:02:45. > :02:50.is alleged to have been a top Army spy inside the IRA involved in up
:02:51. > :02:54.to 50 murders as head of the organisation's
:02:55. > :02:57.internal security. He was named by the media
:02:58. > :03:00.as former West Belfast man He denies the claim
:03:01. > :03:05.he was Stakeknife. Tonight's Panorama includes
:03:06. > :03:08.a recording of a him describing how suspected informers
:03:09. > :03:11.would have been interrogated. In 2015, the Director
:03:12. > :03:27.of Public Prosecutions ordered a new investigation called Operation
:03:28. > :03:28.Kenova. It is reviewing cases
:03:29. > :03:32.linked to Stakeknife as well as a decision made
:03:33. > :03:34.by the Public Prosecution Service not to prosecute the agent over
:03:35. > :03:39.allegations that he lied under oath. I have serious concerns
:03:40. > :03:42.in relation to this decision. Having reviewed all
:03:43. > :03:48.the available evidence I consider the original decision
:03:49. > :03:50.did not take into account relevant considerations and took
:03:51. > :03:56.into account irrelevant factors. This evening's BBC Panorama reveals
:03:57. > :03:58.that the PPS decided not to prosecute Scappaticci for perjury
:03:59. > :04:05.because he was in fear of his life. Among those involved in that
:04:06. > :04:10.decision in 2006 was senior PPS lawyer Pamela Atchison who later
:04:11. > :04:16.became deputy director. It's understood that
:04:17. > :04:18.because of her involvement Barra McGrory asked her to step back
:04:19. > :04:20.from all decision-making That period of extended leave ended
:04:21. > :04:27.11 days ago when she retired. It's understood her retirement
:04:28. > :04:52.was in line with her contract. In tonight 's programme the panorama
:04:53. > :04:57.reporter asks about the deputy. Why has she been on gardening leave for
:04:58. > :05:04.some months? It is not appropriate for me to discuss the personal
:05:05. > :05:13.issues of the deputy director. In a statement on behalf of Pamela
:05:14. > :05:17.Aitchison, she acted appropriately and responsibly. It said she would
:05:18. > :05:20.welcome the opportunity to clarify role but is constrained by current
:05:21. > :05:27.circumstances and is eagerly awaiting the opportunity to explain
:05:28. > :05:28.her involvement. It is likely to be several years before the
:05:29. > :05:31.investigation reports. And you can see that
