:01:24. > :01:26.Lincolnshire police since the first of December.
:01:27. > :01:30.The force says that publishing names on the website and social media
:01:31. > :01:34.isn't about shaming people, but is designed as a deterrent to prevent
:01:35. > :01:39.accidents. However, the police have come in for criticism, over naming
:01:40. > :01:45.people before they have been found guilty in a court of law.
:01:46. > :01:49.The Christmas party season, for police forces across the UK, it is
:01:50. > :01:53.when their campaign against drink`driving reaches its height.
:01:54. > :01:57.But this year Lincolnshire police has courted controversy with a new
:01:58. > :02:00.tactic, it has named those charged with drink driving before they have
:02:01. > :02:04.been found guilty, in a court of law.
:02:05. > :02:08.We are 100% happy it is lawful to do so, it is normal practise to be able
:02:09. > :02:12.to name people after charge. We have not put lists like this out before,
:02:13. > :02:16.we will look at the results of what we are have done to analyse what
:02:17. > :02:21.difference it has made. We are happy at the moment this is contributing
:02:22. > :02:28.to road safety. It's a policy that has received a mixed importance from
:02:29. > :02:32.the public It is a good idea `` response. It is harsh if they have
:02:33. > :02:36.not been convicted to be naming people before they are. If they are
:02:37. > :02:40.innocent it will come out in court, won't it. Here on the Lincolnshire
:02:41. > :02:43.police website are the names of 74 people charged with drink driving
:02:44. > :02:48.over the Christmas period. While the police say that this is an important
:02:49. > :02:54.deterrent, others have questioned the morality of putting the names on
:02:55. > :03:00.here. Michael Pace is a Lincoln based solicitor who specialises in
:03:01. > :03:02.road traffic law It brings up the moral question of why are the police
:03:03. > :03:06.putting themselves in the position of a judge and naming people ahead
:03:07. > :03:12.of a court having decide they are guilty and dealt with them on that
:03:13. > :03:16.basis. Should they be doing this? Morally I don't think they should.
:03:17. > :03:19.The most cent national figures show that 280 people were killed in
:03:20. > :03:24.drink`drive related incidents in the space of a year. A rise of 17%
:03:25. > :03:29.compared to the previous year. And across the UK, more than 55,000
:03:30. > :03:33.drivers were convicted of drink`driving, leading to collisions
:03:34. > :03:38.like this one near Boston in 2011, that claimed a woman's life.
:03:39. > :03:42.Despite criticism from some quarters Lincolnshire police continue to
:03:43. > :03:49.defend their new policy, which they say is helping keep the County's
:03:50. > :03:53.roads safe. We will be asking for your thoughts
:03:54. > :04:00.in a ept omit, joining me to discuss this one is Nick Freeman who has
:04:01. > :04:03.defended motorists accused of drink`driving related incidents.
:04:04. > :04:07.People see it as unacceptable, why shouldn't they be named and shamed
:04:08. > :04:12.It is unacceptable. My problem is the timing of it. It is pre`empting
:04:13. > :04:16.guilt before it has been established. I have no difficulty
:04:17. > :04:20.with the people convicted named and shamed but at the time they are
:04:21. > :04:23.named, they are people who have alleged to have committed an
:04:24. > :04:26.offence, we have a presumption of innocence, it is one of the
:04:27. > :04:30.foundations of ourening lib legal system and it is important that
:04:31. > :04:34.remains in tact. At the moment the police seem to be taking the view
:04:35. > :04:38.that they are entitled, which they are, to name people, and undoubtedly
:04:39. > :04:44.some of those people will be acquitted. Why can't we wait, why
:04:45. > :04:48.don't the police promote the fact there will be a hall of shame and
:04:49. > :04:51.after Christmas when they are convicted, these people can be
:04:52. > :04:56.displayed in this haul of shame. That would have the same defernt
:04:57. > :04:59.effect. People said being named would make them think about the
:05:00. > :05:06.consequences of drink`drive, doesn't that show that the idea is a good
:05:07. > :05:10.one? I think, if you put to the public what I am suggesting to you,
:05:11. > :05:15.that there will be a gallery of shame for all those people
:05:16. > :05:19.convicted, I don't think in any way that dilutes the disincentive, the
:05:20. > :05:23.deterrent effect. It will achieve the same goal but do it while
:05:24. > :05:26.preserving that presumption of innocence, it is very important we
:05:27. > :05:31.don't move towards a police stai state. We don't allow the police to
:05:32. > :05:34.become judge and jury, there is a terrible stigma sobered with
:05:35. > :05:38.drink`driving, and it is correct that those people who are convicted
:05:39. > :05:43.are named and shamed but we don't want the ruin lives and humiliate
:05:44. > :05:46.them if they are innocent. If one of the drivers charged was almost four
:05:47. > :05:50.times over the limit, does that person not deserve to be named,
:05:51. > :05:54.regardless of anything else, that part is fact. We don't know whether
:05:55. > :05:58.it is fact or not. Do we know whether the machine was working
:05:59. > :06:02.correctly? You are making assumption theres, we are making dangerous
:06:03. > :06:05.assumptions because you are alleged to have committed an offence you are
:06:06. > :06:09.assumed to be guilty. In fact the reverse is true, if you are alleged
:06:10. > :06:15.to have committed an offence you are presumed to be innocent, when a
:06:16. > :06:18.court finds that you are guilty, at the appropriate Burdon of proof,
:06:19. > :06:26.that is time you should be named and shamed. It is an interesting thing.
:06:27. > :06:30.Should people be named and name shamed before they have appeared in
:06:31. > :06:41.court? What else would you like to see done to tackle the issues of
:06:42. > :06:42.drink`driving. 280 people killed in drink`driving related incident. Get

:07:37. > :07:41.night. Floral tributes now show where Steve Herbert was beaten, and
:07:42. > :07:46.left for dead on New Year's Day. The 34`year`old father of two was trying
:07:47. > :07:49.to be a peace keeper. Stepping in to stop a fight.
:07:50. > :07:57.His death has shocked those who knew him. His kids have lost a great guy.
:07:58. > :08:01.Whoever it is needs to come forward, they really do lost a great person.
:08:02. > :08:05.Today, at the bar where he worked as a chef, a collection for Steve's
:08:06. > :08:09.family. His colleagues told me of the man who was a larger than life
:08:10. > :08:13.character, whose death has left a huge void. Uncle Steve, that is what
:08:14. > :08:18.we called him. Understandingle Steve. He is going to be deeply
:08:19. > :08:22.missed. Any problems if you wanted to be cheered up in any way, just
:08:23. > :08:28.straight o to Steve and he will sortout out It is disgusting. I
:08:29. > :08:32.makes me ashamed to be from Hull, for something like that to happen,
:08:33. > :08:35.and it is just, it is disgusting that another human being could do

:08:40. > :08:43.This CCTV shows Steve just moments before he was attacked. Police are
:08:44. > :08:48.keen to talk to these four people, who are believed to have picked up a
:08:49. > :08:52.taxi just moments later. After he was assaulted and left for dead on
:08:53. > :08:57.the ground, the group of four people ran off and flagged down a taxi,
:08:58. > :09:02.that was at the junction of Strand Close, what we want do is identify
:09:03. > :09:06.the taxi driver who picked them up. Floral tributes are growing here at
:09:07. > :09:12.the site where Steve was attacked. Messages to a gentle giant, a one of
:09:13. > :09:17.a kind. But what is clear from all of these messages, is that people
:09:18. > :09:23.are struggling to comprehend how this could have happened to such a
:09:24. > :09:27.kind man. They have lost their father on a night of celebration,
:09:28. > :09:31.but New Year for this family has turned into a nightmare.
:09:32. > :09:37.Caroline is at the scene of the attack tonight. What is the latest
:09:38. > :09:41.with this investigation? Peter, a 21`year`old man, a 22`year`old man,
:09:42. > :09:44.and a 23`year`old woman are currently being intervowed by
:09:45. > :09:49.detectives in connection with the murder of Steve Herbert. Police say
:09:50. > :09:52.that CCTV footage they released, they have had a huge response from
:09:53. > :09:56.the public on that, and that has been key in helping them identify
:09:57. > :10:00.those those people and help them to arrest them. But they have stressed
:10:01. > :10:05.to me tonight, they are still keen for people to come forward with any
:10:06. > :10:09.information, that may help them piece together the final moments of
:10:10. > :10:13.Steve's life, before his death. Steve's family want answers, and
:10:14. > :10:18.hopefully in time they will be able to make sense of what happened here.

:11:30. > :11:36.this large would have a midwife`led unit, but it seems to be put off,
:11:37. > :11:43.and postponed, and I was told July, then I was told August, then no
:11:44. > :11:49.news. She is not alone. Hannah is 24 weeks pregnant, she is angry there
:11:50. > :11:54.is no midwife`led you nit to give birth It is important I have the
:11:55. > :11:58.medical care I do need because of my pregnancy history, but I am allowed
:11:59. > :12:03.to just get on with what I need to do and have the home comforts round
:12:04. > :12:07.me. The midwife`led unit at castle hill hospital closed in 2011,
:12:08. > :12:11.because of concerns is about staffing levels. A unit to replace
:12:12. > :12:14.it was due to open in Hull last January.
:12:15. > :12:18.Some midwives who couldn't speak to me on camera have told me they
:12:19. > :12:26.haven't been told about the process o `` progress of the you nit here.
:12:27. > :12:32.The NHS Trust says it is committed to providing midwife`led births but
:12:33. > :12:39.finance has thread problems. It says it has to revise its ams bys for the
:12:40. > :12:43.unit. It hopes to launch the new unit during 2014. The Royal College
:12:44. > :12:49.of Midwives says the unit would have financial and health benefits.
:12:50. > :12:53.They are more likely to need less postnatal pain leaf, they are more
:12:54. > :12:57.likely to department to looking after and caring for their baby and
:12:58. > :13:03.breast`feeding in the postnatal period and less interventions for
:13:04. > :13:08.mums, obviously, equals less costs for organisations It is hoped the
:13:09. > :13:11.unit will open this year, but with costs and design to be finalised
