:01:18. > :01:21.causing death by dangerous driving. A fit of road rage led to hhm

:01:22. > :01:24.knocking down and killing 17`year`old

:01:25. > :01:27.Sarah Burke as she walked from college

:01:28. > :01:29.to her home in Sunderland. Our Chief Reporter Chris

:01:30. > :01:35.Stewart has the story. Sarah was an art student,

:01:36. > :01:37.and a very good one. And her life was ended

:01:38. > :01:40.when 40`year`old Baillie decided It happened here

:01:41. > :01:45.on this busy bus route was trying to bully a driver

:01:46. > :01:52.in a smaller car. And then he thought he'd put

:01:53. > :01:55.his foot down to overtake, from a position so close to

:01:56. > :01:58.the smaller car he couldn't possibly have sden

:01:59. > :02:10.what was ahead. Sarah did not stand a chancd. David

:02:11. > :02:13.Baillie was not even watching where he was going, instead steerhng

:02:14. > :02:18.sideways at the other driver, trying to intimidate him. As she l`y on the

:02:19. > :02:23.ground he didn't jump out of his car, but not to help save. He jumped

:02:24. > :02:24.out to shout at the other driver, who had done absolutely nothing

:02:25. > :02:25.wrong. Leaving court this afternoon,

:02:26. > :02:26.Sarah's parents. Still trying to

:02:27. > :02:28.work out how a man with so many previous convictions

:02:29. > :02:40.was on the road at all. The included 12 thefts or attempted

:02:41. > :02:46.theft of vehicles, six of t`king vehicles without consent, nhne of

:02:47. > :02:51.driving while disqualified, and two of dangerous driving, those last one

:02:52. > :02:57.is considered so serious th`t they each earned him a spell in prison.

:02:58. > :02:57.Yet he was given a licence `s a taxi driver.

:02:58. > :03:02.And that's something which is causing concern.

:03:03. > :03:08.That is an issue, I know thd police are taking it up with the Chty

:03:09. > :03:14.Council regarding the licensing department. We will have to see what

:03:15. > :03:19.the outcome of that is. That must be something particularly tough for the

:03:20. > :03:22.family? Definitely. The famhly are brokenhearted. And full of `nger at

:03:23. > :03:25.the moment I would say. The judge said Baillie had simply

:03:26. > :03:35.tried to deceive the jury. David Bailey is an extremelx

:03:36. > :03:41.devious, manipulative and controlling character. He sought to

:03:42. > :03:43.offset any responsibility for this collision on anyone else th`t could

:03:44. > :03:45.get into his firing line. So a sentence in prison

:03:46. > :03:47.for the killer. Sarah's family say it's

:03:48. > :04:00.a sentence of grief for thel Chris, what have Sunderland City

:04:01. > :04:08.Council had to say? BC the decision was based on Department for

:04:09. > :04:13.Transport advice. That was the case with David Baillie, all well and

:04:14. > :04:19.good. But the important world is advice, that is all it was, advice,

:06:17. > :06:23.and could do with replacing. We were talking about 3000, 400 ,

:06:24. > :06:30.?500. Which is a lot of mondy to me. But John, from Darlington,

:06:31. > :06:32.was attracted by a Government scheme

:06:33. > :06:34.called the Green Deal. Private firms offer energy

:06:35. > :06:36.improvements to people?s holes. The Green Deal was launched

:06:37. > :06:39.by the Government in 2013. than the saving they make

:06:40. > :06:43.on energy bills. But last month it emerged jtst

:06:44. > :06:51.1% of households have signed up But it seemed like the way

:06:52. > :06:54.for John to get a new boiler. Back in April a salesman from this

:06:55. > :06:57.firm, Tivium, visited John's home. He signed up for a Green De`l

:06:58. > :07:01.assessment and paid ?299 but within a day John decided it wasn't for him

:07:02. > :07:16.after all and asked for his money. We returned the cancellation form a

:07:17. > :07:19.recorded delivery. After about seven or ten days I rang up and s`id, I

:07:20. > :07:24.have cancelled it, what is happening about my refund? They said we had

:07:25. > :07:28.not received a cancellation. I said that is very strange becausd I have

:07:29. > :07:36.a Post Office track record of it. It is signed for. Or, we will have to

:07:37. > :07:41.send you another form. They cashed my cheque after I cancelled the

:07:42. > :07:46.contract. He has not had his money back since April, almost ?300, this

:07:47. > :07:48.is a lot of money. To keep his money for that length of time is

:07:49. > :07:50.unacceptable and they should return it immediately.

:07:51. > :07:55.The firm which shares officds in this building in Swallwell

:07:56. > :07:57.near Gateshead say they havd many satisfied customers

:07:58. > :08:02.and offer good value for money. They say John will get his loney.

:08:03. > :08:08.We have over 12,000 customers in the UK, and even if a small proportion

:08:09. > :08:13.of those customers wish to have a refund, there are different

:08:14. > :08:19.processes we have to considdr as part of that. The first one is, a 14

:08:20. > :08:24.day cooling off period, and to process the request. In John's

:08:25. > :08:28.case, it is a relatively straightforward claim. So why

:08:29. > :08:37.couldn't he have that money back in less time? He is in acute if you

:08:38. > :08:40.want. Can pensioners have money taken away and wait for a bhg

:08:41. > :08:48.growing company like yours to pay it back? I do empathise with hhm and

:08:49. > :08:52.apologise for him not receiving his refund quicker. We endeavour to try

:08:53. > :08:54.and offer our services as qtickly as possible.

:08:55. > :08:56.And John? Well, he still has his old boiler.

:08:57. > :09:01.And he's still waiting for his money back.

:09:02. > :09:12.That is one example of the Green Deal going wrong, but there is a

:09:13. > :09:15.wider picture? That is the number of people signing up to it, or the lack

:09:16. > :09:22.of people signing up to it. The government announced a second round

:09:23. > :09:28.of the Green Deal, ?120 million has been set aside for that rev`mped

:09:29. > :09:32.programme. Individual cases like John's is not exactly going to help

:09:33. > :09:38.encourage the message of take`up. Just today, the chap at the top of

:09:39. > :09:44.the Green Deal, Mark Bailey, told a committee of MPs that an incredibly

:09:45. > :09:51.useful source of finance is the Green Deal. The challenge is to get

:09:52. > :09:55.a good product to customers. Around 23% of the public recognise the

:09:56. > :09:59.Green Deal. Crucially, he could not tell whether that awareness was

:10:00. > :10:02.positive or negative. You c`n have your sale on the Green Deal on
