:01:07. > :01:08.In July last year Paul Briggs was on his way to work

:01:09. > :01:11.as a Merseyside Police officer when he was knocked

:01:12. > :01:17.Now a judge has been asked to decide whether doctors should stop

:01:18. > :01:21.His wife Lindsey says it's what he would have wanted.

:01:22. > :01:26.They say there is a chance his condition could improve.

:01:27. > :01:31.Here's Lindsey Prosser with the background to this case.

:01:32. > :01:34.Paul Briggs was hit by a car as he was travelling to work

:01:35. > :01:38.He suffered a severe brain injury and is being cared

:01:39. > :01:42.Today's hearing was heard at the Court of Protection,

:01:43. > :01:44.which deals with matters relating to be people unable to make

:01:45. > :01:50.The court was told that doctors treating Mr Briggs

:01:51. > :01:53.and an independent doctor have stated that he's in a minim`lly

:01:54. > :01:58.conscious state, whilst another independent doctor believes that

:01:59. > :02:00.The court heard that Mrs Briggs was distressed to learn that

:02:01. > :02:03.without a written record of what her husband would have

:02:04. > :02:05.intended in this situation, she couldn't stop him receiving

:02:06. > :02:07.care she believes he wouldn't have have consented to.

:02:08. > :02:09.Doctors looking after Paul Briggs believe there's potential

:02:10. > :02:14.Lindsey Briggs says he'll continue to fight for her husband's

:02:15. > :02:31.A judgment is expected later this month.

:02:32. > :02:35.it's very rare in cases for like this for people to be named.

:02:36. > :02:37.Earlier, I spoke to Lindsey Briggs's solicitor, Mathieu Culverhouse,

:02:38. > :02:39.and asked him why she wanted her husband's life-support

:02:40. > :02:43.Well, this past year has clearly been an extremely difficult time for

:02:44. > :02:46.Lindsey Briggs and for Paul Briggs' family.

:02:47. > :02:48.And they just want what is best for Paul.

:02:49. > :02:51.Lindsey Briggs is firmly of the view that the

:02:52. > :02:53.withdrawal of treatment is in Paul's best interests,

:02:54. > :02:55.given his previously expressed wishes and feelings and

:02:56. > :02:59.And that is a key point, isn't it, that you've

:03:00. > :03:03.Because my next question was going to be, had he ever

:03:04. > :03:05.expressed a view on a situation like this,

:03:06. > :03:08.while he was fit and well, as to what he would

:03:09. > :03:11.And, from what you are saying, he had.

:03:12. > :03:14.Well, there is such a thing as a formal written advance decision,

:03:15. > :03:19.which someone with the mental capacity to make decisions can enter

:03:20. > :03:23.Unfortunately, this is not ` case where there is such an advance

:03:24. > :03:27.But we are presenting to the court a case

:03:28. > :03:32.that, given the expressed wishes of Paul Briggs,

:03:33. > :03:35.wife and to others, that given his current

:03:36. > :03:37.situation he would not want

:03:38. > :03:40.Doctors, though, say he's in this minimally

:03:41. > :03:44.How does a court decide which way to go in a

:03:45. > :03:48.situation where you have soleone saying one thing and doctors saying

:03:49. > :03:51.The gathering of evidence is ongoing, because clearly a

:03:52. > :03:56.medical diagnosis can change, so the court will be presented

:03:57. > :03:59.with up-to-date evidence on the medical diagnosis.

:04:00. > :04:03.But the court will be looking at this decision on the

:04:04. > :04:05.basis of what is in Paul's best interests.

:04:06. > :04:09.one can foresee, not in this case perhaps,

:04:10. > :04:11.where a family might have

:04:12. > :04:17.another reason for wanting to switch a machine off.

:04:18. > :04:19.Everyone who works in these cases recognises that this

:04:20. > :04:22.is the most important decishon a court and a judge is ever

:04:23. > :04:26.These cases are treated extremely seriously and none

:04:27. > :04:30.of these decisions are taken lightly, in any way.

:04:40. > :04:41.That's how the coroner described England under-19 footballer

:04:42. > :04:46.Zoe Tynan at the inquest into her death earlier todax.

:04:47. > :04:50.Zoe was playing for Fylde L`dies FC and hoping to sign a professional

:04:51. > :04:58.She died in August, after she walked in front of a train at West Allerton

:04:59. > :05:08.Mark Edwardson has been at the inquest.

:05:09. > :05:18.Mark, Zoe was hoping to have a successful football career, wasn't

:05:19. > :05:23.she? She was. And that may have already started. She did indeed

:05:24. > :05:26.appear for the England under 19 's women's team. She had been `

:05:27. > :05:27.women's team. She had been a lifelong football. Her caredr

:05:28. > :05:34.lifelong football. Her career started at the age of six when she

:05:35. > :05:35.played for Liverpool Feds. She was so talented she managed to juggle

:05:36. > :05:43.training with athletics career. Last training with athletics carder. Last

:05:44. > :05:52.year she moved teams before being signed by Thiem in the summer.

:06:11. > :06:26.what she would have wanted. So what was said in court today The

:06:27. > :06:28.coroner spoke of CCTV footage which was taken from the train that hit

:06:29. > :06:33.was taken from the train th`t hit Zoe. It appeared to show her calmly

:06:34. > :06:36.getting down from the platform edge onto the tracks as it approached the

:06:37. > :06:40.onto the tracks as it appro`ched the station. Where flowers and tributes

:10:09. > :10:18.But believe it should have been made public sooner.
