:01:13. > :01:19.pensioner stripped of �100 per week in benefits says he's being forced
:01:19. > :01:22.to wait 15 months to appeal against the decision. Dave Hardwick from
:01:22. > :01:26.Derbyshire has written to the Prime Minister to complain about the
:01:26. > :01:36.delay. But the Government admits there's now a backlog of 180,000
:01:36. > :01:39.
:01:39. > :01:44.cases in the benefit appeals system. Pensioner Dave Hardwick has
:01:44. > :01:47.arthritis, diabetes and other health problems but the Government
:01:47. > :01:51.has stopped part of his Disability Living Allowance earlier this year.
:01:51. > :01:55.He claims that has stripped him of around �100 per week. He is
:01:55. > :02:01.appealing against the decision but has been told it will take 15
:02:01. > :02:05.months to go to a tribunal. I am existing but I am just existing,
:02:05. > :02:10.but people desperately need this money who are far worse off than me
:02:10. > :02:13.and to wait 15 months for an appeal against a Government decision? It
:02:13. > :02:16.is totally wrong. He has also written directly to the Prime
:02:16. > :02:24.Minister to complain about the long wait for his tribunal to be heard.
:02:24. > :02:29.He has not had a reply. He says he is now living on his state pension
:02:29. > :02:34.of around �136 per week. Put money so tight that he has to limit the
:02:34. > :02:39.amount of diesel he puts into his brand new mobility car. A car paid
:02:39. > :02:45.for by the benefits system. I have to go to hospital in Derby four
:02:45. > :02:48.times every few weeks and at the end of the day, that is the only
:02:48. > :02:52.diesel I can afford so I can't use it for getting around and
:02:52. > :02:56.socialising. The Government's tribunal services there has been a
:02:56. > :03:00.large number of increases in tribunal cases going to appeal. The
:03:00. > :03:05.backlog stands at around 180,000 cases. More than half of them are
:03:05. > :03:12.the result of people being denied incapacity benefit. Something which
:03:12. > :03:15.Dave Hardwick was not even claiming. He now wants more resources put
:03:15. > :03:18.into the tribunal system to cut waiting times.
:03:18. > :03:20.To discuss that case and the wider issues, I'm joined now by David
:03:20. > :03:28.Jones, the East Midlands treasurer for the National Pensioners
:03:28. > :03:31.Convention pressure group. That is a long title! How unusual is this
:03:31. > :03:34.case, Dave Hardwick - a pensioner being caught up in a backlog of
:03:34. > :03:41.tribunal cases, more than half of them to do with incapacity benefit,
:03:41. > :03:45.a benefit that Dave Hardwick wasn't even claiming? It is not quite as
:03:45. > :03:48.unusual as you think but I know of one in Gloucestershire and I known
:03:48. > :03:51.nationally they have been picking up a lot around the country.
:03:51. > :03:58.Sometimes they are connected to the disability side which is a real
:03:58. > :04:04.problem. The upshot is that Dave is left with basically a state pension,
:04:04. > :04:09.is that enough given that he needs help? Absolutely not. It is bad
:04:09. > :04:11.enough for a normal pension are to be on the basic pension. Our
:04:11. > :04:16.position is that the basic state pension should be above the poverty
:04:16. > :04:19.level which is �178, that would get rid of means testing and that
:04:19. > :04:24.catches people out because if you lose means testing you lose
:04:24. > :04:28.everything. Is there anything that can be done about this 15 month
:04:28. > :04:34.wait? The Government has brought people in because they were aware
:04:34. > :04:39.that there would be so many people. The national pensions have been on
:04:39. > :04:43.to the Government already and a few months ago, they got a standard
:04:43. > :04:46.reply, they will look at it and they will come back at how they
:04:46. > :04:50.will look at recruiting. My own personal view of this now thinking
:04:50. > :04:54.about it, they need to separated from the tribunal and have a
:04:54. > :05:00.separate way of dealing with it. It is actually going to get worse. It
:05:00. > :05:03.really is. And people who have been denied their benefits, they will
:05:03. > :05:08.have to wait all this time for an appeal and in the meantime, will
:05:08. > :05:12.they get the money back if it is found in your favour? The big
:05:12. > :05:16.question. Let's hope so that is not the problem, the real problem is
:05:16. > :05:20.the fact they have not got things to live on and very often they need
:05:20. > :05:26.care. To be able to have that money particularly if they have got a
:05:26. > :05:32.personal budget, they have got a problem, where do they go? We will
:05:32. > :05:35.leave at there, but Dave, thanks Three men have been sentenced for
:05:35. > :05:39.their part in placing a pig's head near the site of a proposed mosque
:05:39. > :05:42.in Nottinghamshire. Nottingham magistrates heard that the offence
:05:43. > :05:45.was racially and religiously aggravated. All three defendants
:05:45. > :05:55.today were fined, another defendant was given a suspended prison
:05:55. > :05:56.
:05:56. > :06:00.sentence in July, for his part in On 23rd June this year, a woman and
:06:00. > :06:03.her young daughter were walking around Collington way in West
:06:03. > :06:08.Bridgford. As they passed this piece of land, earmarked for a
:06:08. > :06:14.possible mosque they found a pig's head stuck on a pole with two
:06:14. > :06:24.deeply offensive words written on the pig. On the ground was spray-
:06:24. > :06:26.
:06:26. > :06:35.painted "no mosque here, EDL Nottinghamshire". 41-year-old Wayne
:06:35. > :06:38.and 20 when -- 22-year-old seen here in light coloured coats and
:06:38. > :06:48.20-year-old Robert seen here on the right with a tie. All three

:06:50. > :06:54.admitted the role in racially and religiously aggravated harassment.
:06:54. > :06:59.The judge said all three of you should be ashamed, very ashamed.

:08:20. > :08:27.Derby. On Wednesday MPs will begin an inquiry into why the firm missed
:08:27. > :08:29.out on the �1.4 billion Thameslink contract. But ahead of that, it's
:08:29. > :08:38.emerged that over 800 UK companies that supply Bombardier could also
:08:38. > :08:41.be badly hit. Here's our chief news The effect of the Government's
:08:41. > :08:44.decision to award the huge Thameslink contract to the German
:08:44. > :08:49.firm Siemens has already been felt at Bombardier with the loss of
:08:49. > :08:56.1,400 jobs at its Derby base. The Canadian owners are also reviewing
:08:56. > :08:59.their UK operations. But the wider knock-on effects are still emerging.

:10:34. > :10:37.Nottingham say it was started deliberately. Firefighters were

:10:47. > :10:56.in a wooden portable classroom. The building has been unused since the
:10:56. > :11:00.school moved to a new site two years ago. No-one was hurt. The
:11:00. > :11:04.Government has approved plans to close two walk-in centres for the
:11:04. > :11:08.NHS despite local opposition. The Nottinghamshire NHS Trust announced

:13:15. > :13:25.using similar versions. In Leicester, it is used in selected
:13:25. > :13:29.It does make you stop and not speak to them when they are doing the
:13:29. > :13:33.drug grounds. Probably a good idea. School catchment areas in Leicester
:13:33. > :13:36.are to be reviewed for the first time in more than a decade. The
:13:36. > :13:40.move comes after a family were refused a place for their son at a
:13:40. > :13:44.primary school on their street. Andy and Louise Cooper now have to
:13:44. > :13:54.drive 75 miles a week to take their son Charlie to a school on the
:13:54. > :13:54.

:13:58. > :14:02.tell when it comes to school catchment boundaries. This is

:14:33. > :14:36.Knott. I can show you why this is an absurd situation. You only have
:14:36. > :14:41.to walk 100 metres down to the bottom of the street and there it
:14:41. > :14:45.is, and entrance to the school. Montrose primary school. But this
:14:45. > :14:51.street has a bizarre catchment area. That side is considered in
:14:51. > :14:54.catchment, and the sad that the Coopers is considered out of
:14:54. > :14:59.catchments of the school was not able to offer charlie Cooper a
:14:59. > :15:02.place despite two appeals. Today, the Mayor of Leicester has ordered
:15:02. > :15:06.a review of catchment areas in the City to stop a situation like this

:15:17. > :15:22.the situation which is frankly appalling, having neglected these
:15:22. > :15:27.catchment areas, is put right and we are able to make sure that
:15:27. > :15:32.children are able, particularly on the doorstep of a school, to attend.
:15:32. > :15:38.It is shocking and disgusting how we have been treated. Thankfully
:15:38. > :15:41.today, it seems that our hard work has paid off and this will affect

:15:54. > :15:58.more families in the City could A new crackdown on metal theft in

:17:39. > :17:44.people from New York, firefighters and we got talking to each other,
:17:44. > :17:50.exchanging gifts and T-shirts and caps and things like that. And I
:17:50. > :17:54.managed to make a few friends and we kept in touch. Mark soon got
:17:54. > :17:58.invited to help out with a firefighters' charity. It collects
:17:58. > :18:01.used fire fighting equipment for countries where it is desperately
:18:02. > :18:06.needed. I went to see the chief at that time and asked him if we could
:18:06. > :18:10.help the foundation. Some of the kit has gone to the Philippines,
:18:10. > :18:14.they used to fight fires in flip- flops and short. And we helped out
:18:14. > :18:18.in the floods in New Orleans as well. 9/11 has changed my life
:18:18. > :18:22.massively and it has taken hours and hours of not only my life but
:18:23. > :18:29.my family's life as well. And as New York commemorates the twin
:18:29. > :18:34.tower attacks this weekend, Mark's has been invited to join the
:18:34. > :18:38.memorial services. It would be very emotional, to go to New York, we
:18:38. > :18:42.have been there on numerous occasions and they look after us
:18:42. > :18:48.like we are one of their own. I cannot put into words what 9/11 did
:18:48. > :18:58.to me. It is a big part of our life now. Another story tomorrow from
