our children or educate our children or anything like that and the named | :01:51. | :01:54. | |
person has different views then who gets the final say? Is it the named | :01:55. | :02:01. | |
person or the parent? The legislation was passed in February | :02:02. | :02:05. | |
for every young person from birth to the age of 18 to have a named person | :02:06. | :02:09. | |
like a teacher or health visitor to look after their welfare. The reason | :02:10. | :02:14. | |
why this family and other campaigners have come here today is | :02:15. | :02:18. | |
because they believe the named person scheme goes against the | :02:19. | :02:21. | |
European Convention of human rights and will diminish their role as | :02:22. | :02:25. | |
parents and their rights to a private family life. The Scottish | :02:26. | :02:30. | |
Government says nothing in the legislation changes parental rights | :02:31. | :02:34. | |
and responsibilities and that the policy is already operating | :02:35. | :02:38. | |
successfully in a number of areas across Scotland. Highland Council | :02:39. | :02:43. | |
has piloted a system in the last four years. One example would be a | :02:44. | :02:47. | |
mother who was worried about the behaviour of her three or | :02:48. | :02:50. | |
four-year-old and she was starting to worry that the child was being | :02:51. | :02:54. | |
labelled as a bad child. She went to see the health visitor who, as the | :02:55. | :03:01. | |
named person, with the consent of the mother, was able to talk to | :03:02. | :03:04. | |
specialists and we got a diagnosis that there was a hearing impairment. | :03:05. | :03:09. | |
The Scottish Government are confident the legislation is | :03:10. | :03:12. | |
complying with the European Convention on human rights and the | :03:13. | :03:15. | |
scheme will start in 2016. The question now is whether the court | :03:16. | :03:19. | |
will grant a judicial review. The former Rangers owner | :03:20. | :03:26. | |
Sir David Murray has won Her Majesty's Revenue and Customs | :03:27. | :03:28. | |
has lost it's appeal against an earlier decision that | :03:29. | :03:32. | |
the Murray group of companies was not liable for | :03:33. | :03:34. | |
a multi million pound tax bill for Our reporter Richard | :03:35. | :03:37. | |

the background to this case. HMRC claimed tax was due on the | :03:43. | :03:53. | |
benefit trusts which was a scheme where money was paid into | :03:54. | :03:57. | |
independent trusts as part of a bonus scheme and employees could | :03:58. | :04:00. | |
draw the money down in the form of loans. It was a very high profile | :04:01. | :04:05. | |
case because Rangers were part of the group at that time and leading | :04:06. | :04:09. | |
players and directors benefited from the scheme and a number of English | :04:10. | :04:15. | |
football clubs use these as well. In November 2012 the first tribunal | :04:16. | :04:21. | |
ruled that tax was not due on these schemes and the HMRC immediately | :04:22. | :04:25. | |
appealed that ends today another tribunal has dismissed that appeal. | :04:26. | :04:28. | |
They have essentially endorsed the ruling that no tax was due. | :04:29. | :04:35. | |
Is there any reaction? De Mari group released a statement that | :04:36. | :04:37. | |
essentially expresses satisfaction with the judgement. | :04:38. | :04:53. | |
HMRC have yet to release a statement but we know that they will die just | :04:54. | :04:59. | |
