:01:06. > :01:16.A Nottinghamshire policeman admits he "made a mistake" after failing

:01:17. > :01:18.to notice an elderly man was disqualified from driving.

:01:19. > :01:24.87-year-old Albert Newman had dementia, and was banned in 2013.

:01:25. > :01:26.But in October 2015, he caused a fatal accident

:01:27. > :01:29.after driving the wrong way down the M1 in Leicestershire.

:01:30. > :01:37.PC Jonathan Mortimer is facing charges of gross misconduct

:01:38. > :01:39.after failing to spot the disqualification

:01:40. > :01:40.during a separate incident two months earlier.

:01:41. > :01:49.Giles, what is PC Mortimer accused of?

:01:50. > :01:52.In August 2015, a member of staff at a Nottingham bank called police

:01:53. > :01:54.to say Mr Newman had appeared confused before driving away.

:01:55. > :01:58.But just two months later Albert Newman was involved in that

:01:59. > :02:03.He collided with a van going the other way,

:02:04. > :02:05.killing himself and a passenger in the van, Michael Luciw.

:02:06. > :02:08.This prompted an investigation of the the earlier incident,

:02:09. > :02:10.which led to three charges for PC Mortimer.

:02:11. > :02:12.The first two are failing to make adequate enquiries,

:02:13. > :02:20.The third, most serious allegation is that he falsely claimed to have

:02:21. > :02:22.called the bank that originally made the report.

:02:23. > :02:24.Today solicitors acting for the police authority said

:02:25. > :02:26.this was a clear lie, designed to, in their words,

:02:27. > :02:44.The 41-year-old has admitted to the first two charges, saying

:02:45. > :02:48.But he says, to this day, he remembers calling the bank

:02:49. > :02:51.to follow up their report, despite evidence to suggest

:02:52. > :02:54.His defence counsel said he had no reason to lie,

:02:55. > :02:57.and that he was let down by his memory and not his integrity.

:02:58. > :03:00.The members of the panel have now retired to consider the evidence.

:03:01. > :03:02.If they decide PC Mortimer's actions amount to gross misconduct,

:03:03. > :03:04.he could face instant dismissal from the force.

:03:05. > :03:08.Colin's in Seville for the Foxes' Champions League clash.

:03:35. > :03:36.BBC East Midlands Today has obtained an internal audit

:03:37. > :03:40.into the trust which runs Bradgate Park in Leicestershire.

:03:41. > :03:44.The park is a registered charity and gets some of its funds from both

:03:45. > :03:48.The review highlights concerns about financial procedures

:03:49. > :03:51.and recommends an investigation into the way staff are allowed

:03:52. > :04:05.Simon Ward has this exclusive report.

:04:06. > :04:07.More than half a million visitors come to enjoy

:04:08. > :04:11.In 1928, it was given in trust to the people of Leicestershire.

:04:12. > :04:14.Last year, on-site activities alone raised more than ?1 million.

:04:15. > :04:17.The City and County Council funds now account for 3% of annual income.

:04:18. > :04:19.Sales of venison, car parking charges and the tearoom are among

:04:20. > :04:27.This internal audit into Bradgate Park trust was carried

:04:28. > :04:33.out by Leicestershire County Council.

:04:34. > :04:35.It says, among other recommendations, "Little assurance

:04:36. > :04:37."can be given that risks, including those of reputation

:04:38. > :04:38."and income recovery, can be mitigated.".

:04:39. > :04:41.I put some of these points to county councillor Peter Osborne,

:04:42. > :04:44.who has just taken over as chairman of the Bradgate Park Trust.

:04:45. > :04:50.It is not finalised, and it would be really

:04:51. > :04:59.That is the opinion of the auditors, so give us your opinion of that.

:05:00. > :05:02.Well, I would have to go back to the auditors and ask

:05:03. > :05:04.for an individual explanation of a particular item

:05:05. > :05:07.But as I say, on something that is still under review,

:05:08. > :05:19.Well, I would expect you when I have the information in front of me.

:05:20. > :05:22.The report says in black and white it wants a disciplinary

:05:23. > :05:28.investigation into staff about late rental payments and not paying rent.

:05:29. > :05:31.What we do over the accommodation is that we have accommodation that

:05:32. > :05:37.The rents are set by an independent estate agent and then that becomes

:05:38. > :05:43.part of their salary and they pay rent on it.

:05:44. > :05:53.The auditors found there are relaxed staff discounts,

:05:54. > :05:55.possibly leading to issues in relation to tax liabilities.

:05:56. > :05:59.It is serious if there were to be a possibility but that is all...

:06:00. > :06:02.We review everything and when we said in the summer

:06:03. > :06:04.that we wanted to have a look at our financial controls

:06:05. > :06:07.and how we did things, what we said was, all right,

:06:08. > :06:10.Is there any money missing or unaccounted for?

:06:11. > :06:16.All we have are internal processes and procedures

:06:17. > :06:21.In summarising all the recommendations in this report,

:06:22. > :06:24.the auditors say it is now for the trust to urgently consider

:06:25. > :06:33.Police in Derbyshire are renewing their appeal

:06:34. > :06:37.for witnesses after a teenager died in a fatal crash at the weekend.

:06:38. > :06:40.It happened on Ford Bridge Lane in South Normanton just before eight

:06:41. > :06:45.14-year-old Connor Revill died after his push scooter

:06:46. > :06:47.was in collision with a black Ford Fusion.

:06:48. > :06:50.Police would like to hear from anyone who saw the car

:06:51. > :07:00.A 27-year-old man has been released on bail while enquiries continue.

:07:01. > :07:03.The Health Secretary has agreed to look into the decision to close

:07:04. > :07:06.Lincolnshire County Council referred the decision

:07:07. > :07:11.Today the authority received confirmation that an independent

:07:12. > :07:15.panel will do an initial assessment of the decision, to see if a full

:07:16. > :07:21.It comes on the same day three local MPs met with the Prime Minister

:07:54. > :07:58.Leicester City. But the fans are hoping for more. It is a grand

:07:59. > :08:04.historic adventure and we'll talk about it in the sport later.

:08:05. > :08:06.Local shops are warning an impending re-evaluation

:08:07. > :08:08.of their business rates will hit our high streets hard.

:08:09. > :08:10.The amount paid to local councils by all businesses,

:08:11. > :08:12.not just retailers, will be announced this Friday.

:08:13. > :08:15.And in many cases, business owners are bracing themselves for a rise.

:08:16. > :08:17.It's prompted the Broxtowe MP, Anna Soubry, a former

:08:18. > :08:19.Business Minister, to call for a fundamental rethink

:08:20. > :08:21.of the entire system which the region's Chamber

:08:22. > :08:41.Nottingham is said to have the highest percentage

:08:42. > :08:43.of independent retailers in a city centre outside of London.

:08:44. > :08:46.One of the oldest is this cards and gift shop,

:08:47. > :08:48.which has been trading for more than 40 years.

:08:49. > :08:49.Their business rate, the government's tax

:08:50. > :08:52.on business properties, is about to go up.

:08:53. > :08:56.Our increase is likely to be about ?4000-?5,000 a year extra.

:08:57. > :09:00.That is over and above the ?44,000 we already pay.

:09:01. > :09:03.So it is a substantial bill, and it is coming at a time

:09:04. > :09:13.A few hundred metres around the corner from The Tokenhouse

:09:14. > :09:16.is the Treat Kitchen, a chain of five sweet shops

:09:17. > :09:26.In the last six months, our product has become more expensive,

:09:27. > :09:29.our cost of staff has gone up by about 5%, our sales

:09:30. > :09:31.have dropped about 10%, and now our rates are going up.

:09:32. > :09:34.So we are struggling to maintain the network of five shops

:09:35. > :09:37.as a result of all of these added pressures in the last six months.

:09:38. > :09:40.The Broxtowe MP Anna Soubry, herself a former Business Minister,

:09:41. > :09:42.is calling for the rates to be radically reformed or scrapped.

:09:43. > :09:45.A view shared by the East Midlands chamber of commerce.

:09:46. > :09:47.Members feel so strongly, the chief executive has

:09:48. > :09:49.written to the Chancellor, Philip Hammond, asking him

:09:50. > :09:52.to reconsider the way the rates are calculated.

:09:53. > :09:55.The way business rates work in the UK currently

:09:56. > :09:58.Businesses in the UK face the highest upfront costs

:09:59. > :10:04.What we are calling for, at the chamber,

:10:05. > :10:11.We need something based on a business's ability to pay,

:10:12. > :10:13.something that encourages those businesses looking to invest

:10:14. > :10:20.and grow and something that is fair for businesses of all sizes.

:10:21. > :10:22.The Chancellor will deliver his Spring budget next month.

:10:23. > :10:25.Tory MPs and small businesses will want to see if he offers any

:10:26. > :10:26.financial support to independent retailers and businesses

:10:27. > :10:37.facing significant increases in their rates.

:10:38. > :10:39.Campaigners have been protesting outside Leicester's town

:10:40. > :10:42.hall today against plans to shut down their local

:10:43. > :10:46.library and merge it with a nearby recreation centre.

:10:47. > :10:50.The City Council says the move would save around ?15,000 a year.

:10:51. > :10:54.But users of Rushey Mead library are warning it would put a whole

:10:55. > :11:12.Making a racket to save their library. These protesters are angry

:11:13. > :11:16.about council plans to move their local library in Rushey Mead into

:11:17. > :11:22.the nearby recreation centre, saving the council around ?15,000. They're

:11:23. > :11:27.talking about merging two buildings. If that happens, how do you get 130

:11:28. > :11:31.square metres of library into 40 square metres of the building

:11:32. > :11:37.currently earmarked? The building will be too small, it is just a few

:11:38. > :11:43.rooms, and our normal library is much bigger. How important is the

:11:44. > :11:49.library building to the community? Very important, it is the heart and

:11:50. > :11:53.lifeline of Rushey Mead. This is one of the most daft proposal the

:11:54. > :11:57.council has ever come up with. You take a library twice the size of

:11:58. > :12:02.this building here, this room, put it in this room and pretend

:12:03. > :12:06.everything can carry on as before. Children trying to do their homework

:12:07. > :12:13.while elderly people are having their lunch club. The council says

:12:14. > :12:22.it is in during cuts from central government. We are trying to do this

:12:23. > :12:28.as an authority, to safeguard services and reduce cost around

:12:29. > :12:33.buildings. Will there be a scenario with aerobics in one room and kids

:12:34. > :12:40.trying to do homework in the next? There are are more than enough

:12:41. > :12:44.opportunities and gaps in the timetables for this. There should be

:12:45. > :12:49.little issue in regards to providing both sets of services. The council

:12:50. > :12:52.will decide at the meeting tonight whether to go ahead with the merger.

:12:53. > :12:54.Time now for the third of this week's reports on sugar.

:12:55. > :12:56.And with a sugar tax on soft drinks looming,

:12:57. > :12:59.the boss of one East Midlands manufacturer is calling

:13:00. > :13:04.Belvoir Fruit Farms has been expanding for 30 years.

:13:05. > :13:06.But its managing director is worried it could be ruined by any

:13:07. > :13:08.levy on its cordials and sparkling drinks.

:13:09. > :13:21.Our Health Correspondent Rob Sissons has this report.

:13:22. > :13:24.Presses, cordials, made in the shadow of Belvoir Castle.

:13:25. > :13:27.It's a business that employs over 80 people and turns over more

:13:28. > :13:33.But the boss is really worried about the sugar levy.

:13:34. > :13:37.These will be taxed a lot and we've got to work out whether we can make

:13:38. > :13:40.them with lower sugar but with the same amount of quality

:13:41. > :13:43.taste so that customers who love them will not be put off by them.

:13:44. > :13:46.If they do attract the tax, a classic example is ginger beer.

:13:47. > :13:48.Ginger beer, because it is so peppery and sharp

:13:49. > :13:51.with the taste of ginger, it needs sugar to soften it.

:13:52. > :13:53.That one, if we make the ginger beer without sugar,

:13:54. > :13:59.it really doesn't taste very nice at all.

:14:00. > :14:02.Some people will say sugar is sugar and we've got to do something

:14:03. > :14:06.It's not just taxing soft drinks, though.

:14:07. > :14:08.Much better would be to tax bulk sugar.

:14:09. > :14:11.If you taxed sugar which went in everything then the government

:14:12. > :14:17.The sugar tax could work out at least 18p more on the firm's

:14:18. > :14:20.sparkling elderflower presse and put more than a pound on the cost

:14:21. > :14:24.Up to 100,000 bottles pass along this production line every day.

:14:25. > :14:25.This business is worried about the sugar tax,

:14:26. > :14:28.that it could put the brakes on expansion or even put

:14:29. > :14:40.It could have a profound impact on us, depending

:14:41. > :14:43.on how high it is set, where exactly these things kick in,

:14:44. > :14:48.Manufacturers are not forced to pass on the tax to consumers but this

:14:49. > :15:00.company warns they probably won't be able to afford not to.

:15:01. > :15:02.There'll be one name missing from the ballot paper
