:01:31. > :01:36.another 86 people. To date Network Rail will face prosecution over the
:01:36. > :01:40.Grayrigg derailment, it was announced today. Badly maintained
:01:40. > :01:45.points were to blame. Peter Marshall has been at the scene and
:01:45. > :01:49.reminded me what happened that night in February, 2007.
:01:49. > :01:54.Had it think anybody was there that night will ever forget the horror
:01:54. > :02:01.of 300 tons of the train flipping through at more than 90 mph. 109
:02:01. > :02:06.people on board, 86 injured, 20 it seriously. One woman, 84-year-old
:02:06. > :02:11.Margaret Masson from Scotland died from the injuries she sustained.
:02:11. > :02:15.The subsequent investigation and inquest into her death decided a
:02:15. > :02:20.poorly maintained set of points was to blame for the accident and the
:02:20. > :02:23.inquest into her death raised doubts and questions about the
:02:23. > :02:28.standards of Network Rail's maintenance routine on the track in
:02:28. > :02:31.the run-up to the accident. The Office of Rail Regulation has
:02:31. > :02:35.decided it is in the public interest and that there is enough
:02:35. > :02:38.regulation -- evidence to pursue an investigation under health and
:02:38. > :02:45.safety legislation. What reaction has there been from
:02:45. > :02:49.her family today? Her daughter has said she is
:02:49. > :02:53.pleased there will be a prosecution in this case. The family has always
:02:53. > :02:56.said they wanted somebody to be held accountable for what happened
:02:56. > :02:59.to their mother. We have been speaking to the lawyer representing
:02:59. > :03:08.the family and this is what he had to say.
:03:08. > :03:13.He seems to me that the prosecution of Network Rail is inappropriate,
:03:13. > :03:16.given the evidence that came out towards the end of last year.
:03:16. > :03:21.they facing the prospect of a huge fine, what are the penalties they
:03:21. > :03:24.could be looking at? You can actually look at previous
:03:25. > :03:29.prosecutions and Network Rail has been prosecuted in the past, in the
:03:29. > :03:35.Potters Bar crash in 2002 when seven people died. They were fined
:03:35. > :03:39.�3 million. In the Ladbroke Grove - - -- Ladbroke Grove crash in 1999
:03:39. > :03:43.they were fined �4 million. If this case goes to crown court they could
:03:43. > :03:47.face an unlimited fine. The MP for this area has said he is pleased
:03:47. > :03:52.they will be a prosecution but believes there is still a case for
:03:52. > :03:56.a public inquiry. It is still very much needed. The
:03:56. > :04:00.Grayrigg crash took part after the Potters Bar tragedy, lives have
:04:00. > :04:04.been lost, lessons clearly what learnt and all the arguments that
:04:04. > :04:08.have taken place still convince me there were lessons that Network
:04:08. > :04:12.Rail have still not learnt. What reaction has there been from
:04:12. > :04:16.Network Rail? They have issued a statement and
:04:16. > :04:18.say they have never hidden from their responsibilities and they
:04:18. > :04:23.were quick to accept it was a problem with the infrastructure
:04:23. > :04:26.that led to this accident. They say they have worked closely with you
:04:26. > :04:33.verities and brought about many improvements to their maintenance
:04:33. > :04:36.regimes since the accident since -- in February 2007. They say rail is
:04:36. > :04:45.the safest form of transport but it is important the industry works
:04:45. > :04:48.together to make it saved us still. -- safer. For macro ford decades
:04:48. > :04:51.Robert Cutting's family have been seeking justice for their son who
:04:51. > :04:57.was shot dead. The teenager from Manchester died in Northern Ireland
:04:57. > :05:01.at the height of the troubles in the 1970s and it was now referred
:05:01. > :05:07.to as a friendly fire accident. His family say army officials refused
:05:07. > :05:11.to elaborate on exactly how and why he died. They have campaigned since
:05:11. > :05:19.then for answers and 40 years on they have been told there will be
:05:19. > :05:24.in the investigation into the case. It is 1972, Northern Ireland is a
:05:24. > :05:26.very dangerous place for British troops to be. Gunner Robert Cutting
:05:26. > :05:31.was to discover just how dangerous when he was shot dead while on
:05:31. > :05:35.patrol in the province one September day. The fatal fire came
:05:35. > :05:39.from his own side. He was the only boy in the family,
:05:39. > :05:47.adored by everybody, we were devastated. And we heard it was one
:05:47. > :05:51.of his own? Angry. We are a service family. We didn't expect one of our
:05:51. > :05:55.aim to kill him. Her Royal citation commends the bravery of the young
:05:55. > :05:59.man from Manchester he died for Queen and country. His family say
:05:59. > :06:06.the military showed them little respect or compassion at the time.
:06:06. > :06:10.His mother Edna recalls arriving home soon after his death to find
:06:10. > :06:14.her son's personal belongings left in a box on the doorstep. 30 years
:06:14. > :06:19.later a letter from the Ministry of Defence told Roberts parents they
:06:19. > :06:23.might be eligible for a pension of �1 per week, subject to means
:06:23. > :06:27.testing. The family have spent decades trying to get to the truth
:06:27. > :06:30.of exactly what happened to Robert. They were not invited to the
:06:31. > :06:36.inquest in the 70s and were appalled to discover a verdict of
:06:36. > :06:41.accidental death Ward -- was recorded. Irene recently obtained a
:06:41. > :06:45.pathology report but showed he was shot four times. A want to find out
:06:45. > :06:51.what happened, and what happened to the person that killed my brother.
:06:51. > :06:55.This is about compensation? absolutely not. We want to find out
:06:55. > :07:00.why they were so shady about everything. Now at last news his
:07:00. > :07:05.case will be reinvestigated. family have never had the final
:07:05. > :07:09.board of inquiry report, they have never seen the full and redacted
:07:09. > :07:12.coroner's report. They need to know all the details. The Ministry of
:07:12. > :07:16.Defence said they hoped the review of his case will be carried out as
:07:16. > :07:19.quickly as possible. It cannot come quickly enough for his family
:07:19. > :07:29.because they had then at last they will have answers to questions they
:07:29. > :07:30.

:13:23. > :13:26.arrived on the beach at Formby today. They our trees that didn't
:13:26. > :13:29.sell at Christmas and they have been donated to try to halt the
:13:30. > :13:37.erosion of the genes at Formby Point. Weeks of high winds have
:13:37. > :13:41.swept thousands of sand -- thousands of tons of sand in on.
:13:41. > :13:46.Call it a late Christmas present. These unsold trees are not here for
:13:46. > :13:49.decoration, they are here to stop the shifting sand.
:13:50. > :13:54.With 5,000 trees to position help is at hand from a local primary
:13:54. > :13:58.school. The sand dunes are a fragile sea defence. It is held
:13:58. > :14:04.together by the Marron grass but in parts Major is needed -- is in need
:14:04. > :14:12.of a helping hand. Coastal erosion is where the sand will blow. It
:14:12. > :14:22.will come further towards where we live. When it gets blown it will

:14:28. > :14:31.The trees will be positioned over a mile of coastline at Formby. It is

:14:38. > :14:42.conservation. They are already helping stop erosion at the River
:14:42. > :14:45.Bollin in Cheshire. The sand dunes on moving inland naturally at the
:14:45. > :14:50.rate of about four metres per year. The idea of the trees is to stop
:14:50. > :14:52.some of that sand blowing in towards the town.
:14:52. > :15:01.Christmas-tree Zagreb because obviously they hold their measles
:15:01. > :15:03.so they are nice and bushy so they really do help to dissipate the
:15:04. > :15:13.power and it buys the San together underneath. The other great thing
