0:00:53 > 0:00:55The Trade Union Bill, which is going through Parliament

0:00:55 > 0:00:59at the moment, would allow employers to use agency workers

0:00:59 > 0:01:01to replace striking staff.

0:01:01 > 0:01:0450% of a union's members would have to vote in a ballot calling

0:01:04 > 0:01:07for industrial action.

0:01:07 > 0:01:10And 40% of those eligible to vote would have to support a strike

0:01:10 > 0:01:14in key areas such as health and education.

0:01:14 > 0:01:17Later this week, the Assembly is likely to vote against allowing

0:01:17 > 0:01:20the UK Parliament to pass parts of the new law,

0:01:20 > 0:01:24but with the UK government adamant that responsibility is not devolved,

0:01:24 > 0:01:27it is heading for a constitutional clash.

0:01:27 > 0:01:30The First Minister has already said it could ultimately end up

0:01:30 > 0:01:34in the Supreme Court.

0:01:34 > 0:01:38We are confident that the Assembly will not give authority for the UK

0:01:38 > 0:01:40Government to legislate in this area.

0:01:40 > 0:01:45The UK Government may take the view that they are able to do so,

0:01:45 > 0:01:48in which case we will seek to reverse the effects of the bill

0:01:48 > 0:01:53in the next Assembly, as the First Minister has said.

0:01:53 > 0:01:57Employment legislation is not devolved to the National Assembly,

0:01:57 > 0:02:01therefore issuing an opinion on it is nothing more than that.

0:02:01 > 0:02:04Passions run deep on issues such as the right to strike

0:02:04 > 0:02:06and the impact of industrial action.

0:02:06 > 0:02:10Although the Welsh Public Services Minister says a legal fight can be

0:02:10 > 0:02:15avoided if the UK Government listens, at the moment both sides

0:02:15 > 0:02:18are standing firm.
