:01:22. > :01:38.across Swindon for weeks and it burnt for two months,
:01:39. > :01:40.before it was extinguished. Today, Lee Averies,
:01:41. > :01:43.who owned and ran the plant with his brother David,
:01:44. > :01:44.was sentenced in court. They had already pleaded
:01:45. > :01:46.guilty to being reckless and negligent, causing pollttion
:01:47. > :01:56.and harm to health. The judge told Lee Averies
:01:57. > :01:58.that his offences cause significant harm and
:01:59. > :02:00.disruption and they were serious But he suspended a 12-month
:02:01. > :02:12.sentence for two years. He did impose a criminal behaviour
:02:13. > :02:15.order, which effectively bans Lee Averies from the waste hndustry
:02:16. > :02:17.for five years. His brother David Averies w`s
:02:18. > :02:19.disqualified as a company dhrector Living with the fire
:02:20. > :02:22.was horrible for many. Residents had to keep windows
:02:23. > :02:25.closed, some went to hospit`l. The smell, the smoke,
:02:26. > :02:34.the burning plastic. It was nauseating.
:02:35. > :02:36.The smell was horrendous. Having to work with it,
:02:37. > :02:43.it was really not very pleasant The Environment Agency estilates
:02:44. > :02:45.there was 10,000 tonnes The Averies had
:02:46. > :02:48.a permit for half that. There was a fire
:02:49. > :02:58.at Swindon Skips in 2013. The council has to deal
:02:59. > :03:01.with the tonnes of rubbish left People are paying good monex
:03:02. > :03:04.to have their waste taken away by reputable people,
:03:05. > :03:07.to be dealt with properly and it has just left someone else to ddal
:03:08. > :03:10.with and put the cost on somebody else - this
:03:11. > :03:12.time, the public purse. The Averies also own
:03:13. > :03:21.Calne Aggregates, which was part The Environment Agency is working
:03:22. > :03:32.to shut it down, too. When the fire was at its hehght

:04:10. > :04:11.earlier, I asked Ian Jeary from the service how diffictlt
:04:12. > :04:14.it was to get it under control. The fire was very
:04:15. > :04:16.difficult to control. As the judge said, the mism`nagement
:04:17. > :04:21.at the site made it much more difficult and dangerous
:04:22. > :04:23.for the Fire Service We had to work very hard
:04:24. > :04:27.to move over 3,000 tonnes of waste away from the site.
:04:28. > :04:30.That was no thanks to the owners. The fire at Marshgate lasted for 57
:04:31. > :04:34.days and involved all 24 of its fire It obviously cost
:04:35. > :04:38.you a lot of money? Yes, we estimate it cost us
:04:39. > :04:41.in excess of ?157,000. But obviously, there
:04:42. > :04:42.were other agencies involved, as well, so the total cost
:04:43. > :04:46.of the operation is in excess of Are you going to try
:04:47. > :04:56.to recover your costs? The next stage of legal
:04:57. > :04:58.proceedings is a Proceeds of That has been placed
:04:59. > :05:02.on the brothers. We will be making sure

:05:35. > :05:38.findings of a report into the treatment of four-xear old
:05:39. > :05:40.Sean Turner from Wiltshire. He died at Bristol
:05:41. > :05:45.Children's Hospital in 2012. His parents always said that staff
:05:46. > :05:47.did not have the training Now, a government ombudsman
:05:48. > :05:51.agrees with them. Sean Turner was a fun-loving
:05:52. > :05:57.four-year-old boy. He knew about his
:05:58. > :06:00.own heart condition before his operation at the Bristol
:06:01. > :06:02.Children's Hospital in 2012. He told his parents he was looking
:06:03. > :06:06.forward to being able to run around with his friends for longer.
:06:07. > :06:10.But Sean never came home. We could see that he
:06:11. > :06:12.was deteriorating. His parents said Sean
:06:13. > :06:15.was badly dehydrated, taking on water by sucking on wet
:06:16. > :06:21.wipes and a toothbrush. His parents say that there were too
:06:22. > :06:24.few staff who did not understand how to help their son, and that
:06:25. > :06:26.when they complained, the responses were, at best,
:06:27. > :06:31.inaccurate and misleading. He was grabbing the wet wipds
:06:32. > :06:35.when I was watching him. He was grabbing the paper towels
:06:36. > :06:42.and I was trying to cool him down so he had
:06:43. > :06:45.a temperature and he would suck out Now a new report has
:06:46. > :06:48.confirmed their fears. The Parliamentary and Health
:06:49. > :06:50.Service Ombudsman's report about the hospital's high
:06:51. > :06:54.dependency capabilities, that Sean's fluid levels
:06:55. > :06:55.weren't monitored properly It calls the failings
:06:56. > :07:03.in nursing care "systemic". And says that the care for Sean fell
:07:04. > :07:06.so far below the established good practice that it amounted
:07:07. > :07:11.to a service failure. It's what we knew,
:07:12. > :07:14.because it is what we lived. Today, University Hospitals
:07:15. > :07:20.Bristol apologised. Their chief executive said
:07:21. > :07:23.he was deeply sorry for failings in care and for the impact they had
:07:24. > :07:28.on Sean and his family. I am also very sorry
:07:29. > :07:30.that we compounded their grhef by giving inaccurate
:07:31. > :07:32.and incomplete responses It is so important to
:07:33. > :07:38.us to have the truth. This was our little boy
:07:39. > :07:40.and he was very brave and we have to live
:07:41. > :07:44.with the guilt that we put him The Turners have been
