:01:07. > :01:08.28-year-old Wayne Moores died after a hit and run crash

:01:09. > :01:10.involving his motorbike on the M4 in 2010.

:01:11. > :01:16.The driver was given a six year prison sentence.

:01:17. > :01:18.The maximum possible penalty for drivers who cause deaths

:01:19. > :01:22.through dangerous or careless driving under the influence of drink

:01:23. > :01:31.But in practice the average sentence given

:01:32. > :01:40.The government is considering introducing life

:01:41. > :01:42.sentences saying offenders should face the full force of the law.

:01:43. > :01:45.But Wayne Moore's family say all such cases should be

:01:46. > :01:49.Deeply spiritual, had a huge sense of fun,

:01:50. > :01:51.was prepared to stand up for things that were wrong.

:01:52. > :01:53.Wayne Moores's parents remember their son,

:01:54. > :01:58.A talented blacksmith, Wayne had been working in Wales.

:01:59. > :02:02.In September 2010, he was travelling home to Hampshire on his motorbike

:02:03. > :02:06.when he was struck by a drunk driver who fled the scene.

:02:07. > :02:11.Nothing can prepare parents for seeing their child

:02:12. > :02:27.Every day, I have that vision, comes into my mind.

:02:28. > :02:31.The driver, Donna Hackett, was given a six-year sentence

:02:32. > :02:33.for causing death by careless driving while under

:02:34. > :02:40.Wayne's parents feel the current wording of charges and the penalties

:02:41. > :02:43.given don't reflect the seriousness of road deaths.

:02:44. > :02:47.There's nothing careless about drink-driving.

:02:48. > :02:51.What message does it give to the criminal?

:02:52. > :02:55."Oh, don't worry, you're just a bit careless.

:02:56. > :03:05.The Government is consulting on whether the maximum sentence

:03:06. > :03:08.for such crimes should be increased from 14 years to to life.

:03:09. > :03:10.Wayne's parents believe that needs to backed up by tougher

:03:11. > :03:22.Why when you get in the kind you dry drunk and you kill somebody,

:03:23. > :03:25.-- Why when you get in a vehicle and you drive drunk

:03:26. > :03:31.It needs to looked at seriously and, as we say, the careless driving

:03:32. > :03:33.whilst under the influence to be abolished and instead

:03:34. > :03:34.make it manslaughter, make it about people,

:03:35. > :03:53.Wayne's parents will continue to push for the law to be rewritten,

:03:54. > :03:57.a move they hope might change attitudes and save lives.

:03:58. > :04:09.A short time ago I spoke to the legal commentator

:04:10. > :04:12.Joshua Rozenberg and asked whether the introduction of life

:04:13. > :04:19.sentences would actually mean much longer sentences for offenders.

:04:20. > :04:21.Sentences for this particular offence are around the five-year

:04:22. > :04:24.mark, but there was one quite recently where a sentence

:04:25. > :04:27.of ten years was upheld by the Court of Appeal,

:04:28. > :04:33.So, it is possible to get quite close to the maximum of 14 years,

:04:34. > :04:37.and if the maximum were raised to life, then that would bring up,

:04:38. > :04:41.I think, all the sentences for this particular sort of offence.

:04:42. > :04:44.It would be a message to the courts to treat them more seriously

:04:45. > :04:47.and the general level of sentencing would go up.

:04:48. > :04:49.We've heard from the family that they are concerned

:04:50. > :04:57.They say that "careless" trivialises this and especially

:04:58. > :04:59.where there is an aggravating factor that

:05:00. > :05:00."manslaughter" would be more appropriate.

:05:01. > :05:02.Would changing the wording make a difference?

:05:03. > :05:05.You can charge someone with manslaughter if they kill

:05:06. > :05:08.somebody as a result of a traffic accident.

:05:09. > :05:12.It used to be more common, but juries were quite reluctant

:05:13. > :05:22.to convict people of homicide, of manslaughter, which is

:05:23. > :05:25.More significantly, it is very difficult to prove.

:05:26. > :05:28.You have to show that the motorist was grossly negligent in order to

:05:29. > :05:32.With causing death by careless driving under the influence of drink

:05:33. > :05:35.or drugs, you just have to show a momentary lapse in attention

:05:36. > :05:39.or driving just below the standard expected of a careful driver.

:05:40. > :05:41.Other families we have heard from here want the law changed

:05:42. > :05:44.so that if you kill more than one person that sentences

:05:45. > :05:48.run consecutively, rather than concurrently.

:05:49. > :05:52.How likely is it that the Government would adopt something like that?

:05:53. > :05:55.What the judge has to do in sentencing somebody is look

:05:56. > :06:00.Obviously, if you kill more than one person

:06:01. > :06:05.feature and you're likely to get a longer sentence but you're not

:06:06. > :06:09.likely to get twice as long because, after all, your bad behaviour,

:06:10. > :06:13.case was the same whether you killed one person or two

:06:14. > :06:18.I don't think that people would be very happy,

:06:19. > :06:23.to be told that the sentence would be lower because only one

:06:24. > :06:41.A school in Poole has written to all its parents after four

:06:42. > :06:43.children came into contact with cocaine on the school premises.

:06:44. > :06:46.One child was found in possession of the drug at Broadstone Middle

:06:47. > :06:48.school and the teachers say the children believed

:06:49. > :06:53.Anjana what do we know about what happened?

:06:54. > :06:59.It happened on the 3rd of January, the first day back after the

:07:00. > :07:04.Christmas holidays. The skills they a fairly chilled with three other

:07:05. > :07:07.children in possession of an unknown substance, a white powder that they

:07:08. > :07:12.believed to be drugs. The school says the children believed it to be

:07:13. > :07:16.sweet, possibly Sherbert. They phoned the police and the ambulances

:07:17. > :07:21.and they treated the children on the scene and took them to hospital.

:07:22. > :07:24.They established that the children hadn't ingested any of the drug,

:07:25. > :07:30.they were fine and they were discharged on the day. This skill

:07:31. > :07:33.she has around 500 pupils aged between nine and 13. We don't know

:07:34. > :07:38.the ages or the genders of the children involved. I was here as

:07:39. > :07:42.school ended today speaking to parents. Most didn't want to speak

:07:43. > :07:44.to as and said the school didn't want to speak to us but I did manage

:07:45. > :07:52.to catch up with two dads. I'll be making an appointment with

:07:53. > :07:57.the headmistress and speaking to her and hear the facts from different

:07:58. > :08:02.people. I've got nothing to say, really. I have heard it is under

:08:03. > :08:05.control. They have elected -- reacted quite well. Due to other

:08:06. > :08:07.parents have been given enough information? We have been kept

:08:08. > :08:14.informed, that's fine. As the school had anything more to

:08:15. > :08:18.say about it? The school says it has written to

:08:19. > :08:23.parent and carers and assured them it was an isolated engine --

:08:24. > :08:26.incident. The police have confirmed it was cocaine and have arrested a

:08:27. > :08:30.30-year-old man and he has been bailed pending further enquiries.

:08:31. > :08:32.A Southampton man's been shot dead in Thailand.

:08:33. > :08:35.It's reported by the Bangkok Post that father of two Tony Kenway

:08:36. > :08:38.was killed in the drivers seat of his red Porsche in the car

:09:19. > :09:21.The idea had been to give councils more control over transport,

:09:22. > :09:23.housing and infrastructure, along with extra funding.

:09:25. > :09:35.This was contentious from the start so what's brought it to an end?

:09:36. > :09:40.Disagreement and contention over exactly the right way forward. The

:09:41. > :09:44.government wanted to hand money and more power to local councils,

:09:45. > :09:48.particularly in the south of England, having done it for the

:09:49. > :09:53.North of England. ?900 million of investment was what they said had

:09:54. > :09:56.been earmarked and almost got into George Osborne pars last budget and

:09:57. > :10:00.was pulled at the last minute because Hampshire County Council

:10:01. > :10:03.said they didn't agree with the way that Portsmouth, Southampton and the

:10:04. > :10:13.Isle of Wight were prepared to go on and bring in other district

:10:14. > :10:16.councils. There a crunch meeting this afternoon. It was all the MPs

:10:17. > :10:19.at Westminster and a lot of the council leaders. It was intended to

:10:20. > :10:20.find a way forward. With the Isle of Wight having changed from

:10:21. > :10:24.independent control to Conservative control and the Conservatives think

:10:25. > :10:27.they wanted nothing to do with Portsmouth and Southampton, it

:10:28. > :10:32.seemed clear, I am told by MPs, that there was no way forward. Now the

:10:33. > :10:36.council leaders are saying it is dead in the water. ?1 billion of

:10:37. > :10:40.government money has gone away and it will be sometime before they find

:10:41. > :10:44.a way to bring that back again. What happens next? The councils will

:10:45. > :10:57.have to think about mergers. This is what is

:10:58. > :11:00.happening Dorset, they are talking about forming super councils.

:11:01. > :11:02.There's a meeting tomorrow. It is happening in or Oxford as well. The

:11:03. > :11:04.organising along government structure, rather than taking

:11:05. > :11:07.existing councils, taking a mere and creating an authority. In the end,

:11:08. > :11:10.it is about setting the course forward for the next decade. All the

:11:11. > :11:14.potential money for social care in particular could have come at this,

:11:15. > :11:18.it looks as if that won't happen and we will have to go back to the

:11:19. > :11:22.drawing board and find some other way, I am told there was well in the

:11:23. > :11:25.room for some kind of combined transport authority for Hampshire,

:11:26. > :11:26.that is different to a devolution deal.

:11:27. > :11:29.The cold weather means it may be taking longer to get

:14:26. > :14:28.Michael pleaded guilty to being an illegal alien

:14:29. > :14:30.in possession of a firearm and disrupting government business.
