:01:32. > :01:34.taught about the dangers of drivers using mobile phones.

:01:35. > :01:36.She has her own reasons for wanting to change the culture

:01:37. > :01:43.Matt Graveling has this exclusive report.

:01:44. > :01:47.Gavin was an Australian through and through.

:01:48. > :01:53.We'd talked about holidays potentially going out

:01:54. > :02:03.It was something we were both really looking forward to.

:02:04. > :02:06.He was on his way to work and then he was about six miles

:02:07. > :02:15.or so from work and then just didn't make it.

:02:16. > :02:20.Lewis Stratford - a 24-year-old painter and decorator

:02:21. > :02:24.from Oxford was driving - and arguing with his

:02:25. > :02:29.girlfriend on the phone - when he crashed into Gavin's car.

:02:30. > :02:31.I wish I could turn back time, change obviously not

:02:32. > :02:47.And from that moment I was just blaming everything on me.

:02:48. > :02:50.And I didn't want to get better then, I didn't want the physio,

:02:51. > :02:52.I didn't want the treatments, I feel like I've been kept

:02:53. > :02:55.here to pay for the mistake that I've made and punished.

:02:56. > :02:57.Gavin died of his injuries four days after the accident.

:02:58. > :03:00.Lewis has already pleaded guilty to causing his death

:03:01. > :03:08.When someone gets convicted of a crime or an offence you never

:03:09. > :03:12.get to see what that person's like and what

:03:13. > :03:23.Just days before he's due back in court to be sentenced,

:03:24. > :03:32.I want to ask what he was thinking, what possessed him to pick

:03:33. > :03:36.up his mobile phone behind the wheel - I want to know how he's feeling

:03:37. > :03:46.now, how it might affect him and to let him know how I'm feeling.

:03:47. > :03:48.Lewis agreed to meet Meg with our cameras present,

:03:49. > :03:52.and restorative justice councillor Helen Leney.

:03:53. > :03:55.An apology that's given in court is very often mistrusted by a victim

:03:56. > :04:04.whereas if a victim sits down face to face with the person who has

:04:05. > :04:06.caused the harm that can be enormously helpful in allowing

:04:07. > :04:15.victims then to be able to move on from what's happened.

:04:16. > :04:18.I'll never forget it ever and I'll never be sorry enough but I can't

:04:19. > :04:22.every time I say sorry it sounds a bit cheap, it just sounds not

:04:23. > :04:49.A little bit, but then so many people do it, so many people.

:04:50. > :04:56.I don't want to hate you for ever, I'm not that type of person.

:04:57. > :05:03.Eventually I will probably be able to forgive you. I just needed some

:05:04. > :05:06.questions answered first. for all schoolchildren to be taught

:05:07. > :05:10.about the dangers of using mobiles behind the wheel before

:05:11. > :05:16.they start learning to drive. Well, a little earlier, I talked

:05:17. > :05:19.to Meg from our London studios. And I started by asking her why

:05:20. > :05:38.she had wanted to have For me, it was about having hows and

:05:39. > :05:43.whys answered. I just needed a few answers to the puzzle and to put the

:05:44. > :05:48.pieces into place. You just said you had a lot of questions. Did he

:05:49. > :05:54.answer those questions? He did and he was very open about it and was

:05:55. > :05:57.able to show his compassion and stated that he didn't want others to

:05:58. > :06:03.feel sorry for him because he knew how much we had been through. How

:06:04. > :06:08.did you feel about meeting Lewis? That he understand why you wanted to

:06:09. > :06:13.meet him? The reason I have done it is to use this filming as a

:06:14. > :06:20.deterrent and to have this as a massive impact on people to stop

:06:21. > :06:24.them from picking up their mobile phone, and on both sides, I think it

:06:25. > :06:29.will really hit home with some people. New laws come out this week

:06:30. > :06:32.on the use of mobile phones while driving and they are supposed to be

:06:33. > :06:40.tougher. Do you think they are tough enough? I am emotionally charged by

:06:41. > :06:46.this but I don't think they are, ?200 and six points to some people

:06:47. > :06:49.as pocket money, so the idea of maybe raising the money and putting

:06:50. > :06:53.them through a diving we are we on this course where they see the

:06:54. > :06:57.impact using a mobile phone can have. We do it with drinking and

:06:58. > :07:03.drugs so why not mobile phones as well? How do you think we should go

:07:04. > :07:08.about changing this culture? The key behind it is education and to start

:07:09. > :07:11.at school, those who are due to a couple of years' time and have the

:07:12. > :07:15.younger generation are weird of the impact using their phones can have

:07:16. > :07:22.and hopefully that will then rub off on older generations. What is your

:07:23. > :07:27.simple message to drivers? Do not pick up the fallen and if it brings,

:07:28. > :07:32.leave it, and it will be there at the end of the journey. You might

:07:33. > :07:34.not make it otherwise and others might not either.

:07:41. > :07:44.Meg's partner, Gavin, died on the A34.

:07:45. > :07:47.The road, which runs from Winchester up into the Thames Valley,

:07:48. > :07:51.seems to have more than its fair share of headlines

:07:52. > :08:00.And is it the fault of the design or the motorists?

:08:01. > :08:02.Our reporter Joe Campbell is near the A34, near Chieveley,

:08:03. > :08:15.As one of the team I am more than familiar with this would both from a

:08:16. > :08:19.motorist and from standing alongside reporting on crashes which have cost

:08:20. > :08:24.lives and change the lives of survivors forever, but is it a

:08:25. > :08:28.dangerous road? The BBC commissioned a team of experts to crunch the

:08:29. > :08:29.numbers and other transport correspondence reports on what they

:08:30. > :08:32.found. Who could forget the terrible crash

:08:33. > :08:35.last year that claimed the lives Tomasz Kroker was choosing music

:08:36. > :08:39.on his mobile phone instead His lorry ploughed

:08:40. > :08:42.into a queue of traffic. A car was crushed to

:08:43. > :08:48.a third of its size. Along with her sons Ethan,

:08:49. > :08:55.who was 13, and 11-year-old Joshua, and her partner's daughter,

:08:56. > :08:59.Amy Goldsmith, who was 11. In the last five years the road has

:09:00. > :09:04.been closed 56 times due to accidents in which people have

:09:05. > :09:09.been injured or killed. So is this road

:09:10. > :09:21.unusually dangerous? There have been a number of

:09:22. > :09:27.high-profile collisions on this road but when we look at the collision

:09:28. > :09:28.rate compared to roads of a more size we find it has a relatively

:09:29. > :09:30.good safety record. Research carried out for BBC South

:09:31. > :09:33.paints a picture of the A34. Over the last ten years,

:09:34. > :09:35.the number of crashes Broadly in line with

:09:36. > :09:39.the national trend. Some parts of the route

:09:40. > :09:43.are higher risk than others. The northern and southern

:09:44. > :09:46.ends are worst. There are different ways

:09:47. > :09:54.of measuring road safety. But the crash rate here on the A34

:09:55. > :09:57.is around one third less than the national average for this

:09:58. > :10:00.type of road. Let's compare it with similar

:10:01. > :10:04.roads in this region. The A34 is much worse

:10:05. > :10:10.than the A303 in Wiltshire. But it is safer than both the A3

:10:11. > :10:16.in Surrey and the A31 in Hampshire. The crashes here are mostly

:10:17. > :10:20.due to driver error. Not to the design of the road

:10:21. > :10:35.or the number of vehicles. There is an issue on this road with

:10:36. > :10:39.the variance of speed. When you have vehicles travelling at different

:10:40. > :10:42.speeds the risk increases significantly so it may be that

:10:43. > :10:45.smoothing traffic speed and increasing the amount of space

:10:46. > :10:46.between vehicles would be a significant step.

:10:47. > :10:48.Here, just over one vehicle in ten is a lorry.

:10:49. > :10:50.So we looked specifically at crashes involving heavy goods vehicles.

:10:51. > :10:53.Over the last ten years the rate has fluctuated.

:10:54. > :11:00.And it's ahead of the national average.

:11:01. > :11:05.The A34 has seen some truly horrendous crashes.

:11:06. > :11:07.But putting all the statistics together, we've found no evidence

:11:08. > :11:26.that it's significantly more dangerous than other roads.

:11:27. > :11:32.Those are the statistics but one thing is clear, those who are less

:11:33. > :11:36.alongside the road are unlikely to be changed in their conviction that

:11:37. > :11:42.something has to change, and to give you a personal perspective, coming

:11:43. > :11:45.here I had to brake sharply on two occasions when Lawrie spilled out

:11:46. > :11:51.with little or no warning. A case of bad driving or that when you have

:11:52. > :11:52.fast moving traffic and slow-moving the there is always the potential

:11:53. > :11:54.for the conflict. Thank you. And I'll be presenting a live

:11:55. > :11:56.debate on the subject, with three of our local radio

:11:57. > :11:58.stations, tomorrow morning, from the village of East

:11:59. > :12:05.Ilsley, in Berkshire. A care worker has gone on trial

:12:06. > :12:07.accused of stealing money from a 74-year-old man on a visit

:12:08. > :12:10.to his home at Littlehampton, At Chichester Crown Court,

:12:11. > :12:13.39-year-old Theresa Stratton is accused of theft from widower

:12:14. > :12:16.David Skerritt, who had Parkinson's The jury was played CCTV footage

:12:17. > :12:19.which the prosecution says shows Miss Stratton taking money

:13:07. > :13:09.Stephen Mallon was fatally injured after being attacked by armed locals

:13:10. > :13:13.and pushed from a 16 foot ledge. Today, at an inquest,

:13:14. > :13:16.his family were told they are now free to bury Stephen's body -

:13:17. > :13:36.eight years after he died. A quiet Spanish village and an

:13:37. > :13:37.unlikely scene for the most violent of unprovoked attacks.

:13:38. > :13:41.Stephen Mallon and his two sons were set upon by 30 men armed

:13:42. > :13:43.with knuckle dusters, iron bars, belts and bottles.

:13:44. > :13:46.A night in Spain, that ensured this family woud never be the same.

:13:47. > :13:55.When they came out of that Barbie were surrounded and cornered in. An

:13:56. > :14:00.armed mob waiting for them, two young lads with their dad and then

:14:01. > :14:06.being chased through those cobbled streets and being trapped, it is

:14:07. > :14:10.horrific. Spanish courts took five years to imprison just one man. He

:14:11. > :14:11.served five years for the equivalent of manslaughter and has been

:14:12. > :14:13.released. Long before Stephen's body was been

:14:14. > :14:21.released from Bournemouth Mortuary. It really is like a living nightmare

:14:22. > :14:28.and we got so used to Stephen being in the mortuary and it seemed really

:14:29. > :14:32.quite normal to us, which is really weird because it is abnormal. We

:14:33. > :14:37.cannot go up and stand outside the mortuary door, we have nowhere to go

:14:38. > :14:41.and we cannot go to a grave only garden of remembrance. Just awful.

:14:42. > :14:43.Stephen's two sons Peter and Carl have both been psychologically

:14:44. > :14:48.scarred and diagnosed with Post Traumatic Stress.

:14:49. > :14:57.He dry fighting for his life and for our lives and we wouldn't be here

:14:58. > :15:01.without him. It is unfair, the amount of people that attacked us,

:15:02. > :15:10.just too much. It went on for too long. He didn't deserve to be left

:15:11. > :15:13.like that in the mortuary. Since 2014 the delay has been caused by an

:15:14. > :15:13.appeal process and the lack of legal aid.

:15:14. > :15:18.The Mallon Family have criticised Dorset Cornoer's Office for a lack

:15:19. > :15:20.of a communication - having made little or no contact.

:15:21. > :15:22.Today's Coroner Rachel Griffin apologised for the delays

:15:23. > :15:24.but in a statement blamed the Spanish judicial system -

:15:25. > :15:26.adding it was something beyond their control.

:15:27. > :15:29.A concusion of "Unlawful Killing" was heard.

:15:30. > :15:36.Stephen's funeral has now been scheduled for later this week.

:15:37. > :15:46.He would be so heartbroken to see really what his family has had to go

:15:47. > :15:52.through these past seven years. He would just want his children to

:15:53. > :15:56.recover and move forward from this. He was always laughing and joking,

:15:57. > :16:09.always smiling. He was just a lovely man.
