:00:00. > :00:21.Now the news for the East Midlands, I'm Anne Davies. A Lincolnshire man,

:00:22. > :00:24.who murdered 10`year`old Rosie`May Storrie, has lost his appeal against

:00:25. > :00:27.his conviction and sentence. Paul Smith was found guilty of

:00:28. > :00:27.suffocating Rosie May at a Christmas party 0

:00:28. > :00:39.suffocating Rosie May at a Christmas party in Leicestershire in 2003. Amy

:00:40. > :00:43.Harris reports. Rosie`May Storrie, aged nine, filmed at home in 2002

:00:44. > :00:49.with her pet rabbit. A year later, she would be dead. Rosie`May was

:00:50. > :00:55.killed at a Christmas party at this house by another guest. 17`year`old

:00:56. > :01:01.Paul Smith. He was convicted of suffocating her and sentenced to 14

:01:02. > :01:05.years in jail. He's always denied murder and his previous `` has

:01:06. > :01:10.previously attempted to change the verdict. Today, it was announced the

:01:11. > :01:13.Court of Appeal refused an appeal againsts his conviction and

:01:14. > :01:19.sentence. It's welcome news for Rosie`May's family. It means we can

:01:20. > :01:25.get on with our lives and go forward in a positive way. It's a decision

:01:26. > :01:29.that can't be reversed, but Paul Smith's father, Nigel, says the

:01:30. > :01:36.fight to clear his son's name will go on. My son is innocent. This is a

:01:37. > :01:41.huge miscarriage of justice. I will continue to fight it. Rosie`May was

:01:42. > :01:46.a born performer. This year, she would have been 21. Her family are

:01:47. > :01:51.coping with their loss by putting their energy and efforts into a

:01:52. > :01:55.dance academy and a children's home in Sri Lanka, set up in her name.

:01:56. > :02:03.Their way of giving other young people the future that Rosie`May was

:02:04. > :02:08.denied. Amy Harris, BBC East Midlands Today. Next tonight, the

:02:09. > :02:11.twins who, their parents say, have missed out on months of schooling.

:02:12. > :02:14.The girls both have disabilities and need to be assessed, but the family

:02:15. > :02:18.have been waiting since last June for some kind of decision. There is

:02:19. > :02:21.the chance of places at a school a mile away, but the council won't

:02:22. > :02:34.fund special transport. Jo Healey reports. It was the girls birthday

:02:35. > :02:38.yesterday, 10 years marked by surgery. Zara had an operation on

:02:39. > :02:43.her spine, last June they moved back from Birmingham to Derby. Since then

:02:44. > :02:53.their concern hasn't been just their health, but their education. My

:02:54. > :03:00.favourite subjects are maths and English. I miss my friends. I miss

:03:01. > :03:03.not going back to school. They are highly dependant. We have been

:03:04. > :03:08.struggling throughout. We have not been able to get any schooling, any

:03:09. > :03:14.home education. It's been uphill. We want them to go to school. City

:03:15. > :03:18.Council has a school in mind. The family say it's a mile from home.

:03:19. > :03:23.The council won't give them special transport. Their chairs won't fit in

:03:24. > :03:29.a car. This would be their only option. They are prone to infection,

:03:30. > :03:33.they have a low immune system. We're worried they will end up in hospital

:03:34. > :03:38.again. If we have to do this every day in the cold, rain and wet it's

:03:39. > :03:44.not a solution. We are very worried that we won't be able to keep this

:03:45. > :03:47.up. In a statement, Derby City Council said the family had been

:03:48. > :03:52.encouraged to apply for help with transport and the council always

:03:53. > :03:55.puts the needs of children first. A 71`year`old woman was helicoptered

:03:56. > :03:59.to hospital after a smash between a bus and tractor in a Leicesteshire

:04:00. > :04:02.village. Witnesses saw a single decker bus collide with a tractor,

:04:03. > :04:07.before hitting a wall in North Street in Rothley today. Three

:04:08. > :04:09.others were taken to hospital as a precaution. The road was closed

:04:10. > :04:17.while emergency services rescued the woman, who suffered serious leg

:04:18. > :04:21.injuries. The bus was well lodged in the wall. The driver side was lodged

:04:22. > :04:27.worse, the tractor hit the door as you would step onto the bus. The

:04:28. > :04:31.front of the bus was in a good mess. The Government has turned down a

:04:32. > :04:34.plan to improve one of our key rail links. A minister says there's no

:04:35. > :04:45.business case for work on the Castle Railway line from Nottingham to

:04:46. > :04:51.Lincoln, via Newark. To no avail. The East Coast Main Line gets

:04:52. > :04:58.passengers into King's Cross in 1 hour 22 minutes. The Government is

:04:59. > :05:03.talking about spending a lot of money on North/ Rail. It's cross

:05:04. > :05:06.country that we need a lot more help. The service would be improved

:05:07. > :05:12.because there is always too many people on it. If the train was more

:05:13. > :05:14.frequent, it would be better. From Nottingham toll Newark in the

:05:15. > :05:18.evening you have two coaches. You have a lot more people commuting

:05:19. > :05:22.from work or university, like myself, who want to get home, yet

:05:23. > :05:30.you can't get a seat. That's bad service. The Castle line opened? 18

:05:31. > :05:34.46 and is regarded as an an important railway. That's why local

:05:35. > :05:49.politicians want new investment to cut journey times. We all want this

:05:50. > :05:56.to succeed right outside our constituency. It's emerged that the

:05:57. > :06:00.message has yet to reach a Transport Minister. The department has

:06:01. > :06:05.received no comment from Nottinghamshire County Council or

:06:06. > :06:09.Lincoln conshire County Council Council. We haven't seen a business

:06:10. > :06:13.case. Council is the organisation that lobbies for our region say it

:06:14. > :06:17.is's disappointed. A business case has been made. Maybe on the Castle

:06:18. > :06:28.Line these things take much longer to arrive. Football now, and both

:06:29. > :06:31.Leicester and Derby were in action tonight. The Foxes beat Birmingham

:06:32. > :06:35.2`1 to set a new club record of eight League wins in a row. Derby

:06:36. > :06:36.were 2`0 down to Yeovil at half time, but they fought back to win

:06:37. > :06:39.3`2. Now a look at the weather: were 2`0 down to Yeovil at half

:06:40. > :06:46.time, but We are in nor a short, sharp cold snap over the next few

:06:47. > :06:50.days. The showers will diminish tomorrow. Some could turn wintry.

:06:51. > :06:55.For the time being it's wetness we have in store for tonight. There

:06:56. > :06:59.could be a wintry element to the showers later on in the night across

:07:00. > :07:04.the Peak District. For most it will be rain showers. It is relatively

:07:05. > :07:09.mild, four or five Celsius our lowest temperature. Grim start to

:07:10. > :07:14.tomorrow morning, cloud and showers. The showers will merge for a time

:07:15. > :07:18.during the morning time. They may turn wintry as the cold air feeds in

:07:19. > :07:20.with highs of five Celsius. Colder still on Thursday, 0

:07:21. > :07:25.with highs of five Celsius. Colder still on Thursday, wet, windy and

:07:26. > :07:27.mild again by Friday. That's about it from the late team. From all of

:07:28. > :07:31.us, goodbye.
