:00:03. > :00:13.Dominic Heale and Anne Davies. Our top story tonight, losing benefit

:00:13. > :00:13.

:00:13. > :00:16.and losing patience. Dave Hardwick is appealing against the loss of

:00:16. > :00:19.his disability allowance but there's a huge backlog.

:00:19. > :00:22.I have to wait 15 months for an appeal against a Government

:00:22. > :00:27.decision, totally wrong. Also tonight, doing the rounds, the "do

:00:27. > :00:30.not disturb" vests helping nurses to help patients.

:00:30. > :00:37.Plus how the 9/11 attacks changed everything for this Nottinghamshire

:00:37. > :00:43.fire fighter. It changed my life massively and it has taken hours

:00:43. > :00:48.and hours of not only my life but my family's life as well.

:00:48. > :00:58.summer goes out with a bang. The excitement, the ups and downs and

:00:58. > :01:10.

:01:10. > :01:13.Good evening and welcome to East Midlands Today. First tonight, a

:01:13. > :01:19.pensioner stripped of 100 per week in benefits says he's being forced

:01:19. > :01:22.to wait 15 months to appeal against the decision. Dave Hardwick from

:01:22. > :01:26.Derbyshire has written to the Prime Minister to complain about the

:01:26. > :01:36.delay. But the Government admits there's now a backlog of 180,000

:01:36. > :01:39.

:01:39. > :01:44.cases in the benefit appeals system. Pensioner Dave Hardwick has

:01:44. > :01:47.arthritis, diabetes and other health problems but the Government

:01:47. > :01:51.has stopped part of his Disability Living Allowance earlier this year.

:01:51. > :01:55.He claims that has stripped him of around 100 per week. He is

:01:55. > :02:01.appealing against the decision but has been told it will take 15

:02:01. > :02:05.months to go to a tribunal. I am existing but I am just existing,

:02:05. > :02:10.but people desperately need this money who are far worse off than me

:02:10. > :02:13.and to wait 15 months for an appeal against a Government decision? It

:02:13. > :02:16.is totally wrong. He has also written directly to the Prime

:02:16. > :02:24.Minister to complain about the long wait for his tribunal to be heard.

:02:24. > :02:29.He has not had a reply. He says he is now living on his state pension

:02:29. > :02:34.of around 136 per week. Put money so tight that he has to limit the

:02:34. > :02:39.amount of diesel he puts into his brand new mobility car. A car paid

:02:39. > :02:45.for by the benefits system. I have to go to hospital in Derby four

:02:45. > :02:48.times every few weeks and at the end of the day, that is the only

:02:48. > :02:52.diesel I can afford so I can't use it for getting around and

:02:52. > :02:56.socialising. The Government's tribunal services there has been a

:02:56. > :03:00.large number of increases in tribunal cases going to appeal. The

:03:00. > :03:05.backlog stands at around 180,000 cases. More than half of them are

:03:05. > :03:12.the result of people being denied incapacity benefit. Something which

:03:12. > :03:15.Dave Hardwick was not even claiming. He now wants more resources put

:03:15. > :03:18.into the tribunal system to cut waiting times.

:03:18. > :03:20.To discuss that case and the wider issues, I'm joined now by David

:03:20. > :03:28.Jones, the East Midlands treasurer for the National Pensioners

:03:28. > :03:31.Convention pressure group. That is a long title! How unusual is this

:03:31. > :03:34.case, Dave Hardwick - a pensioner being caught up in a backlog of

:03:34. > :03:41.tribunal cases, more than half of them to do with incapacity benefit,

:03:41. > :03:45.a benefit that Dave Hardwick wasn't even claiming? It is not quite as

:03:45. > :03:48.unusual as you think but I know of one in Gloucestershire and I known

:03:48. > :03:51.nationally they have been picking up a lot around the country.

:03:51. > :03:58.Sometimes they are connected to the disability side which is a real

:03:58. > :04:04.problem. The upshot is that Dave is left with basically a state pension,

:04:04. > :04:09.is that enough given that he needs help? Absolutely not. It is bad

:04:09. > :04:11.enough for a normal pension are to be on the basic pension. Our

:04:11. > :04:16.position is that the basic state pension should be above the poverty

:04:16. > :04:19.level which is 178, that would get rid of means testing and that

:04:19. > :04:24.catches people out because if you lose means testing you lose

:04:24. > :04:28.everything. Is there anything that can be done about this 15 month

:04:28. > :04:34.wait? The Government has brought people in because they were aware

:04:34. > :04:39.that there would be so many people. The national pensions have been on

:04:39. > :04:43.to the Government already and a few months ago, they got a standard

:04:43. > :04:46.reply, they will look at it and they will come back at how they

:04:46. > :04:50.will look at recruiting. My own personal view of this now thinking

:04:50. > :04:54.about it, they need to separated from the tribunal and have a

:04:54. > :05:00.separate way of dealing with it. It is actually going to get worse. It

:05:00. > :05:03.really is. And people who have been denied their benefits, they will

:05:03. > :05:08.have to wait all this time for an appeal and in the meantime, will

:05:08. > :05:12.they get the money back if it is found in your favour? The big

:05:12. > :05:16.question. Let's hope so that is not the problem, the real problem is

:05:16. > :05:20.the fact they have not got things to live on and very often they need

:05:20. > :05:26.care. To be able to have that money particularly if they have got a

:05:26. > :05:32.personal budget, they have got a problem, where do they go? We will

:05:32. > :05:35.leave at there, but Dave, thanks Three men have been sentenced for

:05:35. > :05:39.their part in placing a pig's head near the site of a proposed mosque

:05:39. > :05:42.in Nottinghamshire. Nottingham magistrates heard that the offence

:05:43. > :05:45.was racially and religiously aggravated. All three defendants

:05:45. > :05:55.today were fined, another defendant was given a suspended prison

:05:55. > :05:56.

:05:56. > :06:00.sentence in July, for his part in On 23rd June this year, a woman and

:06:00. > :06:03.her young daughter were walking around Collington way in West

:06:03. > :06:08.Bridgford. As they passed this piece of land, earmarked for a

:06:08. > :06:14.possible mosque they found a pig's head stuck on a pole with two

:06:14. > :06:24.deeply offensive words written on the pig. On the ground was spray-

:06:24. > :06:26.

:06:26. > :06:35.painted "no mosque here, EDL Nottinghamshire". 41-year-old Wayne

:06:35. > :06:38.and 20 when -- 22-year-old seen here in light coloured coats and

:06:38. > :06:48.20-year-old Robert seen here on the right with a tie. All three

:06:48. > :06:50.

:06:50. > :06:54.admitted the role in racially and religiously aggravated harassment.

:06:54. > :06:59.The judge said all three of you should be ashamed, very ashamed.

:06:59. > :07:03.The court also heard on armed forces Day on Nottingham, two days

:07:03. > :07:06.after the pigs had incident, Wayne also shouted highly insulting

:07:06. > :07:12.phrases at some Muslims who set up a stall in Nottingham city centre.

:07:12. > :07:20.For his part in both these incidents, the man with glasses was

:07:20. > :07:25.given fines and costs. Nicholas Long was given fines and costs of

:07:25. > :07:31.300 as was Adam. In July, another defendant was given a suspended

:07:31. > :07:34.prison sentence for his part in place in the pig's head.

:07:34. > :07:37.Police have arrested a third person in connection with a stabbing in

:07:37. > :07:43.Derby. A 22-year-old man was stabbed on Saturday night at

:07:43. > :07:46.Sunnyhill Avenue outside an off- licence. Police say he is in a

:07:46. > :07:50.serious but stable condition in hospital. A 15-year-old boy was

:07:50. > :07:56.arrested last night. Two men are also being questioned.

:07:56. > :07:59.Coming up later, the tenth anniversary of 9/11. We meet an

:07:59. > :08:09.East Midlands fireman whose life was changed forever by the attack

:08:09. > :08:15.

:08:15. > :08:20.It's an important week for Bombardier and its workforce in

:08:20. > :08:27.Derby. On Wednesday MPs will begin an inquiry into why the firm missed

:08:27. > :08:29.out on the 1.4 billion Thameslink contract. But ahead of that, it's

:08:29. > :08:38.emerged that over 800 UK companies that supply Bombardier could also

:08:38. > :08:41.be badly hit. Here's our chief news The effect of the Government's

:08:41. > :08:44.decision to award the huge Thameslink contract to the German

:08:44. > :08:49.firm Siemens has already been felt at Bombardier with the loss of

:08:49. > :08:56.1,400 jobs at its Derby base. The Canadian owners are also reviewing

:08:56. > :08:59.their UK operations. But the wider knock-on effects are still emerging.

:08:59. > :09:02.According to the Unite union, the ripples from Derby have spread to

:09:02. > :09:05.suppliers across the UK from as far apart as Edinburgh and London,

:09:05. > :09:09.taking in major cities such as Newcastle, Birmingham, Manchester

:09:09. > :09:12.and Nottingham. Even places not usually associated with train-

:09:12. > :09:17.making such as Weston-super-Mare in Somerset and Horsham in West Sussex

:09:17. > :09:20.will be affected. The union estimates that around 830 firms

:09:20. > :09:26.will be hit putting up to 10,000 jobs nationwide under potential

:09:26. > :09:29.threat. Tomorrow the union will publish a survey of suppliers which

:09:29. > :09:33.will show that a large percentage are laying off staff and fear for

:09:33. > :09:38.the future. And Derby City Council says it's proposing to financially

:09:38. > :09:40.support any judicial review brought by Unite. Despite mass protests,

:09:40. > :09:46.the Prime Minister won't budge, insisting the contract was awarded

:09:46. > :09:48.fairly in accordance with EU rules. 200 people will travel down on a

:09:48. > :09:51.special train from Derby on Wednesday in the hope the Transport

:09:51. > :09:59.Select Committee will disagree with the PM and recommend a retendering

:09:59. > :10:05.of the contract. A man serving a life sentence for

:10:05. > :10:08.murder has absconded from Sudbury Prison in Derbyshire. 41-year-old

:10:08. > :10:13.Steven Blissett failed to return to the prison yesterday after being

:10:13. > :10:17.released on a temporary licence. He was sentenced to life imprisonment

:10:18. > :10:22.for murder in 1997. He's described as five-foot-eight with a slim

:10:22. > :10:27.build. 36-year-old Mark Carter has also absconded. He's described as

:10:27. > :10:30.five-foot-ten with a medium build and a Midlands accent.

:10:30. > :10:34.Officers investigating a fire that broke out at a disused school in

:10:34. > :10:37.Nottingham say it was started deliberately. Firefighters were

:10:37. > :10:44.called to the Old Becket School in West Bridgford just after seven

:10:44. > :10:47.last night. As this viewer's footage shows, the fire was started

:10:47. > :10:56.in a wooden portable classroom. The building has been unused since the

:10:56. > :11:00.school moved to a new site two years ago. No-one was hurt. The

:11:00. > :11:04.Government has approved plans to close two walk-in centres for the

:11:04. > :11:08.NHS despite local opposition. The Nottinghamshire NHS Trust announced

:11:08. > :11:12.it wanted to close the care be in Ashfield and Stapleford centres

:11:12. > :11:15.earlier this year but the county council referred the matter to

:11:15. > :11:19.ministers. The Health Secretary says the centre's can close as long

:11:19. > :11:22.as the local health services which remain offer the same quality or

:11:22. > :11:24.possibly even better. Hospital managers say patient

:11:25. > :11:29.safety has improved since nurses started wearing "do not disturb"

:11:29. > :11:33.vests whilst doing drug rounds. Some patients groups have

:11:33. > :11:36.criticised the idea. But anecdotal evidence in Derby suggests staff

:11:36. > :11:46.have been able to focus better on delivering medication because of

:11:46. > :11:48.

:11:48. > :11:53.fewer interruptions. Our health This might appeal to many workers,

:11:53. > :11:58.the first version of what nurses walk on the Derby Hospital's drug

:11:58. > :12:03.round. It was decided to keep the concept of "do not disturb" but

:12:03. > :12:06.give an explanation. To put the programmes on there. Here's the

:12:06. > :12:13.garment second version brought in. Patients do not see red, it is

:12:13. > :12:18.aimed at them and deterring staff from interrupting. It reduces the

:12:18. > :12:24.risk of mistakes. It has made a definite improvement. Not many

:12:24. > :12:28.people interrupting us which is vital. Derby hospitals say it has

:12:28. > :12:33.reduced errors by 10% but could not be specific on exact numbers.

:12:33. > :12:39.Across the NHS in England and Wales, 133,000 drug mistakes were admitted

:12:39. > :12:46.last year. That is an average of 364 per day. In Derby, people had

:12:46. > :12:53.seen the sense of bringing in the garment. I know I would be

:12:53. > :13:00.reassured that they are giving everything there for concentration.

:13:00. > :13:05.Does this give the right message to patients? Surely nurses should be

:13:05. > :13:08.able to multi- task. If we have got patients who require assistance

:13:08. > :13:12.which is non urgent, there are always other people who are able to

:13:12. > :13:15.assist the patient with that. Increasing numbers of hospitals are

:13:15. > :13:25.using similar versions. In Leicester, it is used in selected

:13:25. > :13:29.It does make you stop and not speak to them when they are doing the

:13:29. > :13:33.drug grounds. Probably a good idea. School catchment areas in Leicester

:13:33. > :13:36.are to be reviewed for the first time in more than a decade. The

:13:36. > :13:40.move comes after a family were refused a place for their son at a

:13:40. > :13:44.primary school on their street. Andy and Louise Cooper now have to

:13:44. > :13:54.drive 75 miles a week to take their son Charlie to a school on the

:13:54. > :13:54.

:13:54. > :13:58.other side of the city. Victoria The Coopers have their own tale to

:13:58. > :14:02.tell when it comes to school catchment boundaries. This is

:14:02. > :14:07.George, their eldest son Charlie has been at school today. But not

:14:07. > :14:12.at the school on their Street. That is considered out of catchment.

:14:12. > :14:17.spent hours and hours fight in the council, writing to them, trying to

:14:17. > :14:22.get anybody to see sense but we are in an absurd situation. All the

:14:22. > :14:24.children on the street walking past our house to the school, or

:14:25. > :14:33.Charlie's friends and neighbours going to the school, and Charlie

:14:33. > :14:36.Knott. I can show you why this is an absurd situation. You only have

:14:36. > :14:41.to walk 100 metres down to the bottom of the street and there it

:14:41. > :14:45.is, and entrance to the school. Montrose primary school. But this

:14:45. > :14:51.street has a bizarre catchment area. That side is considered in

:14:51. > :14:54.catchment, and the sad that the Coopers is considered out of

:14:54. > :14:59.catchments of the school was not able to offer charlie Cooper a

:14:59. > :15:02.place despite two appeals. Today, the Mayor of Leicester has ordered

:15:02. > :15:06.a review of catchment areas in the City to stop a situation like this

:15:06. > :15:14.happening again. Once the review is completed, we have an opportunity

:15:14. > :15:17.to put it into place and to make sure of that by this time next year,

:15:17. > :15:22.the situation which is frankly appalling, having neglected these

:15:22. > :15:27.catchment areas, is put right and we are able to make sure that

:15:27. > :15:32.children are able, particularly on the doorstep of a school, to attend.

:15:32. > :15:38.It is shocking and disgusting how we have been treated. Thankfully

:15:38. > :15:41.today, it seems that our hard work has paid off and this will affect

:15:41. > :15:46.and benefit all families in Leicester and that, I am very

:15:46. > :15:54.pleased about. Well this review may come too late for the Coopers, many

:15:54. > :15:58.more families in the City could A new crackdown on metal theft in

:15:58. > :16:00.Derbyshire has led to the arrest of eight people in the first 24 hours.

:16:00. > :16:05.Derbyshire Police launched Operation Calanthia after a surge

:16:05. > :16:08.in metal thefts from homes, churches and railway lines. Four

:16:08. > :16:12.men were arrested on a disused train track in North Derbyshire on

:16:12. > :16:18.Friday. Four teenagers were also arrested in Castle Gresley in South

:16:18. > :16:21.Derbyshire, after lead was found to be missing from homes.

:16:21. > :16:24.More than 6 million is to be spent trying to boost businesses in

:16:24. > :16:29.Leicester. The city council's offering cash grants to

:16:29. > :16:32.organisations that can support and advise fledgling firms. It comes

:16:32. > :16:35.after the city secured European funding to help the local economy.

:16:35. > :16:43.Another 2 million is to be spent improving city streets and public

:16:43. > :16:46.It's ten years this weekend since the attacks on the Twin Towers in

:16:46. > :16:52.New York and as we know it, 9/11, sent shockwaves right around the

:16:52. > :16:56.world. This week we're meeting people here in the East Midlands

:16:56. > :16:59.whose lives were changed forever. From terror attacks here in the UK

:16:59. > :17:04.to troops serving abroad or even something as mundane as catching a

:17:04. > :17:06.flight, we've all been affected by the security crackdown. For more,

:17:06. > :17:16.let's join our social affairs correspondent, Jeremy Ball, who's

:17:16. > :17:20.

:17:20. > :17:24.I was watching TV and it was an unbelievable sight. The guys were

:17:24. > :17:29.going in and the towers were going down, you knew there would be fatal

:17:29. > :17:34.it is. 2002 was the first anniversary of 9/11, I was

:17:34. > :17:39.wondering what I could do myself. Down at Ground Zero we met a lot of

:17:39. > :17:44.people from New York, firefighters and we got talking to each other,

:17:44. > :17:50.exchanging gifts and T-shirts and caps and things like that. And I

:17:50. > :17:54.managed to make a few friends and we kept in touch. Mark soon got

:17:54. > :17:58.invited to help out with a firefighters' charity. It collects

:17:58. > :18:01.used fire fighting equipment for countries where it is desperately

:18:02. > :18:06.needed. I went to see the chief at that time and asked him if we could

:18:06. > :18:10.help the foundation. Some of the kit has gone to the Philippines,

:18:10. > :18:14.they used to fight fires in flip- flops and short. And we helped out

:18:14. > :18:18.in the floods in New Orleans as well. 9/11 has changed my life

:18:18. > :18:22.massively and it has taken hours and hours of not only my life but

:18:23. > :18:29.my family's life as well. And as New York commemorates the twin

:18:29. > :18:34.tower attacks this weekend, Mark's has been invited to join the

:18:34. > :18:38.memorial services. It would be very emotional, to go to New York, we

:18:38. > :18:42.have been there on numerous occasions and they look after us

:18:42. > :18:48.like we are one of their own. I cannot put into words what 9/11 did

:18:48. > :18:58.to me. It is a big part of our life now. Another story tomorrow from

:18:58. > :18:59.

:18:59. > :19:03.someone else's life was changed by nine 9/11.

:19:03. > :19:13.Still to come, a bit of a party at the palace of the peaks. We'll have

:19:13. > :19:18.

:19:19. > :19:24.all the highlights of the three-day I wasn't there but I know somebody

:19:24. > :19:29.who was. Yes, but I missed the Red Arrows, but it was terrific on

:19:29. > :19:32.Saturday. We're in an international break so

:19:32. > :19:34.Notts County stepped into the spotlight, and duly delivered a

:19:34. > :19:38.command performance, dominating Bournemouth in a very enjoyable 3-1

:19:38. > :19:48.win. And today - to take a closer look - I get to play with our

:19:48. > :20:00.

:20:00. > :20:04.A fantastic win for Notts County at the weekend and with no

:20:04. > :20:09.championship football, only one place for us to take our tactics

:20:09. > :20:13.truck and I am delighted to say, Martin Allen, good afternoon.

:20:13. > :20:23.I usually start the beginning with these things. But I am tempted to

:20:23. > :20:23.

:20:23. > :20:28.start with this. This is a heck of belief and the confidence. I

:20:28. > :20:34.believe it is a bit of a South American quality, Lombardo, that

:20:34. > :20:37.sort of quality to him. That goal, the third for Notts County, was the

:20:37. > :20:41.way it started very well. Lee Hughes had not trained for a week,

:20:42. > :20:47.this was the first minute. That is what Lee Hughes has made a living

:20:47. > :20:51.from all these years. He gets his body in behind, he has taken the

:20:51. > :21:00.goalkeeper by surprised and it is rolling into the goal. Actually,
