:00:47. > :00:50.She and another midwife did not refer matters to a paediatrhcian

:00:51. > :00:53.as they should have done when they found Joshua

:00:54. > :00:57.The tribunal chairman Stuart Gray said Lindsey Biggs caused "`ctual

:00:58. > :01:01.harm" to Joshua and "emotional harm" to his mother.

:01:02. > :01:05.There was an "attitudinal problem" and a "lack of remorse".

:01:06. > :01:08.Just desperately sad and desperately frustrated and desperately `ngry

:01:09. > :01:13.with the NMC for letting thhs drag on for so very long.

:01:14. > :01:20.You know, Joshua's death was never investigated properly.

:01:21. > :01:23.Joshua was one of 11 babies and a mother to die after bding

:01:24. > :01:25.treated at University Hospitals of Morecambe Bay NHS Trust

:01:26. > :01:32.This has been the Midwifery Council closing ranks, trying

:01:33. > :01:35.to protect its own people for far too long and without the tenacity

:01:36. > :01:39.of James and others I think we can speculate that we would not even

:01:40. > :01:41.have reached this point at all and that is

:01:42. > :01:46.While Lindsey Biggs was awaiting her hearing

:01:47. > :01:49.on the circumstances of Joshua's death, she was allowed to continue

:01:50. > :01:54.In June, following an investigation into the death of another

:01:55. > :01:56.baby earlier this year, Morecambe Bay Hosptials Trust

:01:57. > :02:03.It's also apologised for letting down patients.

:02:04. > :02:04.The NMC is a dysfunctional organisation that

:02:05. > :02:13.It is letting the very people that relied on it down and it sedms to be

:02:14. > :02:14.not capable of learning lessons for itself.

:02:15. > :02:20.I think it's time there was a root and branch review of the NMC.

:02:41. > :02:43.Earlier, I spoke to Doctor Bill Kirkup, who led the inquiry

:02:44. > :02:46.into the Morecambe Bay NHS Foundation Trust.

:02:47. > :02:50.I asked him about what he thought about the delays addressing what

:02:51. > :02:51.happened. It is very disappointing and it must

:02:52. > :02:54.be awfully difficult for the relatives who are concerned

:02:55. > :02:56.in all of these things. One is that it took a long time

:02:57. > :03:01.for these things to come My investigation wasn't

:03:02. > :03:05.commissioned until 2013, so that is five years down the line

:03:06. > :03:08.anyway and then when we produced the report,

:03:09. > :03:14.one of the recommendations was these cases needed to be re-looked

:03:15. > :03:17.at and I'm afraid it's taken over one year for us to get

:03:18. > :03:25.to the position where in now. Do you think the nursing

:03:26. > :03:31.and midwifery Council needs to look at the way in which it

:03:32. > :03:34.conducts its own investigathons I think that there are prob`bly

:03:35. > :03:38.lessons to be learnt here and the way this has bden dealt

:03:39. > :03:41.with in the first place and the reason it has taken such

:03:42. > :03:45.a long time now and in terms of the way that they have rdported

:03:46. > :03:48.on what they have been doing. I would at the end of all

:03:49. > :03:53.of the cases that they are dealing with related to Morecambe B`y,

:03:54. > :03:56.I would expect them to do an external investigation and to

:03:57. > :03:59.report that in full in publhc. The trust which runs Furness General

:04:00. > :04:01.has apologised and it says ht will never let anyone down

:04:02. > :04:05.in the future as it did in the past. Are you confident that the changes

:04:06. > :04:08.you called for in your report I think the trust have made

:04:09. > :04:12.fantastic strides in implemdnting quite a challenging set

:04:13. > :04:14.of recommendations in the rdport. Obviously these things take a long

:04:15. > :04:18.time to see through and I wouldn't want to say that it is all done

:04:19. > :04:21.and dusted now, I don't belheve it is, but I think they are doing

:04:22. > :04:36.absolutely the right thing. Row police forces have been taking

:04:37. > :04:40.coordinated action against lodern slavery this week that exploits

:04:41. > :04:41.vulnerable people and forces have raided nail bars, car washes and

:04:42. > :04:44.suspected brothels. Our social affairs correspondent
