:00:21. > :00:24.with the Plymouth-based 42 Commando, shot the insurgent in 2011

:00:25. > :00:30.He'd hoped to be out for Christmas but as Clinton Rogers reports

:00:31. > :00:32.the Court Martial Appeal Court in London decided he

:00:33. > :00:42.Surrounded by vocal support, Alexander Blackman's wife walked

:00:43. > :00:46.in to the Court of Appeal with high hopes her husband might

:00:47. > :00:49.Two hours later she emerged disappointed but still hopeful

:00:50. > :00:56.We must remember that earlier this month the Criminal

:00:57. > :01:02.to the Appeal Courts and this is the most important step

:01:03. > :01:09.to getting the conviction and sentence overturned.

:01:10. > :01:12.Blackman's legal team had applied for bail pending that hearing,

:01:13. > :01:15.which could be as soon as late January.

:01:16. > :01:18.But we now know that until it's heard the former

:01:19. > :01:22.will stay in Erlestoke Prison in Wiltshire.

:01:23. > :01:25.An MP who has been part of the campaign of support

:01:26. > :01:28.for Marine A and has visited him several times

:01:29. > :01:36.He will go to bed tonight not an entirely happy man,

:01:37. > :01:41.but at least he knows a few weeks' time this could be all over

:01:42. > :01:44.We have to take the emotion out I think.

:01:45. > :01:47.A former Royal Marine colonel told me this afternoon that

:01:48. > :01:49.unquestionably Blackman had made a mistake in shooting dead

:01:50. > :01:51.the wounded Taliban insurgent, but others may need to take some

:01:52. > :01:57.Yes, he has failed, but I think to an extent the system has failed.

:01:58. > :02:02.Did he know exactly what you could and couldn't do

:02:03. > :02:07.there's a failure in the system because we should have

:02:08. > :02:11.made sure that he did, and if he was under stress,

:02:12. > :02:15.as some of the reports suggest, then the system I think should have

:02:16. > :02:18.picked him up and supported him before.

:02:19. > :02:20.So Claire Blackman will spend another Christmas

:02:21. > :02:24.without her husband but there are hopes that 2017 could produce

:02:25. > :02:35.Former Royal Marine, Lord Bennett, who's based in Devon has been

:02:36. > :02:37.following Sergeant Blackman's case and has been talking

:02:38. > :02:43.I spoke to him earlier and he says they remain optimistic,

:02:44. > :02:54.He's been an exemplary prisoner, but apparently that's not the score.

:02:55. > :02:57.The important point apparently is that there hasn't been precedent

:02:58. > :03:00.in a case like this for bail and the judges have

:03:01. > :03:04.I mean Alexander Blackman and his wife, his loyal

:03:05. > :03:08.and courageous wife, must be bitterly disappointed

:03:09. > :03:12.but every cloud has a silver lining and the Lord Chief Justice who gave

:03:13. > :03:16.the judgment on the bail hearing has said that he will hear the case,

:03:17. > :03:20.expedite the case, and hear it in just over a month's time.

:03:21. > :03:22.So are you confident on bail his murder conviction

:03:23. > :03:28.Yes, I am absolutely confident of that.

:03:29. > :03:33.They have three independent psychiatric reports,

:03:34. > :03:36.three different psychiatrists have said that Alexander Blackman must

:03:37. > :03:43.have been under the most immense and intense pressure.

:03:44. > :03:45.No one who hasn't actually been on a battlefield

:03:46. > :03:50.knows what this entails, what fighting like that entails.

:03:51. > :03:54.Six 6-month tours that man had in eight years.

:03:55. > :03:57.No one is complaining, that is what the Royal Marines

:03:58. > :03:59.are for, they are fighting troops, our elite fighting troops,

:04:00. > :04:01.probably the elite fighting troops of the world.

:04:02. > :04:05.I've visited him in prison and I know him.

:04:06. > :04:10.At worst it's manslaughter and if it had been manslaughter he would have

:04:11. > :04:13.got three years reduced to 18 months.

:04:14. > :04:15.Why do you think all this didn't come out at the time

:04:16. > :04:19.That is a very good question and obviously there are going

:04:20. > :04:23.to have to be questions made and asked of his initial legal team.

:04:24. > :04:27.I'll say no more about that but I suspect that is the case.

:04:28. > :04:36.Two men have been jailed for the murder of a pensioner in Cornwall.
