:01:10. > :01:15.Good evening ` and welcome to Look North. York College has been ordered
:01:16. > :01:18.to pay ?225,000 over the death of a three`year`old at their nursery.
:01:19. > :01:22.Lydia Bishop died when she became caught in a rope left on the slide
:01:23. > :01:26.in the playground on her first full day at the nursery. Last week a
:01:27. > :01:29.worker was cleared of Lydia's manslaughter, but today the judge
:01:30. > :01:32.criticised the nursery for falling" a long way below standard" in
:01:33. > :01:44.failing to enforce safety measures. John Cundy has the story.
:01:45. > :01:49.Lydia Bishop died on her first day at the nursery. She was unsupervised
:01:50. > :01:53.and she was strangled by a rope someone had left on the playground
:01:54. > :01:59.slide. It was 20 minutes before nursery staff even realise she was
:02:00. > :02:04.missing. Last week, is jury at Leeds Crown Court cleared a nursery
:02:05. > :02:08.assistant of any blame for the death of Lydia that she had been looking
:02:09. > :02:14.after. Your college were found guilty of breaches of health and
:02:15. > :02:18.safety legislation. `` York College. The trial judge said that York
:02:19. > :02:25.College had a hike up ability for the death of Lydia Bishop. Such an
:02:26. > :02:32.accident, was both foreseeable and foreseen in both `` for not
:02:33. > :02:36.protecting children on the slide in the playground. The judge continued
:02:37. > :02:40.and said that he considered that your college were guilty of two
:02:41. > :02:43.Syria's failings. They were the more tragic because they took place
:02:44. > :02:47.against the backdrop of the generally careful and thoughtful
:02:48. > :02:54.approach to health and safety matters at the college. The nursery
:02:55. > :02:59.never reopened after Lydia's death. Your college say they remain deeply
:03:00. > :03:03.saddened by the events of 17th of September 2012. We are truly sorry
:03:04. > :03:07.it has happened and we remain committed to learning from these
:03:08. > :03:13.tragic events. The fines imposed on your college is the final chapter in
:03:14. > :03:17.the 18 month saga since the tragic death of Lydia Bishop. Nursing
:03:18. > :03:22.assistant Sophie redhead, cleared of blame, but the college found wanting
:03:23. > :03:28.as they fail to protect the little girl who had been in their care.
:03:29. > :03:34.Tricia Pritchard is from The Voice, a union which represents early years
:03:35. > :04:04.and childcare workers. Good evening. The college has been fined more than
:04:05. > :04:07.?200,000, is that enough? I I don't know that any of us would believe
:04:08. > :04:13.that would any amount would reflect what had happened. Parents and
:04:14. > :04:17.guardians would want to know what procedures should be in place so
:04:18. > :04:21.that a child should not be left unsupervised for 20 minutes.
:04:22. > :04:25.Children should not be left unsupervised for any length of time.
:04:26. > :04:30.Policies and procedures are to protect the children and the
:04:31. > :04:34.practitioners. We should have health and safety procedures in place, risk
:04:35. > :04:40.assessments done on a regular basis and everybody working in that
:04:41. > :04:44.nursery must be familiar with what is expected of them, what they are
:04:45. > :04:50.expected to do since they `` if they see anything going on. It is
:04:51. > :04:53.everybody's responsibility, from bottom up. We are there to care for
:04:54. > :05:00.the children and we must all be accountable. Last week, the Serb ``
:05:01. > :05:06.the nursery worker was cleared of manslaughter, where should the
:05:07. > :05:12.responsibility lies? Ultimately, it is the responsibility of the owner
:05:13. > :05:20.of the nursery. It is up to them on a to put the policies in place. On a
:05:21. > :05:26.daily basis, it is up to the senior team. It does not stop there. It is
:05:27. > :05:31.everybody's responsibility. They must make sure that the policy and
:05:32. > :05:34.procedures are in place and they are adhered to. Even students on
:05:35. > :05:40.placements must know what is expected of them, what they are
:05:41. > :05:45.responsible for. And also, that there is a consequence of not
:05:46. > :05:50.following policies and procedures. It does not stop at the owners, it
:05:51. > :05:53.is responsibility from top to bottom and back`up.
:05:54. > :05:55.Two young brothers from Doncaster have undergone a pioneering
:05:56. > :05:59.operation at Leeds General Infirmary this morning. Ethan and Kyle Roper
:06:00. > :06:04.have had the UK's first miniature heart monitors fitted as an implant.
:06:05. > :06:06.The monitor can wirelessly transmit any unusual heart rhythms direct to

:06:11. > :06:20.Killick's report contains some surgical footage.
:06:21. > :06:25.Brothers Ethan and Kyle Roper are clearly enjoying making medical
:06:26. > :06:29.history. The boys are full of life and healthy outwardly but both have
:06:30. > :06:35.had an extreme collapses recently. Very worrying, perhaps indicative of
:06:36. > :06:39.a heart problem. With Kyle, I remember got out of the bath and we
:06:40. > :06:43.got to the third step on the stairs, and he blacked out. He remembers
:06:44. > :06:50.waking up on the bottom of the stairs, on the floor. And what about
:06:51. > :06:57.even? He was upstairs, going to the toilet. I went up when I heard a
:06:58. > :07:02.thud and I found him on the landing floor. The boys have been fitted
:07:03. > :07:06.with a monitor just under their skin. They can be sent ``
:07:07. > :07:12.information can be sent to the hospital wirelessly. The technology
:07:13. > :07:16.has been around since 2006 but this is the one that the boys are going
:07:17. > :07:22.to get. Much smaller and more appropriate for a child. Right, do
:07:23. > :07:32.you know what this is? Yes, that monitors your heart. Where does it
:07:33. > :07:35.go? About there. There. The procedure is done under general
:07:36. > :07:41.anaesthetic and takes just a few minutes. You are injecting it like
:07:42. > :07:49.the chips they using horses and dogs. There were children at the
:07:50. > :07:57.moment who have finally turned and you try to capture those of on
:07:58. > :08:07.recordings. This can remain active for 23 years. Something will happen
:08:08. > :08:12.`` active for up to three years. In those three years, you can record
:08:13. > :08:18.it. I am impressed. I think he will be. The boys will soon be up and
:08:19. > :08:23.about. The monitors will show if their hearts need any treatment. If
:08:24. > :08:28.so, the new technology might just have saved their lives. Wonderful.
:08:29. > :08:31.Later on Look North, the Steel City still with a chance of the
:08:32. > :08:34.silverware as both Sheffield sides prepare for their latest FA Cup
:08:35. > :08:38.ties. Some news in brief now. And a
:08:39. > :08:42.maintenance worker has been jailed for four years after a toddler fell
:08:43. > :08:45.from the fourth floor of a block of flats in Sheffield. Robert Warner
:08:46. > :08:50.was found guilty of manslaughter by gross negligence at Sheffield Crown
:08:51. > :08:53.Court. He was responsible for maintenance at the flats, where
:08:54. > :08:58.Ryaheen Banimuslem fell through a gap in the safety barrier in 2012.
:08:59. > :09:09.Today police paid tribute to the two`year`old girl and her family. It
:09:10. > :09:14.is a good time to pay tribute to her family, who have displayed
:09:15. > :09:20.tremendous strength and dignity throughout these months. I think the
:09:21. > :09:26.verdict from the jury identified that this is unavoidable incident
:09:27. > :09:30.and it should not have resulted in the death of eight two`year`old.
:09:31. > :09:33.34`year`old Rotherham man David Sindall is due to appear at
:09:34. > :09:36.Sheffield Crown Court on Monday charged with the murder of haulage
:09:37. > :09:39.company boss Dean Armitage. Mr Armitage suffered serious injuries
:09:40. > :09:43.in an incident outside his home on Skiers View Road in Hoyland near
:09:44. > :09:47.Barnsley in August. He died nearly three weeks later in hospital. Mr
:09:48. > :09:52.Sindall entered a not guilty plea in October and the trial is set to last
:09:53. > :09:55.for ten days. An increasing number of families in
:09:56. > :09:59.Yorkshire are choosing to take their children out of school and to
:10:00. > :10:03.educate them at home. So what makes a family decide to go down this
:10:04. > :10:13.route? Joe Inwood has been to meet two families who have given up on
:10:14. > :10:16.mainstream education. Today is the last day this little
:10:17. > :10:24.girl will go through this routine. No uniforms, no more being dropped
:10:25. > :10:29.off. She will be home`schooled. Just picking your home topic and learning
:10:30. > :10:35.as much as you want and not having to stop. It was that desire that led
:10:36. > :10:44.her mum to remove her from the system. When she is into something,
:10:45. > :10:48.she can carry on. I realise it may sound indulgent, but by the same
:10:49. > :10:54.token, she is a small child and you are fostering a love of learning. At
:10:55. > :11:00.the Skinners' house in Sheffield, they have been home`schooling for
:11:01. > :11:04.three years. Today it is maths. An example of how the education, if not
:11:05. > :11:09.the setting, is some fun `` is sometimes traditional. We get one
:11:10. > :11:16.thing that we don't understand, we go over it as much as we want to.
:11:17. > :11:20.English, science. It is not about getting out of school, it is about
:11:21. > :11:26.doing more things than school. But there is a cost. Jackie had to give
:11:27. > :11:34.up a full`time job to become an unpaid teacher. The payback is that
:11:35. > :11:39.the girls get a good education. At an expense, but it is more than
:11:40. > :11:44.worth it. Maybe that is the reason that more and more people opt for
:11:45. > :11:49.home`schooling. In South Yorkshire, 706 children are registered. In the
:11:50. > :11:56.author Yorkshire, 105, and West Yorkshire has 542 children. So why
:11:57. > :12:00.the rise? One expert thinks that the reasons may not be entirely
:12:01. > :12:05.positive. Some people think they could do a better job at home, but
:12:06. > :12:08.for a lot of parents, it is because they feel absolutely desperate and
:12:09. > :12:14.in some cases, it would have been suggested by the school. But as
:12:15. > :12:19.maths turned into a soggy art lesson, the decision for the
:12:20. > :12:22.Skinners has been a positive one. A choice to move outside the system, a
:12:23. > :12:33.choice more and more families seem to be making.
:12:34. > :12:38.Before seven o'clock, I am on Scarborough seafront to see the
:12:39. > :12:42.story of Orpheus the Mariner retold. There are giant puppets and 1000
:12:43. > :12:52.performers. It is a howling gale, what could possibly go wrong!
:12:53. > :12:58.My name is Paul Appleby. I'm also known as Munchie man. You will find
:12:59. > :13:02.out why on look North. `` on Look North.
:13:03. > :13:07.Sport now, and Tanya's here with all the weekend sport and the latest
:13:08. > :13:13.from Sochi. I have been glued to it. A fantastic
:13:14. > :13:17.afternoon on the day that we got a gold in the skeleton bob,
:13:18. > :13:26.Sheffield's Shelley Rudman ended up 16. She started the day in 11th, but
:13:27. > :13:29.slipped down to 13th after her third run and ended up 16th after her
:13:30. > :13:33.fourth and final run. The silver medallist from eight years ago was
:13:34. > :13:36.aiming for a top ten finish, but it was a tough course for her.
:13:37. > :13:39.Shelley's partner, Kristan Bromley, got his campaign under way today.
:13:40. > :13:43.Lying tenth after his first run, he moved up to joint eighth after his
:13:44. > :13:47.second. He was much quicker right from the start, and but for a slight
:13:48. > :13:49.bump might have moved up even further. His final two runs are
:13:50. > :13:52.tomorrow. Football now, and Yorkshire really
:13:53. > :13:55.has got two serious candidates for this season's FA Cup Quarter Finals.
:13:56. > :13:58.But that's if Sheffield United and Sheffield Wednesday get through
:13:59. > :14:02.their fifth round ties this weekend. And there is one primary school in
:14:03. > :14:09.the Steel City, where "cup fever" really is taking hold. Paul Ogden
:14:10. > :14:14.reports. The city of Sheffield has in fact
:14:15. > :14:19.already secured this year's FA Cup for itself this week. For a few
:14:20. > :14:27.hours, anyway. But don't jump to any conclusions about these ribbons. The
:14:28. > :14:33.famous old trophy was on display at the very blue dominated Hillsborough
:14:34. > :14:38.Primary School, down the road from Sheffield United `` Sheffield
:14:39. > :14:43.Wednesday's ground. The FA Cup, every teen dreams of winning it.
:14:44. > :14:51.Every person wants to see and hold it. Teacher Rob Jackson must have a
:14:52. > :14:57.tough time at work. He is a lifelong blade in a school full of Sheffield
:14:58. > :15:04.Wednesday fans. But he is more than happy to predict the results for
:15:05. > :15:14.both Sheffield teams. I will go for a United victory 2`1 and a Wednesday
:15:15. > :15:20.lost 2`1. Never in a million years! Sheffield United will win. Wednesday
:15:21. > :15:29.will get a draw or when, and United will definitely win. That is what it
:15:30. > :15:36.means to everyone. The last few rounds of the FA Cup, everyone loves
:15:37. > :15:42.the FA Cup. The kits have been working hard to show how the city of
:15:43. > :15:47.Sheffield can make its mark on the football world again. Wednesday and
:15:48. > :15:50.United could do worse than copy the supporters' refreshing self belief
:15:51. > :15:54.to get through to the quarterfinals. Halifax fell to a late Chester goal
:15:55. > :15:58.to see them lose 2`1 in the Conference. Twice they've been on TV
:15:59. > :16:03.this season and so far they've had three players sent off. This looked
:16:04. > :16:06.very harsh on Josh Wilson. But having gone behind to Chester, they
:16:07. > :16:10.levelled it in injury time through James Bolton, only for Jamie Menagh
:16:11. > :16:22.to score right at the death to give the home side the victory.
:16:23. > :16:26.I don't generally do statistics, but three times since Halifax have been
:16:27. > :16:30.on telly, they have yet to end the game with 11 men! Anyone want to put
:16:31. > :16:33.a bet on? Now, if you're anywhere near
:16:34. > :16:37.Scarborough this weekend and are happy to brave the wet and the wind,
:16:38. > :16:40.then don't miss the Winter Festival. A giant puppet parade and
:16:41. > :16:43.performance is taking place along the town's South Bay over the next
:16:44. > :16:46.two nights. Hundreds of performers, giant puppets, live music and a
:16:47. > :16:50.lantern procession will tell the story of Orpheus the Mariner ` a
:16:51. > :16:54.young man trying to save his lover from creatures of The Deep. It's one
:16:55. > :16:57.of the most tragic tales of lost love in literature and art. Olivia
:16:58. > :17:06.Richwald is live in Scarborough for us tonight, where it's already under
:17:07. > :17:11.way. Where better to be on a Friday night
:17:12. > :17:16.than here on Scarborough seafront. The story is now well underway. You
:17:17. > :17:23.can see one of the puppets behind me. That is a sailor. We can expect
:17:24. > :17:29.one `` more of these puppets to rise out of the water on boats. It is the
:17:30. > :17:34.story of Orpheus the Mariner. It started about one hour ago. It
:17:35. > :17:38.started half a mile away at the spa complex and it has wound its way to
:17:39. > :17:42.the harbour where it is reaching its conclusion. There are more than 1000
:17:43. > :17:46.performers involved including these guys who are getting ready to sing.
:17:47. > :17:52.They are one of dozens of choirs involved. I filmed some of the
:17:53. > :17:59.preparations a few weeks ago. Let's have a look at that.
:18:00. > :18:05.This is not a vicious form of torture, it is the final rehearsals.
:18:06. > :18:11.To call Orpheus the Mariner ambitious is like calling this
:18:12. > :18:18.winter damp. The weather is sopping, Orpheus is giant. 1000 performers
:18:19. > :18:22.are involved tonight. Organisers had hoped the enormous profits would be
:18:23. > :18:28.more mobile. But better safe than blown into the sea. They are like
:18:29. > :18:33.big wind socks, so if they catch the wind, we are in trouble. They are
:18:34. > :18:41.quite robust. The clothes were made and ripped `` of nylon, so they will
:18:42. > :18:48.dry out. The faces are covered in latex. They are ready for the
:18:49. > :18:52.weather, they are all sorted. Work on the project started more than one
:18:53. > :18:55.year ago. 5000 volunteers were recruited to help with props,
:18:56. > :19:06.puppets, painting, sewing and staging. It is going to look
:19:07. > :19:16.fabulous! Story of whether, when the wind blows, we all pull together! I
:19:17. > :19:24.am making some trumpet horn things. Trumpets will be played by a band,
:19:25. > :19:31.luckily she is not one of them! I can do it. This is one of 14
:19:32. > :19:36.puppets. He will be a drunken sailor when fully operational and finished.
:19:37. > :19:47.It's Blair has to be `` each puppets has to be coated in waterproof
:19:48. > :19:51.paint. It is traditionally a quiet time of year in Scarborough and we
:19:52. > :19:55.wanted a large event of this sort to bring people to the town and show it
:19:56. > :20:09.off. To show that it is a great place to visit even in the winter.
:20:10. > :20:14.Communities all over North Yorkshire have been involved in the
:20:15. > :20:18.preparations. This choir has been learning C shanties. They were all
:20:19. > :20:27.lined the US `` they were all lined the route and sing their C shanties
:20:28. > :20:32.in unison. Finally, if you were wondering what to do with a drunken

:20:40. > :20:43.This show has been two years in the planning. Despite the freezing cold
:20:44. > :20:49.weather, the wind and rain, there are hundreds of people who have come
:20:50. > :20:55.down to see the story. It is part of the coastal festival and Wendy
:20:56. > :21:02.Holroyd joins me. Tell me about it. It is a three`day festival, it runs
:21:03. > :21:09.till Sunday. There are several events, 80 of which are free. It is
:21:10. > :21:12.a mixture of music and dance. Comedy and visual, and of course we have
:21:13. > :21:19.this fantastic Orpheus the Mariner performance tonight. I have to ask,
:21:20. > :21:25.Wendy, everyone is asking why do this in February, it is freezing! I
:21:26. > :21:31.ask myself that every year. We do it in February because we want to bring
:21:32. > :21:35.tourists to the town at a time when it is usually very quiet. We also
:21:36. > :21:40.want to bring arts and fun and entertainment to the residents of
:21:41. > :21:46.Scarborough borough. It also has an economic impact for the town. What
:21:47. > :21:52.are the highlights? The brand`new heavies tonight. And really quirky
:21:53. > :21:57.stuff around the town. A sound installation `` a sound installation
:21:58. > :22:03.at the Rotunda. Orpheus the Mariner has been going on tonight but the
:22:04. > :22:07.story has been going on `` will be told in two parts. The second part
:22:08. > :22:11.will be told tomorrow night on Saturday night. There will be a
:22:12. > :22:15.world record`breaking puppet, which will be enormous. That will be
:22:16. > :22:20.unveiled. It is well worth coming down to watch that tomorrow night.
:22:21. > :22:22.Even in the middle of winter, Scarborough has something to offer.
:22:23. > :22:26.Now, do you ever fancy a takeaway, but can't be bothered to go and
:22:27. > :22:30.collect one? Well, if you live in Barnsley, help is at hand in the
