built a new house
:03:00. > :03:03.and had a boiler in it. He took it out to qualify for this scheme
:03:04. > :03:12.because you have to have a new boiler. And he put in a new boiler
:03:13. > :03:17.under this scheme in order to qualify. Last year it Stephen
:03:18. > :03:21.Brimstone left his post as an adviser to Arlene Foster. Stephen
:03:22. > :03:26.had indicated that in May that he may not stay for a long period of
:03:27. > :03:29.time and decided to pursue other matters in the private sector. I
:03:30. > :03:33.wish him well because Stephen played a key role in relation to the
:03:34. > :03:39.executive office. You have no concerns about him in relation to
:03:40. > :03:45.the scheme? He has decided to move on and he is very private citizen.
:03:46. > :03:49.The DUP said Mr Brimstone is not intending to make in a statement
:03:50. > :03:53.about the allegations. The news comes as political parties have been
:03:54. > :04:00.investigating whether there MLAs have family members involved in the
:04:01. > :04:05.RHI scheme. An ant and uncle have a business which is a recipient under
:04:06. > :04:14.the scheme. The wife of former Ulster Unionist has the boiler for
:04:15. > :04:18.use. The DUP's Carla has indicated her brother-in-law is a farmer on
:04:19. > :04:22.the scheme and the DUP's William Irwin has a son-in-law who also has
:04:23. > :04:27.the boiler. There is no suggestion any of those named operate the
:04:28. > :04:31.boilers inappropriately. Today was the final sitting of the assembly
:04:32. > :04:35.and it seemed appropriate that the issue of the RHI boiler scheme that
:04:36. > :04:40.was on the agenda. The very subject that got us to this point in the
:04:41. > :04:44.first place. As MLAs take the lead, two questions spring to mind, who
:04:45. > :04:47.will return and when will Stormont comeback?
:04:48. > :04:49.The Economy Department was due tomorrow to reveal
:04:50. > :04:53.the names of those with Heat Incentive boilers.
:04:54. > :04:56.Today a judge temporarily banned publication
:04:57. > :04:59.of the details of more than 300 of them.
:05:00. > :05:03.But not all the scheme's participants are against being
:05:04. > :05:04.named, as our agriculture and environment correspondant
:05:05. > :05:21.Johnny Kelly runs the free trees Hotel. In 2014, he spent ?50,000
:05:22. > :05:26.bidding in a wood pellet burner. He says the income from it is part of
:05:27. > :05:30.plans to pay for a wider hotel refurbishment and of the subsidies
:05:31. > :05:35.are cut, he will be disappointed. He has no qualms about letting people
:05:36. > :05:38.know he is in the scheme. I think it's important in the future as well
:05:39. > :05:42.as publishing the names of people who engaged in the schemes, the
:05:43. > :05:44.second publication should go out after the investigation and that
:05:45. > :05:49.should be the names of those people who abuse the scheme. Allegations of
:05:50. > :05:53.abuse and the potential for reputational damage a part reason
:05:54. > :05:58.many firms don't want to be named. 300 of them around a quarter of the
:05:59. > :06:02.total were part of a group action by the renewable heat Association today
:06:03. > :06:06.to stop the economy department publishing the details as planned
:06:07. > :06:10.tomorrow. Counsel for those with the boilers said there would be a media
:06:11. > :06:14.feeding frenzy if the names were to be published. Reporting of the story
:06:15. > :06:18.had been sensationalist, he said, and begin the names and the public
:06:19. > :06:21.domain would lead to a rush to identify and investigate the
:06:22. > :06:27.background of those on the scheme. Including many people using it
:06:28. > :06:30.legitimately and appropriately. Only 4% of businesses in the scheme have
:06:31. > :06:37.given permission for the details to be released. The rest have not. For
:06:38. > :06:41.several hours, lawyers argued over which had presidents, privacy or the
:06:42. > :06:44.public interest? The judge reserved his findings very weak but that left
:06:45. > :06:48.the problem of the potential publication of names tomorrow. To
:06:49. > :06:51.address that, he issued an injunction banning the department
:06:52. > :06:56.from issuing the names of anyone who was a member of the renewable heat
:06:57. > :06:59.Association as of 5pm this evening. The issue of what happens to anyone
:07:00. > :07:06.else, that was left to the Department. The economy minister was
:07:07. > :07:09.on his feet in the assembly as the judgment came through. It left him
:07:10. > :07:15.in an awkward position about what to do next. I particularly regret the
:07:16. > :07:21.injunction that has been sought and awarded this afternoon because I do
:07:22. > :07:26.think in and of itself it prevents full transparency and I will take
:07:27. > :07:30.the time to consider what can they be done in the circumstances. The
:07:31. > :07:34.truth is that it's properly still being worked out. The department
:07:35. > :07:35.says is looking at options for maximum transparency which are
:07:36. > :07:37.consistent with that court ruling. Still ahead on the

:10:11. > :10:16.by the end of March. Three men appeared in a Dublin court

:11:40. > :11:43.police officer said he was being accused of helping an illegal

:11:48. > :11:53.money was found in his possession. The police did not say how much. He
:11:54. > :11:56.also said they would be objecting to bail because of the seriousness of
:11:57. > :11:59.the charges and because of his association with an organised

:16:55. > :17:02.couldn't have been very long and then hit the ground with the bang.
:17:03. > :17:06.The driver got the vehicle under control and that was that, really.
:17:07. > :17:08.He arrived for his second tour of dutry in Northern
:17:09. > :17:20.One of three members of his unit killed during the tour was a friend.

:18:34. > :18:36.people that I knew. I don't see those prosecutions happening. The

:18:41. > :18:41.anyone ever convicted for that killing? I don't believe so, no.
:18:42. > :18:44.The police and pulic prosecution service say cases involving
:18:45. > :18:51.allegations against former soldiers are treated the same as all others.
