:00:09. > :00:11.This is East Midlands Today with Geeta Pendse and me, Dominic Heale.

:00:12. > :00:13.Tonight ` freed. A man who spent six years in jail

:00:14. > :00:28.for a murder he didn't commht. And today cleared of ordering the

:00:29. > :00:34.shooting of a teenager. She should never have been there in thd first

:00:35. > :00:41.place and someone has lost the life but it was not the fault of my son.

:00:42. > :00:50.He was saved by a bone marrow transplant, now he is recruhting new

:00:51. > :00:55.donors. I know how difficult it was to get the dawn, this is my way of

:00:56. > :01:00.giving something back and shgning up for life savers. And the chhldren's

:01:01. > :01:19.laureate pays a visit. Good evening.

:01:20. > :01:23.Welcome to Wednesday's programme. First.

:01:24. > :01:25.A man who was jailed for a lurder he didn't commit has been freed

:01:26. > :01:28.after almost six years behind bars. Michael Hamblett`Sewell was

:01:29. > :01:32.originally convicted of ordering the shooting of the

:01:33. > :01:35.Derby teenager, Kadeem Blackwood. The prosecution had used

:01:36. > :01:39.a controversial law known as "joint enterprise".

:01:40. > :01:43.But today, after a SECOND rd`trial, a jury decided that he WASN'T

:01:44. > :01:46.guilty. Our Social Affairs Correspondent,

:01:47. > :01:54.Jeremy Ball, was in court. An emotional day?

:01:55. > :01:57.Yes. There were gasps and tears

:01:58. > :02:02.from family who were sitting just behind me.

:02:03. > :02:06.I heard them shout "thank you jury," and then, "thank you judge".

:02:07. > :02:09.As that jury took barely a couple of hours to clear Michael H`mblett

:02:10. > :02:19.Sewell, of committing one of Derby's most notorious murders.

:02:20. > :02:29.Free for the first time in `lmost six years he left court tod`y numb

:02:30. > :02:34.with promotion. I am just pleased that justice has finally bedn done.

:02:35. > :02:41.We have suffered for the last six years with name`calling and I have

:02:42. > :02:46.even lost a job through it. He should never have been paid in the

:02:47. > :02:52.first place. At the end of the DA young man has lost his life but

:02:53. > :02:59.through no fault of my son. A 15`year`old was murdered in this

:03:00. > :03:05.part. He was a keen musician who recorded this track for his girl

:03:06. > :03:08.friend but a trivial row ovdr this respect led to this horrifyhng

:03:09. > :03:35.treble nine call. It is now almost six years since the

:03:36. > :03:38.shooting. Two men were jaildd for life for the murder. Michael

:03:39. > :03:50.Hamblett Sewell denied he h`d ordered the shooting. This secondary

:03:51. > :03:56.trial finally cleared his n`me. I am just proud that the name has been

:03:57. > :04:03.cleared and my sister can now get on with her life. He has practhcally

:04:04. > :04:10.grown up in prison. He was 09 when it happened and is 25 now. H hope

:04:11. > :04:18.nothing like this ever happdns again. He has lost six years of

:04:19. > :04:24.liberty and the murder will affect the rest of his life. Why h`s it

:04:25. > :04:30.taken so long for Michael H`mblett Sewell to clear his name? This was a

:04:31. > :04:37.really difficult case to prove either way. The prosecution used a

:04:38. > :04:43.controversial law known as joint enterprise. They simply had to prove

:04:44. > :04:44.he was involved in the markdr. Some evidence used that trial later

:04:45. > :04:59.proved to be unreliable. Let's speak to Paul Bacon,

:05:00. > :05:01.a local lawyer who's defenddd more than 60 murder suspects.

:05:02. > :05:05.Why's the "joint enterprise" law used?

:05:06. > :05:13.There are crimes involving groups of young men. It means different people

:05:14. > :05:17.can be charged with the samd offence even though they have played

:05:18. > :05:23.different roles in the crimd. You look at the reaction there has been

:05:24. > :05:27.to these charges and prosecttions, there are so many appeals which is

:05:28. > :05:32.an indication if there is an unsatisfactory area of the law. I

:05:33. > :05:38.suppose in a lot of these c`ses the person doing the killing is simply

:05:39. > :05:45.following orders, does this not make sure it is the person who is

:05:46. > :05:48.responsible? Before this cale fashionable you were charged with

:05:49. > :05:54.different offences, aiding `nd abetting, a free, if you were not

:05:55. > :05:58.the principal offender who had pulled the trigger knowinglx are

:05:59. > :06:11.just played in all together and it is left to the duty to try to tease

:06:12. > :06:18.out who is responsible. `` Julie. Michael Hamblett Sewell's f`mily say

:06:19. > :06:30.they are also concerned abott the joint enterprise system as well

:06:31. > :06:34.A Leicester care home at thd centre of allegations of ill treatlent had

:06:35. > :06:37.systematic failings, accordhng to a report by an independent regulator.

:06:38. > :06:40.Care Quality Commission inspectors visited Fosse Court in July.

:06:41. > :06:41.The home failed 4 out of 5 `reas of evaluation

:06:42. > :06:43.including safeguarding against abuse and managing medication.

:06:44. > :06:45.The home closed in July after four workers were arrdsted.

:06:46. > :06:48.Last week police confirmed no further action would be takdn.

:06:49. > :06:50.Today the family of one forler resident spoke of their concerns.

:06:51. > :07:02.Every time she said they do not give me food, they do not give md

:07:03. > :07:11.medicine properly, they do not come and clean, I am upset. My

:07:12. > :07:16.mother`in`law says she is a very clean lady. Every time I crhed. She

:07:17. > :07:24.is there and we cannot do anything. In a statement, Fosse Court Care

:07:25. > :07:27.home say they've produced ddtailed representations of what thex believe

:07:28. > :07:30.to be factual inaccuracies hn the report based on the July inspections

:07:31. > :07:33.and are taking advice from their legal team

:07:34. > :07:35.about challenging its contents. Six men have appeared

:07:36. > :07:37.before magistrates in connection with the death of a 30`year`old

:07:38. > :07:40.mother of two in Leicestershire Hayley Pointon died

:07:41. > :07:44.from a single gunshot wound at a house in Sunnydale Road

:07:45. > :07:48.in Hinckley last February. Two 24`year`old men have bedn

:07:49. > :07:51.charged with murder and four others with assisting an offender.

:07:52. > :07:57.They've all been remanded in custody and are due to appear

:07:58. > :07:59.at Leicester Crown Court on Friday. Coming up:

:08:00. > :08:03.A bit of a page turner. We'll be talking to the star guest

:08:04. > :08:13.of a week`long festival of reading that's taking place in Leicdster.

:08:14. > :08:17.Next tonight, one of the biggest ever resdarch

:08:18. > :08:19.studies into breast cancer. The Royal Derby Hospital

:08:20. > :08:23.is leading the way. And it could end up changing

:08:24. > :08:26.treatment around the world. Over the next ten years

:08:27. > :08:30.the investigation will focus on whether armpit surgery is really

:08:31. > :08:34.necessary when breast cancer has spread to the lymph glands.

:08:35. > :08:37.The surgery can leave some women with permanent side effects.

:08:38. > :08:56.Our Health Correspondent Rob Sissons reports.

:08:57. > :09:06.It was a nightmare being in hospital. Ten years on she has been

:09:07. > :09:12.given the all clear from thd disease and is running a here salon. But for

:09:13. > :09:18.life she has been given a lymphoedema which is a swelling in

:09:19. > :09:25.her rest and is unable to lhft heavy things. I cannot lift pans or the

:09:26. > :09:36.Hoover. I have to district ly workload. Will the weather hn future

:09:37. > :09:42.it is possible to avoid lymph node surgery and use something else

:09:43. > :09:47.instead. To find out it will involve 2000 patients being monitordd. 0

:09:48. > :09:52.hospitals are getting involved in the project across the UK and it

:09:53. > :09:57.will take ten years to get the results. The surgeon behind the

:09:58. > :10:02.study says removing diseased lymph nodes will remain the usual

:10:03. > :10:07.treatment for now but with 00,0 0 procedures per year in the TK there

:10:08. > :10:14.is huge interest in finding alternatives. This trial, ddpending

:10:15. > :10:19.on the results, had the potdntial to change treatment. If the sttdy shows

:10:20. > :10:27.there is no added benefit of taking the lymph nodes out then we do not

:10:28. > :10:34.need to do it. Karen knows only too well how far cancer treatment has

:10:35. > :10:39.come. You have to look at it, yes, it is life`threatening but ht is not

:10:40. > :10:45.a death sentence any more. @ lot of people survive. There is life after

:10:46. > :10:51.that and I am living proof of that. A police officer from Leicestershire

:10:52. > :10:54.whose life was saved by a bone marrow transplant has inspired

:10:55. > :10:56.hundreds of people to sign ` register to become potential donors.

:10:57. > :11:02.Rik Basra was suffering from leukaemia and had only weeks to

:11:03. > :11:05.live when HIS donor was found. Today he and his wife held dvents

:11:06. > :11:09.across Leicester to try to recruit one thousand donors in just one day.

:11:10. > :11:28.Helen Astle reports. It has been a busy day at the

:11:29. > :11:39.University. 100 students have signed up for those who need a bond marrow

:11:40. > :11:43.transplant. I had the dreaddd conversation with the surgeon when I

:11:44. > :11:49.was told to start making arrangements. I know what it feels

:11:50. > :11:53.like to be at the darkest. Ht is very frightening and there hs

:11:54. > :11:58.nothing you can do, you are relying on a stranger. You look arotnd at

:11:59. > :12:04.all the people you see in everyday life and you think you could help,

:12:05. > :12:08.you could be the one to savd my husband's life. They are trxing to

:12:09. > :12:14.encourage as many people as hospital to sign up to become a donor. Among

:12:15. > :12:21.those lending the support this footballer, the aim was to get 000

:12:22. > :12:28.new donors signed up in just one day. I know a lot of people in my

:12:29. > :12:35.family who have got illnessds and it is a good cause to donate. Xou are

:12:36. > :12:39.helping somebody. We all have a right to live so if we can help each

:12:40. > :12:45.other out in some way that hs what I am here for. It is really e`sy to

:12:46. > :12:53.register, all you need to do is fill in this form, spit in this tube and

:12:54. > :12:58.wait to see if you are needdd. To give somebody the chance of life is

:12:59. > :13:03.all the thanks I need, it is such a wonderful feeling. It is so humbling

:13:04. > :13:10.to see so many people helping out to try to get to that vision. Hn the

:13:11. > :13:15.last few minutes we have he`rd they have reached their target, hn fact,

:13:16. > :13:17.just over 1000 people have signed up to become donors and there `re still

:13:18. > :13:23.students queueing to registdr. An airline which hasn't flown

:13:24. > :13:26.from East Midlands Airport for 18 years is returning.

:13:27. > :13:29.Aer Lingus Regional, which hs operated by Stobart Air, is starting

:13:30. > :13:32.a new direct route to Dublin. 70,000 passengers are expected to

:13:33. > :13:43.use the service in the first year. It will start in February 2015.

:13:44. > :13:45.The Conservative Party confdrence has wrapped up in Birminghal,

:13:46. > :13:48.with the Prime Minister tempting voters with tax cuts, an enhanced

:13:49. > :13:50.NHS and a tough stance on Etrope. There was also a pledge

:13:51. > :13:54.on building new homes for first time buyers and a curb

:13:55. > :13:57.on welfare benefits for migrants. So what's the likely impact of his

:13:58. > :13:59.conference speech on the political landscape of the East Midlands?

:14:00. > :14:00.From Birmingham's International Convention Centre, here's

:14:01. > :14:13.our Political Editor John Hdss. With eight months to go to the next

:14:14. > :14:20.general election the prime linister outlined his policies and pledges

:14:21. > :14:27.which he hopes will appeal to the porters, especially on tax. On

:14:28. > :14:33.minimum wage you will pay no income tax at all, nothing, zero, zilch.

:14:34. > :14:40.The conference speeches abott rallying the troops. But David

:14:41. > :14:46.Cameron's tax pledge was for ?2 billion in the first two ye`rs of

:14:47. > :14:53.the next Parliament. How will that political language go down hn the

:14:54. > :15:00.Tory held seats that are under threat from UKIP and labour. It is a

:15:01. > :15:09.straight fight between myself and labour. David Cameron was w`nting to

:15:10. > :15:14.appeal to voters who might not normally consider voting

:15:15. > :15:20.Conservative. One local lawxer thinks he might have pulled that

:15:21. > :15:27.off. He has given us a double dose of oxygen. We can knock on doors and

:15:28. > :15:31.ask people to give us anothdr term. Labour, UKIP and the Lib Dels whose

:15:32. > :15:33.conference gets underway thhs weekend will be asking if those

:15:34. > :15:39.pledges add up. The former Children's Laure`te,

:15:40. > :15:42.Michael Rosen, has described as criminal

:15:43. > :15:44.the axing of most of Derbyshire s fleet of mobile libraries.

:15:45. > :15:48.He was speaking during a visit to Leicester, where he was

:15:49. > :15:50.one of the star names in a week`long festival to promote reading.

:15:51. > :15:53.Mr Rosen, who's well`known for his outspoken

:15:54. > :15:59.views, also told us he's in favour of making a library a statutory

:16:00. > :16:00.requirement in every school. Mike O'Sullivan's been

:16:01. > :16:14.along to meet him. The teacher will come along and

:16:15. > :16:20.pressed me on the top of thd head. The former children's Lordy it on

:16:21. > :16:25.the Saint Matthews estate in Leicester at a primary school. He

:16:26. > :16:30.was there as part of the Re`ding festival. I asked him about a story

:16:31. > :16:36.yesterday when we reported that most of the mobile library fleet in

:16:37. > :16:39.Leicestershire is to be axed. It is criminal because the council is

:16:40. > :16:45.doing it and it is criminal because we do not need to. Libraries were

:16:46. > :16:50.fought for in the 19th centtry because people said everybody should

:16:51. > :16:55.have books. It is in books we find out about the world. To then take

:16:56. > :17:02.that away on the ludicrous pretext that somehow we cannot afford it is

:17:03. > :17:07.the nonsense and it is crimhnal The city aims to promote a love of

:17:08. > :17:14.reading in every Child. I lhke to read fantasy books because they

:17:15. > :17:18.build your imagination. It hs important for everyone becatse it

:17:19. > :17:23.helps in your stats and your writing. It helps you with xour

:17:24. > :17:32.speaking. It helps you with your writing. He is passionate about his

:17:33. > :17:38.need for a library in every school. It is compulsory and statutory to

:17:39. > :17:42.have libraries in prisons, ht is compulsory for local authorhties to

:17:43. > :17:46.provide one kind of library service but the one place it is not

:17:47. > :17:55.compulsory is schools. How crazy is that? They expect more star authors

:17:56. > :17:58.next year as the reputation of this festival grows.

:17:59. > :18:01.Still to come this evening ` is our weather on the turn?

:18:02. > :18:11.Anna will be here with the forecast. And the taste of the tropics in

:18:12. > :18:20.Derby, I'll be meeting the lan who has known this. `` grown thhs. Very

:18:21. > :18:33.exotic, just like Kirsty! Thank you! Action from Nottingham Forest

:18:34. > :18:36.and Notts County and some fhghting talk from the Leicester Tigdrs.

:18:37. > :18:37.But first to Derby County. A sending off.

:18:38. > :18:39.A disallowed goal. Two frustrated managers.

:18:40. > :18:41.But in the end Steve McClardn celebrated the anniversary

:18:42. > :18:43.of his appointment as Derby's boss with another win.

:18:44. > :18:47.Mark Shardlow was at the I Pro Stadium.

:18:48. > :18:56.It was a game that turned on this incident. The ball going in the net

:18:57. > :19:02.four Derby after frustrating defending over an hour. The effort

:19:03. > :19:05.they had other thoughts, he disallowed the goal, sent off the

:19:06. > :19:12.keeper and awarded Derby a free kick. The left decided and handball

:19:13. > :19:21.outside the area meant a dismissal and not a goat. In doing so, he

:19:22. > :19:27.upset the fans and both man`gers. I did not see a handball. It was very

:19:28. > :19:32.close. To disallow it, I do not know. What great guys that referee

:19:33. > :19:37.has got! know. What great guys that referee

:19:38. > :19:44.has got! Derby made the most of the one`man advantage. This beattifully

:19:45. > :19:47.taken goal. There was an occasional skier but the victory was m`de

:19:48. > :19:55.certain with this from Chris Martin just before the end. The progression

:19:56. > :20:02.that the team have made is phenomenal. You only have to look at

:20:03. > :20:06.the results. A much better team more organised, absolutely

:20:07. > :20:11.fantastic. I was one of his worst critics but we had in a good

:20:12. > :20:20.position. He has made it like you want to come again. What do you

:20:21. > :20:21.think of Steve? I think he hs a really good manager,

:20:22. > :20:26.think of Steve? I think he hs a really good manager, one of the best

:20:27. > :20:28.we have ever had. It ended hn success with the promise of more to

:20:29. > :20:37.come by his second annivers`ry. Nottingham Forest missed out on

:20:38. > :20:39.returning to the top of the table after a goalless draw at Wigan. It's

:20:40. > :20:50.their third 0`0 in a row. Stuart Pearce is team are still

:20:51. > :20:55.claiming points, they might well have won this one. This could so

:20:56. > :21:00.easily have given them the lead at Wigan. As the other end there were

:21:01. > :21:04.skiers as Wigan produced ond of the best performances of the se`son

:21:05. > :21:13.There was nothing candid about this since awaiting effort. Then they

:21:14. > :21:27.find the keeper rather than the net. Well, with league leaders Norwich

:21:28. > :21:30.losing last night, a win would have put Forest back

:21:31. > :21:32.on top of the Championship table. It is incredbily tight.

:21:33. > :21:34.Forest are second on goal difference.

:21:35. > :21:36.Derby County are in 4th. Just a point behind.

:21:37. > :21:39.But Wolves will go top if they win tonight.

:21:40. > :21:41.In League One, Notts County have now gone six games unbeaten.

:21:42. > :21:43.They had their biggest win of the season at bottom club Crewe

:21:44. > :21:56.last night. Notts County waited patiently for

:21:57. > :22:03.the opening goal which eventually came a minute from half`timd. The

:22:04. > :22:08.striker was on target again just six minutes into the second half. This

:22:09. > :22:14.time the celebration was nohsy and flamboyant as he doubled his tally

:22:15. > :22:18.for the season. Notts were well in command against the wiki is to

:22:19. > :22:22.defence in the league and they wrapped it up with this.

:22:23. > :22:25.Rugby and the Leicester Tigdrs head coach Richard Cockerill

:22:26. > :22:28.has hit back at his critics. The Tigers have lost back to back

:22:29. > :22:31.games in their worst start to the season since Cockerill was

:22:32. > :22:34.appointed five years ago. A thrashing at Bath was followed by

:22:35. > :22:38.a home defeat as the Tigers battle on without 20 injured players.

:22:39. > :22:49.And some critics have questhoned Leicester's training methods.

:22:50. > :22:55.Honestly, they can do what they want. I cannot control the

:22:56. > :23:00.irrational thoughts of people outside this environment but I can

:23:01. > :23:04.control this environment and we have good coaches, good people, we will

:23:05. > :23:08.battle away and when it goes well I want the people who are getting the

:23:09. > :23:13.stick now to see I was wrong and well done. Fighting talk indeed

:23:14. > :23:22.That is of the sport. In a moment we'll have the latest

:23:23. > :23:25.on this balmy weather, but first we meet a man who, come rain or shine,

:23:26. > :23:28.brings a taste of the tropics to his back garden in Derby.

:23:29. > :23:29.We sent Jo Healey to meet Mike Whittaker who can't resist

:23:30. > :23:39.growing exotic fruits. In the past we have shown ndw home

:23:40. > :23:45.prom whoppers and show stoppers Today it is fruit surprising the

:23:46. > :23:52.neighbours in Derby. They could not believe you have grown a pineapple

:23:53. > :23:58.in Derby. It is a challenge. It is the seat you know it must do

:23:59. > :24:09.something. When it gets too big the botanical art and have taken on one

:24:10. > :24:20.of my yucca plants. The seat of his obsession was planted three decades

:24:21. > :24:32.ago when he planted a stone. How do I grew a pineapple? First you get
